>> nbc's kirsten has wrote a great piece on this today. it seems that some of the negotiators talking, and they say they feel that qatar is trying to talk to hamas and tell them that the only route to avoid all out war, a full-on israeli ground invasion is to release these hostages. and it was surprising that they did release these two, i think it was a positive sign, but i think they realize thatholding 200 hospital is not the strongest position i have. th question is there is tremendous anger, understandably, in israel. 1400 people died in this attack at least 1000 of them were civilians that were killed in terrorist attacks. so the israeli public may demand a ground invasion but this does show that it seems that the political leaders of hamas, many based outside of gaza, have enough influence to get some hostages release. so the hope of negotiators is more releases, more time, and more aid into gaza and to avoid an all out war. >> david, when you talk about frustration and anger among people in israel. some members, some family members of the israeli hostages have expressed frustration with their own government for the handling of the situation. saying they are being kept in the dark. that they have to instead rely on digital clues about the situation. what do you attribute that to? >> it is normal, what happens in these situations and that family get incredibly situated. my family got frustrated with the u.s. government. i guess i would urge these families to try to show patience. it's easy again for me to say, i don't have a loved one who is kidnapped right now, but every house for house leaders i've talked to, if you're lucky enough to come home. they don't complain about the government not doing enough. they blame one party for these kidnappings. and that's the kidnapper. hamas is at fault here. he has, there is maybe a better job the israeli government can do communicating with the families. there is maybe more the american government can do. but the problem is that kidnapper. this is inexplicable, there is no reason to take 200 civilians hostage. that's a cruel and cowardly crime. i am biased given my own experience. but the pressure, and the, focus and the anger should be on hamas. >> that question was specifically about the families inside of israel. i want to make sure i also ask you about the families of the 11 americans who are still missing. they met with president biden last week. as you remember. your sense of what is going on behind the scenes in the biden administration itself so that all 11 can be brought home safely? >> i think there's tremendous efforts to work with qatar on this diplomacy. and i should say, more specifically, i'm sure that the israeli government and maybe they're sharing information, there's constant surveillance going on. they are trying to track every piece of information they can't get. cell phone signals, connection of hostages by any member of hamas and find them. they probably been divided into small groups. they're probably being held underground. i'm sure the mother and daughter was immediately interviewed about how they were held, who they were held, within where they were held. i'm also sure that hamas has moved all of the hostages that were possibly held with them to a different location. so there's a desperate effort to get information. i think both countries would try to carry out a raid if they had clear information on where the hostages were. but it will be very difficult. just lastly, hamas held a israeli soldier for five years about a decade ago. and israel was unable to follow him in gaza for five years. so that's how difficult it is to find a hostage there. >> important context. no reports suggesting they attack may have been an attempt to block the impending deal between israel and saudi arabia. your assessment of that? >> i think it was, i think there was a sense that a broader peace agreement was moving forward. and hamas wanted to derail that. and they have in many ways. i think you heard earlier in the interview with the palestinian and gaza, the sense that 75 years has gone by, it may be too late for a two state solution. i'm not an expert on the israeli palestinian conflict. but you do see that in some stage, possibly after hamas has been neutralized, possibly there's a need for more diplomacy about some sort of long term solution here. in some form. but maybe two states. i do not know. but beyond that, right now, it's a tremendous crisis. it's very dangerous. it could spread and intensify if hezbollah attacks for the north. if iran releases hezbollah. this could turn into a difficult war. it's a difficult situation. again, two hostages released without conditions? >> it's interesting that kevin mccarthy is saying that this all started with matt gaetz. >> yes! >> this is when we started getting into trouble with matt gaetz. i think this started when they elected donald trump. this is not about gaetz. look, gates definitely did, in the end, have this motion to vacate and did remove mccarthy as speaker. he started this group. but this is a schism that started, if you really want to get technical, it may have started with newt gingrich. but donald trump was certainly part of it. and i think that now you have this party that is really in free fall. they don't know what they are. they don't know who they believe in, they don't know what they believe in. and i think that really -- there is a significant part of this party that's completely nihilistic, that just want to burn it all down. there are the burn it all down caucus. that matt gaetz is. that. crew and veterans contrary to everything the federal government is supposed to be doing. >> it also struck me, listen to that sound, there is never cognition of his complicity and i think we keep waiting for the moment to come. it's not get there. i wonder, as you look at thought republicans putting their names in for speaker, we have the big graphic with all the minnesota's, tom emmer, one of the very few who did not vote to overturn the 2020 election, who did not carry donald trump's water on that. when you look at these two elements, jim jordan's failu, for thrice. . . , and amara's candidacy, i wonder if between the two, on that continuum, there is a framework for a future republican party that can actually move beyond -- >> that's the 10 million dollar question. that's what we're all wondering. does jim jordan's inability to become speaker mean that donald trump is diminished in that republican party? does this mean, is this a signal that the fever has broken? right? because there is no one donald trump wants more as a head of the house, speaker of the house, then jim jordan. he is a donald trump sycophant, through and through. he was involved in stop the steal. he is donald trump's guy. so the fact that he could be made speaker mains that either donald trump doesn't have the same kind of power he did in congress, which is possible, or donald trump is so distracted by his legal problems that he couldn't focus on that. and either where, you have to wonder, if you're a republican donor and donald trump is now the nominee, because you know the rest of the base, nobody else has come close to him. eight percentage points, 15 percentage points, but not anywhere near him. you have to worry, how is this guy going to run for president? >> there is also, i think it's important to underline this through line, if you can call, it of authoritarianism you've seen throughout this process. the fact republicans who go against jim jordan, the ones who directed against him pop the, not the ones who dared to go against him when it was a secret ballot and didn't have to sign for a name to it. being met with death threats. which is an everyday reality, of course, for some democrats in congress. that part of the story, whether it's happening within their caucus or within their party writ large, it says something about the moment we find ourselves in. >> yeah, i mean, again, the death threats are nothing new, right? this is trump's mo from 2016 on. if you are going to go against our guy, you're gonna get death threats. so i wouldn't say that this is a completely new phenomenon. but i would say that the people, there are not working. congressman bacon was like, so what? he really didn't care. and his wife got all these death threats and they just kept going. and it didn't change his vote. so that is a really important data point. so it's not working the way it has, previously. now, this weekend, you are seeing trump acolytes try to intimidate some tom amorous because they don't want him, because he voted against certification. what i think is worth wondering is, are they going to just keep alienating people until, i mean, how many days does this go on before it really hurt republicans keep in the house. how long do they let this go before they realize that they've just, there are just putting themselves in terrible trouble? >> your cat is trying to tell me that is time for this interview to. and but i have one more question. it's easy when you and i both understand this. our audience understands this. it's easy for all of this does not like the political games or machination -- they're a big stakes here, especially when you talk about the aid pages currently before congress. we talk about the funding deadline. but there is the question, at some, 0. 2 people in that republican congress get so tired of the shenanigans that they themselves are tossing perhaps to be a compromise candidate they get behind one of them? there's also the question of the american people looking at this and saying this is not governance. and if there are real consequences. >> yes. no. i mean, i don't understand why the american people, i think this actually really hurts them. the majority, these republicans. because they have this very slim majority already. and the idea now that they're going to, after a 20 days without a speaker, probably and certainly beat more 20 days, they're going to make this case that they're functional when they control the house, seems kind of notes. i would also say, mchenry, the protemp baker is an option. he said he didn't want. it but there would be, you, know i think democrats are sort of waiting around. there is only -- republicans have a four seat majority. and i think democrats are waiting around, and you're saying, if you want to get back to work, we are here. >> molly jong-fast, as always, thank you so much for your time. next, the former presidents legal troubles may have taken a turn for the worst. but two codefendants who struck plea deals and what that could offer prosecutors. and, more in the middle east. could the -- put the nypd and fbi are high alerts. a former agent is here to tell us what we need to know. >> sometimes, alicia, it isn't so much the terms change but the timing does. and so as that clock ticks down and as the jury is showing up to the building to start filling out those jury questionnaires, sometimes the defendant decides, okay, this is the end of the, line i need to make a decision now. so it's hard to know if there was a different deal, or suddenly the deal look better to chesebro as the potential jurors were walking in the door. >> trump has publicly claimed his election indifference was the result of bad legal advice. how could have been his attorneys testify, then, undermined the defense? >> i think this is going to be a very helpful thing to have kenneth chesebro on the government side here. and don't forget, alicia, one really key finding that happened earlier in the week, that may have also prompted kenneth chesebro to plead guilty, was the judge in that case ruled that the attorney-client privilege would be pierced. but what is not as the crime fraud exception. that is, there was a preponderance of the evidence, that were engaged in fraud when they were communicating. so all that stuff was going to come in. and then you get the narrator, which i think could be very valuable. whenever you have a co-operator with a lot of baggage, like kenneth chesebro, that the jury might discount the testimony to some extent, testifying, to let the prosecutor what they want to hurt to save his own skin, prosecutors typically rely mostly on documents, other witnesses, records, other kinds of things. but it is so helpful to have someone on the inside, like kenneth chesebro, to be that narrator and try to put those dots together. and i think that's where it can be incredibly useful, especially in light of the defense that donald trump intends to land. kenneth chesebro can be the one to say, that's just not true. >> help me understand the timeline. chesebro and pell were supposed to be the first drunken defendants to stand trial. any sense what we know about the timing for the first -- base of defendants, do we expect him to try? together >> we really don't. but they should accelerate things because this trial was expected to last several weeks. now everybody's top it is clear. the judge doesn't have to sit through the trial. the prosecution doesn't have to sit for the trial. and so we could see the trial date get set now at some point. there will still be some time for the filing of motions, and the resolution of this motions. so i imagine that will continue for sometime. but i think with these two, not having the trial, that could move up any potential date. it and as for whether they'll open the altogether that certain is the preference of fani willis. but i imagine, we will see more peels before we return. so the number of defendants who actually go to trial might end up being only a small handful. >> barb, your fellow nbc legal analyst -- predicts they'll become witnesses in trump's federal case as well. but they have not been charged and the special counsel's investigation. talk me through your thoughts of roll on that hypothesis, and what it would be that cooperate before actually being indicted. >> i think it's a very good hypothesis. if you were the attorney for chesebro or powell, it doesn't make sense to plead guilty in one form and leave them exposed to criminal charges and another. because what they're going to do in this case in georgia's go in and testify. and they have to say, all the things they did themselves that makes him believe they're guilty, and they were part of, it and they were on the inside. that public testimony could be used against them in the federal. case i would imagine that theories will be given to jack smith, if they have not done so already, two and -- explore a pre indictment plea. and if you can get a plea before indictment, you can terms that are better. just like the terms think out in georgia, pretty good if you ask me. getting our way with probation. the reason the cup is deals as because they were the. first they got in the door and their testimony is very, very valuable. by the time you start getting up to defendant 17, defendant 18, it's not as much to have that cumulative testimony. so my guess is, they will ultimately cut deals with jack smith as well. >> are, up as we're sitting here, thinking of which of this cornucopia of legal troubles will ask you about, we knew we had to ask you that michigan. speaking of trump allies taking the stand, michigan's a. g. has dropped charges against a fit fake elector interchange for his testimony. what does that tell you about the michigan case? call your cardiologist, and ask about attr-cm. let us live! late cease-fire now! cease-fire now! cease-fire now! cease-fire now when >> protesters in washington d.c. earlier today are calling for a cease-fire in gaza. over 4000 people have died in escalating violence between israel and hamas. over the past two weeks -- left more than 1000 civilians dead, there have been dozens of organized protests across the united states in support of both israelis and palestinians. seri officials are warning the escalating conflict abroad and a rise in denizing language could lead to an uptick in hate crimes here at home and abroad, the state department to issue a worldwide advisory for u.s. travelers. in london, antisemitic hate crimes are already up more than 1000 percent. officials there say -- 100 40%. here in the united states a six-year-old palestinian american bullet was stabbed to death last week. his mother was also stabbed, but she survived. president biden has publicly condemned this as a hate crime. and he called the family personally to offer his condolences. the boy's uncle says that is not enough and want the president to take a more proactive approach to stopping hate crimes against muslim americans. frank figliuzzi joined me now. inside the bureau's code of way, excellence. frank, no doubt tensions extremely high, explain the challenge and the work that the fbi is doing as they seek to both prevent and to investigate hate crimes. >> there is a real challenge here, and all explained why in a second. you'll recall after 9/11, dhs came up with this color coded threat level and it was discouraged because it became confusing and even for law enforcement and it didn't result in tangible differences and security postures. but i can tell you this. if it were in place today, it would likely be raised, the threat level, the color would go up probably from blue, we'd go to yellow, or even. orange and here is why. here is where the challenge comes. and we could take some assurance and comfort from the fact law enforcement is telling us, hey, there is no credible threat identified against the homeland here. okay. that's good. important to note. but i have to also note that that's not really what the threats about right now. it's not about intelligence telling us, for example, that hamas is poised to attack the united states. they never were. they weren't about a presence in the united states that could go operational at anytime. that's not the issue. what concerns the fbi and local instant authorities that most right now is the lone actor. maybe mentally unstable, may be fueled by hatred. wanted to instill fear, acting out irrationally, and we certainly saw that with a tragic stabbing death of the six-year-old you just referenced. it's why the fbi jumped in immediately in that case. doj even issued a press release. it's why we're going to see the federal government come down hard with hate crime and fbi investigations. just in the last, week we saw the fbi director get on a phone call with 5000 jewish leaders as part of a security -- circular communities network, -- we also saw him travel to the international association of chiefs of police conference on the west coast, and he told police executives, we have an increased threat. whether it's bomb threats or physically acting out a places of worship both muslim and jewish. we are in an increased threat posture. >> when he is on the phone with law enforcement, when he's on the phone with community leaders, what is it that he's conveying to them about the threat and about the agency that they do or don't have?
