they really love to one bank winner. hence, no one on that stage. a very good day to all of you from msnbc world headquarters in new york. welcome to alex witt reports. we're going to begin with the breaking. news new reaction straight from the white house. just moments ago, president biden speaking out on the last-minute deal, and the late night boats yesterday that averted a government shutdown. >> truth is, we shouldn't be here in the first, case we should've gone here in the first case, it's time to end governing by crisis saying keep your word when you're given it in congress. >> also today escalating turmoil in the republican -- to remove speaker mccarthy after the messy gop congress stared right into a government shutdown, only to be pulled back by democrats in the final hours. >> let me tell you, why? why the brings micha, why the theater. wide to the last minute, i'll tell you, if i'm sick of it, i can only tell you what the american people are feeling. >> well mccarthy scene here after his meeting with democrat leader is facing growing fallback within the d o g. they are arguing over plans to oust him. >> overnight i learned that kevin mccarthy has made a secret deal with republicans on ukraine. >> i intend to file a motion to vacate speaker mccarthy. i think we need to rip off the band-aid. i think we need to move on with new leadership that can be trustworthy. >> what i just heard is a diatribe of delusional thing cain. by putting this motion to vacate on the floor, you know what he's going to do? he's going to delay the ability to complete that work over the next 45 days. they are the reason that we had to work together yesterday with house democrats to pass a cr. that is not the fault of kevin mccarthy, that's the faulted matt gaetz. >> meanwhile, no hint of a lifeline for democrats like a closet show cortez who is celebrating a clean cr. >> i do not intend on running for republican speaker of the house but i believe that it's up to the republican congress to determine their own leadership, deal with their own problems. it's not up to democrats to say the republicans. >> we have a number of reporters in place covering the reaction to everything happening in washington this weekend. we'll begin with monica alba at the white house with new reaction from the presidents. monika, we just heard from them. he had quite a few things to say. who does he think is to blame for the government nearly shut it down last night? >> alex, this is a message that had been clear in the days leading up to this. the fact that a government shutdown was averted, of, course is been at the white house and by the president. he was quick to say that we didn't need to get to this point in the first place. he echoes something he said on friday in an interview, which is that he really feels that speaker mccarthy made a, quote, terrible bargain and trying to bend to the will of some of these hard-line conservatives who were demanding things that would've really resulted in potential major cuts to some important domestic priorities for this white house and administration. they really, when asked whether he could trust speaker mccarthy as a new deal has to potentially be worked on and discussed here, he said, look, we made the steel back in may, and i expected him to honor it. to hold up his end of the bargain. overall, there is a collective exhale here that millions are going to be feeling the impact of a government shutdown. there is definitely a sense of concern about how these next few weeks make a. here's a bit more on what the president had to say. >> i'm sick and tired of the brics man ship. so where the american people. as you point out to me a lot of, been doing this along time. i've never quite seen republican congress, or any congress, act like this. this spring, maga republicans brought us to the brink, threatening to default on americans debt for the first time in over 200 years. and it was going to cause a gigantic world crisis. we reached an agreement. we shook hands, said here's the deal. now this fall, the maga extremists, once again, have brought us to the brink. this time, to a government shutdown. i'm going back on the deal they made months ago, not keeping their word. enough is enough, is enough. >> a major sticking point is going to be this question of funding for ukraine as it continues in the nearly 20th month of this war after the russian invasion. this is the thing the president says that is essential, and i am told by u.s. officials that there isn't enough money right now to cover battlefield needs and ukraine with u.s. support for a little bit longer. that they will need a funding bill very soon on this to continue the support that they have been giving them over the course of these critical months. that is expected to be a major area of discussion here. the president says he has the speakers word, that he would bring something separate to the -- he knows that both parties have supported us, there is growing opposition to this. particularly among some of these conservatives that have been the thorn in the side of speaker mccarthy. that's a major area to watch here. as these 45 days will likely go quickly, as you know, well alex. >> you just put a spotlight on one of the next big fights. funding ukraine. thank you for that. monica from the white house. let's go to julie tsirkin on capitol hill. julie, you are the first to know that a government shutdown is averted, giving you a long day at work yesterday, give us the fallout after the chaos that you helped to display on your show yesterday. >> from one crisis to another for speaker mccarthy, that's because this morning, we already heard from congressman, matt gaetz. you heard monica talk about authority mccarthy side. there is no bigger thorn than gates right now. he is already vowing to bring the motion to vacate, essentially, any one member can trigger a vote to oust mccarthy from his job. that is what gaetz has promised to do. i want you to take a listen to a little bit more of what gaetz had to say today. what mccarthy replied to him, where they will talk about it on the other side. >> i do intend to file a motion to vacate against speaker mccarthy this week. i think we need to rip off the band-aid. i think we need to move on with new leadership that can be trustworthy. the only way kevin mccarthy as speaker of the house at the end of this coming week as if democrats bail him out. they probably will. >> i'll survive. this is personal. he wanted to push his -- even threatening his own district with all the military people there who would not be paid. only because he wants to take this motion. soviet, bring it on, let's get over it. let's start governing. >> the big question here, is what with democrats do? gaetz needs about five republicans to join him in order to successfully as to mccarthy. i spoke to two republican moderates who work across the aisle often. they don't believe that that would happen, but they warned that gaetz could keep trying to do this again and again. then what with the next 45 days look like? what with the next year look like? until the election. this is not going to bode well for republicans, and they're spending four time continuously trying to prevent the speaker from being ousted by a member of their party who is trying to do it. you heard monica lay out all the work they have to do in the next 45 days. they have to work on their appropriations bills, the house, the senate. they have to find a way to fund ukraine. they have to secure the border according to conservatives who really want that to happen. potentially, those two things can be tied. if gaetz is trying to undermine mccarthy in the process of all of us, that will distract a lot of republicans and democrats, quite frankly, from doing the work of the american people. >> i think you can expect to matt gaetz to be pulling some punches. you heard him talking that it took 15 tries to get kevin mccarthy elected. he said something like, i'll go for 15 times. standby for that, my friend. thank you. joining me now, congressman ro, democrat from california. welcome to you. let's begin with congresswoman alexandria ocasio-cortez's post. here's what she wrote. here's what went down. we just won a clean 45-day gov extension, strip gop, is and cuts to social security edmund and cuts. we staved off last minutes anti-immigrant -- high jinx. people will get paychecks and marjorie taylor greene threw attention on the way out. when one. do you agree with that in his entirety? >> i do i'm proud of leader jeffries and our entire caucus. we basically got all of the funding that the democrats wanted. we averted cuts to school funding,, cuts to food stamps, cuts to medicare, or medicaid, d avoided the draconian provisions that they wanted for folks coming for seeking asylum. we have kept the government open, i credit our leadership and caucus for remaining unified in disciplined. >> does the stopgap bill not include any aid to ukraine, because republicans have been suggesting that any future aid be tied to border security provisions. that was also left out of the resolution. considering the houses so far apart on solutions to the border problem, do you worry about ukraine funding that risk? >> i am somewhat concerned, and i was disappointed it wasn't included. the reason, as we had a lot of votes on ukraine funding for the appropriations process. you have about 300 to 320 members, including lee, who are voting for that funding. you know that the senate wants that. so if you are going to have a minority in that house, thwarting the will of the majority, and then what i said to folks, is look, we can disagree, but if you -- you're basically giving putin license to invade kyiv, how is that a solution? you want to push for diplomacy, you want to push to get a cease-fire, fine. there's no way you can yank that beforehand. i do believe we're going to get, there and it's unfortunate that they've thrown politics into foreign policy. >> let me ask you about something. this is discussed in the show yesterday calling from california, representative sarah jacobs, who says that the senate cr, when they were talking about funding for ukraine, right, that which a lot of republicans are now opposed to due to the cost, they said that that was in the cer, and it was actually just to fund, we've plunging the supplies, were there to be an attack on the u.s. homeland. it wasn't money that was going to ukraine, it was money that was just keeping our borders and everything within safe. is that true? if so, one of the republicans not leading with that? >> well i believe that the senate here, there were many iterations. why do you think that they initially had more funding for ukraine as the administration had requested. i know senator mcconnell is for it, as is the majority of the senate. what we've seen is increasing opposition amongst republicans in the house, and amongst republicans in the senate. it's still a minority of their caucus. i was a 40%, but what this suggests is that we're going to have to really be strong and our efficacy, this is an america's national interest. you can have putin go to kyiv, not expect to pay cuts for america. it would allow china to march into taiwan as a president. it would just undermine the rules based order that keeps america safe. democrats need to make that case to the american public. >> so, kevin mccarthy, they pulled this off yesterday with a lot of support from democrats. was that ever in question? given the options. >> well i do appreciate that the speaker finally stood up to a far-right wing group. that was really going to hurt the american people. i mean, can you imagine? members of congress were going to get paid, our troops weren't. our federal employees weren't. that you would've had park shut down, you would've had air traffic controllers not be paid. it was outrageous. so we did finally do. that he basically gave democrats all that we wanted. i cried at leader jeffries and our leadership team. it was unclear whether he was going to play games with cpr. he didn't, thanks to our leadership. this was a win for the american people. the democrats can't rest on our laurels. we need to continue to work constructively to help the american people. >> you heard the president say how difficult it is that this keeps happening. the way everything happens, it's accomplished. you go running to the brink. it's frustrating, it's unnecessary. it doesn't make the united states of america look ahead. it does a lot of risk as well to our standing economically. so here's the question. we have 45 days for the stop gap measure. is it just setting us up for repeat chaos ahead of november 17? what needs to happen between then and now? >> well the president is absolutely right. the deep, ideological conflicts, they don't take this to the brink where you're threatening shutdown or default. i do think that something important happened here. for the first-time, big pass something that was bipartisan. he got democratic votes. that gives me hope that we are going to be able to be more constructive, because he's not going to all the time be held hostage by very few. i also think that this was the first moment of leadership for our new team. our hakeem jeffries, and they came off with flying colors. they are as good as any previous generation of leaders. i'm really proud of them in our caucus. >> republican congressman matt gaetz said that this morning he plans to launch the process out speaker mccarthy from his leadership post, take a listen to what he said. >> actually think democrats are gonna bail out kevin mccarthy. at this time next, week if kevin mccarthy is still speaker at the house, it will be just because the democrats bailed him out, and he can be their speaker, not mine. >> would you consider voting to save mccarthy? if i came to that? what were the circumstances. >> we're going to follow our leader, hakeem jeffries. we're going to figure things out, and what to do. there are a lot of options. there could be some members who want to table the motion, you don't have to vote for kevin mccarthy to make sure that the house continues to function. what i do believe will happen is hakeem jeffries will help come up with the strategy that puts the american people first, and the democrats will be unified, as we normally have been, as we were the last two years under speaker pelosi, where we pass the inflation reduction act, the biggest climate legislation and the biggest infrastructure bill in 20 years. we have the manufacturing, that is how you govern. one of the reasons, as just by all of the taconic disarray, we were unified, we continue to be unified. >> you know about the investigation underway after new york democrat is caught pulling the fire alarm ahead of the house vote yesterday, so he issued an apology saying that he is embarrassed, i activated the fire alarm. i mistakenly thought it would open the door. i regret, doesn't sincerely apologize for any cousn at cost. is it plausible. and what do you say to republicans who just jumped on the saying that he should face an ethics investigation for creating a delay in voting and be expelled. >> we need some humanity around here. we don't need to make everything a personal attack. i try to refrain from personal attacks against republican colleagues. i am here to do things, to help the american people. he has explained himself, he's apologized, and i think that it's time to move on to things that are affecting the lives of the american public. >> let me ask you this, california governor gavin newsom is rushing to make a decision on diane feinstein seat. the congressional black caucus is that with a new letter urging him -- who i know you also support. newsom says he doesn't want to tip the scales for the upcoming election by choosing someone that's actually running for that seat in 2024. it is a heated race. why do you think that's barbarity as the best choice now? >> first of all, i agree with the congressional black caucus. the governor made a pledge. he said he was going to appoint an african american woman. he should've put restrictions on that pledge. he shouldn't say i'm only going to an appointed african american woman if they don't run for the election. and they have six years. the pledge wasn't just going to appoint someone for nine months. it was i was going to point someone had the seat. he didn't put any restrictions when he appointed alex medina. he ran in 2022. barbara lee has been earning the seat, going to cross the, state building support. is a consistent, progressive voice. my only request is that the governor honor his pledge and appointed african american woman who is going to run for the seat of. it's not barboli, have somebody else who is actually going to run for the seat that can hold it for six years. that is really what the congressional black caucus, and many of my colleagues, want to see happen. >> okay, my fellow californian. good to see you. thank you so much. >> thank you. >> why donald trump is heading to court tomorrow in a case that might feel more important in other cases. we're back in 60 seconds. >> i'm thinking that this latest case has really gotten me pretty nervous and saved. i've got to say i feel bad for any staffer who is around that man right now. man right now. get worhow common is it? what are you hearing about whether or not he, or any of stand.will actually take the >> yeah, alex, that is sti a very important question here. we have not had that guidance he yet on whether or not they are actually going to appear and testify about these allegations. they have these business assets for years, now some of the other people on the witness list who are perhaps just as -- as donald trump's children are. he's the former chief financial officer of the trump organization, they've already pleaded guilty last year to a 15-year tax fraud scheme. he testified against the company, and was sentenced to five months in jail. so i think someone else potentially, you can expect him to testify against trump once again. this includes michael cohen, the former per lawyer who we have heard a lot from over the course of the past few years. so it's also serve time due to actions in part connected to donald trump. there are 28 other people that the attorney generals office intends to call. we previously reported. again, we are very curious about whether they will actually be able to appear, and testify against their father. >> yeah, listen, michael cohen's testimony on capitol hill several years ago was the catalyst for laetitia change opening up this case. lisa, do you expect trump to testify? what with that look like. can -- you think he's going to do it? >> i do. the reason i think he will do it is because it's not entirely within his choice. you know, jacqui was just speaking about the attorney general's witness list, trump and his adult children, or rather, both of his sons appear on both witness lewis, and he appears on the attorney generals witness list. to that point, to the extent that the attorney general calls trump, or either of his adult sons as witnesses, it will not be within his choice. whether they take the witness stand. they have already reported litigation. trump and his children will then help difficult shaw's to face, which is whether to invoke the fifth amendment didn't dissipation of for the criminal liability. we understand that the manhattan d.a.'s office, for example, has been sniffing around charges of potential insurance fraud for many, many months. i don't expect that they'll take the fifth, however, because all of them were to post in the run up to this case, and then in after the case commenced, they were deposed again. instead of taking the, that they gave testimony. former president trump's, case highly damaging testimony that was cited by the attorney general, in accordance with the summary judgment, which he won last, week in part because some of the things that trump used to explain, these ridiculous over/under valuations of his assets, they could not be sustained. in fact, his own testimony was, perhaps, you know, the straw that broke the camel's back for the judge and granting that motion. >> do we expect him to deliver that same kind of testimony. he is the case of meandering, deflecting, not directly answering someone. what with that look like in court if that is how he did deliver his testimony. would it be just back and forth? >> that's a risk for the attorney general. for those reasons exactly, alex. he is such an unpredictable witness. however, to the extent that he -- from his previous testimony, certainly, that's ample grounds for a hostile cross-examination. more importantly, to the extent that he starts meandering, and, rambling the attorney general can always move to strike certain answers as nonresponsive, as argumentative, and asked the judge to get them out of the trial record because they are not directly responsible to the questions being asked with him on the witness stand. >> that is no interest. ajax mid team, prosecutors in the d.c. election fraud case, they are painted tension right now to trump's trip. last monday, to a south carolina gun store. take a listen. >> we've got plenty of pictures. i like that one. >> so, in an updated request for a gag order on trump, doj says that he either purchased a gun in violation of the law and his conditions of release, or, or seeks to benefit from his supporters mistaken relief that he did just that. jacqui, the trump camp eventually said, he didn't buy a gun. do we know whether or not he actually made a purchase? >> alex, that is a very good question that we don't quite know. as you've said, the trump spokesperson later clarified that their statements, that they had not actually deeply place there. jack smith's team, prosecutors, they were involved in this gag order. that the defense either purchased the gun against, or in violation of the conditions of his release, or, said that he seeks to benefit from his supporters mistaken belief that he did so. a separate federal crime. also in violation of the defendants conditions of release. this is also another strike against trump when it comes to these scab orders that jack smith is seeking. purchasing this gone on top of public threats, going for the execution of martinelli along with threats against judge danya -- and mike pence. these are all, you know, they are a crystal clear examples of the gop, you know, presumptive nominee feeling, or continuing to feel like he is above the law when it comes to these cases that he is now fighting against, and trying to really seek to sway opinion and the court of public opinion. >> so, lisa jackie is just fired and lay this out for us. does this mean that trump could get into further legal jeopardy just by the interactions he had in that gun store. even if he didn't buy a gun? >> i think that it's definitely a further thumb on the scale for the special counsel's team and seeking to narrow what trump can say, and what his lawyers can say. before this trial. on the other hands, assuming that he did not actually purchase the gun, there would not be violations of his conditions of relief. as jacqui refer, to in his conditions of release, that is, when he was first indicted in order to not be and jail pending trial. one of the conditions was that he commit no further stay local or federal crimes. it to purchase a gun while under felony indictment, that is an indictment that if you were convicted will put you in jail for more than one year, that in and of itself is a federal crime. i tend to think that the truth is somewhere in between. the place where trump was when he tried to purchase this gun, palm meadows state armory, it's not a federal firearms license dealer. that means you have to find a license dealer to act as an intermediary. my guess is that trump did intend to purchase the gun, and then learned that when he tried to find a license dealer, he would have to complete a background check, and make representations he cannot make. >> that is just extraordinary. well, ladies, buckle up. tomorrow there's going to be a lot to watch. thank you so much for your time. well you thought saturday was a must for kevin mccarthy. wait until monday. what lies ahead for him, that's coming up. first, some happy news to share today. former president jimmy carter is celebrating his 99th birthday seven months after entering hospice care. jimmy carter and his wife, rosalynn, they made a public appearance and his hometown last, week and they're expected to celebrate privately today as warm wishes are sent their way from near and far. >> happy birthday, pal. i've known a lot of presidents, as you have, but i admire you because you have such incredible integrity, character, and determination. you're one of the smartest say upper dead, i looked for your endorsement. i knew he were. you have been changed a bet. he never stopped. i consider it a great honor to know you, and to have worked with you. and i just hope that i can be just one half of the president you are. love you. happy birthday, pal. , pal. when her windshield cracked. is there any sense of relief? >> well,, alex a lot of the people that we've talked to here on the national law this morning, whether it's tourist or locals, they haven't been following the shut down all that closely. they would've been surprised if the national mall, which is quite bustling today, would've looked a lot quieter for the rest of the week. we spoke with folks about how they felt this crisis was avoided with a shutdown, who should take credit, who's to blame if the government shutdown later on. it seems that across the board they blame everybody. they credit everybody for scrambling at the last minute to get a deal. i spoke with a tourist who came in from london who would've been surprised about being able to catch the national park scene, and hopes to visit. here's some of the sentiment that he and other tourists out here today have said about this averted shut down. >> it does seem to me to be quite a dangerous way to run a country. yeah, having the risk of things shutting down just seems like a lot of people's lives and livelihoods impacted. >> if you can't work together on keeping our financial state in order, you have to assume the blame. there's no one person, and no one party that -- they're both citing the right, bills that both passing the bills. they both have to take the blame. >> now, it doesn't really matter to those folks who take a victory lap for keeping the government open because they just don't want their lives disrupted. people just really want to see the shutdowns, which have become quite exhausted, him to prepare for, and worry about, to be avoided. they want to long term solution, and not just keep kicking the can down the road. alex? >> that would be nice. okay, julie, thank you, appreciate that. what a messy night. i'm not talking about last night. new today, the future of kevin mccarthy's speakership is in peril after he teamed up with democrats to avert a government shutdown. just hours before last night's deadline, mccarthy managed to secure 35 votes to secure federal funding for the next 45 days. a move that has infuriated some members of the right. this morning, congressman matt gaetz says that he is moving forward with a motion to vacate, to try to have speaker mccarthy as speaker. >> if this time next week, kevin mccarthy is still speaker of the house, it will be because the democrats bailed him out, and he can be their speaker, not mine. >> you don't have the votes to remove him. >> by the way, i don't know until we have the. i would not have them the first-time, but i might have them before the 15th. i am relentless. i will continue to pursue the subjective. >> joining me now is nbc senior political reporter, and seized in del percio, republican strategist and nbc political analyst. welcome to you both. susie what would be the fallout of republican members of the house turner mccarthy. but it lead to democrats taking thousand 2024? >> i don't see republicans making that with hakeem jeffries as the majority leader. i would love to think that people cared about their responsibilities in washington, and they came up with some kind of power sharing agreement similar to what the senate had, after the 2020 election, it probably will never happen but, it's going to be interesting. what particularly fascinates me is what hakeem jeffries is going to do as far as maybe letting some of his members who are also we, always talk about the republicans who are in vulnerable seats, there are democrats who are in vulnerable seats. maybe it's okay that they keep mccarthy again more than butina, that allows them to stay. >> that's interesting. today, matt gaetz and alexandria ocasio-cortez made different decisions about what would happen if kevin mccarthy's speakership comes down to a house vote. take a listen to these. >> i actually think that democrats are going to bail out kevin mccarthy. >> i certainly don't think that we would expect to see that unless there is a real conversation between the republican and democratic congresses, and republican democratic leadership about what that would mean. i don't think we give up votes for free. >> so what are the chances that democrats saved mccarthy? would he be better than any potential alternatives? do you think they're going to let republicans just figure it out amongst themselves? >> probably the latter, alex. it's far from clear that democrats will step in and bailout speaker kevin mccarthy the situation like this. it would be an extremely unusual move from members of the minority party to do anything but vote for speaker of their own party, which for democrats, is hakeem jeffries. jeffries was asked about this yesterday after that bill went to the past with democratic votes to keep the government open. he said, simply, that he would, the democrats have not had a discussion about any hypothetical motion to vacate, and they would cross that bridge when they get to it. behind the scenes, i spoke to a number of democratic sources in the house about, this and the first thing, they recognize that they do come up for a motion to vacate. then it looks like the partnering with matt gaetz publicly, they're just gonna strengthens kevin mccarthy's hands. they think their best move is to keep their powder dry at this time. there are others who say that they would insist on serious concessions in order to even entertain this notion. things like mccarthy dropping the impeachment inquiry to president biden, which they say is based on no evidence whatsoever. they want to seat at the table when it comes to governing. insisting that cover nerve mccarthy speaks to the -- and and the word of one democratic, cage they want mccarthy to stop letting the crazies govern the house. these are all consensus and that democrats would, wanted if they vote to save mccarthy, whatever procedural machinations they use, they'd be receiving a challenge back at home. even a competitive district, that's a serious start to a democrat when you're asking for democrats to, you know, keep you renominated if they want to save a republican speaker at this time. what republican allies mccarthy are hoping that democrats do is vote present to lower the threshold, to make it easier for republicans to keep mccarthy there. there is no alternative at this time. so democrats, as of right now, it's in their interest to keep their powder dry and see if they be getting anything for it. >> i'm curious, suzanne, before we wrap this conversation, about want to get your take on the second republican debates. and your, pinion who are the winners, who are the losers? >> no, winners and everyone who had to watch it was a loser. it was so bad to watch. what it does tell me is that these candidates who we saw onstage are not to ready for primetime, nor do they really want the job. some have been in line for number two. it doesn't make sense. you want to be president? go up to the lead candidate. they're afraid to go after donald trump. otherwise, they're just spinning their wheels. i will make an exception for chris christie. chris christie has always been willing to take on the former president. >> i'm glad werner, our director, is pointing out this poll. i want to reference it again. it's the new morning consult poll. after the debate, look at, that donald trump, not even there. he saw his numbers go up. every other candidate's numbers went down, with the exception of chris christie. he did go up by 1%. here's the question. is there any point in having another debate that donald trump will attend, susan? >> alex, this is a message that had been clear in the days leading up to this. the fact that a government shutdown was averted, of, course is been at the white house and by the president. he was quick to say that we didn't need to get to this point in the first place. he echoes something he said on friday in an interview, which is that he really feels that speaker mccarthy made a, quote, terrible bargain and trying to bend to the will of some of these hard-line conservatives who were demanding things that would've really resulted in potential major cuts to some important domestic priorities for this white house and administration. they really, when asked whether he could trust speaker mccarthy as a new deal has to potentially be worked on and discussed here, he said, look, we made the steel back in may, and i expected him to honor it. to hold up his end of the bargain. overall, there is a collective exhale here that millions are going to be feeling the impact of a government shutdown. there is definitely a sense of concern about how these next few weeks make a. here's a bit more on what the president had to say. >> i'm sick and tired of the brics man ship. so where the american people. as you point out to me a lot of, been doing this along time. i've never quite seen republican congress, or any congress, act like this. this spring, maga republicans brought us to the brink, threatening to default on americans debt for the first time in over 200 years. and it was going to cause a gigantic world crisis. we reached an agreement. we shook hands, said here's the deal. now this fall, the maga extremists, once again, have brought us to the brink. this time, to a government shutdown. i'm going back on the deal they made months ago, not keeping their word. enough is enough, is enough. >> a major sticking point is going to be this question of funding for ukraine as it continues in the nearly 20th month of this war after the russian invasion. this is the thing the president says that is essential, and i am told by u.s. officials that there isn't enough money right now to cover battlefield needs and ukraine with u.s. support for a little bit longer. that they will need a funding bill very soon on this to continue the support that they have been giving them over the course of these critical months. that is expected to be a major area of discussion here. the president says he has the speakers word, that he would bring something separate to the -- he knows that both parties have supported us, there is growing opposition to this. particularly among some of these conservatives that have been the thorn in the side of speaker mccarthy. that's a major area to watch here. as these 45 days will likely go quickly, as you know, well alex. >> you just put a spotlight on one of the next big fights. funding ukraine. thank you for that. monica from the white house. let's go to julie tsirkin on capitol hill. julie, you are the first to know that a government shutdown is averted, giving you a long day at work yesterday, give us the fallout after the chaos that you helped to display on your show yesterday. >> from one crisis to another for speaker mccarthy, that's because this morning, we already heard from congressman, matt gaetz. you heard monica talk about authority mccarthy side. there is no bigger thorn than gates right now. he is already vowing to bring the motion to vacate, essentially, any one member can trigger a vote to oust mccarthy from his job. that is what gaetz has promised to do. i want you to take a listen to a little bit more of what gaetz had to say today. what mccarthy replied to him, where they will talk about it on the other side. >> i do intend to file a motion to vacate against speaker mccarthy this week. i think we need to rip off the band-aid. i think we need to move on with new leadership that can be trustworthy. the only way kevin mccarthy as speaker of the house at the end of this coming week as if democrats bail him out. they probably will. >> i'll survive. this is personal. he wanted to push his -- even threatening his own district with all the military people there who would not be paid. only because he wants to take this motion. soviet, bring it on, let's get over it. let's start governing. >> the big question here, is what with democrats do? gaetz needs about five republicans to join him in order to successfully as to mccarthy. i spoke to two republican moderates who work across the aisle often. they don't believe that that would happen, but they warned that gaetz could keep trying to do this again and again. then what with the next 45 days look like? what with the next year look like? until the election. this is not going to bode well for republicans, and they're spending four time continuously trying to prevent the speaker from being ousted by a member of their party who is trying to do it. you heard monica lay out all the work they have to do in the next 45 days. they have to work on their appropriations bills, the house, the senate. they have to find a way to fund ukraine. they have to secure the border according to conservatives who really want that to happen. potentially, those two things can be tied. if gaetz is trying to undermine mccarthy in the process of all of us, that will distract a lot of republicans and democrats, quite frankly, from doing the work of the american people. >> i think you can expect to matt gaetz to be pulling some punches. you heard him talking that it took 15 tries to get kevin mccarthy elected. he said something like, i'll go for 15 times. standby for that, my friend. thank you. joining me now, congressman ro, democrat from california. welcome to you. let's begin with congresswoman alexandria ocasio-cortez's post. here's what she wrote. here's what went down. we just won a clean 45-day gov extension, strip gop, is and cuts to social security edmund and cuts. we staved off last minutes anti-immigrant -- high jinx. people will get paychecks and marjorie taylor greene threw attention on the way out. when one. do you agree with that in his entirety? >> i do i'm proud of leader jeffries and our entire caucus. we basically got all of the funding that the democrats wanted. we averted cuts to school funding,, cuts to food stamps, cuts to medicare, or medicaid, d avoided the draconian provisions that they wanted for folks coming for seeking asylum. we have kept the government open, i credit our leadership and caucus for remaining unified in disciplined. >> does the stopgap bill not include any aid to ukraine, because republicans have been suggesting that any future aid be tied to border security provisions. that was also left out of the resolution. considering the houses so far apart on solutions to the border problem, do you worry about ukraine funding that risk? >> i am somewhat concerned, and i was disappointed it wasn't included. the reason, as we had a lot of votes on ukraine funding for the appropriations process. you have about 300 to 320 members, including lee, who are voting for that funding. you know that the senate wants that. so if you are going to have a minority in that house, thwarting the will of the majority, and then what i said to folks, is look, we can disagree, but if you -- you're basically giving putin license to invade kyiv, how is that a solution? you want to push for diplomacy, you want to push to get a cease-fire, fine. there's no way you can yank that beforehand. i do believe we're going to get, there and it's unfortunate that they've thrown politics into foreign policy. >> let me ask you about something. this is discussed in the show yesterday calling from california, representative sarah jacobs, who says that the senate cr, when they were talking about funding for ukraine, right, that which a lot of republicans are now opposed to due to the cost, they said that that was in the cer, and it was actually just to fund, we've plunging the supplies, were there to be an attack on the u.s. homeland. it wasn't money that was going to ukraine, it was money that was just keeping our borders and everything within safe. is that true? if so, one of the republicans not leading with that? >> well i believe that the senate here, there were many iterations. why do you think that they initially had more funding for ukraine as the administration had requested. i know senator mcconnell is for it, as is the majority of the senate. what we've seen is increasing opposition amongst republicans in the house, and amongst republicans in the senate. it's still a minority of their caucus. i was a 40%, but what this suggests is that we're going to have to really be strong and our efficacy, this is an america's national interest. you can have putin go to kyiv, not expect to pay cuts for america. it would allow china to march into taiwan as a president. it would just undermine the rules based order that keeps america safe. democrats need to make that case to the american public. >> so, kevin mccarthy, they pulled this off yesterday with a lot of support from democrats. was that ever in question? given the options. >> well i do appreciate that the speaker finally stood up to a far-right wing group. that was really going to hurt the american people. i mean, can you imagine? members of congress were going to get paid, our troops weren't. our federal employees weren't. that you would've had park shut down, you would've had air traffic controllers not be paid. it was outrageous. so we did finally do. that he basically gave democrats all that we wanted. i cried at leader jeffries and our leadership team. it was unclear whether he was going to play games with cpr. he didn't, thanks to our leadership. this was a win for the american people. the democrats can't rest on our laurels. we need to continue to work constructively to help the american people. >> you heard the president say how difficult it is that this keeps happening. the way everything happens, it's accomplished. you go running to the brink. it's frustrating, it's unnecessary. it doesn't make the united states of america look ahead. it does a lot of risk as well to our standing economically. so here's the question. we have 45 days for the stop gap measure. is it just setting us up for repeat chaos ahead of november 17? what needs to happen between then and now? >> well the president is absolutely right. the deep, ideological conflicts, they don't take this to the brink where you're threatening shutdown or default. i do think that something important happened here. for the first-time, big pass something that was bipartisan. he got democratic votes. that gives me hope that we are going to be able to be more constructive, because he's not going to all the time be held hostage by very few. i also think that this was the first moment of leadership for our new team. our hakeem jeffries, and they came off with flying colors. they are as good as any previous generation of leaders. i'm really proud of them in our caucus. >> republican congressman matt gaetz said that this morning he plans to launch the process out speaker mccarthy from his leadership post, take a listen to what he said. >> actually think democrats are gonna bail out kevin mccarthy. at this time next, week if kevin mccarthy is still speaker at the house, it will be just because the democrats bailed him out, and he can be their speaker, not mine. >> would you consider voting to save mccarthy? if i came to that? what were the circumstances. >> we're going to follow our leader, hakeem jeffries. we're going to figure things out, and what to do. there are a lot of options. there could be some members who want to table the motion, you don't have to vote for kevin mccarthy to make sure that the house continues to function. what i do believe will happen is hakeem jeffries will help come up with the strategy that puts the american people first, and the democrats will be unified, as we normally have been, as we were the last two years under speaker pelosi, where we pass the inflation reduction act, the biggest climate legislation and the biggest infrastructure bill in 20 years. we have the manufacturing, that is how you govern. one of the reasons, as just by all of the taconic disarray, we were unified, we continue to be unified. >> you know about the investigation underway after new york democrat is caught pulling the fire alarm ahead of the house vote yesterday, so he issued an apology saying that he is embarrassed, i activated the fire alarm. i mistakenly thought it would open the door. i regret, doesn't sincerely apologize for any cousn at cost. is it plausible. and what do you say to republicans who just jumped on the saying that he should face an ethics investigation for creating a delay in voting and be expelled. >> we need some humanity around here. we don't need to make everything a personal attack. i try to refrain from personal attacks against republican colleagues. i am here to do things, to help the american people. he has explained himself, he's apologized, and i think that it's time to move on to things that are affecting the lives of the american public. >> let me ask you this, california governor gavin newsom is rushing to make a decision on diane feinstein seat. the congressional black caucus is that with a new letter urging him -- who i know you also support. newsom says he doesn't want to tip the scales for the upcoming election by choosing someone that's actually running for that seat in 2024. it is a heated race. why do you think that's barbarity as the best choice now? what are you hearing about whether or not he, or any of stand.will actually take the >> yeah, alex, that is sti a very important question here. we have not had that guidance he yet on whether or not they are actually going to appear and testify about these allegations. they have these business assets for years, now some of the other people on the witness list who are perhaps just as -- as donald trump's children are. he's the former chief financial officer of the trump organization, they've already pleaded guilty last year to a 15-year tax fraud scheme. he testified against the company, and was sentenced to five months in jail. so i think someone else potentially, you can expect him to testify against trump once again. this includes michael cohen, the former per lawyer who we have heard a lot from over the course of the past few years. so it's also serve time due to actions in part connected to donald trump. there are 28 other people that the attorney generals office intends to call. we previously reported. again, we are very curious about whether they will actually be able to appear, and testify against their father. >> yeah, listen, michael cohen's testimony on capitol hill several years ago was the catalyst for laetitia change opening up this case. lisa, do you expect trump to testify? what with that look like. can -- you think he's going to do it? >> i do. the reason i think he will do it is because it's not entirely within his choice. you know, jacqui was just speaking about the attorney general's witness list, trump and his adult children, or rather, both of his sons appear on both witness lewis, and he appears on the attorney generals witness list. to that point, to the extent that the attorney general calls trump, or either of his adult sons as witnesses, it will not be within his choice. whether they take the witness stand. they have already reported litigation. trump and his children will then help difficult shaw's to face, which is whether to invoke the fifth amendment didn't dissipation of for the criminal liability. we understand that the manhattan d.a.'s office, for example, has been sniffing around charges of potential insurance fraud for many, many months. i don't expect that they'll take the fifth, however, because all of them were to post in the run up to this case, and then in after the case commenced, they were deposed again. instead of taking the, that they gave testimony. former president trump's, case highly damaging testimony that was cited by the attorney general, in accordance with the summary judgment, which he won last, week in part because some of the things that trump used to explain, these ridiculous over/under valuations of his assets, they could not be sustained. in fact, his own testimony was, perhaps, you know, the straw that broke the camel's back for the judge and granting that motion. >> do we expect him to deliver that same kind of testimony. he is the case of meandering, deflecting, not directly answering someone. what with that look like in court if that is how he did deliver his testimony. would it be just back and forth? >> that's a risk for the attorney general. for those reasons exactly, alex. he is such an unpredictable witness. however, to the extent that he -- from his previous testimony, certainly, that's ample grounds for a hostile cross-examination. more importantly, to the extent that he starts meandering, and, rambling the attorney general can always move to strike certain answers as nonresponsive, as argumentative, and asked the judge to get them out of the trial record because they are not directly responsible to the questions being asked with him on the witness stand. >> that is no interest. ajax mid team, prosecutors in the d.c. election fraud case, they are painted tension right now to trump's trip. last monday, to a south carolina gun store. take a listen. >> we've got plenty of pictures. i like that one. >> so, in an updated request for a gag order on trump, doj says that he either purchased a gun in violation of the law and his conditions of release, or, or seeks to benefit from his supporters mistaken relief that he did just that. jacqui, the trump camp eventually said, he didn't buy a gun. do we know whether or not he actually made a purchase? >> alex, that is a very good question that we don't quite know. as you've said, the trump spokesperson later clarified that their statements, that they had not actually deeply place there. jack smith's team, prosecutors, they were involved in this gag order. that the defense either purchased the gun against, or in violation of the conditions of his release, or, said that he seeks to benefit from his supporters mistaken belief that he did so. a separate federal crime. also in violation of the defendants conditions of release. this is also another strike against trump when it comes to these scab orders that jack smith is seeking. purchasing this gone on top of public threats, going for the execution of martinelli along with threats against judge danya -- and mike pence. these are all, you know, they are a crystal clear examples of the gop, you know, presumptive nominee feeling, or continuing to feel like he is above the law when it comes to these cases that he is now fighting against, and trying to really seek to sway opinion and the court of public opinion. >> so, lisa jackie is just fired and lay this out for us. does this mean that trump could get into further legal jeopardy just by the interactions he had in that gun store. even if he didn't buy a gun? >> i think that it's definitely a further thumb on the scale for the special counsel's team and seeking to narrow what trump can say, and what his lawyers can say. before this trial. on the other hands, assuming that he did not actually purchase the gun, there would not be violations of his conditions of relief. as jacqui refer, to in his conditions of release, that is, when he was first indicted in order to not be and jail pending trial. one of the conditions was that he commit no further stay local or federal crimes. it to purchase a gun while under felony indictment, that is an indictment that if you were convicted will put you in jail for more than one year, that in and of itself is a federal crime. i tend to think that the truth is somewhere in between. the place where trump was when he tried to purchase this gun, palm meadows state armory, it's not a federal firearms license dealer. that means you have to find a license dealer to act as an intermediary. my guess is that trump did intend to purchase the gun, and then learned that when he tried to find a license dealer, he would have to complete a background check, and make representations he cannot make. >> that is just extraordinary. well, ladies, buckle up. tomorrow there's going to be a lot to watch. thank you so much for your time. well you thought saturday was a must for kevin mccarthy. wait until monday. what lies ahead for him, that's coming up. first, some happy news to share today. former president jimmy carter is celebrating his 99th birthday seven months after entering hospice care. jimmy carter and his wife, rosalynn, they made a public appearance and his hometown last, week and they're expected to celebrate privately today as warm wishes are sent their way from near and far. >> happy birthday, pal. i've known a lot of presidents, as you have, but i admire you because you have such incredible integrity, character, and determination. you're one of the smartest say upper dead, i looked for your endorsement. i knew he were. you have been changed a bet. he never stopped. i consider it a great honor to know you, and to have worked with you. and i just hope that i can be just one half of the president you are. love you. happy birthday, pal. , pal. when her windshield cracked. is there any sense of relief? >> well,, alex a lot of the people that we've talked to here on the national law this morning, whether it's tourist or locals, they haven't been following the shut down all that closely. they would've been surprised if the national mall, which is quite bustling today, would've looked a lot quieter for the rest of the week. we spoke with folks about how they felt this crisis was avoided with a shutdown, who should take credit, who's to blame if the government shutdown later on. it seems that across the board they blame everybody. they credit everybody for scrambling at the last minute to get a deal. i spoke with a tourist who came in from london who would've been surprised about being able to catch the national park scene, and hopes to visit. here's some of the sentiment that he and other tourists out here today have said about this averted shut down. >> it does seem to me to be quite a dangerous way to run a country. yeah, having the risk of things shutting down just seems like a lot of people's lives and livelihoods impacted. >> if you can't work together on keeping our financial state in order, you have to assume the blame. there's no one person, and no one party that -- they're both citing the right, bills that both passing the bills. they both have to take the blame. >> now, it doesn't really matter to those folks who take a victory lap for keeping the government open because they just don't want their lives disrupted. people just really want to see the shutdowns, which have become quite exhausted, him to prepare for, and worry about, to be avoided. they want to long term solution, and not just keep kicking the can down the road. alex? >> that would be nice. okay, julie, thank you, appreciate that. what a messy night. i'm not talking about last night. new today, the future of kevin mccarthy's speakership is in peril after he teamed up with democrats to avert a government shutdown. just hours before last night's deadline, mccarthy managed to secure 35 votes to secure federal funding for the next 45 days. a move that has infuriated some members of the right. this morning, congressman matt gaetz says that he is moving forward with a motion to vacate, to try to have speaker mccarthy as speaker. >> if this time next week, kevin mccarthy is still speaker of the house, it will be because the democrats bailed him out, and he can be their speaker, not mine. >> you don't have the votes to remove him. >> by the way, i don't know until we have the. i would not have them the first-time, but i might have them before the 15th. i am relentless. i will continue to pursue the subjective. >> joining me now is nbc senior political reporter, and seized in del percio, republican strategist and nbc political analyst. welcome to you both. susie what would be the fallout of republican members of the house turner mccarthy. but it lead to democrats taking thousand 2024? >> i don't see republicans making that with hakeem jeffries as the majority leader. i would love to think that people cared about their responsibilities in washington, and they came up with some kind of power sharing agreement similar to what the senate had, after the 2020 election, it probably will never happen but, it's going to be interesting. what particularly fascinates me is what hakeem jeffries is going to do as far as maybe letting some of his members who are also we, always talk about the republicans who are in vulnerable seats, there are democrats who are in vulnerable seats. maybe it's okay that they keep mccarthy again more than butina, that allows them to stay. >> that's interesting. today, matt gaetz and alexandria ocasio-cortez made different decisions about what would happen if kevin mccarthy's speakership comes down to a house vote. take a listen to these. >> i actually think that democrats are going to bail out kevin mccarthy. >> i certainly don't think that we would expect to see that unless there is a real conversation between the republican and democratic congresses, and republican democratic leadership about what that would mean. i don't think we give up votes for free. >> so what are the chances that democrats saved mccarthy? would he be better than any potential alternatives? do you think they're going to let republicans just figure it out amongst themselves? >> probably the latter, alex. it's far from clear that democrats will step in and bailout speaker kevin mccarthy the situation like this. it would be an extremely unusual move from members of the minority party to do anything but vote for speaker of their own party, which for democrats, is hakeem jeffries. jeffries was asked about this yesterday after that bill went to the past with democratic votes to keep the government open. he said, simply, that he would, the democrats have not had a discussion about any hypothetical motion to vacate, and they would cross that bridge when they get to it. behind the scenes, i spoke to a number of democratic sources in the house about, this and the first thing, they recognize that they do come up for a motion to vacate. then it looks like the partnering with matt gaetz publicly, they're just gonna strengthens kevin mccarthy's hands. they think their best move is to keep their powder dry at this time. there are others who say that they would insist on serious concessions in order to even entertain this notion. things like mccarthy dropping the impeachment inquiry to president biden, which they say is based on no evidence whatsoever. they want to seat at the table when it comes to governing. insisting that cover nerve mccarthy speaks to the -- and and the word of one democratic, cage they want mccarthy to stop letting the crazies govern the house. these are all consensus and that democrats would, wanted if they vote to save mccarthy, whatever procedural machinations they use, they'd be receiving a challenge back at home. even a competitive district, that's a serious start to a democrat when you're asking for democrats to, you know, keep you renominated if they want to save a republican speaker at this time. what republican allies mccarthy are hoping that democrats do is vote present to lower the threshold, to make it easier for republicans to keep mccarthy there. there is no alternative at this time. so democrats, as of right now, it's in their interest to keep their powder dry and see if they be getting anything for it. >> i'm curious, suzanne, before we wrap this conversation, about want to get your take on the second republican debates. and your, pinion who are the winners, who are the losers? >> no, winners and everyone who had to watch it was a loser. it was so bad to watch. what it does tell me is that these candidates who we saw onstage are not to ready for primetime, nor do they really want the job. some have been in line for number two. it doesn't make sense. you want to be president? go up to the lead candidate. they're afraid to go after donald trump. otherwise, they're just spinning their wheels. i will make an exception for chris christie. chris christie has always been willing to take on the former president. >> i'm glad werner, our director, is pointing out this poll. i want to reference it again. it's the new morning consult poll. after the debate, look at, that donald trump, not even there. he saw his numbers go up. every other candidate's numbers went down, with the exception of chris christie. he did go up by 1%. here's the question. is there any point in having another debate that donald trump will attend, susan?
