Donald trump turned himself in at the Fulton County jail last night to be booked and processed on charges he tried to overturn the results of the 2020 president ial election in georgia. Trump denies any wrongdoing. With us now to start off our coverage this hour, msnbc legal analyst lisa rubin, outside the Fulton County courthouse in atlanta. Nbc news correspondent Blayne Alexander Outside the Fulton County jail in atlanta. Dave aaronburg, state attorney for palm beach county, florida. Keisha lance bottoms, former mayor of atlanta, former director of the White House Office of public engagement. So, lisa, what more do we know about this hearing currently under way on the Harrison Floyd case . So, jose, we were expecting that hearing to take place right behind me at the Fulton County courthouse, but as of right now, it is unclear whether that hearing is taking place here or with a Magistrate Judge at the Fulton County jail where blayne is right now. And either event, one of the things that will undoubtedly come up is why Harrison Floyd is the only one of the 19 defendants who remains in custody. The Fulton County sheriff said he was unable to negotiate a bond for himself, but why is still a mystery. Is it because Harrison Floyd couldnt come up with the necessary funds to negotiate a bond order, or is it because there couldnt be an agreement on the conditions of his release . You might know that Harrison Floyd, in addition to this case, is also facing federal indictment or sorry, federal criminal client in Federal District court in maryland. Why . Because when the fbi went to go talk to him about the federal election interference case that jack smith is prosecuting, he had an altercation with an fbi agent that resulted in his arrest. So, i expect well learn more about why Harrison Floyd remains in custody, and, of course, the fact that somebody does remain in custody at all is interesting because we have seen these 18 codefendants of donald trump starting to have divergent interests from the former president who would like to delay his trial for as long as possible where some of his codefendants are cash poor and have incentives to start cooperating, jose. And, so, david, lets talk about that. In this case, floyd, it seems like that is indeed what happens in his case. But it is because he has a prior. Yeah, i think the reason why hes not been given bond automatically is because he has a prior case. Unlike the other defendants. He was charged back in may for attacking an fbi official who was trying to serve a subpoena on him to appear at jack smiths investigation. And he responded with violence. And so fani willis is not going to automatically give that person a bond until perhaps he sees a judge. Thats a difference between this defendant and all the others. So, the process normally would be that when one sees the judge, one is granted there is a presumption in favor of pretrial release, getting a bond. I think he will get a bond and be let out. There is sometimes you go to first appearances, ive done a number of them, and the defendant has an open case, then you hold them until the open case is resolved or the judge decides to let him out. But, yeah, he could be held for a couple of days or even longer, just depends on the judge. So, blayne, now that donald trump has been booked and processed, do we know when hes going to be arraigned . Reporter well, jose, thats unclear right now. We do know fani willis has requested that arraignment take place the week of september 5th, following the labor day holiday. The judge has yet to approve that request. But, you know, one of the bigger questions, though, jose, is what will arraignment look like and will he make an appearance for one. That goes for all of the 19 codefendants. So, we have been told a number of things. One, they could appear together, they could appear separately. We have been told that a virtual appearance is on the table. That this could be done by zoom, something the court started allowing during covid precautions and something that still stands today. So all of those options are still on the table right now. Now, i do want to point out, though, just the sheer magnitude of security that was necessary, the protocols taken for the former president to come down to atlanta to make the jail secure enough for him to go inside for about 20 minutes and surrender, that was a huge undertaking. Were talking about Sheriff Deputies from multiple jurisdictions, the secret service, weeks of meetings to make that happen. So, if there were to be an arraignment of the former president and he were to come in person, that would be yet another heavy lift, a very heavy lift. That kind of brings into question whether or not he would appear in person or would wave the arraignment or whether it would be done virtually if that is still on the table. And, blayne, what do we have any information on the one last person who was expected to hand himself in . Do we know anything about that . Stephen lee . Reporter stephen lee has less than an hour to make his way to the Fulton County jail and surrender. The sheriff says in a statement he believes he said it a couple of times, he believes all the defendants including stephen lee will comply with that new deadline. So, we are constantly refreshing the Booking Website to see if he pops in, to see if we get any more information, but if he is confirmed that he im hearing hes been turned in . Okay. We just confirmed he surrendered. You saw it there. He has complied. Hes now the final of the 19 codefendants to turn himself in. Just shy of an hour before that deadline. So, that means officially one chapter is closed here in Fulton County. We saw the indictment, we saw this string, this parade of surrenders and the final codefendant has surrendered and now we look forward to seeing what the Arraignment Process will look like and look back at the courts to see how the rest of this will play out, jose. And lets if we put that graphic back on, exactly who stephen lee is, hes facing three charges of conspireing to commit solicitation, false statements and writings, influencing witnesses, violating georgias rico act. Charged with an additional two counts of Criminal Intent to commit influencing witness. So, mayor bottoms, you were outside the Fulton County jail as this was all taking place last night, what were you doing there and what was it like . Well, i was there on site doing interviews and it was quite a circus last night. There were a lot of protesters, some of whom mistook me for fani willis when i pulled up and began to chant lock her up, there was a lot of angry energy as best i can describe it, Sheriff Labat and his entire team and a multigeneration coordination with Law Enforcement did a great job making sure that people had the right to protest, but it was orderly, but i would describe it as pretty angry. And i used to work as a Magistrate Judge inside the Fulton County jail, so everything that you see happening really is with exception of the speed that the people are being able to go in and out, that certainly is extraordinary. But what you see happening with the defendant Harrison Floyd is usually how the process works. You are booked into the jail, you have a first appearance hearing, usually the next day those are the calendars that i used to preside over. Given he has an open case in maryland, there may be some type of hold on him and then there would be a process to extradite him to maryland if that is the case. And then the plea and arraignment hearing. So, things have gone according to plan as blayne pointed out, Zoom Hearings for arraignments are customary now and they have been conducted that way since the pandemic. So, shannon, just hours before a surrender, donald trump hired a new attorney, to represent him in the Georgia Election case. What is the significance of trump hiring him . Well, steve saddo is a very well known criminal attorney here in atlanta, has a stellar reputation. You know, we dont know exactly where he let someone go, it could have been a clash of personalities, maybe he didnt like the strategy, but steve sadow is an attorney who is at the center of every big case in atlanta. Hes represented usher, hes represented ti, he was in the he was one of the lawyers in the ray lewis murder case, the nfl linebacker charged in a slaying in buckhead a few decades back. So hes just one of those people who is, you know, going to be right in the mix of things. He is known as somebody who isnt afraid to bring a case to trial, unlike some people who are rather going to plead something out or want to do things with legal papers rather than a courtroom. Youll see him take a pretty aggressive stance. Mayor bottoms, fani willis has faced criticism, even threats for investigating the case and filing charges. You know her well. Is politics involved in any of this . I dont think so. Fani and i worked together, fani is an Emory University grad, Howard University grad, fani has always been a very aggressive attorney. Even when we were very young attorneys at the kendall law firm. And i remind people all of the time, fani is truly a prosecutor. She is not just an administrator. She was one of the most senior ranking prosecutors under the former District Attorney, trying some of the most notorious cases in Fulton County. So she knows what she is doing. Shes taking cases before the grand jury, shes tried multidefendant cases. She is in the her office is in the midst of a big gang trial right now, ysl gang trial. It has been several months of jury selection. I think thats noteworthy for whenever this case may come to trial, that it is likely to take several months just to even seat a jury. But she knows what shes doing. And i know that sadow has a great reputation, but so does fani willis. She represented defendants before and shes worked as a prosecutor. So she also sat as a judge for a period of time. So she knows all sides of the law and she has been doing this for many years and the fact that she took this before a grand jury i think speaks to the strength of the case that she believes she has. David, a judge scheduled in October 23rd Trial for codefendant chesebro, a lawyer accused of orchestrating the fake elector scheme, fani willis proposed all the defendants go on trial the same day. Is that possible . Were talking about 19 defendants with their, you know, cocounsel. Is that possible . If you want to hold it in the basketball arena, perhaps. But in a courtroom, no. Not going to be able to put 19 people on trial in a complex rico case at the same time. So i think what fani willis is trying to do is get a bunch of those defendants to flip. And i think shell get there and get valuable information from some of them. Youre going to see chesebro or chesebro, however you pronounce it, hes going to be first. He wants a speedy trial. He thought cocatch fani willis unprepared, she wouldnt expect to go so quickly. Well, she called his bluff and theyre on for october 23rd. If he thinks shes going to be unprepared, well, shes been working on this case for two and a half years. And i think her prosecutors are going to be very prepared by the time this goes to trial in two months. His lawyers hadnt seen the indictment until we did two weeks ago. Be careful what you ask for. The separation would mean would be beneficial potentially for whom . Well chesebro. But what other impact would that or could that have . It will help the other defense. They get to watch a show run, a trial in advance of their trial, they get to see the evidence that is going to be likely used against them because this is a rico case. Shes growgoing to bring out evidence nationally and see trial strategy, the chesebro and everyone else will see fani willis trial strategy. This will be an advantage to the other 18. Theyre going to use chesebro, chesebro, as a guinea pig. The only person hurt by this will be chesebro himself because i think that he is going to feel the brunt of going first. Lisa, we know this is the fourth case against donald trump. Which is the case you think he should be most concerned about . I think the case that is still poses the most risk to him is jack smiths federal election interference case. And that may well be, jose, the first case that is tried. Thats where the special counsels office asked for a January Of 2024 trial date. You know, of course, that donald trump would like to try that case never and his lawyers propose april of 2026. On monday, judge chutkan of the federal court in d. C. Will hold a hearing at which hes shes expected to rule on when that trial date will be. And both because of the timing and the severity of the charges, and the fact that trump is the sole defendant in that case and is expected to remain the soul defendant, i think that case still poses the greatest risk to him. Even though the georgia charges are ones that he likely cannot wish away if he were to be elected president again. Within minutes of being released from the Fulton County jail, former president Donald Trumps mug shot was broadcast on social media, and televisions everywhere. And for the first time in more than two years, the former president returned to twitter, now rebranded as x, to post his mug shot above a link to his website where hes asking supporters for donations. Joining us with more is dasha burns in iowa and riina shaw, former republican strategist and Senior Adviser of republican women for congress. So, dasha, what more can you tell us about how the Trump Campaign is using this mug shot and how could it shape his president ial race . Reporter well, look, jose, theyre using it as a tool, putting it on merch, on tshirts, mugs, on all kinds of items. Theyre using it to raise money. Why, you might ask, would they do such a thing . Well, im in iowa, you said it, and our nbc news des moines Registrar Mediacom Poll shows among gop likely iowa caucusgoers, 65 of them when asked if trump has committed a serious crime, they say no. Now, does that mean that trump has iowa in the bag . Not necessarily. He, of course, has a wide lead here, but that poll also did show that there is some softness in his lead, meaning there are voters that are very much undecided and still looking at potential other candidates, but this indictment issue, this is not going to be the issue that is going to move the needle for voters. And, in fact, it is the issue that we have seen time and time again, spikes his poll numbers, spikes his donation numbers. The fourth indictment, a little less so, we have seen with each one that people are less and less interested. But nevertheless this is not the thing that gets voters to say, no, no, no, im not going to look at this, this is too much. The people that are not necessarily trump fans may be, but for the base, this is not really moving the needle, jose. We read the indictments and legal battles have actually acted as fuel to trump politically. Does that fuel ever run out . I believe the fuel is now running out and particularly with women. With republican women. When you see a mug shot like that, you see criminal action right there in front of your eyes, and thats hard to look away from and hard to really stand up for and frankly to just defend. Republican women understand that it is now time, the walls have closed in with this fourth indictment, this president is now not only just under serious scrutiny, under the cases of the law, he could very well be disqualified. What they saw on stage the other night were very faint arguments that led them to understanding what is at stake. Either the republicans get their act together and elect somebody new or they continue to stand behind somebody that has a very long road ahead and doesnt deserve defending anymore. I think this is the point which republican women decide to make their break and look at somebody new, whoever that may be in the field of eight that we saw the other night. What, rina, is making you come to that conclusion when we see how in the past these other indictments and all the issues hes been dealing with has actually benefited him . What are you basing that thought on . The fact that he had to pay a 200,000 bail, the fact he actually got a mug shot this time, and that there are 18 others who are taking the heat with him, slowly turning themselves in. This is just Something Like a slow train wreck. You cant look away. And at some point you cant keep saying that this is all part of the democratic ploy, the democrats have this big master plan to bury trump so he cant win the white house back. I look at this this way because nikki haley gave us a master class in how to move forward from a president rife with problems. She main checked this former president saying he added 8 trillion to the debt. Republican women, take that kind of messaging, they internalize that and move forward in a calm and reasonable and practicaled measured responses, like nikki haley did the other night. And, dasha, youre there, in iowa. Have any of the other candidates reacted to this . What is their position . Reporter well, look, if those voters that rina is talking about are out there and considering other candidates, these contenders are out here trying to win them over. The two gentlemen that Split Center Stage at the debate are now splitting the caucus state trying to get folks on their side and trying to capitalize on the momentum from their debate performance. The newcomer to the political world, Vivek Ramaswamy and Florida Governor ron desantis are in the Hawkeye State today campaigning. They both had what objectively is some of the polling is showing good performances. Washington post ipsos poll shows the two came out on top and they are here trying to take advantage of that right now. And they couldnt have more different stories coming into this race. Vivek ramaswamy, very little name i. D. , a lot of people dont know how to pronounce his name. Florida Governor Ron Desantis coming in with a lot of name i. D. But his campaign had some struggles, but now looking to really seize on what some voters saw as a Strong Performance at that debate and ramaswamy getting fiery, which some people thought was a little bit polarizing, but others thought it was great. Now they are here, and theyre really looking to gain some traction, but, of course, with the shadow of the former president looming over all of it. That debate did show what a potential post trump political universe could look like. And if rina is right, they could potentially have a moment to shine here. Maui county released a list, 388 people still missing. 17 days after catastrophic wildfires ripped through hawaii. Officials say that more than 1700 people originally unaccounted for have been found safe. Now hawaii is facing another problem in the aftermath of the destruction. Other parts of the island are struggling to attract tourists. And keep the industry afloat. And i say just, that number is still horrific and it still speaks to the tragic situation here in maui, that 17 days later, 400 people still missing. Lets talk about the list. It now has a list of names that anybody can see, which is, of course, will be heart breaking for some families but helps with accountability, helps with paring that list down even further. The reason why the list is cooked down to a manageable fashion is because the lists came from all these different separate agencies, they were incomplete, they were missing last names, they were missing ages, they were missing genders. And so now we are where we are. I should say that list is still a tragic site, more than two weeks after this fire. On your point about tourism, yeah, that was always one of the biggest worries in the immediate aftermath. With officials telling people to sort of stay away. What they meant was stay away from the immediate area because they needed those hotel rooms to house people who were unhoused. So the rest of maui is a very difficult place to spend your vacation. East maui is totally fine. There is no fact there was a fire on that part of the island. Maui is, you know, it is a small landmass, but it is still relatively large when you talk about this catastrophic fire event. Donald trump, former president , and current president ial candidate, was booked and processed last night in the jail in atlanta. Joining us now is nbcs gabe gutierrez, at the Fulton County jail. Good morning. You spoke with the local bondsman who posted trumps bail . Reporter yeah, thats right, jose. Charles shaw, a well known Bail Bondsman here in the atlanta area, hes had several high profile clients including rapper gucci mane and ti. He was the one contacted by trumps legal team to help post his 200,000 bond. I spoke with mr. Shaw late last night at his office, in Suburban Atlanta and he said that through his attorney, mr. Trump posted 10 of that bond. Take a listen to what some of mr. Shaw told me last night. It was a historical experience, one i never experienced before and one i never will again in my life. Very serious experience. A experience we had to get it done right. And i think we did. And i just think it was just something that was quite extraordinary. I think this is probably the most secured bond ive ever executed in my entire career. Reporter certainly unlike a bond that hes ever experienced in his more than 23year career as a Bail Bondsman here. He also worked on posting bond for several other of mr. Trumps codefendants, including mark meadows. He actually escorted mark meadows into the Fulton County jail behind me yesterday, when mr. Meadows posted a 100,000 bond. As for his experience with former President Trump, he was inside the jail when the former president came in here, was processed, fingerprinted and, of course, took that famous mug shot, but he was kept in a separate room, jose, because of security concerns. Still, he told me that it was just surreal. Jose . Gabe gutierrez, thank you so very much. Monday is already shaping up to be a pretty critical day for these high profile cases centered around trumps efforts to overturn the 2020 election results. In Fulton County, a monday hearing will center on former white house Chief Of Staff mark meadows effort to get his case moved to federal court. And on the same day, judge Tanya Chutkan is expected to set a trial date in the federal elections case. Joining us now with more is msnbc legal analyst lisa rubin in atlanta, and gwenn keys fleming, former District Attorney in dekalb county, which neighbors Fulton County, the coauthor of the Brookings Institution report Fulton County georgias trump investigation. So, lisa, i want to start with Harrison Floyd who had his hearing this morning. What do we know happened . We dont even know if that hearing did happen. Heres why. Our field producer inside spoke with Fulton County Superior Court judge scott mcafee who said that Harrison Floyd remains at the jail today because he hasnt posted bond, that hes entitled to a hearing within 72 hours, but it is not going to be today in all likelihood and not going on right now. Thats as much as we know, thats reportable at this time, jose. His hearing has not yet taken place and is not expected to take place at the Fulton County courthouse today. Turning now to the mark meadows, seeking to have his case moved to federal court with Secretary Of State raffensperger now called to testify. What can we expect there . You know, that hearing on monday is going to be before a federal judge here in Fulton County as well. But it is an evidentiary hearing which i would describe to our viewers as, like, a mini trial with evidence being presented in the form of documents and as you note testimony. And in addition to Brad Raffensperger being called as a witness, i would like to the testimony of Frances Watson as being particularly important. Miss watson is the Georgia Bureau of investigations investigator that trump called on december 23rd. And so, gwen, how strong do you think is meadows argument to get this case moved . I think judge jones will ultimately make that decision. But some of the arguments that you saw in the d. A. s reply brief are salient. In particular, elections are squarely within the state purview. They do not fall within the roles and responsibilities of a president of a federal of that president s Chief Of Staff, and largely not part of any federal officers responsibilities. In fact, there are specific laws and rules that prevent federal employees from engaging or using their federal office in any way to support a campaign. And so i think those laws may present some challenges for the meadows team. But obviously it comes down to the evidence that they choose to present. It is also important to note that mr. Meadows let me back up. It is important to note while the d. A. Bears the burden of proof for the charges, and she must prove the charges beyond a reasonable doubt in state court, for the purposes of this federal court hearing, the burden shifts to mr. Meadows and he only has to meet the preponderance of evidence standard, a much lower standard. But he will have to go first and present evidence that the d. A. Will then be able to counter with the witnesses that you described. So, gwen, being a lower standard to prove, what kinds of issues do you think would be successful on that lower standard . On that lower standard, one of the things that were waiting to see is what evidence, what documents, what witnesses he may be able to present. Obviously all of us who were sworn federal officers or appointees, we signed documentation and took an oath, i dont think there is a question he was in fact a federal employee. The question becomes whether the actions that are alleged in the indictment were part of or under color of his federal role. So that will take, i would imagine, some type of testimony, either from other witnesses, or possibly from mr. Meadows himself. Obviously as a defendant he has the right to remain silent. But he has also the opportunity to wave that right. And so were waiting to see what the strategy will be from his defense team. But certainly if he takes the stand, i would presume the d. A. s office would get the opportunity to crossexamine him, just like any other witness. And that would include or may present some risks later on down the road. This morning the kremlin denies it had anything to do with the plane crash presumed to have killed wagner chief yevgeny prigozhin, who Led A Failed Rebellion against russian leader Vladimir Putin two months ago. In putins first public acknowledgement of the crash, he said prigozhin was a man with a, quote, Complicated Faith who has made many serious mistakes in his life. Meanwhile, the pentagon says the defense departments initial assessment of the incident is that prigozhin was likely killed. Joining us now nbcs chief Foreign Correspondent Richard Engel who covered the wagner group extensively. Pleasure to see you. What else are u. S. Officials saying about this . Reporter so, there is a lot of narratives being built right now. So we have this denial, official denial from the kremlin, from putins spokesman saying, no, we didnt do it, these allegations are just speculation in the west, and that theyre pure lies. And thats something we would expect. What are they going to come out and say, we did it . The u. S. Is saying it is still looking at this matter, did not see any evidence of a surface to air missile, that it was not anything fired from the ground that they would have seen a Heat Signature because the plane was flying at around 28,000 feet, so it would have taken a fairly large heatseeking missile to hit the aircraft and they didnt see anything like that. So their leading theory, u. S. Intelligence leading theory, because theyre still gathering information on this, is that some sort of Explosive Device was put on the plane at some stage. So, if thats the working theory, the question rings who put the bomb on the plane . And there is some interesting comments that have just come out from belarus. The president of belarus, alexander lukashenko, hes very close to Vladimir Putin, belarus was a country that had offered to host yevgeny prigozhin, give him safe harbor, allow him to operate from there, lukashenko just said a very short while ago that he had warned prigozhin that there could be an Assassination Attempt on him, attempt on his life, going back to january, before the mutiny. So it seems like, if you kind of read Between The Lines here, read the tea leaves, which is what were trying to do, that the russians, the kremlin is denying it. And now belarus is suggesting that maybe there were other people that wanted to assassinate prigozhin with longstanding plots going back all the way to january before the mutiny. That would suggest that it wasnt the narrative that we all have been talking about a few for the last couple of days now, that Prigozhin Rose up against putin, that putin waited two months in order to assess the situation, get his ducks in in out this alleged assassination plot. A lot of, i think, Narrative Building is going on right now. While the russians say they are continuing to investigate the site, and they say they recovered ten bodies. But i think u. S. Thank you for being with us. A former president s Mug Shot Spread throughout the world. What do you see as the impact of that image . I think theres two impacts. One domestically, its really important. Its a demonstration that no matter who someone is, ultimately, they do have to be held accountable under the rule of law if we are going to maintain our democracy. Internationally, i think its especially important for us to demonstrate to our allies, our fellow democracies, that we mean it when we say that we are a nation that is built on rule of law. We are not a nation of men or of dictators. We are serious when we proclaim to be a democratic ally. You know this better than anybody else. There are other countries that have prosecuted their current or former president s, france, south korea, el salvador, honduras, brazil. How did those outcomes inform what could happen here, do you think . Those examples, i think, are particularly illustrative of if you are going to maintain a democracy, we are certainly we are exceptional in that we havent had a former president act in this way before. It was inevitable at some point that someone was going to try to test the bounds of democracy. Thats the way men, unfortunately i mean man, the race of man is. If theres a power and limitations, people are going to try to test it. Those other examples are really important, because we know that the best indicator of a future coup is a failed coup. A practice coup. The best way to prevent that, of course, is to crack down and ensure the people are held responsible who have attempted to overthrow an election or overthrow democratic institutions. The former president and many people in his Political Party have been insisting that this is a politically motivated act. Im wondering, one of the key pillars of any democracy is its rule of law. Is this being chiselled away by either what happened or what the former president says happened . The former president and his coconspirators that were indicted under the Fulton County indictment certainly attempted to chip away at the rule of law. Democracies require elections and Peaceful Elections are the bedrock of our republic. By trying to destroy that, by trying to throw out votes, by trying to change the outcome, they were trying to tear down that really important scaffolding that creates our republic. Its really important to remember that the juries that have indicted trump in new york and d. C. And georgia and florida, they are a jury of his peers. They are not selected by president biden. They were not selected by the department of justice. If anything, if we were to allow former President Trump to attempt to overthrow an election and not be held accountable, that would be destroying the rule of law.
