woman's world cup with five days of practice before a touch match in the knockout stages. ♪♪ good day, everyone. i'm andrea mitchell in washington. all eyes are on the u.s. courthouse a few blocks from here where the grand jury examining former president trump's alleged role in attempting to overturn the 2020 election is meeting today. another trump indictment is potentially imminent, according to the former president himself. joining me now, andrew weissmann. former fbi counsel, of course. talk to us about, what is imminent? what are the signals? aside from donald trump saying on truth social, expecting it and his lawyers have been brought in and he did get a target letter on july 18th. >> right. the fact that he got a target letter means that it is highly likely that they are going to charge, particularly in a case like this where it's so high profile. we were all waiting -- i was waiting to hear the defense met with the prosecutors to make an effort. that's also a clear sign. that always happens with good prosecutors, that you give the defense lawyers the opportunity to be heard. i fully expect if it's not today, it's going to be thursday. i would strongly suspect it would be today, unless there's some witness or witnesses who the grand jury really needs to hear from. the reason for that is that jack smith clearly understands the clock. he clearly understands that in order to bring a case before the general election -- if you want it before the general election, you need to bring it. so as soon as it is ready, you can be sure that he is going to bring it. so the key thing i'm looking for in addition to are there charges is who is the assigned judge. that's going to tell us pretty much everything about the timing of when this case would go to trial. >> just to drill down on that for a second, andrew, because the judges in d.c., the federal judges are very experienced with this. they have been hearing numerous cases of the lower targets here, the people who were involved in january 6 itself. there's a possibility here, this is not just donald trump. this could be some of donald trump's alleged co-conspirators. we don't know that yet. the universe, from all the people who worked around him in the white house, as well as those who were in his legal team, his outside legal team. >> absolutely. that is a big open question as to whether there will be co-defendants. you and i and others have talked a lot about the more co-defendants, the harder to bring this to trial, especially if they are all in one case. you can imagine it's possible we may see multiple cases where they have donald trump in one case and other people in another case. people who are sort of, i think, maybe worried about their fate today are people like john eastman, a lawyer who gave advice to the former president about what he could do in terms of overthrowing the election. jeffrey clark, a particularly disloyal person at the department of justice, who seems, by all accounts, to have been less than candid with his bosses and was willing to say the department of justice opened a fraud investigation, even though many people have testified under oath that there was no fraud. those two people, i think, must be very concerned about their fate today or this week in terms of whether they are charged. as you said, there could be other people, everything from mark meadows to rudy giuliani to lesser known names who could also be facing criminal charges as well. all remains to be seen as to how jack smith goes about those very difficult charging decisions. >> andrew, stay with us. i want to bring in garrett haake, jackie alamani and ken dilanian. president trump releasing attacks. this morning, he has been quiet. >> a bunch of re-posts this morning. nothing new this morning. trump world appears to be in a ready posture right now. i have talked to a couple people in and around the trump orbit who are anticipating something today. they operating on the same limited amount of information we have. they had a meeting between mr. trump's attorneys and the special counsel's office last thursday that got overshadowed by the superseding indictment in the documents case. nothing in that meeting shook their broader belief that an indictment is coming. it's a matter of when. they and their allies have statements drafted, talking points ready to go. they have long expected he would be indicted in this case, whether it's this week or next week, sort of immaterial. >> it could be today. this is, for them, certainly a hold your breath moment. jack smith's low profile through the investigations has made him a top political target for trump and his congressional republican allies. hold on, i want to bring in ken. you are a few blocks away at the justice department through the morning. we have seen some activity with the grand jury just now. >> that's right. we have seen grand jurors come in today and report as they generally do on tuesday and thursday. we are two weeks to the day since former president donald trump announced to the world he got a target letter in this case. that's one of the reasons we are on indictment watch. there are other reasons as well. one of the big questions would be, how would we learn about an indictment if it's handed up by the grand jury today? it may well simply be that we get it like we do many other indictments that the department of justice announces every day, via press release. with the indictment attached, because it's not necessary that an indictment be sealed once it's handed up by the grand jury, or it could be promptly unsealed if there's a reason to seal it. it is also a standard practice for department of justice to notify a target's lawyers before they make public the fact of an indictment as a matter of courtesy. there's also a long history of donald trump pre-empting the process and announcing things on truth social. jack smith and his team are aware of that. to the extent there's an indictment today and they notify trump's lawyers, my bet is it wouldn't be with too much advance notice. they want to do a better job of controlling the narrative than, say, it happened in the mar-a-lago case when trump was the first to tell the word he had been indicted. obviously, as andrew and others said, will there be co-defendants? will there be cooperators? will anyone be arrested? all fascinating, dramatic questions that we are awaiting the answers to. >> ken, we have heard from daniel barnes, our colleague at the courthouse, that the grand jurors were seen leaving -- coming downstairs to the cafeteria for lunch. whether they finished their job or not, they are going to get a lunch break. let's all wait on that. jackie, we are talking about jack smith's very low profile throughout the investigations. we have not seen any -- maybe one public statement from him, my recollection. it has made him a top political target for the trump and congressional republican allies. >> yeah, so low profile that willis says she doesn't think she would recognize him if he was sitting next to her. she's getting ready to drop charges against the former president. what we know so far is this idea of trump attacks. the cost of providing protection to the people involved with the investigations into former president donald trump. the justice department spend $1.9 million to pay marshalls to protect jack smith and members of his family. of course, this is a big sum. not uncommon when it comes to the people who have come under the limelight for leading the prosecutions into trump. we know that alvin bragg similarly, the security costs in the manhattan d.a.'s office went up as well. there is some anticipation here that it's only going to get worse once the indictment drops. jack smith dropped the indictment against former president trump and his co-defendants last month in the mar-a-lago classified documents case. there's a feeling that security precautions might need to be even greater when it comes to this indictment, just because of the loaded aspect of what jack smith is going to be uncovering. after all, this all started with the former president encouraging his supporters and allies to storm and attack the u.s. capitol on january 6. >> andrew, picking up on that, there's the issue of whether or not they find some criminal element of incitement. that is an open question. whether there's a conspiracy to overturn the election. whether the fake electors in one or more states are involved. there's a wide range of what could be. do you expect it to be a very detailed indictment if it comes down? the same level of detail we saw in the mar-a-lago indictment? >> yeah. with respect to detail, there's no question that this is going to be what we used to call a speaking indictment. it's going to provide chapter and verse very much as you mentioned, andrea, that we saw in the documents case in florida. to doubt, we will learn additional details, even though obviously we know quite a bit from the january 6 committee. i think there will be a lot to dissect. with respect to the charges, a key thing that i think i'm looking for and others are wondering is whether the charges will include some kind of allegation with respect to the use of force. people may remember who have been monitoring this that the use of force is a necessary component if you bring a seditious conspiracy charge. that's a charge that's been brought against the oath keepers, for instance, certain members of the oath keepers, and the proud boys. it does require that element of use of force. so it will be interesting to see whether jack smith and his team have that connective tissue of the white house to the actual use of force on january 6. the same thing with respect to insurrection charges, whether they have that ability to link up. i think there's no question that they will have an obstruction count. that's something that has been brought against many people already at the foot soldier level. it's hard to imagine that with charges at that level that it's not going to be brought against the alleged ringleader of the conspiracy. >> let's not forget, folks, what we are talking about here in terms of history. because if this indictment comes down and if it's against donald trump, this would be the first time a former president would be charged, accused in a criminal indictment of trying to overturn an election. the first time in american history that that will ever have taken place. this is really the biggest issue facing the country and our politics and the former president himself. thanks to everyone. thanks to all of you for starting us off. how can the fulton county investigation and jack smith's special counsel investigation avoid colliding? donald trump's looming legal troubles are not helping president biden ahead of a potential biden/trump rematch next fall. they are tied at 43% in the latest poll. biden's approval rating is 39%. that's an improvement from last summer, but still concerning to democrats in the white house because just 20% of democrats say they would be enthusiastic having biden as the nominee. 51% say they would be satisfied but not enthusiastic. joining me is peter alexander and peter baker, chief white house correspondent for "the new york times." to the two of you, peter alexander, first to you, your sources in the white house, how concerned are they about this polling? >> i think they are concerned about the lack of enthusiasm. they would like to see a big ovation whenever the president walks up on the stage. they have that in smaller venues. the white house recognizes that over the course of this next year, one of the biggest priorities, biggest responsibilities is to demonstrate the implementation of the policies the president was able to get passed, some bipartisan, some with only democrats. they talk about infrastructure week, which under the former president was a punch line. they say now we have a trillion dollars to be spent. they want to demonstrate that that's happening in their backyard. they realize that's a major challenge. at the end of the day, this is binary. this is about someone versus someone else. if joe biden is facing donald trump, the white house, certain those who support the president, his allies say day americans, t may be in the middle, will recognize there's no choice but to pick joe biden. >> peter baker, the biden campaign is facing new developments in the investigation into his son, hunter biden's former business parter. he reportedly testified behind closed doors that access was trying to sell the illusion of access to his father. he admitted the president was never -- when he was vice president was never involved in hunter's business dealings. democrats who support the president say that all along that he was present for 20 phone calls over a decade where he was either on the phone, in the room, saying hello to business associates. they say it was small talk. is that using the influence,ed biden name as a branding? >> it's not something the white house would have liked to have seen. they have to defend the president's statement that he has had no conversations with his son about his business practices. now they have to square that comment, that assurance with the notion that he got on the phone with business partners, as you say. the report we get from the testimony is that he wasn't actually talking business. therefore, they could make the argument that getting on the phone and having chitchat with associates of his son is not the same thing as being involved. it's a way of questioning his veracity about this and questioning his handling of his family. republicans are eager, on the eve of what seems to be another trump indictment, to make hunter and joe biden a focus. make it out as if, maybe something is wrong with our candidate, but their candidate is bad, too. it's an exercise in what aboutism. president trump never did relinquish his own business, much less his children's business. it's an odd situation. republicans focus on this given the fact they didn't care about trump's conflicts when he was in office. >> more importantly, to the democratic base, which seems to be less enthusiastic, especially really important parts of the base, is the age issue. there's no way to change that. how do they combat that? >> that's the one thing you can't do anything about. you might be able to make inflation better. you might get more fund-raising. you might be able to do more campaign stops. you cannot make him younger. of course, as much as they would like to sell him as a vigorous 80-year-old with aviator glasses and a cool grandpa vibe, taking bike rides on the beach, there's sort of this locked in place image of a president who is slower than he was, a little confused at times and mangles names and memories. that's a hard thing to combat. they will make the argument that, fine, okay, we will take our guy over the other guy any day of the week. the other guy is three or four years younger, he has his own issues with age. if you look at his sentence pattern, you can't diagram a noun, a verb and an object the way you can with -- they will try to take on that argument at some point. it's a real liability for president biden. it's the one thing you can't do too much about. >> we will have to leave it there. peter alexander, peter baker, thanks to both of you. donald trump's legal issues mount. what will it mean for his campaign in 2024? how could the wisconsin supreme court reshape policy in the state? >> reporter: you could see a drastic shift here. wisconsin ist a state with a democratic governor who just won re-election in november. a republican legislature with a near super majority in both chambers. there's not much compromise, not much policy that gets pushed. what happens is, many of the biggest, toughest policy questions end up before the state court. b in the past, that has meant covid restrictions being struck down early in the pandemic. it has meant absentee drop boxes being banned across the state b the court itself. it has meant the state supreme court choosing and siding with republican-drawn maps that have locked in the super majority. now it's a new day. you have a liberal justice taking the bench later today, giving liberals the first majority in 15rs years. the cases that we know are likely to come before this court likely even in this next term, one being abortion, whether or not the abortion ban currently in place, near total ban on abortions here, whether or not that remains legal, whether or not that l stays in place. you see liberal groups launching lawsuits against the election laws in this state, trying to have the court re-visit its decision on drop boxes and absentee voting. weab know election challenges. this is a state where the court came one vote away from flipping the election results back in 2020, siding with former president trump -- almost siding with former president trump. election challenges in the future c will come before this existing liberal supreme court. that's why you are seeing so much action, so much attention on the swearing in that will take place later today. it's why this was the most expensive supreme court race in the country's history. it's why that race was called the most consequential election of this year, andrea. >> shaq, thanks to you. mark and david, let's dissect this. how important, for instance on abortion, on redistricting? >> joe biden won wisconsin by 20,000 votes. in almost every race outside of that supreme court, almost always comes down to 10,000 or 20,000 votes. shaq is right. what he ended up saying at the end about the legal challenges. if this is shaping up to be a close election in 2024, as a lot of the polling ends up suggesting, those legal challenges and how the supreme court endses up ruling in the state of wisconsin could be determinative. >> let's talk about the polling. 43/43. it doesn't get any closer. there's margin of error on both sides that can goer up and down. we are talking about a general election matchup between a former president, two indict indictment indictments and more to come, and someone who accomplished a lot -- thehe white house doesn' think he gets full credit for it as well as facing an age issue, according to the base. >> it's just not that this one "new york times" poll that shows a competitive potential rematch between joe biden and former president donald trump. it's almost every poll that we haveer actually seen over the lt several months, including our own nbc news poll. what we end up seeing is, we are bracing for what could be a very competitive rematch. when you dig into the numbers, when you end up seeing that joe biden is lagging among some key demographic groups that carried him in victory in 2020. talking about women. he is winning but not as well, according to the poll. he isel doing well among africa americans, but not action well. with independents, but in the's well as 2020. for democrats, if they are bracing for a competitive rematch against donald trump, they will need every single inch of the democratic coalition that got him to a 4.5 national popular vote lead, which was still really close in 2020. >> when you look at the electoral college and disadvantages they have got. david jolly, let's talk about the trump super pac. they spent more than $20 million on legal fees alone during the first six months of this year, according to the latest fec filing.challenges. >> sure, andrea. well, it speaks to the amount of legal exposure donald trump has. whether he's a candidate or not, this is someone in serious legal jeopardy. i think you have to looker l at spin rate as does it affect his brand, but then doesec it affec his campaign i tactics? as a brand, honestly, it has been built in from his benefiting the family enterprises, ivanka and jared, to using family properties to the notion that he has all of these legal expenses. i don't know the grift affects his brand. does it affect what he can do on the campaign trail?af arguably donald trump needs that the least. he needs that the least, his earnth media, he's perhaps the most talked about person in the planet. i don't know that it affectsalks ability to actually get out there and campaign. like limited resources would affect rones desantis, tim scot nikki haley and others. >> and, david, do you think people contributing to donald trump and the campaign realize that the money is going to pay foron his attorneys, a wealthy man, by his own accountability, multibillionaire, if he really l is, but certainly wealth enough tobu pay his own lawyers. do you think they care? >> i think the percentage of small dollar donors that read the fine printar is probably prettynt low.et so they're probably surprised today. but if you're supporting donald trump on anything, you're probably there on everything, so i don'tpr think it affects his strength as a candidate right now in the gop primary. >> mark murray, do you agree in terms of what donald trump's support --rm the base is happy pay. and at h the same time ron desantis isam running through h money and i has some big millio dollar donors, but not as many smallot donors. >> i agree with what david is saying. i look at thewh fact that his, that one pac ended up spending more than $20 million in six months on legal fees. if we'ren extrapolating that o for another year, that could be getting closer toar $100 millio. that's a00 lot of money. >> by anybody's count. mark murray, david jolly, thanks so much to you the next round at the world cup.e but can they make it past the next round?
