it to. us hello, i'm alicia menendez. as we come on the air tonight we are closely monitoring the second deadliest wildfire in u.s. history in hawaii on the island of maui. 80 people are now confirmed dead. sadly, the kit mayor tonight wanting the death toll could go up as more damages are assessed. from the air, the toll of these fires, well, look at it, it is hard to take in. homes reduced to rubble. this as half a dozen fires are still burning in maui and on the big island. officials say fire in the historic town of a hyena is now 85% contained the governor saying he believes these fires could be the largest natural disaster in the state's history. , tonight residents either working to evacuate maui, if they can returning home or in cases they are finding nothing. there are also air quality concerns to talk. about we will over the next two hours with live updates from maui we will also speak to a 9-1-1 first responder who is there on the ground working to help fellow americans displace. on to other big stories. donald trump's words catching up to him in court. at a hearing on, friday the judge in the election interference case issued a protective order restricting the former presidents access to evidence. trump's lawyers will have to inspect any notes he takes on sensitive trial materials and trump can't use a cell phone and he review's testimony without his legal team. special counsel is asking for trump's trial to start january 2nd 2020 for the judge warned that date could be moved up if trump tries to intimidate witnesses she told trump's attorneys quote mr. trump like every american has the first amendment right to free speech. the right is not absolute. trump today is at the iowa state fair along. with other republican rivals. here's how he responded to a question about the judges protective order. >> biden put it out because he can't win the fair. he's down in the polls. are you going to overturn the 2020 election. >> trump has already been taking aim at fani willis who is likely to indict him in racketeering charges early next week. that's according to nbc news. another sign of her intention to indict former governor jeff duncan he's been ordered to appear before the fulton carat grand jury on tuesday. in the meantime, trump is running this ad against willis this weekend. listen to what is currently airing all across the atlanta market. >> biden's luis lackey, fani willis. so corrupt. willis got hot crying with a gang member she was prosecuting. >> the dea says trump's claims about her are false and defamatory. washington post calls her urging other prosecutors to take the attack seriously. writing, quote history teaches that when trump cloaks himself in martyrdom and political victimhood bad things can happen. joining our conversation, msnbc contributor and former u.s. contributor joyce vance, sisters and law podcast and a professor at the university of alabama school of law luke broadwater contraction reporter for new york times, an msnbc political analyst ferdinand among. the president of the international and host of these strange days podcast. it's good to see you all. i think we have to talk about the stakes. the fbi shooting unarmed man this week made threats against president biden and manhattan d.a. alvin bragg. how concerned are you about trump's attacks against that. the fact that there is a television ad airing in the atlanta market? >> so, the problem here is that we are so used to this behavior from trump. in many ways, it almost goes unnoticed. it's deeply serious. at this point, a responsible person, which the former president's, not would be aware that they are words carry the threat and the risk of violence. the fact that trump continues this, the fact that he aims his venom at public servants, at prosecutors, at law enforcement officers, at other, it's abundant reason for people to take this seriously. that's why fani willis issued the request that the fulton county courthouse be shut down for a period of time to permit her to move forward without posing a threat to innocent bystanders. the fact that nothing is happening with this first series of indictments, although as you point, out there have been near misses. the fact that there's been no major outbreak i fear has put people into a little bit of a mode where they are not as alert as they should be going forward, law enforcement will have to be on full alert for these sorts of court appearances and other events. >> and i so often ask, i'm going to ask you to walk us through a timeline, this time for the indictment in fulton county. the testimony is tuesday. when can we expect charges,? >> so, we should expect charges in the next two weeks there's a wrinkle in the procedure in fulton county involving how long the prosecutor has to take a case to trial they have to grandeur a sessions from when they indict including the one that they indict. in the last couple weeks of the current session, there's another one that happens in the end of the year. it's unlikely willis would want to wait that long. we could expect to see an indictment during this term. probably early this week it would then be announced. you'll see as we have in other cases and arraignment and then the early proceedings is a protective order. the commencement of discovery. >> luke, as you talked to republicans on the hill do you get any sense that they are bracing for the next two weeks, that they know what's coming? they feel it impacts their politics in anyway? they're on vacation right now, they are not answering your phone? calls >> no, i mean, look there's been no break from donald trump and fracked there's a rallying around him. a bunch of the florida republicans from the hill right now are with donald trump, they flew with them to iowa to support him. so, they almost all expect him to be indicted you can talk to his allies they expect him to be charged with a fourth case. . they believe and i don't know if this is just bluster or not they think that every time he gets charged it's good for him in the republican primary. he raises more money he goes up in the polls he has an adversary to fight against, they can portray it as biased. or the justice department or the democratic circuit or the larger concern for the republicans of course, once they get to the general election all the antics and criminality and charges against donald trump are going to be off putting to a ton of modern and independent voters. they seem to have made up their mind that they're going to go with him no matter what. >> to the point about those voters some gop voters it sounds as though they are getting tired of trump's trauma i want you to take a listen. this is a voter in iowa. >> i voted for trump the last two times if he's the candidate i will vote for him again i think it would be nice to have someone come in with less drama and trauma. >> i like what trump could do if he kept his mouth shut. so that was the thing. he's not a good leader. i liked his philosophies and what he was trying to accomplish. what he was doing, was not good. >> you have sat in on more for case groups than he would probably care to count so you are a master at listening to not only what is being said but what is not being said. when you hear those gop iowa voters what is it that they are telling you. what >> they're telling me, donald trump is going to the republican nominee in 2024. i say, that, alicia, i'm looking very clearly not just at what the focus groups, what the polling is, saying, i think joints vance had it right the outset. we're at the break of the fourth trump indictment. the last one that happened was the big one. the federal indictment on january. six after every single one of these indictments, he has risen in the polls. he has not lost support so, by trump's logic as distorted and irresponsible and dangerous as it is every time something quote bad happens legally for him it's a sign of strength it's a sign of him slacking down and strengthening his hand on this republican primary and what you are seeing alicia these maga based republican primary voters are giving new meaning to the term ride or die they are truly ride or die with donald trump. that's the type of support you tend to see in a cult of personality. they were going to be with him until the bitter end. >> it was amazing to hear the voters say, i will vote for him again. i wish there was someone with less drama. already pledging her fealty to him, i have another legal question for you carlos osten entered a plea in the classified documents case. that type of, delay i know it can see minute in the scope of things, i wonder what that does to a trial date. to what i recall is the busy court schedule next year. >> it's very unusual to see this kind of a delay until arraignment. it's important to remember that de oliveira is not someone who doesn't live in the district he's been indicted. there where you might see delay as with the defendant who's out of state and will have to look around for someone local this is a resident of the miami area. someone for whom there are many opportunities to find council other judges might have considered being a little bit more pushy giving him a day to get council by this does delay the proceedings it is the kindest characterization. it's unusual. it's time for the court to, say okay let's go. >> luke i have a quick question for you. we don't have a lot of time, the special counsel that was appointed this week in the hunter biden investigation, again, understanding that republicans on the hill are on vacation this week, i do wonder, what is it that you are your reporting tells you about their response given the extent to which donald trump and his allies have tried to argue the doj is corrupt and politically motivated? >> right, it's funny. the republicans initially called for david weiss to be named special counsel. they agitated for this and a number of letters. they wanted a special counsel here. now merrick garland has named the special counsel. most of them have reacted with outrage, saying the fix is in, it's a cover-up. there are some more private. i have talked to a lot of republicans over the last few days who think that in some ways it helps them politically. who knows where a special counsel investigation may go. if it keeps hunter biden in the news and in court, they think that's good for them politically. publicly, most of them are decrying david weiss as some sort of whitewashing effort on behalf of the biden administration. >> decrying officially agitated. for joyce and luke, as, always thank you both. you are sticking with. may still to come, from the butter cow to fried everything. the iowa state fair could serve a hefty reality check for the republican party. can anyone take a bite out of donald trump's lead? (announcer) change your life at golo.com. that's golo.com. this weekend, it is all about the candidates, the corn dogs, and a whole lot of other things in the iowa state. there i was the first nation caucus for gop voters, which this time around serves as the first real test of donald trump's hold on the republican party. it could ultimately thin the herd, so to speak, in the wide field of gop candidates. political reports, quote, the iowa state fair kicks off a new more intense period of the republican primary season. as nationally televised debates began this month when we hit the five month countdown until the iowa caucuses. the conventional wisdom on republicans is that if donald trump's republican opponents cancel him down in iowa, the race maybe over. of course, overall of, this trump's long list of legal troubles, but in his sprawling effort to overturn the 2020 election. ahead of trump's visit to des moines today, he blasted special counsel jack smith's push to start the election interference trial in january. just weeks before the iowa caucus. in a new fundraising email, he declares, quote, winning an iowa has always been important. but now it will be a symbol of our triumph through tyranny, -- political analyst, -- i wonder how you see iowa in the timeline of this race? the role that it could potentially play? >> well, felicia, i was the state where a lot of the second tier and third tier candidates think they could make a slush. some of them they think they might be able to defeat trump in iowa. looks very difficult at this point. but it is a state that gives republicans a lot of hope because it is a state where you can actually go and go to places like the fair and connect with people. and maybe catch fire. but for now, alicia, it looks like donald trump has pretty much every state on lockdown, of course there is still plenty of time left. and of course we have that first debate, which will really help shape the race at the end of this month. but for now, this is donald trump's primary -- >> there is real confluence of my interest today. you had voters tackling ron desantis, not just on the ground but also in the. adds the confluence of my interest, the sign. a plane with a banner flew over the fairgrounds with the phrase, be likable, ron! new york times reports, quote, although it wasn't immediately clear what responsible for the, the joke was a reference to advice given to desantis before a 2018 debated during his first run for florida governor. as you know, i read a book on likability, and one of the things that stood out to me in the chapter about politics is that while in general motors do want candidates to be likable, they want them to be accessible, [speaking french] -- [inaudible] [inaudible] but the core question is, can he confidently do the job. and it would seem to me but voters still have questions on that, predicated on what they are watching at florida? >> oh, no question, alicia. he has definitely been caught in that likability trap. and you look at the fact to the question of confidence, what most voters are seeing that don't recognize the work he can afford, they are looking at how's campaign is run. now that might be a reflection of the organization, but -- that campaign has been an litigated disaster. so when you couple the fact that he comes across as very unlikable and he has had a disastrous campaign, it makes it sound as if the new offering at the iowa state fair this year's fried desantis. he very well may be done. and i think you asked earlier, is i will make or break? i don't think it is for donald trump. i think you can afford to lose and still go on to win the nomination. it is absolutely make-or-break for ron desantis. anything less than a first place finish in iowa for ron desantis, if he even makes it to the iowa caucuses in 2024, it's the end of his candidacy. >> particularly interesting to me given that this week the argument was also made to me that while chris christie, there is no world path for him to win the nomination. the possibility of him playing sitting in the top three in a place like new hampshire given the unique dynamics of new hampshire is gone another thing that begins to scramble erased if they are all on the donald trump lane the may start to realize, hey, the one or two guys who are not in this lane here actually picking up some momentum and of might motivate some of them to do the same. our, listen want to make sure i ask you, nbc news asking trump today if he intended to overturn the 2020 election. and he was wanted, quote, you know the answer to that. >> all, i think we know the answer to that. the answer to that is of course. because that is exactly what is donald trump tried to do in january of 2021. overturn the 2020 election. and it is these kinds of statements, alicia, he is not gonna get punished for this in the republican primary. but these swing voters and swing states and swing districts, this is the type of language that they obviously reject. and understandably reject. this is the reason why donald trump and his movement have been rejected in general elections three times in a row, 2018, 2020, and 2022. my prediction is that because he keeps saying these things, that 2024 is likely to see the same result. at the same time, democrats can't take anything for granted. joe biden is dealing with his own struggles and controversies. but this is the kind of language, this is the kind of attitude that swing district voters, swing state voters reject, and of course donald trump is just gonna double down on this, because that is all he knows how to do. >> the president does have the advantage of the fact that he is looking straightforward to the general election. right? "my skin is so much more moisturized." see the difference with olay. out a bit of sitting wildfires in hawaii, the paradise of maui reduced to ashes. as this, our 83 people are confirmed dead, officials fear that number will rise as the continued search is for those missing. president telling nbc news they had -- as wild fire was coming. many were forced to dive into the ocean to escape it. most of the popular tourist destinations of lahaina, along with its many historic landmarks, now lost. it will cost millions to rebuild. hawaii's governor's josh greene saying the wildfires are likely the worst natural disaster in the state history. president biden has signed a major disaster declaration for hawaii, now on the ground, helping those displaced. as the national guard and army are helping fight the fires from above. nbc's steve patterson is on the ground for us in maui, tracking it all. steve, bring us up to speed on the latest there? >> alicia, it is a gargantuan task. we are talking about thousands, at least thousand people still feared the same. this is the road back to lahaina, right now you can see the roadblocks. this police roadblock has been here all day. they have periodically, letting residents back. at some point they have halted traffic entirely which is frustrating to people that have been -- for the last 15 plus hours, maybe even more than that, if you factor in what we have gone through today. and that is not a factor in what they have gone through to get here. as you mentioned, a lot of people leaving their homes as fast as they could. a lot of them with just the shirts on their back, leaving press just medication, leaving pets behind. leaving family members, not knowing where they're familiar reserve. so that's what these people are experiencing right now. that's what they are trying to get it soon as we speak. meanwhile, the search efforts still continues. as you, mentioned the death toll at haiti. and that would make this close to one of the deadliest wildfires in modern american history. and that death toll is expected to rise as collaborative was not going through the wreckage. while more than 2200 buildings destroyed. 4500 people need shelter, need, food need water, the fuel. need like it's. and that aid, that need continues. every minute of every day that this goes on. so this is a huge task, and unfortunately as the days go on, we expect to hear more about the in that wreckage. as first responders continue to give their word there. >> steve, help me understand something. we were just looking at those aerial images of maui. and some of the fires that are still not under control, the smoke that is emanating from the island. and then we see where it is that you are. what does it feel like to be on the ground in maui right now where you are understanding it is the focal point of a whole lot of operations? >> yeah, imagine the most anxiety that you could feel. if you are somebody and one of these cars? because you are talking about, you are seeing the devastation that we are seeing on the news in images. and you are not knowing if your house is a part of that or not. that is a lot a lot of these people are experiencing. there is no smoke here, no sign of damage here, no sign of terrain here, no wreckage here. it's maui. but up the road, maybe 10 to 13 miles from where i am standing, there is nothing but devastation. and these people don't know whether or not their legacy, their family, their home, their pets, the medication that they need, it's part of that devastation. so that is the feeling. that is the mood here. on top of the fact that i spoke to a lot of people, of course, there is an investigation with the attorney general in the state here about whether or not those sirens went. off the state admits the sirens did not go off. the investigation is about why. text alerts went out, tv alerts went out. radio alerts went out. small help to people that didn't have any power or any internet. so all of that is part of this too. and part of the frustration that people are feeling when they are still stuck in this line, trying to get in. alicia? and even more importantly, what is the harm than of it being part of a public school curriculum? >> first, no to that i do not know a floater district yet that's gonna allow this programming in their schools, even though the state has approved it. so -- a lot of teachers across state, very concerned, because what pressure you, even their ceo has said that they intend to indoctrinate students in the state of florida. that is what their curriculum intends. it is not about teaching a complete and honest history, it is about whitewashing history. it's about lying to students. and it certainly has no educational value, whatsoever. and so educators, we want to make sure the content was teachers are using -- screaming for resources and content, we want to make sure that content is appropriate. >> san, it is my understanding that you are leading a memorialization project to preserve african american history. here is what one of the local residents had to say about those efforts. it gives me the opportunity to show the history, show the contributions that were made by the enslaved. to make it possible for madison and others to get develop the constitution. it's important to do that at this time, because this is the time people want to know their history, want to know their answer. talk to me about the importance. i think sometimes this gets misunderstood as though it is only dangerous to black americans when the way that we teach history to future generations is dangerous to all? >> it's actually dangerous to all. american history has many different components and many different parts to it. african american history is a part of american history. with so critically important about telling african american history and telling it truthfully, that provides a prism into the american experience. i serve as the chair of the board that oversees the state of james madison, -- and we are endeavoring to tell the history, not only of madison's views on slavery and the constitution and this sort of route, but the history of the enslaved people who were there. and the truthful and honest way. if we are able to understand the past, but that's tragedies as well as as triumphs, we will be better prepared to solve the problems that we face today that have directed connections to the past. and these videos, this political propaganda, it does exactly the opposite of that. >> andrew, and it's comes at a time when they are a lot of changes happening to education, many florida schools being removing a.b. psychology courses from classrooms. supposedly it violates florida law, prohibiting lessons about sex and gender. there was followed, prompting the education commissioner to release a statement saying ap psych can be taught in schools. why then are some florida school still choosing to mix the course? >> well there is still a lot of confusion in florida. what is happening in florida right now is an all-out attack on public education. it's an attack on curriculum. and it's intentional, in my opinion. it's intentional because there are those with the powers that be who want to drive people out of public schools. we see this attempt to change the curriculum -- block students from getting what they really need. there is an attack on teachers in the state of florida, trying to take away their voice and their ability to do their jobs. every pitcher -- they are not very comfortable with the way the school year starting, they're very, very concerned. they are not excited. and it is why they're leaving the profession in droves. we have over 7000 teacher vacancies right now the state of florida. as the school year starting, what's happening with the curriculum, what's happening with the public schools in florida is really driving, that and at the end of the day, it's kids that are losing it. >> strength, pressure, jeffries that this happens as part of a broader continuum. right? there is a chilling effect on election workers and poll workers, and makes it hard to recruit those folks to be part of our democracy. there is a chilling effort on those who provide proof of reproductive health care to states where is no longer accessible there. in many cases, leaving, states leading women who have high risk pregnancies about the care that they need. and then you talk to educators states like florida feeling like, i can't even just do their job. they are not clearing some guidance from the state what their job is. it is easy to see each of these things in a silo,. but it is all part of one big attack on our democracy. >> we absolutely have to see them as being connected. florida is not las vegas. what happens in florida doesn't stay in florida. it's threats throughout. and it's very, much as you said, not just in those places with the laws of the, past but even where they are proposed, it has a chilling effect, silencing effect. and those who want to do right in the classroom, those who want to do right by their patients in the medical field are unable to do so. they are afraid to do so. and that is about democracy. this is education, this is a reproductive health. but really this is about democracy. and preserving democracy. but also some people have a full menu of rights that they can enjoy. >> andrew, i've got about 30 seconds, left but i want to ask, if you were in another, state you are watching what is happening in florida, what is the lesson?
