Pushed to make his case federal . Then, thousands of escape burning man after being trapped by rain and mud and escapee shares his midnight hike and how he got out. As the 11th hour gets underway on this tuesday night. Good evening, once again, im stephanie ruhle, live from Msnbc Headquarters at 30 rock. Late today, a federal judge handed down the most severe punishment for any of the more than 1000 people charged in connection with the attack on the capital. 39 year old enrique tarrio, faith onetime leader of the farright group, the proud boys, was sentenced to a total of 22 years behind bars. Feds say he played a key role in orchestrating the insurrection, even though he wasnt even in d. C. On that day. But on the eve of january 6th, tarrio tory it was currently missing the founder of the oath keepers militia. He was found guilty of seditious conspiracy, and he was sentenced to 18 years in prison. The push online. Just make sure my guys are okay. Tomorrow. Ive got a lot of stuff to do tomorrow. Nbcs ken dilanian has more on tarrios sentencing. What are we here for . Stop the steal tonight, a central figure in the attack on the u. S. Capitol has been handed the stiffest person sentenced so far. Well not physically present during the january 6th riot, he directed others and support after, wouldnt saying in a text message, make no mistake we did this. Prosecutors had sought 33 years for tarrio, but judge Timothy Kelly it does love it that was too long. Kelly also sentenced for other purposes last week to lengthy prison terms. But far less than prosecutors had asked for. Some of them is seen here at the capitol. American citizens are storming the capital, taking it back right now. There is millions of people here. This is crazy. Tarrio and three other proud boys were convicted and may of seditious conspiracy. Prosecutors said their goal was to orchestrate violence to keep thenpresident trump in office. And the proud boys were behind every major breach of the capitol during the attack. Afterwards on cnn, tarrio ridiculed Members Of Congress who huddled and fear as rioters breached the building. Im not going to cry about a group of people who dont give a crap about their constituents. But a different tone in court today. To the judge, i am not a political zealot and saying to the men and women of Law Enforcement who entered the call today, im sorry. Were also following the latest in the Georgia Election interference case. All 19 defendants have now pleaded not guilty to racketeering charges, and have waved their right to appear at tomorrows arraignment in atlanta, georgia. Meanwhile, politico is reporting some of trumps Georgia Codefendants are signaling theyre likely going to blimp the former president , while claiming they acted at his discretion direction. Its no question that this was done for him, and at his behest. There would have been no reason to do it for him, without his being involved. Nobody wants to be at a trial with donald trump as a defendant. We are getting closer to people getting, ensuring their way toward that trajectory from a distance themselves from donald trump to actually be a cooperator for the government. With that, lets get smarter with the help of our panel tonight. My dear friend jeff bennett is here, coanchor of pbs news hour. And pbs is chief washington correspondent. And katie benner joins us. Pulitzer prizewinning reporter for the new york times. And former fbi special agents clint watts. Hes also a consultant at the fbis Counter Terrorism division. And an Msnbc National Security analyst. Katie, lets start with this major victory for the doj. 22 years for enrique tarrio. No relation to danny tarrio, from a host of dense fever. This is major. This is a big deal. The Justice Department asked for the country iris. And all these so the conspiracy cases, the judge decided the sentencing should be less than what the department as for. Hes done across the board. Even so, this is the longest sentencing with seen. It does two things. It sends every struck message that these crimes are taken seriously by the Justice Department. Three important, especially as we go into another election cycle. Whether it could be political unrest or protest. The other thing it does, it really shows the Justice Department is able to prove that somebody can responsible for a crime, can responsible for getting a crime even if the person is not solely at the scene of the crime or is currently involved in some of the activities that conspiracy entails. As we go into some of these other cases, particularly the january 6th case, donald trump is gonna be interested to see whether or not a jury can be convinced of something about. Again clint, what do you think about that very point . Tarrio wasnt it january 6th and is present this Measure Sentence for help inspire and organize it. What could that mean for donald trump . Many think he inspire it, directed it. Yes, stephanie. Its going to be a word conundrum. Because when all roads start leading back to one or two individuals, and the question weve always, whats the connection to the white house. So much the organized as part of this. As you move up the letter, especially in a rico or conspiracy type case, usually the punishment and suffering of all these things gets much more intense. I think thats what we are today. With tarrio. The other part, you know, with tarrio, yes. He wasnt there the day. But those Text Messages are just so incriminating. The ones who showed their yep. Terrorism, what is it . It is violence or the threat of violence in pursuit of political change. They filmed themselves committing a federal crime for everyone to see. So all of this evidence has been out there in the open. And i just wonder what other evidence is out there that could be in the open as well. Meaning that we have not seen a lot in terms of connections to the white house. It would seem that just looking at a lot of touches coming down towards the former president and staff, there is a lot of evidence starting to surface. I do think those grand jury are handing at those and documents, there must be something there that they would go that far in all of the charges. Yes, they did it and they recorder themselves because they believed if they got in trouble, donald trump would pardon them. Geoff, he didnt pardon them then. Because remember, after january 6th, he hit a couple of weeks, he could have but didnt. What makes any of these people think that if he is reelected hell pardon them now . It is a great question. And look, there are some 1100 people who have been brought to justice by the Justice Department in this case. Enrique tarrio with the longest sentence, some for the two years. And part of the reason is why, if you look at the georgia case, Donald Trumps 18 codefendants, many of them now looking to sit for their cases from his. Because they dont want their fates intertwined with his. Katie, 22 years as a long time. You said it a moment, ago the doj wanted 30 years. What has been the judges rationale for given lighter sentences, and why would tarrio get 22 years and Stewart Rhodes only 18 . Rhodes was there . Roach was there, but when you look at what happened with the prime, plus it was really clear they were in every once this again and again they were the tip of the spear. They actually broke the violence wide open. And they help to penetrate key parts of the capitol that day. You could argue they were the reason why so many people were able to breach the capitol in such violent fashion, clearly they were doing so with emission. Its one of the reasons why the proud boys in general, whether actions are consistent so grave, and why enrique tarrio, as the leader, his crimes were taken extremely seriously and he might get a lauren plans to hit roads. In terms of what is worth has done, one of the reasons hes fun to go for the full recommendation of hes talked about whether or not these people had intent to commit specific violent crimes, or whether they wanted to kill people. He didnt say that. So hes the hunted to bring some of these senses down. That, said more than a decade. More than two decades. These are very serious sentences. These are people who are middle aged. In their 40s. They are going to spin really the rest of their present of life in prison. So its true, these sentences are lower than what the Justice Department recommended, but there are still really serious. Again, i just said it to geoff. Many of them think donald trump will save. Tim clint, i want to share what one say to alex jones over the last few days. Watch this. I know hell pardon. The thing is, hopefully getting them, for him to be able to get into the position where he can at least be i think on the ballot to run, right, because you have one Runner Remaining but i do believe that Donald J Trump will pardon us, but he should. We didnt do anything. Same question i just asked geoff, clint . What they believe don trump will pardon them now. He didnt do that january 7th, eighth, ninth, tenth, 11th, or 12th just a few years ago. I dont know why theyre thinking that, or anyone might get a pardon down the road depending on the art come of three or four different Election Processes and the president showing pick up an office, having 1100 people to choose from. Im just not sure of the situation will unfold the way those gentlemen or thinking it will. But i think it speaks to how they just didnt understand the severity of what they were doing. And they still dont. Well some of the very much played for lighter sentences in the courtroom, when they leave, their tune changes. I think if we look at some of the charges, some of the actual sign of sentiments happen in recent days. It has been up to 22 years. Some of these individuals committed other crimes in places in the past. They have a record in many cases. Im sure influenced the touch as well, in terms of what was going on. And when you listen to all the public statements in the last two years, they can go to court today, ask for a lighter sentence. But looking at what theyre saying, they pulled out of the courtroom the next day, im sure it is not naive and what a work these individuals are justified in what theyre doing. And we always are going to be worried of Something Like this happening again. There is another soundbite we should never forget from pick in point of the. Donald trump on the debate stage, what he had to say about this a very organization. What this. Are you willing, tonight, to condemn White Supremacists and Militia Groups . Proud boys, stand back and stand by. But ill tell you what. Ill tell you. What somebodys gotta do something about antifa and the lift. Katie, we all knew where they were at the time. We knew there were a risk. We knew they were a threat. We knew what is. Did anyone seriously think the proud boys would take the kind of action, orchestrate the attack that they did . I think that so much of what we saw in terms of the Law Enforcement response before january 6th, to the threat of violence, was and pour a failure of imagination. With all of this in the practice competitions capital before january 6th and incite riots and violence, fighting with other Extremist Groups on the streets of d. C. So it is clear they were willing to engage in violence. I dont think anybody truly imagined there will be the kind of wholesale attack on the capitol we saw the day. Clint how might these sentences impact what jack smith is doing . In terms of the sentences, i think it was really start to speak how unified all the defendants are in a lot of these cases. I just dont know phil be able to keep this sort of coalition going. 19 defendants in georgia. Many other defendants in the other trials that are coming up. I just dont know how to keep that coalition going. When you are watching people who are still saying they were justifying direction, get to the two, 18 year sentences. I just would see. It especially amongst the individuals there. Many employers on all of the plow boys were interested in the legal risks of what they are doing on the day, january 6th. So when you watch how this investigation unfold and the trial coming up, how theyre going to go for the next year . Lets talk about how georgia is unfolding. Geoff, you mentioned a moment ago. Some of his codefendants, people in Donald Trumps inner inner circle. Now theres reporting there could be pointing the finger at him. What can you tell us . Is this how funny will this is going to build her case . Potentially. We could get some clarity tomorrow at one pm, eastern. When the judge hears that case, the Severance Motions from Sydney Powell and kenneth chesebro. Sydney powell is of course the attorney who is implicated in an effort to illegally accessed Voting Machines in a number of states. Kind of case broke had a role in setting up the fake a literal scheme. Both of them, through their attorneys, issued request first pinterest. But now they want to have those trials separate from one another and separate from the other codefendants. It will be interesting to see if they point the finger at don trump in trying to take themselves out of responsibility, as outlined in the indictments. That really was definition of what former white house mark meadows is making in his filing to the court. Hes basically saying his case should be moved from the state court to the Federal Court because he was at Donald Trumps behest, as Chief Of Staff. And everything he was doing, he was doing in the lot of work. Brad raffensperger, the Top RepublicanElections Officials in georgia has pushed back on that, saying, there is nothing about that coat suggesting it was in line with his duties as Chief Of Staff. It was a political cult and it was inappropriate. But so far you already have Donald TrumpsChief Of StaffPointy Thinker at him. So it will be interesting to see, well get some clarity, potentially as early as tomorrow about how many other codefendants might do the same. Well Donald Trumps former trade advisor, peter navarro, is out there saying he cant handle his Mountain Legal bills and hoping, just hope, and somebody covers them. I think hes talking to don trump. Im pretty sure mr. Trump doesnt want to answer. Geoff bennett, katie benner, clint watts, think you for starting us off. When we come back, well go deeper in georgia and fulton can specifically. What to expect as funny willis moves her case for, and litter escape from burning man. Rain and mud left thousands stranded over the weekend.
