as we speak, search and rescue workers trying to find 1,300 people still unaccounted for. the governor saying the vast majority of victims that have already been found were burned so badly they'll have to be identified through dna. the latest on the search and the president's plan to head to hawaii coming up. and the really sick trend of swatting synagogue ss fueling new fears among jewish congregations. threatening calls are made during services being live streamed so the suspects can watch crimes unfold at realtime. all this with anti-semitic incidents at their highest level in decades. but we start with donald trump, legally bound to surrender to authorities at the fulton county jail in atlanta sometime between now and next friday at noon. with that jail open 24/7, the how and particularly when are still up to him. could he try to slip in under cover of darkness, will he want to get it over with or wait until the last possible minute. there's one more fascinating possibility, could he try to steal the media spotlight from his republican competitors by surrendering smack dab in the middle of wednesday's debate. no matter when he chooses to arrive, once there the process is automatic. he'll be booked, fingerprinted, have his mug shot taken, a first for the ex-president. throughout the morning, he's kept up his version of a defense on social media, attacking the officials who indicted him while also releasing this video portraying himself as their victim. >> the test of a man is how much he will bear for a cause which he knows to be right. how long will he stand in the depths of despair? how much will he suffer and fight? >>. >> i want to bring in nbc's vaughn hillyard who's been following off of this. greg blue steen, an msnbc political contributor, and carol lam is a former federal prosecutor and an msnbc legal analyst. so vaughn, what's the latest from trump world? do we have any insight into the discussions about trump's next move, or as everyone's waiting to hear what the timing of his surrender might be. >> right, we know there are deliberations that were continuing overnight into exactly when he will come down here to georgia. we know that he will be going to a fundraiser in nashville tomorrow, so potentially thursday or friday are still possibilities, though we have seen in past obviously a great amount of protocol and preparation made ahead of his actual movements for his arraignments, and i think that's an important point here is that in georgia he will not only have to surrender here at the fulton county jail, but he will also have to take part in an arraignment, and those events could take -- happen at two different times and the arraignment could potentially be waived. it could potentially happen virtually. we're working on better understanding the actual mechanics of this here. we know that the secret service has been in touch with the sheriff's office. the sheriff had previously suggested that he would treat each of the defendants coming from this potential indictment the same way he would treat anybody else that would come in for their formal booking. that would mean a mug shot. that would mean fingerprinting, and as you said, the jail is open 24 hours a day and the deadline was given by the prosecutors was next friday here. so with the debate on the line, ultimately if they do try to arrange with officials here an arraignment and a surrendering, the official booking to be happening, ultimately that will also be determined based on the judge's availability. we should expect this to appear on the court docket, when the arraignment is formally filed here. there are a lot of outstanding questions. the trump team are very much reliant on the legal stipulations that must be met here over the course of the next anyone days as well. >> greg, what else can you tell us about how this will all unfold at the jail and frankly, about the jail itself? >> yeah, well, donald trump can waiver his first court appearance, but he cannot waive the surrender as vaughn said. he is going to have to show up at the fulton county jail between now and next friday at noon. my hunch is he's not going to go under the cover of night, and i know you mentioned at the top of the show there's a chance he could do it on the day next wednesday, and that's what the political minds here in georgia are all talking about. the possibility that he could do counterprogramming to the debate. the fulton county jail is not a place you'd wish upon even one of your worst enemies. it is full of -- there's been civil rights complaints. there's been a legal settlement involving someone who recently died there involving a bedbug infestation. it is not a place where we expect donald trump to spend much time there. it's already overcrowded, already plagued with all sorts of problems. the fulton county sheriff said they're going to treat him like any other defendant, all signs point to fingerprinting and possibly a mug shot. >> but he would, i assume, greg, he would be in and out really quickly? >> very quickly, yeah. we do not -- they'd have to move, dozens, maybe hundreds of prisoners, inmates just to accommodate him in a cell. i don't think he's going to spend much more than a few minutes there. >> all right, carol, there's a lot going on legally. we saw a move by mark meadows who filed to have his case moved out of state court to federal court. rudy giuliani made the same case on television last night. let me play that. >> the case should be immediately removed to the federal court under a statute i really doubt she thought about. i don't know if she thinks of it, and that would be 28 united states code section 1442, paren a. which says that any case involving a federal official or one acting on behalf of a federal official should be removed to federal court and it should be done liberally and broadly. the presumption should be in favor of removal. so we should all file a motion in the federal court to remove the case from her and the georgia court, ask for a trial in the federal court. >> so there's a lot to unpack there. let me ask you to do it, carol, particularly that the presumption should be in favor of removal. >> well, the first thing i disagree with mr. giuliani on is that fani willis has not thought about this, i guarantee you, she has thought about this. she is aware of it, but she is probably not that familiar with it in the sense that she has not had to deal with this issue in the prior racketeering indictments that she's brought because those indictments were really based on georgia events, on atlanta events. so this is somewhat new to her in a criminal context. what it means is that if you were a federal government official and you are being charged with state crimes, you are allowed to bring a motion to have this case removed to federal court. you would still be tried on the state charges, but in federal court, and the whole idea behind this was that this was a law passed in the 1700s, and the idea was that you didn't want state courts sort of harassing federal officials. now, this very motion has been brought by former president trump previously in his new york case, and those claims were rejected by the federal court. those charges about paying hush money to a porn star were outside your duties as a federal official, and therefore we're not going to take these into federal court. here the issue is a little more difficult, i think, to parse out the pieces because he -- he was the sitting president at the time of these events, most of these events, not all of them, which is why i think fani willis was well aware of the possibility that this motion would be brought, but it does -- he's going to argue as mark meadows has argued in this motion that they were acting within their capacity as federal officials looking into the integrity of the election laws and ironically, the first look we may get at the evidence in this case may be in an evidentiary hearing in the federal courts for the judge to determine whether there's merit to the argument that they were acting within their capacity as federal officers here or whether they were really acting outside of their duties as federal officers in trying to overturn the election. >> one of the things, obviously, greg, that this would take off the table if it got moved to federal court is cameras in the courtroom, right? and i know that as we were in the lead up to this there was a lot of conversation about that. as you've been hearing over the last couple of days any kind of talk about the possibility of a donald trump and potentially anyone else's trial being televised, have you heard anything to indicate that that might get pulled, or is that the presumption, the overwhelming presumption that it would happen? >> yeah, that's the presumption that if it was removed to federal court, which is still a very open question, right? legal experts as we just heard say it's still uncharted territory in a sense, right? if it does get pulled to federal court, we to expect it not to be televised, although there will be a big push maybe even from donald trump's campaign, who knows, to get cameras in the courtroom because we know that if it is televised and if it's at fulton county like it would be right now, every moment would be magnified and the court of public opinion could also weigh in on how they see the trial going. >> speaking of defenses, we know trump has teased this monday as the day he's going to give us all of his evidence, previous evidence that's been rejected by almost every single court, evidence that there was indeed voter fraud in the 2020 election. have you learned anything new about that? >> we know that he intends to reveal a so-called report that he called large and complex. of course what does complex mean, and does it have any credence to it is the other question because donald trump has propagated these election fraud claims, you know, dating back to 2020 now. there were multiple recounts and audits that were conducted here. governor brian kemp, the republican just yesterday reaffirmed that no legitimate claims of voter fraud that would have changed the outcome of the 2020 election have been presented here under oath in the state of georgia and that joe biden, in fact, won the 2020 election here. nevertheless, donald trump necessarily isn't presenting this in the court of law or in the form of any formal motion, but he's presenting this at his bedminster club in new jersey at 11:00 a.m. eastern time on monday because for donald trump, so much of this is about at least winning the political court of public opinion on this front because it's going to be up to his defense counsel here in the state of georgia to win it inside of the courtroom and very -- it could very well happen that this trial doesn't even begin until after november of 2024. so, you know, donald trump can run his own political, you know, trial outside of the courtroom over the course of the next year plus, and ultimately, he can, you know, reference these so-called fraud claims that he has perpetuated over the last two and a half years and made clear he is not going to run away from the past or anytime into the future, and he is going to run through with this whether it gets him into the white house or not, or keeps him out of jail or not. >> political trial as well as fund-raising operation, vaughn hillyard, greg bluestein, carol lam. up next, search crews with cadaver dogs sifting among the ashes in hawaii, now expecting to find as many as 20 more victims every day. the latest on the ground from maui when we're back in 60 seconds. we're back in 60 seconds. >> woman: why did we choose safelite? maybe. the president and first lady now say they'll be in hawaii on monday where right now it is an unimaginably grim scene. cadaver search dogs are scouring through ashes and rubble with more than a thousand people still missing and 106 officially declared dead. there are at least 40 dogs now working with a specialized mortuary unit from the federal government, arriving along with a 22 ton mobile morgue equipped with x-ray machines and lab examination tables. identifying the dead is a pain staking and, of course, heartbreaking process. family members of the missing are praying together as they submit swabs of their dna at community centers with only a few bodies identified so far. hawaii's governor says recorded deaths could double next week and we may not know the full scope of loss for months. nbc's dana griffin is on the ground in maui, so much devastation, dana. are the resources getting there to help? what, we have a ton of mulch. brand new polling out today shows that former president donald trump's grip on the republican party is tightening, even as he faces a string of criminal indictments. a new "associated press" norc poll shows that 63% of republicans say they want him to run again. stronger support than in april when he first began facing criminal charges, and even more, 74% say they will vote for him, but for general election, well, some major warning signs. 53% of voters say they will definitely not support trump as the nominee, 11% say probably not. nbc's noah pransky is at the big board breaking al of this down for us. this polling was done before the fourth indictment, right? but walk us through what we know about this moment in the race. >> so i'm going to take you through a few of the things i'm tracking here, specifically you know these top line numbers. you know a year ago donald trump had a nice lead. it shrunk after those january 6th findings came out from the committee last year, ron desantis was making some progress, and today the real clear politics average has him up 40 points when you average ten polls over the last month, but let's look at some of the fundamentals. first the question of electability, republicans more likely than in the spring to say donald trump is the most electable candidate from their party, 56%, not so when we look at independents, though, these indictments have had an effect it seems on how independents believe the best candidate who would be coming out of the republican party. donald trump only 26% of independents saying he is the most electable candidate. the other thing i'm watching here is is the door open when it comes to the fervor for donald trump? is the enthusiasm there the way it used to be. 678 of republicans said in a ugov poll, donald trump, they had very favorable feelings towards him, that sup 11 points since december 2022. but compared to where we were two and a half years ago, right after the election, that number was 75%. after january 6th, 65% of republicans still said they had a very favorable view of the former president, and this tells us that that door is potentially open. a lot of republicans might be willing to look somewhere else because they aren't quite as sure as they used to be that they're very favorable towards the former president. so the question remains which challengers might step forward through that open door, nobody has yet. we'll wait and see, chris. >> not even close, noah pransky, thank you for that. >> i want to turn to boston globe columnist, kimberly atkins stohr, and senior msnbc political analyst, matthew dowd. for me, kind of the wildest numbers out of this ap poll are that while 63% of republicans want trump to run, even more -- so presumably people who don't want him to run, 74% say they'd vote for him if he were the nominee. deconstruct that for me. >> well, you know, and i actually think when it comes to election day, donald trump if he's the nominee, he's going to get 92, 93% of the republicans to vote for him. i think it's kind of normal. i think they know, republicans know there's a vulnerability with donald trump, especially in the aftermath of all these indictments and then they don't know what's ahead in that. but in the end, they're going to coalesce around the republican nominee regardless of their -- of feelings of it's maybe flawed in this, and donald trump will get an overwhelming number of republican votes. the problem, as was pointed out by y'all is that independents continue to deteriorate for donald trump and that is where the election will be decided in '24. so even though donald trump will coalesce the republicans and is by far the huge favorite to win the nomination, he's incredibly, incredibly weak among independents. >> yeah, that doesn't help the folks like kimberly scott or ron desantis in the primaries. what's the message out of this poll for them? >> well, i think what these polls show is that republicans are running out of time to make a choice. they can see what happened after the january 6th hearings when the evidence of what went on around january 6th was crystalized and explained to the american people. come next year that's going to start happening in the form of coverage of these trials. the indictments will no longer be amorphous things that people don't really understand because it's the middle of the summer. it will be the headlines for weeks, if not month, and we can see that drag happen later. do republicans decide, look, let's be careful and coalesce around a different candidate given donald trump's liabilities or stick with him and really see something happen later? i will disagree with matt in one element, it's not just independents that are going to decide the election next year, it's going to be turnout. even if donald trump gets 90% of republicans, if they are not coming out to vote and coming out in waves to vote for him given that he will be at that time charged, if not convicted of helping to thwart an election and if democrats, particularly young people are motivated to come out in an effort to save democracy, which should be the democrats' message, it could be a blowout next year. >> could it be a situation, do you think, matthew, where what's happening with donald trump actually depresses the republicans? i mean, sure, there are plenty of them who might say there's no way on earth i'm going to vote for joe biden, but might they stay home? >> i think it's possible, but i think highly unlikely. there's no data in past elections. donald trump was incredibly unpopular among the general electorate, and even among some republicans. he's actually more popular today among republicans than he was when he won the presidency in 2016. and so there wasn't evidence in 2016 that republicans didn't like donald trump and they didn't vote. they actually went out and vote and voted against hillary clinton in the course of this election. and it also shows in the key states in 2022 is republicans don't seem to want to get their hands on the steering wheel and take it away from vulnerable candidates. they nominated incredibly flawed candidates in arizona, michigan, nevada, wisconsin, and many other places, and they lost all those races, and they don't seem to have learned that lesson that in nominating flawed candidates is not a path to victory. my guess is republicans are going to demonize joe biden enough to make sure the republican turnout is at least at its normal level sfwr kimberly, we don't have a poll yet since the fourth indictment, so you know, you have to understand that these polls don't reflect that. having said that, we did talk to some voters in new hampshire after this fourth indictment. here's what they told us. >> not in the primary, it's only been helping him, you know, obviously i do think that it can hurt him a little bit in the general election. >> it's time for him to move on. i think he's just holding it up for -- at this point he's in the way. there are a lot of good candidates, let them do their thing. >> i think he did his four years. he did a good job. he ought to focus on his legal issues and let the other candidates have a chance to become president. >> so that's just a small sampling, but i do wonder what you as a journalist are looking for to see if there might be at some point a shift of any kind at all away from donald trump, and i'll just ask you, kimberly, what you think the chances are that donald trump decides to count a program by going in for booking on the day of the republican debate? >> i'm not sure that that's the split screen he's really going to want, you know, a debate full of people on stage at least looking presidential and him being booked for felony charges, but you know, donald trump doesn't come to me for advice. but in terms of what might happen among voters, even the most, you know, motivated republican voters like primary goers, i think republicans need to listen to them very carefully. look, this is different than 2016 when trump was a new and different person that, you know, candidate that people had never seen before. it's even different than 2020 when he was the incumbent president. he has been out of office, and since then, the only thing that has been highlighted about him is the way that he tried to subvert the will of the voters. so i'm not -- i think that there may be more republicans who wish that there were democratic -- not a democratic, but a different candidate on the republican side than trump than these poll may be indicating. >> since i liked your laugh, even though we're out of time, i'll ask for your 15-second answer on the possibility of donald trump showing up for booking on debate day. >> well, anytime there's a circus in one town, then the performer wants to have a circus in another town, so i think donald trump is going to do -- if he doesn't show up for the debate, which my guess is he's too cowardly to, he's going to have a circus event because he's a performer and he wants to be on center stage. >> matthew dowd, kimberly atkins stohr, we shall see. thank you both so much. we appreciate you. up next, a new volley of accusations between hunter biden's legal team and federal prosecutors about that now derailed plea deal. plus, from new york to california, the new and disturbing series of calls aimed at synagogues that the antidefamation league is now tracking. you're watching court report "chris jansing reports" only on msnbc. msnbc. chevy silverado has what it takes to do it all. reports" only on msnbc. (oven explosion) what about a new oven, can u.s. bank help us there? we can serve loans in as fast as 12 minutes. that would be a big help! huge! jumbo! ginormous! woo! -woo! finding ways to make your business boom. that's what u.s. bank is for. now to the legal showdown escalating over hunter biden's derailed plea deal. in a new filing, lawyers for the president's son claim that prosecutors reneged on the deal and that parts of it remain in place, while prosecutors argue the whole thing is dead. all of this as the case makes a major shift. now a special counsel investigation. nbc news investigative correspondent tom winter is with us. tom, we all saw this deal, not seemingly but i guess collapsed at least for now, so what is hunter biden's legal team suggesting here? >> right, so what they're suggesting is that there's a agreement between two parties, a bilateral agreement between federal prosecutors and hunter biden that says that the pretrial agreement that that is in effect because both sides signed it. that's their contract, that's the way it is. federal prosecutors say not so fast. it wasn't charged -- it wasn't signed by the person who needs to sign off on it and prove it, the head of probation in delaware. we're in a situation where not unsurprising prosecutors have one view of things, hunter biden's attorneys have one view of things, and this comes as there's obviously now a special counsel as you pointed out, which is the same federal prosecutor that was overseeing this investigation before. and every indication we have is that federal charges will now be filed perhaps and i would say most likely, in the central district of california, also perhaps in the district court of d.c. but we're headed down that road while the judge in delaware is still asking questions about where do we actually stand here and is there debate about what is actually in place. >> really quickly, one of hunter biden's attorneys is gone now? >> well, yes and no, local rules in federal court in delaware -- in each federal court, as much as there is similarity between them, have their own local rules. you can't be a witness ask an advocate at the same time. what they're saying is if chris clark, hunter biden's primary defense attorney wants to testify to the facts of these negotiations and address the issues i've just spelled out, he can't at the same time act as hunter biden's attorney. it's not that he's been fired. it's not that he's been dropped from the case, it's just that he can't do both. so if he's going to be called to testify as to actually what occurred, he can't also be sitting at the defense table technically at the same time. that's what that motion was about yesterday, and that's what we expect. >> tom winter, always good to see you. thank you. now to an ugly new wave of attacks on america's jewish community. the antidefamation league is tracking what are known as swatting calls, targeting synagogues in 12 states in just the past month. swatting is when someone calls police falsely claiming something horrible is happening, which usually brings a police s.w.a.t. team to the scene creating a frightening, chaotic and potentially dangerous situation. the synagogues were all live streaming religious services when those calls came in. "new york times" reporter jeffrey mayes is covering this. so jeffrey, what exactly has been happening at some of these synagogues when these calls come in? >> well, they've been worshipping, to be honest. if you look at the live stream video, you see them reciting songs. there was one group of worshippers that was in the middle of a praise dance, and then all of a sudden you see police officers come in informing people that they have to evacuate the building immediately. >> and they post these videos. they live stream these videos. what do they do and why? >> they've been capturing the live stream, and they've posted several of the incidents online. in my conversations with the antidefamation league, they believe there are some demands regarding the groups' use of social media. they want the adl to be removed from certain social media platforms, those are the demands that the groups have made online. >> according to the adl last year had the most anti-semitic incidents in the u.s. in more than 40 years, and these calls are not a joke. the trolls use highly anti-semitic language. you can see and almost feel the kind of terror that it can engender. you know, if somebody says there's a bomb and get out of the building, that's not a fun thing to be involved in. that's not funny. talk a little bit more about the kinds of harassment and the implications of this that we're seeing throughout the jewish community. >> well, i think the goal is to engender fear, so in one particular call, california, they were told that there was a backpack bomb under a bench inside the synagogue. other people have called suicide hot lines and said that they were thinking about killing themselves and killing other people as well, so when the synagogues who are just in the middle of regular services get these calls, there is -- you know, you see the looks of fear, the alarm on people's face. i think what the adl's biggest concern is is that this differs from your average sort of slurs or, you know, graffiti that is written, the sort of regular anti-semitic attacks because, first of all, they don't know who's doing this. it seems to be a coordinated effort. it's happened 26 times as you mentioned all across the country over 12 different states, so they're unaware who's doing this. they're also unaware who's watching this, and there's concern that people who are watching this will be inspired to do horrible things. we just saw the shooter in the pittsburgh synagogue case sentenced to death, which was believed tonight deadliest anti-semitic attack in the united states, so there's fears that this could inspire people to do even worse things than calling and disrupting services. >> jeffrey mays, a very important story you've been reporting. we appreciate you coming on the program. thank you. meantime, fema is sending more resources to hawaii, i'll talk next with the fema administrator in charge of getting help to the people that need it. plus, in our next hour, a foreboding bet, the man who correctly protected the 2008 housing collapse is putting big bucks on a stock market crash. is he on the money again? >> yeah, chris, thanks for giving me an opportunity to talk about this. you know, i just came back from spending a few days on the ground there, and i think, you know, the one thing that people need to remember is that the impact of this community is traumatic, right? they have lost everything, and we're still in an active search mission to make sure that we can identify everybody who isn't accounted for, and so i understand the level of frustration of just wanting to be able to get back in and see some of the area. but we also need to make sure that we are going through the area very respectfully and try to identify everybody, but also making sure that it's safe for people to go back in there. at some point in the future we'll be able to do that, and so we have personnel on the ground. we've had them since day one. we're sending in more. as we continue to fully understand what's going to be needed through the different phases of this recovery process, and we will continue to send as many resources as necessary to support ongoing effort. >> that is one part of it that people obviously, they want to see what happened to my house, where are my family and friend. the other part of it is how do i get through the day, food, water, they're turning on taps if they have one, and it's coming out black. place to live period. so how quickly can you move resources into place so nobody's hungry, nobody's thirsty. people have a roof over their head, just the basics. >> yeah, all of those resources are already in place. you know, i had the opportunity to visit two shelters where there's just an overwhelming amount of donations. we have a distribution center on oahu that has meals, that has water, that we have already sent into the area, and so there are plenty of resources out there, and i think maybe what i could use everybody's help in is making sure people understand, can help me get the message out there of where to go get these resources. you know, i talked to one shelter manager who said they're packaging up food, water, supplies and as host families that are housing somebody that's been displaced come by, they just give them bags of food and water, and so those resources are there. we just need to help get that message out into the community. and as far as the long-term -- >> if i can stop you there, i'm sorry, but obviously the problem there, deeann, is communication. cell towers still down. people may or may not have their cell phones. there's people who literally ran out with the cloths on their back, right. what are you doing in those regards? obviously this may help some. i don't know how many people are able in maui to sit home and watch this, so, you know, we're hearing reports of people just, you know, getting on with loud speakers and trying to tell whoever's in the area what to do. what's being done in terms of communication to et will people know there is help?
