two pm eastern, symone starts right now. greetings, everyone. you're watching symone. we are monitoring breaking news at this hour. it's been a busy day on capitol hill. with a clock ticking and a government shutdown deadline just hours away. house lawmakers just approved, they just voted, y'all, just approved, 45-day stopgap bill. that would keep the government open, democrats coming to the rescue. congresswoman jasmine crockett is here. she's gonna discuss today's 11th hour scramble to avoid the shutdown. and speaker mccarthy surprise move, something he said he would not do. it's not over though, because keeping the government open is now in the hands of the united states senate. they've got eight hours. we are monitoring these developments. we will bring them to you as they are happening. i'm symone sanders-townsend, i have something to say. a lot, actually. ♪ ♪ ♪ crisis averted. we will see. it's been a whirlwind day on capitol hill. because just hours to spare before a devastating government shutdown, the house overwhelmingly passed a short term funding resolution to keep the government afloat. >> without objection, the re-motion to reconsider is laid on the table. >> the vote was rendered 35 to 91. now, it is up to the senate to pass the house bill before it can go to president biden to sign. this resolution will keep the government funded, at current levels for the next 45, days. it will reauthorize the federal aviation authority. aka the faa. and funding for disaster preparedness. this resolution will not include additional funding for ukraine. this is what we call a clean see our, folks. this comes after house republicans spent weeks wasting time, shackling governments stability to their culture wars. and facing multiple, and failing, frankly, multiple times, to pass their own funding resolutions. they had to face the music today. and today, and on told number of federal workers are still anxiously waiting to see if they will be forced to work without pay. all because speaker mccarthy played games and kowtowed to the far-right of his caucus. until this bill is signed by president biden, those folks, they're not out of the woods. it didn't have to be this way. millions of americans are in this position, again, because speaker kevin mccarthy thought it was wiser to kowtow to the extremists in his caucus than to reach across the aisle and keep the government afloat. make no mistake, any progress on this funding today will not be because of speaker kevin mccarthy. it will be in spite of him. here's what house minority leader hakeem jeffries had to say this afternoon. about the path that republicans chose. >> house republicans decided to go it alone. fight a civil war. stand on an island on your own. we want the american people to know, we are gonna do everything possible to stop extreme maga republicans from shutting down the government. [applause] we are fighting on their behalf. to put people over politics. >> the sad part is, speaker mccarthy still might lose his job at the hands of the same far-right members that he spent weeks trying to appease. far-right members like congressman matt gaetz could invoke a motion to vacate, that could end mccarthy's run and speaker. but it wasn't until the brink of shutdown that the speaker attempted to show some leadership to the critics within his caucus. >> if somebody wants to remove, because i want to be the adult in a room, go ahead and try. but i think this country is too important. if i have to risk my job for standing up for the american public, i will do that. >> when it took a historic 15 votes to confirm mccarthy as speaker earlier this year, i ask you, for what shell up profit a man if he shall gain the whole world and lose his own soul? i cannot speak to mccarthy saw, but he has lost his credibility. and soon, he could potentially lose his gavel. all because he chose to hold millions of americans paychecks hostage. before he would finally work with democrats in congress. nbc news capitol hill correspondent, julie tsirkin, as been on the hill. and the center of the action all day. julie, can you explain how this bill came together? we just heard from speaker mccarthy a few minutes ago. what is he saying? >> look, speaker mccarthy held multiple conference meetings with members last night. this morning, i mean, even in the process of the meeting members, did know which way is gonna turnout. you had members of the so-called 21 hard-line conservatives, who wanted to cut spending, wanted to make these radical changes. who were unpleased that mccarthy came into that meeting and one of them to consider his 45-day clean c r. that bill was not filed this morning. it was filed last night, before midnight. because mccarthy seemed to have known that he would come to this position, where he needed to reach across the aisle to get democrats on a bill. to get them to support anything that could pass ahead of this government shutdown deadline. i just talk to speaker mccarthy as other wills of the reporters, a couple of moments ago. here's what he had to say, he's not really concerned, at least at this moment. that a motion to vacate him will go forward. watch. >> would i have wanted the bill we put on the floor yesterday, that would secure our border, cut wasteful spending, yes i do. but i had some members in our office that wouldn't vote for that. so, if you have members in your conference that won't let you vote for appropriation bills, doesn't one omnibus, and won't vote for a stopgap measure, so the only answer is the shut down and up they'd or troops? i don't want to be a part of that team. >> look, mccarthy said he's been having regular conversations with members of senate republicans as well. when it came down to the wire, he saw that he couldn't not get anything done with just republican votes alone. i should note, the vote total on the floor overwhelmingly bipartisan. but more democrats did end up supporting it than republicans. did that's gonna prove to be a problem for mccarthy. >> well, julie, can i just note, it's my understanding that congressman gaetz attempted to, before the house adjourned today, attempted to put a motion to vacate on the floor. but allies of speaker mccarthy jumped in motion to end the session. >> exactly. they motion to adjourn until monday. it was like a queasy moment watching it happen in realtime with gates trying to get up and make that motion. and then mccarthy's allies quickly adjourning the floor until monday to prevent him from doing just that. look, i talked to gaetz this morning, when it came out of the conference meeting. he's resigned to the idea that this clean ciara was gonna move forward. it's gonna be put on the floor. he told me though, he's gonna huddle with members of those conservative hard-liners, who don't want anything mccarthy's fingerprints touch, essentially, , to move on the floor. and figure out what's to come, but mccarthy, for his part, was asked about this. we pressed him on this. he said he put the american people in front of his job. he remains defiant. he hit back on gaetz for not voting for him for speaker. for dragging on those 15 rounds. and said, basically, he could take and when it comes. look, all in all, for the american people, this is good news. this is an outcome that we did not expect or predict, even when i started my day today. that the house would ultimately have passed this 45-day clean cr to avert a government shutdown. >> yeah, i was shocked, julie, or this is only half the battle, because all eyes are on the senate now, what are you hearing from senators? in the senate, this cr there is planning to pass and ukraine funding. now the house sent over a continuing resolution without ukraine funding, are they gonna pass this before the deadline? >> well, all signs point to yes. right now, summit done senate democrats are huddling behind closed doors, to try to figure out next steps. given that the house democrats moved in this overwhelming fashion to support this bill, all signs point to the fact that senate democrats are gonna do the same. not without some machinations in between. they're gonna have about two hours of debate potentially, before they even move to take up this bill. senators, i spoke to, we're optimistic. they could potentially get out of town today. and over that shutdown. but you, right ukraine funding is not in this bill. disaster relief, however, is. i'm told by one republican, for example, maybe mccarthy wanted to put disaster relief in there to try to get some of those hard-liners, like matt gaetz, of florida, to come over and support. disaster certainly reflected his state -- when it comes to ukraine, it points to all fact that democrats and republican have to work together of the next few weeks to move ukraine aid, maybe it attached to some kind of border security provisions. because it seems like that would be more palatable for house republicans to essentially accept their constituents back home, they want the border secured. you know as well as i.d., symone, congress has not been able to figure out a solution, a comprehensive solution, to addressing the border for decades. and without that, president biden is certainly hamstrung to do any meaningful border reform. we'll see if they can make that happen. so, far this clean ciara hurts a government shutdown, averts terrible consequences for millions of americans. and that is what democrats, of course, are touting, as they support this. >> nbc's julie tsirkin, if you have to get speaker mccarthy again in the hallway, you just let us know. and we will come back to you. joining me now, here on set, democratic congresswoman and house oversight committee member, jasmine crockett. welcome to you, congresswoman. just we have it on the record, we uniformity vote for this catering with aleutian. >> absolutely. >> you supported. what was the conversation with democrats first learned of this continuing resolution, clinging cer, if you will, from the house republicans. >> okay, your air quotes said it all. for, us we were like, we don't trust anything that kevin has to say. we don't know what his definition of clean is. so, we need to check this. so, you, know they were upset they didn't give us adequate time to review, unlike the republicans, we were just going to allow 71 pages to fall in our lap. and then take a vote and go back to our constituency. and say, we didn't realize. because we trusted what kevin mccarthy said. so, there were different maneuvers that were employed by our caucus to make sure that our team had some sort of time to review this. >> so, you all feel comfortable with what was in this continuing resolution? >> i think was the best illusion for the american people to make sure we could keep the government open. absolutely. >> there's been a lot of conversation, obviously, it goes to the senate. you just heard me ask, nbc's julie tsirkin, about this motion to vacate. i often hear my reporter friends, other folks, who are asking members of congress saying, well, are the democrats going to save kevin mccarthy? it's my understanding that democrats have been lock in step behind the minority leader jeffries. has there been any conversation amongst the caucus about a motion to vacate? >> there is no conversation among us. that's a republican problem. as far as i'm concerned, we are doing everything that we can to make kevin mccarthy look like he was somewhat competent. by making sure that when there is a bipartisan opportunity on the table, we absolutely do, that if it puts the american people first. his job is not my concern. here's the deal, kevin mccarthy literally needs to find a spine. he needs to tell them, if you go hot, go ahead and hop. file your motion. but instead, he allows matt gaetz to do, basically, treat him like he's a little puppet on a string. it's, like he's pulling the strings. if you're gonna do, it do it. the reality is, there is no one in that caucus that has the votes. so, if it's not kevin mccarthy, i know who has a lot of strong votes. standing behind him. so, it's kevin, it's akeem. my vote is for hakeem. so, we can do another 15 rounds, 16 rounds, whatever. ultimately, what we will see again, is that there is no one else that has the votes. >> all right, so, speaker emerita, speaker emerita pelosi noted that democrats should not bail out kevin mccarthy, and it sounds like democrats are locked in step behind. that speaker mccarthy, he just gave some comments. he had a lot of things to say about hunter biden, joe biden, as it related to impeachment. it seemed quite disjointed to me. you sit on the house oversight committee. you actually went viral this week, because, first of, all did you get brittani profit the? today haven't exhibits? any evidence? >> no evidence today. >> i want to play some comments from you from the impeachment hearing. quote for the, hearing earlier this week. >> i will tell you what the president has been guilty of. he is an fort lee been guilty of loving his child unconditionally. and that is the only evidence that they have brought forward. and honestly, i hope and pray that my parents love me half as much as he loves his child. until they find some evidence, we need to get back to the people's work. which means keeping this government open. so that people don't go hungry and the streets of the united states. >> i really feel like democrats on the house oversight committee, this go around, y'all really came to play. from you to maxwell frost, al sale city, what was the strategy here? >> the strategy was to show that they are inept. and that this was nothing but another distraction. that the republicans wanted to quit and find the american people. so, they thought that maybe if we make joe biden look like he's half as corrupt as trump, maybe the people won't care about the fact that the government shutdown. that's the bigger issue. unfortunately, again, for them, they were outgunned. we have a ton of talent, our bridge is deep on the democratic side. so, well i still haven't really figured out why my clip went viral, everyone brought it in that committee. and i just wish, if you got some extra time, people need to sit down and watch all of us. it was like a master class in what it should look like to serve in the house. if we are going to deal with impeachment, i need the republicans to understand, we are not gonna play with this. democrats, seemingly, or constantly, saying we will stand for what is right. we will stand against what is wrong. and it doesn't matter your party affiliation. well they're over here playing political games, and at the same time, as i say that there, we have people that are gonna go hungry in the streets. >> there's work to be done. >> there is work to be done. >> we will surprise that republican witnesses that were called for this impeachment inquiry hearing, basically said there is no there there for impeachment just? yet >> i wasn't surprised. we've been going through this, my very first hearing, was actually on hunter biden's laptop. that was our very first hearing. so, now -- >> interesting to the american people. >> correct. we've been going through hearings for months. they've come up with nothing. the fact, witnesses and not given the facts that they want, so, now they decide they want to bring in pundits who can opine on what is already been testified to by fact witnesses. you know, i don't know what they thought they were doing. we know what a fact witnesses when we see. when we know what evidence is when we see it. that's why i want to be clear about those boxes at mar-a-lago. that look like evidence to me. >> in the you know what, we will not see on this program. >> congresswoman jasmine crockett, thank you for coming. it want to bring in the evidence, or any props, back after the next hearing, you are welcome at the stable. anytime, my friend. >> thank you. >> good to see, we're gonna keep a very close eye on the hill, as we're going to see how this all plays out. the united states senate. our political panel joins me in just a moment. to game out what happens next. first, our bestie is here, you. all of a very busy day. richard lui with today's other top news stories. richard, what else is happening in america? >> simone, you said, it lot of news today. good afternoon, we'll start with new york city. it is drying off from one of its wettest days in decades. almost seven inches fell just friday, in parts of the city. it flooded subways, freeways, in basement apartments. the record setting rainfall led to a c line at the central park zoo, to briefly escape hurting closure as well. zoo personnel were able to rescue her. there is an arrest, three decades in the making. for the murder of legendary rapper, tupac shakur. officials arrest 60 rolled dwayne keith davidson. yesterday, in connection with a 1996 shooting. davis acknowledged being in the car that pulled up the 2 to 2 putt before he was shot. he never faced charges until now. the white house wished former president jimmy carter a happy 99th birthday, the big day is officially tomorrow. but because it coincided with the potential government shut down, as you get been talking about several events planned to mark the big day are being adjusted. some of the key places associate with carter's life and celebration are part of the national parks service, of which some closed down during shutdowns. the longest living president born in 1924, still spending his days with former first lady rosalynn. more simone after this break. e after this break >> the american people have won. extreme maga republicans have lost. it was a victory for the american people and a complete and total surrender by right wing extremists. >> that was minority leader hakeem jeffries speaking just a few minutes ago under extreme pressure today with a disastrous government shutdown just hours away. the house of representatives finally managed to pass a clean continuing resolution to fund the government for 45 days. they did so because democrats voted with republicans to bail them out. the senate is not expected to vote on the measure later today. i want to bring in my political panel now. few folks who know about congress. former democratic congresswoman stephanie murphy and former republican congressman charlie dent from pennsylvania. both have served during government shutdowns. my first question to both of you is do you miss the house yet? [laughter] >> stephanie, do you miss the house? >> i certainly don't miss that kind of chaos. i'm somebody who used to believe in legislating, and i think what we've seen over the last few weeks certainly isn't the best way to run a government. >> congressman dent, you've also served during a government shutdown. the symbol of pure chaos. why didn't speaker mccarthy just bring a clean continuing resolution to the floor sooner and avoid all this drama? he said he wouldn't do it, but ended up doing exactly what he said he wouldn't do. >> symone, i've been wasting my breath for weeks saying that i very simple way out of this. put up a clean continuing resolution on the floor of the house and it will pass with about 300 votes. that's exactly what they did today. and good for the speaker for doing. that but i knew he would do this. he'd be forced to do this, at some point, and i'm glad he did it before the deadline and out after. so good for him for doing it, good for hakeem jeffries for standing strong and doing the right thing. and now the senate has to make a choice. i always said, the house always complaints about being jammed by the senate. i've always said, the house can jam the senate, to. send it up with 300 votes, and if it wants to aid it, ate it. -- ukraine funding, over the next 45 days, i think i should fund ukraine. that said, they can at least avert a shut down and keep things moving. so i'm glad they did what they did today. they didn't need to go for a procedural votes, a rule vote today. they did this under what's called a suspension. it can go directly to the floor. all they need as a two thirds vote to pass, and they had that. that's what they had the outcome we did. >> good for the american people. stephanie? >> i was just going to point out, most of those votes came from democrats. it was democrats that came to the table, to the floor today, to keep the government funded. they did -- the democrats for the ones who did the responsible thing. and i think they fault themselves 45 days, but are going to be back in the same place if kevin mccarthy doesn't realize his only path forward is to move forward in a partisan way. >> say, that was the point i was gonna bring up on this. you know, 45 days from now, that puts us at what, a little, right before halloween? right after? my math is a little off. >> thanksgiving. >> thanksgiving, there we go. thanksgiving. first of all, we're gonna hold people hostage yet again, and dangle there livelihoods in front of them, right before thanksgiving. and secondly, what changes in the situation? because the far-right members of the house republican caucus are still going to be the far-right members of the house republican caucus. so charlie dent, make it make sense for me. >> as a former member of the appropriations committee, what they need to be doing right now is the house and senate appropriators sitting down and negotiating the final spending bills for the fiscal year. they need to do that. that has to happen. and they have to agree to the number. it's already set in law. and speaker mccarthy was put under pressure by the hard-liners, trying to force him to negotiate the appropriations bill at a lower number than what had agreed to end. law there is another fight coming. but the good news is, i think the country it is passed this appropriations bills, so they're just that with the senate and pass the spending bills at the numbers they agreed to in the law they supported back in may or june. with the debt ceiling. that's the way forward. now there's another cliff and another potential crisis before thanksgiving. >> you know, stephanie. i'm thinking right now about the democratic members of the house who sit and very competitive districts. what they democratic congressional campaign committee will call frontline members. how can they take what happened today, and the effects as democrats as you noted, who pulls, literally, will be the reason the government gets funded, because they voted with republicans to do their jobs. how can they capitalize on that for what are gonna be very contentious prices going into 2024? every member of the house of representatives is up this year and democrats in those seats, this is something that potentially could go well for them, could it not? >> i think they will be running on the effect they are the party of governance. there are the ones that have put military families, children, working families in america first. they were the responsible ones. the vote today was carried by democrats. it was not carried by republicans. and that is the real distinction they can run on and this upcoming election, that, you know, they aren't playing politics with people's lives. and that's a really big distinction between what people are seeing the republican party do. and you know, we were so used to the democrats in disarray hit lines. it's a little bit of a relief to see conservatives and chaos. >> i was waiting on what the alliteration would be. a conservatives in chaos. this question of ukraine funding. it was a major sticking point for republicans, frankly some republicans and some democrats in the united states senate. it has been a sticking point for a number of democrats in the house. what about ukraine funding? how does that we get worked out going forward? congressman murphy and then charlie please we. in >> ukraine funding needs to be a part of our appropriations process bill at the end of the day. it is overwhelmingly bipartisan supported. it is just a handful of people who are trying to stand in the way. and infect, the one dam who did not vote for this continuing resolution voted against it because it did not contain ukraine funding. so democrats are united behind the idea that we must defend ukraine. be sure it is able to keep democracy. and we have to be able to get that across the finish line. and again, it is up to kevin mccarthy, whether or not he's willing to take on his far-right and included in the appropriations bills that come to the floor here in the next month or two. >> i would simply, at symone, i believe ukraine should be funded. but speaker mccarthy should simply let the majority roll here. there is a strong majority in the house and the senate that pushes to fund the ukrainian war effort. so let's have a vote. let's have a vote. and it's terrible that the speaker should not allow this very small tale of this hard-line, why can a much larger talk of the house of representatives. the house of representatives wants to fund ukraine, on a bipartisan basis. there are some who don't. but flush with a small minority dictate policy? >> of course, let me extend my condolences to senator feinstein's family and staff and friends for fear and our country's loss. as has been said repeatedly, she's a trail blazer for women in politics and i think it's just so important to recognize her for not only being a woman and politics, but being an effective legislator. she moved us forward on so it might affect areas, whether it was gun violence or lgbtq rights, or even in our national security and law enforcement areas. she moved us forage in those places at pivotal movements in our country's history. and we all will miss her presence. >> congressman dent. when i was watching these proceedings on the senate floor, it was a nice moment of bipartisanship. democrats and republicans coming together to honor a colleague that many of them served with for every long time. there were lovely words from senator grassley of iowa. and then you hit former president trump. and i doubt what i expected to hear some kindness come out of his mouth. but he spoke at the california republican fall convention yesterday, and instead of honoring and, you know, senator dianne feinstein, he instead said this. and what i'm about to play is a reference to the attack on speaker mri to pelosi's husband, paul. >> will stand up to crazy nancy pelosi who roland san francisco. how is her husband to him, by the way, anybody know? introducing the new swiffer powermop. an all-in-one cleaning tool with a 360-degree swivel head that goes places a regular mop just can't. mop smarter with the new swiffer powermop. >> u.s. supreme court decisions and returned around the country could be a win for democracy in 2024 and beyond. this week the supreme court of thlatest attempt by alabama republicans to use a congressional map that only includes one majority black district. this is the second time in three months that the states republican-led legislature has proposed math and direct defiance of the supreme court decision. a map that would diminish the power of black voters in that state. right now, there are about 20 section two case is being litigated and the united states. we put it on the camera for q. in addition to these section two cases, though, there is a fight against gerrymandering happening at the state level as well. in july, a new york mid level appellate court sided with democrats and ordered the state to redraw its congressional district again. this would result in a new met been drawn just in time for the 2024 elections. these cases matter for the future of our democracy. and only could their outcome make-or-break opportunities for black voters, but these rulings will play a pivotal role in the battle for control of congress. the washington post reports most of these cases, if voting rights advocates are successful, could give democrats an opportunity to gain states in the house. these cases, which originated in places like florida, texas, georgia, louisiana, and alabama involve so-called opportunity districts. if democrats win those elections, those five seats will make a difference for 2024 and one could argue said our democracy. republicans know this all too well, which is why they're doing everything in their power to attempt to gerrymander their way into keeping hold of the house. it is what republicans and alabama or indirect defiance of the supreme court. it is on our courts and judges to follow the example of the case in alabama. they should strike down these gerrymandered maps, side with democracy, and just give the people what they want. free, fair elections. it's simple. representation. just over seven hours until the government shutdown, folks. the senate is under intense pressure to pass the house short term funding bill. we'll look at it across the finish line before midnight? i don't know. maybe it's just for rich people. talk to me about these licenses, paul. the business law syncing in new york, now donald trump, but about his said he has committed fraud. that is what the attorney general's alleging. is donald trump going to lose his new york business losses here? what else is at stake? >> he might lose them. the judge canceled the defendant's business difficult's. all of the defendants, trump, don jr., and eric. that means none of them have authority to make important decisions regarding these assets. so the judge will appoint a monitor, who will be in charge of the properties. this is really about protecting the taxpayers. they damages will be close to 200 and $50 million. so trump might have to sell a lot of his property to pay up. >> so, paul, donald trump was actually deposed in this case. and when he was deposed, he offered a series of non answers, including that he, quote, averted a nuclear holocaust while presidents. donald trump is on the witness list. are we going to see donald trump on the witness stand, do you think, in this case? >> almost certainly not. we know that every time donald trump opens his mouth, he tends to say something that's not true. if a lawyer would sponsor that, that would almost be malpractice. there are going to testify claims he's gonna tell the truth, the whole truth, and nothing but the truth. but latosha james doesn't need donald trump's testimony at trial. although she's got him cold in the deposition. >> this week the realm of developments when it came to the federal election interference case against donald trum judge tanya chutkan said she will not recuse herself, and she also scheduled a hearing to consider implementing a narrow protective order against the former presidts the special counsel's team felt a new brief, adding some recent social media posts to the request, that donald trump should be censored. i was struck they called him a criminal defendant like any other. in this filing. if a criminal defendant like any other or making public comments like donald trump is making, lawrence a gag order be warranted, paul, would there be all these hoops to jump through? >> it certainly would be warranted, and i think at the end of the day, judge chutkan will impose some-limited gag order. she's got to balance competing interests. yes, trump's first amendment rights and, yes, he is a leading candidate to be president. political speech has special protection. at the same time, jack smith says that trump's violent rhetoric is going to get people killed or seriously hurt. he says we already know that, because that's what happened with the insurrection on january 6th. >> jack smith, i think, would be correct on that. lastly, i want to switcho georgia. scott hall, one of the 19 codefendants in the georgia election indifference case. he took a plea deal. he's been linked to the breach of sensitive voter information in coffee county. now, paul, i remember when so many folks got until a vision, not you, but so many people talking about how fani willis was and of her skis, what was she told, 90 people was too much. and now we've got the first person that's flipped. so how could this plea impact sydney powell's trial, that begins and little temper, but also other defendants?
