reproductive care. in theory, turnout would be low, making the initiative easier to pass, and therefore the fall vote on abortion harder to pass. the problem, voters saw through it, and turned out in droves, resoundingly rejecting the gop effort to make it harder to protect access to abortion. an outcome prominent members of the state party worried was inevitable as explained by republican state rep, jamie calendar to ali vitali on this show yesterday. >> what's the lesson for your party come tuesday night or wednesday morning, the ballot initiative fails? >> maybe we should spend more time thinking through things before taking the step. >> reporter: maybe less read meat for the base, more thoughtfulness. >> there is a way to provide the red meat and do things in a thoughtful way. and i'm afraid this was rushed a little bit. because we had to make a certain deadline to be able to get it done. and i think it could have borne a little more debate. and i'm not sure if i would have voted to put it on the ballot if it wasn't in that rushed format, if it wasn't a special election. if it didn't seem pretty hypocritical based on what we had done just a few months by eliminating august special elections. >> big elections in wisconsin, kentucky, kansas, michigan, montana, california, and vermont. contests in red, blue and purple states all turning in favor of abortion and/or democrats. as "the new york times" put to today, overturning roe reshaped liberal swing and moderate republican voters into a political force. joining me now, nbc news correspondent ali vitali who is in columbus, ohio for us. nbc news chief white house correspondent, peter alexander, and bengy sarlin. the conversation you had yesterday, what are you hearing today? >> reporter: he was aware of what this could look like for his party at a time when other republicans who championed the issue were still doubling down on it, and i think they'll face the consequences of that if not in the immediate term, certainly they will see the outcome in november when you look at the numbers here, the way the people turned out, the conversations i had yesterday, frankly just standing at a polling place, i asked several people who went in and out of the doors that were then behind me, and i asked if they were people who were the kind that voted in every single election or if this one was special. they said because of the media coverage and because of the issues that were at play here, they felt it was important to come out here in the middle of august in an election that was announced on a pretty short time line and make their voice heard. that's something that has ripple effects outside of the state of ohio but even just the results in and of itself, you look at the fact that it was 57%, that's an overwhelming and clear decisive issue on the no side. it's not 60%, and it underscores the way republican legislatures in this state were aware of the dynamics, and why they were striving for the 60 in the first place. >> what's the outlook now, ali, for the ballot measure in the fall, the abortion ballot measure? >> reporter: look, this certainly bodes well for it, especially because of the ways we saw abortion be the underlying motivating factor here. it's clear that this was a proxy battle because of course when voters went to the polls yesterday, nothing on their ballot sheet said anything explicitly about abortion, but in the minds of voters, it was clear that those things were linked, even republican proponents of the measure said those things were linked. there were no secrets about what this was, and now we're seeing that in this immediate referendum, and you have to imagine that momentum is going to be sustained, especially as we've seen the polling show the energy remains behind democrats on issues like reproductive access. >> semafor laid out all of the ways the vote outperforms democrats in certain districts in ohio and even outperformed republicans in districts in ohio. walk me through what we learned from this state and how it could turn into a message nationally. >> we've seen a pretty consistent pattern at this point, now that we've had a few ballot initiatives, if they didn't directly deal with abortion, they dealt with them indirectly. voters are bucking their party if it's a straight up and down vote on an issue, there's no candidate, no other issues to worry about. it's not about guns. you can just say it's strictly about abortion here, and so we saw the pattern we've seen in other places. blow out democratic margins and turnout in the suburbs, even if suburbs in ohio that actually do still lean red. there also were cases where some of the areas that have trended towards republicans in the trump era, some of those working class areas, like the youngstown area, again, the no votes dramatically outperformed j.d. vance, the republican senate candidate in 2022. there are clearly voters who have moved to the republican party for a variety of reasons. whatever reason, they do not seem to be turning out or do not seem to be supporting further abortion restrictions here. >> there's a big senate race in ohio, one that democrats hope to hold on to, sherrod brown is running for reelection. the state, again, has been trending red in recently elections other than this abortion vote. does this help him? what's the message about his candidacy next fall? >> you're already seeing speculation about what this means for sherrod brown. one thing that i think is going to be true of him and also a lot of democratic candidates, is yeah, they're going to be running on preserving access to abortion. democrats, every time there's a vote like this, they get more and more confident that this is a message they need to incorporate into their campaigns in a major way. it's not something they should shy away from. it's not something they should hint at. it's not something they should worry or see as a distraction, say, from economic issues. i think we're seeing a lot of crowing from democrats that not just in ohio, but in a variety of races in the house and senate and governor's races, abortion is going to feature prominently. >> peter, i imagine the white house has some thoughts on this. >> the white house does feel pretty good about what we saw in ohio last night, and frankly, they feel strongly that this demonstrates the emotion, the energy exists around this issue as we get further and further away from the supreme court decision. you saw what happened in kansas in the past, a democratic judge at the state supreme court, and the recent proxy vote, took place in ohio, we're hearing from president biden who responded overnight saying this measure was in his words a blatant attempt to weaken voters' voices and further erode the freedom of women to make their own health care decisions. it speaks volumes that ohioans showed up in an off year election. the people's power is not diminished in forthcoming elections, including a critical referendum on whether women in ohio will have the freedom to make their own health care decisions. i think it's important, to underscore this isn't just an issue we have seen now or in the recent past, but an issue they hope to motivate voters going into 2024. they're activists in as many as ten states who are considering efforts to try to create abortion protections in their state's constitutions. where this could have a real impact. states that include arizona, a crucial battleground, not just for the presidential race, for key senate race next year, also this issue. florida, another one of those states where this could be a difference maker in some ways. >> it's going to be interesting, the presidential election, in donald trump ends up being the nominee. while donald trump created the conditions to overturn roe v. wade, he put the justices in place that made the decision. he has not been vocal about it on the campaign trail the way that some of the other candidates have been. he hasn't said there should be an x week ban on abortions federally. he's not going that far. so, peter, does the white house have an idea of how, if it is donald trump, how they're going to go after him on this issue. have they started strategizing that? >> i don't know that they have started strategizing that. to your point they feel strongly that the former president's position, the issue of republicans on this issue is clear having put in place three of the justices, the conservative justices that allowed for the overturning of roe v. wade here, so i think they think this is a winning issue. among other things, it benefits the white house, the president, candidate biden for 2024. it does draw attention away from his low approval ratings, from other issues that have been on people's minds, including the economy and inflation, now coming down, but it's been high over the course of the past couple of years. they realize this is a motivating issue, the president, vice president, both speaking out about it last night, and as evidenced by 57% voting against what's called issue one there, it's obvious that it brings people to the polls. this was an arcane legislative proposal in the middle of august, and yet more than 3 million people showed up, that shows a lot. >> it is a lot of people. one more question on the general election and the coming elections in 2024. the republicans are running on wokism, anti-wokism, law and order, the border, et cetera. the democrats have had the economy on their side, if they want to pound that. the bidenomics issues have turned well for them. this issue of abortion, have we seen evidence that it proves to be a more powerful turnout, motivator for turnout than law and order, than the border, than wokism? >> for the most part, yes, simply put, democrats have been turning out in much higher numbers than you might expect. it's special elections in the off year. some of this has to do with changes in the party. democrats consist more of college educated voters, which tend to be high turnout voters in general. the phenomenons we saw in the midterms, democrats had an unusually good night. they have continued into 2023. this fits a pattern. one thing that could concern republicans a bit, this wokism message has not quite been tested in a lot of races where it's had a clear decisive success. this is one of several of these abortion or abortion referenda where the republican ads were not strictly about abortion. in fact, a lot of them were about trying to argue that a future abortion initiative would somehow indirectly enable the state to force parents to accept gender transitions from children. some of the things, that, for example, ron desantis and others talk a lot about in the presidential trail. once again, there's no sign it seemed to influence voters or turn out voters who were very motivated by those issues in polls or the media. that is a concern for them. >> that's an interesting pnt be so good to see you. thank you for joining us today. paradise is burning. wildfires in maui are forcing people to flee into the oceanof fuel all of this? >> reporter: well, katy, they're two people that we have heard the names of before in reference to this, lieutenant governor, former lieutenant governor in georgia, jeff duncan, the other is a former state lawmaker, jen jordan. the third is a former lawmaker, nguyen. we reviewed one of the subpoenas, we know they're being called to be available to testify between now and the end of the month. as it gets closer to when fani willis is going to make the presentation, they're going to get 48 hours notice. this morning i spoke with both jeff duncan and jen jordan. they tell me they have not gotten the 48 hours notice. what that tells us is this is not going to go before a grand jury this week. that's why we're looking closely at next week. as for who those people are, katy, and how they fit into the d.a.'s case, jen jordan, and vi nguyen were two people among a group of lawmakers who heard a presentation from rudy giuliani where he espoused debunked claims. they will testify about what they heard, and the former governor can speak to what donald trump said in the days following the election. when we talk about timing here, this is something that we're watching very closely, of course, because you see the security behind me. we know that preparations are being made both outside and inside the courthouse due to a number of threats that have come into fulton county, come into the d.a., the sheriff, since we have been getting closer and closer to the announcement of charging decisions. the d.a. said she plans to have this done by september 1st, and she's book marked this period ending next week as when she would announce those charging decisions, again, for security purposes and making sure everything is as it needs to be ahead of possible protests or possible unrest here, katy. >> blayne alexander in fulton county for us, blayne, thank you very much. and coming up next, what was jack smith looking for on donald trump's twitter account? "new york times" publishes from ken cheeseboro, nbc news has not independently verified the memo. walk through what we see from the "new york times." >> it appears to be the original document sort of describing the false elector plan. he acknowledges that he was proposing the bold and controversial strategy that he said the supreme court likely would reject in the end. the memo argued that vice president pence should take the position that it was his constitutional power and duty alone as president of the senate to both open and count the votes on january 6th, and also had this amazing line, it's important that the alternate slates of electors beat and vote on december 14th if we're to create a scenario under which biden can be prevented from reaching 270 electoral votes. look, there's also some sort of covering language that says we should only go forward with this plan if there's a reasonable likelihood that lawsuits showing fraud are going to succeed, but what jack smith has essentially said is all of this stuff was part of a criminal conspiracy to defraud the american people by pushing these false electors. >> i'm going to get to that language in a moment with our legal guest. i'm going to ask you about the other news we have, which is that jack smith got a search warrant for donald trump's twitter. what could he have been looking for? >> that's a big mystery. tweets are public. why do you need a search warrant? there are things that people have associated with their twitter account that are not public, including direct messages or drafts of tweets. what this search warrant was asking for and demanded and ultimately got was everything, all the data associated with it. what's interesting, too, is twitter under elon musk resisted initially, and had to pay a $350,000 fine for resisting. this subpoena first went out in january of this year. the special counsel obtained the data it was looking for. and we have to see if it shows up in the criminal cases. >> could it be as simple -- is his twitter account still out there? i know donald trump was banned from using it. he can't tweet any longer. now he can if he wants to. is the full account still in the public domain? >> i believe it is. draft tweets would not be. if there was a draft tweet that was never sent that was germane to the plot to subvert the election results, i could see jack smith wanting to get ahold of that. >> ken dilanian, thank you very much, and joining me as promised, msnbc legal analyst, lisa rubin, and deputy chief in the southern district of new york, kristy greenberg. thank you for being here. let's talk about this memo. lisa, i read it, i'm not a lawyer. don't have a law degree, and ken was talking about the covering language as he has in there. when i read it, it didn't scream this is illegal to me because there was so much of na. that. can you explain from a legal perspective what was out of lines? >> one of the things that jumps out to me is how kenneth which he has -- kenneth chesebro is telling saying one of the things this will accomplish is to buy additional time for pending litigation. we know on december 14th, the deadline to certify electors, there was no pending litigation, much less any litigation of any type until six minutes before that deadline in new mexico. new mexico is not among the states included here, and yet we know from paragraph 64 of the indictment, they eventually advanced the fake elector plot in new mexico as well. >> why is this memo being called the missing link for jack smith? >> you have a paper trail, the first memo they called the wisconsin memo in the indictment. there's clear language that says, look, just in case. this is just to preserve our options. just in case there are, you know, lawsuits that are successful, then we can go back and use these. the language in this memo, it's very different. it's not saying just to preserve, it's saying this is an alternate. this is a different way that we can use these, whether or not this litigation is successful, and that change in language is pretty stark. >> does it prove that donald trump was more involved in this if it's coming from one of his lawyers? >> not necessarily. i mean, at the time, kenneth chesebro wasn't understood to be a lawyer for the campaign. jim troupe is was. there's nothing that ties it directly to donald trump, other than some of the facts we know about. you don't have to be involved as a defendant. >> acting on advice of counsel could be one of the defenses for donald trump. this is a lawyer send ago memo citing it seems statutes, citing other legal minds out there, and coming up with an idea of how to do this as he argues in a constitutional way, even if it might not be. is that a good defense for donald trump? >> well, i think there are going to be a few obstacles to donald trump relying on an advice of counsel defense. first, these allegations he's relying on where he's saying there is election fraud, those predated the election. this is part of a strategy that he had even before some of these lawyers came into the picture. that's one, and then two, it has to be not only that you're relying on the advice of your attorney, but you're providing them all of the facts and you are relying on reasonable advice, and when you say -- when you have all of your lawyers, your white house counsel, your doj officials, various individuals keeping them out of the room, as is charged in the indictment, and keeping them out of these conversations, and then relying on people who are going to tell you what you want to hear, that's a very different thing. it's not a reasonable defense to rely on. people you know are giving you exactly the advice to get to the conclusion that you want. >> and they have documented that he was getting differing advice from the white house counsel saying you can't do this, it's not legal. mike pence, for instance, doesn't have the authority. let's talk about twitter. donald trump sends a lot of tweets. sometimes those tweets come from dan scavino, sometimes they come from his device, sometimes they don't. is that going to be pertinent to what jack smith might be look at on his twitter account as we try to figure it out. >> that was my immediate thought, go behind the public tweets and see the things we cannot. what's in the draft folder. you probably have the same experience i have. you start to send a tweet, get interrupted. >> i stopped sending tweets more than a year ago, i thought it was a bad idea. >> i have an addiction. i have draft tweets all the time. i would guess if i sent a subpoena to, they would have a receptacle of my draft. if there are multiple devices, multiple ip addresses which is essentially the dna of a device, they will be able to track that, this is from scavino or trump or someone else. >> are there specific moments they could be looking at, specific days, tweets? . >> absolutely. there's a portion in the document where they talk about trump sending an incendiary tweet about mike pence at 2:24 on january 6th. at 2:25, pence had to be evacuated from the capitol. they're looking at ways in which tweets were altered, edited, gone through multiple alterations before critical moments in the time line laid out in the indictment. >> can i ask you ladies about fulton county georgia and what we're waiting for? we believe it's going to happen next week that she's going to present her case to the jury, and the grand jury will decide whether or not to indict who knows who. what is your expectation for what we should be looking forward to? >> so, all indications are that there is going to be a charge here, there's going to be a large conspiracy charge, and by rico meaning she's going to charge a criminal enterprise, and in order to -- >> rico is usually used against the mafia, right? isn't that what the mafia famously gets caught up in? you use a rico charge? >> yes, and it certainly applies here, you have a larger conspiracy, and as long as you have two qualifying expenses under the rico statute, in georgia and you can show this criminal enterprise, and there was one common purpose, you would be able to charge under rico. some of the qualifying offenses could be witness tampering under georgia law. we know there's the perfect call with the georgia secretary of state where they're not only asking him to find the 11,000, you know, votes, but they're asking, you know, threatening him along with that and trying to tell him if he doesn't, he could be subject to criminal prosecution. those kinds of witness influence with tampering, may be a qualifying charge. another may be computer trespass. there's been efforts to interfere with the voting machines. trying to actually extract data from the voting machines. those two right there could be potential qualifying crimes under the rico statute in georgia. >> she's investigating the efforts to overturn the election in georgia. jack smith has come out with an indictment investigating the efforts to overturn the election in general. should we expect there to be different evidence from fani willis than we have seen from jack smith? >> i think overlapping but different. you know, i do think that the coffee county efforts to interfere with voting machines will be a part of this indictment. i think this indictment from fani willis is going to make household names out of local georgia election officials and party leaders that aren't part of the larger scheme laid out in jack smith's indictment. david shaffer, sean still, these are names our audience may not recognize. in georgia politics, they're big deals, they may be caught up in what's to come. >> just one indictment or potentially more? (vo) make the switch. it's your business. it's your verizon. utah. officials say craig d. robertson was making violent threats toward president biden, tied to his visit to utah, which is expected later today, along with threats to d.a. alvin bragg. joining me now is investigative correspondent, tom winter. the fbi doesn't threaten people for saying things. what happened? >> they have been conducting an investigation since march, according to charging documents and the search warrant, which we received, they started the investigation in march of this year. the fbi received a tip-off from a social media company, and it doesn't say which one. and we're in the process of trying to confirm the social media company saying, hey, this person, craig d. robertson of provo, utah, is saying things you might want to look into. the fbi looked into posts involving vice president harris, and alvin bragg. in the course of their investigation they say they went up to him, surveilled him, that he confirmed to them that he was who he was, that these were his posts. at some point, according to the charging documents, he says, hey, fbi, if you're still monitoring my posts know that i've got a gun by my side in case you want to come by again. he made a direct threat against president joe biden. on monday, later this afternoon, the president travels to utah. obviously there's some concern there. the threat against alvin bragg was graphic and specific. it did state he wanted to kill him. he posted photos with guns. he posted photos with the fbi calls a sniper rifle. when they observed him, they said he was wearing some sort of a white shirt, a darker suit. he had some sort of a camouflage hat on him that said the word trump on the top of it, as well as an ar-15 pin. as a matter of course, katy, the fbi's inspection division will take a look at this in these court documents we're still going through. the bottom line is this individual made a number of threatening comments and particularly violent comments. >> go back to what happened when they confronted him, and what led to the actual shooting. >> right. so there were two incidents. back in march, they confronted him, as they typically do. and usually the fbi says hey, are you the one making these threats. do you really want to make these types of threats. >> maybe not a good idea. >> and apparently he confirmed the accounts, the particular post you're referring to, i dreamed of carrying out these violent acts, but it's a dream, he says, according to the charging documents, the next time you come back here, you better have a warrant. he ended the communication after that point. that's according to the search warrant application. they observed him, conducted surveillance, wanted to understand who he was, and at that point, this investigation continued forward. >> how did it lead to a shootout? >> this morning, they were attempting to execute an arrest warrant against him. they were taking him into custody on three counts, influencing, impeding or retaliating against federal law enforcement officer, and then specifically threats against the president of the united states. those three counts they were trying to arrest him on this morning, as well as conduct a search and because they were trying to conduct the search, that's why we have so much detail about the post. including the affidavit. >> tom, thank you very much. neighborhoods destroyed, thousands without power, and hundreds evacuated, some even fleeing to the ocean, what is happening in maui. fleeing to the ocean, what is happening in maui. (vo) make the switch. it's your business. it's your verizon. the island of maui is on fire. evacuations are underway as some people are getting into the ocean to escape the flames. tens of thousands of people are without power. 911 is offline in some places, and there is already extensive property damage including in the popular tourist town of lahaina which you're seeing right here. the flames are being goosed by winds of a category 4 hurricane that is 500 miles offshore. joining me now from maui is tiari lawrence and dustin kaliopu, thank you very much for joining us. you live in lahaina or have family you haven't been able to get in touch with? >> correct. i live in lahaina. tahari lives on the other side of the island. she's from lahaina as well. as you saw in the video, everything in the lahaina has been decimated, including our house. that shot right there is about a block from where i live, and that was maybe minutes after i had evacuated from our home. >> it is chilling to see, and anybody who's been there will recognize that stretch immediately. it's popular with tourists and locals alike. have you been able to get in touch with your family members? >> no, we've gotten in touch with a few family members that were able to walk towards the beach and get minimum cell service but we're still missing a lot of family members. we don't know where anyone is. we're hearing reports of them getting evacuated further northern, so we don't know where any of our family members is. it's pretty traumatizing right now. >> can you tell me what it was like when the flames started coming in? >> the wind had been strong all day, and it's not uncommon for brush fires to start when we have strong wind, but i would say maybe at about 4:00, the smoke had started getting closer to our house, and i could hear the explosions from the restaurants and the gas stations around the corner, and finally, the smoke was next door. our neighbor's yard was on fire, and we had no choice but to get in the car and leave. with the clothes on our backs, just my grandfather and i was unable to get my cat. he was left behind. the smoke was just so thick in the house that i could not see. i couldn't breathe. we were lucky to escape with our i.d.s on us. >> i'm so sorry about leaving your cat behind. that must be so hard. hopefully the cat is okay. we're hearing reports of people fleeing into the ocean to escape the flames in lahaina, that the coast guard had to come rescue them. was that a consideration for you? did you see anything like that? >> i did not. i did drive through front street, and there are a lot of -- there's a large homeless population in lahaina, and so a lot of those people are trying to find somewhere to go, and i guess that was the only option. the fire just kept creeping in towards the ocean. >> has it been an abnormally dry season? you think of hawaii, you think it's tropical, it's very wet. and seeing how the fire has just been able to tear through the island, is it because the brush was dryer than normal? >> yes, we're going through a drought period. we're in the beginning stage of drought season. you know, it was expected to be a pretty rough year, but what's also happened is there's reports that there wasn't water available in the fire hydrants throughout lahaina town. i think that kind of factored into some of the why, you know, there was issues battling the fire. >> and trying to find your family members, i imagine you're hoping that the issue is just cell service. have you been told by officials where to look when things calm down, when cell service is back up or when roads are more passable? >> no, there hasn't been any of that type of information released because as you can imagine, our first responders are working really hard, and so we're just trying to let them do what they do best, support the county at this time, and just be mindful of the operations right now. but there is donation sites and people opening up their and pop opening up their home on the other side of the island. the best that we can do on this side of the island is just be there to support them through this horrific time. >> the images alone are very scary. i can hardly imagine what it must be like to be there. how are you guys doing? >> i didn't sleep last night. i was afraid of waking up and thinking it was a dream and i just sat with that all night. i'm still in a daze. everything that i have known, everything -- everything is gone, completely wiped away in less than 12 hours. and i have family out there who has been missing. they're not confirmed to get any shelter. and if any of them are watching and you're okay, hi, i love you and if you're out there and you don't know where to go, just follow the crowd. it's every man for himself right now. >> gosh, terry, how about you?
