>> we begin this hour with the latest on hurricane hilary which is now barreling towards southern california. the national hurricane center has downgraded the hurricane to a category one storm. still expected to bring substantial damage to the area. california governor, gavin newsom, has declared a state of emergency as the storm is expected to bring punishing rainfall, isolated tornadoes, and waves as high as eight feet high as long the southern california coast. when is a mute correspondent guad bin is joins me live from san diego california. what is the latest on the projected path of this hurricane? >> katie, it is the calm before the storm. you can see it is a beautiful morning here in san diego. just a few hours before the hurricane, which is expected to make landfall as a tropical storm here in southern california. the latest news indicated it was moving east of where we were at. we will have to wait and see how the storm develops here. how it comes in, touch, land just south of us. it is going to hit mexico first. a lot of urban community south of san diego -- take one a, and sonata, could be hit before we get hit. we will have an idea of what it will be like. for now what authorities are saying is regardless of the path it does take, all of southern california is under this warning for the tropical storm. what that means is there is a possibility of flash floods in southern california. this is an area that is not used to that much rain. for people in these areas where floods, i think they are the ones that will have to be watching what happens with the storm. all of southern california is getting ready. over the next few hours we will see how the storm hit soon here, katie. >> juan vinita. is thank you for getting us started. please stay safe, i appreciate you. turning now to former president, donald trump, and the ticking clock that he and his 18 codefendants are facing in the georgia election interference case. full nda, fani, willis has given all of them until noon this friday to turn themselves in voluntarily. law enforcement officials telling nbc news they expected twice impeached quadruple indicted one term disgraced former president to certain himself at the fulton county deer no later than thursday -- former white house chief of staff, mark meadows, has filed a motion to dismiss citing immunity from prosecution. in that filing, meadows claims that, quote, as a federal official at the time of the charged conduct, he, as in, meadows is immune from state prosecution under the supremacy clause of the federal constitution. joining me now, barbara mcquade. former u.s. attorney of michigan, law professor at the university of michigan law school. also a co-host of the hashtag such as laws podcast. -- senior reporter of the atlanta journal-constitution. also logging 15 hours, marathon day, this past week in fulton county. so good to have you both start of the 9:00 hour,. barbed start off with you. yesterday, joyce and i walk through the removal process. we have an evidentiary hearing august 28th in front of a federal judge. during that evidentiary hearing, this judge will determine whether not mark meadows can have his case removed as a state from federal court versus state court. barbara, my question to you is this. mark meadows was a white house chief of staff. donald trump was the president of the united states at the time. what but people like rudy giuliani? we have heard he wants to invoke this concept of removal from federal court because he was, quote, acting at the direction of a federal official at the time of the conduct. >> i do not expect them to have any luck, katie. those who were federal officials at the time of the conduct have, at least, in arguable claim. i don't think it will be a successful claim. those who were not, quote, federal officials -- that is a term meaning that you had a certain status as an employee of the united states of america. none of the codefendants had that. i think for them this argument is a nonstarter -- >> what happens of someone like mark meadows goes to federal court, doesn't successfully get his case dismissed? do the other defendants stay in state court? what are the logistics of that? >> that is a good question, katie. warren we are still trying to figure out. these cases are somewhat unusual. we have heard recently in fulton county that those law enforcement officials who killed folks in the line of duty were able to get their case removed to federal court. this is a much different circumstance. obviously, a very novel one involving the former president of the united states. we are trying to figure out of someone like trump or mark meadows is successful. does that mean that their portion of the case moved to set a record? or does the entire case move there d.a. willis has mentioned she wants to try all 19 defendants gather that is an open question to see whether she will succeed i will be curious to see what justice to jones says on that hearing with mark meadows. >> let's stick with rudy giuliani, rudy rudy as he is called sometime. rudy is an unindicted coconspirator and jack smith's federal interference case up in d.c.. he is now an indicted codefendant in the state of georgia. how does that work? is there any way for him, rudy giuliani, to be a witness against donald trump in d.c.? be a codefendant of donald trump in georgia? >> i would think, katie, any defense attorney worth his or her saw would want to have some sort of resolution on how he was going to testify. even though he is not charged in the d.c. case, the federal case, i think he would invoke his fifth amendment right against self incrimination there because any testimony he gives there could be used against him in georgia. i think he will either be silent in both or he will agree to testify in both. i don't think he will choose one of the other. there is just too much legal peril in the other forum. >> let's walk through some of the logistics, as well. my understanding, correct me if i'm wrong, fani willis and her team could be designated as special prosecutors in federal court if these cases with some of the defendants removed. in addition, do we have any ideas about the potential jury pool and from where that would be polled if this cases removed to federal court for mark meadows? >> that is the benefit if he is, ultimately, successful in getting this case removed. the northern district of georgia, depending on how this works out -- he either get jurors from a ten county swath around the city of atlanta. that it's urban and suburban areas that may be a little more conservative were fulton county where 72% of voters voted for joe biden in 2020. it is also possible, if this case gets removed, it goes to the entire 46 county area in the northern district of georgia. that includes all of north georgia. some of the most conservative areas east of the mississippi. that congressional district, for example, that elected marjorie taylor greene. that would be a huge benefit to someone like mark meadows and donald trump. remember, in that jury trial you only need one juror to hold out. you are much more likely to get it if you are able to get all of northern georgia in on that. katie, we are expecting, if this keeps does get removed, potty with it or t would be sworn in as a special u.s. attorneys. we are still talking about the same prosecution team. we are still talking about state, not federal, laws. what changes are the judge in the jury. if someone is convicted, the presidential pardon would not apply. >> barb, let's talk about that judge in state court right now. judge mcafee. a young judge the bench, just appointed in january of 2023. we mentioned in the last hour of my show that cameras are allowed in the courtroom. you and i haven't been in federal court, it is very rare. it is not happening with jack smith now for the federal cases. some of us in the media would like that to be the case. in light of the threats and the doxxing happening to the grand jurors that sat in service, doing their obligations, when they returned true bills against donald trump in those 18 codefendants, do you think that mcafee could change his mind? do you think that that is good cause to not have cameras allowed in the courtroom? >> i don't think it is going to change the law in the way that the use cameras in the corman georgia. after, all it is all about transparency in government. with high stakes cases the need for transparency, i, think it's higher than ever. i think the need to protect jurors is really important. you do not need to show the jurors. i think it is rare that jurors are shown on camera. what is shown, and where i will have some concern, is the witnesses. the derek chauvin case, you see the witnesses face up close. there are many republican officeholders and others who are likely witnesses in this case. i would be worried about their safety. i think that is where the judge may need to think about doing something. blaring faces, not showing their faces just here in her testimony. jurors are told that they should look at the witness because that helps them to assess their credibility. that is the part we're out have a little bit of concern and wonder whether the judge might want to modify the way they do things to protect the witnesses. >> managing client expectation is something that is important when you're a lawyer. let me put a hat on right now because i want you to manage our viewers expectations. we have heard the fulton county say we will treat you just like any other inmate, mr. trump. do you think that we would see the release of a mugshot? or, the rules of the law are such that a request would have to be made for the release of a mike trout of donald trump? >> the way it works in georgia's people would have to file an open record request to get that. but we should be able to get them in short order. in terms of managing expectations the sheriff mentioned he wants to treat trump and the other defendants like and everybody else. that might be harder in the these jails in atlanta. you are dealing with a former president of the united states with very unique security needs we are talking about a jail that is very overcrowded. you might need to make special considerations for him especially when you're dealing with secret service. that is where we might see some differences. if you are a normal person to be booked at the fulton county jail you might be waiting around for hours in or to get your medical test, fingerprint, mugshot, that sort of thing. i do think that there will be negotiations ahead of time in order to speed up that process so those folks aren't sitting around given the special security considerations for the folks. >> if it were up to me no one is above the law, i think that also should include booking policies. but maybe that's just me. thank you for getting us started on the 9:00 hour i appreciate you both being here. >> coming up next, rico redo. this is not the first time fulton county d.a. fani willis has sought justice using georgia's expensive racketeering law. she is widely considered an expert on the rico act. why trump's force indictment is very different from the rest after a quick break, much more of the katie phang show to come. keep it right here on msnbc. so it smells first-day fresh for 50 days. 50 days!? >> good morning. i think that what folks need to know first and foremost is that the rico statue here in georgia is a very different than the rico statute that most people might be familiar with on a federal level. the federal rico statute is much maudeline eat it and how it can be used in crimes and collectivity. georgia's rico statute is essentially a very broad conspiracy statute. it has been used because of it being such a great tool for prosecutors in both white collar and more violent criminal law settings. so, there is a real familiarity with it here by the folk county d.a.'s office, the employee at one of the foremost experts on rico as well. fani willis has prosecuted some of these crimes herself as well. i think this is a kind of law that people generally associate it with more violent criminals, mafia, things of that nature, given the way it structured differently than the federal law, it makes it a bit more appropriate, or at least a place-able to an election law conspiracy or election law violations like we have here. >> okay, anthony, let's put this to bed finally. there has been some variations on theme on this. is there minimum mandatory sentence for we go in the state of georgia? but >> so, the answer is yes and no. there is options. so, there is a prison option of 5 to 20 years. there is an option for a fine, there is an option for both. in georgia law, but judges have the ability to probate sentences. instead of sentencing someone to five years of probation in lieu of five years of imprisonment. so, no, there is no mandatory minimum term that a judge would absolutely have to impose here under the georgia rico. >> this indictment has 161 acts as alleged, complaints from people like mark meadows that me setting up a phone call or me organizing a meeting, in and of itself, is not criminal conduct. what's your response to the idea that those 161 acts, over acts put forth in the indictment, may look innocent on facebook actually could be used as predicate acts for purposes of rico >> all the time, there are a based charges, in this case, we have the georgia rico, where there are acts which are otherwise themselves in isolation, perfectly lawful. important context of a criminal enterprise or a criminal conspiracy agreement, it makes them more suspect, or i should say, it makes them subject to being a point, a data point for prosecutors about the conspiracy of not just being something that folks are joking about or something that folks really don't mean when they're engaging in these conversations, but rather they're taking affirmative acts in order to further the conspiracy. conspiracies don't need to be successful in order to be criminal and be able to be prosecuted, right? many people, for example, on a day-to-day basis call the secretary of state's office here in georgia for a variety of reasons. that alone is not criminal, if you're engaging with conversations with individuals in order to do something unlawful that involves the secretary of state's office. when you make points of contact, now you suddenly very different dynamic, right? >> so, katie, i, thank you for covering the important details of the people that were actually impacted by this every day. georgians turned out to vote for the first time in 28 years for democratic president. we delivered our electoral college votes. to have someone, a current sitting president come and tried to strip the will of the people, i think that it's happening in the district that we call the fighting fifth, accountability will be brought to donald trump and his 18 lackeys who are coconspirators in the indictment. when you think about ruby freeman and shaye moss, what they had to endure. a sitting president put a target on their backs. they had to leave their homes and get security. when they thought someone was coming to help them, it was someone that trump and his lackeys sent to harass them, intimidate them, and put even more fear and their lives. so, what we know in fulton county is that no one is above the law. my district attorney, fani willis, will hold donald trump and anyone else who breaks the law in fulton county accountable. so, we are gonna allow this process to play out. at some point this week, he will be in fulton county in the fighting fifth so that he can present himself to our sheriff, sheriff patrick law by. there will be a mugshot, donald trump will go through the process like everyone else who's charged with a crime in fulton county. >> you know, the state of georgia politics is always fascinating, right? you have governor brian kemp, publicly pushing back on donald trump, even right after that indictment comes out, former lieutenant governor jeff duncan. i was there in fulton county last week, he testified for hours before that grand jury, calling trump, quote, one of the biggest mistakes this country is ever made. georgia secretary of state, ron raffensperger, famously rebuffing trump's efforts for him to, quote, find those votes. these are all republican officials. so, what do you make of that rift in the republican party in terms of politics in georgia from that cult of trump? >> well, what we also know, katie, governor brian kemp, he might be saying this or that about what he wants the republican party to talk about. this is political for him. he is not standing on the side of democracy, he's not standing on the side of making sure that everyone who wanted to cast illegal ballot is able to do so. let's not forget, brian kemp is the same republican governor who signed -- into law, we're currently litigating throughout this entire process. he's still of the party of donald trump, he's not condemned his party. what he's doing is trying to find a way to remain relevant so he can win elections. this should not be about elections. this should be about what is fair, just, and right. we should all be standing on the side of free and fair election process, not just when it benefits one party or another. and brian kemp is still the party of trump, he's still going along with all of the other things that trump is supporting. let's not forget all of the things he did to lead up to this. so, what we know is that the 2024 election is right around the corner. democrats are going to continue to show the country and georgians how we deliver every day for them because brian kemp, donald trump, and the republican party, they don't stand up for every day georgians. >> let's talk about efforts to maintain voter integrity and to protect the ability for people to exercise that right. you recently reintroduced the preventing election subversion act. this would institute new safeguards to protect state election officials from partisan pressure and to empower nonpartisan local election officials. this legislation may have an uphill battle in congress. but especially considering the legal landscape right now, why is it so important for this bill to pass? >> so, i mean, anyone listen to the story when sheamus and ruby freeman testified on january 6th, what they did was they showed up to work a job that every citizens show up to do, to be part of our democracy. this should have never been subjected to the things they were subjected to. we have to make sure we're, number one, keeping election workers safe, number two, giving our local jurisdictions, our county boards of elections, every tool in their tool book to make sure that everyone has access to the ballot. we should not allow one person or one party to come in and overturn the will of the voters. this election subversion act that's been reintroduced, it might have an uphill battle now, katie, but what i do know is that we are going to have another election cycle in 2024. when we're in the majority, under the leadership of a speaker, we will get voting rights legislation passed, including the voting rights, advancement act, and election subversion act, we can make sure that no matter where you live in this country, in about two years of coterie bank account, everyone has the same access to the ballot. >> congresswoman, i have less than a minute, i did want to ask something about the following. you know, donald trump, very publicly has a pattern of harassment, intimidation of women, and especially women of color. yeah, it looks like it's the women and the women of color especially that are standing up and saying, no. natasha brown, my last hour, saying these are defenders of democracy. what's your message to people that want to break the law regardless of whether or not they were the former president of the united states? i think she is just vying for that vp slight. >> sure she is. katie, please don't make me agree with marjorie taylor greene on the sunday morning. despite the fact i disagree with it great for years, she is right, there is no reason politically for donald trump to show up for the debate. you know, his evangelist like marjorie taylor greene, gaetz, they're there, they may cause some problems. i think the thing is, what is the contrast that donald trump went with those debates? it is telling that he said, there will be no surrender in georgia until sometime thursday and friday after the debate. suggest that even donald trump does not necessarily want the contracts of the debate to be his own arraignment in his own trial in georgia. he wants it to be that he is the former president, he is a candidate of one in this field, there are no others to consider. so, look, i don't know if the tucker carlson interview will be effective. i think what he's trying to frame is, i'm the only candidate in this race, i don't need to show up, i'm the former president. let me kick the sandbox for the night, all at them have their time. >> april, the dnc plans to run tv ads to purchase billboards, and to be on the ground to efforts counter arguments to republican criticism of the biden administration to, quote, put on display just how extreme and out of touch the republican candidates all are with the american people. do you think this is a strong enough strategy for them? >> well, i'm gonna tell you this, both sides, the dnc is gonna be buying, the rnc is gonna be buying. here is the issue for the dnc, they're looking at the spectacle of donald trump, that part. and then, they're looking at the spectacle of ron desantis in this moment who is trying to take attention off of his failures and put it on another candidate. and then, you have tim scott, who is upset with ron desantis over his comments about slavery. this is going to be a spectacle that the democrats are going to be able to use in their favor on wednesday night. i can't wait to see either side because what comes from it will also make the nation see the fractures in the republican party that the democrats are going to really put a spotlight on. >> david, the trump campaign is whining and complaining, saying they want an apology from governor ron desantis for a comment he made on an interview when he called trump supporters listless vessels, actually comparing that to when hillary clinton called republican supporters deplorables. i'm gonna tell you this, fox news is also dragging desantis for the comment that he made. is this further evidence that fox news is actually still in trump's corner? >> well, i think fox news is gonna try to have it both ways. it'll be interesting how they handle the rejection, donald trump left them at the altar after they begged him to participate in the debate, walked away and said no. i think something very telling about donald trump going after desantis this week. i expect all the other candidates to go after desantis as well. he is a candidate with a campaign on the ropes. he's falling, he has hit a ceiling, the interesting thing for all those other candidates on the stage, you don't get ahead in this race by trying to take down donald trump at the debate. you get ahead in this race by taking down round desantis. chris christie and hutchison will have their hits on donald trump, they won't be effective among gop polling, what will be affective among gop polling is to drag rhonda scent is down. donald trump knows that he's doing it from the top of the polls. i suspect all the other candidates will do it from the bottom of the polls to try to take down the florida governor. >> you know, april, explain something to me. isn't the point for the rnc to actually get a candidate who's gonna win the general? i just can't reconcile what's happening here. the rnc is playing fast and loose with how they're courting these candidates, signed the pledge, don't sign the pledge, all the stuff. isn't the point to win? it doesn't look like any of these other people, from the polls, i have a chance other than donald trump at this point. what's the thing that's gonna happen now? >> first republican debate, right? we still have a long way to go before the time we figure out who's actually the nominee. anything can happen. i mean, you have a president who could possibly be fingerprinted, well, he is going to be fingerprinted at some point. you don't know how that's gonna play in the american psyche, right? then, you have chris christie, who's gonna go after donald trump. then, you have ron desantis who's trying to find the light of day. you have so many people who are vying. at the end of the day, the republican party is trying to figure out how to make all of this and reconcile controversy, reconcile their flies in a moment where the nation is watching and see who they can support. at this moment, they're trying to make sure everyone supports the former president, as you said so eloquently. what is it? twice impeached, -- indicted and embarrassed beyond explanation. they're trying to figure out how to handle this moment. right now donald trump is looking like he could be the nominee. that can all change in a matter of days, weeks, who knows. maybe even january, march, or may. >> david, i am bringing you the popcorn for the chris christie part of this debate. i'm gonna be honest with you, i'm gonna bring it for that. but why not all of them just go for broke now? >> it's been definitely tough for us, you know, as i said, fortunately enough for me, all my family has not been impacted in a major way. but again, this is my heart, this is my soul, this is my route, this is where i was born and raised. growing up their, living in lahaina, laying sports there, it can't be easy. i have not been home, you know, and i was actually set to go home this week. but i decided to postpone, you know, kind of let the dust settle, and continue to help from afar, you know, and bringing awareness. i say to people, sometimes these things go away. as other new things come up. so, they will be asked to come on and continue to talk about, bring support to maui. >> well, of course. and let's talk about that continuing support. you are working to raise donations through your foundation. tell us a little bit more about those efforts. and tell our viewers what is really needed back there? >> i think for me, you know, initially, the relief and everyone stepping up back home, you know, initially with products and items that, you know, food, and i think for me the biggest part about this recovery in the long term is, you know, what i want people to understand is that area, you know, where a lot of these homes were built, these are multigenerational families, families that, you know, sometimes i had two, three, four families because of the cost of living there. so, for me, i think it's been amazing to watch, you know, i thank everybody around the world, you know, that has donated, that has stepped up, that has done everything we need, to kind of somewhat get us back on our feet as far as, you know, getting food, getting items, and getting, you know, things to that degree. the long term, you know, for me is that i think there's gonna be the cost of living there is not cheap. the rebuild is not gonna be cheap. the state, the federal government, and the counties are definitely stepping up and trying to find means, you know, to make it better for this community. i think for me that's the thing that i look at long term is that how can i continue to raise my money financially, to be able to make sure that the money is used correctly, and to help those people, that i said, they live paycheck to paycheck, multigenerational families. and, you know, i think for me, the other part of all of this is providing that education aspect of what it takes to recover, and what it takes to go on, and you know, send in the right documents, so that these families can, you know, get the need that they deserve. so, there is those things that i am focused on in the long term, how can i help these families to continue to get back on their feet. and not just get them back on their feet, is how we continue to move them forward. so, you know, it is, the cost of living is, you know, not cheap there. so, i think that's the part that i am focused on now is that how can i help to turn around the recovery. as you see in these videos, it's been amazing to watch the people step up. you don't, for me it's not shocking. i grew up there all my life. you know, stepping up for your neighbor, taking your shirt off for your neighbor, that's something we learned, and we've done our lives. so watching what happened there, with people on the ground, it's been actually very humbling and very heartening. to watch all these people step up. >> yes, and chain, i got less than a minute. but i want you to share with our viewers the heritage, the pride that you have in your home because you talk about multigenerational family is now being completely displaced. i have a particular interest, and my concerns about them being able to come back home to be able to afford to be able to get back there. some of whom have gone to the mainland because they have had nowhere else to go. share the beauty of what you know that island is?
