seniors. pharma is pushing back. ♪♪ good day, everyone. i'm andrea mitchell in washington. donald trump's lawyers hit a wall in their attempt to delay his federal trial until two years after the next election, a proposal the judge in his case called unreasonable. the former president and leading republican candidate for the nomination will be tied down in court starting march 4th, the day before 15 states vote on super tuesday, instead of out on the campaign trail. the judge overseeing the case is being attacked by the former president. former trump chief of staff mark meadows became the first trump co-defendant in the georgia state case to testify in open court yesterday. a high stakes legal gamble that subjected him to hours of cross examination by the d.a.'s office, only to have secretary of state brad raffensperger then, a republican, immediately contradict his testimony. joining me now, blayne alexander in atlanta, and catherine christian, former manhattan assistant district attorney. blayne, bring us up to speed on the testimony of raffensperger. there was a clear division on how he and mark meadows described the phone call from donald trump. meadows was on the call looking for more votes. >> reporter: they described it completely differently. what we heard from mark meadows during his nearly four hours on the stand, he laid out his duties as the chief of staff and said it was customary to set up phone calls between the former president and anybody else. he said he thought it was basically his way of kind of trying to settle some outstanding legal issues in the least litigious way possible. that was mark meadows. when we heard from raffensperger, he believed he thought it was a campaign phone call because of the presence of campaign lawyers on that call. he said that he is used to outreach from the white house, but what he saw to that extent was extraordinary. he said that mark meadows reached out to him before, but the call had gone unreturned. then we heard four clips of that phone call, that infamous phone call that so many of us are familiar with, they were played. brad raffensperger said when he did get an opportunity to speak on the phone, he said that he tried to push back, say there was nothing improper about the election. certainly painted a different picture of the phone call than what mark meadows did on the stand. >> the arraignment is set for next wednesday. do trump, meadows and the others have to show up in person? can they waive it? when do we find out if meadows' trial will move to federal court? >> reporter: i will tackle the last part first. the judge talked about the gravity of the situation. it's not necessarily he is going to try to rush his ruling on this. he said it is possible that it could go beyond september 6, which is when arraignment is. he says if he is not issued a ruling by then, mark meadows would have to basically show up for arraignment. he said the state proceedings can keep going in the meantime. from the fulton county side, the question is, what can the arraignments look like? one defendant has basically waived appearance, entered a not guilty plea. it's likely that we will see that from others to come. they would waive their appearance. we have been told at some point virtual appearances were on the table. they could come in person. a number of ways they could appear. there's a long runway between now and next wednesday. >> thank you very much, blayne. catherine, your reaction to mark meadows taking the stand for nearly five hours, actually. could that hurt -- that testimony hurt him later in this trial? >> definitely. whether it's removed or not. because now he is locked in. it's rare the defendant takes the stand and says, i'm guilty, you got me. when they take the stand, the danger they have is they make statements that are inconsistent with facts. you had in this case the secretary of state of georgia basically contradict the testimony that he gave. so the judge is going to judge the credibility, who is more credible, mr. meadows or the secretary of state? that's the danger. now there's a transcript that the government has, the fulton county, georgia, prosecutors have that they will use against mr. meadows in the future, whether the case is removed or whether it stays in fulton county state court. >> if the judge decides meadows will be tried in state court, can he still challenge that? is the game plan, the meadows defense plan to set up appeals to the supreme court on the key issue of jurisdiction? >> he will try. the problem for him is the state court action continues. as the judge in the district court said, you know what? you have to show up at arraignments because i might not have my decision until then. his game plan, mark meadows -- he should have taken this -- is to ultimately get the case dismissed on the grounds that he had immunity, because he was acting as a federal officer doing his chief of staff duties. the evidence belies that. even his testimony. he wants people to believe he was just merely present, non-active participant, basically a personal secretary. the testimony from the georgia secretary of state and the evidence -- the allegations in the indictment of text messages he sent, including one offering trump campaign financing if they would hurry up the signature process, belies that he was just acting as this federal officer. he was, according to the d.a.'s office, really being a political actor. >> what about this crowded calendar? we know from the federal judge, the implications there, and what has been set in new york, that the judge will defer to the federal case. the jack smith trial is march 4th. that's the start of the federal election interference case. it's the date that fani willis in georgia says she's asked to start her trial. is she going to defer to him? >> she will. when i say she will, the georgia judge will defer the same way that the manhattan judge deferred. it's not unusual or unethical for judges who have a common defendant to discuss amongst each other scheduling. i think that will happen. >> catherine christian, thanks. thanks to blayne alexander, of course, in atlanta. the storm warnings. florida's gulf coast getting ready as hurricane idalia intensifies. get the bank of america customized cash rewards card, choose the online shopping category and earn 3% cash back. hurricane idalia is intensifying as it's barrelling towards florida's gulf coast. the storm could become a powerful category 3 hurricane before it makes landfall tomorrow. idalia threatening to bring a life-threatening storm surge with flash flooding likely and high winds. tampa international airport suspended all commercial operations and almost two dozen florida counties have issued evacuation orders. in the last hour, desantis cautioning residents about the storm. >> make sure you are heeding the warnings from your local emergency management officials. make sure you are doing what you need to do to keep yourself and your family safe. >> joining me now is the mayor of st. petersburg, florida. thank you for being with us. are there mandatory evacuations in your community? what are you telling residents to do? >> it's great to be with you. yes, we do have mandatory evacuations in st. petersburg. we are a city of 260,000 folks in a county of almost a million. out of that million, about 330,000 folks have been asked to evacuate to higher ground because of the storm surge threat. >> at this stage, what are the latest preparations? i see people have sandbags. do you need help, the national guard now alerted? what is happening? >> most areas are used to this battle, cadence of making sure we have hardened our facilities, locked down our vehicles and facilities, done things like reducing our ponds and lakes and making sure that folks that live in those flood-prone areas know we have shelters available. we provide transportation for folks that have special needs. it's more an issue of responding when you have information that there's a threat from the hurricane, even though we are not inside the cone, we have seen from history, as recently as last year with hurricane ian, that even if you are outside the cone or on the edge, a storm can change its track pretty quickly and have devastating consequences. all coastal cities in florida are going through the same prep, making sure folks know what is coming and helping them move to a safe area. >> how worried are you about the storm surge? it's low lying land there. >> i'm a third generation floridian. i respect hurricanes. something is happening with our environment, as you see wildfires, stronger storms. this storm developed really quickly. i think as it moves over the warm waters of the gulf, it is projected to become a cat 2 or 3 very quickly. the weather is changing. i their our response to that has to match the increased threat. we are concerned about storm surge in our area, four to seven feet. it can be devastating if you are in low lying areas. very concerned that folks don't get complacent. i think after seeing what happened with hurricane ian less than a year ago, folks understand how devastating storm surge can be. >> we really appreciate you being with us. we know it's a busy time. good luck to you and stay in touch. >> thank you, ma'am. joining me now is meteorologist bill karins following the storm's track. bill, how bad could this get? >> it's going to be a powerful storm. likely maybe a category 4. this is not going to be an ian, like some of the worst storms, because it's going to hit an area of florida that's the least populated of anywhere in the sunshine state. if you can get 10 to 15 feet of water where hardly anyone lives, we have less destruction when we had ian hit downtown with four to five -- as a category 4 or 5. with that said, we have thousands of people that are at severe risk of property damage and their lives. hopefully, they are out of there. we don't have hundreds of thousands or millions of people in the heart of what is going to be the core of the storm. let me go through this and explain it to you. the storm is intensifying. the track has not really changed since yesterday. taking it up towards the big bend. it's 100 miles off the coast of the tampa area. i don't think the core winds of the hurricane strength will be in st. pete or tampa. they don't have to worry about too much wind damage. the concern on the west coast is all from storm surge. even being 100 miles from the center of the storm, there's a shallow shelf along the coast. it will pile the water up. water issues at the coast. if you are at an elevation of ten feet or higher, you are going to be just fine. you may not lose power if you are lucky. it is other areas to the north where the storm surge is worse that things will be of more serious concern. that includes cedar key, a population of 700. if there's one town that people will wonder how did it survive or did it survive, we will find that out wednesday night after the storm moves out. as we bring the carolina storm o four feet possible. at the same time, a full moon. a triple whammy. savannah could see a top ten storm surge, even from only a tropical storm. keep an eye on that for the south carolina and georgia coastal areas. our computer models haven't changed much. they shifted further away from tampa. now inching closer towards tallahassee. big city here. same with gainsville. smaller cities here. they are tightly clustered at this point. we will get this incredible storm surge from a strong category 3, maybe 4 hurricane. that's 10 to 15 feet. if this was the tampa bay area, it could be a catastrophe. billions and billions of dollars of destruction. up here to the north, it's less monetary damage, because it's not as much to damage. this is swampy areas. there's no beaches up here. if there's any good news, if you have a category 4 storm hitting, you want it to impact as little people as possible. here is the specifics. just because -- once we get to the population centers further south, four to seven feet. tomorrow morning, the water is going to be high. it's in areas people haven't seen before. that's why they have done evacuations. just because the winds aren't that high in the tampa area, the storm surge could be life-threatening, especially north of tampa. that's where the water will be exceptionally high. how high could the winds gust? right now we are thinking between 50 to 70 on st. pete beach and tampa area, maybe to 50 to 60 miles an hour. they go through a lot of storms with winds like this. i'm not thinking widespread power outages. more scattered through the west coast of florida. up here, we get the eye making landfall, that's where you get gusts, 90, 100, 120 miles an hour. the rain will be a huge issue. >> bill karins, thank you. thanks for all of that. we appreciate it. the breaking news from capitol hill now. house majority leader steve scalise has been diagnosed he has been diagnosed with a blood cancer. he has begun treatment. we know he is tough. he recovered after many surgeries after being shot during a congressional baseball practice some years ago. in a statement, scalise says, i'm grateful we were able to detect this early and that this cancer is treatable. we wish him well. the racist attack. what we are learning about the latest hate-filled mass shooting in america and the far reaching impact it is having. you are watching "andrea mitchell reports" on msnbc. what do we always say, son? >> no, i did not. this is what we signed up for. >> newly released surveillance video showing the chilling moment just before the gunman opened fire. on a call with civil rights leaders, the fbi director responded to the shooting calling the attack heinous and pledging to bring every resource to bear as the investigation continues. authorities have identified the victims. a mother and uber driver who had dropped off a friend at the shop right before the shooting. a 19-year-old man who worked at the store and had recently graduated from high school. and a 29-year-old man who leaves behind his 4-year-old daughter. joining me now, nbc's tremaine lee. another horrible racist act. reminds you of buffalo. it was on august 28th, a terrible anniversary of racial attacks around the country in history. >> i tell you what, i think in this moment, it's easy to focus on this terrible tragedy and violence that happened in jacksonville over the weekend. it speaks to the specter of violence that black folks have faced in our country. you mentioned the anniversary of the march in washington where dr. king spoke of a dream of equality that for so many people remained a nightmare with violence always latent. whether it's florida or buffalo or south carolina. in this moment, we reflect on the gains of the civil rights movement and dr. king and so many other people who fought for a more level playing field in america, this is a cruel reminder that america is as violent today as it has been. >> the fbi director has been warning about right wing violence in testimony for several years now, he said they are working and trying to keep the hbcus safe, reassuring them by calling those leaders and faith leaders -- he stopped -- the brave security officer stopped him. what do you say to the students, the faculty, administrators and others on these campuses? >> in this moment, when it comes to education in florida, especially, with ron desantis and his stop woke act, which draws a line, people in that community in particular feel like sitting ducks from everything that we read about the kind of chill it placed over this community, that a gunman may have plotted to kill people on that campus. if not for the students who saw something and said something to the lieutenant, who may have deflected possible violence, you can only imagine the fear that they are feeling right now. communities throughout this country throughout the south have had to be vigilant in the face of unrelenting violence. we can only -- our hearts and prayers objectively as journalists, as americans, go out to the community and so many other communities who face the threat of this violence. >> yesterday, governor desantis facing boos at a jacksonville vigil for the victims. he called the gunman a scumbag. a jacksonville pastor who spoke after him was very direct in his response. he said at the end of the day, respectfully, he was not a scumbag, he was a racist. what's your response to that? >> the issue with that language is it places the onus on one individual and the actions of one individual as opposed to a nationwide sickness of white supremacy in the country and the violence it fuels. as long as he is a scumbag or as long as there's a mental health issue you don't have to engage with the idea that there are co-conspirators online, co-conspirators who create legislation that divide. there are other forces that are contributing to this violence. as long as the act of one individual is just a scumbag, then you don't take the true issue head on. >> thank you very much. classes at the university of north carolina chapel hill are canceled after a lockdown all day monday following a deadly shooting there. officers swarming the campus. some students sheltering in place. other terrified students were jumping out of first floor windows. >> we all just stayed hiding in the stall, just scared. we didn't know what was happening. >> it makes me feel sick, because this is a situation we shouldn't have to worry about. >> the suspect was at large for about an hour and a half before being taken into custody. you can see this live on the local affiliate. captured by the station. he has been identified as a 34-year-old ph.d. student. he is facing first degree murder charges. the victim was a professor. he was his academic advisor. state, local, and federal law enforcement continue to investigate. it's deja vu all over again for political newcomer vivek ramaswamy, facing questions about his qualifications to be president 20 years after he appeared right here on msnbc as a college student. >> i'm vivek, of all the democratic candidates out there, why should i vote for the one with the least political experience? >> i do. george bush, barack obama, joe biden were the other three presidents. in my view, judging by results, the fact we didn't get into any major wars, our economy grew over the same period, did make him to date the best president of the 21st century. i'm running to exceed that bar as i expect i will as our next president by taking the america first agenda to the next level and uniting this country in the process. >> you raised your hand in arguably the most dramatic moment of the debate when asked would you support a nominee if he were a convicted felon? won't it make him to be an effective standard bearer? >> i have faith in our judicial system as the last bastbastion justice. to bring those kinds of unprecedented charges against a former president is a travesty and sets an awful precedent for our country. i want to be very clear about why i've been so vocal. if you look at many national polls in the last couple of days, i'm polling in second place to trump. it would be easier for me if donald trump were liminated from competition. that's why it's important as his competitor that i take a stand and say this is going to be a disaster whether democrat or republican. we do not want to become a political movement where the party in power uses police force to indict its political opponents in the middle of an election. that's not how we do it. the people of this country get to decide who governs. i want to keep it that way. that's why i've been so vocal on this. >> you told chuck todd this about what you would do -- what you would have done if you were in mike pence's position on january 6. >> here is what i would have said. we need single day voting on election day. we need paper ballots. we need government-issued i.d. matching the voter file. if we achieve that, then we have achieved victory. we should not have any further complaint about election integrity. >> what would you have done? you would have not certified the election? >> in my capacity as president of the senate, i would have led through that level of reform, then on that condition certified the election results. >> that means you would not have certified the results that night before midnight on january 6, while that was your constitutional obligation. what if kamala harris did that? what if joe biden and kamala harris win, would she have that same authority? how could you get legislation through, sir, in that kind of legislation, in time to certify the election? you would violate your only as vice president? >> i respectfully disagree. i stand by what i said, not what you said i said. i said that that's what i would have delivered. then use that as an opportunity for heroism to reunite this country. there are two preconditions for the health of our constitutional republic. one is the peaceful transition of power. the other is public confidence in our elections. when those come into conflict, that was a rare opportunity for heroism. this is a national compromise. election day as a holiday. government-issued voter i.d. matching the file. i think -- chris christie and mike pence criticized me. i would love to educate them that the u.s. federal government can set standards for election. look at the american confidence in elections act pending in congress. you could use funds through the help america vote act to say that those are minimum standards. >> that takes time, sir. >> that's how we move this nation forward. with all due respect, the capitol was under attack. they were trying to complete it within that calendar day. as is constitutionally mandated. that's not the time to start proposing legislation. >> i would have begun on november 5th. >> a peaceful transfer of election -- >> that's not what you said during the debate. that's what i said. i said this for months. we would have never gotten to that point had i been in power, either as vice president or the u.s. president. we would have never gotten to that point. it's a stain of our history. it's my job to make sure we never get there. that came after a year of censorship about the origin of covid-19 and lockdowns, the hunter biden laptop. on the eve of an election. the problem is in the united states, like in any country, if you tell people they cannot speak, that's when they scream. if you tell people they cannot scream, that is when they tear things down. i have said that in the days following january 6, 2021. i have said it every step since then. as president, i would have never gotten us to that point. i will lead us forward with a simple national compromise around election integrity without censorship of speech. >> every president in american history has gone forward with a peaceful transfer of power, win or lose. this president had ample opportunity. there were more than 60 federal cases challenging. he lost in all of those cases. let's talk about the hurricane that's approaching. you have called climate change and that agenda a hoax. you said more people are dying from bad climate change policies than of climate change. according to a u.n. agency, extreme weather events compounded by climate change caused the death of 2 million people between 1970 and 2021. can you offer evidence that more than 2 million people died from converting to clean energy? >> i can offer evidence that the number of climate related deaths is down by 98% over the last century. the number of people who died of hurricanes, tornadoes, heat waves and other weather related events in 1920, for every 100 died then is two today. it's because we have technology powered by fossil fuels. a hard fact, eight times as many people die of cold temperatures than of warm ones. the right answer to all temperature-related deaths is more plentiful, abundant access to fossil fuels. the earth is covered by more green surface area today than half a century or a century ago because carbon dioxide is plant food. as a percentage of the atmosphere, it's at a low through human history. those are facts. i think we have to acknowledge those when having this debate. >> there's a hard fact of the hurricane that's approaching the mayor of three generation resident says he has never seen anything like this, the ocean warming. let me move on to some -- >> may i respectfully offer a response? i mean this with due respect. if someone on the other side were an uneducated person from arkansas who didn't go to college and offered one weather event of an anecdote to support climate change, you would laugh them off the stage for saying they don't follow data. the same shoe has to fit the other foot. follow the actual data. >> i'm not talking about one person's opinion. we talk to professors, ak -- academics. >> i think that's driving this false narrative as opposed to the facts i'm citing. >> and dr. michael mann and other professionals. let's move on to foreign policy. you are in charge of letting russia keep the donbas region. that's vladimir putin's demand. there's thousands of ukrainian children being kidnapped, murders, atrocities. isn't that letting putin win despite his war crimes? >> with due respect, my concern is that our steps and nato's steps right now are marching us closer to world war by driving russia further into china's hands at a time when we have no visibility into what russia's red lines are. further, at a moment when russia has a larger nuclear stockpile and super emp capabilities and hypersonic missile capabilities ahead of the u.s. what i said is i would end that war, but on terms that end the russia/china partnership. that's how we deter xi jinping from going after taiwan. right now, xi jinping's bet is that the u.s. will not want to go for two different allied nuclear super powers at the same time. if russia is no longer in china's camp, then xi jinping is going to have to think twice before going after taiwan. i'm the only presidential candidate who has said we will defend taiwan because we have greater national interests there than we do in ukraine. i do not think that this war advances american interests. we should focus on the real enemy that's communist china. that's how i orient my foreign policy. >> i would love to have another conversation about how you would end the russia and chinese partnership, which goes beyond ukraine and goes into a deep-rooted partnership. let me ask you about eminem. they sent you a cease and decease through the music licensing company. have you agreed to move on? won't they just try to find the money elsewhere out of consumers? >> yeah, andrea, that's a possibility. but i think what was brilliant in terms of the way medicare is going to roll this program out is that these ten drugs will soon become 20 drugs and different drugs year after year. even if manufacturers try to do something around, let's say, the ten specific drugs, it is impossible to concede that they could do that for every single drug and on top of that there are pretty stiff penalties if they try some of the games or choose not to participate. all in, not just these ten drugs, but this will help lower costs for everybody in the part d program because there is going to be a maximum you can pay out of pocket. that means real savings in the next several years all thanks to these provisions in the inflation reduction act. >> and it is supposed to kick in, in 2026. when are consumers going to feel the impact, what happens if the drug companies refuse to negotiate or are those the penalties you're talking about? >> they face not just tax penalties, they face the biggest threat which they could lose their ability to be given to medicare seniors, meaning there would be a chance that medicare would limit access for medicare seniors. nobody wants to go that route, which is why i think you're seeing so many lawsuits and actions. i think the signal to your point when will consumers start seeing savings, the signal has already started you're seeing drugmakers already voluntarily reducing, for example, prices on insulin. that happened before this announcement came out today. but i think you should start to see some of these really high density medicare drugs be subject to negotiation in the future and lower costs. >> dr. kavita patel, thank you. and fault lines, who is to blame for the downed power lines which appear to have sparked the devastating fires on the island of hawaii? >> thank you for having me. right now we're investigating on the second day after the crisis so that was on the 10th of august, i asked my attorney general, ordered her, in fact, to a comprehensive review and subsequent investigation into everything revolving around the fire. we'll get to the bottom of it. right now, yes, the county and hico, the energy company, are sparring about who is responsible. what is most important to me is we care for the survivors and we get some kind of recovery monies for the families that lost everything. the facts will come out, we'll be totally transparent and hold everyone accountable. >> there has been so much confusion about the number of missing people tragically. do you have an updated number of how many people you're still trying to find? >> i do. the number dropped originally from 1200 to 800. that's because everyone, we cast a wide net, everyone who spoke up they're worried they lost someone or couldn't locate someone sent us a lot of reports. there were a lot of duplicates. that number under 300 now. the number of missing reports is more like a third of that, missing people to the county. so about monday we expect to have a new number from the fbi. it is tragic, andrea. 115 fatalities. we're beginning to rebuild. i'm grateful to the president, grateful to the bipartisan committee that came yesterday to maui and we're grateful to all of america for caring about us. >> there is a tension between the effort to take care of the survivors and the homeless. and your need for tourisms and some tourists were relocated and are being treated better than the homeless. how are you dealing with that? >> we're treating everyone as equally as anyone should be treated. i'm told it was unprecedented. everyone was removed or got out of the shelters by day 14. which we're very proud of. it was so much extraordinary work by fema and red cross and our local community, we will house people as long as necessary, over 36-week contract with the red cross and i will build some bridge housing to get us through to the time when the people of lahaina tell us what they would like to build. we treated every single person we came across with as much dignity as we could. i provided some medical care to some homeless individuals that were on the edge of the village somewhat charred and in lahaina and i saw one of those gentlemen who was in a hotel along with 6,000 people who had homes that were burned and he was alive and we're grateful for all of the healing that we can do. really a lot of people, of course, in this time of struggle and this time of total grief will have different reactions. there always is some finger pointing. truth be told this was a natural disaster. the fire occurred, god knows the specific details at the beginning and we'll try to find that out, but in an era of extreme climate, when you have a storm with 81-mile-per-hour winds that created a fire hurricane, we have to acknowledge that we are in a different world now and that is why you're seeing that kind of fire. the winds and i heard this from the survivors roared that fire faster than their cars could drive in some cases. it was a miracle that people got to safety. but like i said, we will never make an excuse. we will find better ways to protect people and i hope it will be a global conversation about the reality on the ground because people can be saved if we're better. >> thank you so much, governor. we appreciate your being with us. >> thank you for supporting us. we appreciate it. >> you bet. and that does it for this edition of "andrea mitchell reports." chris jansing reports starts right now. good day. i'm chris jansing live at msnbc headquarters in new york city. it could be the most powerful hurricane to hit florida's big bend since 1950. fueled by wildly hot gulf waters, idalia is expected to explode from a category 1 to a category 3 or even 4 before slamming into the coast tomorrow. officials at tampa general hospital are putting up what's called an aqua fence, an attempt to protect against life
