Right . People in Southern California are not used to a tropical storm. Almost everyone here has never experienced one. Authorities are trying to make sure people took the necessary precautions. They warned residents to make sure they had food and water. For those who live in low areas, know that it may flood in the neighborhoods. Get sandbags, protect your property as best as possible. Also have a plan, in place to go if your area floods. I honestly saw a message shared with one of the residents here coming from the Power Company. Asking them to be prepared for possible power outages. In fact i think the Power Company used language extended power outage that could come as a result. The number one concern is the possibility of flash floods once that rain gets here later this morning. As well a thumb california. There is also a large Homeless Population both in los angeles and san francisco. Authorities have been working hard to get a place for a lot of people on the streets. Three senior Law Enforcement official telling nbc news they are anticipating trump will turn himself in no earlier than thursday. That means by the end of this week we may witness and on precedent it moment in history. The first ever mugshot of a former president of the United States. In the meantime, one of his 18 codefendants, trumps ex white house Chief Of Staff mark meadows has filed a motion to dismiss citing immunity from prosecution. Ali retaliates live for us in Fulton County, georgia, this morning. Ali, all 19 defendants have until noon this friday to turn themselves in. So far not a single one has done so. Do we have any further insight into when we could possibly see that happen . Look, we are watching and we are waiting, katie. Both physically, outside the gates here of intake in Fulton County. Also, refreshing on an app that shows the names of people who are surrendering in the jail behind a. Of course, we know all of the defendants, trump included, have until friday to do that. You are right to point out that this indictment though it is the fourth we have seen of the former president , will look different in terms of what happens when he surrenders. Again, Law Enforcement tells us to expect that no sooner than thursday. Of course, we expect trump to be skipping the debate on wednesday where the rest of his republican rivals will be in a locky. And stand he will be doing some counter programming and most likely turning himself in here on thursday. Really, the reality is this is going to look different because of the fact that there will be much shots, there will be fingerprinting, the sheriffs inside the building behind me have made clear that just because it is a former president doesnt mean they are going to be changing the way that things are typically done here when people surrender for things that they have been indicted for. Of course it is different. You used the word unprecedented. I know that word seems to have lost meaning over the last five years but, it is unprecedented. A former president , someone still trying to run for another term in office and is leading the republican pack in the polls. So much so that he doesnt feel he needs to debate on wednesday. In fact he said there is little political upside to him doing that especially as all of his rivals what we want to make a moment at his expense. Even if he is not there, katie, you and i both know who will be looming over that stage. Both for the actions he took in the 2020 election. The indictments we have seen since then. Joining me now for the legal of all of this, glenn kirschner. Msnbc legal analyst, former federal prosecutor, and host of the Justice Matters podcast. Glenn, because Justice Matters, lets start with mark meadowss motion to dismiss. Filed late last night by him he is claiming the clause gives him immunity from prosecution. He preview that defense in the notice of removal sent to the federal judge in the Northern District of georgia in august 28th through an evidentiary hearing. I wanted to get your top thoughts on what you think are the chances of his success claiming immunity from prosecution because he was a federal official. You know why, katy . I think his chances of success are slim to none with a slim fading fast. I do not think the Supremacy Clause can be so stretched and contorted to say, okay, the constitution provides that the president and his criminal associates can attempt to reverse, corruptly reverse, the results of a president ial election because the constitution takes precedence over state law. That makes no sense. At its core, the Supremacy Clause says that if there is a conflict between, for example, a federal statute and a state statute, the federal statute, usually, will control. To say that, somehow, the Supremacy Clause should stand for the proposition that all of donald trump and his criminal associates, coconspirators, and now who is charged codefendants should, somehow, walk away from their crimes in violation of the laws of the United States, in a very real sense against our democracy, i do not think that will persuade any judge. Glenn, lets switch gears. Lets talk about the classified documents case. Judge cannon was meant to conduct a hearing on the 25th she has since continued this to a date unknown to us, in terms of the public. But she did Give Oliveira until august 22nd to submit his objections to the governments proposed protective order. This will govern the dissemination of the classified discovery in this case. I wanted to bring this to your attention and asked what you thought about that. The doj has said de oliveira, like walt nauta, their charges have nothing to do with classified documents. That is why they shouldnt have, quote, Unfettered Access which is exactly what nada delaware want. What are your thoughts on how judge cannon are going to manage these particular argument that are gonna come from both sides . I do not want to be unkind but i do not think she will manage them well. She has a track record, unfortunately, that involves the 11th Circuit Court of appeals ruling that she abused her judicial discretion. Doing something that the law does not allow to the extreme benefit of donald trump. Katie, i maintained the minute i saw those Appellate Court opinions that her impartiality can reasonably be questioned. The federal law provides that if a judges impartiality can reasonably be questioned, that does not mean that she cant be fair, she cant be impartial. But if there are reasonable questions that can be asked about her impartiality, she is required under federal law to recuse herself, to remove herself. Im still a little surprised we have not seen a motion to recuse filed by jack smith and his prosecutors. That may still come if she continues to make questionable rulings. I have a feeling, katie, that the documents case is on a slow train to nowhere. At least as compared to the federal prosecution of donald trump in d. C. The rico prosecution of donald trump and so many of his coconspirators and codefendants in georgia. Frankly, perhaps, even the criminal prosecution of donald trump in new york for all of his falsification of business records. Glenn, i have about one minute left. I wanted to ask you about the federal prosecution in d. C. What we are calling the federal interference case. The d. O. D. Presenting a 2024 trial date not set by the judge yet. Of course, what is fascinating is the doj has offered, we are prepared to get all of this discovery to the defense and they are not taking. It is there a concern that you have that that they and the discovery process may impact when this case is set for trial by judge chutkan . I have less concern. It is clear the defense team is trying to, intentionally, slow walk this case. Having tried murder cases against johnny chuck him when she was a public defender in the district of columbia, having followed her career ever since as a judge, she does not play. Right . She is not going to put up with the tricks of donald trump and his lawyers. I suspect that the next Court Hearing that she set for the 28th of this month at which time the Magistrate Judge announced that the arraignment she will be setting a trial date. One point he said my grandfather carried an old Poll Tax Receipt in his wallet remind him that the right to vote did not come easy and was not guaranteed. Talk me through why you feel this reminder of this moment in the nations history and why this oped was needed so much so now . Good morning, katie. Thank you for having me. I think we need to really recognize what we are up against in this moment. Yes, it is significant that we have a twice impeached president actually being charged, and as he should, around a conspiracy to actually overthrow, or change the results, of an election. There is a greater underlying question that we have right now. We need to recognize the fragility of democracy in this country right now. As i mentioned in my oped, my grandfather was born in 1905 in alabama. For years, the majority of his life, he could not vote. When he did get the right to vote, it was something that he had great pride in. He would dress up to be able to go to the voting polls. He would take be with him. He had such a sense of pride. What we have now, we are seeing leaders at the highest level a playbook from fascism, intimidating. Using the tool of intimidation, Election Workers and discouraging not only Election Workers but voters from not participating in the democratic process. What i want to do with the oped is to raise the alarm that this is much greater than trump. We need to stop attention to what is happening right now. Secondly, we need protection to make sure we are strengthening our democratic rights. And that we have protection around democratic rights. Three, we have to dramatically reimagine what it is going to take, to build a multiracial, multi generational democracy, the things we need in place to protect the interests and the interest of all individuals in this nation. Lets talk about that intimidation. In the many Election Workers have left those jobs, those positions, after facing political pressure or even facing threats of violence especially in the wake of the 2020 election. Fani willis is notable inclusion, i, think of harassed Election Workers ruby freeman and Shaye Moss Heights the highest Profile Effort for targeting this particular population. Do you think that this is just the start of accountability . I do. I think this is more in line with those being held account. One way that we hold them accountable is at the voters prove we have to show up and record numbers. Those leaders who have been bad players who have not supported democratic rights of the people of this nation, we have to hold them accountable and move them out of office. Secondly, we need a federal Voting Rights act. We have been screaming, as we have embarked on the 60th anniversary on the march on washington, one of the four parts and requests is that there was a Voting Rights act that was strong. The protection of Voting Rights, that we can actually have the protection of that. I think we need to revisit that, as well. Third, we need some additional tools to make sure that those who are actually doing this, they are held to account. I am really happy about the courage that fani willis is shown in georgia hold and to demand these people are held to account. Lets talk about why this is such an important moment. You have been on the ground not only in georgia but in other states making sure that the value of voters votes is not disenfranchised in any way. What does this mean to you that they are finally seeing days in court for what they have done . The people who violated this trust . Ruby friedman, this is a woman who makes 16 an hour. People showed up to her house to harass her. They wanted her to intimidate her and tell her to make a false statement. They were out helping her daughter. Looking at this process, this is a woman who now says she cant even go anywhere, feeling safe or accountable because she was targeted or harassed. 16 an hour. And the end of the day it takes a lot of courage for someone to actually be able to say, no, im gonna have integrity. Im gonna stand my grandma used to say, the truth will set you free. Is not only at that level, we see it all across the border. Even in the state of georgia there have been Election Officials who have the republicans of the state who basically took over the county Election Boards. We have been doing this for four years. They have been removed from the Election Boards in georgia. People like helen butler they have been doing this for over 20 plus years. They have been targeted and they removed off of the board. This attempt to say, oh no, we are just changing the board. We have had workers, ive actually had one of my employees who was simply out standing by, literally just telling people to register, go out and vote to have a gun pulled on her. That is happened several times. People are recognizing that we have those in the Republican Party who are using intimidation to every level. It has a severe impact on a National Security and here is why. Currently, you have three Service Chiefs that they are positioned their own filled right now. The vice chiefs who are due to a fleet up in those positions. They have not been confirmed yet. They are acting chiefs, currently. In their role as acting chiefs, they are also acting in their current roles in the vice of those positions. They are dual having it in this point time. By the way, general mark milley, the most senior military officer in our military. He will retire on the 30th of september. That position will be vacant. And if you go down the line, it is not just our Service Chiefs, it is the complete military where we have officers who are awaiting confirmation. If they are not confirmed, the incumbent in the current seat are being asked to retire. Some are saying no, there are vacancies there. Then you have acting positions because of vacancies. You have folks who may not be fully qualified serving those particular roles that are now being thrust into roles to serve as heads. Now go ahead a, oh you talk. No, no, please. Please go ahead. And we take a look at families, families are in limbo here. We have spouses who already uprooted families. They move every 1 to 2 years at the general officer. They are seeking employment. They cannot get employment at the next duty station. You have kids associated. They cant get to the next schools. They dont know where they are going. They are in limbo. This is just bad across the board. Not only for the firmest members, but also for the families, as well. I would like you to take a very quick listen to senator tuberville himself being unapologetic despite the risk of National Security and the Domino Effect it can have all the way down the line. He is unapologetic about the blockade. He said this at the interview last week. Take a quick listen. I think we will build even more support as time goes. Im not changing my mind. Schumer said yesterday he was not changing his mind, the white house said they werent changing their mind, the pentagon is not gonna change their mind. We are at a standstill. What is your response to someone like Tommy Tuberville to actually have such a massive impact on what happened in our Armed Services . I will tell you, one person being able to determine the progression of what happens in the military service, that does concern me. The other piece of this, we have to remember this is an all voluntary military force. There are no draft here. We have folks here who wait and get promoted. They have served our nation honorably for 30 years of war. Putting this on the back of our military Service Members, making the excuse that we have more general. Look, we have more generals. We need more generals. No one is trying to make extra generals here. All we are trying to do is have a Volunteer Force that is motivated, eager to serve, and who enjoys serving our nation. That is what these Service Members from private all the way up to general, we asked them to do more than anyone else. They go out, they put themselves in harms way. Family members sacrifice themselves by supporting their military Service Members. So, i would say, there is a better way to do this or to make your point. I think it is probably getting harder for him to believe that even he can bluster his way through four indictments, 91 criminal charges. As we have seen recently, he is going to try. I think one of the problems the far has been he has been treated differently from other criminal defendants. Hopefully, that will change this week. He will, finally, see what it looks like to be a criminal defendant in this country who is not treated like a privileged white man with power. Georgia cameras are allowed inside of the courtrooms, absent good cause to exclude them. We have seen there used so far through the unsealing of the indictment just last week. How do you think the presence of cameras inside the courtroom will impact the trial of donald trump . I think it is going to have an enormous impact. Even for people who are his supporters, who think this is a miscarriage of justice, this will be must tv. Donald has always told them not to believe theyre lying eyes, only to believe him. However, when he is the one they are looking at, it will be very difficult for him to spin away from what is actually happening in front of our eyes, right . I think it is going to be Monumentally Employee in that there are cameras, at the very least, in the Fulton County courtroom. I also think it is going to be something that donald himself is going to regret. I think his legal team has asked for cameras in the federal courtroom. I think, pretty quickly, they are teetering to find out that is really not something that wanted after all. After trumps indictment in Fulton County you tweeted the following. Saving a lot of americans a lot of money. It created a lot of revenue by reforming tax bills and incorporating a new 15 corporate minimum tax. However, what economists say is it did not do anything for the sure torments leash. And inflation, really, is another set of policies. Biden has been attacking the. That is a big deal. The Inflation Reduction Act is really a long time protection act. Kind of a carbon reduction act. Biden himself in recent weeks theyve been saying, maybe i shouldve called something else. It really wasnt inflation bill. Im gonna fact check you for a section there, noah. Inflation have gone down. As we noted, it went down to what i noted before. I will get that number again but lets move on to the core pillar. What is the core pillar of it and the president s continued investment in the american agenda . I think he sees bidenomics as investing. Showing that government had a role in americans everyday lives. Both at the cmt net and the Inflation Reduction Act is a lot of things like tax credit which allow incorporation to reinvest this separate piece of legislation which allows American Companies to continue to grow with government made an investment i think a lot of this comes down to marketing. One persons big Investment Bill is an important big spending bill. We look at the way the Biden Ministration has been selling this, they just have not been totally effective convincing americans that all of this spending is investment. Biden has not been, from the numbers, it looks like he has been a great salesman of his own policies. Even though most americans say they are in a better place than they were a few years ago, almost every economic mentoring the Biden Administration stacks up just as well or better than the Trump Administration did. Americans are still not there. Republicans, through their messaging, have been more effective on this. Polling show Americans Trust republicans more on the economy than the democrats right now.
