far-right member of the house triggered a vote that could remove him from his leadership post. we'll have the latest on that fight inside the republican party. also ahead we'll bring you a recap of day one in donald trump's civil fraud trial here in new york city including the moment that seemed to enrage the former president. plus, hunter biden will also be in court today. we'll go through the new developments in that case as well as the impeachment inquiry into his father, the president. good morning and welcome to "way too early" on this tuesday, october 3rd. i'm jonathan lemire. that mornings for starting your day with us. we'll begin this morning, a busy morning, with mutiny in the house republican congress. congressman matt gaetz of florida officially filed a motion late last night to oust kevin mccarthy as house speaker. >> at this point next week one of two things will happen. kevin mccarthy won't be the speaker of the house, or he'll be the speak of the houseworking at the pleasure of the democrats. a number of democrats have told me they're going to do whatever hakeem jeffries says, and i believe them. and if hakeem jeffries wants to adauptd kevin mccarthy, then he can adopt him. then at least he won't belong to me. >> the lower chamber now has until tomorrow to decide whether or not to keep mccarthy in the top spot. as of this morning his support is still up in the air. at least five republicans have gone on the record to publicly state they would vote to remove mccarthy, which means he'll now have to draw on the support of house democrats to maintain his speakership. now, democrats for their part are torn on whether to save the speaker. while some see a world in which they can extract concessions from the california republican in exchange for saving him, others see saving mccarthy as a bad idea after he single-handedly launched an impeachment inquiry into president biden. however, a source close to the democratic leadership tells nbc news that this all depends on mccarthy himself. they say if an arrangement is to be made, it will be up to the speaker to reach out, which he's reportedly not done, at least not. in response to all of this, mccarthy tweeted out a simple message. quote, bring it on. to which gaetz responded, just did. this feels like a 1990s high school movie. as the speaker begins negotiations with members of the house to save his post, minority leader hakeem jeffries will be our guest on "morning joe" later this morning to discuss where they stand on all of this. donald trump is expected to be back in court for day two. yesterday the punishment phase began after the judge found trump, his two oldest sons, and his company liable last week. the former president sat with his arms crossed as his defense team and prosecutors from the new york attorney general's office gave their opening statements. sitting just a few feet away from trump was the attorney general herself, letitia james, who glared at trump while cameras were briefly allowed inside the courtroom. an attorney for trump complained the former president did want a jury to hear the case, but the judge noted that his team had never asked for a jury trial, which would have been standard procedure. after opening statements prosecutors played tape depositions from trump, his sons, and as well as his former attorney, michael cohen, and his company's former chief financial officer, allen weisselberg. they then called their first witness, a former accountant who spent several years handling the former president's tax returns. according to our team at nbc news that was inside the courtroom, trump seemed to take issue with some of what was being said during that testimony and became extremely animated with his attorneys. his face is said to have become beat red while he pointed and finger waved at his lawyers. that aside for most of the proceedings trump appeared rather subdued during the trial. outside the courtroom, though, he was anything but. here is some of what he said to reporters during a lunch break. >> when you have the radical left attorney general like letitia james who's a disgrace to our country, who got elected on the fact that she's going to take down president trump, we're going to take him down. this is called election interference, and worse than that, really much worse than that. and you don't get much worse than electionfortference. i got a call last week, sir, we lost part of the case. i said the trial didn't even start. the trial starts i guess today. he ruled that we lost a big part of the case because he's a democrat club politician. he's a democrat operative, and he's a disgrace. >> a clearly agitated donald trump there. joining us now msnbc justice and legal affairs analyst anthony coaly. he was most recently the top spokesman at the department of justice under attorney general merrick garland. andy, great to see you. >> good to be with you. >> let's start there with the idea of a jury trial? is that something the trump team could ask for? >> i have a cynical view about this allegation. i think what the trump team is trying to do here is lay the ground work for judicial bias on appeal. and the reason i say that, jonathan, you and i have been following and watching the trump team for years. this would be a vital mistake and someone would have been fired for this. and we would have certainly heard about it by now, so i think this is just a lame attempt to distract from what's going on. >> certain he doesn't surround himself with the highest quality lawyers because he doesn't pay his attorneys. we heard from trump multiple times yesterday. clearly performative. it wouldn't have any bearing on the case itself i think, so what's the reasoning behind it. is he just playing for politics? >> this is new trump trial but same trump play book. it's attack the judges. it's attack the prosecutors, and portray himself as a victim all while denying the underlying facts. and the problem for him, jonathan, is that the facts in this case many of them have already been decided by this judge. the judge has already found him liable for fraud. the judge has already decided to revoke his business license, so i think what we saw yesterday was donald trump really trying to get some type of political benefit out of these very real political issues. >> what's your analysis of what actually transpired inside the courtroom yesterday and what we should expect today? >> i think it's all performative to be honest with you. this is donald trump really trying to rally the base. over the last 36 hours msnbc and others have reported he's already sent out three fund-raising solicitations to his supporters. and if you look at the coverage particularly in conservative media over the course of the last 24 hours, there is little oxygen for his republican presidential rivals to break through. so what we have now is donald trump on track to be the gop presidential nominee, and that's, i think, in part because members of the maga base are not paying attention. they're not focused on the facts in any of these individual cases. for many of these individuals i feel like all these cases have just melded together into one major i think way to paint trump as a victim of the radical left. >> yeah, sort of this deep state blob and the details get lost because there's just so much. lastly, do you think that what we saw yesterday both inside the courtroom and then trump, his tirades outside, make it more or less likely he'll actually testify in this? >> so i don't take trump at his word. anything trump says i take with a grain of salt. any particularly lawyer here i think would advise him not to, but i think we'd all have to wait and see what he actually does. >> we'll be talking about it the case in the weeks ahead. later this morning in another courtroom hunter biden is scheduled to be arraigned in federal court on felony firearm charges which will take place in the state of delaware. the three charges stem from october of 2018 when the president's son is accused of lying about his drug use when he was filling out forms while buying a gun there in wilmington. he's expected to plead not guilty. two of the charges carry maximums of ten years behind bars while the third carries a five-year sentence. but it's rather unlikely that a nonviolent first time offender would receive those maximums if found guilty. today's arraignment comes after a plea deal that hunter biden's attorneys struck with the government fell apart earlier this year in the appointment of a special counsel. we're also learning new details about the house republicans expanding impeachment inquiry into hunter biden's father, the president of the united states. three sources familiar with the matter tell nbc news that a federal prosecutor will take part in a closed door interview today with house investigators. u.s. attorney for washington, d.c., matthew graves, who also played a role in the hunter biden case, will sit for a voluntary interview with the house judiciary committee. whistle lower accused graves of refusing to work the special counsel in the case, david weiss. weiss had been investigating the tax charges against hunter biden. doj did not immediately respond to request for comment. wiese's office also declined to comment. we'll have more >> if she was in this game, she left. >> that monday night football take from the many brothers as the seattle sea hawks led the new york giants 14-3 at half time. that was pretty uninspired football, and, well it did not get better after the break for the giants and especially quarterback daniel jones who was sacked a career high 12 times last night. danny dimes was also intercepted twice including a 97-yard pick six you're seeing here that was taken to the house by sea hawks rookie corner devon witherspoon that more or less ended the game. jones was bad. the giants have already gone 0 and 3 in prime time this season and been outscored a total of 94-15 in those games. good news here, the mor league baseball playoffs begin today. we've got four games in the wild card series. the action starts this afternoon in the american league. the texas rangers will look to shake off the disappointment of narrowly missing out on the al title they led most of the yr. they'll visit the tampa bay rays for the opener of a best to three series. meanwhile they'll try to snap an 18-game playoff losing streak against the toronto blue jays. how is it even possible to lose 18 straight playoffs. the milwaukee brewers hosts the arizona diamondbacks in game one and the miami marlins visit the philadelphia phillies. and finally we turn to the nba and a surprising new look for miami heat star jimmy butler who attended the team's media day yesterday with straightened hair and a pair of piercings. >> what's this? >> being put to death. >> treason is treason, and we usually execute or imprison people for it. and all the treasonous actions i see in this day and age is thrown underneath the rug. >> why wasn't he in front of a firing squad within a month? >> violent rhetoric has always been what trump has done, but it's getting to more dangerous and dark places even after january 6th. joining us now politics reporter for semafor, shelby talcott. you had a smart story even though we're just in october 2023 we're still 13 months from actual election day. feels like the general election campaign has already begun. and it feels like it is biden, it is trump. and certainly donald trump already eyeing past the gop primary field even though not a single ballot has yet been cast. tell us about that strategy. this has been really interesting to watch because obviously as you said we still have a ways to go before the actual general election, but what trump is trying to do here is essentially close the door on all his rivals in a very far away second place, and so you've seen him go to michigan where he's trying to win over those auto workers that are typically biden voters. you've seen him ramp up his rhetoric against joe biden in recent speeches, and then you've seen on the flip side joe biden is kind of doing the same. the biden campaign out with an ad last week really directly targeting trump. joe biden is also speaking about the former president in his recent speeches. even though there's a ways to go, it's sort of in a way feels like the two front runners have already decided that the primary is over. >> yeah, certainly polls would suggest americans not all that excited about a possible 2020 rematch, but both parties gearing up for one. let's talk about the rest of that republican primary field, though. they're not giving up although they certainly haven't really gone after trump. yeah, some of them took on the former president but only to criticize his lack of appearance at the debate is. . not much about his record or rhetoric or possible criminal charges. is there any sense that's going to change? >> no, i don't think so. and it's been interesting also because the big question is what kind of an attack can trump's rile rivals use against trump that's going to be effective? you just talked about trump is branding up his violent rhetoric. typically that would be something that you would think a rival campaign would hone in on, and they haven't yet. because you see his supporters which are people his supporters are trying to get on their side, are for this kind of rhetoric. so it's been really difficult for campaigns to effectively find an attack line that actually translates and doesn't end upturning off voters they're trying to get. >> shelby, i know you're in close contact with the trump campaign. what's their current thoughts about what we're seeing play out in a new york courtroom right now? this fraud trial he's already been found liable. do they think there's any negative political impact here? or is this simply about the former president's financial future and ego if he can't do business in new york anymore and is made to pay a very hefty fine? >> hey, john, good morning. we've been watching bond yields rise for several weeks now in the u.s. a lot of the move higher has come up to the federal reserve and essentially sent the message interest rates are going to remain higher than longer than previously expected. in terms of equity markets today u.s. futures indicate a fairly muted change. it could prove to be a roller coaster day. yesterday we saw some pretty heavy selling in equities for most of the day, but a rally left the s&p 500 a little changed on the day. we've got the release of job openings for august due out later today. and at the end of the week on friday we've got the nonpharm payrolls report. >> shares of tesla dropped after the auto maker reported pretty disappointing sales figures. give us the read out on that. >> this report was actually all about deliveries. tesla for the first time in more than a year in the third quarter reported a drop in deliveries compared to the previous quarter. it was also oo lower figure than wall street was expecting. estimates were around 455,000, total deliveries for the quart, and they actually managed to deliver just over 445,000. the reason for weaker deliveries, number one some planned factory closures, shutdown since they upgraded various factories. but two a more macro economic reason, higher interest rates are putting pressure on electric vehicles. tesla has been in extra focus over the last few months as it recently cut prices across inventory of existing vehicles and that's put pressure on some of its competitor tuesday do the same. >> and lastly apple is dealing with overheating in some of its new iphones. customers really complaining about it. what's happening, and is there a solution? "the post" points out the federal government is no longer buying and distributing all vaccines, unleashing a host of complications. the new shots are recommended for everyone older than six months. joining us now founding director for boston university's center for emerging infectious diseases in policy and research. doctor, great to see you again. though not for a good reason, unfortunately. covid numbers going up. let's be clear this isn't the surge that we've seen other times, but they are still starting to skyrocket, and now we're having these reports about parents in particular struggling to get the updated covid vaccine for their kids, and some surveys suggest more than half of adult americans have decided to not get a booster. so just lay it for us. should parents be getting boosters for their kids? should grown ups be getting the booster shot for themselves? how worried are you about the winter ahead? >> jonathan, it's never a good thing, right, when you see me on tv. i think what you've seen is this year compared today last year even as the cases go up, we are seeing a population that's a lot more immunized, and so we're hoping the same kind of deadliness we've seen with prior surges, that we may not see that. but you know what happens, the flu and cold season brings about rsv, influenza, and covid-19. and last year in 2022 we saw a tripledemic and overwhelmed the hospitals. you're right for adult and child vaccination. i think the highest attention here should be for the 100 million high risk americans out there. and october, this is the perfect timing for most people to get all three of these vaccinations. who qualifies for a covid saxeen everyone over six months. flu vaxoon everyone over six months. and 100 million at high risk for covid and influenza. and rsv pregnant people and infants as well as high risk children. and the reason to get it now is what do we do every year regardless of what's going to happen for this virus? next three months we're going to start gathering for thanksgiving and christmas. at least for covid at least for the first four months you have mild protection of illness even though the severe protection those four months we're going to be protected when the travel and gatherings are coming up. >> let's go through real world advice for people watching. you mentioned started. it's a good time to get the flu vaccine, the covid vaccine, also the rsv shots if you can. so should people be getting them at the same time? and where would you recommend people get these vaccines? because we are seeing shortages at places like pharmacies. >> yeah. i think that shortages, at least for adult vaccinations, are improving. as you said, one of the issues has been, over the prior years, the government has actually, you know, acquired these, distributed this, played a major role in ensuring they're stocked everywhere. this year, there are so many more actors that are involved in this process, so you're seeing the growing pains, which, unfortunately, i think it is a reflection of what we need to improve in our health care system at baseline. so the best advice that i can give folks, what i'm hearing is a lot of times, people are showing up at pharmacies and finding out that either it's not available or that it is not covered by their insurance. in those cases, many times, it's because they're in a place that's not in their network. what should you do? the best advice is for you to call your health insurance first to find out where the facilities are that are going to be in your network. once you make the appointment, ensure the day you go in to call the pharmacy and say, "hey, want to make sure you still have the vaccines in stock," before you go in. that allows you to not make the additional trips or to worry that something may not be covered. >> real world and helpful advice there. as cases continue to rise, i'm certain we'll be speaking to you again soon. we are always happy to see you on television, even if some of the news is grim. doctor, thank you again. up next here on "way too early," the biden administration is scrambling to assure that u.s. allies know aid to ukraine will continue despite republican opposition. we'll bring you that new reporting. then, coming up on "morning joe," we'll have live report from the courthouse in lower manhattan, where hours from now, donald trump's civil fraud trial is set to resume, and the former president is expected to return to the courthouse. plus, house minority leader hakeem jeffries will join the conversation, as democrats weigh whether or not to help save speaker kevin mccarthy's job. also ahead, country music icon garth brooks will be a guest. you won't want to miss that. >> well, i think president biden has said, you know, he expects congress to follow through and get some funding in a separate bill, but speaker mccarthy has said that he wants to tie that money to u.s. border security. so it's clear that there are some cracks forming in terms of support for ukraine and in what order it goes in terms of whether congress is going to put it first or put it second. >> there's some in the west wing that have signalled perhaps some support for linking border security and ukraine funding, but it raised a lot of eyebrows over the weekend when president biden seemed to suggest that speaker mccarthy may have already agreed to keep ukraine funding going. perhaps as part of a deal for him to preserve his speakership. white house press secretary was pressed yesterday and danced around it. is it your sense, is there a suggestion a deal was struck, or is this simply the president saying, well, in our previous talks back in the debt ceiling in may, mccarthy signalled he'd support ukraine, and his public rhetoric has, for the most part, been the same? >> i think we're reporting that out. it's unclear, as you said, jonathan, whether or not president biden was referring to an ongoing expectation, that there's a deal that congress will continue to support ukraine, or whether there was some talks over the weekend. clearly, mccarthy is going to need democratic support to hold on to his speakership, it looks like, but the question is also, how soon do they come back with a bill on ukraine? that's one of the things we're looking at. we have a story out about biden, expected to call some allies as soon as today. we have reporters on both sides, in europe and the u.s., really chasing that, because the allies are questioning, is there some waning of support in the u.s. for ukraine? >> that's where i wanted to go next. what is the degree of alarm in the european capitals, particularly in kyiv? >> i think they are asking questions. you know, they are trying to determine whether or not the u.s. is really going to continue, at a time when it is key. we had reporting last month that president zelenskyy is expecting and wanting to fight through the winter this year, compared to some of the backing off they did last year. he thinks that's really the way they're going to be able to make this counteroffensive happen. but i think that's something he needs the u.s. to support in order to do going into this winter. >> conditions for fighting are only growing more challenging. the muddy season and the brutal winter they usually have over there in ukraine. what would be the mechanism for when, assuming there is more funding for ukraine, what is the sense of how it'd happen? an independent spending bill or simply part of the next continuing resolution or longer term agreement to fund the government? >> what say said so far, it'd be a separate bill. the question is, how soon and how much? >> let's go back to the other part of this, where if, you know, mccarthy's proposal is linking ukraine funding to border security, what's the appetite there among other democrats? do they think that's a deal worth taking, and are they seeing the issue that, look, we need to deal with this migrant crisis right now, because we're seeing big cities, often big blue cities, struggling with the influx of numbers, also as we head into an election? >> i was just going to say that, jonathan. we are heading into an election year, and the issue of immigration and cities and this migrant issue at the border, and in other cities, is becoming one of the biggest in the election season. i think on both sides of the aisle, people are realizing that the american public wants some solution here, but the question is, how? i mean, we've been struggling with this immigration issue for decades, in republican and democratic administrations. >> there's no suggestion there would be comprehensive immigration reform, but could there be even additional funding? >> i think that's possible and i think that is where mccarthy is going to try to go. basically say, "hey, we want funding for border security to continue funding ukraine." >> terrific stuff, as always. peggy collins of bloomberg news, thank you. thanks so all of of you for getting up "way too early" on this tuesday morning.
