But that acceptance did not happen in the last election. Millions of americans fueled by the lies falsely believed that their votes had somehow, somewhere been stolen. A mob of supporters of Donald Trumps angrily stormed the u. S. Capitol attempting to take back what they falsely and erroneously in many instances criminally believed to have taken over from them. Now more than two and a half years later more than 1,000 of those individuals have been charged with crimes that they committed on that day and finally the man behind the lies has been criminally charged by the federal government and the state of georgia as well. Two separate indictments from special counsel jack smith and Fulton County District Attorney fani willis that came down 13 days apart. The indictment from Fulton County was Release Add Member of the january 6th select committee, Congressman Schiff posted, quote, so why does yet another indictment matter . Trump attempted to stay in power after losing reelection, that has never happened before in our history. If he is allowed to escape accountability for that, other president s will attempt to do the same. Voters need to know that their vote matters and elected officials need to know that they are not above the law. We cannot allow a president to seek to subvert an election and if they succeed they are president for life. And if they fail, theres no consequence. That is one sure way to lose our democracy. Which brings us back to a word we speak of on this Program Every single day, accountability. How without accountability our democracy will not survive. Trump is trying to avoid accountability. Still spreading his lies, still denying his loss, just last night his lawyers asked the judge overseeing the federal election case to push trumps trial back to april of 2026. When the judge ultimately decides to schedule the trial we will see whether what happens and we will see whether or not a jury of his peers convicts him. Thats all unclear at this point. These multiple indictments against the expresident have already been a massive step toward accountability. Accountability is where we begin the hour with our Friend Officer harry dunn the author of Standing My Ground a Capitol Police officers fight for accountability and good trouble after january 6. I know we made a date to be in studio together but i didnt want to wait another week until i was back to talk to you. Thank you for being here like this. Always good to be with you. I know there is this expectation that you will be like, yeah, accountability, but i feel like you know better than anybody that this is the beginning of a new beginning of the process, right . That what real accountability looks like in the best Case Scenario is still a long horizon away. How does it feel just to be at the beginning of the next phase of this . You know, thats a good question because i asked myself like, all right, now what . You know, hes been indicted in all these different states and jurisdictions and now just like now what . Now what do we do . Do we just wait . If he has his way it will be until 2026. Lord forbid that happens. But, you know, what do we do, just sit here and just deal with the trauma, be retraumatized, hearing all the actually, let me back up. Lets talk about the people that are defending him because those are the things that those people are looking to minimize the things that we went to that we went through. Michael fanone uses the line often i went to hell and back only for people to tell me that hell doesnt exist. So all these different defenses that people are going to use and people are going to be throwing at the wall to get them to stick, were just going to have to live with that. Its kind of like gaslighting us that what we went through didnt really happen. I dont like that we have to accept that. And i try to never do that here. I mean i dont. We dont. Right. We decent have to accept that. And thats playing on their terrain. I mean, i feel i think the way you do that the criminal Justice System kind of springing to life and engaging is an affirmation for reality on earth one. Its an affirmation that the physical violence and the ongoing trauma that you experienced are real, which nobody on earth one doubts, but you are contending with this alternate reality. I feel like every time there is any attempt to defend what trump did on that day or to call them ordinary tourists it is a front to all of you. Well, yeah, thats you have to think thats the game plan of what he did, what his supporters are doing. Theyre doing anything they can do to diminish is there a chance, is there any credibility to what these individuals are saying to what they went through. Look at the reason why people thought the vote was stolen, because these State Legislatures are doing everything in their power, within the law, to suppress the vote of people. So if theyre saying that people arent voting and theres no way that these lies are able to, you know, to grow and to they spread like wildfire, and thats why we get thats how we get what we got on january 6th. You know, you deal with sort of the whole petri dish, right, and the line with the anger with the racism is how january 6th happens but you put the lie in a petri dish with your face and your story and your truth and it sort of shrivels up and dies. How are we doing as a country . Do you feel like the petri dish with the lie and hate and racism is growing more quickly than the dish with the criminal accountability and the Truth Tellers like yourself . I will give myself a pat on the back for that. Not so much the january 6 stuff what he did on that day, me and my coworkers, the men and women of the police department, but not shutting up since then. Not letting the truth and my face die. Im not going anywhere. As long as people are pushing back theyre going to find resistance in myself refusing to shut up about what happened that day until, like you said, justice and accountability has happened. Which now they are trying to delay. If i was, you know, had the opportunity to claire my name in court, you best believe i would be on the first available date, lets make this happen, you know . Thats so interesting. None of his defenses are about defending himself on the facts, they are all about some political smear or political fabrication. Yeah. No. Absolutely. But thats the thing, like we know that it was a lie. The reason why im so confident in saying that, you know, donald trump is responsible for what happened that day is because the individuals who attacked us, not just us as in the law enforcement, but the american people, because thats what that building represents, the u. S. Capitol represents the american people. So when i say they attacked us, they attacked all of america. But the reason why i feel so confident saying that is because they told us with their own words, the reason they were there is because donald trump sent them there. You know, if he had some other facts or other truths, he should get the opportunity to say that instead of spewing all these different theories about, you know, Election Interference and all this stuff. You know, you had an interesting reaction, you credited Cassidy Hutchinson who was a very Senior Advisor to mark meadows, a west wing insider, but you credited her with telling the truth and telling the story of how january 6th happened. Talk about that. You know, i can that just brings the human inside of me. You know, im angry at a lot of people from that day for the failures of, you know, a lot of people dropped the ball that day, whether it be elected officials, whether it be intelligence gatherers, whether it be the president of the United States, whatever, but when it came time to do the right thing, when it came time to do the right thing again, a lot of people stepped up and Cassidy Hutchinson is one of them, especially after learning all the powerful individuals that were up against her, the people that were that she was in the room with and shes probably the youngest person in that room, probably a lot of times the only woman in that room and you just look at those those odds that she was against, you know. Ive got to show a little bit of grace and i appreciate her having the resolve to stand fast and tell her truth and tell her story, to also bring about these indictments that happened because honestly im no legal scholar like harry and your other panel are that were just on. Me, either. But i do know that i believe but a lot of these these indictments would not have happened without her coming forward so im appreciative of that. I think thats right. I mean, i also think about Adam Kinzinger and liz cheney, they were for trump until january 6th, they voted for him in november but they said overturning an election that you have lost is not just a line too far, but then they worked to shed truth on how that happened. Cassidy hutchinson is in the same category. But i want you know, at a human level, and i struggle with this every time bill barr who i think was one of the most damaging people to ever hold the office of Attorney General in our countrys history, says something about the strength of the governments case about donald trump, of course its news because he was such a willing accomplice, but i struggle with the coming late to protecting democracy, coming late to calling a lie a lie, in bill pars case coming late to calling bs, bs. Where does in your case showing grace for those people come from . The better late than never slogan or saying is the optimists way of looking at it. You know, the piss mist i guess thats the optimistic way of looking at it but the pessimistic way was you should have done it from the beginning. Right. And the realist part is where im at. Im mad at you for not doing it earlier but im glad you did it. Thats how democracy works, youre allowed to have different opinions within the law. Oppress people as much as you want within the law but once you cross the borderline of breaking the law thats when you take a stand. I guess youre legally right but morally its still reprehensible to me. I think thats exactly right. I mean, i am glad that Chris Christie is running against donald trump and the republican primary by making some of the same points you and i are, but he was his debate coach through 2020. He didnt quit after good people on both sides, he didnt walk away after he told the proud boys to stand back and stand by, he didnt leave and the access Hollywood Tape came out. Im still so mad that they didnt do something earlier. I guess what im hearing from you is that the fight is big, its about democracy and we have to welcome everybody to the side of protecting her . Yeah. Like we need all the allies you can get with this fight. Look how big look how much support donald trump has. You know, like we cant discredit that just because hes doing everything illegal under the sun, we cant discredit that and hope that is enough to win people over. He still has a ton of support. We need allies from all over if we want to preserve this experiment called democracy. We cant just, you know, take it for granted he broke the law, no way people are going to support. Yeah, his support is growing. After every indictment they do a new poll his numbers are up. This is maddening. But its a problem and it exists and we have to face it headon. I try to always check back in with you about how youre doing personally and i want to do that after i read you something that was news today. This is reported by nbc. Doj finds Police Officer suicide after january 6 attack was a death in the line of duty. Jeffrey smiths widow was informed by doj she is eligible for federal benefits. Last year the Public Safety officer support act was signed into law, it allows families of officers who die by suicide following traumatic events to receive death benefits. I guess another thing in the category, right, of better late than never. But i wonder i think its important to stay on these stories because it was traumatic and it was too much for some of the people involved. How are you doing . Yeah, im glad that you brought that up and officer Jeffrey Smiths widow, i will give her name, erin, erin and i we talk, were good friends, we check in with each other often. That was a big point. She fought her ass off to make that happen. I believe it was with Senator Duckworth that was also involved in that legislation. But, yes, the Human Element is still there. People lost their lives, people lost siblings, spouses, brothers, husbands, whatever, but, yes, the Human Element is very real. Im distracted now, how im doing, im distracted with all of these indictments and everything. So, you know, i guess thats a good thing, you know, that trauma and stuff never goes away. You know, but i always want to focus on i dont like to speculate and talk about things that i dont know about, you know, so thats why i feel confident coming on any show and any program and telling my story because that is what happened. Anything else is just speculation. So im distracted about these different indictments, but thats why i want to keep the Focus On Accountability and justice. And about the Human Element, if i may real quick, i did have an opportunity to talk to ruby freeman this week and just wish her well because the Human Element, you want to talk about that, you know, in her testimony she talked about she didnt even she lost her name. She didnt even want she didnt say her name when she was out ordering coffee or starbucks or something, you know . She used a fake name because she was scared that somebody would recognize her. But i will report to you all what she said, that shes hanging in there and doing as good as can be expected. Everybody keep her in your thoughts and prayers if you are religious. And you reached out to her on the day that she and her trauma was front and center. You had that conversation at the beginning of the week. I just wonder, i mean, you are you are sort of this bright light of connection. I mean, i think the other place where sort of the trauma and the darkness doesnt live is if we all band together and you are banded together with all of us, you keep telling your story, you keep us honest and keep us focused on this doesnt matter in a republican democrat way. I dont know if everyone that was hurt that day in your line of work was of one party or another. This is about connecting as human beings who see the facts as they are and you seem to do that rather effortlessly as well. I try because whats right is right and whats wrong is wrong. It should all be that simple. Thats it. Did the president break the law . Yes. Does he deserve to be held accountable . Yes. Thats it. Nothing more, nothing less. And then if people want to bring up like people want to bring up what about this . Okay. Lets deal with that on a individual basis. Dont try to lump all this stuff together. It could all be so simple. People are overcomplicating this stuff by bringing different factors into it. What are we doing here . You know, if somebody broke the law they need to be held accountable, republican, democrat, president , president s son, it doesnt matter. Like if they broke the law, hold them accountable, period. Everybody, even sitting at this table, fought a different battle that day, but it was all for the same war, and us black officers, i believe we fought a different battle also, and the fact that we had our race attacked and just because of the way we look, you know, to answer your question frankly, i guess it is america. It shouldnt be, but i guess thats the way that things are. Perfect clarity there that weve been talking about. The flagrant racism voiced by Trump Supporters on january 6th is a key feature of january 6th and in the ongoing attacks by the expresident and his supporters now, today, as they continue to verbally attack and threaten prosecutors and judges overseeing his criminal cases. U. S. District judge tanya chutkans life was threatened by a woman who referred to her using racial slurs we wont repeat here. Fulton county da fani willis says she has received numerous racist threats and she has warned her employees to stay alert. Eugene robinson in the Washington Post puts it like this, it was always a matter of time before threats against the Public Officials and everyday citizens who are Holding Trump accountable became explicitly violent and racist. The only question is whether the Republican Party is going to pretend not to notice, which is the same thing as actively joining in. Were back with officer harry dunn. I think that question has been answered, right . I mean, there are no republicans out there condemning Anything Trump says and that includes Mitch Mcconnell who wont condemn trump when he attacks his own wife with racial slurs. Where does that leave us in terms of our vulnerability to this toxic mix of the threat of violence and the racist attacks . You know, its interesting that you brought up the attacks on the former secretary, the racist attacks. Racism makes people uncomfortable, even if you are not the one being attacked by it, but if you are a bystander of it and you are just watching t its uncomfortable. So i do believe i do like what mr. Robinson just said, just standing by makes you kind of complicit i guess. Obviously its not as bad as hurling the words out, but its kind of like with anything. Silence is also like confirmation that youre doing it right, unless, you know, it needs to be condemned and needs to be spoken up against. Maybe it is as bad and i have to credit the writer and researcher with this petri dish, but if you are in Elementary School and there is a Bullying Incident you get treated the same whether you are the bullier or whether you stand around and watch the bullying. Standing around and doing nothing does have the same impact on the extremists. The extremists see a Permission Structure and i wonder if you have any faith that we can tackle that problem at the same time we pursue accountability for trump. But youve got to think about, though, im a big why person. Why do people just stand around . I posted a message on twitter, x, whatever, that i got it was the n word it was the n word spelled backwards and i submitted it to, you know, support and they said they didnt find anything wrong with it. People know that its wrong and why dont people speak out against it . Because they dont know what to say, they are afraid to say, kind of like im minding my business kind of thing. Why do people be quiet . I credit mike fanone again, he said indifference, until it affects them directly i dont have any skin in the game or its not my problem or i sure hope that it gets better for that person. Thoughts and prayers. I feel like thats what people do when it comes to racism. Thoughts and prayers instead of actively pushing back against it. The problem with that i mean, there are a million problems with that, but the problem is theyre coming for everyone, right . I mean, the racism was a feature of trumps original run for office, his slurs against mexicans, his good people on both sides of the kkk rally in the earliest years of his presidency, proud boys stand back and stand by. The problem is now his extremist policies have anyone with a womb or uterus at risk of a governmentmandated pregnancy. The rise in antisemitism, the rise in attacks against asian americans. Not anyone is spared and i wonder where you think the blinders come from that people think they wont be next. Well, thats the thing. I think this just goes back to we need all the allies that we can get. You know, men need to stand up for women in the fight for reproduction health, white people need to stand up for black people. All people need to stand up against antisemitism. You know, asian hate. We all have to stand up against with each other against those forces. And, yes, because everybody anybody can get it and, you know, whose turn is it next . So everybody has to band together. So thats why it goes back to what i was saying earlier, we need all the allies that we can get just because these people it sounds so outlandish, right, but people support it. People support it. Its like we are in this echo chamber. We have to acknowledge that these people exist. A lot of people lets block them out. No, theyre going to keep talking and theyre going to talk their ways to the statehouses and the legislatures and theyre going to be the ones writing the rules. Writing the rules and writing the laws. We have to get involved in this. Frank farguzi said something yesterday or something that we cant stand back. Everybody has to get involved in this. I wonder on the question of political violence, its another one that i think anyone in the arena understands how real and how close those threats are, but you lived it, right . They came for you physically and actually. And i wonder if you can just speak a little bit about how scary it is to be threatened or targeted with political violence. You know, it is scary and i believe, you know, thats why i actually chose the title for my book Standing My Ground because it isnt easy to do. Anybody could have just sat back and be quiet and sat down. I dont like referring to myself as this courageous or even no, not at all, but, you know, i was i am my moral compass is facing north and whatever happens i am okay with it because i believe that what im doing is the right thing and thats what works for me. Mark elias and katie kay join us. Mark, i like to ask broadly how democracy is doing. Today we have headlines, put them into context for us. Today is a good day, you know, within the last 48 hours you had in texas a federal judge strike down a key part of sv1 which was the mass Voter Suppression law that texas passed in 2021, you may remember democrats walked out of the capital to prevent it being passed. Then earlier today, nicolle, Georgia Federal Court struck down two provisions of georgia sb202, one the famed ban on food and water for voters waiting more a than 150 feet from the polling place, waiting in those long lines, that got struck down, and a Provision Requiring voter to put their date of birth on the outer envelope of their absentee ballot, a random provision that would have disenfranchised thousands of voters in georgia, those were struck down. Democracy is on the docket in courthouses around america and its winning and that is a message that people need to hear. What are the you know, sort of things that youre still watching . What keeps you up at night right now, mark . Look, what keeps me up at night is that as quickly and as conclusively as we are winning this other organizations are winning Voting Rights lawsuits and redistricting lawsuits you continue to see Republican Legislatures enact new restrictions on voting. For example, North Carolina the republicans there just enacted a massive Voter Suppression bill in that state, Governor Cooper will veto it, but i expect that the Republican Legislature will overcome that, will overcome that veto. So, you know, the Republican Party hasnt changed its stripes. If you look at the litigation that you mentioned from over the summer, you know, you saw republicans bringing litigation to overturn elections, republicans bringing litigation to overturn vote by mail. You know, it is just a constant, Constant Battle Where the only thing the Republican Party seems to be unified on is attacking democracy. You know, katty kay, i remember right after the 2020 election republicans calling me and saying you are so harsh on the Voter Suppression laws. What could you live with . Could you live with more Signature Requirements . And i said was there any fraud . They said, well, thats besides the point. Thats the whole point. There was no fraud. None of the Election Integrity laws are solving that problem that actually exists and the truth is after the contested 2000 election jim baker and president carter created an Election Fraud commission. They, too, found there was no fraud. Election fraud in our country at a scale that would change the outcome of elections doesnt happen. It isnt a thing. But the sort of infection and the wave and the momentum from propaganda and lies has us in this place where mark is busy every day playing whackamole and even when he wins these laws are predicated on a lie. Yeah, i mean, this is the virus that got pumped into the american system after the 2020 election when President Trump contested the results and wouldnt accept that the election had been free and fair. Court case after court case around the country found that indeed there was no fraud and, therefore, no need to amend laws because american elections were working fine. I mean, the problem with the virus that it undermines belief in democracy in this country and perhaps thats, you know, perhaps thats what theyre trying to do. So much so that i remembered it was a european think tank shortly after the 2020 election downgraded americas democracy from being ranked as a stable democracy to a flawed democracy. The separates is now ranked as a flawed democracy and its all because of the conspiracies that were spread around the country after the 2020 election. It does do real it does real damage to americas credibility at home and to the Election System here at home but it makes it harder for ma, to lead and to try to promote democracy around the world when it is only seen as a flawed democracy. Its such an important point, i think, to take ourselves out of it and look at how people view us. This may date me, but, mark, when i was coming up in republican politics a lot of Campaign Operatives in between cycles but it used to not go all year for four straight years would go and work on elections in fledgeling democracies. I mean, is a democracy project that is civic and educational and more than legal whats needed here and is that happening anywhere . Yeah, what im worried now is that the right wing and the maga republicans are exporting Voter Suppression around the world. There is at least some evidence that they are that they are exporting gerrymandering, for example, to places like great britain, but, you know, they are the great Tragedy Of American Democracy is that for many, many decades as imperfect as it was, it was marching in the right direction. Voting was getting easier. We were becoming freer and fairer and more inclusive in our elections and since donald trump took center stage of the Republican Party, it is not just that we have stalled our progress, its not just that we have even regressed, it is that the central animating theory of the Republican Party has been to suppress Voting Rights, to badmouth democracy, to criticize free and fair elections. And that is a project that will have ramifications beyond our own country and beyond our own time and its very worrying. We have to broaden that out with both of you nicolle go ahead. Its friday evening and im not usually the optimist on the program, especially when it comes to democracy in this country but i guess one thing that does give me cause for some sort of hope is that what we are seeing in the country is record numbers of people turning out to vote. So once you have systemic barriers being putting up to democracy you also have the American Public saying we actually want a say in this. In 2020 it was the highest Voting Turnout in america in 40 years. You have record numbers of women being elected to congress. So there are indications that the American Public sees whats going on and, you know, pun intended is actually voting with their feet and actually trying to take control of the situation and make sure that democracy is working for the maximum number of people. And the antidemocracy measures in ohio and the antichoice measures in kansas are failing. So when they are making a choice, they are choosing democracy. Reporter it is extraordinary because this is a chance to build a relationship between countries that individually have been very close to the United States, but, as you mention, there has been tension between japan and south korea. Coming together in a new kind of partnership that they believe will be helpful on Economic Issues that are shared, things like trying to have Early Warning systems on supply chain problems, we all lived through that during covid. Notably on the potential aggression that has been seen from china as well as north korea with all of its provocations and so one of the things theyre trying to do is have a relationship that is something less than the nato every Member Nation agreeing to come to the defense when one is threatened, but something thats moving in that direction. So if there are security threats between any of the country involved here, the u. S. , south korea, japan, they will consult each other swiftly, theres a new hotline being developed where the leaders can speak instantaneously. You know leaderlevel calls sometimes take a lot of groundwork before it rises to that point. This would be a way to close that time gap when there are urgent issues they need to discuss and a presumption that there would be common defense depending on the circumstances. It doesnt go as far as the nato ironclad agreement but it is really a move toward trying to add a new level of security in the indopacific region where the u. S. Has many economic interests and certainly these allies of the u. S. , that is their Home Neighborhood and they have a lot at stake. It was important for the substance, important in the setting, camp david is used by president s when they believe there is a Pivotal Moment to have, where diplomacy needs that extra push of coming to the president ial retreat, a place that the relaxing and historic.
