Good evening once again, im stephanie ruhle. It is just 249 days until the election. And there is one word to sum up this last week, delay. Delay of the Criminal Court Case against donald trump. Delay as Congress Kicks the can again to fund the government. And delay on taking real action to fix our southern border. So lets get smarter and bring in our nightcap. Lets start with the many, many, many cases against donald trump. John, i turn to you first. The Supreme Court is now going to take up this immunity case for trump. Yes. Which no matter how they decide, they are getting more delays. Right . Yes. Delay, delay, delay. Has already won one given where we are . No. What . Watch his best offense has been slow play this and thats exactly whats happening. These delays will all be forgotten. There is no way he wins this race with parma. Look, the Supreme Court, i have to, say im convinced, theyre the best court money could buy. Seriously. Bribed back better. Bribed back better. Hes gonna get everything he wants from them. When you look at this court, delaying, this trying as hard as they can and i have no problem with this case. This Election Interference Case is the biggest case in the history of this country. I mean, 220 odd years of peaceful transfer of power until this. Its huge. If it starts right before the election, im fine with that. Im fine with voting during a commercial break. But people have got to look at this and realize how rigged this is. And these six justices, youve got two of them appointed by george w. Bush with the majority of americans voted against when you got to the white house. Three of them appointed by donald trump with the majority of americans voted against twice. And the sixth, clarence thomas, by george h. W. Bush who oppose this 64 civil rights act. Americans dont choose the justices who choose our laws for us. And thats highlights that. Dang. Danny, can we talk about what the Supreme Court is looking at . They could make a decision that says, a u. S. Citizen can operate above the law with no consequence. If they do side with donald trump, where does that leave us . It would be monumental. On the one hand, the mere fact that they are taking this case up speaks volumes because the very easily couldve, and many people predicted they might just say, look, the District Court issued an opinion, it was well reasoned. The d. C. Circuit court of appeals issued a well reasoned opinion. Theres not a whole lot of debate here. Everybody seems to be an abuse agreement. They couldve denied the request even hear the case in the first place. But you are absolutely right and that the real goal here, and its strange because none of the lawyers will put on the papers and the judges dont really talk about it, but the unspoken mission here is delay and avoidance of delay. And i will say this, stuff, in 2023, i was saying some of these trials will not start until 2025. And, john, everybody laughed at me. And now here we are. Here we are all these former federal prosecutors who are much smarter than me, there were on here saying, no way. And they are right in a sense. In federal court, federal court moves very quickly. In a ordinary case, you could expect to go on trial very quickly. Bush v. Gore is a great example of the Supreme Court moving quickly when it wants to, john. Youre exactly right. But with these cases, knowing that there would be such monumental legal issues, president ial immunity is, just one of many that this case would take a long time. All four criminal cases would take a long time. And i couldnt point to any specific thing is to say that things happen. Or in latin, think this happiness its a legal principle. Things have happened and here we are. This happened, delay is happening. We should be that surprised. And i stand by what is it in 2023, some of these trends arent Going Forward until 2025. Save the tape, but dont save the tape. Just remember i said tonight and thats it. Dan, a lot of democrats are furious, theyre no panicked about it. But do you really think is voters out there that are actually saying, i think hes guilty. I think hes corrupt, i think maybe he was involved in Election Interference. However, i need a Court Decision to help me to decide how i am going to vote. I am not familiar with any of those voters. How about you . Im not either. And i think don trump has kind of embrace this. When you think of his tactics over the last, call it years since the cases have been bubbling up. Hes happy to sit in a courtroom, hes happy to walk outside the courtroom until the narrative that he wants. All our cameras are there. We dont get to his rallies, we go to court. Listen, aside from this fact, e. Jean carroll that many, i think that really freaked him out. Hes gotta put a bond up or whatever, however that victim out. That pitch to the core of who he is and we will see how that plays out over the time. But these are the ones, obviously the one in d. C. , thats the one that sends him to jail. The other stuff is kind of like, its going on in florida is a bit of a sideshow, whats going on in new york is a bit of a sideshow. And a lot of folks said, lets focus on the really important one to johns point, the one that really is actually 200 of years of History In The Making and might be in the next hundred years how we operate in our democracy. Again, i will side with you, sadly, 2025. Hold on dont they want us to believe that the hush money case is a sideshow . It sounds like it, right . Youre paying off a porn star. But the reason Stormy Daniels was paid off to withhold information, not from Donald Trumps wife but from the american voter. Someones already going to prison for it. Its not a sideshow, donald trump is an unindicted coconspirator, and a lot of guys outrage now had no outrage when Michael Cohen did the time for the exact same crime. And i think the important part here is that we have to make sure hes being held accountable. For everything that hes done. I agree that the majority of voters are probably not weeding through all the legalese that is now going to be extended for another several weeks and months. There will be more motivated about the ivf decision in alabama than they will be likely but this. However, holding him accountable so that future president s can do exactly what hes doing is incredibly important. And also at this point, it strikes me as ironic and problematic that the folks who were out there on january 6th, many of them had been indicted and sent to prison. Yet, donald trump is still out. The ringleaders have not been tried and convicted but all of this socalled footsoldiers have been. I have no sympathy for them. But it really does go to show you the difference in how he acts in the privilege that he has versus all the folks that he sends out to do his dirty work. That has made especially true when he was in front of a crowd and talks about how African Americans should completely understand the position that he isnt because hes being persecuted in a way that [inaudible] is being persecuted. If nothing else shows you how different that circumstances, its today. Because he, because of everything you said about who was appointed the Supreme Court justices, he knows exactly what hes doing, he knows exactly how to play the system. And hes doing it in front of our face. So whoever youll never say that to the black voters. Its passed the black voters. The objectification of us. So if theres no other example of just how rigged this system is how rigged the system is, and how much he is rigging it, is what we are seeing unfold right now. Do you think you will be held accountable in georgia . I do remember the last time we were talking about Election Interference on his part or the 20 odd other codefendants for weeks now. It is all about when fani willis and a fellow prosecutor potentially started dating. The final day of the hearing was today. We havent talked about trump in weeks. A month ago if you asked me what the georgia case meant to trump, id say a real threat. I always thought the federal cases are real legal threat because 90 of federal cases and up in a guilty threat. But now, im not so sure. I think the law on the hole is on the side of georgia prosecutors. I think they end up avoiding being disqualified. But that doesnt mean that the case hasnt been fatally injured. There are many ill give you several reasons. How does it affect the r. I. C. O. Charges . How does it affect the recultureds . Let me say this, it doesnt affect the substantive charges one iota. If youre talking about does it affect whether or not the defendants are guilty or not guilty, it doesnt. And never has. But practically speaking, this case, this motion, could be the end of the georgia prosecution. Let me game it out for you. For example oh my fanduel isnt a fun way are disqualified. Fani willis. She is the arctic type of this case. Whos gonna take it up . Then theyre gonna have to find prosecutors interested in taking this long and a judge chooses. It is going to be the Republican Attorney general in georgia . I think not. Now you have a political reason why this case dies a slow death. Or, for example, maybe it just hangs in limbo while they find someone to take on the case. Youre telling me the kraken lady the effect from nothing, is that what youre saying . Exactly right. Some of the defendants are wondering why did we flip so early. Some defendants have pleaded guilty in the georgia case. Let me tell, you the laws on the prosecutors side. The facts are on the defensive side. Because the facts are salacious. But, heres the theory. And it either flies or doesnt. The theory is that the prosecutors were corrupt. Because she, fani willis, had a relationship that predated the appointment of nathan wade. She pointed nathan wade because he was her boyfriend, and therefore, the money that went to nathan wade, which came back to her in the form of vacations, constitutes not necessarily an actual conflict, but the appearance of impropriety. And that was a major argument today. The Legal Standard to be applied. They dont even know because this is never come up in this context. So they dont know what Legal Standard will actually apply. Its all up to judge mcafee and ultimately, youre right. Does it affect the substantive guilt or not guilty of the defendants . No. But, is it a real problem to this prosecution . Yes. This is why i do worry about what the voters are thinking and how they are interpreting all of this, right . Because its incumbent upon us, in the party, to actually get them to follow this in a way that we are all doing to understand what donald trump is doing, that his goal really was to embarrass them, right . To take them in some way, shape, or form. Theyre waiting for an outcome. Theyre waiting for an outcome. But in the meantime, sheamus, ruby freeman. Have stood in front of the dragon. And stood up for democracy. Ruby freeman saying she cant even use her name anymore. You know . Those are two patriots and john, the other thing is, what youre one of those two other prosecutors, you are simply feeling like, come on, we needed to be flawless. We are going up against a six headed monster in donald trump. That he is using every dirty trick in the book. And im not saying both sides need to be equal, but in order to take this beast down, you need to be flawless. And the fact that there was this issue, even if its salacious, even if its a sideshow, there is a very good chance they are feeling like, are you kidding me . This is im not saying its a federal crime, but they could feel like this is an unforced error of the most consequential, one of the most consequential at least for these prosecutors that they were going to work on. Of course, and i dont see how fani williss relationship erases a tape of cheating and committing fraud in the election. Of course, she is a woman. And that terrifies him. Two things donald trump is afraid of, a strong woman and a strong wind. I dont actually see how this is necessarily in the gate in after the disastrous testimony of some of the witnesses earlier in the week. Its not only about taking him down, its about serving the law and punishing those who are guilty. Theyre still gonna be a lot of time left in this case. And again, i think alvin bragg is going to be a huge case, and i think the florida case where the documents is just getting warmed up. But jack smiths the big one.
