This morning, former President Trump back at his new jersey home in bedminster after spending an historic day in a washington, d. C. Courtroom. Trump pleaded not guilty to four felony counts related to efforts to thwart the transfer of power after the 2020 election. In brief remarks to the press, the former president called his arraignment a sad day for the country, and slammed the case as political persecution. The next hearing is set for august 28th, just over three weeks from now. Joining us this morning, nbc news correspondent Garrett Haake who was inside the courtroom. Former u. S. Attorney joyce vance, professor at the university of Alabama Law School and paul butler former federal prosecutor. Joyce and paul are msnbc legal analysts. You were inside that room, take us there. There are probably two things that stood out to me the most. Ive been in the courtroom for all of Donald Trumps arraignments. Hes getting more comfortable for what was in new york a tense and uncomfortable arraignment. Yesterday, he looked like this was old hat for him. What is so outside the norm becoming somewhat mundane for the former president. You see a degree to which hes been able to build his Court Appearances into his campaign overall. They have a Well Oiled Machine now. The other dynamic that ive been fascinated by the last two hearings has been the presence of jack smith in the courtroom with donald trump. And this room, only about 15 feet apart at an angle where they couldnt help but see each other. As best i could tell, donald trump looked at smith once and for the ref of the time he was in the courtroom, he did everything he could to avoid meeting his gaze again. Smith on the other hand, stared at donald trump every time he spoke, made it clear he was going to look at him. Well see how the interplay continues with between these two men as the two federal cases proceed. And, garrett, so august 28th is the next court date. What should we expect then . Well, i dont think youll see donald trump attend. The judge made it clear it is they would be willing to entertain the possibility he doesnt have to show up at that hearing. There will be filings from both sides well in advance of that hearing laying out what should be the intended trial date and that hearing which will be overseen by a different judge than yesterday, the trial judge, judge chutkan, intends to set a trial date at that hearing. The prosecutors made it very clear they want to move quickly on this. Donald trumps attorneys the opposite, they took the latest possible date available to them to even have that next hearing. And made clear they want a substantial amount of time before the trial starts. Ideally after the election. But youll see a significant debate on how soon or not proceedings get under way in this case. And, joyce, inside the courtroom, the judge warned trump not to commit any crimes as he awaits trial. She also said, quote, i want to remind you that it is a crime to try and influence a juror or to threaten or attempt to bribe a witness or any other person who may have information about your case or to retaliate against anyone for providing information about your case to the prosecution or to otherwise obstruct the administration of justice. Joyce, how unusual is that wording and what are the limits to his speech established yesterday . Well, this is unusual to hear at arraignments, but this is an unusual case given the former president s propensities. The reason that this issue comes up at arraignment is because donald trump has been released on a pretrial bond. He is not in custody pending trial. So the judge was reminding him if he commits any new crimes and thats a standard part of the warning if you commit new crimes, your bond can be revoked. But then she continued it to specify this notion that interference with witnesses, jurors, anyone with information about the case, that that would wring the bell for a new crime. A most unusual warning for a most unusual case. Is there any limits placed on the former president in this hearing . So, some of the typical conditions, of course, apply. Hell have to report to probation. He had to fill out a Pretrial Services questionnaire. But donald trump will get additional latitude because hes running for the presidency. The court will not want to bicker with him over the extent of his First Amendment rights as a candidate. It is possible to keep eyes on him and assure he appears for trial without unduly restricting any of the political functions that hes engaging in. And, paul, yesterday we saw trumps codefendant in the classified docs caseumbrella, bg very close to him, the agent on the right part of the screen and you them handing over the umbrella and jason miller who could potentially be a witness in the 2020 case, traveling with the president. How will trump be able to separate himself from the key players in these other cases . It is going to be really difficult, jose. In fulton county, where we expect Prosecutor Fani Willis to bring a Racketeering Charge against trump, thats the kind of charge that is usually brought in organized crime cases. Jack smiths indictment is much simpler, but the judges warnings are ones more often given to mobsters and gang bangers. Trump earned it with his speeches on social media that have targeted judges, prosecutors and potential witnesses. Some people thought it was interesting that the Magistrate Judge yesterday asked mr. Trump are you on drugs today. But that is standard for arraignments. The warnings were unusual about dont intimidate witnesses, and almost certainly cleared with judge chutkan first. And the whole question on drugs and alcohol, it is what i guess as you say sop on just to make sure that the person is able to understand whats going on, right . And what will be one of the most important days in any persons life, United States versus insert your name. Imagine what that feels like. And you mentioned youve known judge chutkan for over two decades since she was a public defender in d. C. How will she, do you think, preside over this case . With utmost fairness. Ive known her since she was a prosecutor, since i was a prosecutor, she was a defense attorney, and thank goodness i didnt have any cases against her. She showed the same command as a trial lawyer that she will show in the courtroom. Trump may not like the fact that shes judging his case, but he ought to be grateful that it is a public defender. She will make sure that trump receives all of the due process and fairness that he deserves. And if, in fact, a jury finds that hes not guilty, shell say those magic words, mr. Trump, you are free to go. She will let the jury decide this case. But if they convict, the judge is likely based on her previous Sentencing Practices in january 6th cases to send this man to prison for quite a long time. And, joyce, meanwhile, there is already kind of a Schedule Fight Brewing over this case. Here is one of trumps attorneys last night. Listen to this. They want to deny him his Sixth Amendment Rights to counsel. To give me and my cocounsel an opportunity to prepare, they want to deny President Trump haze Due Process Rights to look at documents, to get witnesses, to use our subpoena power. A lot to do with the schedule according to trumps defense team. What is your reaction to this . What does a judge weigh when shaping the timeline of the case like this . So those comments are ridiculous because as the Defense Lawyers know, the government absolutely wont try to defeat the former president s rights. In fact, theyll work with the judge to ensure that he has all of the time he reasonably needs. Why . Because the prosecution doesnt want to obtain convictions, only to see them reversed on appeal and defendants are entitled to adequate time to prepare. What the government wont tolerate here is trumps history of unnecessarily delaying proceedings. Because there is another counterveiling interest that comes into play here and thats the interest of the people of the United States in a fair, speedy, prompt trial. The judge will have to evaluate the interests of the people versus the interests of the president and set a trial date that accommodates both. And garrett, how does this all play out into the political calendar . Well, look, some of it will depend on when the trial dates get set. Later this month, two out of three dates proposed for this next hearing were the week of the first president ial debate. Now we see that that first debate is the 23rd. The first case hearing the 28th. Iowa caucuses are in january. When you get into the early part of next year, you might see the trial in the new york case get under way, the classified documents get under way, all of it happens late in the primary calendar, but before the convention. Bad news for every republican not named donald trump who might want the cases to bang up the frontrunner a little bit. Instead, you could end up with a weakened frontrunner, securing the nomination, going into the convention, and then kind of stumbling into the general election in the middle of multiple trials. They announced that they have been able to identify karen vergata, whose remains were first discovered on fire island in new york more than 27 years ago. No suspect was officially connected with the death of vergata. Joining us now is nbcs stephanie gosk. Good morning. What did the officials have to say . Reporter well, it is interesting, you know, jose, let me give you a little bit of context, while we call these the Gilgo Beach Murders, the remains of at least 11 people were found outside of gilgo beach as well. So this womans remains were found on fire island in 96. Fire island is a good distance away from gilgo beach. But very importantly they said that her skull was discovered in 2011, not that far from gilgo beach. She worked as a sex worker, they say, she was living in manhattan at the time. And thats really all we know about her. They would not make any connection between her and the socalled gilgo four. Sao, Rex Heuermann is charged with three counts of murder, three out of the four bodies discovered on gilgo beach and the Prosecutor Says they have substantial evidence connecting him to the disappearance of the fourth woman. Everyone out here, the question on their mind is are these murders connected and the d. A. Today would not give any indication that they were, jose. Stephanie gosk, thank you for that update. Appreciate it. There is more evidence that hiring appears to be slowing down. The government reported that employers added 187,000 jobs in july, less than the 200,000 economists had predicted. The Unemployment Rate fell to 3. 5 . Lets break it down by race. The hispanic Unemployment Rate rose. 1 . Black Unemployment Rate fell. 2 . Seema mody joins us this morning. Good seeing you. What does this report tell us about the economy in general . Well, jose, the jobs market in july did moderate. It is a sign that Rising Interest Rates and what the Federal Reserve is doing to bring inflation down is starting to have an impact on slowing down what has been a red hot labor market. We did see the Unemployment Rate also dip back to 3. 5 . Thats a near record low. Separately the Labor Participation rate remaining consistently high. And thats why many economists, their takeaway is that this is a goldilocks report. Just strong enough, not too strong, a moderation in growth if you will. It comes as wall street is trying to gauge how this report could influence the feds next month, but so far, markets are responding positively with the dow up 118 points. Were following new developments on the humanitarian crisis at the southern border. Federal Appeals Court says the Biden Administration can keep a rule restricting asylum at the southern border in place. That rule makes it difficult for people to be granted asylum unless they first seek protection in a country they are passing through or apply online. This as we see just how dangerous it can be for migrants trying to cross the rio grande river. Mexican Authorities Say two bodies have been found in the river. One was found along a floating barrier installed by texas to deter migrant crossings. It is the first time a death has been reported along a barrier. The Biden Administration is suing texas to remove. Texas said the person drowned upstream and drifted into the buoys. Julia ainsley joins us now from tucson, arizona. Good morning. What more are we learning about the person found floating in the floating barrier . Reporter well, jose, there is a big debate going on right now. You have mexico, who says the buoys are to blame. The body was found in the buoys, but Texas Governor greg abbott said mexico is flat out wrong. Very sharp statement from him yesterday, saying that the body that the person drowned in another part of the river and has been washed into the buoys. Regardless of where this person actually perished, it is clear that the buoys are forcing migrants to take more dangerous routes through the river. They put that thousand foot barrier, jose, in one of the shallower more safe parts to cross in that equal path part of texas. So now there is a debate going back and forth between mexico and texas. And you have the Biden Administration agreeing with president Lopez Obrador that texas is violating the law by placing those there and thats why they sued texas over the buoys. What does this mean for the Biden Administration to maintain order along the border, but some say it is making it a travel ban because you have to request for asylum in a third country before you can request asylum in the United States. What is the ruling about . Reporter the ruling gets into the very policy you just described, that some critics see as a travel ban, where theyre allowed to turn back some migrants who havent already applied for asylum in a country they passed through or made an appointment on the app. What this really means and as we have predicted, jose, this will probably go to the Supreme Court. It was expected the Appeals Court would agree with the lower court that this policy was a violation, but they are putting a stay in place. So, for now, the policy will remain. It is likely now well see an appeal to the Supreme Court and it is a question of whether or not the court will also keep that stay in place while they hear the arguments. This court is a little mixed on how they run Biden Administration policies. They rule with the Biden Administration to allow them to keep using Enforcement Policies to focus on people who are safety risks. It could be that the court agrees with the Biden Administration again or believes it is an overreach. That is something to watch going forward. And, julia, what are you seeing there . Reporter i dont have to tell you how hot it is and how hot it will get here later today. Theyre seeing record high heat this summer. Around 110. And migrants here are now crossing more than they have seen recently. Actually the busiest sector of the border. Some people are blaming the texas policies for forcing migrants further west. Thats one of the most dangerous parts of the border. We have seen families crossing through, some say they turned themselves in out of exhaustion after sleeping in the mountains, and were also hearing from agents here who talk about the dangers when migrants decide to take this trek. Here what he is this one Border Patrol agent told us yesterday. A lot of times dehydration. In our vehicles, we carry a lot of water. Thats one of the first things we offer. We see little kids that need water. They have been doing this hike for five hours and in need of water. Reporter so you hear about the dehydration, i also spoke to people who were going out in helicopters to do Search And Rescue missions and sometimes, jose, by the time they find the migrants, it is too late to save them and theyre recovering bodies in the mountains and in the heat of arizona where i am here. And you also have new reporting on the Migrant Processing Center set up by the Biden Administration. They claimed over a year and a half ago that these things would be up and running. They claimed this would be a project that would be able to be up and running when title 42 was lifting so more migrants could apply for asylum or Refugee Status in their home countries rather than making that dangerous journey to the u. S. Mexico border. Instead were learning theyre moving the process all online. They wont be the Brick And Mortar offices that they first announced that would look like a place you would go seek Refugee Status in africa or the middle east. Instead, an online process, a lot of advocates are worried that migrants wont get their fair shake for an interview. Yes, they do have three centers up and running in costa rica, colombia and guatemala, they processed us thats, but so far no one has actually been approved to come to the United States. If this is one of the tools they want to use to keep migration down, it could be it is coming online a little too late and could have too little of an effect. I asked the Vice President about that just six months into the new administration, and she assured me these things would be up and running shortly, but were in 2023. Julia ainsley, thank you so much. Good seeing you. The College Boards says florida has effectively banned its ap psychology course. In a statement, the College Board said it was informed by floridas Department Of Education that the class violates state law, the dont say gay law. The education nonprofit says it was told districts can offer the course if they exclude lessons pertaining to Sexual Orientation and gender identity. Floridas Education Agency said they did ban the course and encourages the College Board to stop playing games with florida students and continue to offer the course and allow teachers to operate accordingly. The move comes months after the state was widely condemned for blocking ap African American studies courses. Now to tennessee, two democratic lawmakers expelled by the republican led legislatures won back their seats. Justin jones and justin pearson, two of the tennessee three, led protests for gun safety on the Chamber Floor last april resulting in expulsion from the house. The vote brought on accusations of racism. The Tennessee House reinstated the lawmakers shortly after their expulsion but they needed to run in a primary and general election to stay in their seats. Joining us now from New Hampshire is nbcs julia jester. Good morning. What are New Hampshire voters saying about this latest indictment . Reporter jose, we have been chatting with voters here at the Cheshire County fair and most of them have not really been paying attention to the latest Trump Indictment and arraignment this week and for those who did pay attention, it is not changing their minds about the former president who they have supported the entire time. So, while some voters around New Hampshire who are shopping for potential primary candidates have expressed that they, you know, may or may not believe the allegations made in the indictment, we had our nbc team here on the ground talking to those voters. It is kind of a bit of a tossup for the undecided folks, but for trumps base, they are digging in their heels, supporting the former president and we spoke with one woman earlier today about whether this will change anything in this 2024 primary. Take a listen. From what youre telling me, doesnt seem like the Trump Indictments are going to make an impact. I dont think they will. I really dont think they will. The indictments are ridiculous. They just look for anything. And, you know, january 6th didnt go exactly as planned. You cant tell us that he had anything to do with any of the violence that went on because he didnt. Reporter the investigation and the trial will play out the way it will in washington, but as for voter opinions, you heard it right there. Overall there is a general sense of fatigue among voters here in New Hampshire, hearing about indictment one, indictment two, indictment three, theyre all kind of blurring together in The Grand Scheme of things. So as we get closer to the primary, where not only republicans, but a huge chunk of independent voters will turn out, time will tell and see whether that willmake a difference at all, jose. Julia jester, thank you very much. Tonight, former Vice President mike pence will there be in New Hampshire on the Campaign Trail. Trump, meanwhile, will head to alabama, his First Campaign stop following the arraignment. This morning, Governor Ron Desantis is in iowa as the state gears up for its caucuses in january. This is a New York Times Siena College poll of likely republican iowa caucusgoers before the indictment. Joining us is Donna Edwards and david jolly, both msnbc political analysts. This happened before the arraignment. Do you think well see a change in the days to come, for example in iowa . It doesnt seem like to there is Much Movement in the republican base. I mean, you can see from the reporting, which is more anecdotal, that Voter Sentiment in New Hampshire is probably mirrored in this iowa poll where the indictments are becoming a bit of white noise for republican primary voters. And that is not going to be to the benefit of ron desantis, i think. If you look at that poll, who gained the most was tim scott, who seemed to absorb the short fall that donald trump saw in the polls. So, i expect that this is going to be more of a wash and that republican candidates are still going to struggle against donald trump in the primary. Mike pence has been getting a lot more attention since this indictment because of his role in it, and hes mentioned over and over again. Hes apparently trying to seize the moment. Hes selling too Honest Campaign merch. He saw a surge in donations with 7400 individual contributions on wednesday. Is the indictment helping pence, do you think . No. I mean, the intriguing thing is in iowa and early primary states that have a large evangelical following, mike pence is trying to appeal to the better angels that we should be honest, too honest in some cases, flipping the former president s words against him into something favorable. But in a broader republican party, this spotlight on mike pence and his continued resistance to Donald Trumps leadership during the insurrection hurts him. Republicans have been told there was nothing wrong with january 6th and donald trump did nothing wrong. Mike pence is showing Republican Voters he actually remains out of step with where they are. And Chris Christie spoke with new york magazines kara swisher about his role in the trump investigations. Have you been questioned in any of the investigations . One of them. Which one . I cant say. What was the broad idea . They were trying to get a handle on what i knew about his knowledge of the reality of the election results. Were you helpful . I was honest. That would make it two of trumps political rivals interviewed for this investigation. Will that make a difference to voters . I just dont think it will. You look at the polls and it is showing as many as 97 of republicans are actually still primary voters are still strongly in support of donald trump. I dont think it will make a difference at all. With Chris Christie, i think that his numbers are coming down, although i dont know how much further you can get down below 1 . So, these numbers are pretty baked in. I think good for Chris Christie and a couple of the others who are being a critique and check on donald trump and i dont think it will matter. David, Chris Christie then made a surprise visit to ukraine. He was there today, meeting with president zelenskyy. Do you think that is going to make a difference . It should. Look, the important thing for Chris Christie is he got into this race to be a check on donald trump and arguably others who have shown their fealty to donald trump. At some point, if you are running for president , you have to demonstrate why you should be president , what you might do, what your priorities are outside of the infighting within the republican party. I think what youre seeing from Chris Christie is a recognition of that, sure, hes in the race to make it harder on donald trump, but if hes really in the race, he has to show Republican Voters why he should be considered for the nomination to be president of the United States. This type of trip, this type of engagement burnishes the credentials. I was struck by your comment about tim scott, who is in that poll we just showed third, right . Hes right behind the Florida Governor in that standing with 9 . Is there something that he is doing or not doing that seems to be in some ways working for him . Well, i think tim scott is trying to thread that needle. Hes critical when he needs to be, for example, of ron desantis around the Education Teachings in florida. I think that he is appropriately critical, but threading the needle with donald trump and hes a very likable guy. You get him in small groups and stuff, hes not the best on the big stage, but you get him into those small groups like in New Hampshire and iowa and i think tim scott stands the most to gain. This is a battle about who is going to come in second in the primaries to take donald trump head on and i think you can see tim scott gaining some traction among some of those early state voters.
