so how do they do it? and the disturbing rising close calls involving planes. a new report revealing that last month there were happening at a rate of more than one every day. one while a flight to dallas was traveling at 500 miles an hour and another, two planes came so close the incident was described as "skin to skin." but we begin in atlanta were at this hour of the long parade of defendant involved in what d.a. fani willis -- donald trump's criminal enterprise have begun turning themselves into authorities. the biggest name so far is transformer attorney john eastman who surrendered midmorning after releasing a statement criticizing the indictment as a crossing of the rubicon for our country and expressing confidence he will be fully vindicated. he followed scott hall who turned himself in today at the notorious fulton county jail known as rice street. he is charged with trying to illegally break into election equipment coffee county, georgia. donald trump on the other hand said he will be arrested until thursday. and while there is no chance he will spend anymore time in jail than absolutely necessary, the conditions of his bond that he agreed to may be critically important going forward. that bond order signed by d.a. fani willis and from slurs on monday was not just about $200,000, significantly there is a stipulation that trump is not allowed to make any direct or indirect threat against any co-defendant, witness or victim including posts or reposts on social media. nbc's correspondent has brand- new reporting in atlanta to start off. i know you caught up with john eastman on his way out of the jail. >> reporter: yes, he was in there for roughly 90 minutes, a pretty quick processing after we know he had $100,000 for his bond after he came out he said that it was much processed as usual inside which makes us assume there was a mug shot and he was fingerprinted but he was still defiant about the very claims that led him to be in this position in the first place. i asked him about the 2020 election. >> do you still think the election was stolen? >> absolutely. no question. >> reporter: and you won't answer on immunity from prosecution? >> i won't answer. no comments. >> reporter: did they do a mug shot and everything inside? >> no comment. >> reporter: you watch there as he was both walking to his car and talking with reporters and he was taking our questions and he was keen to talk. i think the no comments are telling then by comparison when he was willing to answer my questions about the 2020 election he was willing to say that he has not spoken to trump and does not regret working with the former president but then he was also willing to say no comment when it came to specifics. specifically if he would see community and the specifics of what happened inside the jail. i will say it was notable because his attorney was present and he tried to steer eastman away from reporters and to have him not answer questions. he clearly was not paying attention and was easy to talk to in terms of wanting to do this q&a. he is also paying his own legal bills and that's one of the questions we had as well. >> chris: ali vitali, thank you so much. now we bring in a washington post national reporter. we also have -- you are the lawyer here. if you are standing next to your defendant it has to make you really nervous if he wants to answer questions. >> 100% and this is what makes trump in particular the worst client of all time but yes, anything he says can be used against him in trial under the rules of evidence so it can be good and it could only be bad. here he is again saying it was absolutely rigged. if he takes the stand or even if he doesn't that can be thrown back at him. >> i also want to talk about something that ali vitali just said. who is paying for all of these defendants, right? if you look at his history he has a problem sometimes paying bills, donald trump does but some of the other co-defendants have complained about the financial burden of this upcoming trial. jenna ellis, trumps former attorney posted just a couple of days ago -- i was reliably informed that trump is not funding any of us who are indicted. with this change if he becomes the nominee? why then, not now? i totally agree this has become a bigger principle than just one man so why isn't maga inc. funding everyone's defense? kathy latham describes herself as a retired teacher and is asking for money. rudy giuliani's legal team says he's broke so they ask, where are the millions trump has raised and will any of it go to them? what does history tell us? >> well, i can't tell you exactly, but you are right to focus on history. donald trump has had a pretty sad history in his legal defense in terms of not even paying his own lawyers for his own defense in certain moments or asking them for huge discount or break and that is a major reason why he has struggled for many many years in many settings to get lawyers. i feel like at the washington post we kind of had a series of b matter stories that we were always ready to write because the story was so's miller. trump struggling to find lawyers who will represent him in the latest situation. he's in the crosshairs of four major cases. in all of them there's going to be an enormous expense. enormous expense, so whether or not he's putting down money for other co-defendants is a big question mark. i would add one more thing which is donald trump was willing or at least his pack was willing to find lawyers the so-called sort of family of white house aides when they were appearing before grand juries and before the january 6th select committee and when those people started to give information that was not ideal for donald trump, they got new attorneys that were not paid by donald trump and that is a standard situation where if you are going to be in our fold, we will pay for your counsel. if you won't be in our fold, see you later. >> all right, let's go back to some of the things that were news before people showed up at the jail. let's talk about the conditions of pretrial release. we saw what they were and we describe them. does it appear to be tailor- made for the president? >> yes. only trump has received this long list. i don't think it's unique to him, it's the kind of thing you might see with a mob boss. he is forbidden with contact to any witness except through counsel. he is forbidden with doing anything that might be intimidating and up in the top there you see the phrase or otherwise obstruct the administration of justice. he is the only one who got that language so somebody has made the judgment specific to trump that this is what his record justifies. very quick point two carol's point -- two carol's point about the defendant, that profile of someone who won't get their money paid and is on the outs is someone who is ripe to cooperate against him so it keep your enemies closer and just today also david shafer from georgia pointed the finger at the trump team saying that they ordered georgia folks to do it so you are getting the dynamic that fani willis want when you have multiple defendants possibly come apart from one another. >> chris: let's talk about if he breaks the agreement. is the penalty just potentially $200,000? he could send out emails saying look, they took my bond money, send me more money and he gets double or triple that. is that what is at play here? >> not at all. he is being released. he is getting the benefit of continued liberty in return for certain commitments he's made. he signed this piece of paper saying he will not do those things so on the one hand the table is set perfectly for a judge to say you violated your agreement and if it were anyone else they would be going to jail and of course with trump is an extraordinarily delicate and fraught question whether to exercise that power, but the power is simply not to forfeit the $200,000. that's incidental. the power is to terminate his release and that's what we are talking about and as he continues to jerk around with the system and do it again and again that's potentially what judges will be facing >> chris: the potential consequences of that. what it would mean to the country. it just seems like it would have to be something so unbelievably egregious before they took that step, but maybe i'm wrong, harry. >> i don't think you're wrong. you will have steps and another step and a step eventually where a judge says if you do this again i have one thing left to do and then everything's on the line. i have 100% agreement with you. trump is seeking martyrdom. i am saying that legally the table is set by virtue of us having sign that be a prisoner but it is a huge and completely unprecedented question whether you put a candidate for a major party candidate in jail based on that role so all i'm saying is the showdown is set legally, practically is a whole different question. >> there is a great article in the post today carol about how breaking the agreement could actually be a when -- win. adviser say i trump campaign sees the benefit in him testing boundaries by publicly attacking judges and prosecutors. either he gets away with it or he gets to play the victim for being censored by the courts. i wonder what you are hearing about that or is there a sense maybe the president, former president doesn't really appreciate what the consequences could be here? >> well, donald trump has had historic problem listening to his lawyers and certainly listening to them and calling their advice, but he's had an excellent track record and a mastery of convincing the public and particularly his supporters that he is being crucified unfairly. that he is under attack and soldiering on again, for their benefit, all for them. he's a genius at convincing people that he is in this horrible situation where no one will let him speak, no one will let him use his first amendment rights but i would go back to what the judge said in the u.s. district court in d.c. she's the one providing over jack smith's indictment of trump. in that case she has said donald trump is entitled to say what he wants to say except there are limits when it comes to this case. there are limits when it comes to any defendant and he is a regular defendant in my court. he is a defendant who has to follow our rules which means you cannot intimidate witnesses. you cannot use facts that are supposed to be handled at trial in this courtroom. you cannot come at individuals and threaten them in a way that appears to be obstruction of justice and any way that could appear to frighten people. now donald trump has a long history of appearing to frighten people. how much more apparent can it be then if you come for me i'm coming for you. that's a pretty big deal for a former president and presidential presumed presidential nominee to make that claim so there is a reason why again in georgia these stipulations have been spelled out and have been explicated as some lawyers would say, made explicit for him and him alone because he's got that track record. >> chris: great conversation, carol leonnig and harry litman. thank you. a look at tomorrow's first republican primary debate. candidates who did make the stage and how they are hoping to try to break free to voters tomorrow night. that is next. ♪i've got home internet from t-mobile.♪ ♪it only costs $50 bucks at t-mobile.♪ ♪just one cord to set up.♪ ♪say goodbye to that truck.♪ ♪oh, what a beautiful mornin'...♪ ♪oh, what a beautiful day...♪ ♪they won't raise your rates at t-mobile...♪ ♪you'll get a great deal every day!♪ home internet from t-mobile... just $50 bucks a month. the stage is set for tomorrow's first republican debate, just two hours long but with the potential to make or break the campaign up some of the eight making a cut including ron desantis. he is the high list pulling candidate on the milwaukee stage and the one with the most to gain or lose. he will take on mike pence, nikki haley, tim scott, chris cristi and asa hutchinson and of course donald trump will loom over the debate without being there. the new details from the nbc des moines news register poll says just what a tough job it is to take him on. the majority of likely iowa gop caucus goers believe he won the 2010 election despite no evidence of any significant election fraud. nbc's dosha burns is in the milwaukee and msnbc political analyst as well. what more do we learn and that nbc news poll and what can you tell us about what's going on in milwaukee? >> we have another major event for the republican party that the former president has decided to snob but that will play out under his shadow and in fact he has forced a split screen for tomorrow night. he has pre-recorded encounter program the event with an interview with tucker carlson that will play on x at the same time. we know that the host of the event will also ask questions about the former president of the candidates and we also know that he will be turning himself in in atlanta the next morning and i'm sorry about that, we are out in public, live television. here we are in milwaukee. chris, there is no avoiding it. he will be looming over the events. and that is what's going to be so difficult for these candidates and look, what you mentioned in your introduction was this new poll that shows the majority of republican iowa likely caucus goers believe that the former president won the 2020 election. this is the epitome of what makes things so challenging for these other primary candidates. it's why in my interview with florida gov. ron desantis it took multiple follow-up questions before he was able to say that trump lost in 2020. they have to thread this very fine needle to try not to alienate so much of his base and how they are going to do that on stage tonight or tomorrow night is going to be a major question and no doubt they're all huddled right now in debate prep trying to figure that out, chris. >> dasha burns, thank you so much. thank you. all right, so rick, even in absentia donald trump will be the key figures and i given both his commanding lead in the polls and his imminent surrender in atlanta. former candidate rick santorum told the wall street journal it's really hard to run against a martyr. how do you expect the candidates on stage to handle what we will call the trump effect? >> well first of all i'm not convinced that donald trump won't be there in milwaukee. i would recommend that he would be there if i was advising him. he is 40 point ahead. there is no point in showing up. he has already recorded his interview with tucker carlson but if it doesn't happen then what happened is everybody on stage who wants to be the alternative to trump, now ron desantis held that position for a long time and sort of still does but he is so far behind i think he will become the target of tomorrow night debate among all the other candidates and so he's really got to be on his guard. he has to be on his game so we will see how he handles that. >> most people know who ron desantis is if you are watching that debate you have heard of him or maybe followed it, but most of these candidates really are not known to most voters. how do they take advantage of this prime opportunity? >> well first of all elections are about the future and about a vision for the future and about differences and so you have to think about when you do a debate what is the headline you want to get out and you have to work all your medications in that debate toward that headline. for example, chris cristi will come out very strong against donald trump and he will be trying to diminish donald trump and that has not played out very well. his negatives are high. he may continue in that direction. the candidates have really got to figure out how do they distinguish themselves in these large debate formats do two things. they diminish most of the people and elevate one or two so you want to be those one or two scene going that way. i think those campaigns are over of those who did not make the stage and i think you will see other campaigns if not more than one will and tomorrow night. >> those four candidates did not make the stage, a spokesperson confirmed will hurd will continue his elders campaign. he and johnson say they will show up in milwaukee anyway. suarez is the only hispanic in the field. so you think those four at the very least are done? >> i do, because the debate is the largest moment in a candidate see for president at this early stage where the most people are going to be seeing who you are and like i said most people don't know who most of these candidates are. for many americans and republicans watching who are trying to make up their mind will be assessing these candidates for the first time and if you are not on that stage they will start looking at other people and deciding if those are the people they will go for. i think it will be interesting to see the fox moderators handle the trump situation. i would predict that the first question to each candidate will be was the election stolen so i am looking forward to that and the second is going to be how much are they going to make trump the issue in the campaign because the media has a tendency to cover the horse race and not necessarily the issues and i hope that the moderators will focus on some really serious issues like how to handle inflation, how would they handle the fact that people's ends are not meeting, how will they handle the nato question? >> we keep waiting for it to end. a lot of people in the middle of the country are like bring on september. we are done with august, let's head towards fall. we have these heat index dangerous. when we have the coverture and humidity and how it feels and this is in the shade. anywhere from the red about 103 is where they start to worry about heat exhaustion and heatstroke. a lot of schools are out there practicing fall sports and they been having to cancel. or they have done it extremely early or late at night. you can be out in the middle of the day. remember, it's noon right now in the middle of the country. 109 it feels like in the shade in st. louis at noon. not much better. little rock and dallas. i was trying to search and find who was actually -- who has the worst heat index. perryville, right on the mississippi river, 117 and then you venture down here to oklahoma and i don't know if this gauge is not working or if it's broken but it says it's 126 right now heat index. tulsa and stillwater, 115. by the way, yesterday in oklahoma it did peek at 127 in this area and they did break the oklahoma state record for the hottest heat index. it's not out of the realm. here is the summer sizzle tomorrow. not a lot of relief. kind of the same story. your relief comes friday saturday in omaha though in areas of northern iowa and minnesota. chicago, friday you get relief. st. louis, wait till saturday. unfortunately nashville drops a little bit but not a lot, chris. >> bill karen's, thank you for that. in california we have unbelievable seen the rescues after a storm brought historic and catastrophic rainfall. this is cathedral city. it's the deluge from the storm and accreted thick mud that coded roads and the only way for emergency teams to rescue the stranded was to use a bulldozer. 14 elderly people were trapped in a senior care facility overnight on sunday and because their exit was locked firefighters had to load them onto the machine to get them to safety. i am joined now by cathedral city mayor, rita lamb. mary, thank you for being with us. how are you guys doing now? >> well, we are definitely in the recovery phase of this whole process but yesterday there were unbelievable scenes and there were amazing scenes. this bulldozer was rescuing these wonderful residents and relocating them, but this is something that i have never seen. i have lived in the desert since '81 and the intensity and the breath and scope of this whole hurricane hilary has just been devastating to our community. >> i'm looking at the bulldozer and people sitting on it. i'm finding it hard to believe. talk about the conversations that you had about frankly, the creativity and what they had to go through to make sure those residents were safe? >> you know, our fire chief, his name is michael contrary and he is bringing with him a wealth of background experience -- michael contreras. they had the public service trucks trying to get in there and they really couldn't get a hold with all the mud and so they creatively thought of using the bulldozers and they made this amazing rescue. the operations fire department personnel that was right on the scene and coordinating this effort was fire chief williams with the battalion chief. he was in the trenches coordinating this whole effort but it was a brilliant rescue. nobody was in peril, but they were all trapped inside this home healthcare facility so it was wonderful that they were all relocated. today we are definitely in the recovery phase and there has been meetings all morning long on what the next steps are because that whole neighborhood bordered between vista chino and panorama which is our to local streets, that whole neighborhood is still inundated in mud so it's a nice sunny day so it drying out. there are some vehicles with people that have four-wheel- drive that are able to get out but most people are still trapped there. it's going to be an ongoing expansive rescue and expensive. >> chris: do you have the resources you need? >> well, we are talking with our county and state and federal officials about some possible health risks -- help for us because this will be more than cathedral city itself. we certainly have been putting the word out for that. and this is such a collaborative effort. i have all agree received calls -- already received calls from mayor steve hernandez from khala taylor and marilyn linda evans from locking test saying we have resources. so our fire chief contreras is director of our emergency operation systems and he's definitely taking charge of all of this and in the next few hours they will be coming up with a plan to move safely into those neighborhoods. >> i'm glad you gave some shout outs because we don't often get a chance to do that for people who every day really put it out there. >> they are wonderful and we are trying to clear up the roads leading to cathedral city. >> good luck mayor. coming up next a hawaii firefighter providing new video of those deadly while fighters in maui, an experience he likens to walking through hell. you're watching chris jansing reports only on msnbc. it's your verizon. type 2 diabetes? i want to bring in nbc's ryan nobles and also back with us is rick tyler. ryan, why would democrats care if glenn youngkin decided to challenge trump ? they are not worried about glenn youngkin taking him on but worried about what he might do to get there and in particular they are focused on the upcoming state legislative races in virginia that are happening this fall which not too many people are paying attention to because they are off year elections but the republicans are just a couple feet away from taking control of the senate and if they are able to hold onto the house of delegates it would give a governing majority to glenn youngkin a democrats fear could tilt the street to the right and then potentially set a platform for him to make a case as a national candidate. at the very least if he is successful in winning back both the house and senate he could at least make the argument to national republicans in a short span of time that his brand of politics is what can sell and a purpleish state than someone like donald trump. it is still something that he needs to accomplish by that time meeting he would have to wind that election in november. democrats are sounding alarm bells because he is raising millions of dollars from well- heeled donors all across the country. democrats are trying to match that and they are saying that they need to stop the train now before it gets too far out of the gate and who knows what his national ambitions could potentially be. >> well, we talk about the national electability issue. when he can be -- for governor he was the first republican governor in that state since 2009 and then governor, i covered that, he was the first since 2009 and there's a poll that has him beating president biden in a head-to-head matchup in his state, which would make the road to 270 easier. could he be the strongest alternative to trump? >> at this point, i don't know why not. that summation was really spot on. that's exactly what's happening. there were a lot of donors with desantis because he was seen as the alternative and since his remarks on ukraine and territorial dispute they abandoned him and they have an electability issue and they have not selected someone new. glen youngkin if he were to win the senate and only has a couple seats to do it. not only is it an off off year, the whole country is focused on if trump goes to the white house or the big house. so this election in virginia is going to be a pure turnout election and that's driven by money. and people are giving millions of dollars to youngkin's spirit of virginia pac knowing full well that investment is not just for virginia but maybe a future investment. now the big risk of course is can he afford to be so late in the states because if he can't get organized in the first three states he would have to sweep super tuesday. is it possible? maybe. youngkin has a brand that cracked the code on trump, which nobody else has been able to do. he brings winning to the republican party where donald trump has brought nothing but losing. >> we asked about alternatives to trump, we start by asking about ron desantis. >> six months ago he was the hope for those that don't care for trump. i'd be happy to vote for him but i don't know the way it's tracking right now it's going to be viable. >> if liz cheney were announce a run for president, potentially as an independent, would you be open minded? >> i would vote for liz cheney many in a heartbeat. >> if virginia governor glen youngkin get into the race would either of you supporting trump back him over trump? >> i would go for trump first but yes, i like youngkin. >> not over trump? >> yes. trump is the leader right now. >> i'm the same way, i wouldn't do it over trump but i do like him. >> do you think a lot of republican voters would consider someone other than trump or does there need to be a place to go if something really unexpected happens in terms of support for trump between now and then?
