Nbcs tom llamas spoke with the family a 79yearold who was identified yesterday. Reporter remembering the man who for decades was the rhythm of lahaina. Music was the love of his life. Buddy jantoc spent life as a musician, touring country before settling down in his forever home of lahaina. Theyre sharing memories like this of uncle buddy playing weekend gigs at lahainas cannery mall. He was always smiling, always laughing. This as nbc news has reviewed a lawsuit accusing Hawaiian Electric of years of inaction and negligence, arguing it should have been planning to shut down Power Systems before the damaging winds hit. The Hawaiian Electric company declined to comment on the pending lawsuit. Nbcs Steve Patterson joins us this morning from maui. What more do we know about that suit and the investigation into the fires . Reporter jose, well start with the suit. It alleges gross incompetence and negligence, essentially. We heard, of course, since, you know, since the suits started, that there should have been a shutoff, that in essence when you have a wind event, you have 45mileanhour sustained winds predicted in the forecast on top of 60mileanhour gusts on top of dry brush that covers this island, there is the likelihood that a fire could start. And it could be a catastrophic fire and thats exactly what it was. What were also starting to understand sort of the depth of these lawsuits, alleging that there were Management Decisions that were made or maybe more importantly not made over years, talking about the sustainability of the grid and how it should have been hardened and strengthened, talking about Management Decisions that were made to prioritize what likelihood there would be a fire in the event of a major wind event. And so all of that is looked at, it is all part of that lawsuit. Meanwhile, there is more on the investigation about the conduct during the actual fire, during and before, i should say. We know that the State Attorney General will be conducting that investigation, that should be in effect widespread, there should be the availability of interviews and evidence that will be taken in. But also the legislature is pushing for the Attorney General to have a Third Party Investigator take on that. In case there are sort of any dilemmas or discrepancies that need to be addressed as well. So, all of this sort of going into what we have been hearing from residents and what we have been hearing from people on the ground who want more accountability, not only from public officials, but for the Emergency Managers who were in charge and were in charge at the time of this fire broke out. Jose . And, steve, as we speak to you, it is 5 03 in the morning your time. Some kids are going to be heading Back To School in maui maui . Reporter yeah, im glad you asked me. There is some good news. You can see behind me, the roads have started to open as of yesterday. The main thorough fare in the lahaina back open for everybody. And about an hour that will be completely open once again, sending traffic flowing back into town. But kids are going Back To Schools as well. It is a difficult process. Especially for people that lived there to try to get their kids to essentially what will be a separate school district. Were hearing three schools within lahaina almost actually completely survived. Theyre completely in tact. They have to do some Water Testing and air quality testing, but that is certainly good news for kids that could be going to those districts or to those schools as theyre able to determine that theyre safe. All sort of giving you signs of life that things are sort of starting to return as this horrific Search And Rescue and recovery effort is happening there in town as well. Jose . Steve patterson, thank you so very much. Joining us now from hawaii, Aubrey Velosas who survived the wildfires, a mother of three who lost everything in the wildfires except one photo. Aubrey, i cant even begin to tell you how much we all feel for you and for the so many people, families that have been so affected by this. But tell us a little bit about, well, what you went through, just a week ago. Well, i went through just like everybody else, we were on the loop of not having to evacuate because the fire was contained, apparently. That was what we were told. And our guards were down. We didnt have plan our whole evacuation. We were doing our normal day playing, cleaning, trying to entertain the kids because there was no school that day. And when the fire alarm went on in our house, the whole community started panicking outside because black smoke was just overtaking the whole community. And we didnt even realize that we have to evacuate. There was no warning. There was no Police Officer going to our neighborhood asking us to take our belongings or evacuate. So we had to we had to tell ourself that we have to go. And most people in my community, in my neighborhood, was just watering their plants, and trying to water their garden when we were evacuating. But there were all black smoke. So when i took my children out of the house, i didnt even i didnt even take any valuables with me. I just took my baby. Shes 10 months old. I was breastfeeding at that moment, and my twin daughters who are 6 years old, my partner took them and my mom got the van ready. We were all in the house. And we got in the van. And we were trying to move to our next familys house, which is five minutes away, which took us about two hours to get there. Five minutes away, took you two hours. It was just that chaotic and you ended up, unfortunately, the house that you were in is gone . My house is gone. The second house that we went to, which is t. C. , my partners house, and his grandparents house all connected are also gone. It took about four hours, again, for us to evacuate. And that second evacuation we had warning from the Police Officer to leave the property. So we went again to another yet evacuation and my house, my partners grandparents house and his parents are all gone. And we didnt take any belongings with us. My t. C. s parents happened to be in alaska at that time. So they were not able to take any valuables outside of their house. So nothing was saved except for our own lives, my children and my mom and all of the loved ones i know were all saved, which is thank god. And when i found that picture in go ahead. No, no. Im sorry. I saw everything gone except for that one picture and were looking at it right now. It is a little bit of that picture, the corner there is burnt, but it is clear. What does this picture mean to you and how did you find out it was there . A friend of mine was a fireman contacted me two days, maybe contacted me earlier, but i have no signal. All of Lahaina Electricity was down. And when he was trying to reach out to see if that was me, i said, oh, my gosh, that is me. And i asked him he found the picture. He said, i didnt, it was on social media, circulating. And they found the picture in lanai island, 40 miles from maui island. And i cannot believe it because i still have the hope the next following day that maybe the house is just burned outside, and that because we cannot go back to the residence. We were not allowed to go back. When we evacuated the first house, i was thinking i could still go back and just drop off the kids to the second house and come back for valuables, but the Police Officers were all saying there is no way we can go back. The next following day, we thought that we could go back to the second house at least to take some valuables, and we couldnt go back too. So i have that hope that something in the house is still in tact. But then when i found the picture, that was when all i realized everything is gone. Because that picture was on my daughters room, really thick album, and if its all the way in lanai island, a separate island, found, that means my house exploded, because we have a car parked in the garage, full tank, and i realize it was all gone. But it gave me hope though too because my great grandmother who raised me from most of my childhood has this way of telling me that everything is going to be okay. And i think that was her way, the one in the glasses, that was her way of telling me that i will get far too, even if there is scar on that fire that happened on 8 08, which is our phone number, 808, even though there is scars around, ill be fine, just like the picture, ill get far and everything will be okay. And i hope in my community as well that they find their hope just like i did. That everything will be okay. Yeah. Aubrey, i cant thank you enough for being with us. On wednesday, a woman was arrested in texas after she left a threatening racist voice mail to judge tanya chutkan, who is presiding over the federal election case from Special Counsel jack smith. An affidavit alleges the woman made a direct threat to kill judge chutkan. She now faces a charge of transmitting a threat to injure a person via interstate commerce. Meanwhile, Donald Trumps 2024 legal calendar is filling up. Now that Fulton County d. A. Fani willis Proposed A March 4th start date for the trial against the former president. That date falls on the eve of super tuesday, when multiple states have their primaries. It also falls right in between the proposed start date for the 2020 federal election trial and the classified documents case. Joining us now, nbc news correspondent Garrett Haake from atlanta for us, nbc news justice and intelligence correspondent ken dilanian and charles coleman, former brooklyn, new york, prosecutor and msnbc legal analyst. Ken, threats against judges have escalated into real harm. The killing of a son of u. S. District judge salas, another man arrested with a knife and a gun last year near the house of Justice Brett kavanaugh what do we know about this threat against judge chutkan . According to court papers, jose, abigail jo shry, 33, lives in alvin, texas, south of houston, called the chambers of judge chutkan after hours one evening and made this racist threat. Called her a stupid slave and the n word and then said we are coming to kill you. Essentially. And if donald trump is not elected, you will be targeted. The department of Homeland Security took this very seriously. Went to pay her a visit. She acknowledged making a threat. She said she didnt intend to act on those threats, but nonetheless, shes now charged and it emerged in the Court Proceedings against her that she had been previously arrested four times for making similar kinds of threats. I think what is notable here, jose, is that donald trump hasnt said a word about this case in condemnation or otherwise as he did not when the fbi shot and killed another one of his supporters who was armed in utah and threatening to assassinate joe biden. So were in a climate here where a group of people on the fringes are taking what they see on media and on social media literally and to heart and becoming very angry and some of the people that are ginning them up are not doing anything to lower the temperature, jose. So, ken, a fringe website that features violent rhetoric posted the purported personal information on monday in georgia. What do we know about this . This is another example of the climate were in right now. In georgia, unusual, the names of grand jurors are made public. Normally theyre secret. This group of Trump Supporters took these names, did some internet research, and doxxed them, published their addresses and identifying information on fringe websites. Were not going to disclose the websites because we dont want to advance and encourage this information. But it is no doubt a really Troubling Development for them and their families and for Law Enforcement and it sort of speaks to the kind of climate that were in and the use of the internet to really try to harm people. So, wait, just to get an update on this, in the state of georgia, the grand jurors in whatever case, their public their information is made public or just their names . Just their names, jose. So that obviously made it very easy for people to do some research and gather their addresses and other personally identifying information and publish them. The idea that their names are made public seems like a relic of a distant age and maybe georgia officials are taking another look at that policy. This is that has happened as a result and it is probably very concerning for them and their families. Indeed. Garrett, meanwhile, the d. A. Proposed a march 4th start date. What happens next . We have not seen any of the 19 people indicted in this case even show up to surrender. Thats the first real deadline at noon on friday. All of these folks are expected to surrender and in georgia, that process is separated from the Arraignment Process so the due date for that would be two weeks later, basically the week of labor day, september 5th. They would be expected to be arraigned. After that, well see if this trial date gets under way. As you pointed out in the top segment here, it is a very busy calendar for the former president next year between the political and the legal. March 4th, the proposed trial date here. March 5th, super tuesday. And the one thing that has been consistent across all of Donald Trumps various legal teams in various cases has been the effort to delay. And to push back trial dates as far as they possibly can. Trump has posted about that on social media, repeatedly. Even today, suggesting he doesnt want to see this trial or any others start until after the president ial election. I wouldnt be surprised if we see filings to that fact from his attorneys sooner rather than later. They dont want to do this anytime in the primary or the general election if they can possibly avoid it. So, charles, not withstanding what the former president may or may not want, how likely is it this case goes to trial on the 4th of march . Well, jose, i do think that the 4th Of March Next year for a case like this is a potentially plausible date. I do think it is a viable schedule. I dont necessarily it will hold. What i expect Donald Trumps defense team to do in this series of cases is to use the furthest date out, which currently we have in the maralago case under judge collins in south florida, that being may 20th, 2024, as the benchmark date and try to get the other cases he has and continues to accrue to follow that case. Essentially that they call in the legal space tracking. So those cases will track that initial case, number one, because it is the first one that is filed. Thats their argument. But then number two, theyre also going to be secretly pushing for that because right now thats the date that is furthest out. It is important to understand, however, that none of the judges in this case in these other cases are bound by that date. They dont have to let their case track. This other case. If they feel like, look, these other criminal cases are ready to go, especially because fani willis is on the state level and jack smith is on a federal level, they can move those cases along and move them forward. So, that march date could potentially move forward, even as there may be some delays. I do think it is a viable schedule. But i do expect that Donald Trumps team will continue to try and delay. Funeral services will be held today in indiana for a child who died on a bus traveling from texas to illinois. He would have turned 4 next week. The Illinois Department of Human Services says a partially state funded program will cover burial costs. The child died at a hospital in Southern Illinois on august 10th after falling ill on a bus traveling to chicago. Authorities investigating what led to her death. This is the first death reported since texas began shuttling thousands of migrants from the border last year. The humanitarian crisis at the Southern Border is also sparking new battles, hundreds of miles away. New york city mayor eric adams says the unprecedented number of Asylum Seekers arriving in the city left it at a, quote, breaking point. Hes facing sharp criticism from new York Governor Kathy Hochul whose lawyers sent a scathing letter saying the city has failed to accept the states offers for assistance and should do more to act in a proactive manner. The mayor responding to the governor during an event on wednesday. The governor and i have constantly talked about our coordination. So if her observation is that here is some things you can do differently, were all in. People who depict that letter as a brutal attack against us, you know, thats how people want to see the governor and i fight. Thats not going to happen. Nbc News National correspondent Gabe Gutierrez is following the story. He joins us this morning. So, gabe, what more does the city need to take care of these Asylum Seekers . Reporter well, hi there, jose, good morning. As you know, the city has been seeing this increasing number of Asylum Seekers and hit a new milestone. More than 100,000 migrants have arrived in the city since spring of last year and there is growing outrage, a protest last night at a new Migrant Facility that is set to open in queens. And actually, jose, a few moments before we came on the air right now, we spoke with a Business Owner here, right next to the roosevelt hotel, this iconic hotel in midtown manhattan. He said his business has been destroyed because of hundreds of migrants that are being housed here in the roosevelt hotel. I spoke with one of those migrants yesterday, karla, from ecuador, she tells us she has been living here for two months and she is with her 4yearold daughter here, very grateful to be staying here, but just wants an opportunity to work and i asked her about her experience and how shes faring. Take a listen. Whats your message for the mayor . [ speaking in a nonenglish language ] reporter she told us, jose, she wanted the opportunity to work and thats something we heard over and over again, but mayor eric adams has been blasting the Biden Administration and asking for expedited work permits for the migrants, something that has been shared by the new York Attorney general as well. The white house for its part has declined to say whether it might consider a federal disaster declaration, which republicans as well as local officials have been asking for. But the white house does point out that the administration has sent more than 100 million in aid to new york city. But this is something that is playing out across the country, not just in new york. Massachusetts governor just declared a State Of Emergency earlier this month and mentioned that tragic story of a 3yearold child dying while traveling from texas to chicago. Here in new york, officials estimate that this will cost City Taxpayers more than 12 billion by 2025. Gabe gutierrez in new york city. Now to new reporting on how the floating Barrier Texas put up in the rio grande to block migrants from crossing into the u. S. Came to be. Nbc news learned the idea for the floating buoys first came during the Trump Administration. Earlier this month, two migrants found dead after drowning in the rio grande near the buoys. Texas says it appears one of the people drowned upstream and the body floated into the buoys. The Biden Administration sued texas to remove those buoys saying it raises humanitarian concerns and poses a risk to public safety. Nbc news Homeland Security correspondent Julia Ainsley is with us this morning. Good morning. How did this idea come about . Well, this started in early 2020 at the end of the Trump Administration, they started to look at vendors who could build these buoys. They were running into a problem in texas, where the wall was having to go over a lot of private land, they couldnt get permission to build the wall, they thought lets build this buoy system. They went out for contractors, of course. I dont have to tell you what happened later on in 2020. The covid19 pandemic surged and they put that on hold. They later canceled the projects because biden was taking office and his administration didnt want anything to do with any kind of barrier along the wall. Buoy or wall along the border. But one of the people who was in this office at the time, michael banks, is now working as governor, Texas Governor greg abbotts border czar. He can bring tactical policies that they had. Think of Steven Miller handling a lot of the legal pieces, how they could burn certain migrants from coming into the u. S. , michael banks, im told, did a lot of the tactical pieces and when he came in, in january of this year, they started working on this idea of putting up more buoys at the Southern Border. The most interesting part of this, it is not just looking back, jose, it is that texas is building these buoys with the exact same specifications that the Trump Administration would have and any continuation theyre doing along the border wall is so that a future Trump Administration can expand these projects in the exact same way, jose. Im told it is gearing up for a future Trump Administration or another president who would be another immigration hardliner. Julia ainsley, thank you so very much for that update. Turning now to an update on reproductive rights. Yesterday, a federal Appeals Court upheld parts of a decision limiting access to mifepristone. In a win for abortion opponents, the judges determined the fda did not adequately account for safety concerns when it expanded access to the pill in 2016. But the Supreme Court has required the drug remain available until the Appeals Process is completed. The Justice Department said it, quote, strongly disagrees with the decision and will appeal. This morning, students in miamidade, florida, returned for their first day of school, amid a new fight over their states curriculum. On wednesday, dozens of protesters marched to the miamidade school board to rally against floridas new academic standards for black history teaching. Under the new guidelines, teachers will be required to instruct students that some enslaved people, quote, developed skills which in some inskan instances could be applied for their personal benefit. What led you to organize these protests . Im angry. Black america is angry. Our history is being assaulted by desantis and this idea of slaves having personal benefits has been especially harmful and insulting. How can a slave in america consider to profit and have personal benefits . American slavery was particularly evil, jose, because it was the only system of slavery in which the enslaved were not considered to be persons, but property. We find this very insulting. And thats why were demonstrating and well continue to do that. Yeah, i mean, it is so important to highlight what youre saying. How can there be anything of any benefit when the concept that people were not people is the starting point to everything. And when you talk to fellow teachers, what do you see and what do they see as the impact these changes could have . It is chilling on teachers. They cannot teach in a normal way they teach. Theyre afraid to teach, you cant blame them. But desantis is to have thrown a blanket over education that is suffering education in our state and teachers are very upset about it. Is there something, marvin go ahead. Yeah, go ahead. No, no, go ahead. I was going to say, one of the things that we find so upsetting is that theyre being required to teach lies, theyre being required by these new standards to teach the lie that was black on white racial violence in florida. Those are lies. We need to help them understand that really happened. We cannot allow these lies to be taught to our children. So, what changes are you asking for . Well, one thing they need to do is revisit the standards. And not by the group of clowns that did this in the first place. The people that desantis is listening to, these black scholars he claims hes listening to, these are Clarence Thomas type extreme republican blacks who are feeding these things to the governor. One of these people, one of these scholars that desantis is relying upon says she is grateful for slavery, she could be in africa worshipping a tree. These are people that desantis is listening to. Member of the team tell me they are certain there are lives that were saved just by the existence of this new unit and this is the first step in addressing what everyone acknowledges is a growing Mental Health crisis. Its not the answer because it still involves the police, and we know that Community Members who have been traumatized are not going to trust that. I would much rather our officers not have to engage in the Mental Health crisis, but its here. Youre forced to do it. Were forced to do it, and we shall do it. You hear some overlap there between the police chief and the Community Members. They acknowledge that this is a serious problem, but how much should police be involved rather than how much a Behavior Specialist or medic should be involved and thats where the difference is. This is a program that is expanding not just in detroit, but they say theyre hearing and getting calls from other areas in other jurisdictions, jose. Shaquille brewster, thank you so very much. Youre seeing the engine of a southwest flight in flaps shortly after takeoff in houston. The plane was able to return and land safely. It suffered mechanical issues and the flight continued the flight to cancun.
