Youve got to be kidding me in case youve forgotten, im jimmy. Ive been off the air five months. Weve been gone so long. Weve been gone so long, the bachelor is now a grandfather. Its been a long time since our last late show. We looked at the calendar today, and check my math on this, i believe we have been off the air for 154 indictments. A look at some of the late night shows which returned to tv for the first time in five months. We have a lot to get to this morning, including a recap of day one in Donald Trumps Civil Fraud Trial in New York City. Part of that is the Punishment Phase. Well tell you about the moment that seemed to enrage the former president. Also ahead, the latest on Kevin Mccarthys Speakership Battle as a far right Republican Forces a vote in the house to decide his fate, whether he keeps his job as speaker or whether democrats will step in and bail him out just to keep the government running. I think democrats will. Are people falling down . You okay, willie . We have some equipment moving. Everybody is in place now. Were getting ready. Okay. Once the show starts, well be ready and set. I mean, jimmy fallon, really excited, as excited as the guy who went to see beetlejuice with lauren boebert. Thats saying something. Whats nice is, you have five months of pentup jokes. Theyve been sitting at home, right, writing these things. Oh, we missed this one, missed this one. They emptied the chamber of the summer jokes yesterday. Yeah. And a lot going on in politics, as Stephen Colbert mentioned. Several indictments since last on tv. Incredible. I heard Something Interesting yesterday. I was watching, as i do, willie, on the way down to the orphanage. I was looking at instagram reels. I think thats what the kids do. Rush, stuff like that. Theyve already gotten my algorithms down. It is nick saban, you know, yelling at the press. Its will ferrell clips. Its also snl clips. Speaking of comedians, they were asking who the best person was for weekend update. Of course, there have been incredible people for weekend update. I dont know if youve seen this clip. Started with chevy chase. Mcdonald, go down the list. He actually said, dennis miller. He goes, i understand all the politics of this, all the he said, i was on a ride with dennis, and hes sitting in the backseat. Hes got a notepad. Were, like, driving a couple miles, and hes just sitting there writing. What are you doing . Oh, im writing jokes. Read him the jokes, and he said, they all could have gone on any show anywhere at any time. Again, a fabulously, fabulously talented actor who, of course, we dont hear that much from anymore. Oh, so funny. And so great in that chair. You mentioneded norm mcdonald, too. His head writer, jim downey, was on conans podcast. If you love comedy and snl, its funny. He step by step walks through how he writes the jokes and why its so good. You have seth meyers, tina and amy. I mean, thats been a cradle of greatness for a very long time. Oh, yeah. Dennis miller truly was one of the funniest guys in the world. Still is. All right. Now, were going to get to things that are unfunny, and that is our top story this morning. Yeah. One of many. This first one especially. The longtime Chief Of Staff for donald trump offering his harshest criticism yet of his former boss. John kelly sent in a statement to cnn which he backs up many of the stories recounted recently of Trump Lashing out against u. S. Service members and veterans. Kelly confirms, trump didnt want wounded veterans in a Military Parade planned for Independence Day because it, quote, doesnt look good for me, meaning donald trump saying that. Kelly also says trump, que, rants that our most precious heros who gave their lives in americs defense are losers and wouldnt visit their graves in france. Kelly then appears to comment on trumsost recent attack o general mark milley, in which the former president suggests he be punished by death. Kelly describes trump as a, quote, Person Who Cavalierly suggests that a selfless warrior wh h served his country for 40 years in peacetime and war should los his life for treason in expectation that someone will take action. In expectation that someone will take action. For him. Yeah. Like january 6th. Yeah. That Somebody Will that someone will kill. As the general said, he said it, an expectation that someone will kill milley for him. The statement ends with kelly saying trump is a, quote, person that has nothing but contempt for our democratic institutions, our constitution, and the re of law. There is nothing more that can be said. God help us. Kelly served as Chief Of Staff from 2017 to 2019. He has criticized trump before, but this statement marks the first time these comments have been confirmed by kelly, who was present at the time they were made. Of course, the Chief Of Staff is right in there and sees everything, all day, every day, and gets a real firm sense of a situation, which is why that Expectation Line is chilling and something we believe to be true and makes the support for trump out there all the more concerning. Well, its obvious. Its obvious what donald trump wants people to do, when they talk about, they should be killed, executed, they should be this, should be that. I dont think it is obvious to everyone. It is. Its obvious that thats what donald trump wants to do. Im glad the general said it. But you look at these horrific statements, willie. There were questions before when they first were in the atlantic, i believe, in early 2020, maybe 2019, who they were about. Was it john kelly . A lot of people thought it was. But who said it is not as important as what was said by donald trump. It goes all the way back to john mccain, obviously, Calling John Mccain a loser for being a p. O. W. Who sacrificed for his Band Of Brothers, who refused to leave vietnam, even though he could have because his father was connected. Just think about that. Donald trump uses his connections to have a doctor lie about bone spurs. John mccain uses his connections to stay in hanoi, being beaten and tortured so badly, he cant even raise his arms above his shoulders for the rest of his life, because he refuses to go home before Everybody Else that came in with him in that prison cell in vietnam. It goes on to, of course, hes at normandy, one of the most Sacred Places, and hes not wanting to visit. Its raining, he doesnt want to get out. He doesnt want to visit the markers, the tombs of soldiers and sailors and airmen and marines who died because, well, they died, so he considers them losers. At one point, he turns to General Kelly, who lost a son, and said, why would anybody do this . Why would anybody sacrifice their life for this country . Whats in it for them, he wondered. Yeah, whats in it for them . Again, this is just one more example, one more example of these people who once claimed to be the most righteous, who claim to be the most patriotic, who claim to be the most supportive of the military, lining up behind a man who is the antithesis of everything that they grew up believing was right. Now, they are behind him in this personality cult. Yeah. That mccain moment that you reference is such an important one. That was back in july of 2015. Important because it gave us a sign of what was coming, which is to say, he did something unthinkable, especially within the Republican Party, trashing john mccain, specifically his heroism in war, and his support went up. In that moment, we talked about it here and we talked about it privately, we said, hmm, Something Different is happening here. To your point, these are the men and women that we hold most sacred in this country and, as you say, republicans always have defended the military. We present this to Trump Supporters, how can you defend this . Theyll say, well, it was the media. He probably didnt say that. I dont know. Now, we have General Kelly, jonathan lemire, on the record in that statement to cnn saying, yeah, everything you read in the atlantic pieces, two of them, thats true. I was there. Those things happened. He did trash war heros. He trashed the militarys dead. He didnt understand why theyd sacrifice, what was in it for them. Yeah. Misunderstanding of the military. It doesnt change how they view donald trump. Kelly has been coordinating with journalists in the background, but, now, he put his name to it. It was, indeed, the battle there is a foundational battle from the marine corps in france, as many marines think, thats where they began, their origin story. Donald trump was dismissive and refused to go to the funeral that day because it was raining and he didnt want to get his hair messed up. That, kelly told people, was the last straw for him, when he realized what sort of person donald trump really was. Will this make any difference . I highly doubt it. Others who work for donald trump, the National Security establishment, who have spoken out against him, general mattis, general mcmaster, john boll bolton, the list goes on and on, theyve forcefully condemned his patriotism, his leadership, and his character. We know what Rex Tillerson thought of him, as well. We cant say it on familyfriendly television. We should take in, elise, the idea that these are people who worked with donald trump day after day in the most sensitive, important moments of his presidency. They knew him best. Much like we saw at the january 6th trials, much like were starting to see in the criminal proceedings, those who spent the most time with trump are saying, he is unfit to hold that office again. You know, john kelly always seemed to have somewhat of a Pain Public Posture when hed be out in public, with the exception of john kelly himself had a pretty bad episode when it was the slain husband of the widow, la David Johnson, and the fight started when it was the worth episode when he was picking on the widow whose husband died a week earlier. That was that, to me, was, oh, this is what trump thinks of our military. He cares so little for the loved ones of those who have fallen in battle, that he literally be belittle them in the aftermath of that loss. So this is nothing new. We know the level of respect that trump has for basically anyone but himself, and we see the contempt in which he holds those who volunteer for service for their country. This is nothing new. It reminds us of the mans fundamental character. I do think, willie, that if this continues, taken together, i do think General Kelly, who served this country proudly and ably for so long, who lost a son, sacrificed a son for this country, General Kelly. General mattis, who, again, another war hero, another man that trump was just so thrilled to have come before him. General mcmaster. I do think if these generals do come out and do speak out and do speak out publicly on camera and do have make a concerted effort between now and next year to talk about just how unfit donald trump is to run for office and to be president of the United States again, be Commander In Chief again, i do think trumps generals, so to speak, the people we were talking about back in january of 2017, trumps generals all coming out, condemning them for all the horrific things he said about our Men And Women In Uniform in this country, i do actually believe that is one thing that could have an impact. With the cult, with people that are sharing and laughing about Nancy Pelosis spouse getting his head bashed in . No, no. But with voters that are actually going to decide this election in the suburbs of atlanta and the suburbs of philly, the suburbs of detroit, and suburbs of milwaukee. We may well hear more now from General Milley. He was somewhat restrained, as the chairman of the joint chiefs of staff, but he may be able to say more. Sat for the 60 minutes interview last week, as well. Joe, for People Like Us Who Revere The People who serve this country and try to lift up injured members of the military and help them, the comments most recently in Jeffrey Goldbergs atlantic piece were particularly abhorrent. He told General Milley that, after a man, a warrior who lost his leg to an ied attack in afghanistan, suffered strokes because of it, been through hell, saying, god bless america, that donald trump says, nobody wants to see that, speaking of injured veterans, warriors, dont let that happen again. How do you defend that . Youre willing to excuse a lot of things about donald trump. We get that, over the last eight years or so. But that, attacking a wounded warrior, how do you defend that . Willie, you see this firsthand in all the work that you do. These men and women are the best of who we are, the best who have gone over to protect and defend this country, who, like bob dole, left a part of themselves in battle. Like bob dole. Donald trump would call bob dole a loser. They come back with injuries and, yet, they stay together. They keep fighting a new fight, a new cause. You see that every day. These are our heros. They are. It stays with them for the rest of their life. Its a reminder that donald trump is all about the superficial. How does it look . Hes creating a play. He is putting on a tv show. If it doesnt look just the way he wants it to, well, then the people who are ruining it for them, in his eyes, are disposable, including hero Military Veterans. All right. Speaking of how it looks, donald trump was in court yesterday for day one of a massive fraud trial against him. Hes back in court today. Welcome back at 18 past the hour. Donald trump is expected to be back in court this morning for day two of his Civil Fraud Trial in New York City. Yesterday, the Punishment Phase began after the judge, last week, found trump, his two oldest sons, and his Company Liable. For fraud. The former president sat with his arms crossed as his defense team and prosecutors from do you think he is bored yet, being in so many courts . Nope. This is what he does. He goes to courts. This one hit his where it hurts. Its about his money. There is a Monitor Being Put in charge of his companies. Theyre going to figure out whether or not they need to be dissolved. Everything this guy is made of. I would say he built, but he actually probably inherited the equivalent of 1 billion from his dad. He inherited about 400 million in terms of todays money, lost most of it. Prosecutors from the new York Attorney Generals Office gave their Opening Statements. Sitting a few feet away from him was the Attorney General herself, Letitia James, Who Leered At Trump while cameras were briefly allowed inside the courtroom. This was quite a scene. I dont think everybody expected those cameras to be in there. An attorney for trump complained that the former president did want a jury to hear the case, but the judge noted that his team had never asked for a jury trial. After Opening Statements, prosecutors played taped depositions from trump, his sons, his former attorney, michael cohen, and his companys former chief Financial Officer, Allen Weisselberg. Then they called their first witness, a former accountant who spent years handling the former president s tax returns. According to our team inside the courtroom, trump seemed to take issue with some of what was being said during the testimony and became extremely animated with his lawyers. His face is said to have become beet red, while his pointed and finger waved at his lawyers. For the most part, though, trump appeared subdued during the trial. Outside the courtroom, though, he was anything but. Here is some of what he said to reporters during a lunch break. When you have a radical left Attorney General like Letitia James, who is a disgrace to our country, who got elected on the fact that shes going to take down President Trump, were going to take him down. This is called Election Interference, and worse than that, really much worse than that. You dont get much worse than Election Interference. I got a call last week, sir, we lost part of the case. I said, the trial didnt even start. I guess it starts today. He ruled we lost a big part of the case. Hes a Democrat Club politician. Hes a democrat operative, and he is a disgrace. Thats a really, really i think i wasnt in that part of my Law School Class on judge trials, where the professor told you, if its a judge trial and the judge is determining your future, that its best for you to insult him and call him a loser and attack him. Again, it makes no sense. As we were watching its also dangerous. For 15 seconds yesterday, as donald trump was saying that this guy could be arrested, should be arrested, of course, theres the threat, theres the intimidation. If i get elected president , im going to arrest you, is what donald trump is saying there. But, you know, any other defendant in america in this position, willie, thats already been found guilty of fraud, the evidence is very clear against him, you know, he is overexaggerating, and everybody in new york had known for decades this is what hed do, you would actually have somebody get on the stand and apologize, saying they made mistakes, they did this, did that, i am so sorry, your honor. Im going to straighten this up. Were going to put systems in place to take care of it and throw ourselves on the mercy of the court. Ill let you know, were not going to do this again. Were going to make sure that anything we file with Tax Authorities of New York State and with banks, its going to be correct. I know we fell far short of the mark. Then you would have a judge saying, all right. This is a problem. Well put your company on probation, or however they do it. But, instead, you have donald trump, who has been caught. This is the bank robber that has been caught. Or this is the congressman part of this has been decided. Caught in a scam with money in his pockets, like jammed into his pockets, looking like the michelin man because he has so much money jammed into his coat pockets. You know, yelling and screaming about unfairly being prosecuted. Hes already been busted. Like, hes already been caught lying. Hes already been caught saying that he had a 30,000 square foot residence when it was, like, 10,000 square feet. Okay, claiming that he had the most expensive property in all of New York City. What a zeen. Well, that was a lie, as well. What is he doing . He is doing the exact opposite of what he should be doing. Hes continuing to drive his car off the cliff. He leaves his lawyers in a nowin position. After its over, hell probably call for the execution of the judge like he called for the execution of General Milley. It is a zero sum game, and its a game he loses every time. As you say, the facts and evidence are stacked against him, so now all he has is to play that outside game, where he goes outside the courtroom, attacks the judge, attacks the prosecutors in this case. By the way, you can expect to see that speech, cue it up every time he comes out of one of the other courtrooms. Attack the judge. Attack the process. Theres a witch hunt against him. Some extraordinary pictures on the covers of the newspapers here in new york this morning. Looks like an ad for the apprentice. Wall street journal, a similar photograph of the tantrum outside the courtroom, as two Police Officers stand by. Lets bring in bloomberg legal and politics reporter, erik larson. He was in the court overflow room yesterday covering trumps fraud trial. And professor of law at colombia, john coffee jr. , author of corporate crime and punishment, the crisis of under enforcement. Erik, how does this look right now for donald trump . I think the fact he showed up, actually, its a position of strength for him, which is interesting. I dont think anyone was expecting him to show up until the last minute. Now, we see why. He was able to do a lot of that grandstanding, give that big speech outside of the courtroom. Every time there was a break in the trial, he was viciously attacking the judge and the Attorney General. So this is, you know it helps him in part of his campaign, to be honest. As you said, hes already been found liable for fraud, so the case is kind of in the states favor pretty strongly. The judge clearly has accepted a lot of what the state has to say. What kind of defense are you hearing from his legal team, other than Letitia James is biased and the judge is a democrat . Is there anything on the evidence where theyre defending themselves . Yes, theyre focusing a lot on whether or not any banks were actually harmed by this alleged conduct. Theyre looking at these inflated Financial Statements, wildly inflated according to the judge, from 2011 to 2021, saying these were submitted to various banks, Deutsche Bank and others, insurers, to get better terms on lones and policies for years, and he reaped 250 million in illegal financial benefits as a result. But he says these banks were not harmed at all. He paid back all these loans. They actually made 100 million in interest off of him. Both sides are calling Bank Employees as witnesses because they both think theyll be able to back up what they say. At the end of the day, even though he has been found liable for fraud before the trial, there are other significant claims, including falsified Business Records, things like that, which the judge could still rule in his favor on. Professor, lets set aside trumps hysterics outside the courtroom and talk about the merits of the case being tried within it. What have you heard so far from both the state Attorney General as well as trumps defense team . And how strong do you think the claims are . Hes been found liable, but for how much . Well, i mean, hes appointed the judge has appointed receivers who still have to be named, who are supposed to liquidate all these companies that are within trumps organizations. The one thing i think you were missing is as petulant and silly as trump seems, he is probably being rational from perspective, because he wants to exploit this trial. It is an opportunity to show again that he is the victim of political persecution. That has been his main theme, and its raised his popularity in the republican primaries. So hes figured out that, im going to go to this trial. He almost never has gone to civil trials. But he is doing it because this is a way to raise his theme, that there is a persecution going on and you should raise in arms and support me because were being attacked by the evil government. Erik, explain, if you could, what exactly has been decided and what still has to be decided in this case. And how long the Punishment Phase of what has been decided could take. Well, the judge has said this trial is going to go until december 22nd, so we can expect a lot of evidence on whether or not these six remaining claims trump is liable for, whether or not he conspired to falsify these Business Records, whether or not they were used in specific transactions in a way that harms these banks, and then Insurance Fraud is another claim in there, as well. But then there will have to be more arguments on whether or not the full 250 million has to be disgorged, and whether or not trump and his two sons, who are also defendants, would be banned from being directors or officers of any new york based company. As the professor just said, you know, theres this whole other aspect that has to be decided outside the trial on this fraud claim thats already been against trump. We really dont know how far thats going to go, what the outcome will be. Even trumps lawyers dont know, and the judge hasnt really clariied what it means, that all these companies are going to have to be dissolved once this receiver is put in place. But right now, there are five more claims that the judge has to decide on liability for, and then, based on those, hell go into the penalty phase. So, professor, i spent the day listening to commentators who cant seem to get over their fealty to donald trump. One of the arguments they made was, oh, my gosh, this is so political. If this Attorney General can do this to trumps business, he can do it to your business, too. Im curious, if you could put into context these Fraud Allegations that hes accused of, and some he has been found liable for, how do they compare to other White Collar Crimes in their severity and their size . We have to understand that the Attorney General is operating under a unique statute that authorizes her, and no one else, not private plaintiffs, to dismantle, to liquidate a company that is engaged in persistent fraud. She does not have to prove that anyone has been damaged. She only has to prove this company consistently defrauded people, in this case by inflating its assets, and because you are persistent fraud, were going to throw you out of New York State. That was the intent of the legislature, but this implies only when the Attorney General brings the case. Im curious, from what you have seen, do you believe the Trump Organization has been is it likely they have been engaged in, quote, persistent fraud . Well, i think the inflation of assets has been shown. He granted Summary Judgment, and there was lots of evidence. Weve heard the stories about calling a 11,000 foot apartment a 30,000 foot apartment so that you could get a higher valuation on it. They are treating rent controlled buildings as if they were the same as nonrent controlled buildings. Thats a way to inflate assets. The evidence was strong with the Summary Judgment, and he is an experienced judge. You dont grant Summary Judgment unless you believe there is no fact in this case that really has to be further resolved. It is all clear. All thats really left now is the penalty. Wow. Yeah, and that sounds certainly, mika, through the years, like persistent fraud. Professor at law at colombia, john c. Willie and i came up with this concept. What year did we come up with this concept, willie . Just after the war, 47, i think it was. 47, a couple of kids, couple of crazy kids coming back. We were so swept up with excitement. Please, please, just get to steve. Everybody, you know nobody would kiss me goodbye. But we said, we should do that inside that building over there, and thats what was born. Steve rattner, of course, has been with us for over a 50th of a century. Steve rattner, so glad to have you here. The kids have now weve given them time to wake up. Before we let you get to the charts, i want to ask you about this deal. Its a shortterm deal on capitol hill to keep the government open, the Continuing Resolution. They kicked the can down the road. Talk about how much work there still is ahead. Oh, well, im going to show you some numbers that will show you how much work there is ahead. They accomplished nothing. They simply, as you said, kicked the can down the road. Theyll have 45 days in which to do two things. One, figure out whether they want Kevin Mccarthy to still be the speaker anymore. Now, there is this motion to vacate that matt gaetz filed, and itll consume an enormous amount of effort and time, and they have to resolve unbelievable differences, which ill show you, between the two sides about how much we should be spending. Why dont we start with how much the house and the senate plans to clash, and how difficult it is to actually synthesize those two plans. So youll remember back in the spring when we almost defaulted on our debt, there was an agreement between the white house and the republicans as to what spending would look like for this coming year. When we talk about spending, were talking about nondefense discretionary, meaning, we dont talk about social security, medicare, a lot of the parts of the budget. Ill show you that in a second. We talk about things like the Transportation Department or Housing Department and so forth. Out of that pool of money, the deal between the president and the republicans back in the spring was to make a 2 billion reduction. Spend 2 billion less in the fiscal year that began this weekend than we did the previous year. Senate republicans and democrats, bipartisan, they agreed on actually increasing spending by 4 billion. They put some money back for a few things that they thought were important. Mccarthy came up with a bill that he hoped would pass the house that involved 60 billion of spending. The hard right, the maga group, whatever you want to call them, killed that bill. He came back with a Continuing Resolution that would involve cutting 196 billion of spending. They rejected that bill, too. That is where we are now. Let me put those numbers in perspective for you. As a share of our economy, obviously, the original two deals we talked about, very small effect on our not on the economy but on our spending. The Mccarthy Bill would have cut spending in this category by 9 . The house Continuing Resolution would have cut spending in this category by a full 30 . Ill show you in a bit what some of those implications are. Steve, lets move over to your second chart, about where the money is coming from, the proposed bill here was 60 billion of proposed cuts. Massive reductions in nondiscretionary funding. The mandatory funding is obviously the biggest part of the budget, so what are they going after, because they cant touch that . Right. Because they cant touch that, and let me show you how small a part it is, so you have here, this is our nondefense discretionary. 14 of the budget. Defense is 12 of the budget. Social security, medicare, other kinds of aid to people who are suffering, and then a bunch of other stuff, and interest on the debt, of course, we cant cut. Theyre fighting over this tiny sliver of ukraine aid, which is more symbolic than substantive, obviously. Youre cutting out of this little piece of the budget. The consequences of that are Something Like title i education, 77 cut. Women, infants, children, like food stamps, 70 cut. Affordable housing, 66 cut. So on and so forth. The Labor Relations board, 33 cut. Water quality, 55 cut. So the math is almost impossible. How do you reconcile . This is the smaller of the two. This is the 60 billion one. Imagine if you tried to do the 196 billion one, which they havent even laid out the specifics of. So this would really gut and this is what theyre trying to do, of course this would gut so many functions of the government that so Many Americans depend on. Yeah, were talking about things like grants for lowincome schools, water quality, et cetera. Lets look at that third chart, steve. How does the debt and deficit play into this . As weve said many times, the last administration under donald trump in just four years added nearly 8 trillion to the debt. What does it look like now, and how does it affect this conversation . Look, we do have a deficit and a debt problem. That much of this is legitimate and fair. Our deficit this past fiscal year was 2 trillion in the federal government. Its going to be 2 trillion again this year. You can see here the deficit, which is this whole space in here. What happened . Basically, we kept our Revenue Share of the size of the economy roughly flat. We did cut a bunch of taxes. You can see the george w. Bush tax cuts, the trump tax cuts. We held on our revenues. Meanwhile, our spending was exploding. We end up with 2 trillion deficits. That, of course, turns into debt. We have 33 trillion of debt at the moment in this country, and lets just show where that came from. All the way from 1776 until bush took office in 2001, we accumulated and that includes fighting wars, world war ii 5. 7 trillion of debt. Then you can see every president since then has added a huge amount of debt. Trump, as you just said, willie, 7. 8 trillion of debt in one term, far less than, for example, barack obama across the two terms as a proportion. Biden so far, 4. 6 trillion. These are just unsustainable amounts of debt that were adding, but you cant do it by cutting all that other stuff. Its just too much deficit relative to what you have available in those discretionary programs. And, steve, thats always been the problem. Its always been the problem. Its something that we dealt with going all the way back to 1995 when we were talking about balancing the budget. People say, oh, well take from foreign aid. Well take from food stamps. Well take from this. No. No, its social security, medicare, medicaid, defense spending, and, now, a hell of a lot more than what we worried about in the 90s when we tried to balance the budget. Interest on the debt and the massive tax cuts to the richest americans that trump gave us a couple of years ago. So, you know, weve had, for 20 years now, president s trying to do everything all at once. Not only have they said, well take all guns, take all butter, well also continue to cut taxes for the richest of americans, which, of course, is, sadly, inverted our tax system in such a way that you look at billionaires, you look at the richest americans, they have much better Tax Treatment than Working Class Americans or Small Business owners or entrepreneurs who are just starting up, who are paying, you know you know, a lot of workers in states like new york, connecticut, new jersey, illinois, california, theyre paying 50, 51, 52, 53, 54 of every dollar they make to taxes. Whereas, you have people in wall street paying 15 , 16 , 17 , these billionaires. Its just insanity. So talk about how were not going to balance the budget with these yahoos saying, oh, cut food stamps, cut foreign aid. Its just a small, small proportion of our budget. Yeah, look, we have a 2 trillion deficit, and all that other stuff over there only adds up to less than 200 billion. And itd completely, completely and utterly gut the federal government in terms of what it does. Yes, were not even getting close to balancing the budget. Joe, you said it right. The conundrum is we have all the stuff nobody feels we can cut, and we can debate, maybe we should be doing something in here, but right now, these are untouchable, even donald trump says theyre untouchable. You have this little sliver youre dealing with. Spending has been going up by a rapid rate. Ta taxes, as you point out, weve been cutting and cutting, tax cut, tax cut. Tax revenues have not been going up as a share of the economy. You have to do something. You either have to deal with taxes, and i agree with you about where the money should come from. There are a lot of rich people not paying their fair share, or you have to deal with making some changes in here. Otherwise, youre never going to get this deficit down to anything that looks like a balanced budget, let alone something that is a balanced budget. I know it sounds radical, but a fifth grader could say, well, it seems to me you have to make it so your revenue line matches your spending line. Thats what we have to do. So do you want to jack taxes up that much . Thatd be bad for the economy. Do you want to cut spending that much . No. I think that would cause a lot of pain in a lot of ways. Weve got to figure out a way to have those two numbers come together, and thats going to take leadership. Yeah, its going to mean Cutting Taxes or raising taxes for some of the richest americans who have had a pretty incredible run over the past 20 years, going to have to raise their taxes so they pay the same share, the same percentage that their clerical staff pay, that Small Business owners pay. Its just not fair. Then, yeah, we have to figure out where were going to save money. Those number haves to come together. Steve rattner. As weve been saying time and again, i said it during the trump years, we cant push this off any longer. Steve, i know you and i were saying this during the obama years, too. I mean, you were part of an organization. Weve been saying this a long time. Its just, why am i going on right now . Because the problem just keeps getting more difficult to fix. If we dont fix it very soon, itll become unfixable for the next generation. We have a 27 trillion economy every year, gdp. Thats extraordinary. First in the world. Yet, were carrying around 32 trillion in debt. That doesnt add it for long, does it, steve . No. By the way, our debt to gdp ratio, the debt in relation to the size of the country is higher than almost every other country, france, germany, you pick it, the uk. We have more debt. Yeah, joe, youre right. I mean, weve got to do something here. Whats interesting is that nobody cares anymore. Nobody cares. Nobody cares. 2 trillion used to be a lot of money, yet we just went from one fiscal year of 2 trillion deficit to the next of 2 trillion deficit, and you dont hear anybody saying anything about it. Nobody cares anymore. The only time the republicans care is when theres a democrat in the white house. Thats the only time. Again then they do it. Weve been talking about this nonstop. Republicans, when trump was in office, they went along for the ride. They spent, spent, spent. I said this during the obama administration. The only time republicans care is when there is a democrat in the white house. Sure enough, republican gets in the white house for four years, and they spend more money. Did the same thing. The longest serving white house Chief Of Staff for donald trump is offering his harshest criticism yet of his former boss. John kelly sent a statement to cnn which he backs up many of the stories recounted recently of trump, lashing out against u. S. Service members and veterans. Kelly confirms trump didnt want wounded veterans in a Military Parade planned for Independence Day because it doesnt look good for me. Thats what trump said, quoting him. Kelly also says, trump, quote, rants that our most precious heros who gheir lives in americas Defensare Losers and wouldnt visit their graves in france. Kelly then appears to comme on trumps most recent attack on general mark milley, in which the former president suggested he be punished b death. Kelly describes trump as a, quote, Person Who Cavalierly suggests that Afless Warrior who has served his country for 40 years in peacetime and war should lose his life for treason in expectation that someone will take action. Again, that the line. Its just like january 6th. He says these things because he wants his supporters to follow through with him, whether its a Riot On January 6th or the execution of a military war hero. Kellys statement ends with him saying trump is, quote, a person that has nothing but contempt for our democratic institutions, our constitution and the rule of law. There is nothing more that can be said. God help us. Mike barnicle, we saw these comments come out a couple of years ago in the atlantic. There wasnt a name attached to them. A lot of people thought it might be the general, but the general came out and put it on the line. God help us. Here he is serving as Chief Of Staff. A guy who gave his life for this country. A guy who saw his son literally give his life in sacrifice and service to this country. There is donald trump, a man he is working for as president of the United States, that is talking about how him bringing Wounded Warriors to him is something he doesnt like. It doesnt look good for me. People who die in battle give their lives for this country, calls them losers. So there it is. There it is. Joe, it is hard to describe what a hollow, empty, selfcorrupted individual the former president of the United States is. One of those conversations that john kelly now accounts recounts took place at Arlington National cemetery. The former president has a negative aspect to him, obviously, but says something extraordinarily negative about people who fought and died for their country. The setting where it took place is General Kelly is standing next to the former president in Arlington National cemetery, section 60. Iraq and afghanistan veterans are buried. Trump says what he says. Within five feet of a headstone marked for robert kelly, lieutenant robert kelly, United States marine corps, killed in afghanistan, 29 years of age. General kellys oldest son. He says what he says right there in front of General Kellys sons headstone. I dont know how anyone who has served this country in uniform or otherwise, i dont know how anyone could even mention or think of voting for such an individual. As mika just said, and its probably all you can say at this point, god help us. Thats exactly what General Kelly said at the end of that statement, god help us. I mean, rev, we have this thing where, like, we cant be shocked anymore by what donald trump says, but we ought to be shocked by this. Over the last 8 1 2 years, hes said things repeatedly about the military, disparaging the military, showing he has no respect or understanding for the sacrifice of Military Veterans or those lost, the families, gold star families who have lost someone. When you put that to Trump Supporters and say, really, youre okay with him saying General Milley should be executed . Youre okay with him disparaging dead and Wounded Soldiers . Theyll say, well, its the media, or its just donald being donald. He is just popping off. Is there no point along this ride where you go, ive had it . Thats too much for me . You would think disparaging the military, the republicans over the years have taken such great pains to say, we are patriots. The military is us. We defend them. You cant step out on this stuff and criticize the president . Nobody really has in the party, certainly among his supporters. And that is very, very, very discouraging about our looking at their character, members of his party in congress. Because when he has said ugly things, you can say to yourself, he is trying to sell to a certain crowd. He is trying to appeal to a certain audience. But when you stand in a cemetery of people that have died serving the country and disparage those that are still alive, that may have certain deficiencies physically because they served the country and you say that, thats not you playing to a crowd. Thats who you are. That tells us who you are. Youre not going to grow out of it. Youre not going to change. You dont want to change. Thats you. If we can look at a man that is really like that, how do you even risk putting him back in front of this country and sitting in the oval office with our secrets and guiding this country . Thats who he is. So lets take a look at what some Trump Supporters in iowa said over the weekend about when they were asked about trumps comment about mark milley. Treason is treason. Theres only one here for treason. What is that . Being put to death. Treason is treason. We used to execute or imprison people for it. All the treasonous actions i see now in this day and age is just thrown underneath the rug. You know, trumps feeling about mark milley, and i agree. Why was he not before a firing squad within a month . Yeah. Okay. So i just, you know lets just bring the entire reality into this. We know a lot of those people who support trump dont watch morning joe, okay . So whatever they watch, my question is, and this is what molly jongfast wrote about, i think, a week ago. This conversation, one of the reasons why thissickness is cultivating in society, there are places that are News Organizations say theyre not shocked about milley saying that, its not shocked that those who died for us are losers. They dont know because its not covered in the world where they get the news. Its a huge problem, not something we can ignore. The problem is, it is selfselective. As i say to my friends, i say, oh, i just dont follow the news anymore. They say, really, what do you do . Again, they start telling me about how they go to these conspiracy websites. Its not just conspiracy websites. Or they get facebook deals. Or they go to some more extreme cable news channels. You know, elise jordan, the thing is, they can look at Rupert Murdochs Wall Street Journal and see that this is a lie. They can look at the Associated Press and see that this is a lie. They can look at general news lines and see that this is a lie. Yeah, but what . Theyre not going look, i think a lot of these people watch news all day and listen to it. Theyre not, you know, spending time looking for whatever newspaper. I think that this is im sorry, ill say it, theres newsmax, theres this, that, also fox, which i watch a lot. They dont cover this. Thats what they watch. But do well im sorry. Ill be careful here, but fox doesnt say that mark milley should be executed. But they dont cover this. They dont cover this. Well they dont cover this as news, and they dont think its shocking. Well they dont. Theres one person on you dont watch. I do. I watch all time. 24 hours a day . When it is brought up by like, they bring in a leftleaning host, and it is completely ignored. Im sorry. These people dont get information, and they dont get a sense of context. Okay. Well, i dont watch fax 24 hours a day, so i cant say they never bring this up. I know you watch it a lot. I know you watch it a lot. I know you dont watch it 24 hours a day. Do know this, though, and i think we can agree on this, elise, when you have a Republican Debate and you have everybody lined up at that Republican Debate, and you know a lot of these people that were seeing, saying that milley should be executed, are watching that debate, and it doesnt even come up at that debate, and it doesnt come up at that debate because, really, the first question that should have been asked in that debate by the moderators, number one, should have been, donald trump was found guilty of committing fraud. Specifically, he overestimated the size of his own luxury apartment by, i dont know, whatever percent, 10,000 square feet when it was 30,000. They should have said, hes already been found guilty of fraud. Is that how Somebody Running for president should comport themselves . The second question should have been, donald trump has said that mark milley should have been executed. That came out this past weekend. What are your comments there . So i will say, i will agree with mika, that in events like this, they should bring it up. They certainly should bring it up on fox news, newsmax, whatever channels mika wants to bring up. But, certainly, at a republican president ial debate, when these are out there and are extraordinarily important, like the Wall Street Journal Editorial Page said the morning after the debate, they should have brought him up. They didnt do it. That certainly is on them and on the network in that case. Joe, id argue that those voters that we just saw interviewed in iowa, they are completely radicalized. Theyre the segment of the republican electorate that there is no coming back at this point. They arent even watching fox news anymore. They arent even watching the debate on fox news anymore. Theyre so solid and so there for trump. Those are the voters that the Republican Party has to worry about. Will they even vote republican if another republican nominee happened to get the nomination . Yeah. Thats really how far, i think, the divide is. So the two things here are, one, the Creeping Radicalization of the Republican Party that is going to dominate everything in terms of how we cover this election, and then, two, Donald Trumps legal troubles, which hes being covered as if he is running a political campaign. It has to be done in concert with the potential legal ramifications of all of these court trials that hes going to have to and appearances hes going to have to make throughout the campaign process. There was a really good survey that the Lincoln Democracy Project did recently, 16,000 sample that was very thorough, slicing and dicing the republican electorate of today. Theres that portion thats already radicalized, and then theres the portion that is flirting and is almost radicalized. You also on the left have radicalization trends, too, although not as strong as what were seeing on the right. Well, and, elise, you know, mika was talking about fox news. The fact is, you are right. A lot of people have become so radicalized, they dont watch fox news anymore. After firing Tucker Carlson, they think fox news is filled with sellouts, members of the deep state, as well. I know. And you look at how its impacted foxs ratings. They would have, you know, various downward trajectories if they did try to go back to, you know, their roger ailes model of having some conflict. So the brand has had to lean into the persona of being, you know, in bed with trump, and thats been controversial, frankly. You read the latest michael wolfe, book, and theres the battle within. Its this debate that is happening all across news media broadly, as ratings are, you know, going away in the era of more streaming and of digital. But theres some really fundamental questions to ask about how far networks are willing to go, pandering in their coverage. I think the same whole conversation could have had, and we wont have it, about republicans in congress in the senate and on the hill. They just wont do it. They could have move the meter, but they wont. Donald trump appeared in court yesterday for the start of his Civil Fraud Trial in New York City. Nbc news senior Legal Correspondent Laura Jarrett has a recap. Reporter donald trump once again in a courtroom with the fate of his Business Empire now on trial. In court, we will prove our case. Reporter new York Attorney general Letitia James accusing mr. Trump, his sons, eric and don jr. , and his namesake company, the Trump Organization, of exaggerating the value of his real estate properties, including trump tower, maralago, and 40 Wall Street by over 2 billion to receive better loan terms from banks. No matter how powerful you are, no matter how much money you think you may have, no one is above the law. Reporter just outside the courtroom doors, the former president attacking james, a democrat, for bringing the civil suit. Every time they give me a fake indictment, i go up in the polls. Reporter and going after the judge, who is also a democrat. They have a rogue judge who rules the properties are worth a tiny fraction, 1 100th, a tiny fraction of what they actually are. Reporter the republican frontrunner arguing the banks were not victims of fraud and blasting the suit as Election Interference be. Theyre wasting everybodys time for many months on this case, where banks got paid a fortune, loan money got paid back. Didnt even need that money. Reporter but the judge already rejected that argument, pointing out the state only needed to prove his Financial Statements were false and misleading, and mr. Trumps, quote, clearly contain fraudulent valuations. The key issues now left for trial, who is to blame for that fraud . How much should be paid as a penalty . In a Deposition Video played, mr. Trump suggested checking the accuracy of Financial Statements was the task of his longtime chief Financial Officer and codefendant. Was Allen Weisselberg responsible for that . I would say yes. Beyond what was happening inside the courtroom, aside from the Circus Outside where donald trump was yelling at the immediate you cant. Trumps point of view, the main thing is what happened outside, turning this into a political circus. He pretty much succeeded because what he said was so extreme. The media cant ignore it, he is calling the Judge A Rogue judge and calling the prosecutor a racist right outside, you know, 10 feet from the front door of the court. Pretty amazing. Inside the court, i would say, the most striking thing to me was how aggressive trumps lawyers were in, not so much attacking the judge, but making clear theyre going to challenge every aspect of this trial. Trumps lead attorney, former florida solicitor general, a smart lawyer, was on his feet, objecting to everything. Their basic argument is the judge already decided this trial and decided trump was guilty of fraud last week. Theyre going to appeal at some point. I think theyre basically trying to build a basis for that through this proceeding. John, did i hear correctly yesterday the judge say this trial will last until the week of christmas . Yes. If so, what is going to take that long . I mean, if you look at the witness list, theres dozens of witnesses on both sides, including the trumps and people who work for them, but also lots of Financial Experts that trumps people will put up, saying, you know, these valuations were reasonable. The government will put up their experts saying they arent reasonable. Obviously, they werent reasonable, but, you know, trumps people have got, i think, some professors from nyu and elsewhere who are willing to say that, you know, i think it was within the bounds of reason. Valuation is difficult to decide anyway. Thatll be their argument. John, yesterday, we saw Performance Art from the former president , stepping outside, as you pointed out, 10 feet from the courtroom, maligning the judge and Everything Else that was going on inside the courtroom. What are the odds, how long will he continue to go back to court in person . Thats the great question, right . Last week, nobody expected him to turn up. He doesnt have to turn up. Its a civil trial. After the judges ruling, he decided to turn up. I dont think hell be there all the time. He may be there today and tomorrow. This week is clearly turning into, you know, this is his Media Strategy for the week, attending his trial. I doubt hell sit through all the expert witnesses, but he may be called back to testify. I wouldnt be surprised if he pops in now and again, because this is, as you say, a show for him. He is running until christmas. He sees himself as the star. Im sure he will pop in now and again. This is his sphere. Right, exactly. Thats what is sort of, i guess, most disturbing about it. Last week, the stories were that this was a setback for trump. For the first time, hes been called a fraudulent, basically, by a court, by a judge. This week, hes turning it into, basically, a campaign trail appearance. Hes not only been called a fraudster by a judge, it undermines his brand that he did his Television Show around, that hes built this myth that he has to defend. I want to ask you about something you said, because i think it goes to the core of what i was thinking as someone who has known trump for 30 years. Part of the reason i think he showed up is he really doesnt think anyone can fight and defend him like he can. Which is why you say the lawyers were like an exercise, because he was sitting there. He feels if he wasnt there, they would not be as exercised, would not be as energetic. I need to be there to give these guys some gut, then im going in the hallway and doing what no one could do for donald trump, and that is defend donald trump. Call people names. Anybody in their right mind would not do this, other than a supreme narcissist. I think thats why he had to be there, assist from the political advantage he thinks he is getting with the media coverage. I think you might well be right, reverend. Hes probably right in media terms, nobody can speak out like trump and attract the attention that trump attractattracts. It was interesting he has two lawyers. An experienced lawyer who has argued before a Supreme Court, and then he has his tv lawyer most of the time. She gave an Opening Statement which was trumpian, in which she said, look, you know, maralago is probably worth 1 billion. Hes got them both. Hes got his tv lawyer and his, you know, Supreme Court lawyer, and he is outside the court himself defending. It was a triple whammy. Our next guest says the practice of democracy requires lessons from Abraham Lincoln. The 16th president of the United States made it a practice to meet with a wide range of people, including those with different beliefs he felt were wrong. His goal, to find something in those conversations that was in the public interest, whether it was a Political Alliance or public policy. Those lessons from lincolns past could help us work through our current polarized political climate. I dont think it is too much to ask for this reason, we think of lincoln as a secular saint. Someone who was almost above human measure, but he was, in fact, a human being, and he was a politician in a very divided time. He realized if it was going to remain a republic, if it was going to remain a democracy on one country, he didnt have to persuade everybody to agree with him, but he needed to build a majority. In order to do that, he needed to deal with people who differed from him on issues and find some Common Ground. When he couldnt do that, hed try somehow to use or take advantage of his exchanges with people. You know, people who say now, weve never been more divided, you have to stop and say, lets not forget the civil war, for gods sakes. Yeah. Did Abraham Lincoln in those times, did he have people on the other side of the aisle who he could reach out to . Yeah. In many ways, joe biden pitched himself as a, you know, above the fray, bipartisan president , has worked in the senate, has friends on the other side, but hes found that to be a difficult task. There were limits. Lincoln ended up in a war with people on the other side, with whom he could not compromise. Yet, he talked with all kinds of people. There were radical, antislavery figures, like Frederick Douglass, a major character here, who felt lincoln wasnt going far enough, fast enough, and accused him of negro hatred, on the way to the emancipation proclamation. There were critics on the other side, including slave owners, who lincoln tried to deal with. There was a letter he wrote to his best friend, joshua speed, who came from a slaveholding family, admitted that slavery was wrong but, in lincolns opinion, was not serious, politically, about ending it. Lincoln said, youre wrong about this. Heres why youre wrong. But if for this we must differ, differ we must. Rather than ostracizing this guy, he signed the letter, your friend forever. In the end, when the war came, he got some use out of this man, joshua speed, for the union. Steve, i loved the book that was on Frederick Douglass, which broke down how douglass was critical of lincoln, even though theyd talk, and later became much more appreciative of lincoln. Which i didnt know. Because a lot of people feel lincoln and douglass were like hand in glove, and that wasnt true. Talk to us about how and im hoping its in the book, that it took a certain kind of selfconfidence and stability of lincoln to be able to deal with people that was basically on his side but was critical, and to deal with those that were opposed. He must have been a man that did not deal with a lot of his own insecurities like weve seen some president s of late. Just not to mention anyone particular, but i think maybe i know where youre going with that. I think it is great that you use the phrase selfconfidence, the word selfconfidence, because lincoln had a lot of it. He was a humble guy, wasnt an arrogant guy. He was humble in his presentation, but i think it came from confidence. He knew who he was. He was very smart. He had confidence in his ability to reason through the situation. If someone like Frederick Douglass was extremely critical of him, could take thatn board. When, finally, douglass came to the white house in 1863, one of the major meetings of the 16 meetings in this book, to protest about lincolns treatment of black soldiers in the civil war, lincoln didnt say, send him away. A crowd was in the room, tons of visitors in the white house, he said, send the man in right away. They had a conversation. Lincoln admitted to Frederick Douglass, i have been slow. I will allow that you could see that i have been slow to do some things that need to be done, but i am moving as fast as i can politically. Once i have taken a position, i will not retreat. Which douglass took as the most important statement, that lincoln was not going to give up on his commitment to end slavery. Steve, i have a strong suspicion that given the American Education system, a lot of americans come to think of lincoln as an ordinary guy who became extraordinary only through the course of the civil war and what happened. Keeping the country together during the course of the civil war. But it appears, i think, as well as your book, other books, point out that lincoln seemed to have extraordinary political instincts in how to operate within those instincts, to keep everything, his cabinet together and the country together. I agree with you on every point. My mom, who is watching, told me that she grew up with an idea of lincoln as you described, that he became president almost by chance. And there was an element of chance in the Republican Convention in 1860. But he worked really hard at the politics, exactly as you say. He thought about people. He empathized with other people, and he tried to figure out how to motivate them. He had an idea of humanity, which sounds a little grim, that people are primarily motivated by selfinterest. Oh. But having concluded that, he tried to harness their higher c. It is almost an entirely white electorate in the state of illinois. Hed talk about why slavery was bad for them. Hed say, slavery makes a mockery of our pretensions as a beacon of liberty in the world. The rest of the world laughs at us about this. He would say, you think slavery is in the south and were in this northern state, and its far away. Slavery can spread, and itll spread here and damage you and hurt your job. He was talking to people about how this issue would affect them, which can sound a little cynical, but it was what he felt was necessary to build a coalition, to build support for something that people may not have felt all that connected to. This story is so amazing because youre writing about an argument over human bondage. Theres not really any black or white there, yet, lincoln was able to fight with his opponents and, yet, not look at them can contempt. How did he manage to do that . Also, what role did his relationship with his wife and the grief they were going through play into his human interactions . Oh, my goodness, yeah. He has a remarkable statement at one point, talking to a free state audience in illinois. It is an audience of white voters. He says, the first thing to think about is that slave owners are not worse human beings than we are. If they were in their place, we might do the same thing, which is a dark thought, but his idea was, slave owners acted out of selfinterest to preserve something that benefitted them. So he took this humble position, essentially, that we are all flawed. We are all human beings. We all have problems. We all act out of selfinterest. But having admitted that, how can we move in a more moral direction . How can we match our selfinterest with a moral cause . So having said, dont act like youre superior to the other guy, dont demonize, even these people doing this terrible thing, lets talk about the terrible system and change the terrible system. You write, steve, with regards to mary todd, extraordinary care drive, on april 14th, 1865, the day he was assassinated, what did they talk about on that ride . Im glad you brought it up. Its a fascinating marriage and also a very difficult marriage. Lincoln probably was not the ideal husband because hes out traveling. Hes been a politician. He is being a lawyer. Hes lost in thought. He suffers from depression. She is also thought to have had some form of Mental Illness and was temperamental and had difficulty controlling her impulses and Everything Else. It was a terrible struggle, this marriage. But she was politically astute, politically smart, and as ambitious as he was, and supported his ambition. At the very end of the war, on the last day of lincolns life, they take a carriage ride. Lincoln says, we must try to be more cheerful from now on. You can see him in that moment thinking about the possibility of happier times, because the war is ending. The presidency is succeeding. Maybe they can be happier together with one another. That was a thought that he had hours before going to fords theater. For the marriage and country at large. Yeah. The new book is differ me must, how lincoln succeeded in a divided america. Democratic congressman Henry Cuellar of texas was the victim of an armed carjacking last night in washington, d. C. The robbery occurred about a mile south of the Capitol Building while the congressman was parking his car in theavy yard neighborhood. According to a statement from his office, he w b three armed assailants who stole his vehicle. Th congressman was unharmed during the incident, and the car was later recovered about two miles away. No arrests have been made so far. How frightening. Willie, another sign of just how bad crime is in the nations capital. Especially carjackings, a rash of carjackings in recent months. Were glad the congressman is okay this morning. Meanwhile, the record surge of migrants crossing into the United States is stretching resources very thin in Many American cities. Now, hospitals are sounding the alarm, saying they also are overwhelmed. Nbc news Homeland Security correspondent Julia Ainsley explains. Reporter the border crisis surging. Officials telling nbc news there were over 200,000 illegal crossings at the southern border last month. A record 3 million migrants cross the border in the last year. Now, a new warning, 1,000 miles away in New York City, where officials tell us resources are overwhelmed. Across Public Hospitals in New York City, a quarter of the patients are now migrants. Over the last year, nearly 30,000 visits by migrants and 300 new babies born to migrant moms. Staff here at belleview hospital tell us theyre eager to help, but the numbers are tough. This has been the hardest work ive ever done, but its been the most impactful work ive ever done. Reporter and most of the visits to the taxpayer funded legal payerfunded legal clinic are by migrants. Our clinics are full and there are waiting lists and people are turning people away or referring them to other places. Reporter randy redkin from new yorks Legal Assistance group says so many migrants are asking for legal help on asylum representation and health care access. Now she says american citizens who need Legal Assistance with eviction and insurance have to wait up to ten weeks. If you ask me do we need more resources for legal services, i would say absolutely yes. Reporter meanwhile, new yorks governor now slamming the situation at the border. It is too open right now. People coming from all over the world are finding their way through, simply saying they need asylum. Reporter new york mayor eric adams saying providing service for migrants will cost city paks pairs 12 billion. But Biden Administration officials blamed adams response. It is not an operationally sound effort, one dhs official told nbc news. Meanwhile, migrants on the street are desperate for help. We met orlando who fled violence and he did not want to show his face. How is it for you sleeping on the street . You have to make believe it is a king size bed and you lie down and go to sleep. He said he came to new york because he heard of social service the city would offer to migrants trying to start a new life. New york city is one of those overwhelmed by the crisis. So texas had to get on a plane and go to tampa, and theyll take on Tyler Glasnow and a rays team decimated by injuries all year, but kevin cash and his crew always find a way to make it work. I want to see if texas can regroup, go in there and find a way to take out the rays. That being said on the flip side of that in the American League, willie, in minnesota you said it. They havent won a postseason in a long time. Minnesota has been one of the hotter teams in the second half, so i think thats going to change a little bit. I want to thank you. Well, i think the phillies are everyones sexy pick to make another run to the world series like they did last year. They are littered with stars. They can handle the big moment. If they can get by the marlins they will take on the braves, a team theyre super familiar with. Yeah, Kyle Schwarber, theres been this whole change in the dynamic of how a lineup is constructed. Used to have the little guy who could lay a bunt down, run a little bit, slap the ball the other way. Not the case. We are putting a guy that puts a buck 98 with 50 homers and 100 ribbies in the leadoff spot. I would beware a little bit. This marlins team is hot, theyre motivated. They have a lot of lefthand pitching that can kind of subdue the schwarbers and the harpers so i dont think it will be as easy a series for the phillies as maybe the National Fans think. Lets turn to the last series, the other one in the national legal, the Arizona Diamondbacks got to the playoffs ahead of schedule. Zack allen is great. A lot of young players. They face the Milwaukee Brewers who are dealing with an injury to one of their aces, brandon woodruff. What is your read on that series . Im devastated by that injury. I think milwaukee could have been kind of a sleeper team in the National League to make their way to the world series or at least the nlcs with you know, they had a threeheaded monster with burns, woodruff and peralta. You could argue it is as good a three as anybody heading into the postseason without him, crafty veteran maybe gets the ball in game three. Im sure we will see how it progresses. Something to keep your eye on, arizona super aggressive on the base pads, young, athletic, hungry to advance 90 feet. Ken William Contreras and the milwaukee Pitching Staff sub died arizonas ability to run. Milwaukee, theyve always been one bat away. Molina covered up a lot of flaws for a lot of people in that organization. You bring in a new catcher, the pitcher is working with him, got off to a little bit of a rough start. But when the dust settled for me when you looked at the st. Louis cardinals roster, the reason they struggled, todays games are about high velocity, nasty, exploding pitchers that strike guys out. St. Louis didnt really offer that. A lot of balls in play. A lot of contact all over the place. Their starters got off to a tough start and they were never able to really regroup. Mark is amazing. Weve been gone so long the bachelor is now a grandfather. Its been a long time since our last late show. We looked at the calendar today and check my math on this. I believe we have been off the air for 154 indictments. A look at some of the late night shows which returned to tv for the first time in five months. We have a lot to get to this morning, including a recap of day one in Donald Trumps Civil Fraud Trial in New York City. Part of that is the Punishment Phase. We will tell you about the moment that seemed to enrage the former president. Also ahead, the latest on Kevin Mccarthys Speakership Battle as a far right Republican Forces a vote in the house to decide his fate, whether he keeps his job as speaker or whether democrats will step and bail him out just to keep the government running. Right. I think democrats will. Are people falling down are you okay, willie . We have some equipment moving. Everybody is in place now. Were getting ready. Oh, okay. Once the show starts, we will be ready onset. I just didnt know if lamire was running from one set to another. You should talk, mr. Two minutes late. Elise is here. Were good. Yeah, were ready now. Game on. Oh, good. Well, i tell you, mika. Yeah. No one can ever, ever accuse me if im late of running to set. No, thats true. He swaggers in. Swagger than a run. Stagger. Stagger, yeah. Sinatra hat on, smoking a cigarette, a drink, put it down, okay, well go over there. Always here. It is always nice, the late night guys. It is great that they that was fun. It was great they came back. I mean jimmy fallon really excited more as excited as the guy who went to see beetlejuice with lauren boebert. Thats saying something. What is nice is you got five months of pentup jokes. Theyve been sitting at home writing these things. Oh, we missed this one, missed this one. They kind of emptied the chamber of the summer jokes yesterday. Yeah. And a lot going on in politics as Stephen Colbert mentioned. Several indictments since they were last on tv. Yeah. You know. Incredible. I heard Something Interesting yesterday. I was watching as, you know, i do on the way down to the orphanage, i was looking at instagram reels. I think thats what the kids do. Stuff like that. Of course, theyve already got my algorithms down. It is nick saban yelling at the press. It is will ferrell clips, but it is also some snl clips. They were asking dana carvey who the best just speaking of comedians, who the best person was for weekend update. Of course, there have been incredible people for weekend update. I dont know if you have seen this clip. It started with chevy chase, but, my gosh, norm mcdonald. Go down the list. He actually said dennis miller. Oh. He goes, i understand all of the politics of this. He said, i was on a ride with dennis and he is sitting in the backseat and hes got a notepad and were like driving, like a couple of miles. Hes just sitting there writing. Were like, what are you doing . Oh, im just writing jokes and he read them the jokes, and he said they all could have gone on any show anywhere at any time. Again, a fabulously fabulously talented actor who, of course, we dont hear that much from anymore. Oh, so funny. So funny, and so great in that chair. You mentioned norm mcdonald, too. His head writer on weekend update, jim downey, was on conans podcast this week. If you love comedy, love snl, it is worth a listen because he goes through sort of step by step walks through how you write the jokes and why norm a wags so funny and good. It is if you go down the list you have seth meyers, tina and amy, a cradle of greatness for a very great time. Oh, my gosh, yeah. Oh, yeah. And dennis was one of the funniest guys in the world, still is. Now we will get to things that are unfunny and thats our top story this morning, one of many. The longest serving white house Chief Of Staff for donald trump offering his harshest criticism yet of his former boss. John kelly sent in a statement to cnn which he backs up many of the stories recounted recently of Trump Lashing out against u. S. Service members and veterans. Kelly confirms trump didnt want wounded veterans in the Military Parade plaed for Independence Day because it, quote, doesnt look good for me, meaning donald trump saying that. Kelly also says trump, quote, rants that our most precious heroes who gave their lives in americas defense are losers and wouldnt visit their graves in france. Kelly then appears comment on trumps most recent attack on general mark milley in which the former president suggests he be punished by death. Kelly describes trump as a, quote, Person Who Cavalierly suggests that a selfless warrior who has served his country for 40 years in peacetime and war should lose his life for treason in expectation that someone will take action. In expectation that someone will take that action. For him. Yeah. Like january 6th. Yeah. That someone will kill as the general says. He says it in expectation someone will kill milley for him. The statement ends with saying trump is a person who has nothing but contempt for our democratic institutions, our constitution and the rule of law. There is nothing more that can be said. God help us. Kelly served as Chief Of Staff from 2017 to 2019. He has criticized trump before, but this statement marks the first time these comments have been confirmed by kelly who was present at the time they were made. Of course, the Chief Of Staff is right in there and sees everything all day every day and gets a real firm sense of a situation, which is why that Expectation Line is chilling and something we believe to be true and makes the support for trump out there all the more concerning. Well, it is obvious. It is obvious what donald trump wants people to do when he talks about saying they should be killed, they should be executed, they should be this or that. I dont think it is obvious to everyone. It is. It is obvious thats what donald trump wants to do. Im glad the general said it, but you look at these theyre just horrific statements, willie. There were questions before when they first were in the atlantic i believe in early 2020, 2019, who they were about, was it john kelly. A lot of people thought it was. But who said it is really not as important as what was said by donald trump, and it goes all the way back to john mccain, obviously Calling John Mccain for being a p. O. W. Who sacrificed for his Band Of Brothers who refused to leave vietnam even though he could have because his father was connected. Just think about that. Donald trump uses his connections to have a doctor lie about bone spurs. John mccain uses his connections to stay in hanoi, being beatened and tortured so badly he cant even raise his arms above his shoulders for the rest of his life because he refuses to go home before Everybody Else that came in with him in that prison cell in vietnam. It goes on to, of course, hes at normandy, one of the most Sacred Places and he is not wanting to visit. It is raining. He doesnt want to get out. He doesnt want to visit the markers, the tombs of soldiers and sailors and airmen and marines who died because, well, they died so he considers them losers. At one point he turns to General Kelly who lost his son and says, why would anybody do this . Why would anybody sacrifice their life for this country . Whats in it for them, he wondered. Yeah. Whats in it for them. Again, this is just one more example, one more example of these people who once claimed to be the most righteous, who claimed to be the most patriotic, who claimed to be the most supportive of the military, lining up behind the man who was the antithesis of everything they grew up believing was right. Now they are behind him in this personality cult. Yeah, and that mccain moment that you reference is such an important one. That was back in july of 2015. Important because it gave us a sign of what was coming, which is to say he did something unthinkable, especially within the Republican Party, trashing john mccain, specifically hips heroism in war and his support went up. In that month, we talked about it here and talked about it privately and said, hmm, Something Different is happening here. To your point, these are the men and women that we hold most sacred in this country and, as you say, republicans have always defended the military and we present it to Trump Supporters. How can you defend this . Well, it was the media. He probably didnt say that. I dont know. Now we have General Kelly, jonathan lemire, on the statement to cnn saying everything in the atlantic that is true, i heard them. He trashed war heroes, the war dead. He didnt understand why they would sacrifice, what was in it for them, a fundamental misunderstanding of the military, a fundamental misunderstanding of patriotism. Yet you can expect internally among republican supporters it will have no impact. Kelly has been known to work with journalists but this is the time he has put his name to it. He had some success as Chief Of Staff keeping trump in line and it went away. Theres bella wood in france that basically that many marines think thats where they began, their origin story. Donald trump was dismissive and refused to go to the funeral that day because it was raining and he didnt want to get his hair messed up. Kelly told people that was the last straw for him when he realized what sort of person donald trump really was. Will it make any difference . I highly doubt it. Others who work for donald trump, the National Security establishment who have spoken out against him, general mattis, general mcmaster, john bolton, the list goes on and on. They have all forcefully condemned trumps leadership, his patriotism and character. We know what Rex Tillerson thought of him as well. We cant say it on Family Friendly television however. None of that has led in a drop in support at all, though we should all take in the idea that these are the people that worked with donald trump day after day in the most sensitive, important moments of his presidency. Theyre the ones that knew him best. Much like we saw at the january 6th trials, much weeklike we we much like we are seeing, those who spent the most time with him are saying he is unfit to hold the office again. John kelly seemed to have a pained public posture when he would be out in public with the exception john kelly himself had a pretty bad episode when it was the slain husband of the widow, it was la David Johnson and niger and the fight started when trump was this was in my mind the absolute worst episode when he was picking on the widow whose husband had died a week earlier. That was that to me was just, oh, this is what trump thinks of our military. He cares so little for the loved ones of those who have fallen in battle that he literally will belittle them in the aftermath of that loss. So this is nothing new. We know the level of respect that trump has for basically anyone but himself and we see it. We see the contempt in which he holds those who choose to volunteer for service for their country. So this is this tells us nothing new. It just reminds us of the mans fundamental character. I do think, willie, that if this continues taken together, i do think General Kelly who served this country proudly and aably for so long, who lost a son, sacrificed his son for this country, General Kelly. General mattis who, again, another war hero, another man that trump was just so thrilled to have come before him. General mcmaster. I do think if if these generals come out and speak publicly on camera and make a concerted effort between now and next year to talk about just how unfit donald trump is to run for office and to be president of the United States again, be Commander In Chief again, i do think trumps generals so to speak, the people we were talking about back in january of 2017, trumps generals all coming out condemning him for all of the horrific things he said about our Men And Women In Uniform in this country, i do actually believe that is one thing that could have an impact with the cult, with people that are cheering and laughing about Nancy Pelosis spouse getting his head bashed in. No, no. But with voters that are actually going to decide the elections in the suburbs of atlanta, the suburbs of philly, the suburbs of detroit and in the suburbs of milwaukee. We may well hear more from General Milley. He was somewhat restrained as joint Chief Of Staff, but he may be able to come out and say more, except for that 60 minutes interview last week as well. Joe, for People Like Us Who Revere The People who served this country and who try to lift up injured members of the country and help them, the comments most recently in jeffrey gold burgs atlantic piece were particularly abhorrent when he told general milly after a man that lost his leg to an ied attack in afghanistan, who suffered heart attacks and strokes because of it, who had been through heel saying god bless america, he pulled milly aside and said nobody wants to see that speaking of injured warriors of veterans, dont let that happen again. Wow. How do you defend that . How does it sit with you . You are willing to excuse a lot of things about donald trump, we get that, over the last eight years or so. That attacking a wounded warrior, how do you defend that . Willie, you see this firsthand in all of the work that you do. These men and women are the best of who we are, the best who have gone over to protect and defend this country, who like bob dole left a part of themselves in battle. Like bob dole, donald trump would call bob dole a loser. They come back with injuries and yet they stay together. They keep fighting a new fight, a new cause. You see that every day. These are our heroes. They are, sand it stays with them for the rest of their lives and it is a reminder donald trump is about the super fish. How does it look. He is creating a play, putting on a tv show. If it doesnt look just the way he wants it to, then the people who are ruining it for him in his eyes are disposable including hero Military Veterans coming up, we will go live to Lower Manhattan for day two of Donald Trumps quarter billion dollar fraud trial. Donald trump is expected to be back in court this morning for day two of his Civil Fraud Trial in New York City. Yesterday the Punishment Phase began after judge Arthur Engoron last week found trump, his two oldest sons and his Company Liable. For fraud, yeah. The former president sat with his arms crossed as his defense team and prosecutors do you think he is getting bored yet being in so many courts . No, this one this is what he does. He goes to courts. This hits him where it hurts. Because it is about money, right . A monitor is being put in charge of his companies. They will figure out whether they need to be dissolved. Everything this guy is made up, i would say he built, but he actually probably inherited the equivalent of A Billion Dollars from his dad. He inherited about in terms of todays dollars about 400 million. There you go. Prosecutors from the new York Attorney Generals Office gave their Opening Statements. Sitting just a few feet away from him was the Attorney General herself, Letitia James, Who Leered At Trump while cameras were briefly allowed inside the courtroom. This was quite a scene. I dont think everybody expect it those cameras to be in there. An attorney for trump complains that the former president did want a jury to hear the case, but the judge noted that his team had never asked for a jury trial. After Opening Statements, prosecutors played taped depositions from trump, his sons, his former Attorney Michael Cohen and his companys former chief Financial Officer, Allen Weisselberg. Then they called their first witness, a former accountant who spent several years handling the former president s tax returns. According to our team inside the courtroom, trump seemed to take issue with some of what was being said during the testimony and became extremely animated with his lawyers. His face is said to have become beet red while he pointed and finger waved at his lawyers. For the most part trump appeared subdued during the trial. Outside the courtroom though he was anything but. Here is some of what he said to reporters during a lunch break. When you have the radical left Attorney General like Letitia James who is a disgrace to our country, who got elected on the fact that she is going to take down President Trump, were going to take him down, this is called Election Interference and worse than that. Really much worse than that. You dont get much worse than Election Interference. I got a call, sir, we lost part of the case. I said, the trial didnt even start. The trial starts i guess today. He ruled and we lost a big part of the case because he is a Democrat Club politician. He is a democrat operative and he is a disgrace. Yeah, thats a really really, i think i wasnt in that part of my Law School Class on judge trials where the professor told you if it is a judge trial and the judge is determining your future that it is best for you to insult him and call him a loser and attack him. Again, it makes no sense. As we were watching also dangerous. For 15 seconds yesterday as donald trump was saying that this guy could be arrested, should be arrested, of course, theres theres the threat. Theres the intimidation. If i get elected president im going to arrest you is what donald trump is saying there. But, you know, any other defendant in america in this position, willie, thats already been found guilty of fraud, the evidence is very clear against him, you know. He is overexaggerating and everybody in new york had known for decades this is what he would do. You would have somebody get on the stand and apologize, saying they made a mistake, say this, say that, i am so sorry, your honor, im going to straighten this up. Were going to put systems in place to take care of it and throw ourselves on the mercy of the court, to let you know were not going to do this again, we are going to make sure that anything that we file is with Tax Authorities of New York States and with banks is going to be correct. I know we fell far short of the mark with that. Then you would have a judge saying, all right, this is a problem, well put your company on probation, however however they do it. But instead you have donald trump, who has been caught. This is a bank robber that has been caught. This is a congressman who has been caught part of this is decided. Am scam with money in his pockets, like jammed into his pockets, looking like the michelin man because he had so much money jammed into his coat pockets, yelling and screaming about being unfairly prosecuted. He has already been busted. He has already been caught lying. He has already been caught saying he had a 30,000 square foot residence when it was like 10,000 square feet, claiming that he had the most expensive property in all of New York City. What a scene. When that was a lie as well. God. And whats he doing . Hes doing the exact opposite of what he should be doing. Hes continuing to drive his car off the cliff and leave his lawyers in a nowin position. And then after it is over, you know, he will probably call for the execution of the judge. Oh, my god. Just like he called for the execution of General Milley. It is a zero sum game and it is a game he loses every single time. As you say, the facts and evidence are stacked against him so now all he has is to play the outside game where he goes outside the courtroom, attacks the judge, attacks the prosecutors in this case. By the way, you can expect to see that same speech. Just cue it up every time he comes out of the other courtrooms, attack the judge, attack the courtroom, a witch hunt against him. This looks like an ad for the apprentice, that face. The Wall Street Journal, a similar photograph too. Wow. Of the tan truck outside the courtroom as two Police Officers stand by. Yeah. Oh, the drama. As speaker of the house. The drama. So much drama. What in the world will happen . The Lower Chamber has until tomorrow to decide whether or not to keep mccarthy in the top spot. I wake up laughing. At least five republicans publicly stated they would vote to remove mccarthy. Hold on one second, hold on. Willie, im not good with math. Hold o on. Lets see. Im 435 members of congress. Yeah. You were one of them. Remember that . I dont like to talk about it. I did, i did. Okay. Okay. Hold on. 435. 435 minus 5. You say five want him out . Five hold on. Yeah. Thats five. Willie and i almost won the nobel prize if they hadnt ripped off the research. Im good at math. That would be not calling for mccarthys ouster. Checking the math on the back of the envelope, it does check out. He may need democratic help to get there, to get over the line. So a lot to get the democrats to maintain speakership. Mccarthy reportedly called House Minority leader Hakim Jefferies last night regarding the speaker ship. Lucky for us he joins us now. Can you share with us the conversation you had with Speaker Mccarthy and do you believe democrats will help him keep his job . Good morning. Good to be with you. It was a private conversation that we had. Key have had multiple private conversations over the last several months as weve been working our way through the 118th congress. What i will say to you is what i said to him, which is that we have a caucus meeting this morning. We will have a family conversation about this issue, relatively a First Impression and hasnt been before the congress in 110 years or so, and then figure out where to go from there. We said from the very beginning of this congress that we were committed to finding Common Ground with the other side of the aisle whenever and everywhere possible to make life better for everyday americans, but we would also push back against the extremism whenever necessary. Unfortunately, weve had to do that time and time again. So Leader Jeffries, there are Many Democrats as you know who say, yeah, no, were not going to help this speaker, the one who opened the flood gates of an Impeachment Inquiry and the other legislation you disapprove of, broke a budget deal with President Biden. Is it your sense there are enough democrats who might be willing to say, hey, the house of representatives is working, hes going to keep his job and to vote to support him . Well, that remains to be seen. We do know that the house of representatives has largely been turned over to the most extreme elements of the House Republican conference and thats not good for the American People. Well have to see how that plays out in the context of this possible motion to vacate that may be before us either later on today or tomorrow. We do know as democrats, look, we came to congress to fight to make life better for everyday americans, build a healthier economy, put people over politics, but the republicans have been fighting each other from the very beginning. We are in the midst of a republican civil war and it is undermining the ability of the congress to solve problems on behalf of hardworking taxpayers. One way or the other thats going to have to end, not necessarily in the context of what may be before us this week. It just has to end because it is not a productive situation for the country to find itself in with all of the challenges that we continue to work through to try to deal with the problems facing everyday americans. Well, you know, when the house hits a republican civil war that is hilariously being fought over an issue that republicans were the worst ever at managing in the two years they controlled all branches of government in 17 and 18, biggest deficits ever, biggest debts ever, biggest budgets ever, biggest pork barrel spending ever. That is what is so funny about this cometojesus moment. Im just wondering though, congressman, you are talking about pushing back against the extremism. I understand one party not wanting to help another and i understand people not trusting Kevin Mccarthy because he didnt keep his word, but if there is a way forward wouldnt it be the best move for congress and for the country, for republicans and democrats to roll over these most extreme members . We have been working hard to come together and isolate the most extreme members of the House Republican conference from the very beginning. We were able to do that and coming together to avoid a catastrophic default that House Republicans were threatening to blow up americas economy. We provided the overwhelming majority of votes to get that default Crisis Resolution over the finish line. Right. And we did something unprecedented and we provided the votes so that the rule would pass so we could get to the underlying bill and we crossed over. We most recently were able to provide the votes necessary in order to meet the needs of the American People and pass a Continuing Resolution that would avoid a very dangerous Government Shutdown. So our track record has been very clear on this issue and we will continue to lean in to bipartisanship as it relates to meeting the needs of the American People. This is a procedural issue. Right. That will be before us, and, again, we have a caucus meeting. I care about what members of the caucus have to say. This is a vote of conscience in many ways and i am interested in hearing what every Single Member of the House Democratic family has to say on this issue and then well come to a collective decision at the end. Yeah. You would agree with me just looking at the situation, if in fact republicans and democrats come together to procedurally crush the five or six people that are now trying to hold up the entire house, that would be good for democracy, would it not . I think that what will be good for democracy is that we had a rule that was in place that didnt empower a single individual to basically discharge the speaker. Right. Two congresses prior to this one under democrats, under the leadership of speaker pelosi, the rule was pretty clear. I understand, congressman. We have that rule. I understand. Thats right. I was there. In fact, we used that rum. I agree with you. We used that rule to run Newt Gingrich out of town, me and a handful of four or five other. What im sayingsnf. I get that. But we are where we are now. Yeah. Moving forward, would it be best for us to have the republicans, democrats come together and show these people they cant hold the entire legislative process hostage and help mccarthy get get his votes and continue for the next year . I think moving forward we should come together around a set of institutional changes that foster and promote bipartisanship as opposed to giving one or two individuals the ability to hold the congress and the country hostage. I think those institutional changes would allow the congress to work better to race toward the center as opposed to what has been laughing over the last year, which is the extremes have been driving the train. Yes. And, unfortunately, trying to drive america off a cliff. Are you saying the same thing . What do you mean . It is what well, talking about rule changes that need to be put in place. Okay. To stop the extreme the question is i just wonder though. You have one or two of these people that, again, are holding the whole place up and you have hundreds of reporters following people that, you know, theyve got a caucus of three or four. Yeah. This happens on the left side, too. I remember when you had some people coming in in 2018 that said, were the progressive caucus. Nancy pelosi said, wait a second, i thought i was progressive. It is almost like reporters cant help themselves from following the bright, shiny objects even if it is three or four out of 435. Thats true, joe. But lets take a step back and recognize that the overwhelming majority of the House Republican conference in the immediate aftermath of january 6th voted to decertify the election, lift up the big lie. The overwhelming majority yeah. Continues to promote donald trump as their candidate. The overwhelming majority have voted or threatened to default supporting an illegitimate Impeachment Inquiry when their own witnesses have said there is no evidence to go after the president. So lets not just isolate this to a hand full of individuals when you look at the totality of how House Republicans have conducted themselves in this congress and in prior congresses during the trump era. Good point. Speaker jeffries a few moments ago told our friends at cnbc the democrats have not asked for anything and im not going to provide anything. He said he is not making any promises in exchange for votes, and that would seem to include ukraine funding which was missing from the Continuing Resolution that passed over the weekend. What assurances do you have that these House Republicans are going to revisit that issue and in what sort of mechanism . Do you foresee this being a separate funding bill for ukraine or part of the next cr . Because theres a lot of alarm in europe and particularly in kyiv that ukraine funding was not part of the discussions this weekend. Yeah, i have raised this issue with my republican colleagues and counterparts and it is very critical we provide the ukrainian people with the support necessary for them to continue their courageous battle against russia. Here is the question that will be before the congress. Are we going to choose americas National Security interests on the one hand or side with the proputin caucus in the republican conference that internally is led by Marjorie Taylor greene and externally is led by donald trump and Tucker Carlson . That undermines americas National Security interests and thats why it was so unfortunate at the insistence of House Republicans we punted on the ukrainian issue. We need to get to that in a matter of weeks, a matter of days because it is the right thing to do for america, for democracy, for freedom, for truth and the western world. Congressman, maybe you can help us out here. Earlier this year Kevin Mccarthy had a handshake deal with the president of the United States which would have taken care of the nightmare that occurred last week almost shutting down the government. He reneged on that teal with the president of the United States. Why would anyone trust ordeal with Kevin Mccarthy now given the fact that he cant keep his word . Well, that certainly is one of the issues that ive heard from a lot of members of the House Democratic caucus, that there are real trust issues with the Republican Leadership and with the republicans overall, based on the fact that they, of course, negotiated an agreement with the president of the United States. It was passed into law. More than 300 members of the house supported it and then immediately turned around and broke the agreement that they themselves insisted that they negotiate, that we arrived at to avoid the type of drama the American People have been experiencing. There was no need to take us down the road of the shutdown fight other than the republicans decided to break off the agreement that was in the best interests of the American People. Thats unfortunate. Of course, we dealt with a variety of Different Things including coming into the session last month and the First Official act was to launch this illegitimate Impeachment Inquiry, presumably at the former, twiceimpeached insurrection in chief donald trump who continues to run large parts of the House Republican conference. These are all of the challenges that i think we confront as part of the chaos, the dysfunction, the extremism that we see on the other side of the aisle. It is not one or two individuals. It is the approach that they have taken to governing and it is hurting the American People. House Minority Leader congressman Hakeem Jeffries of new york. Yesterday the Punishment Phase began after the judge found the former president , his two oldest sons and his Company Liable last week. Despite not having to be in the trial himself, donald trump is expected to arrive to the courthouse here in Lower Manhattan for day two of his trial. It is not clear how many days he intends on being here. Yesterday on monday, the first day of the trial, he used the opportunity not to willingly testify in front of this judge. He has not indicated yet whether he will go on the stand himself, but instead he used the opportunity to walk out of the courthouse doors and on three different occasions yesterday, once in the morning, once on the lunch break and once in the after to go before cameras and go on a monologue about the pending proceedings. For donald trump, he was quite explicit, saying at one point, quote, this is a disgrace and you ought to go after this Attorney General. He also took on the judge in this case, who already had that initial ruling last week. Donald trump was joined by his two attorneys, chris koois and alina has been baa. When she went before the judge, she indicated she had intended to speak but with much fervor and much defense of donald trump, much echoing what he usually posts on his social media account. She attacked the integrity of the proceedings. The judge suggesting this will last until as late as december 22nd. The first witness yesterday went on the stand, Donald Trumps former personal accountant who worked on the assets named here in this lawsuit by the Attorney General. We expect him to go back on the stand today as the defense team has the opportunity to cross examine here. We then potentially would have the second witness. This is a long list from don junior to eric trump to ivanka trump to michael cohen. Its going to be up to his defense team to win in the court of law inside of the courtroom. Two very Different Things. So does the former president have to be at these proceedings, and how much longer does he play to stay there . Reporter no, he doesnt have to be at these proceedings. There are really two benefits for him out of this. Number one, he is able to suggest to his vast millions of followers that he is taking on the trial system and the prosecutors and judges head on. He is using the mugshot from Fulton County to continue to fund raise. We know that tens of millions of dollars from his leadership pac from gone to pay his expenses. The second part of this is that for donald trump, he has been fickle when it comes to who represents him on his legal teams. He has fired numerous individuals over the last year. There have been several others who have decided to walk away from him. In this case, the only way for donald trump to tornado watch how his defense team handles the judge and the prosecution is by sitting in the courtroom himself and watching them come to his defense. Were you surprised by anything you saw yesterday, which is that donald trump really making his case outside the courtroom screaming about the judge and the Attorney General . As far as the case itself goes, what was your takeaway yesterday . Im not surprised that he did that. This is his way of testifying without being cross examined. So thats what he was doing. He must have forgotten theres no jury here. Its the judge. So hes not influencing any jurors. This is all about his campaign. Im surprised his attorney in her Opening Statement instead of being like a lawyer and using it in her Opening Statement to show why the Attorney General cannot prove by the preponderance of the evidence their case. She basically used it as a spokesperson and brought up arguments that really can be argued are not based in law or fact, which attorneys are not allowed to do. We have to peel back what happened yesterday. When donald trump says this is an outrage that the judge just handed down this decision and were already to the penalty phase, what does that mean exactly . The judge granted a motion for Summary Judgment just on one cause of action. Its a big cause of action. Its a violation of the New York State election law, which basically allowed the judge to say your business certificates are cancelled. In new york you need a certificate to run a business. Theyre cancelled. No business. What the judge didnt do is decide whether they falsified their Business Records, filed insurance applications with false information. The a. G. s office still has to prove that and prove donald trump and his business did all of that with the intend to defraud. Its very different. What the judge decided last week didnt require the prosecution to prove intent to defraud. So this is a real trial. Instead of spouting about this is a witch hunt, fight and show with evidence how they are not proving the intent to defraud. Thats what the lawyers should be doing, Donald Trumps lawyers. A lot of this is also Donald Trumps personality where he feels no one can advocate for him better than him, and he put the pressure on the lawyer. In her Opening Statement, she was talking to an audience of one, donald trump, not really to the judge. Exactly. Unlike the first part of this where the Summary Judgment came from the judge, were now to the phase where the a. G. s office has to prove intent to go to the next steps in terms of what the penalties will be. These were actually criminal charges that are being prosecuted civilly. Remember, the manhattan d. A. s office cy vance investigated these acts, and he recently said that he would have, if he had remained and he didnt probably chose to prosecute. The incoming d. A. Put a pause on it. That does not mean hes not going to prosecute it. The Attorney General has a burden. It is not proof beyond a reasonable doubt. Its preponderance. The attorney has to prove the Business Records were falsified and done with the intent for the Trump Organization to defraud that they issued these false Financial Statements and it was done with the intent to defraud. Its not just to be puffery and say im the top on the forbes list. Again today it appears that mr. Trump will appear in court. Again, you were a former assistant District Attorney. Each and every time he had the opportunity yesterday, mr. Trump came out and attacked the judge and the Attorney General in pretty violent language sometimes. Do you worry at all that the Attorney General of the state of new york, an africanamerican woman, is placed in any danger by this verbal rhetorical arsonist who uses every opportunity to demean and try and destroy her reputation. I do. And also the judge, some of the things he said yesterday about he should be criminally prosecuted and hes a hack. First of all, the judge and tish james, they just shake it off and let it roll. But donald trump, as we know, has a fan club of people who act on what he says. So i am certain that the a. G. And the judge, i hope, that they have security. Every time he says these things, its like setting fire on people who arent well and who might be violent and do things. She was there because of the importance of the case and to provide support for her attorneys. Shes not personally trying it. Thats why she was there. He doesnt have to be there. He was there, as we know, to come outside and say things that he probably does not have the courage to say on the stand. He has a right not to testify, but this is a way of doing it without being held accountable. Im curious if this trial impacts trumps present businesses as they are operating now in New York City . I know theres a receiver, a monitor theyre going to figure out how to put in place. But anybody doing business right now with trump inc. , would they have any concerns . Would this impact his business negatively . Would people not want to do business with trump given the ongoing litigation and whats been alleged and whats been found . Definitely. Now, the certificates cancellation, the judge didnt give clarity about what will happen. I think Donald Trumps lawyers even said, what does that mean, are they dissolved immediately . But why would you do business with a company that the judge just said are going to be cancelled . And if you lose this trial, you wont even have your company anymore. If i were a business person, i would not want to do business with a company like that. Those people are thinking about that now, whether or not they should conduct business. It will be a fatal blow to Donald Trumps companies if he were to lose this trial. Theres a pending gag order in another case thats being discussed right now. How could one play into the other . Do you think were going to hear from the judge in the federal case that trump needs to stop talking like this . This will be more ammunition for jack smith and special counsel. Yes, its a completely separate case, but it goes to show the type of defendant that donald trump is, that wherever he goes, he cant help himself from making intimidating, threatening, disparaging statements against attorneys and judges in pending cases. A farright republican officially filed a motion last night to oust Kevin Mccarthy as House Speaker. The Lower Chamber now has until tomorrow to decide whether to keep mccarthy at the top spot. As of this morning, his support is up in the air. At least five republicans have publicly stated they will vote to remove mccarthy, which means he will likely have to draw on the support of House Democrats to maintain his speakership. What i will say to you is what i said to him, which is that we have a caucus meeting. Lets bring in sahil kapur. What do we expect today . Reporter now that matt gaetz has triggered that motion to vacate, it has to take place in two legislative days. Five is the magic number. Gaetz does have five republicans who will vote to oust mccarthy. That is enough for mccarthy to require some democratic help to survive. Democrats have very torn on this. Some do see value in potentially voting to rescue speaker Kevin Mccarthy. They may not have to vote with gaetz. All they have to do is vote present. They see it as a vote to push back against farright extremists. One thing that does keep coming up is they think theyre going to get something from Speaker Mccarthy. The problem is mccarthy just said on cnbc that hes not going to provide anything. There does appear to be a disconnect between what democrats think this is going to be about and this only weakens him with the farright and center right republicans. There are democrats who are emphatically against this idea. They say no way democrats should entertain the idea of rescuing mccarthy. Eric swalwell is a hard no. Another hard no is congressman jerry connolly. Quote, democrats should tnk long and hard about this. Theres absolutely no upside to preserving mccarthy in the speakership. He says it is an unstable speakership and we should not enable, aid or abet his continuation in office. And what is the basis for why democrats are apprehensive . The biggest thing is they dont trust mccarthy. Are they really going to rescue a speaker who is impeaching President Joe Biden over what they say is no evidence . The other problem is a lot of these members who might potentially vote to save mccarthy are centrists in swing districts. This morning were checking in on one of the most impactful projects of his post presidency, building homes for habitat for humanity. We were there to maybe take a picture and hold a hammer, and we stayed all day. We had the best time. Thats kind of when our love for habitat for humanity was born. Its wonderful. There are so many great things about habitat and working with the carters. This is an amazing organization. Its why we keep coming back. For people that havent done it, so many people have been involved through the years. Talk about how theres such a sense of Community Around one of these projects and how you almost instantly see the outcome of your work, helping other people. Yeah. I think thats what its all about. Its basically just people loving people right here, all walks of life. It doesnt matter. If you can swing a hammer, come on. If you cant, theres other ways to volunteer as well. When you meet the firster president of the United States and first lady, theres always a sense of awe from ordinary people. What was your reaction when you met jimmy carter to get to know him and speak with him . Well, i think we ever feel like, oh were buddies now. I know there was a particular moment when we were in haiti. The hotel that we stayed in was this brick building. At night, we would sit downstairs and kind of talk over the day. One night president carter wandered in and sat down with us and started telling stories. It was an amazing evening. When we went upstairs to go to bed, garth and i shut the door and we were like Little School children. It was an amazing experience. This is special and we need to enjoy every second. They are the example of service. They served our country and theyve continued for many years to serve the world in the way that we all want to. Theyre the examples of how to be. It takes public and private and Civil Society coming together to make sure that works. We serve in 70 countries and the United States. The families buy the houses, but we need subsidy in either financing or land. When corporations come together, that allows families to be able to purchase homes they otherwise could not afford. I got tired of having very smart wonderful friends of mine tell me they were done with politics and angry at the United States and sick of the division. So i wanted to offer people a road map that abe lincoln gave us about how to be happier, healthier, better americans and how to create a more perfect union. The book lays out seven steps we can all take to be abe lyndon and in so doing make ourselves and our country better. Im looking at the short version of them. I love the first one. Laugh. Well, you cant be abe lincoln and not laugh. He was renowned for his sense of humor. People used to go to the white house not to meet the president , but to hear his jokes. He admitted that he needed laughter in order to live. He said if i didnt laugh, id cry. And he said if i didnt have laughter, i would kill myself. We know he suffered from depression. Laughter was his coping mechanism. I dont see a lot of laughs in our leaders now, at least not intentional ones. Were going to put the seven steps up. Laugh, improve, navigate, collaborate, object, love and now. What do we do as a country when you consider the fact that five of those seven steps, i think, are probably obviated by the lingering shadow of a menace in america who used to be president of the United States . One thing that we keep in mind, i find it helpful to remember that during the entire civil war abe lincoln kept the government open. We didnt have a single Government Shutdown. Even though half the country was trying to destroy the federal government. The reason is lincoln took the idea off the table. He said government continuity was a right of the people that could never be abrogated. He never let insults affect how he approached the problem. He was a man who lived by fact, by reason, and by empathy. And until we get back to those lincolnesque principles, we can never be what lincoln wanted us to be, which was a nation of people who actually cared for one another.
