it says this guy did bad things, and this is what happens. but for millions of others, it's come to be a badge of honor, an idea that was helped along by donald trump and his campaign team. who immediately worked to turn what is normally something shameful into something powerful. a marketing photo for exactly the candidate they are trying to sell. a defiant and righteous soldier fighting against a corrupt government. again, with millions of americans, that image does sell. so well it could very well help him win the republican primary. after all, he's far and away the front runner so where in the world does this country go from here? how does this divide not get worse before it gets better? does this country's fate get settled in a courtroom or at the ballot box or does it have to be both? joining us now is nbc news correspondent vaughn hillyard who's outside of the fulton county jail for us, nbc news senior legal correspondent laura jarrett, and "atlanta journal-constitution" political reporter and an msnbc political contributor, greg bluestein. those are big questions, let's get to the reporting about what's going on. laura, i'm going to start with you. donald trump and the others were originally going to have a trial date a little bit later on. now at least one of them wants their trial date on october 23rd. we'll see if that happens. we also have hearings coming about whether this case should be sent to federal court and taken out of state court. what's the argument there? >> this all starts because the former chief of staff mark meadows decides to file a motion to pluck the case out of state court into federal court. he filed that just on behalf of himself, saying because i was acting as chief of staff, as part of my official duties, this case should be in federal court. the judge said fine, you want a hearing, it's going it happen 10:00 a.m. on monday. it's a big deal. they're going to hear evidence. they're going to hear from the man at the center of this entire thing, how this all started, the former secretary of state, brad raffensperger who gets the call to reverse the election in georgia. i don't think we're going to hear from mark meadows, anything he says at that hearing could be used against him by prosecutors. it could be interested to see how prosecutors are framing the case, what exactly raffensperger said about what happened on the call, and everything leading up to it. prosecutors say mark meadows is the one who actually arranged it. meanwhile, you have other people now saying i too want to remove my case to federal court, and why do i want to do it? because i was acting at the direction of a federal officer, not mark meadows but the former president himself. i think you're starting to see where perhaps there's a little bit of not necessarily conflict, but diverted interest between someone like donald trump who of course wants to slow this whole thing down, and other people who are trying to get this whole thing thrown out by pointing the finger at him. >> when they are pointing the finger at him, does that change the prosecution in any way? does it make it more likely that one or two of these people might flip? does going into the jailhouse, special the jailhouse in fulton county, which is notorious, and said to be pretty gross and disgusting, does going in there, you know, kind of open your eyes? >> look, i haven't talked to any of those 19 individuals, but i would have to imagine that was a humbling experience for all of them, and perhaps eye opening, especially for some of them, like big players, at least one of them is still in custody last we checked and so this, again, as a person who may not have a long standing relationship with the former president. maybe this is somebody who doesn't want to serve time for him. isn't prepared to do that. some of the fake electors say i was there for one meeting, and now i'm being charged with a crime. this is the beginning baby steps for a lot of these folks. it's early stages to see whether or not they, again, change their tune and decide to cooperate. >> yesterday we were talking about october 23rd for the trial for the ken chesebro, and we were wondering what the judge would say, the judge said yes. is part of it happening? >> a part of it is technical and speedy and boring. it starts because he says he's asserting his rights. fani willis, in order to make sure this case doesn't go away, okay, fine, we got you a date, and the judge signed off on it, but only as to ken chesebro, the question is whether even that october date realistically sticks. everyone is agreeing with it, following the speedy trial right, it may not stick. there may be more motions, delays, i'm not sure you should expect to see anyone go on october 23rd. >> don't mark your calendars with pen. >> this is more about following the letter of the law. >> vaughn hillyard let's talk about what's happening down there. harrison floyd still in custody? >> reporter: harrison floyd is still in custody. he's the only one of the 19 that remains here at the jail. he's the only one that did not post bond. he has an initial appearance within 72 hours that is afforded to him, if he does not, in fact, post the bond before then, but the other 18 defendants all posted bond. all 19 defendants have formerly surrendered. lee, the illinois pastor behind the alleged scheme to put pressure on fulton county worker, ruby freeman to falsely admit voter fraud on her part, he was the final one, the 19th defendant to turn himself in. literally in the 11:00 a.m. hour, before that 12:30 deadline, but right now, this is when this process begins, which each of these defendants who clearly have differing interests begin to put their motions forward about when not only the trial will be heard but as laura just pointed out, there's five defendants who have asked for their cases to be moved to the federal court, and there's still plenty of time for others to do the same. >> and talking about what it must have been like to go and get processed at this facility, yes, donald trump did it within minutes, everybody else, it took longer. tell me about the fulton county jail. >> prosecutors and defense attorneys say you wouldn't wish upon your worst enemy. it's problem plagued, the history of overcrowding, of violence and abuse, of mismanagement, seven deaths in the past year, three in the past month. civil rights complaints and ongoing justice department investigations. senators ossoff and warnock have called for federal inquiries into the jail's processes and management. even the sheriff himself said it was a humanitarian crisis there. so donald trump, you know, was not treated like every other defendant or a person charged with a crime in that sense because he didn't have to spend eight, nine, ten hours to be waited and booked and processed there, it was less than 20 minutes. but at least he was treated like any other defendant in getting finger printed and getting the mug shot that we have all seen. >> it raises questions about what your reaction is if you walk in there and what it might make you consider. we'll see. vaughn, talk to me about what donald trump has been doing in the past 12 to 20 hours since he has been out, and how the campaign so quickly took that mug shot and made it into all sorts of merchandise from mugs themselves to beer koozies and t-shirts and bumper strategicers. >> >> reporter: right. we know donald trump has no campaign events planned. he is back at his private club in bedminster, new jersey, he engaged in one conversation on newsmax last night aboard his plane in route from georgia back up to new jersey in which he called the experience here a terrible experience, and he had suggest that he didn't even know all of the other defendants here, suggesting there was wrong doing, they were being unfairly persecuted in his words. you mentioned the mug shot, you know, one of his allies telling me that it's going to be the most iconic photo in american history, and they are going to use it to at least the best political advantage that they can because frankly on the legal end, there's only so much control that donald trump has over this process going forward. you mentioned the store they are selling the mug sot from. he posted to twitter, known as x now, with a link directly to the store. donations made to donald trump, 90% of the donation, goes to his 2024 campaign. the other 10% to his save america pac which has been used by donald trump to pay his legal expenses in the past. we mentioned the different products, you've got t-shirts, you've got beer koozies, mugs, most often folks put their pets or kids on mugs, for those who prefer bitter coffee, you can get donald trump's mug shot. for $25, that's up for anybody to do. you would be contributing to his 2024 campaign, as well as his own legal defense. clearly donald trump is looking at four criminal trials ahead here, and legal funds are needed, not only for him and other defendants as well. >> what do we know about what might have been happening behind the scenes regarding the photo. it looked like that a deliberate pose he struck, that grimace and that scowl. >> i have been told that it was a quick snapshot, it was limited number of individuals that were actually inside of the facility with him. he was only in there for just over 15 minutes. for donald trump, he claims that he did not know what a mug shot was because he went to the wharton school, according to donald trump himself, talking to news max last night, if you didn't know what a mug shot was, he does now. it's a quick process inside of the jail here, and one that shut down all of the streets and the jail. one normally open for 24 hours. >> talk to me about fani willis, this idea that kenneth chesebro might have been trying to call her bluff by asking for a speedy trial. what do we know about the preparations she's done for this, and what her office is currently doing as all of this stuff begins to get processed? >> look, this investigation has been going on since fani willis took office, since she first heard that infamous phone call between donald trump and brad raffensperger, she joked she wished brad raffensperger didn't live in fulton county, but he does. this is her territory. they have interviewed 75 witnesses for the special grand jury investigation, and compiled who knows how many documents and reams of information, so she's ready, and i think we saw that when she basically called chesebro's bluff, and said you know what, i'm ready for trial october 23rd if it comes to that. we don't know if it will come to that, chesebro's defense attorneys have not seen discovery. they don't know what kind of case prosecutors have lined up. they could retract the request for a speedy trial. fani willis has demonstrated she's ready for anything that comes at her. >> i wonder, the test, laura, of the criminal justice system, it's been tested on the federal level, on the state level. is it ready? >> i don't think it knows yet, and i think part of the challenge is figuring out how to treat somebody fairly who obviously occupies a position like nobody else, right, so even just going -- >> and uses his position like nobody else. >> right, we have talked about so many times, what happens with the bail conditions, right, in order to stay out of jail, he has to follow a whole litany of different rules. right? he can't intimidate witnesses, he can't even talk to codefendants about the facts of the case, but if he doesn't follow that, again, that's a stress test of the system, at what point do you pull the trigger and say, okay you have to follow the rules or there has to be consequences. >> getting a jury in any of these matters, i know some of the districts are different than others. this country is so divided, and it's not so neat as to say everybody lives in the city thinks this way, and everyone who lives in that city thinks that way. it's got to be daunting for a prosecutor to have to find a unanimous jury to convict someone like donald trump on anything. >> it's part of why i think so many people have predicted who have done hard and complicated racketeering trials have said this is going to take a really long time. even just the voir dire process, when you actually talk to potential jurors about their inclinations and if they have biases, that process can take weeks or a month or longer in a case like this. it's part of what goes into the calculation of why we're trying to help our audience understand, this is a long road. >> also help our audience, what should we be looking to next, there's the meadows hearing on monday. >> monday is a big day. both of these cases, the meadows case in georgia and d.c., don't forget, tania chutkan who's overseeing the federal part of this election interference investigation, she's holding a hearing at 10:00 a.m. as well, to set a trial date, and donald trump wants it out two years from now, and the prosecutors want something pretty aggressive. she might set something, you know, maybe june or july, maybe perhaps next summer. but even that, that's extraordinary, in the middle of the campaign, we talked about the time line and the political aspect of this overlapping, but we're going to get a lot of clarity on monday in both cases. >> we're going to talk about that and whether she might say anything about what donald trump himself has been saying in the last few weeks. laura (vo) football season is here. get nfl sunday ticket from youtubetv on us. a $449 value. plus, get a free samsung galaxy z flip5. only on verizon. . joining us now former manhattan assistant district attorney and msnbc legal analyst, catherine christian. i know we have been talking about this mug shot since 8:30 or so last night. i think it's worth talking about again. this is the former president of the united states who now has a mug shot, and i don't think it's easy to parse what this means for the country because so many people in this country seem wildly different versions of what that picture represents. >> well, i mean, he's using it now to fund raise. it's almost as if he's taking it lightly, and i have to say, georgia congressman john lewis was a freedom writer, the people who went down south to, you know, integrate and fight against segregation. he and the other freedom writers used their mug shot as a badge of honor because what they were doing was for the cause of justice and to fight against segregation. former president trump thinks his mug shot is a badge of honor is quite sad. because it shouldn't a badge of honor. now, every person who's arrested in this country usually gets a mug shot, so he was actually being treated specially in manhattan and by the special counsel for the miami and the d.c. case. so that georgia has in this case said no exceptions, every one of these 19 defendants is going to get a mug shot in many ways speaks to equal justice, but that he's using it as a badge of honor and to fund raise is, you know, i think is quite sad. >> on that same note about seeing different versions of what that mug shot represents and what i was just talking about with laura jarrett, i would love to get your insight as a d.a. how do you put together a jury that you believe will fairly hear your argument, a jury that isn't predisposed to believe one thing or another, about somebody like donald trump. >> you know, it can happen, and the way you do that, the way you get a fair and impartial jury is through jury selection, which is also called voir dire, and there will be extensive in all four of his cases if they go to trial, extensive jury selection because it isn't whether or not you're a democrat or republican. it's whether or not when you are in that courtroom, will you listen to the evidence in the courtroom and listen to the law as instructed by the judge and make a decision based solely on that, not whether you -- and you don't want someone as a prosecutor, you don't want someone who says i hate donald trump and no matter what the evidence is i'm going to vote to convict. and obviously you don't want someone who says i love donald trump, no matter what he did, i'm going to vote to acquit. you want someone, and i believe you can find 12 people who can listen and fairly say, whether i like him or not, he's not guilty because the evidence was not proven beyond a reasonable doubt or on the other side, he is guilty. >> what sort of questions do you ask to get there? >> you basically ask that, you say, you know, what are your feelings about donald trump, and that's sort of how you get them. anyone who says i've never heard of him, you know they're lying. they have to go. you have to parse it out, and both sides and the judge will be asking, you know, going through this jury questionnaire, and i'm assuming they're going to have an extensive jury questionnaire, and you parse out anyone who says they have no opinion, you can say i have no opinion about his guilt, but you can't say i have no opinion about him, because everyone in this country has an opinion about him one way or another. it's going to be an extensive process. this happened in a civil rape defamation case in manhattan, and they were able to find, you know, jurors who he would say because they found him liable, they were not fair and impartial, but they were fair and impartial because they did find him not liable for rape. but they found him liable for another sexual assault. so i think if they were not fair and impartial and just wanted to stick to him, he would have been found liable for everything. >> i have one more on georgia, and then i want to get to the federal case that judge chutkan is overseeing, the federal election interference says. on georgia and the october 23rd date, it's not necessarily that kenneth chesebro is going to have a trial on that date, if it's not that date and he's still asking far speedy trial, could we see him alone going to trial soon after that, could we see him go to trial sooner than the codefendants? >> it he and his attorneys are serious that they really want to try a case, really want to waive motions, don't want to take the time it takes to go through all of the discovery, and you know, piece by piece and find inconsistent statements possibly of witnesses, then it will go. i suspect if these are very competent attorneys they will say, yeah, i didn't think, you know, the d.a.'s office actually thought we were serious about this. they have not received a piece of discovery yet. they only have the indictment. so you're talking about really, october 23rd, you're really saying that you will be prepared on a case like this to go to trial and effectively represent your client? so we might see that it won't happen on october 23rd. >> prep us for what you expect judge chutkan to say at the hearing on monday regarding the trial for the election interference case that jack smith is bringing, not necessarily about the date of the trial, we're going to find out when we find out. do you expect her to address donald trump and address some of the comments he has made over the past few weeks about her and about the case. >> she might not address specifically about her, that's a little too -- she probably will restate what she said the last time. that even, you know, clearly ambiguous statements, inflammatory statements will affect the decision about whether or not this will be a quick trial because those statements have the possibility of tainting a jury. now, he hasn't, he did before the protective order makes statements against vice president, former vice president pence, which who will be a witness, he will probably be a witness in georgia and be a witness for the january 6th case, and, you know, you cannot intimidate witnesses, so i think she will reiterate that firmly. i think when she picks a trial date, particularly if she picks one, she's not picking april 2026, believe me. but if she picks one that the fence thinks is too soon, she might make a statement again. well, as i said the last time, inflammatory statements might call for us to have a quicker trial date. so there will be no, she's not holding mr. trump in contempt but she might be firmer this time to be more explicit about what he can and cannot say about the case. >> katherine christian, thank you very much. we'll check in with you again soon, i'm sure. coming up next, could there be a surprise gop candidate about to enter the race? joining us now from iowa is nbc news correspondent dasha burns. they can't go after him for fear of the wrath of the voters. if they're not going to go after him and maybe take the same path he's taking on a lot of the issues, how do you distinguish yourself, how do you say vote for me instead of donald trump? >> well, it's a really great question, and one of the candidates that's here in iowa today, vivek ramaswamy is doing quite the opposite of going after him, he's embracing him wholeheartedly, calling him the greatest president of the 21st century, but saying that, you know, i'm running because i think i can deliver what he couldn't, and then not as polarizing as he is, that's sort of the argument he's making and still developing kind of a bromance with the former president, and donald trump, in fact, was praising him, even though he is his political opponent. so it is vivek ramaswamy and florida governor ron desantis who according to a recent poll from the "washington post" won the debate, the two came out on top, and it's really fascinating to me, katy, that those are the two because they split center stage, now they're both in iowa, running around the state, and they could not be more different candidates, right. vivek ramaswamy came into this race relatively unknown. people didn't know his name, let alone how to pronounce it. florida governor ron desantis perhaps the greatest name idea aside from donald trump, of course, but has sort of struggled through this race, and didn't have any attacks on others or didn't get very much fire from other candidates during the debate where as ramaswamy was really in the hot seat the entire time, and now they're both here trying to capitalize on that momentum, and very very different ways here, running around iowa, but very different styles from both candidates, katy. >> dasha, thank you very much. and joining me is usa today washington bureau chief susan page, welcome back, hope your vacation was nice. let me ask you about just this republican field and with donald trump dominating it in every which way, now dominating it but being a multi indicted candidate with a mug shot, how do you run against him, especially if the voters don't want to hear anything bad about him in the primary? >> the only candidate who's going to dislodge donald trump from the front runner is donald trump. if there's a health crisis or legal crisis than the ones he has faced already, maybe he could be replaced but the fact is since we started doing polling in primaries, no candidate with the kind of huge and consistent lead that donald trump has now has ever been denied the nomination. now, they may lose the general election, but donald trump's going to be very hard to not give this republican nomination. and that's why you see these candidates take these slightly divergent tactics, vivek ramaswamy is hugging trump every way he can. desantis is trying to criticize without saying his name. nikki haley criticized that was one of the more interesting things that happened that night. >> can i ask you a question at the top of the show, you're well positioned to answer it. how does the divide get better before it gets worse, i mean, is it possible when you have a mug shot like that that half of the country thinks is great because this is him doing, finally getting, facing the consequences he deserves to face, and the other half of the country, or a third of the country, at least, saying that this is the image of a fighter and a fighter that they want to regain the white house in 2024. how do you bridge that divide. >> so, katy, this is my 12th presidential campaign i've covered and it's the one that's the most driven, the most divided and the angriest of all the campaigns i have covered, but it is not the worst time that america has faced big divisions. i mean you, start with the civil war, which is pretty serious. 1968, the division over the vietnam war, a time of great stress on our nation, we have had the civil rights movement, the women's movement, we have had big changes in america that have put americans on different sides of a really fundamental debate. so while i find these attacks on our democracy really worrisome, especially the refusal by some to accept the results of an election, i think we have to remember we have strong institutions, and i talk to voters on other side, they love america, they want to protect america. they see very different threads to america. that's something that we need to figure out how to address. >> this is a test of our institutions and the strength of our institutions, one of them the criminal justice system and do you believe in the justice system, and the other one, are elections and do you believe in free and fair elections. so i'll ask you the other question i have, which is is the only way to settle it by settling it both in court and at the ballot box? >> yeah, i think the courts are important. i think these court cases we're seeing coming forward are an important way to hold to account people who tried to overthrow, not just donald trump, but others who tried to overthrow the results of the legitimate election. in the end, the american people were to decide, we're going to have a general election in a little more than a year, and that's going to, we hope, settle this debate. it won't settle the debate, but we want to have an election that people believe it enough that they are prepared to move on from this moment in which we find ourselves. >> susan page, good to see you, thanks for coming on with us. >> thanks. in what could be the next nationwide union strike, 90% of auto workers gave leaders authorization to strike, with negotiations fail. the contracts for nearly 146,000 workers are set to expire in three weeks time. their demands include a 46% wage increase. the return of pensions and a reduction in weekly work hours from 40 hours to 32. general motors, ford and city lantus all issued statements saying they are committed to reaching deals with the union without a strike. three weeks time before they might do it. coming up next, what the pentagon thinks happened to yevgeny prigozhin. plus, what maui county says hawaiian electric failed to do despite fire and wind warnings in the days ahead of the deadly wildfires. in the days ahead of the deadly wildfires. (vo) football season is here. get nfl sunday ticket from youtubetv on us. a $449 value. plus, get a free samsung galaxy z flip5. only on verizon. the kremlin is calling international speculation that vladimir putin was behind the plane crash that allegedly killed yevgeny prigozhin a quote, absolute lie. while prigozhin's death has yet to be confirmed, two u.s. officials tell nbc news that it appears to be an assassination. here's nbc news chief foreign correspondent richard engel. >> reporter: the u.s. believes russian mercenary leader yevgeny prigozhin was likely on this plane when it suspiciously crashed outside moscow on wednesday and that he is dead. british officials are calling it very likely. but what exactly brought down the plane is still a mystery. two u.s. officials said intelligence gathered so far points to sabotage, with one official saying a leading theory is that an explosive was placed on board, although they can't say with certainty. u.s. officials are convinced this was no accident. payback for prigozhin's mutiny two months ago when he dared to lead a column of mercenaries toward moscow and challenge russian president putin's grip on power. while many suspect he ordered the hit, putin said russian investigators still need time to learn all the facts. he offered his sincere condolences and described prigozhin as a talented businessman but who also made serious mistakes in his life. the pentagon says there's no indication the jet was hit by a surface-to-air missile, that the heat signature of a launch wasn't detected. russian aviation officials say they have recovered the remains of the ten people on board, some so disfigured, identification is difficult. >> whatever happened at 28,000 feet was catastrophic in nature, and it basically knocked the airplane out of the sky. >> reporter: this morning, new images were posted on russian social media showing the wing that was ripped from the plane in mid flight. reportedly found nearly two miles from the crash site. the kremlin has so far made no mention of prigozhin's mutiny. but the message seems clear without it. if you challenge putin, this is the price. >> joining us now, nbc news chief foreign affairs correspondent andrea mitchell. it's good to have you. when will the u.s. have a better idea of what could have possibly happened? will the u.s. ever have an idea more definitively than we currently have of what happened? >> such a good question. they will probably have an assessment at some point, but they may be reluctant to release it. for a lot of reasons. one thing is it could disclose sources and methods. they don't want the kremlin to know how good their intelligence is. there's a lot of reasons why the u.s. may not release its assessment, but as you always heard and as richard has been reporting, they think it was likely a bomb, not a surface-to-air missile. it was at 28,000 feet. they think there would have been a heat signature for it. and interestingly, lukashenko in belarus, where you know, very briefly prigozhin went, and went back to russia and was mostly, according to my sources, in st. petersburg, but interestingly at a meeting in moscow when he flew on this private plane. his private plane. so it's one he always used they knew exactly where it was going and had meetings in moscow, apparently with kremlin figures. he was relaxed enough to think it was all patched up. lukashenko said today, here's a great quote from the belarusian leader who had dealings with prigozhin when the rebullion was first put down, he went to minsk and belarus, he said, i know putin, he is prudent, very calm. even a slow person making decisions on other less complex issues. therefore, i cannot imagine that putin did it, that putin is to blame for this, and he goes on to say, it's too rough, too unprofessional a job for putin. so i don't know quite in what context that is. he's known to, have assassins kill openly, people fall out of windows. >> poisoning. by door handle at one point issue right?
