>> well, a couple things. number one he's about as old as i am and he can't remember his wife's name. >> that was president biden last night on late night with seth myers. today the president could face a sizable protest vote in michigan's primary. we'll go through that straight ahead. meanwhile, the president is optimistic that a cease-fire in gaza could happen in a matter of days. we'll bring you the very latest on the negotiations between israel and hamas. and that comes as congressional leaders are set to meet with biden today at the white house in hopes of hammering out a deal to avoid a government shutdown. good morning and welcome to "way too early" on this tuesday, february 27th. i'm jonathan lemire. thanks for starting your day with us. and we'll begin this morning with a presidential primary election in michigan that's being held today. president biden is expected to easily defeat his only real challenger, congressman dean philips of minnesota. but his biggest challenge is likely to come from the state's large arab american population. we'll explain that in just a moment. meanwhile, the republican primary is much more complicated. today's results will determine only 16 of michigan's 55 delegates. the other 39 will be decided saturday during a state party convention. but there will be competing conventions this weekend because of a leadership dispute within the michigan state gop. christina, an election denier and donald trump supporter, was removed as chairwoman last month following a vote by state party committee members. she has refused to accept the results and still claims to be the state party leader. earlier this nupt the republican national committee recognized a man who was endorsed by trump as the actual state party chairman. he'll oversee a convention in grand rapids while karamo is holding her gathering in detroit, deeply confusing. biden campaign cochair gretchen whitmer acknowledged a large portion of the electorate will not vote for biden protest his handling of the israel-hamas war. >> i think there will be a sizable number of votes committedch. i think it is very person's right to make their statement what is important to them. >> the uncommitted organizers have said they want to get at least 10,000 votes. do you think they'll reach that? >> i think that's possible, yeah. >> president biden has seen significant backlash in the state from his arab american and muslim american population as well as some young progressive voters. we should note governor whitmer will join us later this morning on "morning joe." joining us now white house reporter for "the wall street journal" subriana siddiqui. good to see you again this morning. the president faced a protest vote in new hampshire. some people were encouraged to right in a cease-fire instead of the president's name and that amounts to nothing. today feels much more sizable. give us the lay of the land. what should we and president biden expect in michigan today? >> thanks for having me. well, i think first and foremost president biden will comfortably win the michigan primary. there's no question about that since he's facing minimal opposition. but as you point out there is this effort to get voters to cast their ballots as uncommitted. and michigan is the state with the highest and number and percentage of arab americans in the country. and those who have been frustrated by president biden's handling of the israel-hamas war and specifically the humanitarian crisis in gaza is using this as an opportunity to really warn the president he does not currently have their vote. and barring a significant change in policy, they are likely to either vote third party or stay at home in november. it's not they're planning to vote for former president trump. but i think the margeern this group -- this effort is looking toward is having at least 10,000 uncommitted votes. that was trump's margin of victory in 2016. now president biden won by roughly 154,000 votes in 2020. but i think the message is still if this is a close election, then that margin of victory or that margin of 10,000 could actually make a difference. if thought they could potentially secure more uncommitted votes and it is a warning sign to president biden and the white house that they need to change course in their handling of the war and do a lot more to try and reassure this community and reaffirm their support with the community in the past elections has predominantly voted with democrats. >> it could be a real warning to president biden and potentially humbling if those numbers are sizable. sabrina, let's take the other side of this then. what does the president and his campaign staff -- how are they going to address this in the aftermath of today's election? how do they reach out to the community, and how do they hope to repair things by november? >> it's been a bit of a problem because last month the biden campaign dispatched its campaign manager to meet with some local arab american leaders and the biden campaign manager was rebuffed by many local officials. in recent weeks you actually saw some top foreign policy national security officials from the biden administration sit down and have a consideration. now, the biggest problem isn't that these voters are not looking for a shift in tone. they're looking for a shift in policy. so what i often have heard from them is they don't want to talk about the politics. they don't want to talk about, you know, thou hoir going to vote in nchb so much as what is the president going to do to what -- to bring about what they want, which is a permanent cease-fire in this war as well as, you know, the u.s. no longer sending military aid to israel, at least in the course of this conflict. and that's something that this administration is not really prepare to do. the president is pushing for a temporary cease-fire and last night he said he hopes there'll be one by monday, but we're not expecting a significant shift in the u.s. support for israel in this -- in this war and so, you know, what the lasting impact of that is going to be with this community is still untold. again, i think the biden campaign is trying to draw contrast with former president trump, a lot of his inflammatory rhetoric and policies towards muslim and arab americans but it's not clear drawing that contrast is going to be enough when these voters are i think really frustrated by and disappointed with president biden's posture especially as the death toll in gaza has neared 30,000 people most of whom are civilians. >> you make a great point here. the president has hopes of a cease-fire coming, and certainly those around his re-election bid hope the war in gaza will fade from the headlines in november. but will this population of michigan and other places friv and move on and come back to the president sphthat's the open question. terrific stuff to start us off this morning. sabrina, thank you. we'll talk to you again soon. >> meanwhile, president biden and former president trump are both expected to visit the southern border on the same day. this thursday. in a statement yesterday the white house announced biden's trip to brownsville, texas, where he will, quote, reiterate his calls for congressional republican tuesday top paying politics and provide the funding needed for the border. meanwhile, about 300 or so miles away in eagle pass, texas, donald trump is also planning to deliver remarks. that's according to two sources telling nbc news. speaking to reporters after filming his appearance with seth myers yesterday, biden briefly commented on the competing trip with trump. >> will you meet with migrants while you're there, mr. president? >> hey, jonathan, good morning, yeah. that big high stakes meeting today at the white house with president biden before congressional leaders that's beginning at 11:30 in the oval office. and you asked the key question what are we actually expecting out of this meeting? i don't think the expectation should be too high for too much progress. look, this has been going on on capitol hill behind the scenes. the negotiations for these full-year government funding bills. and negotiators and congressional leaders had hoped they'd be able to rollout those bills this weekend, but senate majority leader chuck schumer on sunday telling colleagues they did not yet reach a deal because of these house republican demands. we've been seeing for months hard line conservatives in the gop conference have been demanding controversial policy writers on hop on issues like abortion, transgender matters and a litany of other issues. we're now seeing conservatives hold the line. there were a number of hard liners yesterday and in recent days saying they'd be willing to shutdown the government over this matter. the chairman of the house freedom caucus going as far to say a shutdown is not ideal but not the worst thing. that gives you the dynamics where things stand right now. speaker johnson has a big decision to make. strike a deal with democrats other other republican who want to govern and keep the government open, but of course that begs the question of is his job safe. >> let's spend time there on speaker johnson who has frankly struggled in his new post, having trouble getting basic bills passed and as you laid out well, faces a real dilemma on his future. what's the latest you heard with republicans what johnson might do? how safe is his job? >> jonathan lsh let's set the scene and give context. this is the third time he's up in the funding dead line and has to make a decision of shutdown or a deal with the democrats. the two previous times johnson was in the predicament he ended up cutting a deal with democrats to pass a continuing resolution and buy more time to finish out these full year negotiation. he's now faced with that same question, but hard liners are really throwing down the gauntlet and digging in their heels. and they're frustrated with speaker johnson. like i said the two previous times he was in had situation, he turned on them, struck that deal with democrats. republicans really this as one of the last opportunities they can flex their muscles and use leverage to their advantage to try to force some policy concessions. now, if johnson doesn't go down that path and ends up striking a deal with democrats to keep the government open, that then begs the question how safe is johnson's gavel? we all remember that speaker fight in october after mccarthy's ouster. it was messy and not a great look for republicans, so there's a big question are they're willing to go back down that path? if speaker johnson does go ahead and strike a deal with democrats to keep the government open, there's going to be a lot of angry conservatives, and there's going to be a lot of speculation about his job security. >> that is safe to say. i also think a safe bet if government were to shutdown in an election mind you, republicans will take the blame, not president biden. next up here we'll go live to cnbc for a look at morning's top business headlines including a look at the newest addition to the dow jones. you're watching "way too early." we'll be right back. [ passing wind ] welcome back. donald trump and some top executives at his company are now officially appealing their $464 million civil fraud case. lawyers for trump filed a notice of appeal yesterday challenging judge arthur engoron's finding that the former president lied about his welt as he grew his real estate empire. writing in court documents, trump's attorney asked the state's appeals court to decide whether the judge committed errors of law and/or fact, and whether he abused his discretion and acted in excess of his jurisdiction. it's unclear how trump would pay the judgment and the roughly $100,000 a day in interest, an amount that will simply grow until it's paid. it's likely the appeals proceedings can last a year or more. meanwhile prosecutors in trump's hush money case are asking the judge to impose a partial gag order on the former president ahead of next month's criminal trial. the manhattan d.a.'s office is looking to bar trump from making or directing others to make public statements about potential witnesses, jurors, court staffers, and members of d.a. alvin bragg's legal team. the d.a. cited trump's, quote, long history of making public and inflammatory remarks about the participants in various judicial proceedings against him. wave also learned trump's legal team is hoping to block key witnesses from testifying including his former fixer, michael cohen, and the two women he paid to stay quiet about affairs they alleged to have had with trump. adult film star, stormy daniels and former playboy model karen mcdougal. joining us here on set state attorney for palm beach county, dave aronberg. good to see you this morning. let's start there on this criminal trial. what is your assessment as to can trump's lawyers be kesful in blocking testimony from three witnesses, cohen, mcdougal, daniels, who are key to the case? >> not really. it's a criminal defense lawyer's dream to be able to say don't let them testify and don't harm our case too much. and they're saying michael cohen lied. he was convicted of lying to congress, put that's who prosecutors put up as witnesses because people who engage in crime hang out with other people who are not, you know, choir boys. and michael cohen i think has come forward and did the right thing, but he did lie. that doesn't mean he can't testify. it's for the jury to decide what kind of credibility he has, not for the judge to exclude the testimony all together. i think it's a pipe dream the lawyers are going to keep him out. >> do we think the d.a.'s request for a gag order will be appropriate and happen? >> jack smith won the day when he got a partial gag order. the d.c. court of appeals upheld it, plus he saw the disgusting messages salven bragg received when he started to throw verbal hand grenades at him. we should never have taken for granted or be numb to the fact the leading candidate for president on the republican side poses a real danger through his words on potential jurors, the witnesses, the judges, and prosecutors. >> so let's shift to the appeal trump's attorneys have filed on the civil fraud judgment. big number. what's your sense as to the possibility of success for them? and will trump still have to pay while the appeal is being heard? >> he's got to post a bond -- >> when does he have to do that? >> well, it's 30 days after the judgment. so the clock is running, and it's going to be tough for him because i don't know how liquid he is. he also has to pay the bond to appeal the e. jean carroll judgment. so it's going to be tough for him. plus i don't think he has the likelihood getting the verdict overturned. judge engoron was pretty thorough in his decision. in the end it was donald trump who inflated the size of his own apartment three fold. that's not a rounding error. you know, that's not harmless puffing, that's fraud. >> yeah, state attorney general letitia james suggested perhaps if needed if trump can't pay some of the his assets including property could be seized in order for him to make good. dave, there's just so much each and every it seems like on the trump legal front. and we're expected to get developments in the fulton county case today, the fulton county case. they're going back to court. >> this is big day there. terence bradley, who was nathan wade's former diverse lawyer has said he cannot testify of a lot of their details of their relationship because of attorney-client privilege. well, judge mcafee there in fulton county said, no, the privilege does not block you from testifying any longer. you need to take the stand again and come clean. and boy, that could mean some bombshells. we'll see. today is a very big day in that trial, in that hearing. >> there's been some revelations since that may be damaging to her and maybe the future of that case. and lastly we know as just covered the new york hush money case is going to go to trial before the election. there's the other case trump is facing that could do the same would be the federal election interference case. there's a consensus georgia is probably next year, the classified documents case probably next year. it's this jack smith january 6th case. we're all waiting on the supreme court. what's your sense as to a time line there? [ applause ] think about that. if you're running for president, your job is to bring as many people to you as possible, not push people out. >> oh, yeah. >> right! >> that's what he is doing, pushing people away from the republican party. >> she's not wrong. that was former south carolina governor nikki haley in grand rapids yesterday, making a final pitch to michigan voters before today's primary in that state. joining us now, politics editor for bloomberg, laura davidson, who has been closely watching the race in michigan. let's start on the republican side. it is expected that donald trump will win again. but what is the sense as to the showing haley can have? is she going to get a similar number to, as she eluded to, where perhaps 30%, 40% of republicans will opt not to go with trump? >> you know, she has a less good advantage than she did in south carolina. that was her home state. she'd been advertising there significantly, and she had great name id. michigan's rules allow for an open primary, so, therefore, she could pick up moderates, independents, even democrats who choose to cross the party line. but, still, she's not expected to win. this race is really confusing because michigan not only has a primary today but a convention on saturday, and delegates are awarded at both the contests. this represents the fractured nature of the republican party. even on saturday, there are going to be two conventions because of fighting between the leadership there. in some ways, this is advantageous to haley. even if she doesn't win, she's able to point to this party that's fractures, divided, and, in some ways, is saying they don't necessarily all want donald trump to be president. >> that's certainly a good point here. that plays into her argument. she is commitment no matter what happens today to stay through at least next week, which is super tuesday and a host of states vote. what is her team saying as to how they think she can fair a week from now? >> they're not setting expectations that she will win or even poll ahead of donald trump. she's saying, look, there's 40% in new hampshire, in south carolina that want an alternative to trump. we're going to keep running. this advantages her. she is able to, as she keeps going through these primaries, pick up delegates, even if she's not winning. she gets, you know, a small fraction of them. if for any reason down the line donald trump for legal reasons, for health reasons, for something unforeseen, isn't able to run, it positions her as the heir apparent in the case. >> donald trump's first criminal trial starts in less than a month. i'm sure haley has that in mind, as well. certainly, though trump keeps racking up the wins, there are real warning signs for his general election campaign. let's shift to the democrats now. president biden also going to win today. there's no question there. but as we covered earlier in the show, there are some voters who are planning to protest his handling of the war in gaza by threatening to vote uncommitted. tell us your sense on the ground, what you've heard from michigan. how big of a number is that going to be? what message could it send? >> it's really not clear. it's about 70,000 arab-american voters in michigan. this is sort of the group that's sort of pushing this vote uncommitted for biden. there's some thoughts that internally, they're looking to get 10%, so roughly around 7,000 votes. obviously, there's a range of reasons, not just the gaza issue that could have democrats dissatisfied with biden. this is a bellwether for how biden and democrats could fair in michigan in the fall. michigan is a key swing state. biden has a complicated coalition he needs to pull together. he needs arab-americans, black voters, union households. right now, state polls show in a head-to-head matchup with trump, he is lagging. >> let's talk a little more about november which we will likely see biden and trump. in michigan, one of the most crucial battlegrounds on the map. trump, of course, won it in 2016. biden took it back for the democrats in 2020. it's hard to see a map for the president to re-election if he loses michigan. tell us more about the coalition and what the trump team is really targeting to try to win pack that state. >> the trump team is looking more at black voters than women. they've decided that suburban women aren't their best target, but they picked up a lot of support, at least initially in the polls of black voters showing that they're interested. remains to be seen whether that'll hold through november. michigan, wisconsin, and pennsylvania, the blue wall in the upper midwest, is something both biden and trump see as key to their path to victory and noted that biden won it in 2020, trump won it in 2016. that's why you see the president and trump both going to michigan frequently in their travel schedule. >> we certainly heard donald trump's, shall we say, unorthodox pitch to black voters over the weekend. hard to see how that'll help. we have complete coverage of the michigan primary all day on msnbc. politics editor for bloomberg, laura davison, thank you for joining us this morning. thanks for getting up "way too early" with us on this tuesday morning.
