Right now the clock is ticking for former President Donald Trump and his legal team. They have until 5 00 p. M. Eastern today to respond to a motion from the Special Counsels Office Asking for a privilege order. Jack smiths team wants the judge to forbid trump from making public the evidence they are turning over to his defense. They point to a series of alarming posts made by the former president over the last few days including one which said if you go after me, im coming after you. Lets get the latest on this and more from nbcs vaughn hillyard. Blayne alexander is standing by in atlanta where were expecting developments in the Georgia Election probe. Vaughn, tell us more about why the Special Counsel is asking for this protective order and how trump world is reacting. They submitted the file on friday. In the filing they made it clear theyre looking for this protective order which would very specifically prohibit the former president from revealing evidence obtained through the discovery process, this during a criminal proceeding is when the Department Of Justice turns over the evidence it has gathered that it plans and intends to present during these criminal proceedings and gives it to the Defense Counsel. The concern from the Department Of Justice is that donald trump has not only shown a keenness to revealing evidence, but also to putting pressure on potential witnesses. Mike pence was one of those this weekend in which he called his former Vice President delusional. Of course, mike pence may be one of the witnesses to go on the witness stand. Theres also concern about tainting a potential jury pool. In that filing from the Department Of Justice they wrote in part, quote, this could have a harmful, Chilling Effect on witnesses or adversary affect the Fair Administration of justice in this case. Again, that 5 00 p. M. Deadline is today in which trumps Defense Counsel will be able to respond. Over the weekend they put forward a motion to have extra time. A judge rejected that motion so a filing should be expected here in the hours ahead. Lets bring in former u. S. Attorney Barbara Mcquade to react to this. Barbara, how could trump publicizing evidence be dangerous or potentially compromise the case . Well, imagine if he were to say things like hes already been saying about mike pence is a bad person, mike pence is a liar. That could invite intimidation or harassment from members of the public. It could also have a Chilling Effect on the witness themselves. It my cause them to rein in their own testimony or become reluctant to testify if they know they will be targeted by trump and his followers. Its very bad for the integrity of the evidence in the trial in this case. Is the post that he already put out, if you go after me, im coming after you, is that Witness Tampering or intimidation, something hes been warned against . Well, its very vague. Its deliberately vague. When he says things like this, he says, this is just political speech. I think the judge is going to find herself in a very challenging situation. I think hes going to continue to push the limits. On the one hand, if she enters a protective order, a gag order to tell them to stop saying all these things, hes going to cry foul and say never before in the history of america has a president ial candidate been gagged from campaigning and defending himself. On the other hand, if she does not enter an order to gag him from saying these things, were going to see witnesses continue to be targeted. Even if it does not have a chill effect on their testimony, i think it puts their lives in danger in the same way trumps call for action on january 6th is seen as a call for attack, i think the same can be said about his calls for action going after people who are against him. Trump is already saying he cant get a fair trial with just chutkan, that hell be asking for recusal on very powerful grounds, end quote. Bash, do you see any reason for recusal . No. Recusal comes when theres a conflict of interest. The mere fact that someone may have ruled against your party, move against your interests in the past does not mean the person cant be fair. You have to show Something Like a financial stake in the outcome of the case or a Family Member affected by the outcome of the case. None of those things are present here. I dont think were going to see a recusal in this case. Remember, its not the judge who decides the case. Its a jury. Im confident they can find 12 people that are unbiased and can be fair in this case, even if it means a lengthy voir dire process. Blayne, the fourth criminal indictment of trump could come any day. How is Fulton County preparing . Reporter were watching it very closely. Were of fishlly at the start of week two of this threeweek period that the da has laid out in which she strongly indicated were going to hear her charging decision. The biggest difference here between this week and last week, ana, is the presence of security. Look behind me. Ive been standing in front of this Fulton County courthouse for days on end. This is very familiar territory. Weve never seen it look like this. Both sides of the street are now impassable, being blocked by Law Enforcement cars. Cars are not allowed to drive in front of this courthouse. More barricades, more Metal Barricades have gone up as well. Certainly security is increasing. The other thing were also gaining is a little more insight as the da prepares to present her case to a grand jury in Fulton County. We dont know when thats going to happen or what thats going to look like. We do know subpoenas have started to go out for witnesses to appear before this grand jury. For instance, one journalist who stumbled upon a group of alternate electors in 2020, hes received a subpoena to come forward and testify as has a former lawmaker who is sitting on the panel where Rudy Giuliani came down and presented before lawmakers. She was a member of that panel and confirmed shes received a subpoena as well. Certainly seeing things starting to move, starting to change. We dont know when its going to happen, but certainly watching things closely. Barbara, it feels like whiplash, three indictments of a former president in four months, potentially another indictment on the way. Your reaction to this being the reality right now. I think that, if we had more time, we might see these indictments spaced out more. I think all of these prosecutors are scrambling to get their ducks in a row so they can have their cases tried before the November 2024 election. Of course, the fact that theyre all coming gives donald trump more fodder to say, look, theyre coming after me because im the leading republican candidate for president. Of course, all of this is about holding him accountable for conduct that occurred almost three years ago. The fact theyre coming together really is more coincidence than anything. These prosecutors work promptly but thoroughly to bring their cases as soon as they reasonably can do so. I imagine while those cases are somewhat complicated and they wanted to have a sure case before actually moving forward with any type of indictment. Weve been hearing a lot of one of trumps lawyers laying out potential defense arguments. Here is what john lauro had to say. He said the president asked him to violet the constitution which is another way of saying he asked him to break the law. He never said. He never said thats wrong. A technical violation of the constitution is not the violation of criminal law. Thats just plain wrong. And to say that is contrary to decades of legal statutes. Barbara, what do you think of that argument . I think it is john lauro who is wrong. The statutes that are violated here are the ones alleged in the indictment. By asking mike pence to just make a little violation of the constitution is what amounts to that deprivation of rights and that conspiracy to defraud the United States and that obstruction of an official proceeding. I think he was trying to poison the public or maybe even the jury pool by suggesting all of this is legal, but none of that will hold up in court. Barbara mckad, thank you very much. This latest indictment has done little to soften his attacks on Florida Governor ron desantis. If the election is a referendum on joe bidens policies and the failures that weve seen, and were presenting a positive vision for the future, we will win the presidency and have a chance to turn the country around. If, on the other hand, the election is not about january 20th, 2025, but january 6, 2021 or what document was left by the toilet at maralago, if its a referendum on that, were going to lose. With trump in the race you know with trump in the race that is largely what its going to be about. Youre not fighting against joe biden, youre fighting against trump. Whoever puts their hand on the bible on january 20th every four years is the winner. But respectfully, you did not clearly answer that question. If you cant give a yes or no on whether or not trump lost, then how of course he lost. Trump lost the 2020 election. Joe biden is the president. But the issue is i think with people in the media and elsewhere, they want to act like somehow this was just the perfect election. Governor desantis fighting his own battle to convince voters and donors he has a shot against beating mr. Trump. Despite lagging poll numbers, a Campaign Cash crunch and relentless attacks from rivals. Recently his biggest individual donor threatening to pull back cash unless Governor Desantis shows he can win over moderates. An example is the sixweek Abortion Ban Desantis signed in florida. The governor has implied the issue should be left to individual states. So would you veto any sort of federal bill that tries to put a nationwide ban in place . We will be a prolife president , and we will support prolife policies. I would not allow what a lot of the left wants to do which is to override prolife protections throughout the country all the way up really until the moment of birth in some instances which i think is infant side. Ive got to push back on that, because thats a misrepresentation of whats happening. 1. 3 of abortions happen at 21 weeks or higher. Theres no evidence of democrats pushing for abortions up until their view is all the way up until that, there should not be legal protections. Theres no indication of democrats pushing for that. Zblp ana, you bhengsed the feud with Governor Newsom in california. Fox news host sean hannity hosting the debate. I asked Governor Desantis about why hes debating someone not even running in the 2024 race. He mentioned something entering. He said its the vision for florida versus the vision for california, setting that out for americans to understand. He also said he believes biden may not be the nominee. He believes you might have Kamala Harris, you might have gavin newsom, there are a lot of folks waiting in the wings. You can see in recent weeks the fights hes been picking have been with Kamala Harris. Theyve been with gavin newsom, clearly looking to take on some of the folks he sees might be waiting in the wings, as he said in our interview there, ana. The answer relating to trump losing the 2020 election. Did any of this sound like a new desantis to you . It was at least straightforward. I will give the governor that. He answered the question and i dont think anyone has any doubt that he believes that former President Trump lost. That being said, there were so many other things, i just was nodding my head about his answers about abortion were completely inappropriate. How so . Because hes unwilling to answer a question specifically on an issue that he knows his donors are infuriated about. When he ran for reelection for governor in 2022, he touted the 15week abortion ban. He refused to say if it should go to six weeks. He then came out as a candidate for president and said it should go to six weeks. His donors are angry. People are seeing him as far too extreme. Hes hemorrhaging independent women in his own state. You can imagine what kind of general election candidate hell make. Overall, the most important thing to recognize i think about ron desantis is he missed his window. Ron desantis should have started going after donald trump in january, february, march. If you look at the poll numbers during that time, thats when trump was the weakest. Now he can retool, reset, reboot. At the end of the day, he will not be the number two if something happens to donald trump and hes no longer a possible candidate. No one is going to ron desantis. They will look to tim scott, for example. To me hes just flying on the way down. Your top takeaway, congressman . Let the flailing begin. Here is the thing about ron desantis. He can try to reboot his campaign all day long. He cant reboot his personality. He is not a good retail politician. Thats what iowa is about and what New Hampshire is about. He had this little safe space he had built up in tallahassee for himself where he was cac cooped, not just from regular people but from the media as well. He wasnt doing any normal interviews for years. Now he doesnt have that type of protection, as a consequence his numbers are sliding, sliding, sliding. What were going to see, i believe, because no one in the republican field is searching, is the potential for other candidates to get in. Its certain that Glenn Youngkin is looking at this again, and i dont think we should count him out. He seems to think other candidates will get into the democratic race as well. Lets take a listen to what he actually had to say about governor gavin newsom. You said yes to debating governor gavin newsom. Youre debating someone who isnt even in the race. Some are saying this is more like an Undercard Debate for 2028. Why are you doing this . A couple things. I think debates between florida and california, that debate has been had in the sense that people have left california, have come to florida. Theyve voted with their feet since weve both become governor. I think its a debate about whether do you want the california model or the florida model. This debate between Governor Desantis and Governor Newsom, good idea, congressman . Its only a good idea because his numbers are dipping so incredibly. When he thought he had an opportunity to actually be on equal footing with donald trump, he was rejecting this debate. Now he is desperate and it looks like it. So considering the circumstances of his president ial campaign right now, yeah, its a good idea because he should try everything he possibly could, but its yet another sign that his president ial Campaign Stands zero chance. Do you think its a good idea . Do you think he and Governor Newsom would make a good debate, susan . Do you think it would be revealing for the voters to see him in that spotlight . If you look at Governor Desantis previous debate, no, its a very bad idea. Hes not a very good debater. That alone is probably e why he shouldnt go into it. Its a stunt and hell get credit. It makes sense for him to do it while hes on the way down. The problem is Governor Newsom, frankly. That would be a real annoyance to the dnc and others. Having that debate will show what he could bring to the table and especially i know its a sensitive issue with the democrats, but especially when it comes to joe bidens age. It looks like hes rehearsing for something. So hed get smacked down pretty darn hard. What do you think about that . I think Governor Newsom is serving in The Pit Bull Role right now. Weve seen Kamala Harris emerge in that role as well, and in a very effective manner. Lets also not forget about the fact that floridas stats right now are absolutely woeful. Inflation is skyrocketing in florida right now. Property prices are skyrocketing. People are upset left and right. Insurance rates are skyrocketing i see how you pivoted there. I have to wrap this up. I was trying to get you to respond to this idea if Governor Newsom is put on the debate stage, would he be potentially problematic for democrats and joe biden, to have that comparison . Absolutely not. Politics is a team sport. And all hes doing right now, hes taking that down someone who, quite frankly, is taking themself down in a pretty effective manner. Its going to make for good showbiz. It will be good for his brand, theres no doubt. What he will be doing each and every minute of that debate is defending president bidens tremendous record. Some Breaking News this morning out of california where at least three people are dead after two firefighting helicopters collided in mid air. This happened as the choppers were responding to a fire that started in a building in Riverside County and spread to three acres of surrounding brush. One of those helicopters was able to land safely nearby after the collision, but the second crashed, killing all three people on board. The victims names have yet to be released, but they included a Fire Division chief, a fire captain and the pilot. The exact cause of the crash is under investigation. Ukraines Security Service says it has detained a woman gathering intelligence for the russians about president zelenskyys movements. Law enforcement Officials Say the woman, who has not been named you can see her through in the middle of the screen they allege she was caught redhanded as she handed info to the russian. Matt bradley in our London Bureau and also with us former Army Infantry officer clint watts. What do you know about this woman and the info she allegedly gave the russians . All a bit murky so far. Everything we know comes entirely from ukrainians intelligence agency. Nbc has been unable to verify most of the information. But according to ukrainian tlens, this woman was a local resident in the small city of mick leia. According to ukraine intelligence she had been seen traveling around taking photographs of Electronic Warfare systems and ammunition warehouses. They said the suspect had been seeking information about the details of president Volodymyr Zelenskyys itinerary. All of this was done to prepare for some attack on mykolaiv. President zelenskyy is thought to have been the target of since the war began in 2022. Thats why ukrainians are calling this an attempt to kill the president , basically an assassination. The sbu says this woman was caught redhanded. Not photographing these installations, but detained while passing on information she collected on to her russian handlers. Like i said, theres still a lot of sketchy information here. Another interesting thing here, ana, is the ukrainian authorities havent reported having actually charged this woman with anything. They said shes only been detained pending an investigation. They added that, if shes found guilty of whatever they charge her with, she faces up to 12 years in prison. I cant help but think back to the start of the russian invasion when it did seem like zelenskyy was the main target. This, of course, is reminiscent of that as you point out. Do we know what kind of Danger Zelenskyy was actually in at this time . Luckily they intercepted what could have been a plot. Reporter ana, we dont know, to be honest. This information is limited and quite new. As i mentioned, zelenskyy is thought to have been the target of assassination before, mostly in the opening days of the war. The fact that zelenskyy has stayed in ukraine so long, didnt leave until nearly a year after the invasion began, has really impressed and buoyed a lot of Public Opinion in ukraine in favor of zelenskyy. Even if he was in danger, it doesnt seem like the kind of thing he would shy away from. Even though the sbu says they caught this woman redhanded, the fact that she hasnt been charged yet seems to indicate there are a lot of o questions about this case and her motive. Clint, we see zelenskyy everywhere, it seems. Hes certainly not trying to be secretive about his movements. How vulnerable is he to potential attack . Once they saw ukrainians have success on the battlefield, it became apparent that the Center Of Gravity for ukraine, keeping the momentum going, one of those is president zelenskyy. Hes been very inspiring, both inside the country. Hes also one of those key nodes that brings together all western support, nato support for ukraine. Its always been assumed that the russians, if they had the chance, would try to eliminate zelenskyy as a way to really not only bring down morale but break the linkages with the west and push everyone to the negotiation table. Its not surprising that this is going on. I think its surprising that at this point there are still saboteurs or spies inside the country held by ukrainians that theyre still trying to flush out that might be working on behalf of the russians. If these allegations are true, how should ukraine and its allies respond . I think the ukrainians will probably have to reveal part of the investigation, as we were just talking about, to really understand what it is. They also need to provide reassurance to everyone both inside ukraine and outside ukraine of what the Chain Of Command would be. If president zelenskyy were, for some reason, to be killed or wounded, what would the Chain Of Command be . I dont think theres been much discussions about that. Maybe those inside the government understand it very well. But youve got to really build confidence that this ukrainian fight would continue to endure. I think above all is the western countries that support ukraine would need to be able to explain how would they support ukraine and what would they do if russia were to execute an assassination plot like this.
