it is friday and we have got a fantastic night crap grew recapping week it was, about let's talk about the day that is and we saw major developments in cases that involved the current former president. judge tanya chutkan issued a protective order in don't rams 2020 election interference case after hearing arguments from the government and trump. >> she put everything that has to do with witnesses in the compartment of it and sensitive information. not just grand jury witnesses, anyone that the government had interviewed. that is the first thing. and the second thing is that, even as she gave a negative to the trump defense team of not defining everything as sensitive materials, she took it away by making clear that anything that the government was concerned about in terms of both impairing the jury pool and also going after witnesses, would violate the order anyways. >> judge chutkan also warned trump's lawyers that continued inflammatory statements from the client would only increase the need for a speedy trial. also, in washington, attorney general merrick garland called a surprise press conference to announce the appointment of a special counsel in the hunter biden probe. >> tuesday of this week, mr. weiss advised me that, in his judgment's investigation had reached a stage at which he should continue his work as a special counsel. and he asked to be so appointed. upon considering his request, as well as the extraordinary circumstances relating to this matter, i have concluded that it is in the public interest to appoint him as special counsel. >> the white house says it had absolutely no advance notice of the announcement and made no comment. finally, president biden's attorneys are in talks with federal prosecutors over an interview into the investigation of his handling of classified documents, that includes negotiations over when and where such an interview would take place and the scope of the questions. with that, let's get smarter with the help of our leadoff panel this evening. jon allen is here, senior national politics reporter for nbc news, the initial washington correspondent for the atlanta journal-constitution, former republican congressman david jolly of florida and an msnbc political competitor, and former federal prosecutor or not to marry, adi ease also a legal affairs columnist for politico. ronaldo, let's start with his protective order. what are your thoughts? >> well, i really think that this is a loss for trump. if you played a clip a moment ago about how it was a split decision. i actually think that the judge chutkan it made a very wise decision here by not trying it to gather too much on these first amendment issues, but what she did is warned him, and i thought the key quote that you write a moment ago was that this could increase the likelihood of a speedy trial. essentially, what i think she is going to do, because she is a very seasoned lawyer, she is litigated for a long time is she is going to basically tell trump the more trouble you cause her, the more you are badgering witnesses, the speed here that trial is going to get, the less accommodations she's going to give him, and ultimately that's going to be a bad, bad thing for donald trump. >> dave, it with the exception of jail time, is a speedy trial trump's worst nightmare from this judge? because his main defense is delay. >> yeah, that's right stephanie, grenada is exactly right. i think many of us were expecting a more restrictive environment. is there an environment in which donald trump could be facing pretrial detention? the judge here clearly understanding all of the special circumstances and instead decided that we're just going to speed up the trial, mr. former president, see what you think of that. look, donald trump's entire strategy for his presidential run, as well as a little bit of his legal strategy, if he's going to ultimately seek absolution at the ballot in the post to the court, is to push any trial, any of the current three indictments, and perhaps a, fourth pass say mid march when he would likely shore up the republican nomination. a trial for donald trump going into the general election, given his mindset, he thinks helps him. but it could hurt him if he is up 30 points and he does not yet know what would be the result of a trial before the republican nomination is secured. so donald trump wants this trial in the summer, not before march, but the judge said today, hey, keep it up mr. former president and you might get this in january. >> john, you're not going to see me advocating it to delay this, however the said say that they are going to hand over 11 million pages of discovery. we know that trump is already facing some cash flow problems, but put that aside. he does not have major law firms representing him. with dozens and dozens of young people and researchers who can pour through this. he has got a couple of guys who basically had to sign off and leave their firms in order to work with him. how on earth are they going to go through this? how is his legal team going to face him? >> that's the right question, stephanie, and as our colleague pointed out earlier today, one of the trump lawyers effectively said that they're going to have to have volunteer lawyers for the people who aren't getting paid because there's not enough money to pay people. those 11 million documents, this is a real problem for donald trump, and it is a huge, huge problem. we saw him spend about $30 million to save america pack in april, about $30 million -- at the end of. so he is capable on that. >> 11 million documents. téa, judge chutkan already has extra security, she needed it in the court house just to get a coffee. we know that down in atlanta, the courthouse is preparing to lockdown ahead of next week's expected charges. if these are the precautions that law enforcement is forced to take now, what is the trial environment going to look like? >> well, that is a big question because i think that we are seeing that it is a wildcard, how support of president trump might act as the news of these indictments continue to come down. we saw the circus that happened when he turned himself in in new york. but there was not the same type of drama surrounding the indictment in florida for example, that being said we are in unprecedented territory when it comes to a former president possibly going to trial and all of these cases. again, some of it has to do with how trump speaks to his supporters. what he said on social media last week when you come after me, we come after you. a lot of people said that could incite people to shop in fulton county next week, it could incite people to do other things as these cases unfold. that is why law enforcement is on edge in fulton county and elsewhere, and taking a lot of precautions. >> all right, we're not, a new topic. the president's son, hunter biden, david weiss has now been assigned as special counsel, elevated. what do you make of that appointment? what is going on here? >> well, a couple of things. first of all, there is clearly, i think, a appearance issue here. one thing that was going on in capitol hill, republicans were pushing for the deployment, they were suggesting that garland and the administration were trying to protect biden's son, that argument is gone. cut off at the, knees that is one thing that happened here. but i think another thing is the plea deal that, hunter and his -- thought that they had negotiated with wise, that has fallen apart. part of the two sides are at odds, wise is continuing to investigate and this, i think, gives him more leverage. it basically is a signal to hunter that to better negotiate with wise, they better be able to come to the table, because otherwise he is going to keep investigating. >> one group of people anxious to talk about this today, and it was republicans. i want to share a bit of the reactions that we saw from republican presidential candidates. watch. >> i think it is about time that we saw the appointment of the special counsel be get to the bottom of not only what hunter biden was doing, but what the biden family was doing, and the american people deserve answers. >> i don't trust it, i don't think the american people trust it, i don't think that the american people trust the department of justice or anything it is going to do. >> it seems to me that they are going to find a way to give him some type of soft book a treatment and i don't know why you to point this guy to be the special counsel. >> okay, here is my question, david. if there was not a special counsel, they would be mad. now, there is a special counsel and they are still mad. what scenario, with the exception of punishing joe biden, forcing him out of office? what realistic scenario would they want to see around hunter biden? because, again, it is under investigation and there is not, at this point, and a direct line to the president. hundred doesn't work in the government. >> the one thing consistent about republicans on the hunter biden matter, stuff, is bad faith. it's all about bad faith. he was not being investigated to announce and now they have a special counsel, well, we don't trust the special counsel because we only trust jim jordan and chairman comer and kevin mccarthy to jump this innuendo gap on the behalf of the american people to make allegations that can't be substantiated. i will, say in terms of david weiss not making the request to be a special counsel, he's kind of like the referee in a game against -- and so he changes his call. but look, after five years of investigation, he proffered to a court a charging agreement that said, after five years of looking at this, here are the two charges. the tax charge and gun charge, and this is what the doj suggests and the judge said i don't know about that. so he goes back and says, okay, i'm going to change my opinion on this. now, some of the special counsel stuff might be around jurisdictional issues. delaware, california, is a d.c.? it might actually make it harder for house republicans to investigate this because now the doj says wait a minute, we've got a special counsel investigation. at the end of the day, what we know is hunter biden is a private citizen. nothing to this point after five years has pointed a finger at joe biden with any credibility whatsoever. perhaps this investigation takes six months, perhaps it takes two years, it probably is an unwanted distraction right now for all sides, but i've got to tell you, merrick garland and david weiss right now, they have made both sides angry but not in a way that actually lifts their credibility. probably in a way that diminishes it. >> john, what are republicans in congress going to do? in theory, they are going to call hearings. so let's say they do. who are they going to call? hunter? he doesn't work for the government. >> he doesn't work for the government, i think it is going to be difficult to call in the middle of a trial, which david's point, this frustrates their investigation to some extent. to your point earlier, what would make them satisfied is if hunter biden's kidnapping the lindberg baby. i mean there is -- not a limit what they would like to see happen to hunter biden. but i do think that republicans are going to continue to make noise about this, if you remember kevin mccarthy, way back in the 2016 race, talked openly about the benghazi investigation is going to harden -- and i don't think that you're going to see house republicans rest on this hunter biden issue, at least in terms of talking about it. >> they can't, not with the legal he turned up for trump, which it is in the state of georgia. so, let's go there, to. a lot of rumblings that he could get charged there this week, what do you think is happening? >> you know, that is the big question. i think that a lot of the signs point to the fact that the sheriff, the district attorney, they are preparing for a security situation that kind of indicates that they are going after big fish, which has led a lot of people to believe that president trump may face charges, if not him, perhaps some of his top allies, the eastman,'s the giuliani's, you know, we won't know, but the signs are pointing to something really big happening in folding county really soon. >> david, with all of the hearings and headlines coming out of jack smith's world, are people underestimating what could happen in georgia? >> yeah, i think so. you, know it is interesting, the prudent analysis of this suggests caution because it is easy to say, after everything that we have seen in the last six months, that each successive indictment makes trump stronger. thus far, that has been the trajectory. but the gravity now of the jack smith's indictment and the possible trial, as we have been discussing in january ahead of the primary, or the additional indictment in georgia, the question about actually subverting our republic is on the line, does that actually continue to strengthen donald trump or does it cause republican voters in the early states to say, look, this just might be too much? every republican candidate with trump baked in those tragedy that this might be too much. four indictments might be too much. we have not crossed this moment out, but we are entering it and we will watch to see. >> all right, ronaldo, another new topic. disgraced former crypto king sam bankman-fried, no longer fried, the former founder of ftx, got his bail revoked today. until now he has been in northern california living with his parents, awaiting trial, but now he has been ordered to go to jail for tampering with witnesses. this is happening just as a donald trump is potentially going after potential witnesses. what did he say last week? reminder, you go after me, i'll go after you. do you think trump or his legal team are paying attention to what just happened to sam bankman-fried? you know, if i was a trump legal team, i would be showing this article that you just showed on the screen to my client and warning him that that could happen to him. you know, sam bankman-fried -- the only criminal defendant who is more foolish about talking to the press than donald trump. he's practically a member of the prosecution team. it takes a lot of skill to be a billionaire who has a massive bail -- and home arrest, and to screw that up by trying to go after witnesses trying to release his former girlfriend's diary to try to intimidate her because she's the star witness against you. very foolish, and he's frankly getting exactly what he deserves, and i think -- a lengthy sentence. >> well, we will soon find out. all right, last topic. i know you have made you guys cover so much tonight. what should we make about president biden's lawyers negotiating with the doj about his potential interview about handling between classified documents? well he stepped into office, we were coming out of the perils of the pandemic. but do you think it's risky to be running on economics? we don't have a clear path ahead of. us >> it's an interesting path ahead. inflation has certainly come down. it was running your 9%, now it's near 3%. the unemployment rate has remained unchanged. we have never had in history, in post for history, a time when inflation has come down quite so much. -- quite as low as it's been. it hasn't gone up almost at all, three and a half percent. it's near a 50-year low. and the weird thing is this recession that everybody keeps forecasting, it's like, i call it the good the recession. we keep waiting for, it and waiting for, it never comes. we are tracking right now. it's early days, but the third quarter is running three or 4%, almost double what we believe to be the potential economy. when i surveyed economists on that, -- they thought it was gonna be right around the goose egg. it's unclear to me if the american public is going to feel these numbers. >> okay. >> that's a very different story from what the actual numbers are from an economic point of view, they're looking pretty good. and there's a story to tell about how things break next year for the biden administration. i don't know if it's going to be true or not. but, next year, the federal reserve should be cutting interest rates. if we get control of inflation, this would work fairly well for the biden administration. >> supercharge them. >> it could help the stock market, it could make people feel better, it could use the housing market. right around early spring or early summer of next year. >> let's go from facts to feelings. sammy, he might have all the facts in his corner, but if you and i went out to dinner tonight, we look at our being ill and say, is that 20% more than what it was before the pandemic? how does the biden administration -- you can't convince people to feel better. >> i don't think this is something that you can reason people into believing. you can show them the numbers, but as we know, money is a very emotional thing for people, even when times are good. >> go try to book a hotel or a plane ticket. >> right, exactly. and i think that ultimately, to be honest with you, i don't think right now is going to make or break the presidential race next year. i don't think that most people are pain such sharp attention as they will be next year. i think that this is a good time for biden to be pushing those winds that he, that we have been having in the economy. i think next year that we are going to be looking at very different situation. i think that the other issues like abortion, climate change, i think the number of young people who are going to be voting next year, is ultimately what's going to make a way bigger difference than the conversations that are happening this summer. >> abby, after congress takes its five-week break, they come back, and there's only a couple of weeks that they have to pass a budget. if we end up with another showdown and a shot down, is not going to be a sideshow? or could that actually impact things from an epic no standpoint? >> i mean, it can't. when you have a government shutdown, it can impact travel, national parks, school field trips, and these things -- small ways in american lives. >> well, they pass people off. >> i remember my trip was canceled because of the 1995 shut down. these do have an impact, but i think the larger problem for the people in office right now is just how unstable this looks. it's not just going to be the spending bill, they're going to be other bills that are coming on that usually pass very easily that americans aren't even aware exist. and they could be falling apart. so this is -- this is going to be a very chaotic fall. >> one of the reason fitch downgraded us was for this gridlock. phil, let's talk about the split screen, right? president biden is out here grinding it out, talking about the economy, talking about policy, while donald trump, who he could be facing off against, is on his grievance tour, getting people fired up about anything they're mad about. and also, he's doing this between his court appearances and indictments. the fact that trump, though, is dominating the headlines, what do you think about that? because trump would argue all presses good press. >> and frankly, the medias in the middle of this, because how will they determine this? right now, we're seen biden out there making this argument, and the media is still pretty skeptical. they don't particularly, or totally are convinced this is true. where you have trump out there saying the economy is that disaster, a catastrophe, which obviously isn't true. but it's the extremism of it that is what the republicans push, and get some headlines and it keeps him in the news and he keeps pushing it. and his people believe him, even though he has the worst record for honesty and maybe the history of the presidency, in terms of line, including the biggest lie of all-time. so, how does biden get to the point where he can be credible against a guy who is completely not credible unless the media starts to say, yeah, we need to start acknowledge that what he's saying is right and the other guy's not saying the truth. >> stephanie, i have another question. >> you're not here to ask the questions, just so you know. >> fine, ascot. >> it's kind of a rhetorical question and kind of. not -- if the economy is such a slam dunk issue for the republicans, why aren't they talking about it? why is it all woke politics, grievance politics, all this other stuff, if they're going to win on this issue, why are they not slamming it every day? >> because you know the answer. because it's not a home run. we have a complicated economy, so you can't possibly say it's all good for -- >> you can't possibly say it's good for everybody, because with 330 million people, it's not. but republicans cannot slam him every single day and yesterday on the economy, because it's not a winning argument for them. they have to do something else. so it's actually dicey for them, to keep pushing on the economy. >> they push, it but they push without facts. they just push it. they just say, it's a disaster, it's a catastrophe, and then there's a report saying, this job came in way bigger than expected. inflation is going down. so they can't really sell that convincingly except with rhetoric and saying it's a catastrophe, it's a disaster. they can't be specific. >> i mean, i think that what, we used to talk about how republicans are so great at message disciplined, they're so good at getting on the same page. and they are pretty good at that, but they've chosen to focus on what bathrooms people are using rather than speaking about the economy. even if they could make a cohesive argument for why the economy is bad, they're not doing that because they are lost in this forest of, we hate disney, and we hate bud light, who are we going to go after next? it doesn't get them the ratings to talk about the economy anymore. there are so far afield of what used to be normal, that i don't even think we can compare this anymore to a pass situation. >> here's my question to you. what do we cover? right? because people are gonna argue, i'm tired of hearing about donald trump every day, and i take that argument. however, this is a former president of the united states who has now been indicted three times, potentially a fourth, with the most recent one being charged with trying to defraud the united states of america. how do you not lead with that? >> i think the most important thing, particularly in television, is for every reporter, executive producer to very thoughtfully go into any interview with donald trump. there should be mortar boards, there should be actors doing role play of trump, and it should not be live television. >> and guess what? every one of us here would love to sit down with donald john trump, and i'm counting the minutes until i get that opportunity. but besides interviewing him, how do we cover this political landscape? >> i think that we have to stop covering what people are saying and cover more of what they're doing. >>, very rachel maddow of you to say that. >> thank you. i think it's very boring to talk about what people are saying. words are cheap, actions are tough. it's hard to get things done. and i think that if we spend more time, even if it's not the biggest story, even if it's not biden or trump or the speaker or anything like that. covering smaller say mean stories about what people are actually doing, what governor desantis is doing, i think these are the type of things that actually give people a sense of what's actually going on. >> okay, but to stay on that, here's one of the reasons that so important. who do you hear about every day? marjorie taylor greene, lauren boebert. tell me how many legislatively winds either of those women's have had. until a hot minute ago, they didn't even sit on committees. >> i don't have a problem with this dilemma, because i'm gonna cover the economy. i'm gonna cover it every day from six in the morning to six in the evening. so i don't have that dilemma. the politics to me are -- to me, are distraction from what should be the national conversation. i think there are really important debates about the distribution of wealth in this country, how we tax people. how we spend that tax money. about deficits. i think the republicans have a winning argument on, but i can only take it so far because the solutions are those that are political third rail's here. i just think, as a reporter, i just keep pressing on the things that i think are important and i get that there is this need of the media to report this. this meltdown that goes on as far as the political discussion. but to me, i think it's a big distraction. >> you said they were winning argument. every time i hear that, they created a massive deficit when they were in charge. so why would they be different? >> it's gonna play differently from the last strike happened and shut down in 1980, because what happened here was the studios, because of streaming and netflix, out netflix shake up the industry, they basically scrapped their own business model. they threw it out the window, and they basically said okay we all need to become streaming networks and we all need to get some of these and we've got to make fewer episodes of shows and spend more money on them, and they're losing their shirt on this business. it doesn't really work, financially at all. and they consented to that and what is interesting is that uygur, this week, comes out and talks about this and he basically says that we are going to charge way more money now and the future is that we put ads back on shows. we're going to put bad back on shows. so they're going back the cable tv model, they're basically saying sub fees and commercials, why you didn't want when you signed up before streaming, that is the way for us to make money. we can't make money this other way. so, they have to go back to this business model and effects the strike dramatically because they threw out the way that they could actually compensate writers and actors with residuals and resales of shows and everything. those are not worth anything to those people anymore, so it is whatever solution they come up with, they have to address this. >> does that mean, steve, if suddenly hulu, disney+ charges more money, say they get a big boost in subscriptions like netflix did, or any of those actors, writers, performers, seeing any of that dough? >> that is what the fights about, it's about technological change and it's a fight about, you have not even asked about the a.i. issue which is there as well. look, to me, i don't know that much about the media business but what i did cover once in my life was the oil business. what do they do? they take stuff out of the ground, they piped and sell it. this idea of the vertically integrated media company that looks like an oil company, i'm not sure it is working. i don't think they have the expertise in all aspects of this to really make a go out. to me, the big difference is that they don't put the oil in the ground, the writers and actors put the oil in the ground. they can't control this. >> abby, you are a writer. do you really think we're going to get to a place where a.i. and the chatbot is going to replace writing? even actors, this idea that barbie is going to make a billion dollars this week if it was a computer generated -- ? >> i sure hope not. but i spoke with a hollywood writer this week and this person characterized on these statements coming from uygur, from unnamed sources on the studio side saying things like they want to make this last so long they're going to drive rioters out of their homes. that is only going to make this last longer. this is a stalemate, this writer said it took a risky strategy and has turned it into a righteous cause. as the temperature escalates on this, it is likely only going to prolong this. >> do you think it gives the rioters, the actors, a lot more power in this strike that the last time strikes existed, there was no social media. they did not have a voice that they can connect with us so that we can see that. all of it was behind closed doors, not anymore. >> i think it goes beyond that. it is incredibly rich that you have these executives saying we can't pay writers more because our business model isn't viable. these are people who are heads of the biggest companies in america, so i think the free hand of the market would have an answer that, if you cannot sustain your business model, then there is a very strong chance that something will come in and find a way for writers and actors to keep creating their craft. >> you could make a movie on tiktok. you could make a series of short -- >> but your average writer out there is not going to say i'm writing on a show and now i'm going to be a tiktok star. it's not gonna work, we're talking about millions of people. there >> i think there is a chance for another distribution channel, technology is going to move faster than these negotiations will and i think it is a question of a platform -- >> they are going to completely alter this because, i can't even fathom this that you're going to say, okay, the star will be the same but all the rest of the actors could be models. >> is that why the studios are holding out, because they know that a.i. is around the corner and it is emotional and upsetting to see what is happening to writers and actors? but these studios can hold it because they are saying i can and will own your likeness and i don't need extras. >> they just had a massive movie revival, they had two movies come out and instead of being able to capitalize on that there is no work going on. instead of capitalizing, they can't even get the stars to promoting the movies a summer because they are all on strike. they have done such damage to the core business by doing this. instead of forward thinking and saying, let's bring the writers and actors in some way economically. >> i want to give you the economic viewpoint on this. let's say that they come up with an a.i. that can do your job. are you better or worse balls? people think that the ohio vote this week was about abortion. well, republicans are literally asking voters to do is dilute your own power. do they think that is a winning strategy, or, and i promise i'm not trying to be biased, are they hoping people aren't paying attention? because i am hard-pressed to find anyone who would say, i'd like to vote against my own power. please dilute me. >> i think it is -- this is an august election, it was expected to be low turnout, it's let's see what we can get through that's not a november. and so, -- >> that's people turned out. >> what you're saying, they didn't want to say my vote is only worth three quarters of a vote now. people have said no, you can't do that to me. >> which is why you should be a little bit careful about extrapolating too far from the vote, right?
