about a likely expulsion, vote plus president biden's messaging tightrope, donald trump's legal fishing expedition at the word of the year for 2023. we have a lot to get to as the 11th hour gets underway on this monday night. greetings everyone, i'm simone townsend's town stand in for stephanie ruhle. tonight, another group of gaza hostages are released as israel and hamas agreed to extend a temporary pause in fighting. nearly a dozen women and children all from a single kibbutz where fried just hours ago, and are now in israel. this latest release comes after hamas freed other groups of hostages over the weekend. nbc's richard engel is in israel with more. >> reporter: with the deadline for a four-day drew -- truce about to expire, hamas released another batch of hostages from gaza tonight through the red cross. 11 more israeli women and children, all from the coutts of nero's, close to gaza, were freed after diplomacy led by qatar and egypt and more baby coming out. hamas and israel agreed to extend their troops to more days, at least. hamas says the same terms apply, three palestinian prisoners freed from israeli jails for every hostage along with other conditions including more aid into gaza. there were no americans in this group, only one has been at least in the cease-fire so far. abigail eaton, who turned four in gaza and, is now an orphan. both of her parents were killed by hamas during the corpse massacre of 1200 israelis. abigail was sheltered by neighbors until paper all kidnapped. abigail, who goes by -- has become a symbol of both tragedy and hope in israel. we met her ramp tonight. >> we are protecting her and a lot of love and care. it's what she needs right now. she's only four. she's been through hell. she needs quiet and to heal from everything she's been through. >> rotem celebrated her 13th birthday in israel hospital tonight. she was surrounded by a small group of friends, including emily hand, who was sleeping over at her house near cousin and was killed alongside her. her mother was not at the party, she remains in gaza, held by hamas. hello was freed on sunday and greeted by her uncle, yet your. he told me today, she seems to have disassociated herself from the trauma, like it happened with a stranger. >> you can with you she doesn't show much emotion? >> yeah. she speaks about it like it's a scene from a movie. she speaks about the facts that happened. >> despite the extended troops, it is still far too early to talk about a lasting cease-fire. israeli prime minister, netanyahu, visiting troops in gaza this weekend, says the military operation will continue until hamas is driven from power. >> tonight, we've also seen palestinian presidents released by israel, 33 were freed and are now in the west bank city of ramallah. agreed to extend the truce to relieve the suffering in gaza,. earlier today president biden noted in a statement that the united states is taking full advantage of the pause in fighting to increase the amount of humanitarian aid moving into gaza. this week, it absolutely can go back to israel, the west bank, and by. as this all unfolds, new reporting from the new york times says the president hopes to use this temporary pause to change the direction of the war, but the washington post reports biden's handling of the conflict has increased tensions within the white house. with that, let's bring in our lead off panel. nasa's, a co-anchor of -- nbc contributor. eugene daniels is white house correspondent for politico and playbook and he is the coauthor of playbook. my little boss or q is here, a global affairs analyst. senior fellow of the atlantic council, he's currently based in israel, but has just returned to the u.s.. emma, you know, we now have this two-day extension of the truce with the white house as hamas has made some commitments, specifically to release another 20 women and children over the next two days. how much does that still depend on negotiations and do you think we will see -- you have any reporting that's just we will see any americans in those numbers? >> so, we don't know who we will be seeing those numbers just yet. i think it's important -- all hostage negotiations are fraught and high risk. none more so than this, in the middle of an act of war when you are fighting a stopping to get the hostages released. so far, what we've seen over these now for exchanges that we have had unfold so far, basically confidence building measures. can both sides pull it off? so far, both sides have stuck to what they said they would do. israel has been releasing palestinians. they've been holding in their prisons. some have not been charged in many cases are still being held for months at a time or years at a time. hamas has continued to release mostly women and children. tonight's latest exchange of 11 hostages that they have released were all women and children, mostly children. nine of the 11 were children. all from this one kibbutz nir oz, which was incredibly hard hit on october 7th. one out of every four residents there is now believed to have been killed or kidnapped on that day. if history is a guide, as diplomatic negotiations continue, the last four exchanges have gone as planned. they hope the next two will also unfold as planned, next two days. the biden administration hopes that lays a foundation for continued cease-fires and continued negotiations. we should note that the prime minister says their goals remain the same, eliminate hamas, make sure this doesn't happen again and they want to get all the hostages released. >> eugene, again, we've only seen one american hostage relaced. four year old abigail, who is an orphan now, whose parents were killed on that horrific attack on october 7th. is the white house concerned that there may be an incentive for hamas to hold american hostages until some of the very last, if not through a different round of negotiations altogether? >> yeah. that's a big concern that they have, right? trying to figure at how to get more americans out before this and. if you're hamas, think about it. you see how excited president biden was with abigail. you saw hail the country has talked about it, how israel is excited about it. you're trying to figure out ways to be able to have this fighting. one of those would be to hold american hostages as long as possible. also saying, you do have to continue to show good faith, right? keeping all of the american hostages away at the last moment is not a dumb white house administration does all the time, they are going to realize that is happening, right? we will say, something has been really interesting throughout these negotiations is president biden has continued to use the stories of the hostages and their families to push netanyahu, qatar and egypt, to have these conversations and to make sure these things work out. he had an october 17th zoom call was some of the family members of hostages. berated him and talked about the pain that they're feeling, the anger that they were feeling and he used those conversations and his negotiations with netanyahu saying, these are the kinds of things that we need to fix. they are going to do when you to do that and he will continue to do that with the american hostages. >> you know, it feels to me that the white house seems to be vindicated in their strategy. they feel vindicated in their strategy because up the progress, if you, will that is being made and jake sullivan was on with our colleague, kristen welker, on sunday. essentially said just that. now, you new york times has reported that says that white house hopes to use this pause to, you, know push the israeli government to corral the military action, if you will. i guess, how much is the leverage is the president have at some 0. 1 could argue that it may run out. clear a for the last sever official go time an do everything mitigate civilian loss of life. we are asking them to act within the bounds of international law. the question we always put to them is, are they? they have not been able to publicly answer that. the biden administration's policy, this is been, clear publicly, they are standing firmly with israel after every step of the way. we know privately that they have been pushing officials and military leaders. the war cabinet in particular to do more, to stem the loss of civilian life. for seven weeks into this, where he, has 1200 israelis were killed. in the most brutal and horrific fashion on october 7th. since then, more than 13,000 palestinians have been killed. civilians, two thirds of them women and children as a result of the israeli response. this cease-fire is in some form, yes, a vindication for the white house, to be able to say, we can get a pause. we are able to stem the loss of life that has been unfolding. what happens next is the big question. >> eugene, along those lines, the washington post has reported and notes that this crisis, this war between israel and hamas has rocked the white house more than any other issue of biden's presidency yet. within that washington post reporting, it details a meeting that president biden had with some urban muslim americans and they push the president on his comments that he made about not believing the numbers from the gaza health authority or the palestinian health ministry coming out of the gaza strip and he, according to this reporting for -- nbc news hasn't cooperative that reporting, the president apologized. that is not something that we heard publicly from brighton officials. >> these kinds of meetings have been happening since, really, october 7th, right? you had jeff science, the chief of staff, done, fine, or the deputy of national security adviser, also meeting with a group of younger, more diverse folks that work in the white house to talk about these issues. what you are seeing here is something that is playing out in the democratic party at large. it is this conversation about how much do you fully support israel, don't say anything bad about israel, and at the same time, talk about what is happening with palestinians and at the context of this fuller conflict that has been happening for decades and decades. what you are seeing with younger folks is that they are completely okay and feel good about separating the actions of the government and the actions of the prime minister of israel from jewish people and the people in israel. that is not something that the older democrats have figured out how to navigate, to have this happening in the white house and the democratic party fully. a conversation that works. i will say this, all the campaign in the white house, they're very cognizant that that could impact the youth vote, that you see in 2024, that politically they have to figure out how to thread this needle as they move forward. one, they have to keep folks from resigning in the white house, which we have seen some of those resignations. also, figure out how they can thread the needle, do what they are doing and keep the relationships they have in israel in the middle east, but also figure out how to keep the youth vote. >> voters also in michigan and in the suburbs, uk -- and dearborn, it's subsistence lee and heavily arabi do tmichael, you were in the middle east>> t sec of mind is getting tther be jeoso, what i'm saying is the substantially in very much soi k weekend in vermont and rising in t college students, all palestinians. in burlington, ver visiting family thanksgiving. cannon abdul hami a walk, chatting in arab englishtwo of them were wearinge hoodie walked toward them and pulled out a pistol and started firing. without saying a word. all three were shot. >> they're all stable. hum, the prognosis is that he won't be able to walk again. >> reporter: his parents spoke at nbc news is maclachlan today in the west bank city of ramallah. >> it was a vicious crime. it will change my son's life. >> forever. >> there is no reason that he should have been targeted in this way. it was a targeted crime without a doubt. >> reporter: authorities have not charged eating with a hate crime. police say they are still investigating. hematomas father wanted to stay in the u.s. for the holidays because it would be safer than ramallah. >> who would think that something might happen in such a diverse place in the world? >> well if you think about why, it is because they needed some votes and they were concerned that any opportunity to push him out would result in a democrat winning that seat. guess what? a democrats probably going to win that seat no matter what. what it does say, and it's to another story, the rnc is low on cash. they are low on cash relative to this point in 2016 and 2020. one of the reasons given, a lot of the donors, big donors, are concerned that the party does not have its act together. if you wonder why, this is exhibit a. maybe mccarthy is exhibit a, and this is exhibit p, but they sort of go hand in hand, if you have a party that essentially coddled this individual, and kept him on board so he could they could get his votes they deserve all the negative attention that they are getting. having said that, we do expect that there is an expulsion to take place, he expects that. there are a lot of candidates waiting to run for the special election that would happen ten days, or call it ten days after it would happen. the gop, feels pretty strongly that they will be able to win that seat given how well they they did earlier on election day. we will see how that part of it goes. i do feel strongly that the democrats are going to win that seat. >> reporter: stuart, santos expulsion could make the republican majority even smaller, if republicans and long island do not capture the special election. do you think it'll impact how any of the members vote? i will note a number of republicans, and a number of democrats voted to not expel him in the first expulsion vote, but a number of votes have changed their tune. if the resolution comes to the floor, they will vote to expel him. >> you know, george santos to me, represents the logical conclusion of the collapse of the republican party as a governing party. he is a liar in a party that no longer believes in truth. he is a fraud in a party trying to perpetrate one of the greatest frauds ever, within a legal president. he is really in congress for no purpose. now pretty much sums up the republican party now, i think. why are they holding on to this guy for a vote, a vote to one purpose, what have they done in congress? absolutely nothing. and it really is just a party to exist to acquire power, perpetuate power for those who are in it. but to no other purpose, then power. that is a party that is not a traditional american party. it is more like a syndicate, or cartel. [laughter] i've worked against the democratic party for a long time, but i don't know what conclusion to come to you but it's the only pro democracy party in america now. >> reporter: what else can you say after that? let's talk a little bit about the senate, i want to play for you basil what chuck schumer said today, listen to this. >> before the year is out there is a lot of other work we must do here in the senate. members should be ready to stay here in washington, until all of our work is completed. we must, for wine, finish the task of passing an emergency supplemental bill for aid to ukraine, aid to israel, humanitarian assistance to civilians and gaza, and finding for the pacific. time is short. >> reporter: you know, we have not seen a lot of legislation come out of the house. the senate has been doing -- heavy seen either chamber staying into their recess to get this done, we're talking about christmas? >> i can see it perhaps in the senate, more so than the house, because i think chuck schumer is about the business of getting legislation passed, and policy enacted. i think it is particularly important when you think about the aid package to israel, and to ukraine. particularly on this issue of aid. in addition to the heartwarming video of the hostages coming and, being returned to their families, another really heartwarming video is of the trucks carrying aid into gaza after so long without it. if that could be argued, as part of why this package is important i do think it will necessitate them staying around to make sure that it gets done. i know that it comes at a cost, because there are a lot of voters that are wishing that this would not happen, in terms of the money for what we are doing abroad versus the money available for american citizens and voters. but, i believe, that chuck schumer really wants this to get done and will do everything to make sure the folks getting around to getting it done. >> reporter: republicans want to include border funding in these age aid packages. president biden sent to congress, it did encourage include border funding, funding for taiwan, funding for ukraine and israel, but the republican house only passed aid to israel. do you see, the border finding complicating things? the supply chain is something that every day americans, we can feel it when it takes a little longer to get our package or cost a little bit more. across the pond. >> i think it's a tremendously important to have the president out there, particularly right now. you turn on the tv and the news is dominated by what is happening in the middle east, i think for what is happening for so many americans as they are very worried about, very occupied about the cost of living, and their sense of economic security. it is important to talk about progress. in many ways, the president talked about the economy today, one we have seen progress, but we also have much more work to do. meets americans more of where they are than saying that we, are back in the economy is booming. it's hard to get people to feel what they don't feel, or see what they are not quite seeing yet. the president is not on the ballot this, year so he's got time for the economy to get better this year. as he explains, and talks about the economy it's important not to get ahead of where people are. it's important to talk about the progress being made. the roadmap is about the 2011 2012 -- then vice president will remember all too well, talking about progress but do not get ahead of where people are. >> reporter: i think that's a very important point robert. the fact is many americans feel like, and are still living paycheck to paycheck. there are folks out there that argued the white house made a mistake by focusing too much on the recovery part, the booming economy, how quickly america came back, and not enough about what they are actually doing to enable it. how exactly should democrats message this to voters? i think a lot of times when people talk about gdp, or the broader economy, it just misses people. the vice president i believe is in houston tomorrow, what should be she be saying to voters in houston? >> i think it's a little bit of the old clinton, i feel your pain. to your point, we get in washington and people will get very focused on the gdp, the unemployment numbers down, what are jobless claims doing, all important statistics, but not really necessary how people feel the economy every day. i think it is important to talk about, look gas prices are down that's a good thing, the cost of groceries this thanksgiving, and heading into the holidays are down from where they have been. we know interest rates are still high, rent is still up, we still have progress to make. we still have unfinished business. in many ways it gives him a runway to talk about what he is going to do in the next four years, not just what he has done in this term, as it gets into the reelection. very important to talk about the progress, but really just as important if not more, to talk about the unfinished business and the concern people still have about the cost of goods and services in this country. >> reporter: that is the economic tightrope that the president is walking, and he is walking a similar tightrope when it comes to the middle east. he is working very closely with the israeli government. israel is our ally. the president is facing pressure over the humanitarian crisis, that we are watching unfold in gaza. how can he, and the white house, broker a better outcome for israel, without losing the support of a coalition that he will need next year if he wants to win the election? >> you know, simone, i make the same thing of that claim that the court judges made when donald trump's defense attorneys one week ago today, argued to the court in washington d. c., i was in court for the oral argument, they said donald trump did not directly threaten anyone, and charge -- got very animated and she said, and i quote, there is a clear pattern here. donald trump issue statements and threats follow. so it feels to me, simone, like the judges have already moved beyond that hollow claim that donald trump is not responsible for these threats. the question remains, you know, what kind of a gag order will they approve, and return to the child with a direction to reimpose? >> does donald trump have anything to gain from testifying? again i found surprising he was going back to the stand? >> and the court of public opinion, perhaps. in the court of law, i believe he has nothing to gain. but on the other hand, he probably has nothing to lose, because judge engoron, the presiding judge has already ruled that he is liable for fraud. the only question, is how much will he have to pay back, and will he be prohibited from boone business in new york moving forward? so i think it will probably use this as another fundraising opportunities being out all sorts of unresponsive nonsense from the witness stand, then brag about how it was perfect testimony. >> and, on that note, this is not a case where we will see that testimony on the stand. we will only have good reporting to know what comes out of his testimony. you know politico actually pointed out even if donald trump faces big penalties from this case, that he may actually be able to use a lengthy appeals process to avoid the worst of it. do you actually see that happening here? >> yes i do. if the wheels of justice slow in the trial court, they will be even slower in the appeals. appeals can drag on for years. so whatever judgment engoron hands down, it may be held up in the process for quite some time. that does not mean that there hasn't been real damage done to donald trump's ability to do business moving forward. what reputable financial institution would do business with somebody who has been found liable for having engaged in years long systemic business fraud? >> well, stranger things have happened, glenn. i want to talk about a piece that you wrote for msnbc. com before we go. you write that while it appears likely the flow so classified documents case could be, delayed that might actually end up hurting donald trump. can you just explain to people why?
