Trump employee for is obviously a corroborating witness with the prosecution who will testify under oath that de oliveira said that and that de oliveira asked him to commit that crime of obstruction of justice because the Security Camera footage was already under the subpoena by the Justice Department when donald trump wanted the footage deleted. He went into Federal Court today in florida and bought a Washington Post lawyer paid for by Donald Trumps gullible contributors to tell the Magistrate Judge that he couldnt enter a plea today because he has not been able to find a Florida Attorney to represent Carlos De Oliveira, a Florida Rules require. There are 77,223 lawyers in florida. Southern florida, where the Federal Court is, in this case, as the highest concentration of those lawyers. None of van are available, according to the trump criminal defense team. And they told the judge that they couldnt possibly find one until august 25th at the earliest. They suggested delaying the arraignment of Careless De Oliveira until august 25th. The Magistrate Judge no doubt feeling insulted by the blatant and lazy attempt to create unnecessary delay, told the defendant to be back in court on tuesday, with a florida lawyer, and be ready to enter a plea. The other two defendants, don trump and walt t nauta, entered the plea of not guilty today to the carriages and superseding indictment. Don trump was not required to attend today session today. In washington d. C. Special Prosecutor Jack Smith filed a proposed Trial Schedule for the case of states of America Versus donald trump in which donald trump is charged with conspiracy to defraud the United States, i conspiracy to obstruct an official proceeding. Jack smith suggested a Trial Schedule that would accommodate pretrial motions in september, october, november, then begin Jury Selection on december 11th, with the first day of trial set for january 2nd. In jack smiths filing with court today, he used Donald Trumps newest Criminal Defense Lawyer, john lauros television comments against him. Quote, and the defendants initial appearance, and in several television interviews, Defense Counsel has suggested that the Speedy Trial Act is intended only to protect the defendants rights, not so. Under both the sixth amendments speedy trial clause and a Speedy Trial Act, the right to a timely trial is vested in the public, not just in the defendant. Defense counsel claimed both an immediate interview and an initial hearing that the government has been investigating this matter for three and a half years, while the defense is starting with a blank slate. Not only is this claim impossible, as january six 2021 was two and a half years ago. But it is disingenuous. The defendant and his counsel have long been aware of details of a governments investigation leading to this indictment, having had First Contact with Government Counsel in june of 2022. Jack smith said he is prepared to produce most of the Discovery Evidence in the case to the defense as soon as the court issues a protective order, with rules about how that evidence must be treated by the Defense Lawyers and most especially, importantly, by defendant trump. An ambitious Trial Schedule submitted today by jack smith, with a factual Trial Sessions scheduled to begin the First Business day of the new year, but they need the protective order. They need the rules of the road to be put in place before this case can get really started. What are you expecting to happen on that . I expect them to get it and the fact that they need it is underscored by todays filing. Smith said that he will, in this case, as he did in maralago, give trump much much more than trump is entitled to at this stage of the proceedings, in order to serve this speedy trial, and that is going to include a grand jury transcripts. And its very important than that he not be able to try to vilify them in the public eye. And so it is part and parcel. You need the protective order in order to give him a lot of information early, in order to serve the speedy trial. But its gonna come back to bite them, just like don trumps own comments publicly, and campaign events, on tv, have already come back to bite him, not only as these criminal prosecutions, but even in the civil trials with e. How does this prosecution in michigan interfere with, if it does, jack smiths prosecution . The tangible worry would be it goes to trial and certain people witnesses not even the defendants make certain statements that differ a little bit from what they would say in trial before jack smith and the challenge lawyers with nothing to do would have a field day with these teeny discrepancies. I dont see it in michigan, though, i mean its very straightforward. Its just these actual electors themselves. Were gonna also see it in georgia and well see with a grand jury testimony actually revealed there, when there is a similar process going on. In some sense, it is reinforcing this date and federal actions, but the tangible worry, the prosecutors get a little nervous about, is statements that are slightly different by the same person and the opening for crossexamination. Hes also host on the podcast making the case. Senator whitehouse, you promised us it would get worse. It has gotten worse. Does it feel good to be right about these predictions . No. I wish it did. And i wish i felt this was the bottom of it. I think its going to continue to get still worse. There is more to disclose about Clarence Thomas. This coming week Justice Thomas and Justice Alito run out the clock on the extensions for their disclosures. So they have to make those disclosures next week. There is a 30day window in which they become public. So well find out a lot more from them about their own disclosures. And people will be picking out what theyve disclosed and what the press has found out to make sure that they are telling the truth. We may find out new things from their own disclosures as they fear that those things will become exposed in later investigative efforts. And then we are only just beginning to understand how very improper our Justice Alitos interview in the Wall Street Journal was. That was deeply improper. And thats gonna come out more. So Supreme Court justices and judges on the Judicial Conference need to understand that this is not going away. Its going to continue to get worse because the heavier is inexcusable. We keep coming up against no guardrails here. And so just to go back to your point, where there is theoretically a deadline, that they have to meet for disclosure forms. What if Clarence Thomas just doesnt meet the deadline . I think he believes that nothing can happen to him. Yes. I think the problem that hes going to face and there is that the Financial Disclosure committee of the Judicial Conference has those rules. And thats also the group thats going to advise the Judicial Conference On Whether or not his failure to file is willful. And if there is a question, a question whether his failure to file is willful, that question is referred to the Attorney General of the United States for a proper investigation. So if your Clarence Thomas and you are refusing to meet a deadline, you are telling the people you have the Position Power to refer you to the Attorney General of United States from destination, im blowing you off, pals. That is not a good place to be in because that power of referral to the Attorney General is a power conferred of the Judicial Conference by law. Okay, so that does feel like something that even Clarence Thomas would be concerned about, the idea that the Justice Department would then be conducting a potentially criminal investigation of him. I do suspect that he would still feel a moon from the ultimate effects of such an investigation. But that seems to be the only possible pressure on him. Well, the Judicial Conference can investigate these matters, and they can amend the rules and tighten things up for the Supreme Court. I frankly hope that they will. And they can require more disclosure. But i think a lot of this is going to be on you and me, collectively, the press and the congress, to keep digging to the bottom of this. Because what the Supreme Court justices have told the rest of the worlds, we have no rules, we do not care, we will not answer your questions, and you can basically go pound sand. But theres no other position in government where you get to do that. Not judge, is not legislators, not members of the executive branch, not Town Council Members in small towns and counties around the country. You just dont get to behave that way as a government official. So the extent to which they are out of line is going to come to haunt them before too long, and were going to do to the bottom. This is not going to. And isnt your sense that there is any pressure at all on Clarence Thomas from inside the Supreme Court . Im not sure about that. I think that there likely is beginning to be pressure within the Supreme Court. I am confident that there is pressure from within the Judicial Conference. Those judges are the chief judges of all the different Circuit Courts Of Appeal and selected District Court chief judges, very powerful and august group, and they have to follow the rules. They know the rules in though the Supreme Court justices are cheating. They know that the excuses are being made and they make no sense, are not correct, and they also resent that by treating this behavior of Supreme Court justices as legitimate, they impute to the rest of the judiciary that they might be doing the same thing. So i think the pressure is building within the Judicial Conference to take the necessary steps against these relatively rogue Supreme Court justices. The last time a president ial candidate won with that much of the vote was 40 years ago, when Ronald Reagan won reelection with 58 of the vote, and Tuesday Night in ohio, 57 of voters voted in support of the democratic partys position on Reproductive Rights. The ohioans said that every person in this states special, and we are going to continue to have the right to determine what we want to have happen here. Why . Because the majority still rules. Joining us now is the Senior Senator from ohio, Sherrod Brown, member of the Senate Finance committee and also a candidate for reelection in ohio. Senator, thank you very much for joining us tonight. Really appreciate it. Very eager to get your reading of Tuesday Night vote in ohio. Yeah, it was a bonus and they rejected the power grab of politicians, and they said we want to preserve our vote and our voice. Its clear that politicians in columbus didnt want voters to have their say, so they can do whatever they want on abortion, on voting rights, on civil rights, on labor rights, and right to work and all those issues. So it was a big victory for ohio. And because it reverberated across the country, we will be on the state in the country to have abortion language, abortion rights, Reproductive Rights in the november ballot. It was a good victory for the country. It was fascinating to see republicans in ohio trying to impose, basically, the said 60 vote rule on the state of ohio but you can only win if you have 60 of the vote instead of 51 of the vote. Yeah, they have tried to rig the system. They made voting harder especially for young voters, black voters. They have done an extraordinarily effective i guess is the right word job on gerrymandering. Democrats typically lose by six or seven points in if you look at averages, the legislature is more than two won both houses a republican, congress, the same way. Now they want to rig this so that we couldnt put abortion language or stop them doing right to work or stop them from weakening voter laws. All of those kinds of things. That is why this victory was so important. But the other thing it did, lawrence, it empowered activists in the state. I have never seen, i, well its a huge turnout for a special election. It was about four times with the Secretary Of State predicted. You dont see that in august special elections. Thats why they scheduled it down. But ive seen such a sea change among people in ohio who were feeling, progressives were feeling discouraged, activists were feeling discouraged, columbus was a listening to anyone, apparently. Conservative or liberal. And this makes people realize yes, they have a voice, yes they have a say. And thats going to go forward into november with the Abortion Bill on the ballot and beyond. So there is that statewide election in november this year, but november of next year, you and President Biden will be running in ohio. Does Tuesday Night tell you anything about the dynamics the you and President Biden will find yourselves running in in ohio next year . Yeah. It tells me. This voters rejected a power grab. Voters rejected special interest government. Thats what my whole career has been about. Whether its fighting for the fentanyl bill, whether its fighting for the pact act to extend health care to veterans, whether its writing the bill and getting a bipartisan agreement on a bill through the banking housing committee, which a chair, on holding Wall Street Executives who run the banks, holding them accountable. So voters, they voted for me in the past because i do stand up for those interest groups. Thats what last tuesday is about. Thats why i asked people to come and join us for this race in the next year. I know every democrat running statewide in ohio, including President Biden, they always want to know what is the Sherrod Brown secret. Democrats struggle statewide in ohio. You make it through. How do you do it . And talk about the dignity of work. Its hard work, but its also listening to people, and its that focus on the dignity of work. I think that it standing up for interest groups. Thats why tuesdays vote with such good news, i think, for all of us. Do you see tuesdays vote in ohio, is that old saying is ohio go so goes the nation, which might not be as true as it used to be in president ial pause the politics. But is there something in that, in tuesdays vote, for the rest of the country . I think voters around the country have really had it with special interest government. When they see the power that wall street has, or they see in East Palestine when that train derailed. Part of that was because Congress Railroads have had their way with congress on the regulators too long. When they see these banks fail, workers dont bailed out when people get laid off but the banks to. I think people have had it up to here. With Special Trust government. If that reverberates across the country, we see a very good year in 2024 for those politicians who stand up for these interest groups. And so i do think we need to have good federal Policy Makers and modern labor laws like the proact to make sure that we are able to move into active negotiations that are successful for all parties.
