about the new sighting. we begin with a look at what could be an important day in the georgia interference case against former president donald trump and his 18 codefendants, and all 19 people charged with conspiring to overturn the results of the presidential election there are scheduled to be arraigned tomorrow, but only two of them, former white house chief of staff, mark meadows, and former coffee county director, have entered a plea. the proceedings in fulton county superior court will be conducted now on camera. garrett haake has been covering the trump investigations, and milea whily, president of the leadership conference on civil and human rights. garrett, most of the defendants won't be there so what can we expect things to look like tomorrow? >> we could end up in a situation where none of the defendants are present, and there's still time for the last two remaining defendants who have not filed a waiver in the case to do so. if georgia, if you already have surrendered and been processed, you don't have to be present. of course, we're waiting on mark meadows. remember, he testified and pushed in a separate hearing to have his case moved to federal court, arguing his role in all of this as the white house chief of staff meant that it should be a federal judge and federal judges that over see the case, and we have not seen a decision in that point of order in this case, and we may not by tomorrow so it's possible we could see mark meadows filing his not guilty plea, via a waiver. there's a lot of paperwork in that courtroom tomorrow. >> what is the strategy for those that decided not to waive their arraignment? >> well, one of the major issues here is how you want to be depicted in the public. how you want to show up. part of this will be theater, theater in what i mean is not the arraignment itself, necessarily, but what will follow in terms of public statements and public appearances, and it's shocking to some degree, because if you are a criminal defense attorney this is not what you want to see. we know with mark meadows and misty hampton, we are starting to see something akin to trying to make sure they can, in the case of mark meadows, and in others, sean hill, kathy latham, trying to get into a federal court and get possibly friendlier jurors. they don't want to be displayed on television, particularly when they are trying to hold out to look innocent. >> there's no longer two but one left, right, josé? >> yeah, since we have been on the air, mark meadows just filed his paperwork to waive his arraignment and plead not guilty. it's not surprising following the pattern of the rest of the codefendants. he's separate from any of the other codefendant, of course, still waiting on a decision if his case would separately move to federal court. it is just the matter of paperwork here, and mark meadows pleading not guilty via waiver in georgia. >> and some of trump's codefendants are starting to turn against him? how concerned should he be about them turning on them, if they, indeed, too? >> well, a case in which the allegations are you are part of a criminal enterprise is to say, no, i am not, that is that guy. in this case, if you are a mark meadows or kathy latham, the two saying get he out of the state court, and mark meadows saying i was doing what i was told to do by the united states president, and that's a way of distancing yourself and that's not a way of saying nothing wrong happened here. there's a lot of legal incentive to do that. to garrett's point, there will be an interesting and important decision made, and not just mark meadows, but he is alleged to have stood in the position of the campaign and said to the state of georgia, we will help you with campaign funds to speed the count, and that's not somebody acting as a chief of staff to a sitting president, that's somebody acting for a partisan and politician. that's not the people's business, that's political business. and latham doesn't even have that argument, because she didn't serve in the white house. it will be interesting to see how it plays out when that judge decides whether or not to allow the removal, and that will be an indicator of whether or not donald trump will have success or failure doing the same thing. >> and garrett haake, thank you. we have breaking news in alabama where just this morning a panel of three federal judges struck down the state's latest congressional district map and said it violates the voting rights act, and a special master have now been directed to draw a new map. what is your reaction to this? >> this is a huge victory for democracy. it's not the end of the road. we know there may be an appeal, but the reason there's a victory for democracy is because what we saw in alabama was simply something the court itself found, a federal judge found, was unconstitutional, and it was an effort to deny black voters their voice on getting somebody and deciding who represents them. remember, alabama just has one congressional district that is majority minority, one member of congress, and he has been an activist for voting rights, and to expand the seats available to black voters. the reason it matters in alabama is it's not just alabama, first of all, it was louisiana. we saw four different courts, georgia, ohio, alabama, louisiana, say there has been tampering with the ability of black people to have a say in who gets elected to office. in alabama there was literally 80,000 more black voters added to the voting roles -- the increase in population, i should say, and not voting rolls, and there was a gerrymandered district, and that's what even the supreme court, which has not been a friend to voting rights said it was unconstitutional and discriminated against people who were black. >> thank you for being with us. turning to washington, where the former chairman of the far-right group, the proud boys, is set to get sentenced today. he will be the final proud boys leaders sentenced after three other members were issued between 15 to 18 years behind bars, and federal prosecutors are seeking a 33-year-sentence for him. and joining us from outside the federal courthouse in washington, d.c. is ken dilanian. what are we expecting to hear today? [sniffs] what is — wow! baby: daddy. sinex. breathe. ahhhhhh! 12 past the hour. this morning, first lady, jill bidens resting in delaware after she tested positive for covid yesterday. she's experiencing only mild symptoms. the white house also said president biden tested negative before returning to the white house and he will continue to test regularly. joining us now is our white house correspondent. monica alba. >> we are going to see if there will be a domino affect. we understand the president will continue to be tested and we are not sure if that is once every 24 hours or more regularly than that, because he has a normal public schedule today. he will be honoring an army captain later in the white house and it's unclear what other precautions will take place. he was with the first lady yesterday before leaving for philadelphia, and over the weekend they were together and went to florida to survey the hurricane aftermath. the first lady went to various states to do a back-to-school tour, and she was supposed to start teaching herself today at a community college in the area where we know she has been teaching for sometime. i am told by the first lady's office they are working with the community college to get a substitution teacher for that classes, and she will continue to be monitored by the white house medical team. the president is scheduled to leave for india and vietnam on thursday to that high stakes g20 summit. we will need to have an answer of how he's doing, and whether there are any symptoms. the white house will give some answers, we hope, later today. last summer both the president and first lady did test positive at slightly different times and they had rebound cases from paxlovid, that drug that is supposed to severity on covid. we are trying to figure out if the first lady will take that again as she hopes to recover quickly. >> monica alba, thank you so much. north korea's kim jong-un may soon travel to russia to meet with vladimir putin so they can figure out how to support russia's war in ukraine. he said he had nothing to say on this topic. the spokesperson released a statement reading in parted, quote, we urge north korea to seize its arm conversation in russia and not provide or sell arms to russia. and joining us now, keir simmons. what is the significance of this possible meeting? >> well, i think it's a big deal for russia because north korea has a good deal of russian munitions that russia would, i think, easy guess, would like to have in its war with ukraine. i think it's also important because it signifies as far as moscow is concerned, it's preparing itself for a war of attrition, and that's some of the messaging from the biden white house is to expect something along those lines. this is further confirmation of that. it would not be the first time president vladimir putin and kim jong-un met like this, and in fact, back in 2019 we were there when kim jong-un travelled by train to the far eastern area on the pacific coast of russia. it's likely, and "the new york times" is reporting overnight, that would be the case, that the plan would be that kim jong-un would do that again. it's possible the biden white house made known it knows about this meeting and was trying to prevent it, and because we know kim jong-un is concerned about security, and so josé, ultimately, what this indicates is this continuing partnership between russia and north korea and factor in china there, just earlier in the year the financial times reported kim jong-un take part in the navel exercises with china, and we have seen them talk about the building of the alternative without the same from the u.s., and this indicates more of that. >> and also, you are following a major shake-up in ukraine with president zelenskyy replacing his defense minister? ♪♪ cold water can't clean tough stains? i'd say that myth is busted. turn to cold, with tide. 23 past the hour. breaking news from spain where this morning the country's soccer federation parted way with the coach of its world cup-winning women's team, and this comes after complaints of his controlling behavior. the statement from the federation does not say why he was let go, and his departure comes after the president of the soccer federation kissed a player on the lips during a victory celebration, and he was suspended after he initially defended his actions. now turning to a new look at the state of the republican race for president, a new poll from "the wall street journal" shows former president trump expanded his lead with 59% of gop primary voters saying they will vote for him. governor ron desantis is in second with 13%. no other contender made double digits. joining us with more is steve kornacki. always a pleasure to see you, my friend. what do these numbers tell us? >> what is significant, josé, you can see for yourself, this is an overwhelming lead for donald trump in the national poll, and the fine print of when the poll was conducted, august 24th to august 30th, meaning this poll was entirely conducted after that first republican presidential debate. in fact, all of these respondents saw it or absorbed the fallout from it in the media coverage, so there was all sorts of talk like did ramaswamy surge, or nikki haley surge, and haley is up a tick here. and donald trump has an overwhelming lead, and they looked at all the republican candidates and asked the republican voters do you have favorable or unfavorable view of the candidates? it's not as if trump is uniquely popular among republicans. trump has a high favorable and unfavorable, and so does ron desantis and tim scott and nikki haley, and not only is trump winning big, but he's winning big against republicans that republican voters like. trump is continuing to lead on the republican side and also in spite of all the criminal charges brought against him. and many say it's because of the backlash from republican voters to it, and you have the hush-money and the classified document case, and the overturning in the georgia case, and they asked the republicans are they charged politically motivated and without merit or legitimate, and overwhelmingly, they said they are without merit and are siding with trump on this. if trump holds on to win the republican nomination, interestingly in the poll they tested trump and biden head to head in the general election, and trump tied with biden. you might ask in the face of all of these prosecutions of donald trump, his defeat in 2020, and the under performance of trump aligned candidates in 2022, how could the general election be, and the big thing has to do with the fact that maybe the roles are reversed this time if they have a rematch. biden is the incumbent, and trump is the challenger. and so in the view of biden as president, it's a 42% approval rating, and that's a perilous place to be as an incumbent. there are areas where biden has a clear advantage on likability. there's a question of if he is corrupt. 58% say trump is corrupt. that's a bigger number than biden, but i would point out, biden, 48%, nearly half of the voters described him as corrupt. a slight edge for biden when it comes to honesty. what might be vulnerable and what could be accounting for the slack in the polling here, two questions, mentally up for the job, and biden 36, and trump 46%, and they are both old candidates and biden is older, but three quarters of voters say biden is too old. it's just a little under 50 for trump. there's a 26-point gap there. it makes you wonder, i think, if age is a factor. is this election going to be won or lost around the margins, but if age is a factor it's hurting biden around the margins. >> and the strong accomplishments as president will surprise people? >> yeah, another one. the dynamic shifted a bit from 2020 where trump was the incumbent and biden was the challenger, and now you have folks looking at the biden presidency and judging it in the moment, and looking at the biden presidency, and sometimes when they look at past presidencies, they can reassess it and looking in the past than in real time, and when you look at 46-46, it's that dynamic switching -- if trump is the nominee, of trump getting to be the challenger from the incumbent president, and talking about things that move numbers around the edges, that might. >> steve kornacki, thank you very much. joining us with more, former republican congressman from florida, and he's an msnbc political analyst. what is your reaction after hearing from steve? >> i think democrats ought to be concerned, when donald trump, one of the most controversial candidates of all-time, somebody engulfed in legal troubles, and somebody who is really not liked by most americans is tied with joe biden in the race for president. this should be sounding alarm bells across the democratic establishment and they have to find a way to strengthen the president's re-election campaign, because right now a tied race does not bode well for president biden. >> yeah, some of the issues of likability, and the whole issue of corrupt, and then the concept of accomplishments. that's -- you know, i mean, say what you will about president biden, but there have been a slew of accomplishments, and you may agree or disagree with some of them, but a slew of accomplishments in the first two years and going forward, and yet this poll says that at least, you know, this one snapshot says that folks thinks trump has a stronger record of accomplishments? >> yeah, you have to look at the economy. the trump time was not stable, but there was study job growth and steady gdp growth. when president biden came in, that's when inflation started growing. a lot of republicans say well maybe it was his fault because they passed the $1.9 trillion package right at the beginning of his presidency, but it's obvious inflation was already growing. inflation has left a deep scar in the american economy and left a lot of americans frustrated and now you have high interest rates designed to combat inflation, but they also increase the cost of living for americans, borrowing costs, and people that want to buy a home, it's very difficult right now. i think when people think back at the record of accomplishment, they are mostly thinking about the economy, and probably not other, you know, legislative accomplishments like the ones we have seen the biden administration produce, the infrastructure bill, a compromise on gun policy, and there's a pretty significant list of bipartisan achievements, however, when voters think back, i think they mostly think back at their personal economy and during the trump presidency, there was not this inflation issue, and interest rates were low and that makes a big difference. >> former congressman, thank you for being with us this morning. up next, an intense manhunt for an escaped killer in pennsylvania, and it actually expands. plus, the historic impeachment trial of texas's attorney general, and why members of his own party want him out. you are watching "josé diaz-balart reports" on msnbc. . whenever you are ready. (vo) the all-new subaru crosstrek wilderness. adventure on the edge. here's why you should switch fro to duckduckgo on all your devie duckduckgo comes with a built-in search eg but it doesn't spy on your seac and our browser blocks creepy ads that follow you around fro and other companies. and it's free. download duckduk 36 past the hour. >> the manhunt for a dangerous killer enters its sixth day. the suspect was spotted outside of where the police concentrated their search. what is the latest? >> reporter: i can tell you talking to residents here, nobody expected the manhunt to go into the sixth day, and that latest sighting south of the parameter, just two miles away from the chester county prison, and that's where the heavy concentration of police has been over the last several days, and they shifted their focus to the area south, a couple miles away from long wood garden, and that's where the bulk of the activity is centered on. a private security camera is where this is coming from, and then a doorbell show, he's clearly been collecting items out there. this is the message from authorities to the public, make sure your doors are locked because they don't want him to gather supplies and extent the manhunt any longer, and one man thinks cavalcante might have been in his home while they were home. we have that interview if we could play that, please. >> that pressure that we have been putting on him is working. we squeezed him hard enough over a period of a few days, and he was not able to get relief and managed a place to get out, and i wish we would have been able to capture him before he got through the parameter, and it's a large and dark area, and not to make excuses but it's difficult terrain and things. >> reporter: that was not from the homeowner but that was from the state police and the briefing this morning. that was in response to the question, do they think this has been a failure, because they have been focusing on the two-mile radius, and they wanted him to get out in the open and to force him and really make him tired and hopefully this comes to a peaceful resolution, soon, josé. >> and a man was telling you he believes a weapon of his was taken by this guy? >> reporter: yeah, he said a knife may have been taking, and police are vetting every tip coming in, and they don't know what he has on them, but he has the duffle bag and clothes and they are warning the public to be cautious of any sighting and make sure they lock their doors. >> thank you so much for that update. we turn to texas with a historic trial is under way. an attorney general, ken paxton, is facing impeachment, and he's the third official in the state's history to be impeached, and there was a denial of dismissal. joining us now from texas state capitol, is jane tim. this is unusual. what is paxton accused of doing? this is very unusual. >> he's accused of 20 articles of impeachment from corruption to bribery and abuse of public funds and public trust, and it all surrounds his relationship with the donor and developer here in austin, and how he helped that individual and helped him to navigate his legal troubles, and the impeachment managers say in service of that man. the trial is behind me, as you said, and republicans have voted against the attorney general, and we saw 12 republicans voted with democrats on that motion to dismiss, and at least one article of impeachment, so really some fascinating stuff. >> what can we expect from the proceedings? what is the timeline? >> it could take two to three weeks. it will look like a civil or criminal trial. we will have witnesses as well as a cross examination, and evidence presented by the lawyers, and it's a political trial. in a few minutes we will see a lot of witnesses, more than 100 people have been subpoenaed to testify in the trial, and they are all appearing in mass to appear in front of the senators that act as the jury and will likely be sworn in, and really a political spectacle, as well as in trial. >> thank you. the senate returns from recess this week, and punchbowl news says, quote, things are a mess. why this month is critical. plus, how the united auto workers union is coming dangerously close to a strike. you're watching "josé diaz-balart reports" on msnbc. i'm taking a two-year business course. i've been studying a lot. i've been producing and directing for over 50 years. it's a very detailed thing and the pressure's all on me. i noticed i really wasn't quite as sharp as i was. my boss told me about prevagen and i started taking it. i feel sharper. my memory's a lot better. it just works. prevagen. at stores everywhere without a prescription. >> still a mess, i hate to say. you are, as you noted, about 25 days from the government shutting down, and there's a huge gap between the house and senate on how much the government needs to be funded with, and on policy issues with things like border security and impeaching joe biden, and marjorie taylor greene said just yesterday that she would not move to fund the government unless an impeachment inquiry has begun, and this house is not back until next week and we don't know how it will get solved. i would not be surprised, and i would say better than even odds the government shuts down between now and the end of december, and that's a safe assumption but certainly not 100%. >> is there a cr already on standby? >> kevin mccarthy, speaker of the house, wants to extend that until november 15th, and he has to get that through with a sizeable number of republican votes because he got himself in trouble last night when he relied on democratic votes to get the bill through the chamber. this will be a high wire act for mccarthy when he returns next week. >> meanwhile, mitch mcconnell cleared by doctors but that's not satisfying some republicans? >> we have not heard any republicans publicly say he should step down, but the letter his office just put out said he did not have a seizure disorder or have a stroke, but what has happened when he froze in a pair of public appearances, one on capitol hill and one in kentucky, and i think there will be more questions in the coming days and weeks ahead about his status, and he will be at a senate republican lunch tomorrow addressing his colleagues for the first time after they have been back after a 40-day recess. >> anything of weight on the impeachment query? >> there are 18 republicans in the house that represent districts that joe biden won, so it's a very delicate mccarthy t to figure his way out of. he tried to set the stage that he doesn't want to rush impeachment. but a lot of members of his conference think it's beyond time, it is pastime to impeach joe biden. >> welcome back. things are a mess. perfect headline. thank you very much. turning to a potential strike that could have a major impact on the automotive industry. next week, contracts between the united auto workers union and general motors and ford expire. the union president is ready to fire up the picket lines. president biden is not worried about a strike. joining us is dominic chu. what should we look for?
