And we begin this morning with the results of a special election in ohio that could have National Implications for the battle over Abortion Rights. Ohio voters rejected issue one last night, a republicanled measure that would have raised the threshold of what it takes to amend the states constitution to a 60 super majority. According to the ohio Secretary Of State, still unofficial results, 57 voted against the measure, 43 in favor, and while the word abortion didnt show up anywhere in the ballot, issue one would have applied to a referendum in the fall when voters will be asked whether to enshrine Abortion Protections in the states constitution. Ali vitali is in columbus, ohio, this morning. Good morning. What has the response been like there today . Reporter well, look, we watched already republicans trying to brace for what could come down if issue one failed. I actually talked to the Secretary Of State in ohio yesterday, just before polls closed. He is someone who very directly linked Abortion Access and issue one at the ballot box and this is what he said just minutes after he voted. Watch. No. It is better to fight and lose than never fight at all when it is a worthwhile cause. I can tell you this, i think it will succeed because i think ohioans value protecting their constitution. It is easy after an election to go back and say what could have been done differently or whatever. I can tell you this, The Other Side has spent a lot more money than we have spent. Reporter in fairness, both sides spent a lot of money getting out the word about this. But clearly you heard him there saying no regrets about the strategy that hes put forward here, staking a lot on this Ballot Measure here. The white house by contrast celebrating the results overnight. The president in a statement saying that this speaks volumes in his words that ohioans showed up in an off year august election and certainly turnout numbers were already really sparking some reactions before results even came in. The fact that we are now seeing over a Million People voting in this election, again, in an off year, in the dog days of summer, august election, really does go to show the motivation that was here on the ground and, frankly, you heard sherrod brown, a senator in his own tough battle for reelection in ohio next year in 2024 trumpeting that kind of continued enthusiasm, especially around this issue. Watch what he said this morning. This was four times the turnout that the Secretary Of State had predicted and the race was overwhelming. It was clearly about it was clearly a rejection of the power grab of the politicians and in columbus were making and the voters certainly about abortion, but certainly about the corruption in columbus and the power grab by state officials. Reporter and so a clear and decisive result. I think it is important to point out, though, jose, this is yet another red state that were seeing in the aftermath of Supreme Court overturning the roe decision where despite the fact that this is a state that typically goes red, that were used to seeing on our maps in the republican column, when abortion is on the ballot, directly or indirectly, voters are siding with that. Nbc news learned Fulton County georgia District Attorney fani willis is expected to present her case and her investigation to a grand jury next week. This as a judge has ordered attorneys from both sides to appear in court on friday. Theyre going to discuss proposed restrictions on what the former president can publicly say about evidence gathered during the investigation. That news comes just after trump suggested last night at a rally that he could defy any Protective Order the judge may impose. So, they want me they take away the right to the First Amendment. Now they sue because so now i have one of these lunatic reporters back there saying, sir, id like to talk to you about your case. Im sorry, im not allowed to talk about it. Somehow thats not good for votes. Do you agree . We say i cant talk. Id love to i will talk about it. I will. Theyre not taking away my First Amendment right. And there is also new evidence special counsel jack smiths investigation may be far from over as the grand jury investigating interference in the 2020 election met again on tuesday. Meantime, the New York Times obtain a copy of a previously unknown memo. Lawyer Kenneth Chesebro sent the memo to another lawyer helping a Trump Campaign effort to overturn joe bidens win in wisconsin. Chesebro admitted he was proposing a bold controversial strategy. The Supreme Court would ultimately reject. And nbc news has not be obtained or authenticated this memo. With us now to talk more about this, nbc news correspondent Vaughn Hillyard and catherine christian, a former assistant District Attorney in manhattan and a msnbc legal analyst. You described yesterdays speech as maybe the most youve seen publicly trump be defiant. What did you mean by that . Lets be very clear. This process of this criminal proceeding is just beginning and this notion of Protective Order is a pretty common one, and yet what is he saying . He told that crowd, he is going to defy it. I will talk. And this goes back to also repeatedly yesterday donald trump continued to propagate the Election Fraud claims that got him into trouble in the first place and led him to these charges that came down last week from the special counsels office. He called it a disgusting stolen election, repeated over and over, he called it bs, the crowd started chanting bs in return. For donald trump, so much of this is about essentially echoing the arguments that his Legal Defense says theyre going to make in the court, that he genuinely believed the election was taken from him. Now, despite 2022 election losses for so many election denial candidates for donald trump, it is just as important the 2024 election for him as this is convincing the american electorate that he is he won the 2020 election. And, you know, then you have to see what the reaction was in the hall. This so far has been working for the former president with those who are just dogmatic supporters of his. Right. We saw what happened when he challenged the Certification Process in early 2021. It led to a physical attack on the capitol. And the conversations that i have had over the last months but also yesterday in New Hampshire are words of individuals that truly believe that donald trump had the white house taken from him, and is now being unfairly prosecuted and is going to be put into jail unfairly. He has galvanized this base of support around him. I dont know what a january 6th 2. 0 could look like. From the conversations over the last months and over the last week, it is very clear to me that were heading to a dangerous point here. Because donald trump, their leader, hes not walking away from the brink, hes running right past it here and into the very end whether hes in jail or loses the president ial election, i think were going into a very dangerous territory because he has millions of americans behind him. So, what is this fight over the Protective Order tell us about what we can expect Going Forward . It is interesting. The former president of the United States in that video which, believe me, the judge has seen or someone has shown to her, has basically said im going to violate a court order. The judges order. Sorry about that. We have a little bit of feedback on our mic, but i think were going to fix that. Sorry to, you know, get that so he just said, donald trump, that he intends to violate a court order. Now, that could be bluster and then when the order is put in place, hell be good. But this will be a test of the judge. Because the judge has already shown, shes told his attorneys, youre telling me you cant be here this week after i ordered both sides to be here this week . Youre telling me monday. She said everyone will be in my courtroom on friday at 11 00. And so far we havent heard either of mr. Trumps attorneys say they wouldnt be there. It will be interesting on friday. This is a Protective Order hearing, happens in every courtroom throughout the country. It is routine. Judges grant Protective Orders to protect witnesses safety and to protect the integrity of proceedings. There is nothing novel about this. The only thing that is different, you have a defendant publicly saying he intends to violate the order. It must be unusual to say the least to have, you know, a court demand specific issues come and pretty much every single time and yet the defendant saying, ill do what i want. It will be interesting because im intrigued why the judge didnt require mr. Trumps presence on friday. Even by zoom. Because you want to maybe she will, maybe shes not going to make her decision friday. You want to make sure in open court on the record that he responds, that he understands the terms of the agreement, and he intends to abide by them. Thats typically how its done. Interesting to see if that will happen. Curious to know your thoughts on this story that has come out on this memo. How strong of a piece of evidence is this previously unknown Kenneth Chesebro memo for the prosecution . Well, it is very strong because it wasnt secret to the prosecution. It may have been for the New York Times. It is included in the indictment. Coconspirator number five. So, after they fail, they meaning mr. Trump and the cospeaker terres allegedly, fail to convince the State Legislators and the officials that there was Election Fraud in their states, it was, like, okay, lets do plan b, and that was to organize a slate of fraudulent electors. That was the memo that is included as part of the facts of this indictment that the New York Times spoke about. So it is the defense will argue nothing in the memo says we intend to violate criminal law, it just says i believe the Supreme Court will reject it. But it clearly was part of the conspiracy to overturn the election. And the fact that it was from one lawyer to another lawyer in a political camp, is there any, you know, weight to that on a kind of a Bigger Picture perspective or is it just these are two lawyers sending each other all kinds of im sure there will be and the indictment is not going to include every evidence and every witness. There will be a witness who will say there was probably a conversation with the main defendant mr. Trump and all the coconspirators about how we actually have this Fraudulent Electors Scheme be put in place. So, vaughn, now the next possible step is in georgia, right . How concerned or are they concerned in trump world about this possible indictment . I know. I have a hard time with my own notes trying to keep all the cases in order. I have no doubt the american public, but perhaps the hardest of them all is Donald Trumps own team, his Legal Counsel here. Donald trump himself yesterday on stage in New Hampshire predicted a fourth indictment, telling the crowd fourth one is coming in the next week. We expect this to come down from the District Attorneys office in Fulton County at some point next week. That meets the timeline she had set forth. Several witnesses have received subpoenas in which they would be given 48 hours in advance to appear. None of those witnesses to our understanding have received those notices, which is what leads us to expect this to come next week here. But for donald trump, this is the biggest concern for him and these are state charges. If he were to win back the white house, he would be able to hypothetically pardon himself from federal charges here. But from District Attorney fani willis, it is not just donald trump being targeted, but also more than at least a dozen allies here. This could be a far ranging conspiracy that set of charges that she may be ready to issue here and so for donald trump, the biggest challenge is that these are going to be a lot of political allies for Rudy Giuliani to potentially the Georgia State Republican Party chairman. The current chairman. This is expansive. And georgia, it is a battleground state. It is an important state for him in 2020. What are the next steps that we should be looking out for in georgia to see whether this case does come to fruition or not . If everyone, not me, the reporters are going to be staking out the courthouse next week and to look for any signs of what they call a true bill. Did the grand jury vote the indictment . And the question is, as vaughn said, will it be multiple defendants . Coconspirators . We know that Fake Electors, alleged Fake Electors, were given immunity so they can testify about what happened and why did they become Fake Electors . That will be very interesting. And will it be a rico indictment, which is you do that when you go after complex criminal scheme. Normally organized crime. Organized crime. But this particular d. A. Were following Breaking News this morning. Hawaii has activated its National Guard to battle the multiple blazes that have left thousands of residents without power, forcing hundreds to evacuate. The fires are ravaging two separate areas. Maui and an inland region in one area, 12 people were rescued after jumping in the water to escape the flames. Heavy wind gusts brought by passing of Hurricane Dora have obstructed some Rescue Efforts. Nbcs Maura Barrett joins us now. Good morning. What more are we learning about the fires . Reporter jose, i want to let that image of those people jumping into the ocean to escape the flames really sink in because that paints a picture of how catastrophic this event is and how desperate people on the island are to get away from the flames and how quickly this fire is spreading rapidly expanding overnight. It is still Early Morning hours, there just after 5 00 a. M. Officials are describing this as an unprecedented event. It is rapidly evolving, causing extensive damage and there is that added factor of this hurricane that category 4 hurricane that came out from under the island, hundreds of miles away, but adding 60 to 80mileperhour winds that then stoked those flames and across the dry brush area spread the fire into this area of lahaina, a very populated tourist area and the island has also now ordered evacuations to the Southern Side of the island as well. And because of this hurricane, the Rescue Efforts are really at risk as well because they cant fly the Fire Fighting helicopters used to drop water, to try to contain the fire as well as get a scope of how big the fire is and how which direction it is going. And so in addition to the lack of abilities these Rescue Efforts are facing right now, theyre also looking at issues on the ground, literal roadblocks, trees down, they cant get on the road, and cell service is down. 911 service is down. Hospitals already reportedly overwhelmed. So this is a very dire situation as those winds continue. We have heard that they expect to see those winds die down over the next couple of days. But this is very much an unprecedented event in hawaii. Even though it is the beginning of their wildfire season, the dry conditions that they have had recently is really what is problematic here and what residents are just not used to, jose . The citys shelter services, including the homeless, are now caring for more than 100,000 people. Meanwhile, the democratic governor of massachusetts is criticizing the Biden Administration for what she says has been inaction when it comes to addressing the number of Asylum Seekers. Since 2020, there have been more than 5. 9 million encounters across the southwest border, according to customs and border protection. Joining us now is nbcs ron allen, outside the Roosevelt Hotel here in new york city where Asylum Seekers have been sleeping inside and outside. What are officials in new york telling you about how theyre addressing those who come here Seeking Asylum . Reporter the mayor just gave an address about this whole issue, a very formal appearance, which is unusual for him, but hes trying to really sound the alarm on this problem. Last week he said the city had run out of space, and today he said the city reached the Breaking Point. More than 100,000 Asylum Seekers who arrived here during the past year, he said. They created more than 200 emergency shelters, they are trying to house as many people as possible, provide food. Other accommodations. Get the kids in school and so forth. But he is calling for more help from the federal government and from the state government. Heres some of what mayor adams just said. Take a listen. New yorks compassion may be limitless, but our resources are not. And our partners at the state and federal levels know this. We continue to face impossible decisions about allocating our resources. And that means a loselose, while most vulnerable new yorkers as well as those Seeking Asylum. Reporter one thing the city plans to do is to build a massive shelter out in a place called Randalls Island that can accommodate as many as 2,000 Asylum Seekers. Thats going to take several weeks, however. Theyre still trying to find more space around the city and people keep coming. They estimate as many as 500 a day, some of them bused here from states like texas. Others arriving on their own. The mayor saying that new york is the epicenter of this crisis, and he wants some specific things from washington like more money, more resources. But they also want to see an easing of the work permit process, so that people coming here, migrants, can actually work earn some money and support themselves to some larger extent. And they also are calling for a Decompression Strategy at the border. Essentially a system that the federal government would manage that would send migrants to other cities, other states around the country. Something new york has been trying to do and meeting resistance. What about the Roosevelt Hotel . Is that still a place where people are able to stay . Reporter yes. There are hundreds of rooms here, priority is given to families with children. It is packed. And it is also the arrival center, where people arriving to this country, into new york, and many directly from the border, begin the process of applying for asylum, which as you know can take months and years. So, that this place is serving those multiple functions. Earlier, last week there were people sleeping on the streets and it had become overcrowded. That situation eased because the city found other spaces, local churches, other community centers, other places to put people, where people can find some shelter. Again, as the mayor said again and again now recently, the city reached the Breaking Point and there is no more space in the city to put migrants for now, he says. These are men, women, and children. Turning now to a tragic story out of the mediterranean sea. 41 migrants are believed to have died following a shipwreck last week in the central mediterranean, according to the Ansa News Agency who spoke with some of the survivors. The four who were found alive told rescuers that 45 people were on the boat including three children. They say the boat took off last thursday morning from tunisia but capsized and sunk after a couple of hours. Supreme court overturned the constitutional right to an abortion in our country, were learning new information about how the reversal of roe v. Wade might be impacting the job market. Both are red states and blue states, feeling different kinds of ripple effects. Nbc news correspondent Morgan Radford is with us this morning. Morgan, you saw some new data on this. First of all, it is great to see you. Great to see you, thanks for having me, jose. You saw and studied new data on this. What did you find . It is interesting. This is the first look behind the curtain we received. The data is fascinating. This is a study done by the indeed hiring platform with researchers at the university of southern california, and the labor of economics. It looks specifically at companies that decided to offer financial help for out of State Abortions just shortly after the Dobbs Decision came down. In other words, if you worked for these companies and lived in a state with a strict abortion ban, your company would cover the cost of traveling out of state to get an abortion. So, heres what they found. The companies that announced these policies saw an 8 increase and people clicking on their job postings compared with similar jobs at similar employers who did not have such a policy. So you can look on your screen there, that dotted line, thats when the dobbs ruling was officially released. The studys author says the uptick you see after that, it is equivalent to what they expect to see if those firms had Just Announced a 12 increase in actual wages. That higher level interest was especially noticeable and typically female dominated jobs and states where abortion became illegal after dobbs. So nursing, child care, den dentistry. There was also a downside. The study found the same companies had a drop in Job Satisfaction from many existing employees, according to employee reviews that were shared online. That decline, it was largely driven by a dip in satisfaction with upper management. So in other words, the decisionmakers and the company and this was true both in red and blue states. So, thats fascinating. What exactly does that second graph tell us, you think . It is interesting. Some people have asked does this mean that private companies are sort of stepping in to do the work and close the gap for states where states have perhaps not provided the reproductive benefits and the answer is no. The researchers say we shouldnt take this away because companies that had a lot of employees and states that had deep restrictions, they basically saw that they were upset, those places were upset at seeing those Abortion Bans or lack of reproductive care. So, you know, you have to kind of look at the data a little bit more closely. This is the first time we have been able to see the impact for the workers and their companies. Thank you very much. Always a pleasure to see you. It is pretty amazing, were actually two weeks away from the first republican president ial debate. Eight candidates have already qualified and are getting set to take the stage. Joining us now to break this all down for us, ana navaz and matthew dowd, chief strategist for the 2004 bush cheney president ial campaign. What makes the first debate so crucial for so many candidates . This is the first chance that most of the republican president ial primary field will have to really take their case to millions of americans. What we have seen so far, polls continue to show, is that former President Trump continues to dominate in those polls. And hes out far ahead, by the folks who are in second and third place as it were, depending on the polls. So for all the talk about the number of candidates who come in, some who are now overtly criticizing President Trump, many of whom, most of whom we should say, have stayed away from overtly criticizing him, this debate stage is where the contours of that contest will take shape. And well see how many of those candidates who do speak out against former President Trump will do so on the stage, and well also see, by the way, if mr. Trump shows up himself. Thats still an unknown, right . He could or could not show up. So, matt, you worked on president ial campaigns, what is it going to take for a candidate to breakthrough in this atmosphere . Well, i mean, these debates are probably the most important moments of the entire campaign. It is not the ads they run, it is not the news story they get over staffing or whatever. It is this. And as anna said, it is the first time theyre going to be able to speak to millions of republicans in the course of this. It is interesting, you have to look at this thing in the field and the people theyre trying to appeal to. And this is the republican field this is not Republican Voters who want a policy discussion. Thats the interesting thing. They actually want, because they support donald trump, it shows it, they want a sort of Personality Conflict or how are these candidates going to take on the democrats in some divisive way. Thats what republican primary voters want. I am going to be fascinated in this debate, first, if donald trump shows up, thats a big question mark, and if he doesnt show up, my guess is what the debate is going to be about is who is the best alternative . And i would predict if donald trump doesnt show up that the person on stage that is going to get the most incoming besides joe biden because theyll give this sort of backhand to biden on every question is probably ron desantis. Because all the other candidates want to be the alternative to donald trump and right now ron desantis is that. But his campaign has been very weak and hes been falling in the polls in the last two months. So it is going to be a fascinating. If no trump, i think ron desantis gets a lot of hits. If there is trump, a wild stage. And, if there is no trump, and it is desantis, desantis has been going down on the polls. But he still, i guess, number two in most of the polls. A lot of the other candidates are at zero and 1 and 2 . Yeah. I mean, but his numbers now have gone from being behind donald trump by 15 points to being behind donald trump by 35 points. And so his lead his how far down he is from donald trump, hes much closer to the rest of the field in this time frame. So i think theyre going to the other candidates are going to sense weakness on ron desantis part. But i think the whole hinge point of this debate as usual as we saw in 2016 is completely dependent upon whether or not donald trump is at the debate. And were also following news out of the ohio Ballot Measure vote. What is the significance of this outcome . Jose, i think one of the biggest takeaways is that more than a year after the Supreme Court overturned roe v. Wade, Abortion Rights remain a Major Driving issue for americans. I mean, the defeat of this measure that would have raised the threshold to 60 for any kind of constitutional amendment says a lot about how voters, even in red states, are seeing Abortion Rights right now. In november, ohioans will vote. We have seen a number of states in the last year, blue states in particular moving to protect and further enshrine the rights in their states. We have seen red states do that. We have kansas and montana and kentucky, ohio now being the latest to seem like it is trending that direction. And so, you know, we have seen Abortion Rights now impact the midterm elections in places like michigan, wisconsin Supreme Court election. There is really no race that when Abortion Rights come up, it hasnt tended towards protecting those rights. And major races. And so i think the takeaway for most folks is this will continue to be a major issue in 2024. And thats a problem for republicans who have yet to find a cohesive message around that. And it is right now looking like it is an advantage for democrats who continue to make it a central part of particularly of mr. Biden and Vice President harris reelection campaign. And im just wondering, matt, you were going to Say Something . Go ahead. No, i think anna was sorry. Im sorry. The only thing ill add to what anna just said which i agree with is even there is a broader concern, the fate of our democracy. And i think what ohio showed and kansas and all these other states is if you run on the fact that majority should rule and not 60 or not some gerrymandered district that the voters say we should hold our leaders to account and it shouldnt be some finagled rule they put in place to get 60 . So, to me, that were going to still have another election, we had two in a row, were going to have another one in a row where the health and the whether or not our democracy survives as Majority Rule is going to be on the ballot in 2024. The fight broke out when a group of white boaters refused to move their pontoon to make way for a riverboat and instead attacked a black boat captain. All three men face charges of assault. We have a total of four charges, misdemeanor assault, against three alleged aggressors. One of them is in custody. We have a photo of him right now. Richard roberts, hes facing two assault charges. Police are also asking for another man, reggie gray who is seen wielding a Folding Chair to contact police. Were looking at video of the brawl that unfolded over the weekend. None of the men pleaded yet. You see here the brawl is divided along racial lines. Were going to get to that component in a moment. Were also hearing from that coa moment. Witnesses are telling msnbc news that captains were yelling over the pa system for some 45 minutes asking the pontoon owners to move their boat. The witnesses say that was entirely preventable and they were ignoring the calls. Police say they have reports that racial slurs were being used. Theyre investigating that right now. The key takeaway, according to the Mortgage Bankers association, applications for a home Purchase Mortgage fell 3 for the week. That led to a 27 drop over the same week last year. Its even more dramatic when it comes to refinancing a home mortgage. Applications there fell 4 for the week leading to a 37 drop from the same time last year. For context around that dropoff, the average rate for a 30year fixed rate conforming mortgage and a jumbo mortgage, they both rose above 7 for the week. Federal housing authorities or fha loans which are more popular amongst firsttime home buyers, also lower to middle income families, they saw Interest Rates rise to 7. 0 which is important because it marks the highest fha loan rate since 2002. The bottom line, jose, higher Interest Rates arent just making homes less affordable, theyre also incentivizing existing homeowners to stay in their homes which in many cases have mortgages at much lower rates.
