it has been quite a week. michael beschloss is here to put it into perspective as the 11th hour gets underway on this friday night. greetings everyone, i'm simone sanders townsend in for stephanie ruhle. donald trump's divisive and potentially dangerous rhetoric is about to be tested in court. monday morning a federal appeals court will weigh to lift a partial gap order imposed by judge tanya chutkan. who is overseeing the election interference case in washington d.c.. this afternoon judge chutkan denied the former presidents bid to strike references to the violence of january six from his indictment. that rule came just hours after we learned more about trump's own view of that day. and the rally on the ellipse. here's what he told abc's jonathan carl. a little bit more than two months after the insurrection. . who >> if you look at the real signs of that crowd it was never reported directly. it's the biggest crowd i've ever spoken in front of by far that went back to the washington monument. >> you told him we wereoi to go up to the capitol. >> i was going to. d then secret service said you can't. and by the ti tt i would have been that when igot back i said i wanted to go back i. was thinkingabout going back during the problem to stop the problem. g imyself. secreterce did nolike that idea very much. i could've do that and you know what i would've been very well received. don't forget thele that went to washington that they, in my opinion, they went because they thought the election was rigged. that's why they went. >> of course we know that the 2020 election was mostly not rigged. as for trump that wanted to go to the capital, we did hear about this in detail the january six committee hearing. >> the president said something to the effect of i am the president, take me up to the capitol now, to which bobby responded sir we have to go back to the west wing. the president reached up towards the front of the vehicle to grab at the steering wheel. mr. engel grabbed his arm. and said sir you need to take yourself off the steering wheel. we are going back to the west wing. we are not going to the capitol. mr. trump then used his free hand to lunge towards bobby. >> meanwhile new house speaker mike johnson is making thousands of hours of security footage from the capitol riot available to the public by posting it online. there is also news in the georgia election case brought by fulton county d.a., fani willis. she is seeking an august 5th trial date for donald trump and 14 other defendants in the case. that is less than a month after the republican national convention in just three months before election day. just hours ago tonight a judge in colorado rejected a bid to keep donald trump off the 2024 ballot. that challenge was based on his comfort to overturn the 2020 election results but the judge said that trump did engage in an insurrection. with that let's bring in the lead off panel to get smarter. josh allen is here senior national politics reporter for msnbc. any landscape is also here for the wall street journal. and former new york prosecutor charles coleman. who i believe it must be founders day for -- charles will start with you happy founders day. let's start with the news out of colorado. here is the secretary of state reacting to the judge's decision to keep trump on the ballot. >> having the courts say that the former president engaged in an insurrection is big news for the entire country. donald trump is a danger to american democracy and that is something that is really novel about this case. that the judge decided that. >> so she agreed with the plaintiffs that donald trump committed an insurrection on january 6th. can you explain this ruling to us? in the insurrection. why is he still allowed to be on the ballot? >> the biggest issue the case had from the outset is the notion that the 14th amendment in the united states constitution doesn't necessarily outlined, we have talked about this before. what the actual standard is to satisfy in order to take someone off the ballot, and so while the judge did in her assertion, basically make the decision for the whole observation that it appeared that trump was involved in an insurrection and was involved in an attempt to subvert the american government, they did not necessarily rise to the level of being able to fulfill whatever the standard may have been for the 14th amendment. we talk about the fact that the justice did not indict him. in fact he hasn't been indicted anywhere criminally and because of that that standard in terms of the constitution was not met, and also the cases to be dismissed which is a problem that post lawyers anticipated from the beginning. now it's come to fruition. >> put the instruction finding then be significant to special counsel jack smith, or d.a. fani willis, either of those cases? >> yes and no i would generally speaking say no especially when it comes to fani willis's case. she's gotta move forward because she's looking at state statutes in georgia and the recall law. and the way that they cases construct it is entirely different. with respect to jack smith i think he's already someone who put his ducks in a row in a particular way over how he has constructed's history of the case to move forward. whereas i don't think that either of them would ignore the decision anything that comes from it. i don't know that it's gonna impact what both of them have planned, in terms of how they are going to litigate these cases. >> okay so anything and how important is it that the judge found that donald trump did participate in an insurrection? i mean it is, that is not something that i've heard before, that's not something that puts a question on the table. it seems like the colorado judge answered. >> absolutely i think the question is, who is it important to? there are different audiences here, as you know trump supporters have shown time and time again and they said there is rock-solid support for him. whatever the judge had said, i don't think it will impact them very much but polls do show that independent voters will be very important when the general election. they are looking at this and do see it differently. democrats of course, this is the case that the president in the white house wants to make. is they want to have a contrast between trump and joe biden. and this is the kind of find that bolsters the white house case that. this is a candidate who was chaotic. who is difficult. and so it helps the white house but it doesn't hurt trump when you're looking at this initial primary stage. >> it wasn't just colorado. michigan and minnesota also rejected efforts to keep donald trump off the ballot. i mean does it seem to you that the judges may be trying to avoid getting caught up in the legal drama? >> i think so i think we are talking about voters who have this choice. i think even if we talk to democrats they say beach trump not in accord. but beat him on the ballot. that is the way that you not only and trump. when you and trump-ism. you do it at the ballot box. that's how democracy works in this country. so trump will be on the ballot and i don't think that's all unexpected. i think if he wasn't on the ballot that would only galvanize his supporters. >> i think it's a really good point. you talk to a lot of folks in trump world. we heard donald trump in his own words on that tape with john carl. and what he said was a stark contrast to what he told the folks at the rally. he was on the stage talking about he wants someone to fight like hell. what stood out to you about donald trump's comments in the audio? >> number one. jurors voice that he wanted to go down to the capitol. and then he saying that he wanted to basically get them to stop which you may make that argument in court. but there's a lot of evidence in the contrary. that he was to your point beforehand wiling up that crowd. telling them to fight like hell. other speakers of the crowd inciting the crowd it goes to the white house and makes no effort while the capital is being stacked to stop that until very late in the day. this is that odds with basically all of the evidence that we have seen about january 6th and not surprising at the same time. that trump would try to make this argument now. >> including the videos of donald trump his. many takes. his digital videos of asking people at the capitol to go home. charles, i want to turn to mondays gag order appeals court hearing. what will you be watching for there? what should we be watching for? >> someone is an attorney, and pay a lot of attention not by the arguments made to the party but the questions asked by the panel. the reason i say this is because i'm interested to see how they're being intend to thread the needle and the balance to make sure they can maintain a fair and impartial trial so that donald trial can have his rights upheld. but also maintaining and protecting donald trump's first amendment rights. this is gonna be very interesting conversation as far as how they thread that needle. and the questions that they ask are gonna give insight as to what they are thinking about. obviously this is a case of forced impression. in case of the amount of influence. and the case that you're talking about. a former president who is also the candidate for president in the middle of an election cycle being tried in criminal court for a felony at the federal level in these are all things that are just explosive in and of themselves. but when your weaving in the part about donald trump and how he approaches attacking the audience, attacking the, jury attacking witnesses, attacking jurors and all of that. that becomes a very different conversation. and so i am going to be interested to see how the judges or the appeals court are looking to dissect the balance of donald trump's constitutional interesting constitutional, rights as well as protecting the partiality of the trial. >> here's how the new york times describes trump's legal strategy, deny allegations are criminal, blame his lawyers, and gaslight with fiery rhetoric. amy, how much does this echo his political strategy? especially from the campaign? >> i feel like it is a perfect echo. it is almost exactly the same idea. doubling down on the strategy. it's to say. of course i had to fight the election because there was fraud and of course you would want the president to be standing up against fraud and so it's the absolute trump playbook that we've come to know since 2015 really. when he was march on the national stage of the political figure. and so yeah i read that piece in the times. yes of course these lawyers are on the exact same playbook as the campaign but the second problem with that strategy of course is to say. if anything was wrong about the strategy it was the lawyers who i hired. the best people that i had around me giving me bad advice. >> it's a deflection. >> there was a miss headline opportunity. there could've been denied and distraught. >> we have to send the sober and speak to that it is of the new york times, let's talk about this campaign the, you have fani willis asking for a trial date. and 14 others for augusta. few of these for other trials that are gonna be happening. what is the same for the campaign? let's be clear. jury selection for the january 6th federal d.c. case will start the day before super tuesday? >> get ready for the next year to be all about donald trump's trial and there will be some election is. if the polls were to be made now and they stay in the same trajectory these are targets of the republican nominee for president. the august up here it is interesting right down smack in the middle of the general election, and i think that's something that is gonna be difficult for them to contend with and something that republican voters are thinking about i think over the course of the next several months. >> campaign, campaign, campaign. charles, trump's lawyers filed to oppose d.a. willis request for august 5th, what do you think the judge in georgia will decide? i mean they did grant the trial to start early for jen ellis, and we saw that went. >> simone i do think the trump's attorneys have a fighting chance of getting this push further down the road if you're talking about on his fifth start date. for the reasons we've already talked about. at that point donald trump would be the presumptive republican candidate. and that is something that is gonna weigh heavily on the notion of election interference and how this could influence voters in one way or the other. so i think once you lean into that it's gonna be something i fully expected them to do the entire time that they have been preparing their legal strategy. and the fact that election season, election day will be about 90 days from that point. give them some sort of ground to stand on which will be clear, was donald trump's plan all along. funny willis is aware of this. which is washington go-ahead asking for the day which they think is realistic. i do think that his attorneys are gonna push back as much as they can on that. and i expect that if it is denied, they will try to appeal it and get that they moved further into the future. >> before we go, there is one more new case. new reporting. not a new case but reporting that the classified documents case. the one in florida. it's about four months behind because of some of the judges decisions. this is judge cannon who was appointed by donald trump. charles what do we think is happening there? what is going on? >> i think that donald trump's legal strategy has been very affected. because we have the judge that is willing to work with him, she is obviously a trump appointee and she hasn't given them everything that they've wanted but she's done enough where they can move the camp further and further down the road. there's documents. they've dragged their feet to get security clearances that they need for discovery prepare the case but nevertheless judge aileen cannon hasn't necessarily stood in their way. in terms of having them slow down in the rhythm that they would've liked. so it's a combination of things. some of been in their control in many of not. but at the end of the day this is all playing to donald trump and what it is that he has wanted to achieve. >> well, we will leave it there. jonathan allen, 80 landscape, and charles coleman. thank you very much. we want to turn now to the latest in the israel hamas war, israeli forces i launched a new airstrikes in gaza. as the ground forces push deeper into the territory. hospitals are now the focus for both the aid groups racing to save lives and for israel's military as it searches for hostages, nbc's perseverance has more. >> tonight's israel announce a recovery in the body of nitriles corporal noah, the second hamas hostage found dead near al-shifa hospital. israel says in 24 hours. israel has shown videos, it says indicate hamas held hostages inside of hospitals and tonight hamas admitting hospitals are there. that's the youngest hostage and terrified. holding him in his brother while they were all abducted by hamas. >> i'm getting angrier by the days. because this is back. i want to celebrate the first birthday without hime firs birthday without him >> there is an ak-47. >> the israeli military saying it found ak-47s, grenades and other weapons al-shifa, and it says, a tunnel nearby. israel and the u.s. saying that hospitals in gaza have been harboring hamas command centers. >> just scratching the surface. >> palestinian red crescent posting videos pushed through hospitals for the north. to the south, where our camera crew today filming more chaos and bloodshed. and now, is u.s. military -- >> is there a reason why you should push on rather than stop at the stage for a deal, for a hostage deal? >> i think so. i absolutely agree that the article. there was one part of it that i really keyed a on, which was the part that suggested that if he were to win re-election, the people who would work for him would be the most loyal, the most ardent supporters, that really struck me, because, for so many people, who may end up going to work for the white house in 2016, they could say, with some credibility, at least, that they're doing for country, but if they do it in 2024, if he is elected for this term, he's doing it for him. they're doing it for the cause. they're doing for the -- that is extraordinarily dangerous for the country. everything that we have heard over the last few years, from january six on, certainly confirms it. the other point that they make is tha
