trump will surrender at and atlanta, georgia, jail. why the fbi is now investigating the threats for the grand jurors who voted for his fourth indictment. -- we have breaking down all of the latest legal development. classroom culture war. a new school year means new confusion for teachers over what they can and cannot teach. states like florida restricting lessons on race and sexuality. i will talk to a teacher who was so fed up, she quit. the grim reality of the post-roe world. a 13-year-old rape survivor forced to give birth after her state effectively outlawed abortion. the heartbreaking story that has galvanized the reproductive rights movement. all of that and more is coming up. >> we start this hour with new details on donald trump's fourth indictment. nbc news has learned that law enforcement officials are now expecting the former president to surrender to a fulton county jail no earlier than thursday of next week. fulton county d.a. fani willis as given trump, along with his 18 codefendants, until friday to voluntarily turn themselves to face charges related to overturning the 2020 election results in georgia. one is a trump lawyer and the lead architect behind the, so-called, fake electors scheme. this week, a review on january six showed -- the grounds of the capital, the day of the insurrection. the previously invoked fifth amendment when asked about investigators if he was in washington during that we. tensions are high around the georgia case would be an understatement. thanks to georgia state law, the names of fulton county grand jurors were revealed among the changes of that unsealed indictment. it didn't take long for their identities in person information to lead on line, as well. leading to harassment and threats of violence. now the fbi stepping in adjoining the fulton county sheriff's office to help investigate all of these threats. getting this hour started for us is nbc news correspondent, julie tsirkin, live from fulton county, georgia. julie, as of this morning, nbc now knows that donald trump is going to turn himself in, or plans to turn itself and to that jail no earlier than thursday. what more do we know about this purported timeline? as well as the surrender of his 18 other codefendants? >> katie, the timing is interesting. it is just a day after the first republican debate in milwaukee. the former president says he plans to skip accords plans can change when he plans now to turn himself in no earlier the next thursday. he has until midday, friday, the other 18 codefendants. liz brock either and i just went to the booking info to see if the defendants knock their way into the jail behind. me there is this and torrence. there's also a back and trans. none of them have been booked yet. the jail is open 24/7 for booking. they can really arrive anytime day or night. so far that has not happened yet. remember the judge that the deadline for next friday for them to do so. of course, as we move forward in the timeline here in the booking process we have a couple defendants who are actually trying to move this to a federal case. i am talking about mark meadows and his former chief of staff. his evidentiary meeting is that nine days from now to look into that. of course, we do not expect anything other than delays -- even if it does move to federal court, the parameters of undergoing to say the same. exactly as dea fani willis here outlined them. >> dea fani willis has proposed in a scheduling order that the arraignment for these 19 defendants take place that week of september 5th. she is also proposed a march for 2024 trial date. very fluid here but could we expect those dates to be cemented into place? >> katie, you know better than pretty much anybody that it case this large with so many defendants either one of them can make motions to appeal delaying the proposed trial day. delaying ornaments that are set to take place. at this case they are set to arrive two weeks after the booking is complete. the former president already taken to proof -- blasting the d.a. for setting the march 4th proposed date. that is just a day before super tuesday. basically the biggest primary event where primaries kick off in several key states where the republican election for the 2024 presidential race. trump is blasting that. funny with this as it multiple times that she wants the first hearing to happen within six months. some experts say is very ambitious considering the scope and the size of this case. also, the sprawling list of defendants here, any of which, like i, said could make a motion to delay, to appeal. conversations are ongoing. the judges and the parties have proposed dates. as we saw on the 2020 federal action against the former president, pushing to delay that trial until 2026, two years after the presidential election, we do expect him to continue making the motion in this case. trying to delay all of these trials, for simultaneous trials youth racing until after the 2024 presidential election. a race where he's currently still the gop front runner. >> julie tsirkin, thank you so much for getting us started in this nascar hour. i appreciated. joining me now is maya wylie, presidency of the leadership conference on civil and human rights. esidencyalso a civil rights att. maya, it is good to see you. let's stay with the fulton county case, before we talk about some of the other trump cases that are going on. you know, we have talked about protective orders. we have talked about gag orders, possibly, being imposed in other cases involving donald trump. we have heard the news. not only has the grandeurs in fulton county been threatened and doxxed online. but we also know that federal judge shotgun in that indictment against on trump has been threatened, texas woman has been arrested. do you think that there is a real possibility in the state of georgia rolling around the fulton county case that donald trump could be gag order? that he could provide some violence from happening? >> i certainly think it is a possibility. you know, katie, the sad thing here is this is exactly what we have seen in election cycles. the election cycles in and of themselves, we see a spike in violence and particularly arrests that are hate motivated. we see donald trump himself, both as a candidate back in 2015, and his system, who has been known to provoke violence. it is certainly possible. i expected to be something to be concerned about. remember one of the counts in the fulton county indictment includes the incitement of threats and violence against ruby freeman, a poll worker. >> maya, there was a promise made by donald trump that he was going to reveal, quote, a large and complex detailed, ain't irrefutable report to be revealed at a press conference. it was called off. trump posted on truth social. his lawyers will be putting on a legal filing. let's talk to law a bit. do you think he actually heated legal advice, maybe for the first time, from his lawyers telling him you are actually risking your defense the more you are putting out a theory of defense for people to see. >> yeah, that is the way it appears. it is impossible, of course, to know what is happening with those conversations. donald trump is someone who likes to talk. he likes to say what he wants to say. he does not like to be told what to say. we know that from his tweets, even if president. you can tell the difference between his own personal tweet versus ones that were crafted for him. we have seen this behavior from donald trump. you can even remember as early as james comey, he was fired for james comey. the ukraine crawls to president zelenskyy. he makes the statements and then he has all these public conversations about what they said, what they mean, sometimes he contradicts himself. he says different things. if you are an attorney, as you know, katie, the last thing you want is your client going around talking about a case. possibly saying inconsistent things. making promises that can't be kept. saying that there is evidence that is not evidence. all that does is damage your case. it is hard to imagine that if there was exculpatory evidence. the evidence was out there that would prove the donald trump had not committed a crime, it would have gone unnoticed or an stated by lawyers or by representatives. or by donald trump, themselves. all of these years leading up to these indictments. >> it specially in fulton county, maya. that was a two and a half year investigation by fani willis. one last question before we go to break. we are gonna stay unfolding county right now. rudy giuliani says he's gonna follow suit with mark meadows. the removal from federal court that meadows has done, what we expect on trump to do. eight of the 19 defendants in the fulton county indictment, maya, the lawyers putting aside the shame that they put to the profession that we have, do you think it is a viable thing for rudy giuliani to claim i may not have been a federal official but as acting at the behest of a federal official, that being donald trump, when i did the conduct alleged in this indictment. >> it is certainly hard to imagine that this will work. i certainly do not think it should. it's the same is rudy giuliani acting or pretending he is a white house counsel when he is a private citizen. steve mccann running around saying i have executive privilege when he wasn't a staff member the white house. you don't get to say your public official when you are not a public official. you did not get to say your public official because you had at one time or currently worked for a public official in the person's private capacity. to the extent that rudy giuliani holds himself up to an attorney of donald trump it is his private capacity. he was even saying that back when we had the first impeachment with his visit to the ukraine. trying to get a criminal prosecution started against hunter biden. all of that he made it publicly clear he was doing it in his private capacity. the only capacity he can have as someone who was not hired by the white house. >> maya, doing some throwback there. first impeachment? >> we are privileged to have what, we have a ton of mulch. myatt wylie staying with us for another block, so we can continue our conversations about donald trump? mountain. legal troubles. so, maya, let's switch gears now. let's talk about the classified documents case. it's kind of hard to keep track of everything because there's so much going on, but there is an upcoming hearing that is sealed to the public in front of judge aileen cannon. it's going to take place under cepa, a classified information procedures act, and i have to do with the protective order. do you anticipate, maya, that the outcome of this upcoming protective order hearing may actually influence whether or not this case goes to trial in may of 2024? >> you know, it certainly could. it's up to the judge on this case gets scheduled, and when the trial is actually held. there's no question that there are real concerns about the national security secrets that are in the documents, that donald trump unquestionably took to mar-a-lago. so, the question is whether or not it requires a significant amount of time -- the information in those documents and how they were handled, but i also think that protective order, in light of what we saw in the indictment itself, the fact that they were secrets that included our vulnerability to foreign attacks, as well as some of our allies, certainly suggest there's a need to be very cautious about those particular documents. >> yet, you know, maya, there has been the addition of a third codefendant or a third defendant in that indictment. we have carlos de oliviera. he finally got his local council. so, now they're officially in the mix. what about the arguments that are being made that walt nauta and carlos de oliviera, that their cases don't hinge on these classified documents? so according to the doj, you know what? everything that's happening with cepa doesn't have to do with them, so there shouldn't have to be a delay in terms of how this case progresses? >> yeah, i think it's a very clear argument that the government has. the issue of the allegations against the other codefendants are about obstruction. they're about blocking the government from getting the documents back, or understanding what documents existed, comply with subpoenas, none of that is about the substance of what goes in the documents themselves. but their behaviors around the documents. and that really is a big difference, and for sure, if you are a donald trump counsel, you are saying oh, look, we've got you know, thousands and thousands of hours of tapes and all these documents. , though they know what's in them as well. but in this case, that really is only the question of did they or did they not obstruct the federal government from getting those documents back or understanding whether or where those documents were stored? and that is a very subjective matter. >> and why, outlets switch gears now to the federal election interference case. honorary melber show, they were some exclusive footage about a danish documentary and, who we know from the select committee hearings, but it showed a longtime trump advisor roger stone plotting to override state election results just days after the election. that's not a secret, we know there were plans in trump world to lie about him losing the election before november of 2020 even rolled around. i want to talk about links. i want to talk about ties. roger stone, never indicted. roger stone, not even identified as an unidentified coconspirator in the election interference case. but do you think that with new information, and as america comes, out that special counsel jack smith is taking another look, in terms of tying donald trump to violence on january six? there's a reason, right, that special counsel jack smith didn't originally charge donald trump with the insurrection related criminal conduct. >> yeah, i mean, the one thing we know about jack smith and this team, the special counsel's team, if they don't stop. the work doesn't stop. they'll supersede an indictment if they need to. we'll bring new indictments. that's been clear. and their work has been ongoing. i think the question here is, you know, how much evidence and bandwidth and priority? [music playing] >> as students and teachers go back to school, they're also returning to the culture wars inside their classrooms. in georgia on thursday, a public school teacher in cobb county was fired for reading a book to fifth grade students about gender identity. in arkansas, a battle over ap african american studies is proving after the arkansas compartment of education attempted to pull the course from the states official offerings. citing quote, indoctrination concerns. and in florida, at the epicenter of conservative attacks on education, teachers are bracing for a year of confusion and understaffing. the florida education association, the states largest teachers union, claims there are nearly 7000 vacancies across the state. our next guest left her position after the states right wing policies took a toll on her mentally and physically. she told nbc news quote, that date they came through to vet my books, i passed out in class. my health was in jeopardy. my husband said, you need to get out of this job. joining me now, former florida high school english teacher, heather felton. heather, look. i've got a third grader in public schools in florida, and every year, i'm looking at more and more of her education being diminished by what's happening in our state. you had a plan to visit with a media specialist, and i put that in quotes, because i think that's just not a real job. and you removed about half of the 700 books you had in your classroom, because you were fearful that something was going to happen. you actually have a panic attack during that visit with media specialist. talk us through that day and why it ended up being the final straw for you. >> well, it was really just knowing that there was so much going on in my classroom at the time. i had an intern teacher. she was trying to teach. there's a class going on. the media specialist, who, she's wonderful, and has unfortunately not been able to do much of her own job because she spending so much time doing this vetting of books. she was going through all the classrooms. she came in, we are going through the cabinets, i'm showing where everything is. and a lot of it came back to, i was angry. and that's really, i think, what kicked off the panic attack. i was just angry that the state didn't, doesn't give us trust as teachers to know what is good for our students. i taught juniors and seniors. in high school. so, these are not small children. the books that i had in my classroom i had been gathering over nine, ten years. and putting them all together there, so students would have access to books during class. it's always a good thing when they finish a book. so, they have something else to do. and i had gone through the books myself, pulled out a bunch, our media specialists and her volunteer were coming in, and so it was just that anger that the state, the district, didn't trust us as teachers to know what we should and shouldn't have in our classrooms. and so my heart rate went up and everything just kind of, and i blacked out. >> heather, let's talk about the very real educational impacts. when teachers like you, who care, who are parents themselves, leave this profession because of what they are going through, what is the very real impact on children who are just trying to get a quality education in the public school system in florida? >> that's the rough thing. and that was really my biggest regret is i was leaving my students. it's hard on them. they are thrown into this state of flux. they don't know what's coming. they don't know what's going to happen next in their education. smaller kids, it may not be as impactful, other than the fact that they don't have enough teachers. but when you get to the older students and they are seeing their curriculum being cut. they are seeing the classes they want to take no longer offered, books that they want to read are no longer available, i had a student actually ask me, what is it they're trying to protect us from? why do they want us to be ignorant? and i didn't have an answer for that question. >> do you have a concern, heather, it's not just florida, or seeing a lot of republican-led legislatures and red states that the gop has held bent on making sure there's only one version of history that kids are going to learn. they're going to whitewash history and make sure it's only a particular version. they talk about and they complained about the quote, indoctrination that happens under the watch of somebody like you, a caring teacher, but we see that it's spreading. , so what are your fears about what's happening to the future of american children in the educational system? >> the biggest thing is they're missing out. we are limiting their education. we are taking away black history or whitewashing black history. we are pretending that lgbtq people do not exist. by removing books, references to them, from our schools. but and then our laws are making it even harder for lgbtq people, particularly transgender people, to be able to function in normal society. regulating where they can go to the bathroom, i mean, that is a basic human need. and so so much of this is aimed at being exclusive, and we're removing people from society by pretending they don't exist. you know, when we came out with our declaration of independence 200 plus years ago, life, liberty, and the pursuit of happiness. well, but not in florida, and not for all citizens. those lost that are being put into place are eliminating their rights to their liberty, and their pursuit of happiness. >> heather felton, i'm disappointed that you're not going to be a part of the educational system. i hope that you come back on behalf of children like mine, so that they have an education that is quality and from somebody who cares. thank you for joining me this morning. i appreciate it. >> thank you. >> coming up next, the reality of abortion restrictions. a mississippi rape victims forced to give birth that just 13 years old. due to her state's near total abortion ban. candidate for mississippi attorney general, greta kemp martin, on the disturbing reality of but turtle health care in post roe america. this is a story you cannot miss. so, keep it right here. you're watching msnbc. watching msnbc. ! you need sinex saline from vicks. just sinex, breathe, ahhhh! [sigh] now, powerwash gives me the power of an overnight soak in minutes. with 3 cleaning boosters... not found in traditional dish soaps that help break down, loosen and lift away food and grease... so much faster! >> nightmares becoming a reality for so many. disturbing real life horror stories are surfacing in states with the most restrictive abortion bans. in a story first reported by time magazine, this month, a girl only 13 years old gave birth after her mother said that her daughter was raped and impregnated by a stranger in clarksdale, mississippi last year. the girl could not get an abortion, and is now a mom, going into the seventh grade. the mother of the girl tried to find an abortion clinic, but the last provider in mississippi closed last summer. after the supreme court's decision, in dobbs forces jackson's women's health clinic. the closest abortion provider was in chicago, illinois, and that drive to chicago would have been more than nine hours from clarksville, mississippi, and ultimately, the mother decided it was too costly of a trip. today, mississippi, along with many of the states surrounding it, has a six-week abortion ban with-limited exceptions for rape or if a pregnancy is life-threatening. but these exceptions are rarely granted, and poorly tracked. joining me now, greta kemp martin, the location directed for disability rights mississippi and the democratic candidate for mississippi attorney general. greta, thanks for joining the show. first, i want to get your reaction to this incredibly heartbreaking story of a 13 year old girl who was raped, forced to give birth, and that was going to go into seventh grade? >> first, thank you for having the, katie. this is, unfortunately, a common story. what we are seeing in this post-dobbs landscape that was created by my opponent is that we have restricted policies across the strait that do not allow women to get the care they need, and even the exceptions that are in place are narrowly interpreted. in some cases, there are fearfully applied, and in this case in particular, it failed. so even though there is a rape exception to mississippi, even if the victims file a police report, it appears there is just no clear process for granting these exceptions on someone needs abortion care. >> and greta, to your point about these exceptions, in the beginning of this year, the new york times reported in your state of mississippi, those two exceptions existence that states abortion ban went into effect. but the state is requiring that a rape be reported to law enforcement in order to qualify for a legal abortion. you actually have to go to the police and be victimized again, in my opinion, but even if an exception is made, that person still must travel out of the state to even obtain the procedure that potentially could save her life. so, what needs to be done, greta, to ensure there is equity in not only abortion access and care, for everyone, including the most vulnerable residents living in your state,? >> well, i think my hope is that our federal government will eventually codify roe, and this will not be a problem. but as we stand in this post-dobbs world, i believe there has to be some broad interpretations of these exceptions. even the exception that allows an abortion -- we have physicians that are fearful of even utilizing that exception to treat their patients. they are afraid will be penalized, will be criminalized, don't have their license taken from them. so, these exceptions do not work. if you are going to place a 15-week abortion ban here in mississippi, you have to be able to apply these exceptions and cases like we are seeing here in clarksdale, mississippi, like we have seen across the country, where the wife or the mother has been at risk. we've had women being sit at the front lines until your life as an risk. i cannot adequately treat you. so, these exceptions have to be broadly interpreted, and honestly, we need more exceptions. if you're in mississippi, we do not have an incest exception. our lawmakers have spread that that will never happen in the state. if you're going to have exceptions for adequate care, you have to have them broadly interpreted. >> greta, that last abortion clinic in mississippi closed after dobbs came out last summer in 2022, but before, dobbs patients could drive to a memphis clinic that was only 90 minutes north, or to another clinic in jackson, just two and a half hours south. what are your mississippi residents telling you as you are campaigning to be the next a.g., about this attack on the reproductive rights? >> so, you know, i do not believe that mississippians position on abortion is clear cut as my opponent and hurt friends would like to think. right after dobbs in june of 2022, we had a slight majority of mississippians who actually disagreed with the decision to overturn roe v. wade. about 51%. and only about 18% of mississippi voters want abortion to be illegal in all cases. and as recently if june of this year, we have polling that says individuals that voted in the republican primary on august 8th, about 45% supported repealing the trigger law that bans most abortions in the state. plain and simple, mississippians, especially mississippi when, and do not want the government interfering in their medical decisions. and i think, time and time again, we are seeing that across the state, but our lawmakers and my opponent just continue to ignore the wishes of mississippians. >> greta, mississippi has the second highest maternal mature mortality rate in the united states, with 43 deaths per 100,000 live births. and black women in mississippi are four times as likely to die from pregnancy related complications as white women. so, what does this say about mississippi's priorities for reproductive health care as a whole? "my skin is so much more moisturized." see the difference with olay. >> so, what do you a secret burner phone, a secret email account, and a secret super accounts all have in common? well, the answer might surprise. you there actually not so secret and the more. after investigators revealed evidence in the impeachment case against texas attorney general, ken paxton. in less than three weeks, paxton faces a historic state senate impeachment trial over allegations he abused his office. he has denied any wrongdoing and is moving to have the charges dismissed, point pointing to a so-called forgiveness doctrine, a texas government code that states an official may not be removed from office after allegations made before they are elected or reelected, as in this case. but could these new allegations and evidence spell the end for paxton? joining me now is tony pulaski, investigative reporter at the austin american statesman. tony, run me through these new allegations. they sound like a very steamy, i don't know, many series or something. >> well, they do. but the landscape for all of this is that ken paxton is accused of helping and often investor by the name of nate paul and in exchange for that, received financial benefits. we're talking about an allegation that he received a home remodel and nate paul employed ken paxton's alleged mistress. so, all of these new revelations that are coming out speak to the depth and the intricacies of the relationship, the alleged relationship, between paxton and paul, and all of the steps that show they were in fact, intertwined over an extended period, while ken paxton allegedly was using his position and his office to benefit paul while under investigation, while paul was under investigation by the fbi. >> yeah, and tony, how could this new information, this new evidence being set forth by the impeachment managers impact paxton's defense? it is invocation of that forgiveness doctrine? >> one of the main reasons that we understand house investigators so strongly wanted this information made public is that paxton has said that because some of the allegations were known to voters, when they resoundingly reelected him, in 2022, then he can't be impeached on those allegations. that voters and his mind knew about the allegations and elected him anyway. but house managers say wait, not so fast. they may have known certain allegations, but there are far more at stance of claims that they believe that voters did not know and could not know, because according to them, ken paxton took numerous steps to conceal not only his relationship with this investor, nate paul, but also to conceal his activities, as you mentioned, katie, by using burner phones, anonymous email addresses, and fake uber accounts. >> >> yeah, and, tony another of the allegations as ken paxton was having an extramarital affair with a woman who ended up getting hired by nate paul's company. i bring that up because ken paxton's wife is actually a member of the texas state senate. she can't vote at the impeachment hearing, but her presence at the trial is still required, you've been as a non voter. so, what is she saying? i do know that she has, from what i've read, some influence on that texas state senate. >> she carries a lot of influence. she is obviously part of the paxton dynasty that reigns supreme or at least, previously, has reigned supreme here in texas and the reality is some of her friends and colleagues are in fact republican texas senators who will be faced with voting whether or not to dismiss her husband from office and, by the way, katie, not just dismiss him from office, but in fact, potentially banned him from ever serving texas voters. again >> paxton, as we know, has become somewhat of a darling for right wing republicans for his crackdown on issues like abortion access and immigration rights. but has this impeachment drama dented his light on the texas and national stages at all? >> this is a very interesting question, and frankly, something that's hard to pinpoint here on the ground in texas. perhaps the most important litmus test will be the impeachment trial and how those senators, 19 texas republican senators, vote. but katy, it was a very dramatic moment earlier this summer, when we saw a number of texas house republicans in fact, vote to move impeachment articles and to move this process into the senate. but what we also understand, and the aftermath of that, some of them have paid dearly, with being sanctioned by the republican party at their districts. so, in the minds of some of those house republicans, they have, in fact, we understand, sort of second-guessed their decision. but in terms of where the state republican voters really lie, regarding ken paxton, i think that question remains in the air. but again, the indication will be once this trial moves into the texas senate here on tuesday, september 5th. >> tony, so, set that table for our viewers. we now have this explosive new evidence that's been posted on the website online that people could look at in terms of the impeachment trial that is upcoming. can you kind of give us a timeline and what to expect in the event horizon?
