with alicia menendez. >> thank you so much reverend sharpton. menendez hello everyone, i'm alicia menendez, coming and they are tonight with breaking news l of maui, where the death toll has risen to 93. sadly, officials fear that number will rise. these are now the deadliest wildfires in modern u.s. history. here's hawaii's governor, josh greene, earlier today, on msnbc. >> if they need, they need our love. they need our embrace, and they need resources. right now, we are still in the throes of the acute phase of this recovery. meaning that we are still recovering the tragic loss of life, and the bodies that were, that were previously -- here in hawaii. it's a war zone. >> as the death toll rises, and rescue recovery efforts expand, there's also a growing push for accountability across hawaii, three law firms have already filed a class action suit against the electric company on maui, claiming the wildfires could have been avoided if the utility company had turned off powerlines ahead of the wind storm that sparked the fires. another high priority at this, our getting essential's like food, water, clothing, and wi-fi to those who have been displaced. >> we're doing this as one big family, one big -- . and that's our mission right, now is to support the people who really need it. but right now, we are connecting all supplies, all non perishable food, all gas, all propane, all close, all food, everything you have. >> there is good news to bring, even in the thick of all of this devastation. u.s. coast guard has rescued 17 people from the waters off maui. they have a jump, to escape the flames. the coast guard had also located 40 others, who went missing. later this hour, we will take you live to maui for an update, including on how those relief efforts are going, with representative from world central kitchen, so stick around that. but first, let's turn to georgia. this week, we could see a fourth indictment handed down to former president donald trump. fulton county d a fani willis will resent her case to the grand jury, starting tomorrow. at least two witnesses are ordered to appear tuesday. georgia's former lieutenant governor, and a freelance journalist, who stumbled into a meeting of alternate gop electors at the georgia capitol, on december 2020. also, georgia election official gabriel sterling, said today he will testify again, if asked. sterling oversaw the 2020 vote count, and repeatedly debunked trump's claims of fraud. >> i testified before a special grand jury, and two interviews with the d.a.'s officers. my lawyers haven't said i can much about one, one way or the other. but if i am called, when i'm called, i will go and do it before. i will tell the truth, answer honestly. that's all we can do in the situation. >> joining now to discuss, msnbc legal analyst lisa reuben, an msnbc political contributor greg -- . he is a political reporter for the atlantic journal of constitution, and author of the book, flipped, on georgia politics. -- according to reporting, we could see the nine as early as tuesday evening. help us understand that timeline, and who might be involved? >> yeah, well it could be a multi defendant indictment. we've expected this sort of time period to be in the crosshairs for a long time. but now we have it on the record, now that the former lieutenant governor jeff duncan -- they journalist above said that they've been called in to testify behind crow closed doors. on tuesday, that sets up the situation of a scenario where we could hear from fani willis, the district attorney, as early as tuesday, that there could be indictments against donald trump. and, some of his key allies. remember, about 18 target letters, at least 18 target letters were sent to the orbit around donald trump. so, we could be seeing indictments of many of his closest allies as well here, in georgia. >> lisa, this may seem very one-on-one to you. i think a lot of us are curious. take us inside that courtroom, what is it that members of the grand jury are going to be hearing? is it akin to closing arguments in a trial? what is laid out for them, at this point in the game? >> basically, the prosecutors are going to establish for them, what are the elements of the charges that they intend to bring against which defendants. and then, they're going to walk them through, and maybe a polymerase or ancillary way, the evidence that they have against each of them. it's certainly less involved than an actual trial. and the other thing that the grand jury has an opportunity to do, that -- or what we consider typical jurors, don't it's two asked questions to those prosecutors, one on one, one at a time, sort of in the last form of a sphere. but that's what we should expect to happen. they can also asked questions, of the witnesses themselves. and so, we should expect that some of those who have particularly compelling stories to tell, they may engage in some back and forth with the grand jurors here. and, particularly given what we heard from former four of -- the special grand jury emily kohrs, that may be something where we got some back and forth, between the grand jurors and the witnesses. >> greg, text messages filed in a separate lawsuit show trump's attorney, sydney powell, organized a visit to the coffee county election offices. what do we know about that part of the story? >> yeah, we've known for a while that the coffee county was under the microscope of what happened on. there is a little georgia county, very deeply conservative, trump country down there. it was not a very close election. but we know that the team of trump supporters, and data analysts, they had hired, entered the coffee county elections boardroom, took and spent hours and they are copying voting data, -- was caught on surveillance footage, certain security. that data was stuck -- to conspiracy theorists in the county, pro trump conspiracy theorists. so we know that's under the microscope. we are not of course or that will be involved in the indictment, but we know that fani willis and her investigators 14, have been closely looking at what happened -- . >> when i asked one of our other legal analyst, lisa rubin, what this indictment might look like, she described it as chapters. that instead of laying out one ruling, either a big narrative that will take this piece by piece, i wonder when you look at these text messages, in this separate lawsuit, if you have any sense of where they might factor in in those indictment chapters? >> you're talking about the text messages themselves? i think the coffee county narrative is, as you are the legal guests explained to you, sort of part of a number of overlapping conspiracies. we used to think about what happened after the 2020 election, as successive stories. and we know now, through the federal indictment, through the january six committee hearings and other evidence, that actually, there were a number of sort of overlapping conspiracies that meet, in sort of one big event diagram. i expect that's how the george indictment will look. there were no people working together, and separately, on different elements of the plot, with the overlying objective to grant the presidency to donald trump, illegitimately, at the end of the day, alicia. >> greg, you have trump running an attack at against a willis -- i'm not going to make our audience watch that. talk us through what we know about security at the courthouse, how officials in atlanta are preparing, what it is that you are watching for. >> we know that the former president has tried to undermine and undercut the, and destabilize this investigation from the get-go, as well as the other investigations. we know that the d.a. has talked openly about the threats she has faced, the racial epithets, the other slurs hurled against her. we know that she is under an intense security. there is security barricades around the courthouse, the streets are shut down. there are staffers who are working virtually starting last week we also know that there's a number of other measures to be taken right now they don't want to talk about, because they don't want to give it away to those who might seek to do harm. in her >> lisa, nbc asked the former president trump yesterday, i'm sure you sought, if he intended to overturn the 2020 election. and his snarky response was, you know the answer to that. and i wondered, as i watched that, given the protective order and so much more what prosecutors might make of that remark. >> that remark is hard to make something else, right. it's like the rorschach test of political responses. you see and it what you want to see and it. if you are inclined to believe that president trump intended to steal or overturn the election, you saw it one way. and if you believe that president trump was solely trying to vindicate the real results of the election, which is to prevent it from being stolen by democrats, you saw what you want to see into it there. i don't think that the response comes close to violating either the terms of the protective order, which really is about how you deal with evidence of the case, or even president trump's conditions of release, which more broadly covered witness intimidation, tampering with the jury pool, or other attempts to obstruct the administration of justice. however, to i think that his renewed focus on president biden, and somehow insinuate that joe biden is behind the effort to prosecute him, when all evidence to the contrary, could get him in trouble? this why did this say hunter biden is part of the family? theamican people don't trust the department of justice, they don't trust the intelligence agencies. >> joining me now is msnbc political contributor mack daddy, seat is a chief strategist for the bush cheney campaign. also alencia johnson a political strategist and former biden campaign senior advisers. good to see you both. it's crystal clear what republicans are trying to do. trying to create a symmetry and the legal troubles of these two candidates that does not actually exist, and then they are doubling down on their core message of injure undermining it institutions like our intelligence audience is, the department of justice all of the above. my question is, is it is as clear to voters as it is to us? >> well, i think it's clear to most of the voters that will vote in the generally election, it's certainly not clear to voters that will vote in the republican primary. as i listen to that from nikki haley, and i listen to that from ron desantis, what you realize is that donald trump kind of put the biggest hole in the ship of democracy, he certainly recruited a whole bunch of other people to put more holes in the ship. that's why i think we are at a time when yes donald trump's a puck proximate danger to democracy is to tayshawn's of justice in the rule of law. but he's got a lot of recruits now the scene just as dangerous as he is, and i think that's what is most concerning in the country today and the state of our democracy. >> i'm not sure if you had any the chance to watch reverend hal sharpton's conversation with vice president kamala harris. but she really make the case that democracy is on a ballot, it is a thing that she stays up and worries about, and she may not be prosecuting the case against donald trump directly talking with his legal woes, but she is under lining what the stakes of this election are. >> i think she is absolutely right. i did have a chance to watch that interview, but i've seen her speak over and over about this issue. even before the mainstream media has been having this conversation of making a connection that this is what trump is doing is undermining the democracy. this is been the crux of her argument, and this is what we are voting for in 2024. in addition to the fact that the republicans are going after our institutions, they're also going after our freedoms, that express our positions, whether it's voting rights, or women's rights. all of these things are put together in his fight for democracy. i appreciate what you said at the beginning of the segment that these are two different types of comparison that unfortunately the republicans are trying to make the same. and it actually allows them airtime to talk about something that isn't their plan for the economy, that isn't their plan for health care, because the reality is, they don't necessarily have a plan that is popular with general election voters. >> they don't believe that they're gonna actually win this on policy. mac, there are some, sumptuous p candidates who are trying to pull a pull back base back from trumpism. take a listen. >> if we can't have these honest debates within the republican party that we are not going to be able to ensure that this trend that has been happening for the last 20 years, where republican has lost the national vote, for 20 years, that shouldn't be the case, and we should be honest and look at ourselves. donald trump is a liar, donald trump is a loser, and donald trump is a national security threat to the united states of america. >> it's easy to contextualize donald trump within the republican party of 2024 win or lose, but there long term consequences for the party of course. and for america if the gop continues to stick with donald trump? >> yeah, but i don't think they have suffered enough and the republican party is not suffered enough to understand that completely. they lost in 2018, they lost in 2020, and they lost most of the races in 2022, but they don't seem to have lost enough to have learned that fundamental lesson. god bless will hurd and chris christie in asia hutchison for trying to push back and a few republicans trying to push back and speak the truth. the problem is they are speaking to a republican party which is where they are seeking votes for the primary in the nomination that doesn't actually want to hear the truth. that has no desire to hear about what donald trump said not in the course of his time that he's beaten a national stage. and so that is the problem that they get into. yes it's important that they speak that truth. the problem is they are not going to change minds of people have no desire to hear that truth. >> it just strikes me that republicans are so mired in the depth of this primary that they're not looking forward to the general having a conversation about what we will take to swing those voters. meanwhile, that is what president biden is laser-like focused on. we have new msnbc news reporting that sent billions of dollars in highway, rich and green energy projects are in the works, courtesy of bills passed earlier in the presidents term. for now though arizonans are largely driving in the same congested road, sweating in the same 110-degree summary, shelling at nearly $4 for a gallon of gas and wondering when the white house says lofty promises of economic transformation renewal ever materialize. last week when i interviewed biden harris reelect campaign manager julia rodriguez, she said i think is soon as people begin to feel these economic realities and benefits that will shift. but there's messaging work that has to be done alencia. how do you close that gap between what the biden administration is done specifically when it comes to infrastructure investment and what it is that voters feel? (vo) make the switch. it's your business. it's your verizon. now to the breaking news of hawaii, the death toll rising overnight to 93 as fires one of the deadliest in modern u.s. history. officials fear that number will climb into the hundreds as more damages assessed. fema announced today that hundreds of national guard members will be arriving in maui. the red cross a short time ago said they have had 3000 shelters in place since the fires began. white now 2200 buildings were lost in the blaze including most of lahaina's cultural and historical landmarks. here's why representative who represents maui said about the destruction earlier today. >> we walk through the streets of louisiana yesterday and i can tell you it's absolutely heartbreaking. it was shocking, surreal. we've heard all these words, but to actually walk the streets and still see fire smoldering in the distance, to see cars literally melted into puddles that have hardened on the road. axes on buildings and cars to see it is been search for signs of casualties or even life. we are not at a point where we can say a timeframe when people will be allowed back into the area. >> meanwhile, questions are mounting and outrage is growing. three firms have already filed a class action suit against hawaii electric, saying that the utility company did not act with the proper caution against the winds. here officials are also lost with the emergency siren warning system did not activate, leaving people little no time to get out. and the cease steve patterson is tracking it all. steve give us an update on the recovery effort. where does it stand at this time? >> yeah first of all it's very difficult for some of these residents to hear that they believe should have been in place in the first place. number one saying their never heard of saying, very difficult here because this is one of the sophisticated siren systems in the world according to the hawaii government. number two there also were supposed to be text messages that went out and radio messages and television messages residents i spoke to said they never went out for internet to get those messages. a lot of frustration first of all by the initial response. secondly, a lot of residents are really trying to get back into their homes not only to figure out if their home is still there but in some cases to figure out if they can get crucial medications they can see a loved one that they left behind, if they can get water to their pets. these aren't necessary essential needs. one woman i spoke to, she is delivering insulin to people who need diabetes says she was stopped for hours trying to get back into lahaina with the understanding that there are still smoldering hotspots, that there is a very sensitive scene back there with the dna records they need to now comb through, but needing to do her work. listen to this. >> there was a couple of tankers that went through and so people were standing in line for hours getting gas and stuff, so they're getting surfaces out there like gas and food and dropping things all over the place, but no medication. if people can't get their drugs -- i pressure medication it's tough. >> everything that we've heard so they're 45 people -- a lot of them sleeping in six shelters of course opened across the island. a lot of people in their cars waiting for the moment when they can get back into confirm if they still have a place to live. alicia >> and we see steve patterson as always thank you so much. with now let's live now activation manager for the central kitchen. tell us how you're charities helping recovery issues. we just heard about the needs for shelter, food medicine, where can you step in? >> thank you alicia. we're working on the western side of the island. ellen at the university of hawaii in maui. we have three chefs cooking meals as we speak. we have teams of about 45 people spread out in the northwest area of lahaina, a lot of those areas where we are actually going door to door delivering meals. for lunch today we will serve about 2500 meals. for dinner we will serve another 2500 meals. it's really about now. we were on the ground on wednesday, immediately serving meals. we immediately got a kitchen up and running. we are working with some wonderful people here in maui. i.d. help the a pouring of support, it's really just been tremendous. this is really a close knit committee and we are doing what we can to support them with what we can. >> the chefs who work with world central kitchen told me before that when you are a chef you grab your nice and went. they're also that age agencies are blocking roads to lahaina preventing you from getting. there haven't is world central kitchen kitchen contending with that? >> we community has been real great. we made some really great relationships i think we are certainly respectful of what they're trying to do the emergency services are doing as best as they can. they have been really helpful as we explain what we are doing trying to get food into the areas. we have been able to move certainly not as fast as we would like but we are getting through into the areas right now. it's really thanks to all the emergency response system that is in the area right now. >> and as much as you are focused in making sure that people have the food and the nutrition, i suspect that you are also talking with people all through that delivery as you do that do you get a sense of what is most needed on the ground right now? >> really we are focused on providing hot meals, but i will tell you as i go around now as i read my emails, and read my chats, there are a lot of people reaching out. can you help? here there's 20 people who can't get out to the distribution sites you don't have meals? we have vans, we have trucks, we are getting to those people as quickly as we can to provide them hot meals. we will come to them. we have the urgency of now to get people of meals as soon as possible. >> when you balance the urgency of now with the humility that you have share the you are up and running perhaps not as quickly as you would have liked, one of the biggest obstacles, the biggest challenges you are running into executing what you want to execute? >> i would say, we had sandwiches on the ground. we were scouting on with food on wednesday. we had hot meals going into the community on thursday. really what we are seeing in some of these areas it's a disaster zone, so we have to be respectful of the emergency crews that are getting in there. we have to be respectful of the first responders and we are doing that. but we are also making sure that we are getting meals, food out to the people who need it, that's the most important thing for us really to act with a sense of urgency. so we have been very fortunate that we've been able to get out there and help. people >> it's incredible and john i hear you on the sense of urgency. i also khiry on the reality focusing on the now because there is always a duality in these crises as you well know. there is the moment, there is the immediate need and then there is making sure that our attention is sustained such that even as people continue to pivot to the reality of what has happened in the rebuilding that needs to take place that we do not turn our attention away. your sense of both how long world central kitchen is going to be able to do this and how people want to help can best help right now? what are the lessons that you think he can take away of going into 2024? >> alicia thanks so much for having in covering ohio. we were excited about the outcome on tuesday night and, quite simply what it carabao is at a high and scare about the democracy. at the end of the day, the like people all across the country, we want fair elections and we want fair choices on important issues, and on this one in particular like abortion, but in everything ranging from labor rights to voting rights to redistricting which are all at stake in ohio, both in this election last tuesday next last tuesday but in months and weeks ahead. we were surprised and happy about the outcome and i think we will see forward moving forward in ohio, is the wing map that you saw well as we go into 2024 and beyond. >> one of the things i am struck by when you look at a variety of states that have considered referendums pieces of legislation, kansas, kentucky, it may not be people who consider themselves pro reproductive rights or pro-choice that come out and vote in these elections. it's a lot of people who say, while the government is really overreaching on this one and this is the type of extremism that i cannot support and i cannot validate. i wonder if someone who i am certain is mochi your charge of the grand plan and your fair share of door-to-door and calls with voters, the sense you got of what was most residents with a voter who knew you needed to persuade to come out and vote for you? >> i think you're exactly right. ultimately this is about our freedoms, it's about our democracy, it's about making clear the choices in front of ohio voters, both last tuesday and what we'll see next november. ultimately, i think most ohioans are on the side of women having the freedom to make their own decisions. they do not want out of touch politicians in the doctors offices with them and their families as they make difficult health care decisions. i think what you're seeing as well is that an electorate that is remarkably sick of the out of touch extreme positions coming out of our state legislature, which if you'll recall was last year was gerrymandered quite profoundly, it was declared unconstitutional seven times but our state courts. we will go back to the drawing board this fall with district -ing in ohio. so for folks who want to join us in the district-ing fight and the abortion fight, they can go to higher dams dot org to find out about these things happening in the buckeye state. >> given that you are an expert on your own state, and you understand these things. i think there is a tendency to draw all the states that have gone red in the last few presidential cycles. what works in ohio does not work in another state. so going into 2024, one of the unique dynamics in ohio that you think ultimately the state pivots on? >> i remember that barack obama won ohio two times as well, so ultimate swing state status to go back and forth. when things ohioans have always been for it for elected officials who support them, their families, their job, their wages and, there is no better fighter for ohioans, there's no better fighter for all hines freedom and wages and sherrod brown. i think ohioans will remember that as they go into the voting box in 2024, especially when you see who he is up against. coming out of tuesday i think it's safe to say that the biggest loser in ohio has been officially crowned frank la rose, ohio secretary of state, who staked his political career on state issue one, and is trying to challenge senator brown in 2024. he shows himself to be out of touch with most ohioans on this subject of a balloon, but he shown himself to be a pretty bad official and pretty poor stored, with ohio's trust, costing is $20 million in a special election it turns out most people didn't support and in what, but also failing to administer the election in many key ways and in an effective way. i think voters will remember that next year as we get into the 2024 cycle. >> my last question to you. i have to imagine that if you are the democratic chair of a state party, when all of a sudden you have an election like this and national attention turns to your state and there are multiple reported and fake pieces written about that it is possible that ohio is back in play. it is exciting, because there is possibility of national resources pouring into your state. there's also little bit of, buckle up because now this is going to be a different ride from the one we saw. what would it actually take from a resource perspective to put ohio back into play?
