president biden and the first lady will travel to the maui disaster zone monday, as the death toll passed 100 people. recovery crews bringing in more highly trained dogs to help in the search for victims. >> how daunting is it? >> it's the worst thing i have ever seen. this is apocalyptic. it's terrible. good day, everyone. i'm andrea mitchell in washington. we are on defendant watch today as presidents trump and his 18 co-defendants in georgia have nine days to surrender to the fulton county jail for fingerprinting and processing in advance of a separate arraignment to be scheduled before a judge. they will enter their pleas. one of the most prominent of the former officials charged, mark meadows, has petitioned to have his case moved to federal court where d.a. willis would still try the case, but meadows would more likely have a much more favorable jury pool from all of northern georgia, not just fulton county, and there would not be cameras in the courtroom. meadows' argument expected to be made by mr. trump and other defendants, is that the actions he took in georgia were part of his official duties as a federal office holder. our legal experts will drill down on that. rudy giuliani, one of the other co-defendants, says the trial should be delayed until after the 2024 election. >> a federal court should enter an order enjoining all of the cases until the election is over, because they are clearly now not cases, they're not even crimes. this is the first amendment. this is free speech. it's my actions as a lawyer. i have a right to argue for my client. i have a right to exaggerate for my client. i have a basis for everything i said. half of what they wrote about me is false, and they know it. this should be put off until after the election. >> joining me now, nbc's vaughn hillyard at the fulton county jail. vaughn, we should points out that rudy giuliani was for a while the number three official in the justice department and a well-known prosecutor who really was the first to use the rico law in these civil cases, while collar cases. vaughn, all 19 defendants will have to arrive there at some point over the next nine days for a big dose of reality. they have to arrive at the jail. they are white collar criminal cases. >> reporter: right. rudy giuliani is contesting that this is a misuse of the racketeering statute here in georgia. rudy giuliani will have to make that case in front of a judge. for rudy giuliani, the last time he was in georgia was when he was testifying in front of an official proceeding at the georgia capital building here in atlanta. this time around, he will have to show up at some point over the next nine days here at the fulton county jail to formally surrender. the sheriff here suggested that he would treat each of the defendants, including donald trump and rudy giuliani, just as he would anybody else that is getting booked here. that would include a mugshot, fingerprints. the jail here is open 24 hours a day. as long as they appear here before august 25th, it is an open-ended question as to when these 19 defendants will ultimately come here. governor brian kemp was explicit in backing up, essentially, the indictment charges in a tweet in which he posted, the 2020 election in georgia was not stolen. anyone with evidence of fraud has failed to come forward under oath and prove anything in the court of law. mike pence, the former vice president, echoing the governor just a few moments ago in indianapolis. take a listen. >> the former president and his allies have said for more than 2 1/2 years and continue to insist to this very hour. the georgia election was not stolen. i had no right to overturn the election on january 6. [ applause ] it's a hard truth. my friend governor brian kemp said it well yesterday. he said, for nearly three years, anyone with evidence of fraud has failed to come forward to provide evidence in a court of law. >> reporter: you and i were talking earlier about the surrender process versus the arraignment process. those two things could happen on separate days for donald trump. we do not know when his formal arraignment will take place. it could very well happen after august 25th. we do know that the u.s. secret service has been in contact with the sheriff's office to coordinate around his visits to georgia when they take place. >> now let's bring in ryan reilly and former u.s. attorney barbara mcquade. ryan, tell us about scott mcaffee, the judge assigned to the case. >> when they get the arraignment. he is a very fresh judge. former u.s. assistant district attorney. he has experience. the most interesting thing here is his link to kemp and his appointment by kemp. the governor of georgia has been in a back and forth with donald trump. i expect when we see donald trump potentially target him, as he targeted other judges, that might be the basis which he uses to say that this individual is associated with kemp and that's the reason that he is making a decision. there's another layer he won't have to deal with as much as other judges have. we have seen racial targeting of the judges. that's not something he will have to deal with. i do feel like there will be a large number of attacks aimed towards him regardless just because of any potential decisions that he makes down the line that are potentially unfavorable to donald trump. >> to say nothing of what willis has had to deal with on the racial front. barbara, let's talk about that. you have -- i want to ask you about there federal versus state court procedure. this judge has been on the bench for eight months. i was watching last night some of the georgia -- former officials down there saying he is experienced as a prosecutor locally, federally. he was an ig statewide. to handle this kind of docket and to handle all of these pre-trial arguments, particularly some of the big issues that are going to be coming to him from all sides. you have 19 defendants, including donald trump. he is probably the newest judge sitting on the bench down there. >> yes. every judge is new at some point. cases are assigned based on random draw. you don't say who is the most experienced or who has the best set of credentials to handle a particular case. you get what you get. i can imagine for any judge to see your name show up on the docket as the trial judge assigned to this case is probably one that is not met with a great deal of joy or welcome, because you know that every decision you make is going to come under incredible scrutiny by all parties. you might find yourself the victim of attacks, as wove seen with others. i think that a judge is entitled to the presumption of good faith and independence until they show themselves otherwise. >> let's talk about state versus federal, the advantage for the defendant -- for these defendants in particular is that if it's moved to federal court, it is all of the northern georgia district. so he has a different jury pool where fulton county is democratic. the rest of georgia has red areas. there will most likely not be cameras in the court. that said, what he was doing in fulton county was not what a typical white house chief of staff does. that wasn't his white house duties to go in and oversee the election count and press those local officials. >> yes. this removal statute allows a federal officialcharged in the where i'm not sure i can get a fair wrap and the state is interference with my official duties as an officer of the united states, so it should move to federal court where i can get a fair shake. the requirement for that is that they were only acting in the scope of their authority. here, superficially, mark meadows makes a decent argument. all i did was attend meetings and arrange phone calls and show up for vote counts and do things the president asked me to do. if that were the end of it, maybe so. the indictment here doesn't accuse mark meadows of simple performing his duties as the chief of staff. it accuses him of abusing his authority. you have to take these allegations at face value. his continues to climb, with only 27% of the burn zone searched. hawaii's governor is saying officials expect to find between 10 to 20 bodies a day. miguel almaguer was granted rare access inside the burn zone. >> reporter: ground zero of the burn zone, for the first time the federal government giving nbc news an up close view of the destruction as search and rescue look for the missing. how would you describe the search area? how daunting was it? >> it's the worst thing i have ever seen. it's aapocalyptic. >> reporter: where were escaping in vehicles. authorities have to go car by car to see if they can find anyone who didn't make it out alive. with more cadaver dogs on the way, officials expect to identify up to 20 new victims a day. this 79-year-old and this 74-year-old are the first two officially be identified. the governor says multiple children are also among the dead. >> we are heartsick that we have had such loss. >> reporter: families like this man, the wait is agonizing. his grandmother is missing. >> i love you grandma. i hope you are at peace. >> we go slow, methodical. we are thorough. we are respectful. these are somebody's family. >> reporter: the cause of the fire is still under investigation. this resident says he watched a downed power line ignite dry brush just outside his home. >> flames start almost immediately after from the dry grass. >> reporter: at least three lawsuits have been filed against hawaiian electric, alleging turning off the power lines would have saved lives. the utility company had no comment. now, a week after the fire destroyed this haven, families are left waiting for answers from the ashes. >> joining me now is bobby lee, president of the ohio firefighters association and the chief executive officer of team rubicon, a humanitarian organization that served communities before, during and after disasters. the video is devastating. he would saw how quickly they ignited. tell us about the challenges that the firefighters are facing, things like -- >> thank you. i was there on sunday. i looked over it. we experienced -- we lost homes in other parts of the island, too. nothing as bad as lahaina. it looked like somebody dropped a bomb. i've been in the fire department for 36 years. i have never seen anything close to this. it's really heartbreaking. it's a tight-knit community. it's a tourist attraction across the world. it's sad to see something like this. >> how much was the lack of water pressure a factor? >> apparently, that seemed to be pretty much everything. we had half a dozen crews there when this fire started. that was the biggest problem i heard from our members that were there was that they couldn't get water. when you have a fire company, a fire truck without water, there's not much you can do. it's like a police officer gun without bullets. we can't do anything without a water source. >> art, talk to us about team rubicon. you have covered so many disasters. how much of a challenge is this in terms of getting resources there? >> obviously, the fact that this happened on an island makes things more difficult. we always have the luxury domestically here notice united states, the ability to have supply chains that are resilient, can happen quickly. those are complicated on islands like hawaii. one of the things that we are really lucky to be able to have, however, is we have a presence of volunteers that are -- that understand the culture, able to respond and work closely with the officials such as mr. lee there and his teams. the government officials at every level. to ensure what we are doing is aiding in the recovery instead of creating unneeded taxes in a situation where everything from water to food to lodging, there's a competition. our goal is to ensure we can aid mr. lee and the officials to ensure what we're doing is helping those survivors of the terrible tragedy. >> bobby, the white house just announced the president and first lady will come to hawaii on monday. there's always the concern that they are coming too soon. here is what the president had to say. >> i don't want to get in the way. i've been to too many disaster areas. i want to go and make sure they got everything they need. i want to be sure we don't disrupt the ongoing recovery efforts. >> by his coming monday with everything that that involves, the huge teams that always travel with any president, is this the right time for him to be coming? is it too soon, too late? what will his presence mean to you? >> i think having the president here would be a really good thing. whenever he decides to come. me personally, i was pleased when he signed the emergency declaration. just to have the amount of federal resources that are coming in now is very, very comforting. the search teams, the cadaver dogs, it's a sad event to have to take care of. it's reality. i appreciate all the federal resources. i look forward hopefully to seeing the president. >> bobby, art, >> let me tell you, i'm here in michigan's upper peninsula, and it's 80. it's unusual. we know climate is real. this president has ushered in so many incredible efforts to bring costs down for american families and to make sure that the united states of america is where innovation and manufacturing is happening. we are seeing it all across the country. this president's work has really made people's lives better. i know that it is challenging, but with our inflation rate low and our unemployment rate low as well, it's working. it is making people's lives better. we are feeling it here in michigan in every part of this great state. >> arguably, this legislation would not have passed without the support from joe manchin. but he told the white house he will not attend the ceremony today. he issued a statement really escalating his criticism. he said the administration is trying to undermine energy security by implementing what he today calls a radical climate agenda. what's your response to that? >> listen, i'm not going to respond to a particular u.s. senator. i have nothing bad to say about him. i will just say this. if you look at the map across the country right now, there's undeniable what's happening. it's expensive and deadly. that's why our president has focused on ensuring that we are responsible stewards of our natural resources and bringing down our impact on climate but also making it easier for americans to participate in the transition that's happening, whether it's ev tax credits or supply chains so we do the clean energy jobs at home, making it easier for americans to get affordable energy to their homes and for businesses to thrive at the same time of being responsible leaders in the world. i am proud of what this president has been able to accomplish. but we cannot stop now. we have to throw our foot down on the acceleraccelerator. >> despite the economic progress and the lowering of inflation and what has been done, spades in the ground on a lot of the projects, despite that, you have donald trump, a former president in so much legal trouble, four indictments, and yet a "new york times" poll of a hypothetical matchup between him and the president, he is tied with president biden. that poll was taken before this last indictment. that's got to be frustrating to you as a co-chair and to the white house. >> well, you know, a year ago people were writing my political obituary. and i won by 11 points and flipped both chambers of our legislature in michigan, something that hadn't been done in 40 years. at the end of the day, voters are not stupid. they are very smart. they know who is really working to improve the quality of their lives, who is working to codify rights instead of taking them away from people, who is working to make sure that all people in this country can get on a path to prosperity. ultimately, that's how elections are decided. i'm confident that what this president has done is for the benefit of americans. as we get closer to the election, that will drive how votes are. we take no one for granted. that's why the work that he has done, the focus on all people and creating paths to prosperity and making america a friendly place to do business and to grow jobs, that's what's important. that's what's going to ensure we help every person achieve what they want to be able to take care of their families and enjoy a high standard of life at a low cost of living. that's precisely why i think the president will continue to tell the story of what he has accomplished. it's so big and there's so much that sometimes it's a hard story to tell. people in this country are smart. they know what's working. they know who is focused on them. ultimately, that's going to determine the next election. i feel very good about what this president has accomplished. >> i'm sure you in michigan hear what we hear in washington and i hear when i travel, that many democrats, supporters of joe biden, are nervous about this. there's talk -- this is what happened on "meet the press" this past weekend, a supporter of the president, says that president biden should pass the torch to a younger, different democrat. i want to play some of what he said. he talks about you. >> i would like to see a moderate governor from one of the four states that democrats will need -- >> gretchen whitmer? her or tim walls? help me out. >> you said a few names that would be great. joe biden is down right now. >> what do you say to reassure democrats? >> listen, i'm supporting the president because he has a record and has gotten things done and he cares about the average person. we had a lot of conversations about how the agenda has to be communicated, because he has an incredible amount of work done. i am proud to be supporting president biden. i am proud to be on the campaign for re-election. i know that when this story hits more people and they understand what's happened and they see the cost of their insulin going down, which this president championed and got done, is one of many examples of how life is getting better for people in this country. i think it's going to be very clear that this president should be re-elected, do this work for another four years. he has my support as well as a lot of those moderate democratic governors. we see what he has done. we know how it has been improving the quality of life for the people we serve. we gotta continue doing this. we can't go backwards in this country. >> i know michigan was out front in going after the fake electors and the case you brought there. what's your reaction to georgia and the d.a. going after the fake electors in that broad indictment of not just the president but 18 co-defendants? >> i am a lawyer, but i'm not a criminal attorney. i can tell you, i'm watching the process play out. i know, as someone who has been targeted by people that were intent on hurting me, we have to have confidence in our justice system. it will play itself out. i can just say this, we have an opportunity to get four more years out of a man who has dedicated his life to public service, who has done more work to improve people's lives than most who are in public service. that's precisely why at the end of the day, i have confidence that joe biden will get a second term and an opportunity to continue this work. we take nothing for granted. we take no person for granted. every person in this country is person. every person deserves a path to prosperity and a leader who is not serving themselves but serving the public. i think that's the juxtaposition of what we have seen in today's politics. it's why this is another very consequential election coming up next year. >> governor whitmer, thank you so much, from the beautiful upper peninsula of michigan. thanks for taking the time to be with us today. we appreciate it. >> thanks, andandrea. north korean mystery. they say travis king wants to stay in that country. what is the true story? make it arexvy. top republicans are rallying around donald trump after the 2024 frontrunner's latest indictment, his fourth. his closest primary competitor, ron desantis, seems unwilling to ramp up his attacks. instead, criticizing what the florida governor is calling the criminalization of politics. joining me now is brendan buck and phil rucker, soon to be the next national editor. phil, desantis said donald trump should never have entered the race because of his legal issues. but we are one week away from the first debate. many candidates are unwilling to talk about this publically and directly. >> yeah. andrea, it's interesting. they are trying to thread this needle so they don't alienate trump supporters, who they would need votes from in order to win the republican presidential nomination. if you look at some of the republican -- leading republican officials in the state of georgia, they have been more direct and sharper in their critique of trump. governor kemp, the former lieutenant governor there, both saying this is a real wake-up call for the country. i'm paraphrasing. time to turn the page. this was really an assault on democracy that occurred a few years ago. >> it's interesting that brian kemp, the governor, very popular, came out right away. to that point, brendan, our nbc political team did a deeper dive on georgia politics. speaking to four republican strategists there, they say that donald trump needs to win the state to take back the white house. this latest indictment is going to hurt him with independent voters there, if he is the nominee. do you agree with that? >> yeah. georgia has not been kind to donald trump going back a few cycles. brian kemp has shown a model for how you can be a strong republican, stand up for yourself and you don't need to play trump's game. you can still be very popular, as you said. georgia is brian kemp's state, not donald trump's state. there are few red states you can say that about. i think that does show an approach that some of the voters -- excuse me, some of the candidates can take. look, there are a lot of republican voters who see what donald trump did for what it is. they are clear-eyed about it. they are ready to move on. i think what we are seeing with a lot of the people running in this primary is confusion over who your gettable voters are. those are the people who are open to voting for someone else. people who are trump supporters are trump supporters. you need people who like donald trump. but there's and opportunity for people who are ready to turn the page. brian kemp has shown it and made himself popular in the process. >> phil, what about the debaters next week? he's still playing hide and seek with his primary rivals about whether he's going to come, whether or not he does show or make a surprise appearance, he's now the central factor of the debate stage, and he has a lot of other dates on his calendar. he has to surrender to the fulton county jail by noon a week from this friday, that's a week from this friday. nine days from now, to be processed on his latest indictment regarding alleged efforts to overturn the 2020 election. next week he promises to refute the charges in a so-called report that he will deliver at his bedminster home and resort on monday. he could decide to take part in the second debate then many september, but in october, new york's attorney general letitia james' civil lawsuit against the trump organization is scheduled to go on trial, and in january, everything kicks into high gear when the trial and the election interference case, from special counsel jack smith is at least slated to start if the judge insists on sticking to that aspirational schedule. a week and a half later, the iowa caucuses and e. jean carroll's second trial are to be happening on the same day, and in march, super tuesday will be quickly followed by the trump hush money case in new york. fast forward to may when the classified documents trial is on the docket followed by the rnc convention in july. joining me now, nbc news senior political editor mark murray, eugene scott, is former obama white house press secretary robert gibbs. so mark, you work on this calendar all the time, you live by this calendar, not so much the court calendar. now you've got to factor that in and the former president does. >> the whole rhythm of a campaign is we march from primary to caucus, primary to caucus. >> to arraignment. >> right, well, i'm getting the to that. that is the normal operation with breaking news and other events that always stack in between. now all of a sudden it's those primaries and caucuses and the are trials that we're going to end up seeing. i actually think the most mind boggling thing about it all is that it is very possible given those court dates we're going to end up seeing after super tuesday, after going into may, even possibly beyond that donald trump could end up winning iowa, could end up winning new hampshire, south carolina, have a lot of delegates banked in the super tuesday, and then the trials begin. then the question becomes even if a jury finds him guilty, what then? >> right. >> and eugene, more people have been talking at the iowa state fair about what they think about all of this and what they think about the trial. here's some of what they had to say. >> why would they say that he's been indicted for a fourth time? >> i guess i really don't know. >> my wife keeps me in touch with that because i'm retired and i don't keep up with it. but she watches fox news all the time. >> i really don't care. i've seen the headlines and i just -- it doesn't matter to me. >> and you did a focus group in michigan, what were they telling you there? we just interviewed the governor today. >> we did. i think what was really interesting about michigan swing voters, people who voted for trump in 2016, biden in 2020, they said they can't keep up with the indictments. it's not that they don't care. one gentleman said there are just so many and i'd rather talk about the economy, abortion rights, foreign policy, and the focus on the indictments is actually keeping candidates from being able to tell voters where they stand on these issues and that's concerning a lot of swing voters. >> robert, to you about the indictments, do you think that this breaks through or it would only be if there are cameras in the courtroom as is likely in georgia, if that stays in the state court and not the federal court? >> andrea, i think it will always breakthrough when you hear, begin to hear as you mentioned in the previous segment whether or not some of donald trump's opponents are going to take him on. it's hard to brand trump a loser if you don't actually admit that trump lost the election, which i think has been hard for different candidates to modulate on. it will be interesting to see does somebody take a step and try to make the case here? do they continue to defend donald trump? because look, if they're not willing to pull him away or three and pull him away from his voters, i doubt they're going anywhere. >> mark, getting any of these candidates to focus on this when they're so worried about angering the base, i mean, as i was just discussing, you know, with brendan buck that mike pence does seem to be moving in that direction because of his central role and because it is -- you know, people know what he did, so they already have to make a decision about him. >> yeah, and of course you know, it's not only -- it's also asa hutchinson and chris christie have been the bigger critiquers when it comes to donald trump and his conduct and litigation, but are they kind of reading where the republican electorate is? like, you know, if the idea is is this actually being driven by the campaigns and the candidates or are they just really responding where the electorate is and the overwhelming majority of republicans say donald trump did nothing wrong. if that is what they're reading from their voters, maybe the best course of action is to admit that donald trump did nothing wrong, he won 2020 and go from there. >> i was talking to the governor, governor whitmer about of course the inflation reduction act and some of the policy successes arguably of the biden administration. when you were talking to voters out there from your focus group, are they acknowledging that or where are they? >> there were two interesting findings. the swing voters love the governor but they don't credit democrats and biden for the infrastructure successes. they don't see signs saying this is something that came about from democratic lawmakers and they aren't sure it's wrong for republicans to take credit for it, even if they didn't vote for them, which is really interesting. what was made very clear is that biden has a lot to do to remind swing voters of what he's already done. >> and then there's hunter biden, robert gibbs, in terms of things hanging over the democrats and the white house. now we know that one of his attorneys has actually resigned from representing him because he's going to be a witness in the argument over whether or not that plea deal was canceled because he helped to negotiate it. so all of this is still up in the air, and it's very conceivable that the president's son is going to be on trial during the campaign. >> yeah, look, this is not a helpful series of developments for the white house. they don't want to see this go forward, and in all likelihood it will. you think it's going to be incumbent upon the white house to make sure that allies are telling voters the differences between the president's son potentially being in trouble but not related to the president and the ex-president who's facing four different indictments. but undoubtedly, this is not a great political development for this white house even if legally beyond this trial doesn't feel like there's a lot more investigation to go. you got to remember that the special counsel has been at this for more than five years, so it's unlikely that somehow it's going to uncover something dramatically new in this. he'll still have to deal with the trial. >> briefly, mark murray when you talked to white house officials, how nervous are they about the hunter biden issue. >> it's certainly at best a direction for them. at worst it's something that creates something and metastasizes into something more. this is something they probably want to get done now as far as instead of being lingering out there. >> thank you very much. eugene, good to see you, thanks so much robert gibbs, that does it for us for this edition of "andrea mitchell reports." follow us on social media @mitchellreports.
