alex. we begin with breaking news, just minutes ago, the judge in the election interference case now ordering donald trump's team to respond to the government's motion for a protective order again in the election case. stating their position on the matter by five pm on monday. requests for protective order came after the former president posted on truth social, quote, if you go after me i'm coming after you. joining us, now glenn kershner, former federal prosecutor and now msnbc legal analyst. he was in the d.c. courthouse thursday for trump's first appearance. , glen what is the significance of this breaking news? >> aaron, i'm surprised that when the judge received jack smith's motion for protective order, and jack smith quoted donald trump, you know, when donald trump posted what can only be described as a threat, i'm not surprised the judge has ordered them to now respond at light speed, as you said, i was in court on thursday i saw the judge admonished donald trump as follows. mr. trump, i remind you that it is a crime to influence a juror, threaten a witness, retaliate against anyone or obstruct the administration of justice. not 24 hours, later we donald trump seems to have done that by posting, if you go after, me i'm coming after you. i look forward to seeing how they explained this to the judge. >> in your, opinion do you think he purposely defied that order? >> that is what i would be arguing if i wear the prosecutor with representing the interests of the american people. i think he already tried to walk it back and say, well this is just about politics. i was really talking about my opponents in the race for the presidency. but don't think anybody is buying that. >> right, glenn, stay with us because we're gonna talk to you more about what you saw thursday in just a few minutes. we're gonna backtrack a little. but the federal case against former president trump colliding with his 2024 campaign for president. and b, c's julie, sorkin is in atlanta with the latest. with the latest. former president trump back on the campaign trail this morning, less than a day after his latest court appearance, speaking to supporters as the special counsel made a new request of the trump legal team. >> a new twist in the case of the people of the united states versus donald trump. over his legit attempt to overturn the 2020 election. >> overnight, special counsel jack smith's office requested a court order, asking the judge in the case tomorrow the former president from publicly disclosing some of the evidence gathered during their investigation. >> the move came just hours after mr. trump posted on his truth social platform, we quote, if you go after, me i'm coming after you. >> prosecutors say mr. trump had written multiple posts like that one that could have, quote, chilling effects on witnesses in the case. early this morning, a trump spokesperson called the former presidents post, quote, the definition of political speech. >> this all played out just hours after he appeared at a sold-out fund-raiser for the alabama republican party. touting new endorsements from the states gop congressional delegation. just 24 hours after pleading not guilty to federal felony charges. mr. trump accused of subverting the 2020 election in an attempt to claim power. >> we need one more indictment to close out this election. one more indictment, and this election is closed out. >> mr. trump is still the front runner for his party's 2024 presidential nomination. leading his closest rival, florida, governor ron desantis, by double digits in the key early state of iowa. according to this new poll. >> the former presidents chief challenger, offering his strongest rebuke yet of trump's election fraud claims. >> i've said many, times the election is what it is. all those theories that were put out, they did not prove to be true. >> now, mr. trump's next court appearance in the 2020 election probe is in three weeks. that's not slowing down his campaign. trump will be the keynote speaker at tonight's fund-raiser in south carolina for republicans. >> back to you. >> back to you >> that was julie tsirkin. we're gonna head back to glenn kirschner who's just joining us. glenn, what about this timeline of monday at five pm? do you think that's enough time? what do you think the response will be? >> you know, erin, i have a feeling the response from the defense team will be we agree with the protective order. the protective order is designed to protect the witnesses once the prosecutors turn over the discovery, the evidence to donald trump. to prevent them from disseminating that information, to prevent donald trump from talking about it in his rallies or posting it on his social mediaplform. i fully expect the defense will agree to the protective order because they want the discovery of the evidence as quickly as they can get it. what i'll be interested to see is if they address the threat that the client is posted not just 24 hours after the judge could -- put him on notice but that could be a violation of his conditions of release. i have a feeling they might sidestep that. if they do, they might separate their clients claim that this is about politics in his campaign for the presidency. it had nothing to do with the trial and i don't think anybody is inclined to believe that. >> politico says that they are pointing to trump's previous social media post and the legal metal puddling against him. doesn't this fall under the umbrella of free speech? >> it doesn't, not if you are obstructing the due administration of justice. think about, it if you are a witness against donald trump, and he, for the first time is getting the evidence, including what you said about him in the grand jury and you know you are a future trial witness against donald trump, and one of the first things you see is donald trump, the person against whom you are about to testify, has posted something that if you go after, me i'm coming after you? that has a natural tendency to interfere with witnesses and interfere with the due administration of justice. i am hopeful we will see the presiding judge, judge tanya chuck, can at least consider something narrowly tailored restrictions on donald trump's speech and posts, designed to prevent him from being able to intimidate witnesses -- we just saw the sketches from the courtroom, you have an interesting perspective. you saw trump in jack smith a few feet apart, where they end your line of vision? what can you tell us about the dynamic between them? >>, yes i was in an adjacent courtroom where there was a live feed from four camera angles. the reporting that i heard from a few reporters we had in the courtroom itself confirmed what i saw, which is donald trump not making eye contact with really anybody. not interacting with anybody. he certainly did not look in the direction of jack smith, whereas jack smith seemed to be focused like a laser beam on donald trump. and then jack smith engaged in pleasantries after they carry with any number of folks in the audience. so yeah, two very different approaches by two very different men. during the course of the brief arraignment hearing. >> glenn, you said trump did not look at jack smith. but let's talk about what he did do in the courtroom. one pool reporter from abc reported observing trump shake his head and irritation when the judge was reading the consequences for violating his terms of release. specifically when the judge mentioned the word arrest. was that something that you saw as well? >> you know, i didn't notice him shake his head. but i don't think he takes direction particularly well. i think he takes restrictions on his conduct even less well. so i think he will continue to dig his own legal hole deeper and deeper, and the fact that judge, tanya chutkan, a former public defender for nearly a decade in washington, see somebody i used to try murder cases against back in the day, has caught this assignment. she will preside over the case of united states of america versus donald trump. i think donald trump and his defense team have met their match. because she will not indulge any shenanigans or any improper tactics by trump or the defense team. i think she will run a very tight ship, she will give him a fair trial, and i believe a speedy trial. >> all right, glenn kirschner, thank you, we will be talking you for your expertise in the coming days. thank you so. much what about the secret protecting donald trump? more now on the timing of the many trials facing donald trump in the coming months as they clashed with a political calendar for the republican presidential nomination process. let's bring in charles coleman, former brooklyn new york prosecutor, now civil rights attorney and host of the totals coleman podcast. and perry, stein she covers the justice department and fbi for the washington post. charles, let's start with you, as we look at the timeline, how do you interpret the judge ordering the trump team to respond by monday to prosecutors social media concerns? >> well, erin, i wouldn't look too much into that in terms of connecting that to the ultimate trial date in this case, what i do you, think, however is that what that continues to do is set clear boundaries, very early, on in front of a defendant who is constantly and repeatedly showing himself willing to test the boundaries of what the judge has said is appropriate and is not appropriate in terms of public remarks. nevertheless, i expect that we in the spirit of what we're talking about, in terms of this very quick return and response, that is going to basically guide what is going forward in terms of letting donald trump's defense team know that we are continuing to move this thing along. so while they are not necessarily debating, i think that the overarching sense that is provided to both of the parties, both the prosecutor and the defense, team is that we are not going to delay any part of this trial unnecessarily moving forward. >> charles, i want to ask you about that because there's a lot going on here. how can just sort out hearings for all the different cases? i mean, an indictment in georgia would only crowd the calendar further. which judge is the ultimate decider of which trial goes first? >> truthfully, these cases right now are on a separate track. i suspect at some point when donald trump's defense team looks at the entire landscape, they are going to excess which is the most favorable date for them. i'm still predicting is likely going to be may 20th, 2024 date, set by judge aileen cannon, down in florida. they are going to try to use that as a benchmark to suggest that everything should track that. that is not necessarily going to mean that it, will but it will be an attempt by his defense team to try to slow everything down and he was the furthest day out as the bench part to fall every time it falls into that. >> i want to get your reaction to this because here is what trump's lawyer, said about the push for a speedy trial. take a listen. >> one, two, take precedent did trump to trial, in a few months, they want to deny him his sixth amendment rights to council. to give me and my co-counsel an opportunity to prepare. they want to deny president trump his due process rights. to look at documents, to get witnesses, to use our subpoena power. speedy trial rights are a defendants speedy trial rights. a citizens speedy trial rights. not the government. we >> all, right charles, does he have a valid point there when you consider the volume of cases trump's up against as a speedy trial even more unrealistic? >> i will say he has a valid point as if, yet i will say there is a potential that he could make the argument. it is a viable, argument at least that the volume of these cases could potentially lead to a need for additional time. i think it's premature to make that sort of assessment at this point because quite frankly, whether it's mar-a-lago, or even the january six, case we really don't know the extent of the discovery that is going to take place. it is going to be voluminous. we know that, we just don't know what that means, and how it, looks at this point, it is premature to make the argument that pushing for a particular date is denying donald trump his due process. i think that is certainly an extreme argument that may be taken without proper context. as we get into the weeds, i do think that if he's able to legitimately state, look we have security clearances we have to worry about. there is lots of information we have to go through and pour over in our discovery. in addition to what i anticipate are going to be a plethora of different -- that may, at that, point have some credence. but right now it is simply too early to say. this is unique and that you are talking about several cases where there is going to be a lot of evidence to pour over during this. >> all right, perry, we mentioned that there is now new five pm monthly deadline for trump lawyers that. comes after the magistracy -- judge gave trump's warnings before swearing into conditions of release. you wrote about the new doj request for protective order as it relates to trump's social media posts. here's what he posted and how his campaign is defending his words. it's right, there if you go after, me i'm coming after. you what are prosecutors most concerned about? >> when i, mean this is a fairly standard thing that they ask, a protective order in a case, it's not a gag. order it's a fairly standard thing that dictates how the class -- not classified, but the materials, any evidence during the discovery process is scheduled. they did make a point to say well, trump has posted a lot on social media, i have reported in the past that prosecutors, individuals in this, case there's been an increase of threats they've been facing once with their name gets, online in circulated in right-wing circles and extremist circles. i think they are worried, they've mentioned specifically this, you cannot release any identifying details of people involved in the case, as we go through this, to me, it seems like they're worried about perhaps they would say the safety of people involved in the case. also, intimidating witnesses, the jury, not getting a fair trial out of this. >> you think his lawyers are worried about it too? perry, i also want to ask, you your colleagues at the post are raining about what may happen in the event that trump is convicted. the question of whether or not he can avoid prison. if he couldn't, how exactly would this circuit -- secret service protection work? >> yeah, i mean, that's a good question. it's a whole lot of hypotheticals in there. but i think that president trump is a former president, former presidents get secret service detail for life. so this brings out a whole enormous amount of questions. i think in that, story there's a quote from secret service that says they don't really have an exact policy right now on this. obviously there is no precedent for this. but you know, i think there is a quote in that article from a legal expert that said, sure he can go to jail, hypothetically, but it's probably not the most practical pathway. i, mean it's going to be expensive and may not make much sense to have secret service there. we don't know what will happen, that could be questions that will get answered when these trials go along. >> learning as we. go charles, trump is now facing 78 counts. as we look at the breakdown, possible sentences, i want to ask you about the election fraud charges. what exactly do prosecutors have to prove here? do they have to prove trump knew and believed that he lost the 2020 election? what intent to prosecutors need to show? >> well, they don't have to establish that he knew, aaron, they have to establish that he should have known, as a reasonable person. and i think that the indictment that jack smith set forth does that very clearly in terms of describing and enumerating the number of people who are in donald trump's inner circle, providing him with put repeated information as to why the election fraud claims were baseless and not rooted in fact. i think that covers that box. as far as his, intent they essentially have to prove that he knew this and continued to spread the lies that he was spreading with the intention of trying to disrupt the election. so going out and saying, for example, all, this election was stolen, it was, right when you know that it, wasn't it's not enough. but when you combine that with the notion, if i'm using these lies to try to get secretary of state in different states to decertify the results. now you are talking about trying to interrupt the peaceful transfer of power. when you're talking about, that and the electors scheme, you combine those -- things that is intent necessary to actually disrupt an election. that is where jack smith is going to be focusing his case, his prosecution, which is where he has to prove it to a jury. not only did he know or should have known that he, lost but he continued to spread these lies. for the purposes of trying to disrupt the election. >> charles coleman, perry stein, we have a lot of legal ground to cover, thank you so much for being with us. the georgia election interference case and the impact it could have on donald trump's already jam-packed legal calendar. msnbc,'s katie phang, gives us a road map coming up. ad map coming up ad map coming up ...to not only enhance the fan experience, but to advance how the game is played. now's the time to see what america's largest 5g network can do for your business. try killing bugs the worry-free way. not the other way. zevo traps use light to attract and trap flying insects with no odor and no mess. they work continuously, so you don't have to. zevo. people-friendly. bug-deadly. struggling with the highs and lows of bipolar 1? this weekend, donald trump is making a last-ditch effort to delay the election investigation and georgia. trump will appeal a ruling that rejected his move to disqualify district attorney, fani willis. this comes as the d.a.'s office says it will announce any charging decisions in the case no later than september 1st. joining me now is katie phang, former florida prosecutor and host of the katie phang show. there you are, katie, i'm gonna have you roll up your sleeves for a second. if georgia does indict trump, what will happen next and will he have to fear it -- appear in person? >> he will, so once the indictment is unsealed, because the presentation of evidence that's going to be done by fani willis is to a grand jury, that is meeting in secrecy. the indictment will be unsealed, and all trump will have to appear for his arraignment. , now this is going to be -- usual for donald trump at this. point this is his fourth indictment. upon receiving that indictment he will have to appear in court, and europe lee, and his bond status will be re-addressed. not like he's going to be taken into custody. however, we do know that there is an intention to handcuff and fingerprint and mugshot donald trump when he goes to fulton county. if that is completely different than the experience he had in manhattan, under alvin, bragg and furthermore, in federal court, so once we have this indictment unsealed, we will have a full look at the breath of the charges that donald trump is looking at. we will also find out whether or not there are additional codefendants that are going to be charged alongside donald trump, vis-à-vis his attempts to overturn the 2020 presidential election results in the state of georgia. >> based on katie, what you know about the investigation, what are the charges you think trump could face? >> i think there is a reasonable expectation that you could see charges that include election law offenses. false statements, forgery, recall that there was a fake electors scheme that interestingly was also a part of the recent jack smith federal indictment that just came out this past week. you could also look at computer trespass charges. there was the attempt in coffee county to access the actual machines that were located there that were tallying the ballots. i think critically, overall looking for, is whether or not fani willis charges we -- racketeering. fani willis is known for that. charged it's definitely within her specialty wheel house. there is certainly a number of predicate offenses, meaning there is crimes that are of the state and federal level that can be charged against donald trump in this instance. a lot of people are going to look and see whether or not racketeering is a part of this indictment, and whether or not, and emphasis on -- the coconspirators who conspired with donald trump to be able to commit this crime. >> katie, if he were charged, this would be his fourth indictment this year. how will all of the prosecutors manage this? will they make sure there's no scheduling overlap? and which cases take precedence? >> so, there is this traditional theory of deference where federal cases go before state. cases of, course the real question, is, quote what is ready to go? what is ready to go to trial? you can find there is also civil trials that are pending for donald trump, not just criminal. when it comes to the triage of civil versus criminal, civil usually takes a backseat to criminal. especially if somebody is in custody, and, mind you we don't know if donald trump will stay out of custody while he's pending his criminal cases? criminal will go before civil, and some federal will go before state. however, d.a. of and bragg and manhattan said he will show deference to special counsel, jack, smith if it looks like there's going to be a collision of trial scheduling between jack smith's cases and alvin bragg's case. maybe just maybe we could see that for fulton county d.a., fani willis. we've had her on record, just the last couple of days say, i'm ready to go. of course it depends on whether or not the defense is ready to. go there is going to be some accommodations awarded for the process to the criminal defendant, that being donald. trump however, at the end of the, day it is the trial judge, him or himself -- that will dictate when the case goes to trial. >> we talked about the red pen you. have what stood out to you in the 45-page indictment of the federal election? case >> i've got it. here you guys are welcome to -- everybody can come check this out. it's 45 pages, it's fascinating because has been, said it's a shouting indictment. not just a sneaking indictment. the level of specificity and detail was profound. it was actually exquisite in terms of how surgically jack smith put together this indictment. it is not flattery, it is honesty. you can read this, case not -- be a lawyer and be able to follow along. simply put, it was a knowing pressure campaign by donald trump and his coconspirators to not only start with state officials but move on to the doj, mike pence, and ultimately, violence on january 6th. it was all done knowingly by donald trump. >> katie phang, thank you so much for your insight. let's bring in peter, baker msnbc political analysis, chief white house correspondent for the new york times and co-writer of divide, or trump in the white house. i want to get your reaction to the indictment. how was your biggest take away in, dare i ask, is anything surprising you? >> the biggest takeaway is just how important this one. is not to minimize the consequence of classified documents being mishandled or being paid hush money. this is the heart of. that this goes to our viability of our system as a whole. when it charges donald trump with is essentially one of the greatest crimes in the history of the night. states to overturn an election, to keep power, even after the voter said, no you should have it anymore. that is something we've never seen by a sitting president in our history. i think therefore it is an important test of our system going forward. i think that's the most important thing on a big. level in terms of surprise, the facts were not new. if you followed the january six committee last year you are probably familiar with the. narrative you had a few new things in. they're broadly speaking, he was not charging trump with instigating the right against the capitol, he charged him with using the riot as a matter of pressuring congressman and the vice president in order to give him the election. that's a different, think therefore takes away kind of one of the arguments the trump team usually uses when trying to defend. him >> peter, and one of her new articles, you predict that trump's case will have broad implications for american democracy. you said quote, while he failed to keep his grip on power, mr. trump has undermined the credibility of elections in the united states, and then you went on to say, bringing the case to court, of course, may not restore that public faith in the system. what do you think are the broader implications of this case? how will it affect the country in the long term? >> you are going to hear mr. trump and his team try to re-litigate the 2020 election against the false theories and lies about what happened. conspiracy theories, and basically made up examples of fraud that didn't happen. what that means is we're going to continue to feed into the theory that a lot of americans have, three out of ten americans according to the polls, that something was wrong about this election. something was fraudulent, when it. wasn't that means, that you, know this was built on. faith it is built on the idea that we trust our elections, we trust that the results are in fact what they are reported to be. if a lot of americans, a significant share of americans don't have the trust, then of course, it really begins to fray at the social con packed -- 200 years -- ago >> it's scary to think the damages. then peter, before i let you go, you ended your article with this sentiment. quote, now the justice system and the electoral system will engage in a 15-month race to see which will decide his fate first. and the countries. the real verdict on the trump presidency is still to come. when you step back and look at how this whole thing will eventually be resolved, do you think there needs to be a political resolution beyond a legal solution? and what might that be? >> that's a good question. there already has been one political resolution. he ran an election and. lost the voters decided they didn't want him to be president. he's running again, he's trying to say he's gonna come, back he's doing very well obviously in the republican primary. what's going to be remarkable to see is whether or not the electorate decides that a thrice indicted president, who may or may not have been on trial by the time they go to the ballot box, should be returned to office. does that in fact supersede in some way the judgment of the legal system? if he were to be returned to office, despite some convictions, would that mean that the voters basically took those convictions into account and said, well we don't care of enough about? that that's an interesting an unprecedented question. we've never had anything like this before. whose judgment matters the most? jim corner. >> sure, i hope so. i do believe there is a lot of smoke and where there is smoke, there is fire. >> you on the oversight committee, republicans think they scored some kind of victory this week with governors testimony. the answer is, i sure hope so. what is your response to that?
