his message to the people of maui about their loss and the recovery while the next storm threat takes aim at the texas gulf coast, tropical storm harold, less than 100 miles away from landfall. good morning, thanks for being here. it is 10:00 eastern. i'm ana cabrera reporting from new york and as we come on the air, the first of donald trump's 18 co-defendants has just surrendered down in georgia. scott hall charged in the covey county election breach has been booked at the rice street bail. his bail set at $10,000. trump lawyer john eastman also expected to surrender as soon as today, according to his attorney. eastman faces nine counts including racketeering for his alleged role in trying to overturn the state's 2020 election. the man whose name is at the top of that indictment, the former president, says he will surrender on thursday, a day after the party's presidential debate, an event he says he won't attend. trump's bond has been set at $200,000. and it includes an explicit and unique warning, quote, the defendant shall perform no act to intimidate any person known to him or her to be a co-defendant or witness in this case or to otherwise obstruct the administration of justice. let's go to atlanta and nbc's blayne alexander, also with us former federal prosecutors carol lamb and former senior investigative counsel for the january 6th house committee and partner at salengi, gay, elsburg. tell us about john eastman and scott hall. >> sure. so, this was our first surrender we have seen in this sprawling rico case in fulton county. scott hall was booked in some time between late last night and early this morning. in fact, at last check, and i just checked the inmate status there on the fulton county jail website, he is still listed as detained in the fulton county jail. now, we know that his bond was set at $10,000. we know that he was one of five people who worked out a consent bond agreement yesterday. so already those terms have been negotiated. so we're going to keep refreshing, we're going to see when he's processed out, how long he's going to be held there in the fulton county jail and the possibility is perhaps they haven't updated the website. the other person that we're expecting to see surrender today, john eastman. as you laid out right there. he was granted a $100,000 bond, consent bond, also signed yesterday. but we know that under those terms he has agreed not to have any sort of communication with co-defendants or witnesses except through counsel. so already the terms of those have been worked out. as you know very well, another one of the people who received a consent bond agreement yesterday, former president donald trump, who posted he plans to surrender on thursday. >> and what can you tell us about those pretty strict bond stipulations for trump, who, again, is set to surrender on thursday? >> yeah, notenoteworthy. i caught up with his attorneys yesterday as they left the fulton county courthouse. they had a meeting with the d.a.'s team and i asked them what can you tell us about the terms of surrender, about when he'll surrender and they said you'll find out shortly. these are some of the things that were very likely discussed when they came to that agreement over consent bond. another thing that was notable about the former president's consent bond as opposed to the others we saw yesterday, that was signed by fani willis herself, the d.a. herself. the others were signed by somebody in her office. this one was signed personally by district attorney fani willis. we're also learning some new details about what will happen, what will likely happen when he comes down here on thursday. according to people familiar who have told nbc news, he's expected to come in, basically get booked and go right back out. we're not expecting a whole lot of fanfare here, a whole lot of events or anything like that. he's going to come in, and get back out. another question we have, ana, is what will it look like when he actually goes into surrender? he's expected to go in through this kind of back portico area that is largely away from camera view. so it will certainly be interesting to see how much time he spends inside the actual building. >> thank you for the updates, blayne alexander. carol what is your reaction to this bond decision and this explicit warning made to trump? >> couple of things of note, ana. it was noted fani willis herself signed the bond conditions of release for donald trump. i think that that's really fani willis taking responsibility for this case. she is saying i'm not putting it on any of my deputies to have brought this case against donald trump. this was really my decision and here's my signature on now the conditions of release. so i think that's the sort of symbolism behind that decision. i think that the conditions of release themselves are -- were negotiated in context here. we have seen incidents in the past, of course, where donald trump has taken shots at lots of people, co-defendants, witnesses, judges, and you see the judges not only pushing back, but now taking anticipatory moves to warn donald trump. they don't want to wait until a threat is actually issued before they address the problem. so, remember, that if his team chooses to challenge any of these conditions of release, which they won't, because they have now agreed to them, but if she -- if a judge were to impose the conditions of release, and they took issue with them, remember who would be looking at this on appeal, other judges. and judges understand that you have to keep control over the courtroom and that the job of the trial judge here is to keep control of the courtroom and to protect those who are involved in the case and that includes both co-defendants and witnesses. so, i think what you see here is reasonable in context, reasonable in terms of what we have seen donald trump's behavior been, not only in this case, but in other cases as well. >> and you made a good point as you discussed that trump's lawyers had to sign off an agreement to these conditions, and the judge that will oversee the trial, scott mcafee, also signing on, not just the d.a., fani willis. so, what are your thoughts on this and is it odd at all to have these bond conditions and, you know, the money, monetary amount also laid out, even before a person surrenders? >> no, that's pretty normal. and especially in high profile cases that are nonviolent, it is very normal to agree to a consent bond. i think what's interesting here is that a bond that is typically about getting a defendant back to court, and not committing other crimes. here when someone has substantial means, $200,000 is a pretty small bond. and president trump, i mean, he's effectively in a kind of custody by virtue of secret service protection. i think what the bond shows in comparison to his other cases where he was let out on just signature is he's going to be treated like any other defendant. it is a small bond relative to his wealth, but it is a bond that is effectively unnecessary because where is he going? i think what it is showing is that d.a. willis wants him to be seen like any other defendant, in the fulton county system, that he's not going to be treated differently. and i think what is also important is that by virtue of it is not just that his lawyers agreed, it is that president trump agreed to the terms so that means in the future, if he violates something on twitter or does something that violates the bond, it is not that his lawyers agree, the judge is going to say you said these were the conditions by which you would abide by to stay out of prison and he's going to have to answer himself if he doesn't. >> that includes not posting stuff on social media or even reposting things made by other individuals on social media that could be construed as some kind of a threat or intimidation, right? >> exactly. i think, you know, it is probably unlikely that a former president is going to be remanded to custody pretrial. but i think what the conversation is here is it is the opening shot. i think everyone expects that president trump is not going to abide by the conditions fully. but any judge wants to set the record that, hey, i was clear about what you had to do, and if the judge has to take any other actions, limiting his speech, otherwise limiting his phone access or something else, there will be a clear record that former president trump was fully warned that that could happen. >> and so, carol, one of the other co-defendants in this case, mark meadows, has already pushed for this case to be moved to federal court and now we have two more co-defendants, jeffrey clark and david shaffer requesting the same thing. is that a sound legal strategy? >> well, it is a strategy that is not terribly surprising and in fact was anticipated in terms of the federal -- the former federal officials in the case. there is a law that allows them to actually ask that their case be moved to federal court, but i want to be clear that if you succeed in getting your case moved to federal court, and it is actually tried in federal court, it is still tried on the georgia charges. in fact, fani willis would probably get designated, her and her team would probably get designated as special assistant u.s. attorneys to appear in court and to represent now the united states. but, these would be on state charges, so, it would not be possible for either donald trump were he to be re-elected or any other president to pardon these individuals, just because they're being charged in the federal court. they would still be charged on the state court -- on the state charges. so, that's important to bear in mind. i think that shaffer is an interesting situation, because it is -- he's an individual who was not a federal official. but it will test the theory whether somebody acting at the direction of the federal official could have his case moved into federal court. the interesting thing about this is it splinters the case potentially. there could be individuals who don't want their case to be moved to federal court and that would mean that fani willis, if these individuals succeed in getting their cases moved to federal court, it would mean that fani willis would now have to try this case at least twice, once in federal court, and once in state court. >> that sounds complicated. let's talk about another development in a separate case, the federal case against donald trump on election interference and trump's team wants this trial pushed to 2026, which we reported, while the special counsel just filed a response to that saying that would deny the public a speedy trial and arguing that the defense, quote, cites out of place statistics and cases, overstates the amount of new and nonduplicative discovery and exaggerates the challenge of reviewing it effectively. what do you think the judge will do here, when could we expect a trial? >> i fully expect a trial is going to happen next calendar year. so -- >> before the election? >> before the election. a speedy trial is a defendant's right, but the public also has a right in a speedy trial and what that means, if the public has a right to see the fair administration of justice quickly. and i could not think of a case where that's more important than deciding whether a former president tried to subvert an election before he runs for re-election once more time. i fully expect with everything judge chutkan said, she's going to move this case forward quickly and the motion that former president trump's lawyers filed i just didn't find that quite serious. they're noting, for example, statistics about his save america pac document that came from that, they're looking at trial times that happened in covid, which isn't a fair comparison. i think jack smith's team is correct that this case could move forward next year, and i fully expect it will move forward. >> all right. thank you so much for being here. now, from georgia to chicago, where a woman is facing federal charges after allegedly threatening to kill former president trump and his 17-year-old son barren. according to the complaint, she emailed the threats to the head master of a palm beach school and she allegedly admitted to it when she was questioned by the secret service. her detention hearing is scheduled for tomorrow. when we're back in 60 seconds, the final countdown to the first gop debate. the elephant in the room, the front-runner who won't be there. plus, more fresh nbc news polling, how many iowa republicans actually believe donald trump's false election fraud claims? also ahead, if you saw sparks flying outside your airplane window, what would you do? how the faa is looking to improve safety after a string of air scares. and then later, children and a teacher hanging 900 feet over a ravine after a gondola cable broke. the mission to save them. broke. the mission to save them (christina) with verizon business unlimited, i get 5g, truly unlimited data, and unlimited hotspot data. so, no matter what, i'm running this kitchen. (vo) make the switch. it's your business. it's your verizon. (christina) with verizon business unlimited, i get 5g, truly unlimited data, and unlimited hotspot data. so, no matter what, i'm running this kitchen. (vo) make the switch. it's your business. it's your verizon. one day to go. eight republican candidates now confirmed to be taking the stage tomorrow night at the first gop debate. front-runner donald trump, of course, won't be there, even though he's still dominating in the polls. and take a look at this, part two of the nbc news des moines registrar poll just released shows 51% of iowa republicans believe trump's false claims that he won the 2020 election. let's bring in nbc's dasha burns in milwaukee, the site of the debate, with brendan buck, former press secretary for house speaker john boehner and former detectivic congresswoman from maryland donna edwards. without trump on that stage tomorrow night, what can we expect? >> look, this is another major moment for the republican party that the former president has decided to snub. and that nevertheless will be playing out under trump's shadow. he has forced a split screen moment where while the debate is happening, we're likely to see a tucker carlson interview that he has pretaped, playing out at the same time. we know that the debate hosts will be asking the candidates about the former president. we know all of the candidates are preparing to figure out how to keep walking that fine line, how to talk about the former president, who is going to be attack him, who is going to be trying to maybe defend him while also saying that they're better positioned. we have seen them wrestle with this question over and over again. and what you pointed out in your introduction there, the poll showing majority of iowa caucusgoers believe that he won the 2020 election, what is a really fine point on why it is so difficult for these candidates to find a way through this. it is why in my interview with florida governor ron desantis it took multiple questions, it took a lot of pressing to get him to say that trump lost the election because a lot of voters believe that trump won. it is going to be really interesting to see how they navigate this. this is a massive opportunity because trump is gone, but also is a really tough line to walk or really tough needle to thread for these folks in this really pivotal -- really first big moment for voters that might just be tuning in to this primary, ana. >> and, so, dasha, do we know the debate stage layout in terms of who is going to be where yet? >> we don't know the exact layout yet, but, look, we know that florida governor ron desantis is the front-runner, second to trump, right? we know he's going to be getting the majority of the attacks, so i think we can make some assumptions there that he will be the one getting piled on probably in the center there. >> stay tuned for that. brendan, eight candidates on stage tomorrow, former congressman will hurd is not among them. he was left out. he's taking issue with the debate polling requirement that looks at likely republican voters. hurd's campaign writing this, quote, anyone regardless of party who is willing to check the box for a republican should be considered a likely republican voter. expanding our party should be applauded, not penalized. what do you make of his complaint and the requirements themselves? >> well, i think will hurd is doing whatever he can to get on the debate stage and that's what the candidates are going to do at this moment when they're on the outside looking in. i think the -- while will hurd is an important voice to add, i think the rules are fine. some of the candidates, i'm not just talking about will hurd, a lot of the candidates need to take a hard look at where they stand, what their chances are and whether they are diluting the republican anti-trump vote or they're helping to build up an alternative. i think everybody deserves their chance to make their case. but especially after this debate, if you're still mired in 1% or even 2%, 3%, 4%, 5%, you need to think about getting out. you need to think about can we credibly or can we rally around one single credible alternative to donald trump? we can't allow what happened in 2016 where the votes were divided up and donald trump benefitted from it. so i hope that some of the people get their chance, if it is not working out for them, they sooner rather than later show themselves out. >> i'm sure every single one of them wants to be the alternative and saying why is that guy the person we should be rallying around? we'll see if the debate makes a big difference. i want to dive deeper into this new headline from the poll, 51% of republicans in iowa still believe donald trump won the 2020 election. so, with these numbers, what do those on the debate need to do to move the base away from trump? >> well, the polling numbers really confirm dasha's reporting that because of the -- because of where republicans are in terms of believing that trump won the election, i think it is very -- it is going to be very difficult for these same candidates to go and attack donald trump, to even have to respond to the question about who won the 2020 election. i think it is going to be very tough for those candidates, and i have to say, with respect to brendan's analysis, i think one of the challenges, of course, is that these republicans haven't distinguished themselves from trump, it is not really clear to me if you add up the numbers that trump isn't the second choice for a number of those candidates, and so even if some were to drop out, it is not clear at this point whether they have the numbers to defeat donald trump and i think that republicans are dug in on this question of whether trump won the election, that it is going to be very hard to undo that. any candidate who tries runs a risk of alienating an awful lot of the iowa electorate. >> dasha, let's talk about debate prep. here is vivek ramaswamy, and he posted this video of him playing some tennis yesterday, saying this was a solid three hours of debate prep. do we know how other candidates are preparing and i'm kind of laughing looking at the topless or shirtless ramaswamy out there on the court, reminds me of other politicians who put those pictures of them all muscly out there for the public. >> yeah, it has been a bit of a muscle man primary here, but, yeah, vivek ramaswamy with the tennis, he's also throwing a party tonight, he seems to be having a little bit more fun. everyone else has been in study hall, hunkering down in prep. we know that it is going to be a little bit difficult for florida governor desantis given the extraordinary amount of information that was put out with that leaked memo and then the follow-up memo from his campaign, the duelling memos from the super pac and campaign. which strategy is he going to follow, what is that going to look like? he's really boxed in a little bit there. everyone, again, is trying to figure out how they're going to deal with the trump factor. everyone has been bringing in the big guns for debate prep, getting in those coaches, getting in those reps, all the folks i've been talking to say they are ready to go for tomorrow night, ana. >> brendan, we learned the former president has already prerecorded an interview with former fox news host tucker carlson that he plans to use as counterprogramming to this debate. ron desantis had this to say about trump's absence on the stage. listen. >> i think he owes it to people. i don't think our voters, even people that appreciate what he did, and i'm actually one that appreciated a lot of what he did too, i don't think they're going to look kindly on somebody that thinks they don't have to earn it. >> brendan, do you think trump's strategy could backfire? >> there is a chance, but i think it is a smart strategy. look, the most important thing for any of these candidates is people's attention. one of donald trump's super powers is his ability to suck up all the oxygen, blocks out the sun and hard for anybody else to get any traction. and i think what he's doing by not showing up, we can assume there is going to be lower ratings, and by turning himself in the next day and by doing this interview, it is actually really smart. these people on the debate stage need donald trump more than donald trump needs them. that's actually one of the key things for the people who are on the debate stage. they have to find some way to get impact on, make the point that ron desantis was just making, they can't have this whole debate this whole primary go through and donald trump never shows up. they need to bait him into coming him, making that contrast so that he feels like he needs to come in and be part of these debates. i expect what ron desantis said there, hopefully a lot of them are going to be saying that, and i think it is a pretty good message. >> congresswoman, it is notable the lone woman on that stage will be nikki haley. how do you think that could help or hurt her tomorrow night? >> i think it is unclear. nikki haley has been both trumpeting the woman card, the identity politics that don't play well in the republican party. i think she has to tread lightly. everyone is going to notice she's the one woman on the stage. and i think she's going to are to distinguish herself by pointing to her record as governor and being willing to both give a punch and take a punch in this debate. and, look, ron desantis is the one who has everything to lose and so all of these candidates are going to be piling on against him and i think nikki haley has to, you know, thread the needle that all women candidates do. can't be too aggressive and at the same time you have to be aggressive enough. >> okay. former congresswoman donna edwards, brendan buck and dasha, thank you, all. we have breaking news. john eastman has just surrendered at the rice street jail. we're working to get more information. blayne alexander is there and joining us now. what more can you tell us, blayne? >> reporter: well, ana, we can tell you this booking popped up within the past few minutes. when i spoke with you earlier this hour on your show, there was only one person who had been booked in. now john eastman has as well surrendered. his attorney put out a statement last night saying he was going to turn himself in today. we knew this was coming. and now he's put out a statement. i want to share a little bit of that statement with you. he said this is a statement upon self-surrender today in fulton county. i'm here today to surrender to an indictment that never should have been brought, it represents a crossing at the rubicon for our country. the statement goes on for another three paragraphs or so there. but really to just kind of lay out what we expect his argument will be in all of this. saying what we heard from him what we heard from others who have spoken out so far through their attorneys or through other channels that they believe that these charges should never have been brought. what we have right now, the second surrender, his bond set for $100,000. his was another of the five consent bond agreements that were agreed to and signed and made public yesterday. so we have now seen two of them surrender. we know when the third is going to come. former president donald trump, he's posted that he plans to surrender on thursday at some point during that day. and that all of that comes as we continue to wait for the other co-defendants to turn themselves in as well. >> just trying to paint the picture in the mind's eye here as this booking process proceeds, how long do we expect it to take, do we know where he's held during the booking process? >> reporter: i think that's a good question. the fact there were consent bond agrees worked out takes away some of the administrative work or paper work that leads someone to stay in the jail for a booking process for some length of time. already all of that has been agreed to. in theory, that should expedite the time he's able to get in and get out quickly. now when anybody goes into the fulton county jail, there is also the issue of processing. so we're talking about likely fingerprints, likely mug shots, just going in and doing the things that anybody would do if they're getting booked into the jail. that is something that will still take an amount of time, not determined yet how long, but the fact that the paperwork is worked out, the consent bond agreements and terms were already agreed to will likely expedite his in and out there at the jail. >> so, two people now of those 19 co-defendants total, we have learned have surrendered to georgia authorities. john eastman the very latest. blayne alexander, thank you for your reporting. up next, president biden sees the devastation in hawaii. his message to the people of maui. plus, a double whammy of wild weather out west. the flooding in california, and raging wildfires in washington. n (christina) with verizon business unlimited, i get 5g, truly unlimited data, and unlimited hotspot data. so, no matter what, i'm running this kitchen. >> so we mentioned all the single story residential homes have been searched now. can you walk us through what's next? >> reporter: yes, so, there is about 15% of that burn zone that has yet to be searched. that's because there are multilevel structures there and one of the fema representatives that we spoke with said they're going to have to delayer some of the buildings, including a four-story apartment building they haven't been able to set foot in to search for more remains. we're told from the governor, unfortunately some of the victims may never be found because the fire burned so hot, he estimated up to 2,000 degrees, which is hotter than an incinera incinerator. a lot of the remains turned to ash. there are still cadaver dogs and several teams on the ground combing through the wreckage. but we're sold that the search could take an additional few weeks, just because it is going to be more complicated, more methodical and more tedious. >> what stands out to me about all of the wreckage is how unrecognizable so much of it is because it has burned and destroyed and twisted in so many ways. dana griffin, thank you very much for your ongoing reporting. now to the west coast, where the cleanup is just getting started this morning after tropical storm hilary left flooded roads, trapped cars and toppled trees in southern california. and now this downgraded storm system is moving further north, which could be a good thing. it could bring some much needed rain over those deadly washington wildfires. nbc's erin mclaughlin is covering all of it for us south of san bernardino. erin? >> reporter: look at this, it looks like it could be from an earthquake, this is from a mudslide, tropical storm hilary has changed the landscape of this area. now crews are working around the clock to clean it up. meanwhile, overnight in los angeles, an emergency situation after a hospital lost power. the cause of that power outage is unclear. this morning, first responders working to rescue california's most vulnerable residents. a power outage at white memorial hospital in los angeles affecting hundreds of patients, including some on ventilators. emergency evacuations under way as firefighters had to carry some patients down flights of stairs with elevators stalled. >> a tower that specializes in nicu, obgyn and specialized rehab completely lost hour. >> reporter: the cause of the outage unclear. it comes as emergency response teams worked throughout the west coast. as the damage left by tropical storm hilary is coming into fuller view. in cathedral city, heavy mud flows trapping elderly residents. firefighters using construction equipment to bring them to safety. >> to use a 50-ton skip loader, that's not something we do so it can't be comfortable for them. >> reporter: in forest falls, residents like vicki say they're thankful to be alive. following a massive mudslide that trapped firefighters sunday night, and narrowly missed her home. >> it was just so much mud that it just went right over everything. >> reporter: residents say the mountain just gave way and came pouring down this road. what is left, about six feet of mud. you see just this is like quick sand. and officials say that until this is clear, an entire town is cut off. meanwhile, in eastern washington state, multiple wildfires continue to threaten lives and property. scorching more than 20,000 acres and forcing thousands to evacuate. nbc's jesse kirsch is there. >> here in the small city, parts of this community are ravaged by wildfire. look at this neighborhood, home after home burned to the ground. >> reporter: back in southern california, the bravery and training of first responders is being credited with saving dozens from fast-rising floodwaters. this morning, the aftermath, buckled railroad tracks, abandoned vehicles and a half submerged 18-wheeler. a sobering reminder of the storm's destructive power. officials tell me that damage assessment begins in earnest today. they're going to be looking for two things, infrastructure damage and residential damage and from there determine whether or not southern california qualifies for that fema assistance. meanwhile, authorities here are on the lookout for more mudslides like this one, especially in the burn scars. back to you. >> erin mclaughlin, thank you. we're also tracking a new tropical storm taking aim at texas this morning. tropical storm harold is expected to move inland today, from the gulf of mexico, threatening to bring heavy rain, so the potential of flooding and gusty winds as well. even as the storm moves ashore, dangerous record-breaking heat is expected in texas, and the central plains. and so we're going to keep an eye on all of it. up next on "ana cabrera reports," a mother of nine shot and killed, allegedly over a pride flag. new details about the shooter's social media history and why this could be a potential hate crime. plus, as if flesh-eating bacteria wasn't already enough to worry about, you can add listeria to the list. those health warnings next. listeria to the list those health warnings next (christina) with verizon business unlimited, i get 5g, truly unlimited data, and unlimited hotspot data. so, no matter what, i'm running this kitchen.
