trump throws his support behind jim jordan for speaker, but will it make it easier for him to claim the gavel? and the jobs report stunner, the big numbers that economists didn't see coming and how the markets are reacting. plus, two people charged in a fake elector plot in michigan try to argue they're not guilty. just brain washed. how that worked out for them. and why the new jersey's attorney general's office is re-examining a deadly car crash from years ago involving senator menendez's wife. our nbc news reporters are following the latest developments. first we want to go to capitol hill where nbc's gary grumbach has more on the endorsement that could shake up the speaker's race. you've got jim jordan reveling in the endorsement from the former president, steve scalise seems to be playing more of an inside game. talk us through it. >> reporter: jim jordan and steve scalise are really spending the day on friday here on zoom calls. they're meeting with different parts of the republican caucus. they're meeting with the western caucus, members of the western house of representatives, they're meeting with the small business community, people that are really into the business minded members of congress, and so they're doing that right now. and that will continue throughout the rest of the week. and right now it does seem like momentum is in jim jordan's favor. he certainly has the support of some of the outside republicans, outside of congress, people like donald trump as you mentioned, people like steve bannon. that will certainly ingratiate him with some of the far right americans who vote for people like donald trump or support and listen to people like steve bannon, but those people don't get to vote for speaker of the house. so the big question here is what does donald trump's endorsement really mean for especially some of these moderate republicans who will have to make this vote. here's what steve scalise had to say this morning on fox news. >> it's a lot of one on one conversations over the last few days i've been having with my colleagues, and a lot of introspection about how we get things on track. the problems we have internally, they don't go away with the new speaker. the reason i've been able to build such a strong base of support over these last few days, that's been growing, is that i've got a long proven record, for the families who gave us this majority. >> reporter: in terms of what next week looks like in the race for house speaker, every house republican is going to get together on monday and talk about who they think they're going to support. those meetings will continue in smaller groups on tuesday, and they hope they can avoid what happened in january where it took 15 ballots to get kevin mccarthy named speaker. they hope they can avoid that by having a consensus candidate come up and a candidate that really can go to the full house by wednesday. >> gary grumbach for us, thank you, appreciate it. let's talk jobs numbers, you've got sky high new jobs numbers and it may sound like good news all around, but it's been a roller coaster ride for the markets in the aftermath. steve liesman joining me now for cnbc on msnbc. two things, what is going on here, and could this mean action from the fed? >> well, i'll take them one by one, what's going on here is very strong job growth, not only s ts month off the charts, but they revised up the prior twomonths. the good news partf that is it came with modest job growth -- msorry, wage gains. if those wage gains had been higher, it would have ignited more concerns about inflation. instead, the stock market is sort of rallying on this number after being spooked by it early on, they decided, hey, this is okay. we can have strong job growth if we have people coing into the work force, and wage gains are muted 4.2% year-over-year down from 4.3. that's good news for the stock market. why? because it means to answer your second question that the fed may not have to hike. now, don't get too excited because yields are pretty high, mortgage rates are high. your credit card interest rate is going to be high right now but that's the market doing its thing. it may mean the market is doing the work for the fed. it might bring a little bit closer to the day when the fed can cut back a little bit of the interest rates and let the reins out on the economy. >> lots of mays and mights there, though, i got to say. we're certainly going to be watching what fed chair powell does. >> i'm doing my best with what i've got. >> thank you, appreciate it. today in michigan, two of the 16 accused fake electors tried and failed to get their cases dismissed. nbc's shaq brewster is live for us in lansing, michigan. this was the first major hearing in this case, walk us through it. >> reporter: yeah, yasmin, the judge ruling that these cases will proceed, and she said that it would be inappropriate to dismiss these charges at this juncture before any official evidence has been presented to her. but in two of the motions that were filed, we did hear and see comments from michigan's attorney general dana nessel when she was speaking to a liberal group last month during a virtual conversation and said that she believed these fake electorsbrainwashed and that they genuinely believed that donald trump won the election. the defense attorney said, hey, that undercuts the arguments and the eight felony counts that the defendants are facing because, in those counts, which allege that these people engaged in forgery, that requires criminal intent. i want you to listen to some of the arguments that we heard from defense attorneys and how the state prosecutor responded. >> all of these charges require proof beyond a reasonable doubt that the defendant acted with the intention of cheating or deceiving. the defense believes regarding whether she was cheating or deceiving anyone was more than relevant, it's an element of each of the crimes. >> even if they're doing something wrong for the perceived right reasons, still makes that act wrong. >> reporter: now, we also know that the judge denied a motion to sever from one of theents or one of the defendants to sever his case from the other one important thing to point out here, while michigan was the first to charge these fake electors who you see on your screen right now, we do know that at least three others have been charged in the georgia probe that directly involves former president donald trump. >> shaq brewster for us, thank you, shaq. appreciate it. want to turn now to nbc's tom winter who's standing by for us. tom, you got the new jersey attorney general's office asking questions about the fatal car crash senator bob menendez's wife nadine was involved in five years ago. what are they looking at? and does this have any connection to the federal case against the senator and his wife. right, so answering the last question first because it's the easiest, at the moment there's no indication that this accident has anything to do with the federal case except for the fact that it is believed to be the reason why nadine, now nadine menendez, at the time nadine arslanian, needed a new vehicle. this is the damaged vehicle from the car accident we're looking at on screen, i can't describe -- yasmin, something obviously we've spent some time focusing on. that's kind of the connection to this, and we're wondering why she needed a vehicle at the time, and this is apparently as you can acutely see the reason why. this is her on police body worn camera camera, and presumably the office of attorney general is asking questions of bergen county prosecutors in the bogota police department, that's the police department that you see there on camera, they're asking questions about how this accident was handled. was it handled appropriately, were procedures followed. some of the questions they might be asking are the very questions we're asking of why or perhaps was there ever any request for the records from the vehicle that would have indicated speed at the time of the accident. were there any records requests sent, subpoenas for information from her cell phone to determine if she was on her phone at the time of the crash. we know that there were two prior tickets, excuse me, that were issued to now ndine menendez for use of a cell phone while driving a motor vehicle, according to public records. there's a number of questions that they could possibly ask. there are a number of questions that we are, in fact, asking, but of course i have to say throughout all of this, of course nadine menendez has not been charged with anything pertaining to this crash. she was found not to be at fault by police that responded to the scene. so they have not themselves raised any questions about criminal wrongdoing. you are looking at her leaving federal court where federal prosecutors have accused her of wrongdoing. >> thank you, tom, appreciate it. coming up, did former president trump spill military secrets to a foreign national at mar-a-lago? the new report raising serious national security concerns in just 60 seconds. we'll be right back. y concerns just 60 seconds. we'lbel right back. your brain is an amazing thing. but as you get older, it naturally begins to change, causing a lack of sharpness, or even trouble with recall. thankfully, the breakthrough in prevagen helps your brain and actually improves memory. the secret is an ingredient originally discovered... in jellyfish. in clinical trials, prevagen has been shown to improve short-term memory. prevagen. at stores everywhere without a prescription. welcome back. the big question did president trump spill national security secrets to a member of his mar-a-lago club? there's this new report out from abc news and later matched by "the new york alleging that after leaving office, the former president discussed potentially sensitive information about u.s. nuclear submarines with anthony pratt, an australian billionaire who allegedly shared the informs with scores of others, including more than a dozenoreign officials, several of his own employees, and a handful of journalists according to sources familiar with this matter. those sources telling abc news that the potential disclosure was shared with jack smith's special counsel team and that pratt has been interviewed at least twice by prosecutors and fbi agents. i should note that nbc news has not independently verified this report. i want to bring in former federal prosecutor shan wu, also with us political white house correspondent msnbc political contributor eugene daniels as well. shan, let me start with you on this one. i want to read a portion of the "new york timeorting on this. according to another person mili with the matter, mr. pratts now among more than 8 people whom prosecutors have identified as possible witnesses who could testify against mr. trump at the classified documents trial, considering this reporting coming out of the "new york times" and abc news as well, how strong of a witness do you see mr. pratt being, shan? >> he sounds like a very strong witness. i think the question is his particular interaction with trump has not been charged. it certainly would be important evidence to get in front of the jury, but they're going to have to get it in under the category of it's evidence of trump's state of mind showing its intent. since it's not charged conduct, it would technically be outside of the court, hearsay. it's very powerful evidence. of course to the jury, the point would be this shows his m.o. this is how he treats classification. he doesn't pay attention to national security issues. he feels he's able to willy nilly share it. >> i want to read a portion of abc news's reporting as well, shan. two pieces of information about u.s. submares, the supposed exactr of nuclear warheads theytinely carry and exactly how close they supposedly can get to a russian submarine without being detected, some of which is what the former president it seems shared with mr. pratt. it is unclear if this information that was actually shared was accurate, but from a legal standpoint, does that even matter? >> well, it matters in the sense not so much the sharing may not matter, but smith's team would have to drill down to see accuracy, was that sensitive or classified information, and it certainly sounds like it would be extremely sensitive information. i would be surprised if it was verified as the type of information it was, and the category being sensitive, classified that wasn't charged. sometimes there are other reasons not to charge that. they may not want to have to reveal in court or to defense more information like that. that's the problem with these classified information cases, but it's certainly quite alarming. >> eugene, give me your reaction to this, especially in context to what we already know about what the former president had shared when he was in office as president of the united states. i remember with sergey lavrov over intelligence that he was given about israel along with what we now know that was revealed during his indictment in the jack smith election interference case in which he shared with journalists about a possible attack on iran. >> yeah, i mean, this is something that donald trump has done for a very long time, right? showing people and similarly trying to -- people that he's in the know, look at this thing that i have that i can show you that's really interesting, whether it's a letter from kim jong-un or the things you just laid out. and that as it was just stated shows the jury and also shows like the rest of the country and the world kind of how he views not just classified material but things in general, that it seems like you talk to folks who have been around donald trump for a long time, kind of information as information and there not being layers to what's super important. as president, he should be able to share, he believes, whatever he wants to whomever he wants. that is something that the people around him say he's felt for a very long time. whether or not at the end of the day this gets into the actual special counsel case and is seen by the jury, it is out there, and i think the jury after they're chosen and they say, you know, i've not seen anything, these things or whatever, it is out there and therefore the people are seeing it, and that i think is something really interesting, had the trump team is probably a little nervous and irritated about, especially because this is one of the cases when you talk to legal folks at times, that may be an easier one to explain to juries and people in general, you know, donald trump took things that he wasn't supposed to and he didn't see classified material as important to keep from people who weren't supposed to see it. that is an easier thing to explain than a convoluted complicated january 6th or election interference case. >> i'm wondering as eugene is talking about this and if they can use this, i'm just thinking through this, if they can use as a defense in a way in saying that he has been so liberal in his sharing of these classified documents, he didn't even necessarily understand the importance of classified material and who you can and cannot keep that from. can that at all be used in their defense, considering how many reports we have of how much he has shared when it comes to these classified documents also as presidents not just as a former president? >> i think legally that wouldn't hold water because the problem is -- unless he can show he was being told it was okay to do that, sort of the advice of counsel or he was told was not classified, it's not going to matter that his defense is he didn't understand it. that's almost like a mental competency defense. if it's classified, if it's national defense information, he can try, it's basically a jury nullification. i was really confused. i thought it was all mine, and they can try that, but it's not a very legally sustainable defense. i think to eugene's point, one of the reasons you see the trump team not reacting so much in the substance but saying these are leaks, these are leaks, they're very aware of the fact that this is beginning to seep out into the public that this is what he does all the time, and that's not good for the jury pool. >> shan wu, thank you, eugene daniels, thank you as well. all right, an unexpected move from donald trump's legal team, as the former president drops his lawsuit against his former attorney, michael cohen, trump had sought $500 million in damages against cohen who he accused in court filings of, quotes disparaging him through myriad public statements including the publication of a new book, podcast series and innumeral experiences. trump says he is dismissing the lawsuit now but promises to pursue it again after he has prevailed in dealing with the witch hunts against him. new details today giving us a glimpse at the just how ugly next week's speaker battle could get as 45 members of congress express frustration about mccarthy's ouster, one of those 45, republican congressman anthony d'esposito joins me next. we'll be right back. next we'll be right back. so many all star options. it's just for subway mvps right? >> i think a lot of work to do is probably an understatement. it's going to be an interesting week. it already has been an interesting week thus far over the last few days speaking to candidates who are throwing their name in the hat to run for speaker of the house. the fundamental changes i think are fairly simple in that we cannot allow to see what happened earlier this week to happen again. i don't remember that coming from a republican perspective. i don't imagine that the issue we faced is a partisan issue. i think that for the sake of this country, we don't need to see what happened the other day happen again. >> so let me get you on the record so i'm clear on what you're saying. are you essentially saying that to no longer have a motion to vacate raised by only member as this happened with matt gaetz bringing up the motion to vacate with former speaker mccarthy? >> correct. >> got it. do those changes need to be in place before a vote is issued for the next speaker of the house? >> i don't think -- i don't think that's necessary. i think that there should be some trust in our conference that we can move changes like that to the floor while at the same time electing the next speaker of the house. i think what's paramount right now is getting our government back to work. we last saturday, you know, worked this a bipartisan fashion to pass that 45-day cr, really putting the clock on the field in how much time we had to put appropriation bills to keep our government running. and obviously from the stunt we saw a poll by matt gaetz earlier this week, that has now stalled. the goal and the focus of all of us should be getting the gavel back smack down and let's get to work because that's really what the american people want to see. >> you say trust, are you willing to trust a conference that just ousted your speaker? well, i trust the 96% of the republican conference who, you know, have been unified and were unified earlier this week and that kevin mccarthy should remain the speaker of the house. the other individuals, matt gaetz -- matt gaetz, i do not trust, but i think there is trust to find with the other individuals that voted with him. i think that this -- these last few days have been a time for conversation. they've been a time for reflection, and i think that now we need to get back in that room on monday or tuesday and have real conversations. because like i said, this isn't about partisan politics. this is about getting our country back on track and making sure that we remain open now 37 days from now. >> i heard an interview with tim burchett a little bit earlier today in which he talked about how -- and he's one of the eight obviously for folks that don't know who voted to oust speaker mccarthy who talked about the fact that he felt marginalized, that his voice was not being heard and there was over spending happening in congress. what is your reaction to that? >> i don't think anybody's voice was not heard. from everything that i've seen over the last nine months since we gavelled into the 118th congress, speaker mccarthy and the entire leadership team has had an open door policy, and obviously governing and running the united states of america comes with compromise, and i think that there is no one member that's going to get everything and anything that they want. i think that we come to washington d.c., we come to capitol hill, at least i did, with the idea that you need to work together. i reflect back often on my days as an nypd detective working with people from all different walks of life, different economic backgrounds, different color skin, different religions and certain different political ideologies. we got out of the car each and every day in some of the most violent neighborhoods in new york city to get the job done, and that's what we should be doing in congress. it's not about, you know, feeling that you didn't get your voice heard. i believe everyone's voice is heard. i think, again, there's time for compromise, and we need to understand that we're doing the work of the american people. we're in the doing the work of our personal feelings. >> i'm glad you're talking about compromise and working together. i want to read for you this op-ed from democratic leader hakeem jeffries who pitched a plan for a bipartisan coalition in the house. let me read it for you. he says this, the details would beubject to negotiation, though the principals are no secret. the house should be restructured to promote government for consensus and facilitate u and down bills that have strong bipartisan support. in short the rules of the house should reflect the inescapable reality that republicans are reliant on democratic support to do the basics of governing. a small band of extremists should not be capable of obstructs that cooperatio what do you say back? what is your reaction to that? is this a feasible plan? >> i'm not certain. obviously i have to read the plan in place, but i think that i do agree with the fact that we need to work in a bipartisan fashion. but i do believe and we've seen it throughout the 118th congress that republicans have passed good legislation. we have put bills on floor and been able to pass them. obviously the last week or earlier this week, we did see matt gaetz, who i believe is an extremist, take out a personal vendetta on the floor of the house of representatives to oust the speaker of the house. what we're seeing right now, it all could have been avoided if minority leader hakeem jeffries and the rest of the democrats did not vote with matt gaetz. >> do you know if you're going to vote for jordan, scalise or hern? >> i do not. i think that we're going to see a lot come out over the next few days. i think that there may even be some others that are interested that are sort of keeping their powder dry and waiting to see how the next few days unfold. i look forward to electing the best person to lead this country forward and has a good finger on the pulse of new york. >> congressman, thank you, sir. appreciate it. we're following breaking news, a former u.s. army service member has been indicted on charges of attempting to pass national defense information to china. ryan reilly is on this and joining us now for more. this allegedly relates to a visit the army service member made to hong kong in march of 2020. >> that's important, that's when the pandemic was really hitting, so he's been in hong kong, basically been hanging out there for a really long time and trying to get this information to chinese intelligence officials. what's really interesting is a lot of this is based off of his own google results and a lot of the information that was on his icloud account that really gives you some real insight into what he was sort of thinking contemporaneously at the time. so in these early months he was googling phrases like soldier defect, can you be extradited for treason, questions along those lines, and then he also prepared these word documents allegedly that were on his apple icloud that also sort of went into the details of these classed -- this classified information he wanted to pass along. there's also an email to his sister that talks about what exactly he was thinking and said he learned information while working for the military that made him feel unsafe to live in america and that he wanted to sort of cut ties with america as much as he could. he was going to sell his house back home but didn't intend on having much communication with officials in america and had been trying to work out this visa process but over staying his visa in hong kong as he was trying to get into china. and actually prepared a word document written in chinese language, important classified high level documents is what it said, and then created another word document that ran through the information that he was actually trying to pass along to the chinese here alleged. >> ryan reilly, thank you for that update. we appreciate it. coming up, everybody, global outrage after activist morality police, yet another brutal assault on a young woman for not wearing a head scarf. what iran's government is saying, plus, reaction from a former state department official coming up. t official coming up. medicare and medicaid, i have some really encouraging news that you'll definitely want to hear. depending on the plans available in your area, you may be eligible to get extra benefits with a humana medicare advantage dual-eligible special needs plan. all of these plans include a healthy options allowance, a monthly allowance to help pay for eligible groceries, utilities, rent, and over-the-counter items. the healthy options allowance is loaded onto a prepaid card each month. and whatever you don't spend, carries over from each month. other benefits on these plans include free rides to and from your medical appointments. and our large networks of doctors, hospitals and pharmacies. so, call the number on your screen now and ask about a humana medicare advantage dual-eligible special needs plan. humana. a more human way to healthcare. theo's nose was cause for alarm, so dad brought puffs plus lotion to save it from harm. puffs has 50% more lotion and brings soothing relief. don't get burned by winter nose. a nose in need deserves puffs indeed. america's #1 lotion tissue. this month join the new subway mvp rewards program and get rewarded. get 50% off any footlong when you join subway mvp rewards. so many all star options. it's just for subway mvps right? is in ohio with the latest details on this. i know we just heard from shawn fain. give us the details of what we know and how much longer this may last. >> reporter: as for how much longer this may last, don't have an answer for you there. that is obviously part of the union's core strategy is keeping everyone guessing about where they may or may not move next, but what i can tell you at least for the time being, the uaw has not expanded its strike. so this is the first week since the strike began, so week by week, we have seen the strike expand twice now. there was the initial strike, and then they expanded against gm and stellantis, and then they expanded against ford and gm, and each of those two expansions, the company that was left out was said to have made progress according to the union. this time around the union did not announce any new strike expansion. that is a point of significance. the other thing that stood out is what the union said came from gm just before the union's president spoke a short time ago. here's part of what shawn fain had to say about what general motors is apparently giving in to now. >> we were about to shut down gm's largest moneymaker in arlington, texas. the company knew those members were ready to walk immediately, and just that threat has provided a transformative win. gm has now agreed in writing to place their electric battery manufacturing understood our national master agreement. >> reporter: yasmin, there are two things i want to point out there about electric vehicle batteries. evs are seen as the future of this industry. they are also something that has been a point of concern and contention throughout negotiations because there's the possibility that electric vehicles will require fewer workers to make them. so that in theory would mean fewer jobs. that is something that is a point of concern for people, and the other thing that is interesting about what gm has apparently agreed to at this point is that a week ago when ford went from being given an exemption on further striking to being included in a strike expansion, the ceo of ford said that he believes the union was holding off a deal largely over electric vehicle battery plants for that company. so you have to wonder what ford is now thinking that they are seeing that the union is saying that gm has agreed to something according to the union, that is, on a similar topic. so that's something we're definitely going to be looking for closely. we have reached out to general motors for clarification, for confirmation on this but have not yet received the statement. we do know that we are expecting something from the general motors team. this is something that gets to the heart of the long-term concerns for workers and for this industry as this industry moves toward an electric vehicle future. so this is something that could potentially be really pivotal and ground breaking moving forward, yasmin. >> certainly will, jesse from inside the train. the problem is it is unlikely the iranian government will release that footage to show what went o. but you look at the international community and how they view this, right? one year after the death of masa mahsa amini. will the community view this as something that is repeatedly happening against women inside the country of iran? >> the international community just awarded a nobel prize to an iranian woman who is fighting for things like being able to go outside with your hair uncovered. pretty simple freedom we enjoy here in the united states and elsewhere in most of the world, but is against the law in iran. the united states has sanctioned the morality police after last year's killing of mahsa amini and we're waiting to hear what the united states is going to do in this instance. we don't have many more tools left in the toolbox. the united states has sanctioned iran since 1979, multiple sectors, right? we have the energy sector because of the nuclear ambitions. we sanctioned the financial and banking. we've made it very difficult for anything other than humanitarian aid to get in there, but this pattern and practice of behavior by iran's morality police to physically hurt, assault, and even kill women is something that is known. it is something now that is becoming more of an outrage in the global community because of internet access, so supporting covert internet access for iranians has been huge. >> yeah. >> but unless -- at this point, absent being able to go into iran and directly influence their behavior, the global community is running out of options to match and meet the outrage of the women of iran. >> the thing is, though, it seems as if the regime right now in iran feels a bit emboldened, right? the $6 billion release of money being managed by the qataris, the prisoner exchange, yes, the sanctions that were leveled against iran basically in that same week that the prisoner exchange was happening, but then, oh, by the way, some reporting that we're hearing now of the possibility of resuming talks on the nuclear agreement with iran. if that happens, you have a lot of activists, especially part of the diaspora here in the united states who see that as em boldening the current regime in iran, especially when things like this are continuing to happen. >> not just activists but many members of congress, many voters who believe in a hard line against iran, similarly a hard line against other regimes where the united states have relationships, and also, those regimes that have massive human rights abuses. saudi arabia is the classic example, but the united states have major arms deal. it's a problem for the biden administration, especially with the progressive left. biden came into office saying he was going to hold human rights abusers accountable. then we see that he has cut new deals with saudi arabia. we're hearing about diplomatic talks to some degree with iran. and it's that practical thing that takes over, that the practicality they argue is that these regimes aren't changing anytime soon, so the united states should get what it can get. whereas activists and others will argue that the united states needs to stands up for basic human rights, if the united states doesn't do it even in words, strong words from the president, who else is going to help these people. >> thank you so
