videotapes. thank you as always. the fab simone. i'm so proud of you. good evening, welcome to politicsnation. , we lcome to tonight's lead, governing by crisis. >> relief and revulsion, that's what i'm feeling tonight having watched this week's dramatic but successful term federal spending and avoid a government shutdown that was literally just hours away at this time last night. and while i am relieved that those thousands of federal employees will receive their paychecks, i remain revolted by the -- from house republicans. it nearly crippled america to score political points. president biden echoed this, the same sentiment this afternoon after signing the spending bill into law. saying it was time for congress to stop governing by crisis. >> enough is enough is enough. this is not that complicated. it has to end. there shouldn't be another crisis. >> so, the nation can continue to conduct its public business for at least another six weeks. speaker kevin mccarthy may not hold on to his job lavant and off he even preside over the next spending battle as he faces the new challenge to his leadership. meanwhile, former president trump is traveling to new york tonight ahead of his civic trial. his civil trial tomorrow. setting up a potential face off with new york attorney general letitia james who plans to be in the courtroom, according to a person familiar with her. a new session of the supreme court starting tomorrow. abortion, gun cases, social media all on the docket. in california, governor gavin newsom much decide very soon who will replace the late great senator diane feinstein at a time when democrats hold the slightest majority in the chamber. lots to cover tonight. let's get started. joining me now, congressman barbara lee, democrat of california. currently running for the u.s. senate. congresswoman, first, thank you for joining us tonight. i imagine you are relieved as we all were about the passes of yesterday's spending bill to keep the government open. or democrats that republicans voted for the resolution. can you talk about how you all came to this consensus? what we can expect when this comes up again in just 45 days. >> thank you, nicely with, you congratulations to you. your voice and your leadership is certainly needed for such times. i do have to salute and congratulate and said happy birthday greetings to president jimmy carter. i was able to be part of his sunday school class on several occasions. i'm telling you, he's a remarkable human being. yes, we had quite a time. democrats lead. first of all, speaker mccarthy was being held hostage by the maga extremist republicans and buy whatever deal he made with them. in fact, the republicans were ready to let the government shutdown. it would have furloughed so many workers. so many peoples lives. services would have been stopped. small businesses would have been in tatters. health care even cut. public safety accounts. it was a dangerous moment for people in this country. democrats stepped up. we fought to make sure that one of these budget cuts which they have presented 30% on all of these efforts that helped low income people, poor people, middle class to make it in this country. they are ready to cut the budget by 30%. i have to say, democrats save the day. leader hakeem jeffries was brilliant in the strategy. he sought was taking place on the floor. they gave us this bill by 15 minutes before they want to vote on it. it was outrageous. we don't know. leader mccarthy knew exactly what to do in terms of parliamentary procedures. we had time to read the bill. >> leader jeffries, the spending bill passed the house yesterday afternoon. it only took until this morning for florida congressman matt gaetz to say he will move this week to our speaker mechanic are the. some moderate publicans are urging democrats to save the speaker. several of your colleagues have said they will vote in favor of booting mccarthy. where do you stand? have you made up your mind? >> no, i'm not saying anything at this point. we have to talk to leader jeffries. we have to determine a path forward. speaker mccarthy has not stepped up in terms of an agenda and putting people over politics. first of all, so why should democrats save his speakership. i have no idea what the path forward is. i don't know what type of arrangements could be made. i have no idea. i think it's important right now for democrats to follow leader jeffries in terms of our strategy because we cannot allow the republicans and the maga extremist republicans to hold any speaker hostage for their agenda. it would really hurt and harm the american people. >> the watch what happened last night. it was not only frustrating, when you look at what was at stake, it was just outrageous to me. i can't tell you how angry i got. i'm on television. i won't say another word. >> they're not people before politics. they are paying their political gains. unfortunately, speaker mccarthy is caught in that. he did not step up. >> urged by a man facing 91 felony counts in four trials. he can put a lot of them into this kind of position, to listen to him. it's unbelievable. i want to -- to jimmy carter. i want to offer condolences over the loss of dianne feinstein who passed away friday after more than 30 years representing california in the senate. governor gavin newsom has stated that he's going to naming someone certainly. as you, know he pledged to appoint a black woman. he made other statements it will be people -- you said you don't want to discuss this out of respect to the family. i'm going to respect that, the statements about the. i want to bring it up. so viewers would not feel i was ducking the issue. my position is what it is, we will find out in a respectful time with the congresswoman wants to say about that. >> let me just mention a couple of things about senator feinstein. >> these have not been brought forth about senator feinstein. in offering my condolences and grieving like the rest of our state and country is with the loss of this trail blazer. a couple of things and stories that i want to relate to. we were on the senate floor. senator padilla spoke eloquently about the fact that he had been a staff person a silent immigrant working -- also senator feinstein had a person in her office who was specifically dedicated to the african american community. from day, one she really understood what the diversity meant in terms of her overall agenda. percy was at every single event representing diane feinstein. representing the senator on all the issues we cared about in the black community. early on, she killed about racial equity and diversity and inclusion. secondly, i voted against the authorization to use military force. it was a hard vote. i was the only one who voted against it. senator -- >> the only one in congress, about a. >> house and the senate. senator feinstein, even though she disagreed with me, she knew i loved orchids. i have this painting, she was an artist, she painted this beautiful painting of an orchid. she signed it and she put 2001, the date. she gave that to me. and kindness and love. she wanted to lift me up. you know reverend al, that was a difficult time. the side of her gentleness and kindness gets lost because she was such a great leader. such as the assault weapon ban. leaving on all the issues in my district. helping us bring fellow resources to my district and to california. those stories need to be told, i know her relationship with the black community and how percy was so close to her and how he really represented her and took our issues back to her so she could champing them innocent. i'm a witness, head of the app national network, we have chapters in sacramento and l.a.. percy i would see almost every time i came to los angeles. i know you are correct there. before we go. i want to ask what you make of republican attacks to your come congressman jamal bowman the capitol police investigating white -- woman said it was unintentional. speaker mccarthy compared it to the acts of january 6th. e acts other members of the party are calling for his expulsion. is this an overreaction, perhaps even a distraction being pushed by republicans? i know jamal well. i doubt if he would intentionally do things. investigations -- even that, even if they find something to compare to january six, congressman? >> it doesn't make any sense speaker mccarthy, you never know where he's coming from on anything. i believe congressman bowman. i know him well. you don't do this intentionally. he apologized, let's move. on the trying to find anything they can to distract from their efforts to destroy our democracy and to make sure that budgets are cut and people are relying on them for childcare and health care and for housing. they are distracting and trying to distract from the real work that we are trying to do as democrats. taking away the attention on what they're doing to destroy our democracy. forget what speaker mccarthy says. i know we're going to have to circle around it. i intend to do that it's a bunch of noise, they're showing how petty they are. >> thank you congresswoman i really for being with us tonight. from the house to the senate, joining me now, democratic senator jeff berkeley who sits on the appropriations and budget committee. thank you for joining me today. >> great to be with you. >> thank you again. let's start with the spending bill. you and your colleagues work to keep the government running for another 45 days. what's going on right in terms of getting started on a longer term plan? >> there are 12 spending bills. they've all come out of the appropriations committee with bipartisan supporting, some of the most difficult bills like the interior bill which i chaired. we came out unanimous. we have a real foundation. now we have to move all 12 of those to the senate floor. we'll probably do it in a series of what we refer to as -- 3 to 4 time. the challenges make it easy to really slow things down. we don't have time to slow down. in the next four weeks, we need to get all 12 of the bills passed. >> it seems speaker mccarthy will face a challenge to his leadership this week for members of his caucus, from where you sit in the senate. are you concerned that the turmoil against republicans will affect your ability to get things done for the american people? >> here's the fascinating thing. we have a model of bipartisan work in the senate. we kept say the only way we're going to save the government is to have bipartisan work in the house. mcconnell, not mcconnell, the house speaker, was being led around by the crazies on the far-right. the mega stream us. they worked to throw me out of office if he didn't do anything they wanted. we were talking to where you have three months ago that hey signed up for, kevin mccarthy signed up for the president. and then they said, well, they wanted a percent cuts. they want to 30% cuts. crazy stuff. also lots of poison pills. he finally had to cut the cord and say i'm going my own way. i'm pushing forward the bipartisan bill that mimics what the senate has done with some significant differences on ukraine and pumped up some of the disasters. it was the senate bill. the result at the last second. here's the thing, what happens next week's iq jeffries going to make phone call automobile in order to provide democratic votes for someone who will lead the house on a bipartisan fashion. will it be kevin mccarthy? are we going to see a repeat of the extremist that we've seen today it? >> this spending bill did not include aid to ukraine. president biden addressed that today. take a listen. >> the speaker and the overwhelming majority of the congress have steadfastly supported ukraine to defend itself against the aggression and brutality of the russian attack on women and children. in addition to the military in ukraine. there is no ukraine funding disagreement. i fully expect the speaker to keep the commitment secured and support needed to help ukraine as they defend themselves against aggression brutality. >> are you confident, senator, that a stand-alone bill will pass on ukraine? call your cardiologist, and ask about attr-cm. ♪ ♪ ♪ >> welcome back to politicsnation. let's bring in my political panel. former senator doug jones of alabama, and olivia troye, former homeland security and councillor terrorism adviser to vice president pence. let's start with the fallout in the house after congress passed a cr bill to avert a government shutdown hours before the deadline. earlier today, florida congressman, republican congressman matt gaetz says he plans to file a motion to revepeaker mccarthy this week. he brushed off the threats today, but to survive a challenge, he may need democratic votes. politico reports former speaker nancy pelosi has won minority leader hakeem jeffries and some in his leadership team not to rush to bail mccarthy out. doug, what would be the advantages and disadvantages of democrats throwing speaker mccarthy a lifeline? >> i think that speaker mccarthy is in a tough situation right now. he's got chaos in his own caucus. he has people with knives out after him. they've been that way for sometime. at the same time, he has not done anything to really help democrats. trying to maintain his speakership. he broke his promise to the president on the debt ceiling, he has called for and has sanctioned impeachment hearings that have no basis whatsoever. i think that the democrats, this is likely a pretty easy vote for most democrats. i think that some in the democratic caucus will likely look at only this last vote and think that he did the right thing. he stood up to that maga caucus, the freedom caucus. at the end of the day, i tend to agree with speaker pelosi. this is not somebody that has really exercised leadership. it seems to be simply making promises to get to a certain point, and then realizing that those promises cannot be kept. i think that we are going to be seeing some interesting moves in the house of representatives over the next three weeks. >> olivia, many vulnerable republicans and moderate districts wanted no part of a shutdown. now they are facing the possibility of another protracted leadership battle. the republican majority is slim to begin with, are the gop hard-liners in the house putting it at risk? >> they absolutely are. every day that they behave in this way, and that the circus goes on, and the maga world within the gop is another day that the gop's brand is hard. it's another day that the party gets derailed and its progress. we are going backwards here, and i think that they are completely disruptive. i think that moderate republicans out there who are concerned about keeping their seats have a right to be concerned. we are in a situation here where we came very close to many americans lives impacted. people forget, some of these people saying yes, we'll stick it to the federal government. it's about the repercussions of, how about the restaurants that will be impacted? the service industry. multiple layers here across the country that get impacted when the government shuts down like this. here we are again, we are going in circles. now there is going to be this spectacle of a fight with matt gaetz, who personally i think does not deserve to be in congress given his unethical behavior, and the investigations he is under. i think that matt gaetz should actually be stripped from his committee assignments and be put in a box, be taught a lesson. i think other maga republicans should be taught that lesson as well. kevin mccarthy needs to be stronger and standing up to this wing of the party. >> olivia, let me stick with you a minute. tonight, former president donald trump is expected to be in new york city ahead of the civil fraud case by new york attorney general letitia james. that goes on trial tomorrow. the a.g. will be in the courtroom as, well setting up a potential face-off between her and trump, according to a person familiar with the a.g.'s plans. the judge in this case sits in his ruling on tuesday, trump and his company are liable for fraud by misstating the true values of multiple real estate properties. trump and his children are on the list of potential witnesses during the trial. with less than four months until the iowa caucus, trump still dominates the republican presidential field despite his legal woes. is there still a chance in your judgment for another candidate to surge in the polls, or does trump have this race all wrapped up? >> as much as i would like that to be the case, i would prefer that another candidate surface, and that we move past the trump moment of the party. i do not see that happening anytime soon. i don't see a path for it. he is the stronghold in the republican party right now. i fully expect him to be the nominee. he is finally somewhat been held accountable in the rule of law. i hope that he will be held accountable until the end. he has been defrauding americans for years now. he continues to defraud them. he will probably, i fully expect that he will show up at that court hearing because he will fund-raise off of it. once again, defrauding people, lying to americans and raising money off of this. unfortunately, i just don't think that the republican party is going to be able to move past him anytime soon. >> doug, as an attorney, your thoughts on this first trump trials starting tomorrow? >> reverend, i think this guy has been cast. i think this judge is already making -- such that we are going to see some very serious repercussions. i think that is the best word. legal repercussions for trump and his real estate empire, his whole business holdings. think about this, think about the fact that you have got a judge that is likely to rule a final ruling for damages in a fall trial, saying he misrepresented so many things in his business dealings. all of his properties. that is the basis of all of his money. it's the basis of his so-called empire. if that gets called into question, it is going to have serious repercussions for him financially, as well as all of his holdings. i think that we are going to see a lot happening. i like to say one thing as well, going back to olivia's point about the shutdown. all of this is connected, nothing happens in a vacuum in washington, d.c.. the trump trial, the finding of fraud by the court, the absolute fiasco of an impeachment hearing that the republicans had in congress the other day. all of these things are connected to the fact that kevin mccarthy had to cave in. he had to go back to actually governing and doing something for the country, rather than -- because the party was really going to continue to suffer if you held out for these maga extremists. >> let me stay with you a minute. let's turn to another very important issue. the supreme court. it opens a new session tomorrow. the last session ended in june with monumental decisions ending affirmative action and college admissions. that has set off a series of lawsuits targeting diversity programs. you spoke last night on this program on them being sued right now for alleged violation of the civil rights act forgiving funding for black women to have businesses and grow those businesses. of course, the year before the court overturned roe v. wade. what can we expect next from this conservative dominated court, doug? >> reverend, it is really a crapshoot at this point. while you saw a lot of those decisions, you also saw the court uphold the voting rights act in the alabama case. you saw a pullback to say that some of these conservative groups, advocacy groups trying to make all of these changes legally. they might have gone a little bit too far. i'm hoping that we are going to be seeing that with regard to all of these lawsuits that are following the affirmative action. the supreme court, you've got a couple of folks in particular. i think justice roberts, justice kavanaugh, they are the type of justices that might say, look, we will only go so far. you're not going to be able to take every ruling and run rampant with it to completely alter american jurisprudence, american society. it remains to be seen. i think any legal commentator will tell you that they would expect a more conservative ruling. i think that that will happen, but at the same time, some of these things we might be surprised that they might be pulling back just a little bit and tilting a little bit back towards the center. at least we can all hope that way, reverent. >> all right, doug jones and olivia troye, thank you both for being with us tonight. after the break, preaches returning to professors behind the podium as they fight to preserve americans black history. black history. >> welcome back to politicsnation. well governor ron desantis has escalated his war on black history in florida public schools, african american parents in the sunshine state have found themselves grappling with how to give their children a full accounting of the black experience. since now they cannot expected in the classroom, or in libraries that have banned books on the subject, but a coalition of the states black churches is pushing back against the restrictions of the desantis administration with what they say is black history, history filtered through the lens of truth. joining us now, at the reverend rhonda towns, executive director of faith in florida. i want to start by saying that as a child of the civil rights movement, i am old enough to remember the freedom schools. i was just a kid before i joined in new york, operation bread basket. i would read about the freedom schools which originated during the movement to ensure that black children in the jim crow south would receive an education that affirmed them and black people. it's why i'm troubled the today in florida, black parents, community groups, and of course churches, are having to create modern-day freedom schools to fill the void created by states restrictions on how black history is taught. how is your group fit in florida leading this push to fully teach black history in florida, even if it is outside of the classroom? >> yes, thank you reverend sharpton. what we are doing is organizing black churches across the state to commit and take a pledge that we will teach black history to our children. young people overall, because the watered down version that has been taught is not real, it's not authentic. we are taking the responsibility upon ourselves to make sure that black history will be taught in its full truth. the black church has always played an active role in teaching our children. we are just going to continue that and make sure that it's still done in a way that our children can receive the best through our churches. >> you are galvanized by florida's decision earlier this year to ban an advanced placement african american history course from the states high schools. that decision of course, following the states so called stop woke act of 2022. restricting how race is taught in the states public schools. i know that many -- coming down there with our b homes, bishop rudy mckee. that has been at the center of a lawsuit the restricts academic freedom, violating the first and 14th amendment. florida is just one of several states that have introduced or passed laws restricting how the divisive topics like race are taught in public schools. i bring it up because i understand that your group fif, faith in florida. has been contacted in other states that are not part of the black church community, on guidance for how to circumvent these restrictions. what are you hearing from them when they reach out? >> we're hearing several things. number, one we have white churches in the state of florida that have agreed to teach black history. they might not be able to teach it in a way that the black church can, but they can teach it in a way of accountability. they've joined as well, over 20 other states throughout our country that have also agreed, they are keeping their eyes on florida, watching what is being done. preferably, it will not hit their state, but nevertheless they know the importance of it. other states have joined florida in committing to teaching black history. and it's realness. >> this past -- florida unveiled new educational standards governing among other things how the history of american shadow slavery would be taught. perhaps the mos controversial item in those replies standards where the suggestion that some slaves benefited personally from the experience, because they learned useful skills. last week, south carolina republican senator tim scott, the only black candidate seeking a gop presidential nomination said this. listen. >> there is not a redeeming quality in slavery. america suffered because of slavery. we have overcome that. we are the greatest nation on earth because we faced our demons in the mirror, and we made a decision. black families survived slavery. we survived texas and literacy tests. we survived discrimination woven into the laws of our country. what was hard to survive was johnson's great society. >> i will remind you that florida governor desantis also was speaking and seeking the nomination, seeking that night. he was just two podiums away. your thoughts on senator scott's comments? overcoming social programs, we have not overcome -- comparing that to slavery and jim crow. >> yes, senator scott needs a course himself on black history. i'm not sure what lens he is looking out of. first of all, we have never benefited from it, but also they have modernized slavery through our criminal justice system, through public education systems, housing, and so many other issues that have impacted black people. we've not arrived, we have done better, but we have not arrived -- we have not yet -- we still face some racism. >> let me ask you this, i'm out of time but i want you to give me an idea. give our viewers around the country and idea of what you are teaching in the churches as you are starting to operate. who is doing the teaching now? how do you determine whether they are qualified to teach? >> what we have done is provide a tool kit giving out churches the creativity of whatever way they choose to teach. whether it is through art, music, the word of god, we just provide a tool kit, and the individual churches creating their own curriculum on how they will teach black history. when i say that, it means a variety of denominations. they have chosen to teach it. we've just made a space, giving them materials of all ages who can benefit from this teaching. in the churches itself, individually choosing to have that curriculum that works for their church. so far, it has been a huge success. >> i'm glad to see that there has been effort, and of course, we also need to keep that pressure in the judgment on the governor and state legislature. in the interim, we cannot let people, children black and white and latino, and asian, in florida going without an ability to go somewhere and learn the whole truth and nothing but the truth. thank you so much, reverend rhonda thomas. >> thank you. >> up next, not one but two special birthdays i want to leave you with. my final thoughts, that is next. t is next salonpas, makers of powerful pain relief patches for 89 years... believes in continuous improvement... like rounded corners that resist peeling, with an array of active ingredients... and sizes to relieve your pain. salonpas. it's good medicine. >> tonight, i want to wish former president jimmy carter a happy 99th birthday. i have met and talked with the former president carter on many occasions. he has always been kind and gentle, inquisitive about whatever social issues are going on at the time. and i genuinely kind man, it's important to me, a genuine christian. he does not teach sunday school to just posture. i wish him a very happy birthday today. tuesday, it is my birthday. i will reach another birthday this coming tuesday, october 3rd. i am thankful to god and my mother, who raised me. giving me certain determination to keep going. although i am older than most of my national staff at the -- and most of the staff here that work on politicsnation, i'm still young enough to get up every morning and work out. i still have a strict diet, i do a rally and holler every saturday morning. usually on the road in more than one city a week, -- and if you put on a record, i can do the meanest james brown dance the side of augusta, georgia. i wish me a happy birthday. always a time of reflection, and one of the things that i must reflect on is the honor of talking to you every saturday and sunday. we'll be right back. videotapes. thank you as always. the fab simone. i'm so proud of you. good evening, welcome to politicsnation. , we lcome to tonight's lead, governing by crisis. >> relief and revulsion, that's what i'm feeling tonight having watched this week's dramatic but successful term federal spending and avoid a government shutdown that was literally just hours away at this time last night. and while i am relieved that those thousands of federal employees will receive their paychecks, i remain revolted by the -- from house republicans. it nearly crippled america to score political points. president biden echoed this, the same sentiment this afternoon after signing the spending bill into law. saying it was time for congress to stop governing by crisis. >> enough is enough is enough. this is not that complicated. it has to end. there shouldn't be another crisis. >> so, the nation can continue to conduct its public business for at least another six weeks. speaker kevin mccarthy may not hold on to his job lavant and off he even preside over the next spending battle as he faces the new challenge to his leadership. meanwhile, former president trump is traveling to new york tonight ahead of his civic trial. his civil trial tomorrow. setting up a potential face off with new york attorney general letitia james who plans to be in the courtroom, according to a person familiar with her. a new session of the supreme court starting tomorrow. abortion, gun cases, social media all on the docket. in california, governor gavin newsom much decide very soon who will replace the late great senator diane feinstein at a time when democrats hold the slightest majority in the chamber. lots to cover tonight. let's get started. joining me now, congressman barbara lee, democrat of california. currently running for the u.s. senate. congresswoman, first, thank you for joining us tonight. i imagine you are relieved as we all were about the passes of yesterday's spending bill to keep the government open. or democrats that republicans voted for the resolution. can you talk about how you all came to this consensus? what we can expect when this comes up again in just 45 days. >> thank you, nicely with, you congratulations to you. your voice and your leadership is certainly needed for such times. i do have to salute and congratulate and said happy birthday greetings to president jimmy carter. i was able to be part of his sunday school class on several occasions. i'm telling you, he's a remarkable human being. yes, we had quite a time. democrats lead. first of all, speaker mccarthy was being held hostage by the maga extremist republicans and buy whatever deal he made with them. in fact, the republicans were ready to let the government shutdown. it would have furloughed so many workers. so many peoples lives. services would have been stopped. small businesses would have been in tatters. health care even cut. public safety accounts. it was a dangerous moment for people in this country. democrats stepped up. we fought to make sure that one of these budget cuts which they have presented 30% on all of these efforts that helped low income people, poor people, middle class to make it in this country. they are ready to cut the budget by 30%. i have to say, democrats save the day. leader hakeem jeffries was brilliant in the strategy. he sought was taking place on the floor. they gave us this bill by 15 minutes before they want to vote on it. it was outrageous. we don't know. leader mccarthy knew exactly what to do in terms of parliamentary procedures. we had time to read the bill. >> leader jeffries, the spending bill passed the house yesterday afternoon. it only took until this morning for florida congressman matt gaetz to say he will move this week to our speaker mechanic are the. some moderate publicans are urging democrats to save the speaker. several of your colleagues have said they will vote in favor of booting mccarthy. where do you stand? have you made up your mind? >> no, i'm not saying anything at this point. we have to talk to leader jeffries. we have to determine a path forward. speaker mccarthy has not stepped up in terms of an agenda and putting people over politics. first of all, so why should democrats save his speakership. i have no idea what the path forward is. i don't know what type of arrangements could be made. i have no idea. i think it's important right now for democrats to follow leader jeffries in terms of our strategy because we cannot allow the republicans and the maga extremist republicans to hold any speaker hostage for their agenda. it would really hurt and harm the american people. >> the watch what happened last night. it was not only frustrating, when you look at what was at stake, it was just outrageous to me. i can't tell you how angry i got. i'm on television. i won't say another word. >> they're not people before politics. they are paying their political gains. unfortunately, speaker mccarthy is caught in that. he did not step up. >> urged by a man facing 91 felony counts in four trials. he can put a lot of them into this kind of position, to listen to him. it's unbelievable. i want to -- to jimmy carter. i want to offer condolences over the loss of dianne feinstein who passed away friday after more than 30 years representing california in the senate. governor gavin newsom has stated that he's going to naming someone certainly. as you, know he pledged to appoint a black woman. he made other statements it will be people -- you said you don't want to discuss this out of respect to the family. i'm going to respect that, the statements about the. i want to bring it up. so viewers would not feel i was ducking the issue. my position is what it is, we will find out in a respectful time with the congresswoman wants to say about that. >> let me just mention a couple of things about senator feinstein. >> these have not been brought forth about senator feinstein. in offering my condolences and grieving like the rest of our state and country is with the loss of this trail blazer. a couple of things and stories that i want to relate to. we were on the senate floor. senator padilla spoke eloquently about the fact that he had been a staff person a silent immigrant working -- also senator feinstein had a person in her office who was specifically dedicated to the african american community. from day, one she really understood what the diversity meant in terms of her overall agenda. percy was at every single event representing diane feinstein. representing the senator on all the issues we cared about in the black community. early on, she killed about racial equity and diversity and inclusion. secondly, i voted against the authorization to use military force. it was a hard vote. i was the only one who voted against it. senator -- >> the only one in congress, about a. >> house and the senate. senator feinstein, even though she disagreed with me, she knew i loved orchids. i have this painting, she was an artist, she painted this beautiful painting of an orchid. she signed it and she put 2001, the date. she gave that to me. and kindness and love. she wanted to lift me up. you know reverend al, that was a difficult time. the side of her gentleness and kindness gets lost because she was such a great leader. such as the assault weapon ban. leaving on all the issues in my district. helping us bring fellow resources to my district and to california. those stories need to be told, i know her relationship with the black community and how percy was so close to her and how he really represented her and took our issues back to her so she could champing them innocent. i'm a witness, head of the app national network, we have chapters in sacramento and l.a.. percy i would see almost every time i came to los angeles. i know you are correct there. before we go. i want to ask what you make of republican attacks to your come congressman jamal bowman the capitol police investigating white -- woman said it was unintentional. speaker mccarthy compared it to the acts of january 6th. e acts other members of the party are calling for his expulsion. is this an overreaction, perhaps even a distraction being pushed by republicans? i know jamal well. i doubt if he would intentionally do things. investigations -- even that, even if they find something to compare to january six, congressman? >> it doesn't make any sense speaker mccarthy, you never know where he's coming from on anything. i believe congressman bowman. i know him well. you don't do this intentionally. he apologized, let's move. on the trying to find anything they can to distract from their efforts to destroy our democracy and to make sure that budgets are cut and people are relying on them for childcare and health care and for housing. they are distracting and trying to distract from the real work that we are trying to do as democrats. taking away the attention on what they're doing to destroy our democracy. forget what speaker mccarthy says. i know we're going to have to circle around it. i intend to do that it's a bunch of noise, they're showing how petty they are. >> thank you congresswoman i really for being with us tonight. from the house to the senate, joining me now, democratic senator jeff berkeley who sits on the appropriations and budget committee. thank you for joining me today. >> great to be with you. >> thank you again. let's start with the spending bill. you and your colleagues work to keep the government running for another 45 days. what's going on right in terms of getting started on a longer term plan? >> there are 12 spending bills. they've all come out of the appropriations committee with bipartisan supporting, some of the most difficult bills like the interior bill which i chaired. we came out unanimous. we have a real foundation. now we have to move all 12 of those to the senate floor. we'll probably do it in a series of what we refer to as -- 3 to 4 time. the challenges make it easy to really slow things down. we don't have time to slow down. in the next four weeks, we need to get all 12 of the bills passed. >> it seems speaker mccarthy will face a challenge to his leadership this week for members of his caucus, from where you sit in the senate. are you concerned that the turmoil against republicans will affect your ability to get things done for the american people? >> here's the fascinating thing. we have a model of bipartisan work in the senate. we kept say the only way we're going to save the government is to have bipartisan work in the house. mcconnell, not mcconnell, the house speaker, was being led around by the crazies on the far-right. the mega stream us. they worked to throw me out of office if he didn't do anything they wanted. we were talking to where you have three months ago that hey signed up for, kevin mccarthy signed up for the president. and then they said, well, they wanted a percent cuts. they want to 30% cuts. crazy stuff. also lots of poison pills. he finally had to cut the cord and say i'm going my own way. i'm pushing forward the bipartisan bill that mimics what the senate has done with some significant differences on ukraine and pumped up some of the disasters. it was the senate bill. the result at the last second. here's the thing, what happens next week's iq jeffries going to make phone call automobile in order to provide democratic votes for someone who will lead the house on a bipartisan fashion. will it be kevin mccarthy? are we going to see a repeat of the extremist that we've seen today it? >> this spending bill did not include aid to ukraine. president biden addressed that today. take a listen. >> the speaker and the overwhelming majority of the congress have steadfastly supported ukraine to defend itself against the aggression and brutality of the russian attack on women and children. in addition to the military in ukraine. there is no ukraine funding disagreement. i fully expect the speaker to keep the commitment secured and support needed to help ukraine as they defend themselves against aggression brutality. >> are you confident, senator, that a stand-alone bill will pass on ukraine? >> i think that speaker mccarthy is in a tough situation right now. he's got chaos in his own caucus. he has people with knives out after him. they've been that way for sometime. at the same time, he has not done anything to really help democrats. trying to maintain his speakership. he broke his promise to the president on the debt ceiling, he has called for and has sanctioned impeachment hearings that have no basis whatsoever. i think that the democrats, this is likely a pretty easy vote for most democrats. i think that some in the democratic caucus will likely look at only this last vote and think that he did the right thing. he stood up to that maga caucus, the freedom caucus. at the end of the day, i tend to agree with speaker pelosi. this is not somebody that has really exercised leadership. it seems to be simply making promises to get to a certain point, and then realizing that those promises cannot be kept. i think that we are going to be seeing some interesting moves in the house of representatives over the next three weeks. >> olivia, many vulnerable republicans and moderate districts wanted no part of a shutdown. now they are facing the possibility of another protracted leadership battle. the republican majority is slim to begin with, are the gop hard-liners in the house putting it at risk? >> they absolutely are. every day that they behave in this way, and that the circus goes on, and the maga world within the gop is another day that the gop's brand is hard. it's another day that the party gets derailed and its progress. we are going backwards here, and i think that they are completely disruptive. i think that moderate republicans out there who are concerned about keeping their seats have a right to be concerned. we are in a situation here where we came very close to many americans lives impacted. people forget, some of these people saying yes, we'll stick it to the federal government. it's about the repercussions of, how about the restaurants that will be impacted? the service industry. multiple layers here across the country that get impacted when the government shuts down like this. here we are again, we are going in circles. now there is going to be this spectacle of a fight with matt gaetz, who personally i think does not deserve to be in congress given his unethical behavior, and the investigations he is under. i think that matt gaetz should actually be stripped from his committee assignments and be put in a box, be taught a lesson. i think other maga republicans should be taught that lesson as well. kevin mccarthy needs to be stronger and standing up to this wing of the party. >> olivia, let me stick with you a minute. tonight, former president donald trump is expected to be in new york city ahead of the civil fraud case by new york attorney general letitia james. that goes on trial tomorrow. the a.g. will be in the courtroom as, well setting up a potential face-off between her and trump, according to a person familiar with the a.g.'s plans. the judge in this case sits in his ruling on tuesday, trump and his company are liable for fraud by misstating the true values of multiple real estate properties. trump and his children are on the list of potential witnesses during the trial. with less than four months until the iowa caucus, trump still dominates the republican presidential field despite his legal woes. is there still a chance in your judgment for another candidate to surge in the polls, or does trump have this race all wrapped up? >> as much as i would like that to be the case, i would prefer that another candidate surface, and that we move past the trump moment of the party. i do not see that happening anytime soon. i don't see a path for it. he is the stronghold in the republican party right now. i fully expect him to be the nominee. he is finally somewhat been held accountable in the rule of law. i hope that he will be held accountable until the end. he has been defrauding americans for years now. he continues to defraud them. he will probably, i fully expect that he will show up at that court hearing because he will fund-raise off of it. once again, defrauding people, lying to americans and raising money off of this. unfortunately, i just don't think that the republican party is going to be able to move past him anytime soon. >> doug, as an attorney, your thoughts on this first trump trials starting tomorrow? >> reverend, i think this guy has been cast. i think this judge is already making -- such that we are going to see some very serious repercussions. i think that is the best word. legal repercussions for trump and his real estate empire, his whole business holdings. think about this, think about the fact that you have got a judge that is likely to rule a final ruling for damages in a fall trial, saying he misrepresented so many things in his business dealings. all of his properties. that is the basis of all of his money. it's the basis of his so-called empire. if that gets called into question, it is going to have serious repercussions for him financially, as well as all of his holdings. i think that we are going to see a lot happening. i like to say one thing as well, going back to olivia's point about the shutdown. all of this is connected, nothing happens in a vacuum in washington, d.c.. the trump trial, the finding of fraud by the court, the absolute fiasco of an impeachment hearing that the republicans had in congress the other day. all of these things are connected to the fact that kevin mccarthy had to cave in. he had to go back to actually governing and doing something for the country, rather than -- because the party was really going to continue to suffer if you held out for these maga extremists. >> let me stay with you a minute. let's turn to another very important issue. the supreme court. it opens a new session tomorrow. the last session ended in june with monumental decisions ending affirmative action and college admissions. that has set off a series of lawsuits targeting diversity programs. you spoke last night on this program on them being sued right now for alleged violation of the civil rights act forgiving funding for black women to have businesses and grow those businesses. of course, the year before the court overturned roe v. wade. what can we expect next from this conservative dominated court, doug? >> reverend, it is really a crapshoot at this point. while you saw a lot of those decisions, you also saw the court uphold the voting rights act in the alabama case. you saw a pullback to say that some of these conservative groups, advocacy groups trying to make all of these changes legally. they might have gone a little bit too far. i'm hoping that we are going to be seeing that with regard to all of these lawsuits that are following the affirmative action. the supreme court, you've got a couple of folks in particular. i think justice roberts, justice kavanaugh, they are the type of justices that might say, look, we will only go so far. you're not going to be able to take every ruling and run rampant with it to completely alter american jurisprudence, american society. it remains to be seen. i think any legal commentator will tell you that they would expect a more conservative ruling. i think that that will happen, but at the same time, some of these things we might be surprised that they might be pulling back just a little bit and tilting a little bit back towards the center. at least we can all hope that way, reverent. >> all right, doug jones and olivia troye, thank you both for being with us tonight. after the break, preaches returning to professors behind the podium as they fight to preserve americans black history. black history. >> welcome back to politicsnation. well governor ron desantis has escalated his war on black history in florida public schools, african american parents in the sunshine state have found themselves grappling with how to give their children a full accounting of the black experience. since now they cannot expected in the classroom, or in libraries that have banned books on the subject, but a coalition of the states black churches is pushing back against the restrictions of the desantis administration with what they say is black history, history filtered through the lens of truth. joining us now, at the reverend rhonda towns, executive director of faith in florida. i want to start by saying that as a child of the civil rights movement, i am old enough to remember the freedom schools. i was just a kid before i joined in new york, operation bread basket. i would read about the freedom schools which originated during the movement to ensure that black children in the jim crow south would receive an education that affirmed them and black people. it's why i'm troubled the today in florida, black parents, community groups, and of course churches, are having to create modern-day freedom schools to fill the void created by states restrictions on how black history is taught. how is your group fit in florida leading this push to fully teach black history in florida, even if it is outside of the classroom? >> yes, thank you reverend sharpton. what we are doing is organizing black churches across the state to commit and take a pledge that we will teach black history to our children. young people overall, because the watered down version that has been taught is not real, it's not authentic. we are taking the responsibility upon ourselves to make sure that black history will be taught in its full truth. the black church has always played an active role in teaching our children. we are just going to continue that and make sure that it's still done in a way that our children can receive the best through our churches. >> you are galvanized by florida's decision earlier this year to ban an advanced placement african american history course from the states high schools. that decision of course, following the states so called stop woke act of 2022. restricting how race is taught in the states public schools. i know that many -- coming down there with our b homes, bishop rudy mckee. that has been at the center of a lawsuit the restricts academic freedom, violating the first and 14th amendment. florida is just one of several states that have introduced or passed laws restricting how the divisive topics like race are taught in public schools. i bring it up because i understand that your group fif, faith in florida. has been contacted in other states that are not part of the black church community, on guidance for how to circumvent these restrictions. what are you hearing from them when they reach out? >> we're hearing several things. number, one we have white churches in the state of florida that have agreed to teach black history. they might not be able to teach it in a way that the black church can, but they can teach it in a way of accountability. they've joined as well, over 20 other states throughout our country that have also agreed, they are keeping their eyes on florida, watching what is being done. preferably, it will not hit their state, but nevertheless they know the importance of it. other states have joined florida in committing to teaching black history. and it's realness. >> this past -- florida unveiled new educational standards governing among other things how the history of american shadow slavery would be taught. perhaps the mos controversial item in those replies standards where the suggestion that some slaves benefited personally from the experience, because they learned useful skills. last week, south carolina republican senator tim scott, the only black candidate seeking a gop presidential nomination said this. listen. >> there is not a redeeming quality in slavery. america suffered because of slavery. we have overcome that. we are the greatest nation on earth because we faced our demons in the mirror, and we made a decision. black families survived slavery. we survived texas and literacy tests. we survived discrimination woven into the laws of our country. what was hard to survive was johnson's great society. >> i will remind you that florida governor desantis also was speaking and seeking the nomination, seeking that night. he was just two podiums away. your thoughts on senator scott's comments? overcoming social programs, we have not overcome -- comparing that to slavery and jim crow. >> yes, senator scott needs a course himself on black history. i'm not sure what lens he is looking out of. first of all, we have never benefited from it, but also they have modernized slavery through our criminal justice system, through public education systems, housing, and so many other issues that have impacted black people. we've not arrived, we have done better, but we have not arrived -- we have not yet -- we still face some racism. >> let me ask you this, i'm out of time but i want you to give me an idea. give our viewers around the country and idea of what you are teaching in the churches as you are starting to operate. who is doing the teaching now?
