his wife killed someone with her car and the damage to the car was enough that she wanted another car. and so the story of that bribe car in the indictment has just become very very dark. we will get to that later in this hour tonight. but it is mentioned in the indictment that there was a car accident but it doesn't say in the indictment that she actually killed someone. we have now learned all of that just today. >> that story, the more we learn about it the more we hear the details, it gets more depressing and distressing. . >> i can't imagine that it gets worse from here. this is bad is any such story has been. we'll get to that later in the hour. >> it is a gruesome chapter. in their life. i will be watching, lawrence. >> thank you, alex. thank you. today the day after a judge issued a gag order directly to donald trump, who was sitting right in front of the judge, in a new york courtroom, donald trump decided to leave that courtroom and leave town. that's how well that gag order worked. new york state attorney general letitia james, who brought the civil fraud case against donald trump, told the news media that donald trump show is over after donald trump left the building. >> so mr. trump is no longer here, the donald trump show is over. this was nothing more than a political stunt, a fund raising stop and now we can continue to go forward with our trial, and we are confident that justice will be served. >> fake tough guy don trunk trump did not dare disobey the judges gag order today, which orders don trump to not say a word about the judge's staff and the court personnel. so now we have proof that gag orders on donald trump can work. the gag order specifically did not restrict donald trump's comments about attorney general letitia james or the judge himself, and so, in his performances for the news media, going in and out of the courtroom, donald trump attacked the attorney general and the judge, mostly by calling them democrats. because it is a civil trial, don't trump was under no requirement to attend the trial, and so most members of the news media knew that donald trump was lying at the cose today when hesaid, i'm here, stuck here. i' rather be right now in iowa. i'd rather be in new hampshire, south carolina, or ohio, or a lot of other places. but i'm stuck here. donald trump's decision, not long after that, to stop being stuck there, proved that statement was a lie for anyone who didn't already know it was a lie, and because donald trump is uniquely stupid, and because he tells so many lies, he cannot possibly keep track of his own lies. exactly 100 seconds after donald trump said that he was stuck there, he forgot that lie, when he was asked, why he was attending the trial. when >> why attend? because i wanna go after the press. >> and with that answer, donald trump foolishly admitted to exactly what attorney general james accused him of, coming to the courthouse just to put on a show for the press outside of the courtroom. attorney general james said that donald trump speaking to the press in the hallway was just a political stunt, and she called it, quote, a fundraising stop. and once again, donald trump proved letitia james right by sending out this desperate fundraising email at 201 pm. friend, i just left the courthouse for the day for my unjust trial in new york. please make a contribution of any pay the legal bills that donald trump has decided he cannot afford. most trump voters never contribute a penny to donald trump. they don't fall for that part of the trump hustle. but the ones who do have the weakest minds in the history of political fundraising response. they worship amanda who began running for president saying this. >> i don't need anybody's money. it's nice. i don't need anybody's money. i'm using my own money. i'm not using the lobbyists. i'm not using donors. i don't care. i'm really rich. >> he never used one penny of his own money. but for those few weeks there, in 2015, when he was saying that, republican voters were saying that one of the reasons they loved donald trump is a candidate was that he would be incorruptible, because he never had to raise any money. and now donald trump is the american politician who has set the record for the most money raised to pay for a criminal defense attorneys. the man early trump supporters thought was so rich that he was incorruptible because he didn't have to raise money is now accused of being the most corrupt politician in american history who has raised more money for his individual benefit than any politician in american history. don trump's performance in the hallway of the new york courthouse where he could not keep his lies straight, is why none of donald trump's criminal defense attorneys can build a strategy based on donald trump testifying in his own defense. and on trump tries to perform for the news media, in the courthouse hallways during his criminal trials, anything incriminating that he might stupidly say can and will be used against him inside those criminal courtrooms, even if he is too afraid or two guilty to testify in his own criminal defense. leading off our discussion tonight is adam class feld, senior legal correspondent for the messenger and was in the courtroom for today's proceeding, also tim o'brien, senior executive editor from bloomberg opinion and author of trump nation, the art of being the donald. he is host of the bloomberg podcast crash course in an msnbc political analyst. also catherine christian, former manhattan assistant district attorney. she's an msnbc legal analyst. and adam, we have to bring in with you because you were there. you are in the courtroom today, and because i wasn't, and there is no transcript, i don't even know how to guide you in the questioning. report to us from the court room the things that we need to know today. >> one of the things that was immediately notable today was just how frustrated trump was. i think i said a little bit earlier in the day, in my reporting, that trump was at the zenith of his frustration. he was moaning in court at a time when the judge had basically accused his lawyers of doing performative questioning's. there was no jury here. then trump groaned and said something just mumbling something about treasury. it's a very cavernous courtroom. the lines were to mediately clear. it was clear that he was talking about the fact that it was a non jury trial. he was jotting down notes at one point. he threw up his hands. and then, as you noted, lawrence, he went out of town. he flew out to florida and that was the end of his three-day stint for the opening week. he is expected to testify. what happened in court much substantively and ongoing testimony by his former accountant, who had been very recently accused the trump organization of withholding records. his testimony continued. there was another accountant who was called. cameron harris. he delivered very brief testimony because he was only in town for a little while, but basically interrupted the testimony of the other counted, donald bender, who will return tomorrow. and that is what is at the heart of these proceedings. these transactions, the people who prepared the presidents, the former president's financial statements, statements of financial condition, and we'll get in the weeds of that, as the week continues, without trump there. >> kevin christian, one of the things donald trump likes to say in the hallway is that it's an injustice that there is no jury for this trial. but that is something his lawyers chose, isn't it? >> that's correct. there is a debate, and saying he probably was not entitled to one because this was a case involving the attorney general seeking equitable relief. but he didn't even ask for one so he could've astral one and litigated. instead the law is not clear, iran, or we should get a jury trial. so he literally a check off box the way it works in new york state supreme court. and his lawyers didn't do that. they now are saying well we weren't entitled to one anyway but he could've checked it off -- . i made his lawyers, don't blame him, his lawyers could've checked it off and he could've litigated and said we were entitled to. one >> tim o'brien, it was never supposed to come to this for donald trump. you wrote a book, the first real analysis, saying donald trump is not as rich as he say he says he. izzy sued you for that. but of course he could never let that case go to trial where he would have absolutely lost in the courtroom and so it never made it to trial. but his game in the past was always to scare people away from this very subject and try to scare you away from the subject of how rich is he. >> you know, lawrence, i was fortunate. i was in the new york times at the time. i had the backing of the new york times lawyers, my book publisher at the time. retain mary joe white. former u.s. attorney for the southern district of new york, who was my primary lawyer. a lot of journalists don't get that kind of support when people with resources come after them. even so, i think that trump believe that my publisher and or the times, the times wasn't a defendant, it's just me in my book publisher, would settle. and we didn't. and as that thing rolled along and we started through discovery getting his tax returns on his bank records, he became increasingly erratic and he actually wanted to settle himself at one point. and we had him so far out on a limb we were beginning to saw the limb off of that tree, that we refused to seattle. and we pushed along and ultimately a judge dismissed the case on summary judgment, saying that trump's claims that i had acted with malicious intent and accurately reporting about the shabby state of his finances was driven by nothing else than fact gathering. and the same issues are in play in this courtroom right now, this idea that he inflated his assets to get larger bank loans that he might not have otherwise is achieved, and he lowered's assets to pay the tax bill. what's remarkable is that he goes out in the hallway two days now. yesterday he went out into the hallway and he said, you know, it can't be fraud, because i was relying on the banks themselves to figure out the value of what i was giving them. which is sort of equivalent of a bank robber saying it can't be a crime because i watch into the bank and the teller should've known whether or not i was a bank robber. today he goes out in front of the cameras and says the numbers i gave to the bank really weren't accurate. in some cases they were too low. in fact they were much higher than the numbers are going to the bank. which is may help him in the idea of not misleading the banks but it is not helping with the tax authorities. and his lawyers can't risk strain him from self incrimination and displaying how ignorant he is without the possibility of some of the frauds he committed, because i think he retained them from a saturday night live skit. they are as performative as he is. he's performing for his voters. his lawyers are performing for him. and none of them are gonna get a good result. >> adam, apparently one of the judges complaints today is that the trump lawyers are performing when the judge says there is no jury here, what he means is, i'm the finder of fact here, and i'm the person you need to argue this case too. i don't need you to go through the kinds of questioning you're going through, because i already know what these facts are. the normal litigation scenario, those lawyers would recognize that. they would speed up. they wouldn't be bothering your finding the person in this finding. the trump lawyers apparently still need to perform for the people sitting beside them there the defense table. >> that's correct. the defendant was still at the table. i would give you a couple of examples. when that happened pretty recently. trump's lawyers have made no secret of the belief and trump has made no secret of his belief that the statute of limitations would throw out a number of claims. now this allegation has failed a couple of times at the trial level. the first department immediately to stop the trial. but they have, throughout the trial, lodged objection after objection after objection. after under the statute of limitations. look, you major record, they said, you can make a continuing objection that will serve the purpose of your appeal, your record is made, move on. and it took a long time of that for them to actually move on. today was a different issue. during the cross examination of an accountant, there was very combative questions, line by line, under these financial statements. the judge said, essentially, group things altogether. that didn't happen. the judge grew visibly frustrated. he pounded on the bench. instructed historiography her to record that he was pounding on the bench and said this is ridiculous. this is the dynamic that is brewing in court and it's going to carry over as cross-examination resumes tomorrow. >> catherine christian, we saw a gag order work today. don trump was told, don't you dare say anything about my clerk again, the judges clerk, don't say anything about these courtroom personnel, nothing. and so what it poses for other judges and poses for this judge is what else, what are the kind of comment might you want to restrict donald trump from saying? >> we'll, if he, in this case, says something about a witness, and there are a lot of witnesses to be called, you can anticipate, and i can guarantee, the judge engoron is going to make a judgment of witnesses. it was in direct response to the beyond the pale thing the donald trump did by posting this woman who is not the judge, we call them cords attorneys, posting her face up, accusing her of being schumer's girlfriend, putting a link to her social media, using her entire name. that was beyond the pale. and the judge just-limited it to his court staff and as of yet, at least in this trial, donald trump has not said anything about any witnesses. if he does, judge engoron will put a gag order about witnesses. so it will be a step by step. >> catherine christian, jim o'brien, adam klasfeld, thank you all for starting off our conversations tonight. >> thank, you lawrence. >> exactly! don't delay the game with verizon or t-mobile 5g >> for years beginning in the home internet. catch it on the xfinity 10g network. 1950s the speaker of the house was a democrat. beginning with sam rayburn and ending with tom foley. they included the most powerful speakers in the history of the institution, rayburn, mccormack, o'neill. every democratic speaker was powerful. every democratic speaker was effective. in those 40 years, republicans not only forgot how to be speaker of the house, they never expected to be. then, in 1994, without a single pundit predicting it, the republicans shocked themselves by winning the house of representatives for the first time in 40 years, and suddenly newt gingrich and to try to figure out how to be speaker of the house. he created the era of the government shutdown. no republican speaker has kept the job as long as he wanted to. republicans eventually turned against gingrich and every republican speaker who followed him. the longest serving republican speaker was dennis haster, who was later revealed to have been a pedophile and went to prison. after leaving the speakership. kevin mccarthy's failure as speaker is in its way the most spectacular since his speakership ended so dramatically with the first ever vote to vacate the speakership. the two leading announced candidates for republican speaker now are congressman jim jordan in congressman steve scalise. we already know that no matter who the next republican speaker is, that speaker will not be able to govern within his own party and will fail, as every republican speaker has, in trying to govern the united states of america. joining us now, democratic congressman maxwell frost of florida. he is a member of the house oversight committee. congressman frost, thank you very much for joining us tonight. i was thinking that when i was in my twenties, as you are now, and when i started working in united states senate in my forties, i had never seen a republican speaker of the house. i have never seen the house of representatives controlled by republicans. and when they first got that power i stared wondering, will they know how to do it? and pretty quickly proved, nope, they don't. and apparently they still don't. >> exactly. it's not just mccarthy. we know that the same thing happened with both boehner and gingrich before them. their own members threatened to overthrow them, to make sure that they lost their jobs just the way mccarthy just did. but they took a different road and decided to resign. mccarthy said bring it on, and it was brought on. it was brought on very quickly. and unfortunately we made history. and look, this is a somber moment. the house of representatives cannot take on any new legislation. all they can do is focus on electing a new speaker of the house. and guess what? the rule that made it so mccarthy right now is in the speaker is still the rule. and so what i'm telling folks is we need to work on making sure we get rid of this rule or else the house of representatives will always work at the bidding of folks like matt gaetz and the people on the far-right maga extreme wing of the republican party. >> the constitution only mentions one position in the congress. doesn't say anything about there being senate chairman or senate majority leaders. it does say that there has to be a speaker of the house. and right now, america does not have a speaker of the house. >> yes, exactly. we have no idea what the timeline is on how this is going to be -- we know both congressman jim jordan and steve scalise have announced their races, but we are unable to really understand where this is at. we will have more clarity next week. the entire republican congress or conferences and chaos right now. and they brought this upon themselves. we all knew this was coming. it wasn't a matter of if, it was a matter of when. and now it is happening right now. we are less than 45 days away from another government shutdown. we have a budget to get through. we have a lot of work to do. and the republican party has imploded from the inside out. >> none of us really have any tools for predicting what happens next with the republican, the current republican control of the house. because none of us have ever seen anything like this. how many ballots will it take for either jordan or scalise to emerge as the front runner? then how many ballots after that? we don't know. but what we do know, what we do know, as kevin mccarthy proved, and paul ryan proved before him, the position of republican speaker is a powerless position, leaving the house dysfunctional. >> 100 and 10%. and what we have seen here is, every time it becomes very dysfunctional, it has been under republican majority. and like you said at the beginning, they are just not ready to govern. this is not, i'm not even talking about ideology or left versus right. this is about, does your conference or caucus have the ability to govern, to pass legislation, to pass budgets, to work for the american people, and what we have seen since the day i came to congress, because remember, i didn't get sworn and on january 3rd like you're supposed, to i got sworn in many days later, on a friday night at 2:15 am, because the republican party could not get it together. what i said then and what i say now is that was a microcosm and a model of the next now year of the republican majority, and so we'll see what happens. there's no way to know what the next few weeks look like. we can only hope that they get it together so we can move on with the business of this country, co-governance working together. we passed a continuing resolution to stop us from going into a government shutdown, and guess what? you've got maybe eight bad apples in the house of representatives. if we could just straighten them out. republican governments in the house of representatives would go smoothly. >> so let's just back up for a minute. the two alternatives here are jordan and scalise, who both voted not to certify the election of the president of the united states. think about this, lawrence. i often thought, what is it like to work in the biden white house in congressional liaison when you have to go over and talk to people. i mean okay, maybe you don't like your boss, you don't like that, you dealt with that when you worked on the hill, but they don't think that your boss is a legal president. where do you begin with that? it's just such dysfunction. and the heart of it, why does the republican party exist now? there is no governing philosophy, like you've been talking about all night. it exists to defeat democrats and electra publicans. and that's sort of the definition of a cartel or syndicate. like opec. no one asks opac what is higher purposes. they sell oil. and the republican party is just lost. >> yeah, if they believed in something, you could organize around that. and you have pointed out that this was a party that said, for decades, that it wanted to reduce or control or cut government spending in different ways. we know there was a certain amount of gamesmanship in that, the things they were afraid of cutting. but then donald trump comes in and they forget all of that. they never mentioned. it they raise the debt ceiling for donald trump whenever necessary. we're dead skyrockets under donald trump. they abandoned all sorts of things. that they we thought they thought prior to donald trump exposing, as you said, that it was all a lie. >> all of these things that we have put forward as republicans as deeply held values turned out to be marketing slogans. i don't know any other conclusion to come. two people don't abandoned deeply held beliefs and a couple of years unless something extraordinary happens to counter them. it's not just the party drifted away from these principles. they are actively opposed to them. character counts. whatever happened to? that personal responsibility. now do you ex if you accept personal responsibility you are champ, you're a soccer. the pro putin element of american politics is in the republican party. there is absolutely no reason that the party can articulate a governing philosophy. say what you will about someone, pick bernie sanders. bernie sanders has a philosophy of government. he can argue with you. you can head, you can love it, but he can articulate it. i don't think anybody on the conservative side can do that with any credibility now. >> as to matt gaetz future in the house of representatives, there's talk today about oh why, don't we just kick him out of our group of republicans. i haven't heard anybody say a word that can in anyway change the matt gaetz dynamic in the house of representatives. >> yeah, what do they do when mccarthy was speaker?
