police now identifying the man they say was yelling about a pride flag outside a business, tore it down and killed the store owner. plus smoke billowing across the pacific northwest as wildfires rage in washington state with more than 100 buildings destroyed. and new data on the challenge of fulfilling what is for many the american dream. owning their own home. our nbc news reporters are following all of the latest developments and we start in atlanta where ali vitali has been watching the action at the fulton county jail. you just caught up with one of trump's co-defendants, john eastman give us the latest. >> reporter: this as eastman was coming out of the jail after surrendering ahead of the friday deadline that fani willis laid out for all defendants here. trump said he won't turn himself in until thursday but we can tell there's progress being made in terms of seeing the co-defendants set consent orders which sets the bond amounts they have to pay once they surrender and that's the first procedural step to having them come into the fulton county jail behind me. but for eastman, someone at the center of the fake elector scheme who we talked about a lot in the january 6th investigations and now the doj's probe into the aftermath of the 2020 election and now the fulton county probe into the aftermath of the 2020 election, i asked eastman about that election, the thing that landed him here in the first place. and he's doubling down. watch. >> do you still think the election was stolen? absolutely still? >> no question. no question. >> you won't answer on immunity from prosecution? >> won't answer. >> do you think the others in this case have a standing on that? people like meadows? >> no comment. >> did they do a mug shot and everything inside? >> no comment. >> thank you, sir. >> reporter: a few important things for us to check through, chris. of course we know that regardless of the fact that eastman believes the 2020 election was stolen we know it wasn't. that's not the construction of all of this. it's underscored when you see things like the latest poll out of iowa that shows that a majority of iowa and independents believe that trump won the election and trust him above people like their pastors, friends, family members. it shows the way the lie has infiltrated the grass root parts of this movement. the other thing that struck me from my conversation with eastman, even as his lawyer was trying to steer him away he wanted to field questions from me and several other reports gathering here. it was telling to see what he said no comment to versus what he engaged with. he told he was paying for his legal fees, hasn't spoken to his former president but didn't regret the work he did for his former client but mum when asked if he would seek prosecutorial immunity and when asked if he was fingerprinted and had a mug shot. but his lawyer said it was the same as anyone when they turned themselves in, so we can assume there was mug shots and fingerprinting for eastman. >> thank you my friend, great job there. fantastic stuff. we want to go to a deadly shooting of a california clothing store owner allegedly over a pride flag. maggie vespa has the latest on that for us. what are authorities saying now? >> reporter: they're saying they're still investigating this as a hate crime. i say that despite the fact that 27-year-old travis ikaguchi is dead, he was killed an hour after the shooting less than a mile from the shooting. they say he is the guy who showed up to that store, lori carlton's store, tore down a pride flag that was hanging out front while yelling anti-lgbtq slurs. they say when carlton walked out to confront him and tell him to stop doing that, that's when they say he shot her. this comes amid an alarming rise on attacks on the lgbtq community and as experts point out now apparently its allies. take a listen. >> our community has seen a lot of violence and now that is out -- now that's stretching out to the allies in our community. so it's -- that part is definitely shocking. a symbol like a flag that is for us supposed to be love and acceptance has been weaponized and turned into something that now someone loses their life over. it's horrible. >> reporter: horrible is one way to describe it. a lot of people sort of sending out their condolences, including celebrities who worked with carlton, new her brand her store, including jamie lee curtis. her own daughter, one of nine children she and her husband shared saying make no mistake this is absolutely a hate crime. you can see the memorial growing around that store. she has one in lake arrowhead and one on the studio city lot in hollywood. covered in those rainbow colored flags. >> maggie vespa, thank you for that. now to the northwest and the fight against wildfires. jesse kirsch has the latest from washington state. jesse? >> here outside spokane, washington what you're seeing and hearing is good news. the rain is going to help firefighters as they continue to battle the wildfires in this region. you can see the aftermath behind me here. it's not just aftermath because there is still smoke emanating from the ground. make no mistake, even with this rainfall, firefighters are still working an active wildfire. but what this does is it's going to help them, we're told. allow them to be more aggressive, go on offense, if you will, against the wildfire. we're looking at around 25% containment at last word of the gray fire where we are right now. that's good news for people who had been told to evacuate their homes in recent hours. roughly 4,000 people have been told they can return to their homes. there are still roughly a thousand people in medical lake and that community, city, surrounding area alone of people -- there are roughly 1,000 who still are being told to stay out. they've been ordered to evacuate, they have not been told they can go home and again because we're still dealing with an active wildfire. so that's what's going on here outside of spokane. this is a series of wildfires. what we're looking at now is relief from the sky, something that will hopefully allow firefighters to continue making progress here. back to you. >> thank you for that. new numbers are out today showing once again it's a tough time to buy or sell a home. cnbc's leslie picker joins me now for cnbc on msnbc. walk us through the new data and what it means for people in the housing market right now. >> so chris, a 23-year high in mortgage rates is essentially causing people to stay put in their homes and that means sales of previously owned homes are dipping more than 2% in july compared with june and 17% year over year, that's compared to july of last year. all of that data is, according to the national association of realtors. and chris, this means that the pace of homes sold was at its lowest since 2010. 13 years ago, that was in the aftermath of the financial crisis. now all -- not all regions are trending in the same direction. sales dropped the most in the northeast, down about 6%. but they actually rose in the west, up nearly 3%. but the overarching problem is that no one is putting their home on the market because they don't want to forego the lower mortgage rates they've been enjoying for several decades now in lieu of the current 7 plus percent rates that are currently out there. that means there are now half as many homes for sale as there were precovid. and short supply means prices continue to move higher. the median price of a home sold in july was a whopping $407,000. up 2% from last year, chris. >> leslie picker, thank you for that. the special counsel is pushing back. why jack smith's team is saying no way to bumping former president trump's trial to 2026. the pointed response to trump's legal team in their latest filing. we're back in 60 seconds. ck in s (christina) with verizon business unlimited, i get 5g, truly unlimited data, and unlimited hotspot data. so, no matter what, i'm running this kitchen. (vo) make the switch. it's your business. it's your verizon. come monday the judge will have a huge decision to make, whether to start donald trump's d.c. conspiracy trial before or after the election. trump's attorneys say anything before april 2026 would be unfair to their client. but now, special counsel jack smith is arguing that kind of delay would be unfair to the country itself. denying the public its right to a speedy trial. he also argues, yesterday, that trump's lawyers are exaggerating the challenges posed by the case including the claim they need to review 100,000 pages a day to meet the government's proposed trial date of next january. ryan riley is following this case from d.c. tia mitchell and katherine christian, an msnbc legal analyst. good to see all of you. ryan what can you tell us about the doj's argument to the judge? >> so jack smith's office is arguing that trump's team needs to catch up with 21st century discovery practices here, trr documents that need a close review, the witness testimony that you see in this case, not every document is going to need to be p manually reviewed by a lawyer and the search capabilities that you have in a case like this involving massive discovery is something they should and can take advantage of. in cases like this, reviewing discovery cannot be measured by page count alone in comparisons to the height of the washington monument and the length of a tolstoy novel is nothing comparable. in fact, it's distracting from the issues at hand, determining what's necessary to prepare for trial. instead it should be measured by its relevance, organization, access nlt lt accessibility and reviewability. >> this is what they're arguing, right, that it's going to -- if you put the paper on top of each other, it would stretch nearly 5,000 feet into the sky. is there something to that argument? >> they say it would be like reading "war and peace" 78 times a day. no. because what the special counsel has said 65% of the documents that they -- remember this is electronic they weren't delivered boxes of paper. 65% of those documents that they have received, they already have, have access to, they knew about. it's the january 6th house of representatives committee hearing, it's tweets, it's social media posts, it's things in the national archives. so the defense has access to it or has it already. and the special counsel said they delivered it electronically in an organized way to make it easy to search the information. so reading "war and peace" 78 times that's beyond an exaggeration. >> when judge cannon set the date she split the difference between the two sides. if the judge does that here it would be after the election. how does the judge do it? it's not always splitting the difference. >> if the defense gave a reasonable date, there would have been a split difference. that date of 2026 was not a reasonable proposal and the court pushed that aside. really you lose creditability of the court when you give a date like that. and january 2024 it could be argued that's not a fair date to say that five months after the defendant is arraigned on a case like this he should be ready for trial. i don't like to predict, but she'll probably do a may or june date. and all of the judges can -- it's not unusual or unethical for judges to coordinate trial dates and that can happen in this case. >> they're going to need to, actually. tia, let's shift to georgia where donald trump has agreed to a bond that bars him from intimidating or threatening any witnesses or co-defendants i know that's something that fani willis has been concerned about. is her office convinced these rules are enough to stop him? >> i don't think her office is trying to predict what the former president will or won't do. people like us are, and i think a lot of us are wondering how is former president trump going to -- if he continues what he does normally, which is criticize his appointments, his perceived appointments, he's likely to violate the terms of his bond agreement. but i think fani willis will say she's not predicting what president trump will do. she's trying to lay out terms that she thinks will best benefit the trial. best protect the integrity of this case and keep people safe. now whether he abides by it or not is up to him. >> so just yesterday, okay, so this really gets made. yesterday he called fani willis crooked and incompetent, highly partisan said she should be impeached. he has accused black prosecutors of being racist. he's attacked judges, gone after their families. so where is the line? it if this kind of thing does not break the agreement could it be construed as witness or jury tampering? >> it's not what the defense will argue p. he didn't talk about a witness, a co-defendant and he did not talk about a victim. and that's true. what's going to to have to happen is the judge, the fulton county judge will have to make it clear that statements that could taint the jury pool and clearly calling the da in the county these horrible things could taint the jury pool are also included. so, you know, the defense wants to make it, oh, he didn't say x, y, and z, so the judge and probably the prosecutor are going to ask for clarity. you don't want the da to say he can't say bad things about me. he can say he's being persecuted. but when you say vicious things about the prosecutor and the judge, that's tainting the jury pool. >> there's also planning to use a state commission to go after fani willis later this year? [ cheers ] running up and down that field looks tough. it's a pitch. get way more into what you're into when you stream on the xfinity 10g network. top democrats are putting together a kind of wish list of what they think will help their party when the republicans debate tomorrow night. for example i'm managing a royal rumble on the debate stage where they're talking about each other's mamas and all kinds of craziness. >> or please continue to double down on a six-week abortion ban. and i'd like to see a huge defense of president trump and a full on assault of reproductive freedom and abortion. david is a former campaign manager to jeb bush. we've been talking a lot about the debate's impact on the republicans in the primaries but how aggressive is the democratic rapid response team going to be and are they largely at this stage of the game reinforcing things with people who have their minds made up already? >> i think when you're democrats -- the three that you showed before, what they have in their minds is independent voters, right. so moderate republicans, not to be persuaded to vote for biden or just out and out independent voters and what are they seeing on the stage. i agree, governor murphy had the right temperature there about a defense of trump, which david could tell you, defense of trump -- excuse me, critique of trump coming from a republican hits differently and has credibility with independent voters more so than a critique of trump from a democrat. and abortion, to have those candidates on the record about where they exactly are on an abortion ban. governor desantis signed a six week abortion ban, he doesn't like to talk about that. so i think if you have -- it's not as if it's going to change the race overnight for democrats to have a good critique of trump out there from republicans or discussion of a six week abortion ban but it will be on the record, it will -- it's something you can come back to -- can come back to later defining what the general election is going to be like. what the republicans are like. how precarious is it for republicans on abortion? a poll released last month showed nearly three quarters of americans think abortion should be legal until at least six weeks and that includes 56% of republicans. so is that one of the trickiest issues they have to address? is it trump, do you go after him? what are the pitfalls for everybody on that debate stage? >> abortion southern district a tricky issue. you -- >> abortion is a tricky issue you're right about that. i doubt this debate will be about abortion at all. it will be about trump. governor murphy will get about half of what he wants out of the debate i think. there are two figures to watch, you have trump looming over all of it he won't be on the stage. but ron desantis has a lot to gain and maybe some to lose from the debate. he'll be the center of attention for most of the candidates who want to contrast with him. and then you have chris christie, i know viewers want to watch him come off the top rope on donald trump and start a fight. that's the effect of having the other candidates on the stage fighting with chris christie, which works out well for chris christie. number one, i don't think you want to go with chris christie, marco rubio learned that eight years ago. but more than that what you're looking for in the dy baits is air time. if christie is the only one willing to take it out on donald trump on the january 6th stuff and the indictments, chris christie is going to take up air time fighting against the other seven candidates. that's what i'm interested in watching. >> i think's interesting you have a chris christie, for whom these attacks on trumps and they are pointed and clever and they get a lot of attention, have not worked with the voters who are going to be going to the polls for the primary but they could potentially really, as david points out, hurt anybody else on that stage, who tries to go toe-to-toe with him. >> yeah, the -- i mean, he's jersey. i have a jersey husband, like i get -- >> you know jersey. >> i know jersey. i know chris christie is great in a fight. it's true what david said. i guess that -- i think what will happen is chris christie -- donald trump is not going to self-implode, self-combust. somebody needs to take him out. i think the other republicans on the stage are thinking, let chris christie make that argument and let me benefit from it but i am not going to be the person that attacks trump. and instead, they may want to try to defend -- to defend trump because that's -- they seem to think that's in their interest. but even though they're running against him, but everyone seems to be the one that doesn't want to do the murder-suicide. they don't want to take trump out. they want to benefit from it. so i think a lot of them will leave christie to do that. but it's very dangerous to get into a -- you know, a back and forth with christie when you do not have fact osyour side and if you are trying to defend donald trump you are not going to have facts on your side. >> david, in an interview on fox last night, ron desantis addressed the fact that trump will not be on the debate stage. here's what he said. >> he has a great opportunity to come out and do this. i think he owes it to people. i don't think our voters, even people that appreciate what he did, i'm actually one that appreciated a lot of what he did, too. i don't think they're going to look kindly on someone who don't think they have to earn it. >> it's a noncriticism, criticism. what do you expect to hear if anything about trump not being there. if they do talk about it, is what we heard right there from ron desantis getting him anywhere? >> well, that -- i sat in a lot of iowa focus groups, posing thee questions, trying to figure out how to go at trump and he kind of threaded the needle right there for what you need to do as a republican. look how it's worked out for chris christie, a 60% unfavorable among iowa caucus goers. that's not a path to nomination. you have to say i like trump, but he doesn't respect the voters because he's not going to debate. he's too distracted, he lost three elections in a row, i'm a winner. those are the messages that work but you have to slide into the trump criticism a a little bit more -- you just got to be more cautious when you do it. people are receptive to these messages. but once you go at him like jen maybe would. you know, the voters -- republican voters will put on the jersey and helmet and go to battle with you. this is the way to do it. that's an effective method we'll see how it works tomorrow night. he does have a lot at stake tomorrow night given the troubles of the campaign over the last couple of months but that also provides an opportunity for him to right the ship. >> as both of you know well it's one thing to have a right message, it's another thing to deliver it. we'll see who can pull that double off. david, jen, thank you both so much. republicans investing heavily in minority voters in wyoming but as candidates head to the debate, the question is can they win those voters away from democrats. what they're saying next. with verizon business unlimited, i get 5g, truly unlimited data, and unlimited hotspot data. so, no matter what, i'm running this kitchen. (vo) make the switch. it's your business. it's your verizon. when the presidential candidates take the debate stage in just a little more than 24 hours they'll make their case in milwaukee, a city with a 40% black population and in a gop primary unlike any we've seen. this race for the white house is the most diverse presidential field in modern history for that party. shaquille bruster is live in wisconsin. republicans are investing more time and money they want to turn out the minority voters what are you hearing from people, is it working at all? >> reporter: republicans say it is still early to get a real sense of the sense of their efforts but they say they're going to keep trying. that's why they're having the first presidential debate here in milwaukee. why they chose milwaukee as the city to host their national convex. convention. we wanted to look at those efforts and see the success they've had. deep within this neighborhood is an attempt to engage minority voters. when you pass the office what are you thinking? >> curious. >> girard randall helps run the space that originally hoped in 2020. >> this whole strip has become known as the black arts strip. >> reporter: he says it's been a hub for republican recruitment, organizing and engagement, including at the city's juneteenth celebration this year. this place, in terms of a fixed location is generally where people can come to get more information about the party and its platform. >> reporter: and serves as a stop for gop candidates. >> we are going to be on the near north side of milwaukee. i care about everybody in the state of wisconsin. >> reporter: the concept expanding in 2021 when the national chairwoman opened a separate chapter in a largely hispanic neighborhood. >> as a party we have to show up in communities that have been democrat. >> reporter: while that space is closed this one remains active, though its influence unclear. last november top republicans earned about 18 of 370 votes cast in this ward. the same one that houses this republican office. >> it's a battle for every vote in every neighborhood. >> reporter: how do you make that sell when in this ward you have less than 5% and the most recent -- >> you just keep plugging away. you don't get discouraged by the fact that, you know, it's 5% today. it might be 10% in the next election. >> reporter: 2020 exit polls showed just 8% of wisconsin's black voters blacked donald trump. randall said the target for state republicans has been 30%. >> i get on the bus here every day. so i don't see nobody come in or out of it. >> reporter: democrats say they welcome thele challenge. >> you can put as many offices as you like here. but our voters, our residents understand who has their back and who continues to deliver. >> reporter: as republicans here insist this is a long term strategy. >> we can't extend the reach of the party unless we make a case to those voters that we'll need now and in the future. >> reporter: is another way of saying that the republican party will need black voters? >> we always have. >> reporter: and there are some warning signs for democrats here in milwaukee as well. while they've been able to maintain and expand their margins here in milwaukee. there has been a drop off in voter turn out. we saw it in the midterm elections we saw it in 2022 compared to 2018. part of why the biden campaign announced the new ad targeted for this media area and the reason you see top dnc and campaign officials here in milwaukee for the republican debate. there's a constant need to engage folks here in this crucial battleground state. >> fascinating stuff. shaquille brewster thank you. shachar row richardson is now the fastest woman in the world. she ran the sprint in 10.5 seconds. this was a stunning upset. a personal best for her, by the way. the win over the defending world champion from the outside lane marking a major comeback. she had been poised to compete in the olympics in tokyo but was suspended after testing for marijuana. she said after the race i'm not back, i'm better and i'll continue to be better. how much better can you get than the speed of light, practically. feeling the effects of coronavirus years after infection you are not alone. what we're learning about long covid symptoms and what, if anything, you can do about them next. ything, you can do about t next d, i get 5g, truly unlimited data, and unlimited hotspot data. so, no matter what, i'm running this kitchen. >> chris, that's right. our understanding of long covid isn't terribly advanced from this time four years ago. we still don't know the extent of long covid, how to define it what diagnostic criteria. we really don't know how to treat it as still three years into this -- or living with covid-19. but what did the study show? it looked at about 140,000 veterans getting care within the va system across the country that had covid. anywhere from mild covid all the way to severe and compared it against a group of veterans that never had covid-19. what did it find? it found some of them definitely had -- even if they had mild symptoms prolonged disability, even brain fog. but some of them had, whether they had higher or lower insfekss up front, they had a higher risk of developing blood clots. these are not symptoms we correlate with long covid so there's a cardiovascular risk that has increased, even with mild covid-19 it was a surprise. >> folks who have long covid and they know who they are, and it's a struggle. part of the struggle is they're fine for a while and something comes on long exhaustion. we know what some of those symptoms are laid out in the study. what do they do at this point? >> well, here's what we know. here's the encouraging news. early data, this is early not fda regulated in any way or approved, but early data does suggest the antivirals that you and i talked about for acute infection to keep someone out of the icu, it does appear they might be effective in long covid symptoms reduing the risk of diabetes. so the treatments we have, vaccines to prevent, vaccines to treat long covid or antivirals might be effective towards long covid, unfortunately a long trial has yet to produce results that are actionable so we can get the treatment in the hands of we can get treatments in the hands of folks that need them. but it does appear to be promising that the treatment for acute covid might be the key to solve the problem of long covid. >> when we talk about as we have about returning covid cases, i've seen it, i'm sure you've seen it much more than i have, is it an argument for folks who are thinking, well, what should i do in mid september when this other vaccine, booster vaccine, is that the right term, becomes available that people need to get it or put this study in perspective with ongoing treatments for covid and prevention of covid? >> reporter: yeah, we have been covering this heartstopping story all day and we can now report there has been a happy ending in the last hour, the prime minister of pakistan has announced that all those kids and their teacher have been safely rescued. but i can tell you a couple hours ago this was not a sure thing at all. this started at 7:00 a.m. local time, so nearly 20 hours ago, these kids were on their way to school in a remote part of pakistan and that involves taking this kind of rickety cable car over this mile wide valley. there were some 900 feet in the air when the overhead cable snapped and that car almost literally hanging by a thread. the pakistani military scrambled helicopters that were over the car, they tried to lower commandos down and they were able to rescue at least one of those kids that way. but they were really concerned that the wash, the turbulence from the helicopter's row ter blades were causing it to shake and could fall. but the rescue operation continued in darkness. rescue teams and locals improvising this kind of low tech pulley system and hand by patient hand from the side of the valley, they were able to bring the remaining kids and their teacher back to the side. we just spoke to a local official in the area who confirms those kids have now been reunited with their families. and he was praising the rescue teams for deciding to continue this mission in the darkness to save those parents the anxiety of knowing their kids were hanging there into the night. >> unbelievable story. raf sanchez, thanks for bringing it to us. that will do it for us. our coverage continues with katy tur reports right now. good to be with you. three lawyers and three different straenlgs. john eastman has been prosecuted but yet eastman trying to convince mike pence he had the authority to stop counting electoral votes is still claiming that he believes the election was stolen. saying absolutely, no question. that is what he told ali vitali outside of the rice street jail just a few minutes after he he was booked on nine c
