people. our laws that protect national defense information are critical to the safety and the security of the united states. and they must be enforced. violations of those laws put our country at risk. in the indictment itself, we learned some of the documents contained u.s. nuclear secrets. and while we have not seen any of those documents, for obvious reasons, there is new reporting from multiple outlets that donald trump cavalierly shared nuclear secrets with a foreigner one evening at mar-a-lago, allegedly. nbc news hasn't confirmed the reporting, but "the new york times" cite two sources familiar who say shortly after he left office former president donald trump shared apparently classified information about american nuclear submarines with an australian businessman. and that during the the conversation, the former president revealed how many nuclear war heads the subs carry and how close they can get to a russian sub without being detected. sources familiar who say the australian businessmen went on to tell dozens of other people, including his employees, journalists, and other foreign officials. so, what is jack smith's team doing with this information? and what sort of witness could this businessman be for the prosecution? trump's campaign says trump did nothing wrong. they call the leak illegal and say the information lacks proper context. also, what, if anything, can be inferred from the timing of this news? this morning, the judge overseeing the documents case granted trump's legal team a number of extensions for pretrial motions. we have legal experts to assess, and a national security expert to weigh in on the gravity of the alleged revelation. and while we are at it, we also have news on another trump court case, the ongoing fraud trial in new york city. today there was big and potentially damning testimony from one of donald trump's own former employees. so, joining us now, nuclear policy and national security expert joe cesarean sony. joe is a member of the council on foreign relations and former adviser to the u.s. state department. what could have been revealed here? this idea that donald trump was allegedly having conversations with an australian businessman, a foreigner at mar-a-lago for numerous people to hear about how many nukes our subs could carry and how close they could get to russian subs without being detected, with the caveat we don't know whether or not this was all bluster? >> right. this is some of the most highly classified information in the u.s. system. when i worked for the government, i had top secret code word clearance. i worked on nuclear weapons programs for almost nine years in the government and house armed services committee. i did not know how many war heads our subs would carry or how close our submarines could get to the adversary submarines. the reason, i didn't have a need to know. so, the navy keeps this information very tightly held. they want to introduce uncertainty in the minds of our adversaries. it's the cornerstone of our nuclear deterrence policy. now, we have about 14 nuclear submarines that carry ballistic missiles. each carries about 20, but the exact number is not revealed. you may not think it matters if a submarine off the coast of china is carrying 20 nuclear war heads or 160 nuclear war heads. that's the range it could be. but it matters to the navy. that's why they don't disclose this information. they don't want the chinese, for example, to be comfortable in thinking that they can carry out a strike or deter the united states and minimize the u.s. response. same with our asw capabilities, antisubmarine warfare. we don't want the adversaries knowing how close we can get. that uncertainty is central to deterring enemies from taking action against us. that's the information that donald trump disclosed. >> can we dwell on that for a moment. can you explain further why it is such a big deal. i think there are people out there who will say, again, what you mentioned there, that the number of war heads, does it really matter if they know? they've got to already know how close we can get. they've got spies. they've got intelligence of their own. this information is probably not all that secret in reality. >> well, i'm telling you, it's pretty secret. i didn't know this. i never knew this. the number of people who know this information is probably in the, oh, i don't know, hundreds of people who know precisely what one of our boomers, our ballistic missile submarines is carrying on any patrol, the mix of targets they have. and the navy cares about this. let me give you an example. if i had done this, i would be in jail right now. the fbi would have been at my door, they would have led me away in handcuffs, and you wouldn't be hearing from me for quite a long time. people have been arrested and jailed for much less revelations about u.s. national security strategy. the navy cares about this. that's why they keep it secret. >> the idea he was having this conversation, again, nbc has not confirmed this reporting, having it at mar-a-lago in the open with a businessman, who went on to tell his employees, went on to tell foreign officials, i think a lot of them foreign officials with the country of australia, and then journalists. is there any way that you can look at this and say, maybe it's not that bad? >> no. there isn't. there is no way whatsoever. and it's bad on several fronts. on one front, many of us feared donald trump kept this information, he must have kept it for a reason. was it just pride? was it amusement? was he trying to monetize this information? might he be sharing these secrets with u.s. adversaries or with allies he favored like israel or saudi arabia or vladimir putin in russia. now it turns out that he's not selling the information. he's giving it away as party favors at his dinners at mar-a-lago. this is even more serious than many of us thought. he's got loose lips that could sink navy ships. that's the problem we have here. and that's just on the defensive side, what it does undermining our deterrence, our ability to introduce uncertainty in the minds' of our adversaries buchlt at the same time, he's undermining our defensive alliances. he's undermining the confidence that our allies can have in us. how can you trust a country whose president is giving away some of our most highly classified nuclear secrets. what might he be doing with the secrets your country is sharing with the united states? he's undermining us on the deterrent side, where we want to instill uncertainty in the mind of our adversaries, and on the alliance side, where we want to give our allies confidence they can trust us, trust the united states, we will keep you safe, we will keep your secrets. that's now in doubt. >> donald trump is a candidate for president again, and by a look at the polls, he's doing pretty well, currently the far front runner for the republican party. and he's head to head with president joe biden. what's your message to those voters out there who say they want to give him another shot? >> a vote for donald trump is a vote to undermine american national security. there's no question about it. i don't know many serious national security experts who believe it would be a good thing for the united states to have donald trump be president. i don't think any of our allies would think it's a good thing for them if the leader of the united states, the leader of their main defensive ally is giving away secrets, can't be trusted, as unpredictable as donald trump has proven to be. it would be a disaster for america if donald trump were to become president again. >> joe, thank you very much. appreciate it. joining us now is msnbc legal analyst lisa ruben, who has been inside of the courtroom covering the donald trump fraud case all week, and former federal prosecutor in new york, jessica roth. let's start with this nuclear story from abc news and "the new york times." this australian businessman is said to be one of the witnesses for jack smith's team. what sort of witness is he going to be? >> it sounds to me like he would provide some very important background information to establish essentially a pattern of the former president acting recklessly with the regard to maintain the secrecy of our national defense information. i don't believe that anything about this particular information is alleged in the indictment. it's not the basis for any of the specific charges. but nevertheless it could be admissible and relevant to show this pattern of the former president acting recklessly with regard to very sensitive, including nuclear information. and therefore it would go to his intent. >> same thing. it would go to his intent. one of the things about this anecdote that really trieks me, katy, is that he leaned forward, according to this reporting, when he was sharing the allegedly classified information. that shows that he understood that this wasn't intended to be shared, that it was supposed to be classified. again, as jessica said, that really goes to his intent. none of the indictments, allegations, pertain to the disclosure of national security information. it's all about the retention. nonetheless, the disclosure at bedminster and this disclosure too shows his recklessness and his knowledge that he was doing something wrong. >> i apologize. i have my seasonal cough that will not go away. i apologize if i cough in the middle of the segment. let me you about the fraud trial. >> jeff mcconney was on the witness stand. he's the former controller of the trump organization. he's now retired and he was examined thoroughly about different valuations of trump properties in different years, really to show the egregiousness of the fraud that the attorney general is alleging that mcconney, who himself is a defendant, the other individual defendants, and the trump organization as a whole engaged in. for example, they asked him whether he understood that mar-a-lago had a date on it that prohibited it from being used as anything but a social club. he denied that he knew that, but they showed he in fact had it in his possession for many years as part of an appraisal and valued mar-a-lago as if it could be sold as a private residence, in miami fetching a much higher price. they showed similar valuation differentials that could not be explained as anything but fraud. >> how does the defense use them? how do they try to counteract with the prosecution as led him to reveal? >> it's going to be very interesting to see how the counsel for the other defendant approached the cross-examination. will they try to deflect responsibility to show, for example, perhaps that the former president had nothing to do with these financial statements. they may try to put distance between this individual's work and those documents and the other individual defendants, former president trump, and his sons. they may also try to suggest through their form of questioning that the valuations he included are appropriate. that is the trump theme, which is that his properties are uniquely valuable because of his hand. so they may be trying to put together that affirmative case as well. >> donald trump is trying to get this trial -- not the trial, but the summary judgment stayed. he's appealing it. he wants the trial thrown out. he wants all the other trials thrown out. he's filing a flurry of motions right now. and going back to the classified document case -- not to ping pong around -- but there is one other note i want to get to. that's judge aileen cannon agrees to some of his motions from his lawyers to extend the deadline for some of the pretrial paperwork. what happened today with that? and can we infer anything from the timing? >> i want to be very clear about something. judge aileen cannon has not yet pushed out those deadlines. what she's done is stay all the deadlines so she can consider the larger request to push them out by several months or even perhaps until after the november '24 election, which is what trump's attorneys said in a filing yesterday. i think we can infer from that and the fact that aileen cannon has not acted with all deliberate haste so far, as contrast with judge tanya chutkan in d.c., that she is strongly considering whether or not she should either move a bunch of pretrial deadlines by several months, which would elongate the trial schedule, or is considering the whole kit and caboodle, and moving it until after the election. >> what would be the argument to move it back so far? is it because there's so much classified information and the process would take so long? >> my understanding is that the motion is requesting a delay based on what the defense says are failures on the part of the government to provide them with adequate access to the information, including in florida, in a place where it's most convenient for the former president and attorneys to review it. the question will be, how much merit is there to that claim? she's the one who has access to what is the information that has not yet been disclosed. we don't have access to that because it's classified. the question is, what's the volume of the material involved? how credible are the claims they haven't had adequate time? and how committed is she to keeping to the schedule she already set. we saw in d.c., judge chutkan did grant additional time to file motions, but only two weeks. depending on how inclined the judge is to keep things moving, that will affect also the contents and the merit of the motion, how they rule. >> we'll see. and we'll look forward on monday to the testimony of allen weisselberg. tuesday, sorry. monday is a holiday. tuesday. ladies, thank you very much. appreciate it. coming up, two massive strikes this week, both health care employees and auto workers. what's the status of their negotiations? >> people thought it would be a circus, katy, and republicans want to avoid seeming more like a circus than they actually are, of course. 15 rounds on the floor in january, no speaker now, unlikely to be a speaker next week, i would say, if i were betting today. they are trying to round up support and they don't think -- and i think this is the right inclination, katy, i don't think they think we'll get any votes going on fox news with bret baier. nothing against bret baier, but i don't think that helps anybody lock up votes. these candidates are saying, come waste your time with me, katy. and that's the name of the game. i mean, we've seen a lot of people in the past try to play outside games here and try to gin up the outside base. but this is an inside campaign in which lawmakers are asking -- candidates for speaker are asking lawmakers for their support, for their trust. and going on tv is not, with all due respect to television, is not going to get their trust in any way, in any appreciable way. >> you get my trust every time you come on the show. >> i know, katy, but that's because we're friends. >> let me ask you what hakeem jeffries is arguing. a unity government. please start talking so i can cough. >> yes, you got it. there's no chance that's going to happen. listen, if they go ten rounds again without a speaker, could there be a candidate that emerges that could get democratic and republican support? maybe. that's possible. but here's the thing, if you are a republican and you have a republican majority in the house, why would you seed any power to democrats? as dave knows this well, congress is about power, about exercising and the use of power to achieve the ends that voters sent you to washington to do, plain and simple. how do you go out if you're speaker of the house and you need to raise a couple hundred million dollars to -- close to a billion dollars nowadays -- to keep control of the house and say, give us your money. we are governing with democrats. it doesn't work like that. it's a nice op-ed. it's a nice topic for fans of "west wing," but it's not redwral. but, again, we could get into this. if they can't find a speaker in a month or something like that -- perhaps that happens -- until then they have 221 seats and they want to get a republican speaker of the house because this is a republican majority. by the way, hakeem jeffries is not going to be suggesting a unity government when he's speaker if he's speaker next congress. nancy pelosi never suggested a unity government. i think this is not tethered to reality. >> i hear you. it might not be tethered to durnt reality. i hate the idea that it's pollyannaish to think about. the vast majority of americans look at washington and are disgusted. they want washington to work together. the vast majority of americans are not as partisan as washington is. dave, you tell me more on that. >> katy, by-gone era we might have seen some kind of compromised speaker. the ideological balancing point of the house is someone like don bacon from omaha or ryan fitzpatrick from pennsylvania, a very moderate republican who's just enincensed that the motion to vacate was won. this current motion by jordan and scalise is fascinating. it's possible that jordan could have more support among republicans than scalise, with trump's help, although i'm skeptical of it. but i think scalise, as for the next in line incumbent, has a better path to getting closer to 215 or 16 or whatever number the quorum dictates. >> 217 is the number. let me ask you about what sort of speaker is going to help them keep the majority. i've had mark mull narrow on. does a jim jordan speaker help them win re-election? (announcer) change your life at golo.com. that's golo.com. there's breaking news on the auto workers strike. union president shawn fain says he has made progress with gm. >> we were about to shut down gm's largest money maker in arlington, texas. the company knew those members were ready to walk immediately. and just that threat has provided a transformative win. gm has now agreed in writing to place their electric battery manufacturing under our national master agreement. we've been told for months that this was impossible. we've been told the ev future must be erased to the bottom. and now we've called their bluff. >> joining us now from streets borrow, ohio, nbc news correspondent jesse kirsch. jesse, it's a really big deal for him to have texas auto workers say they'll go on strike. texas, that's not a unionized shop right now, is it? >> reporter: katy, what i want to tell you about that facility they are talking about, uaw is calling this gm's biggest money maker. this is where they make things like chevy suburban, so bigger suvs. and the union is claiming that with the threat of that plant, that facility being brought to a halt, that the company capitulated on what is potentially something that could be groundbreaking in this industry, what shawn fain was just talking about. they're putting ev battery manufacturing into a national master agreement between the union and one of these companies. and what is significant about this is the industry is moving toward electric vehicles. ev battery plants are still coming online. that means this is potentially new facilities, facilities that are in the works right now, and you could think there could potentially be facilities that haven't even been thought up yet, that would now, based on those terms, potentially, be part of the union agreement. so, the union would be negotiating for those workers' pay and fits. so, that would potentially up labor costs, give more to those workers. it also could help keep the union's rank sbilized because there's concerned with evs potentially requiring fewer jobs to make those vehicles that you could wind up seeing people losing jobs in future years. that could wind up evening things out and maintaining the workforce that is part of the united auto workers. the other piece of this, which is significant, just a week ago the ford ceo was talking about -- believing that the union was largely holding up a deal with that company over ev battery plants. so, knowing ford was saying that was something the union was holding out over and essentially suggesting it was something that wasn't even in that current agreement negotiation that they're talking about, something that's more forward-thinking, we now have gm apparently agreeing to something like that. we'll see what pressure that puts on the other companies. we have not yet heard back from gm. we're waiting for a statement from him, but potentially a pivotal development today. >> that shop in arlington is a unionized shop, but the threat of them walking got them to get a lot more than they thought they would get. jesse kirsch, thank you very much. today is day three of the health care strike. it is also the last day, at least for now. 75,000 union workers with kaiser permanente walked out on wednesday, demanding higher staffing levels. the union argues patient care is suffering because staff is short and the system is overtaxed. joining us now from los angeles is nbc news correspondent david noriega. today is the last day, david. are we potentially going to see a longer strike in the future? >> reporter: the short answer is yes, quite possibly. we do have a major update today. there is a new round of bargaining sessions that's scheduled for next week, starting thursday. we're the first to report that acting labor secretary julie sue is going to participate in those bargaining sessions. she's going to be present in oakland, where kaiser is headquartered. this is high stakes, high level people getting involved here. as far as where we stand noun the negotiations, the unions, the coalition of unions, believes they made progress, that this first three days of striking worked inso far as they're getting movement, getting offers from kaiser. however, they say it's not enough and they want to keep the pressure up. to answer your first question, it's likely as things stand now we may see another strike in the first week of november. in fact the union negotiators are considering adding even more days to the five-day strike they're already planning. we can see things get even more disruptive for -- this is millions of people kaiser covers. things could get even more disrupted as the union tries to keep pressure up on the company. >> you were interviews a patient who was really upset yesterday and didn't blame the strike on the union or the workers, blamed the strike on kaiser saying there's a ton of money but they're not putting it into the their facilities. what else did you hear from patients who are potentially losing add-on treatments? >> reporter: it's interesting, i and my colleagues spoke to a number of patients, including patients who were seriously and acutely affected by this strike. pretty consistently all of them talked about having had these procedures delayed in the past, having to struggle for months to get appointments with doctors, other practitioners. so, they all seem to recognize by and large that the problems are deeper than just the strike and that the strike is a symptom of a larger problem, which is the severe understaffing crisis, which affects not just kaiser but the entire industry. this is one of the questions we're going to have to contend with. where is public opinion going to fall on this? >> reporter: a lot of mixed reviews on this announcement that caught some local leaders by surprise. we do know that of course starr county is part of the rio grande valley, which over the last year has seen part of that steady surge of migrants. in fact, we have the latest number here from homeland security. it says in the last year alone, this rio grande sector, where this new proposed wall would go, saw an estimated quarter million attempted illegal crossings. so, there's certainly a need in this area of some sort of solution to migrants coming across. but what's so interesting, katy, is when i spoke to the county judge of starr county, where this wall extension would go, he says that the wall is not the answer he's looking for. and here's more of what he had to say. take a listen. >> has there been any communication between the biden administration and you or your office? >> no, sir. >> how does that make you feel? >> how do you think it makes me feel? it's not very good. you know because i get asked questions by not only the media, by citizens of the county, and i really don't know. i don't know what's going on. i don't know what's happening. i don't know the type of construction. all i know is that we're getting anywhere from 17 to 20 miles of border wall built. >> and you believe that having any extra amount of wall in starr county will help curb this surge of migrants? >> absolutely not. >> reporter: now, the judge went on to tell me, katy, that he was first notified about two weeks ago by the department of homeland security in a letter that was sent to his office detailing the plans for the wall. but he says he still doesn't know exactly where it would be going as of today. he called the use of that money appropriated back in 2019 under then-president trump, the money used for this wall essentially a waste. and he wished it could be used to go towards hiring more border patrol agents or using higher tech solutions along the border, solutions that he feels would be more effective than simply extending part of the wall that a lot of people here feel is not really effective. that said, we have heard from those residents locally, katy, who tell us that, you know, any extension of any kind of the wall gives them some peace of mind. katy. >> morgan chesky, morgan, thank you very much. joining us now is democratic congressman from california, ted lieu. congressman, thanks for being here. let's talk about the border. the president says this money was appropriated by congress, he has to build that wall. he does not think the wall works. the mayor that morgan was just talking to does not think the wall works. what would work down at the border? >> president biden is correct. during the trump administration, this money was put into the appropriations bills, and according to administration, they have to spend it. i do note that the administration also waived environmental laws to do that. so, i'm not clear as to whether they have to spend the money if they also have to waive environmental laws. i'm not an expert in this area. i'm getting more details from the administration. and in terms of border security, we need more advanced technology. we need to have comprehensive immigration reform. there are laws that we currently have to enforce and also bills to reform our immigration system. and i support comprehensive immigration reform. that's how we, sort of, this problem. >> that's a great thing to hear for a lot of americans, who are desperate for some sort of immigration reform. 245,000 crossing the border and cities across the country, including cities now like chicago and new york city overwhelmed with the number of migrants that are here. they say they can't handle them. there's not the infrastructure in place. why don't you start working on that with republicans? republicans have been talking about the border nonstop. they want to hardline versions of it, put those into a number of bills. do you think there's room to negotiate on this with this republican majority in the house? >> a number of democrats have been working with republicans. there are various bipartisan proposals being floated. there have been bipartisan bills that have been introduced. we can't do anything right now because the republicans took out their own speaker. so, the house of representatives is in chaos because the republican party can't govern. democrats are ready to govern. we just need a willing republican partner that will abandon extremism and come work with democrats on a bipartisan th forward. >> so, both the governor of illinois and the mayor of new york city have raised one particular issue about what is making it harder to assimilate the migrants into the cities and get them housing, get them working. part of it is that there's a five, six month delay between when they come in and when they are allowed to start working. can congress shorten that time line so that migrants don'treso on a subway to try to get enough money to pay rent somewhere, to get out of a shelter? >> democrats are definitely willing to work with republicans to come up with a solution. and that does also bring to mind that today we had another outstanding jobs report. 336,000 jobs created last month, thanks to president biden's policies. and we clearly need a lot more people in america to be able to sustain our growing economy. and we have still one of the lowest inflation rates of any of the major civilized countries. >> is that something you can work on once there's a speaker? is there any legislation that is currently on the table to shorten that particular time frame for when they can start working? >> there have always been bills introduced on that specific issue. whether or not republicans would like to join democrats remains to be seen. the first order of business is for the republican party to make a decision to govern and elect a speaker. >> do the biden administration is doing enough on this? i mean, you have the mayor of new york city saying that the city is in crisis. you have the governor of new york state saying the state is in crisis. you have the governor of illinois saying the same thing about illinois, that the administration has sent 46 million to illinois, $100 million to new york. illinois says -- i'm sorry, it needs $330 million for the city of chicago, and not $46 million. and new york says it needs $12 billion. is the biden administration out there in front of this issue that seems to be building in democratic cities and states? >> richard nixon shut down the border because of the crisis at the southern border and then he reopened it because that policy failed. this has been a problem decade after decade after decade after decade. when we had a chance to solve it with comprehensive immigration reform, house republicans blocked that. it is at the step of the house republicans -- >> do you want to hear the president talk about it more directly? >> democrats working -- >> do you want to hear the president talk about it more directly? do you think if the president focused on it more directly, that would get more momentum, put more pressure on the republicans to come to the bargaining table?
