of the house foreign affairs committee talks about his recent meeting with president zelenskyy. overnight, comedian dave chappelle was attacked on stage while performing at a comedy festival in los angeles. we'll bring you the very latest. and we begin this morning with a continuing firestorm over the unprecedented leak of a draft opinion in which a majority of justices on the u.s. supreme court appear ready to overturn the right to an abortion, granted by the roe v. wade decision, nearly 50 years ago. a handful of protesters are still in front of the u.s. supreme court this morning. as they have been since politico first published the draft opinion roughly 36 hours ago. protests were also held last night until cities across the country from new york to chicago to phoenix. the supreme court has confirmed the document published by politico is authentic. but it stressed, this is not the final decision which will likely be issued in late june or early july. chief justice john roberts said in a statement that he has ordered an investigation into the leak which he called a singular and egregious breach of trust and continue to get fierce reaction across the political spectrum with republicans denouncing the leak and accusing liberals of being behind. it. vice president harris blasted republican leaders when she spoke last night to emily's list a group that works to elect democratic candidates who support abortion rights. >> how dare they tell a woman what she can do or not do with her own body. how dare they. how dare they try to stop her from determining her own future. how dare they. try to deny women their rights and their freedoms. >> and with us to start off the coverage this hour, nbc news justice correspondent pete williams, msnbc anchor yasmin vossoughian, and amy weinstein, a legal analyst and nbc news capitol hill correspondent ali vitali. pete, what will the supreme court's investigation into this leak look like? >> i think the supreme court couldn't even answer that question for us. this is not the kind of thing that the marshal normally is in charge of. she's the chief security officer, but she has a lot of options it seems to me. one is she can try to look at the document itself and see if there are clues in that. a sort of hire outside experts that could forensically analyze, that's a possibility. question people in the court, of course. in the past, chief justices upset at leaks have even suggested that people could be polygraphed. whether it would come to that or not, i don't know. i suspect that she's just beginning to get the answer to that question herself, jose. i just think it's going to be a long and difficult thing for her. leak investigations always are. even inside the government. even investigators who are long used to doing leak investigations say that they're very, very difficult, because, of course, the obvious place to go would be to call politico and say, hey, by the way, where did you get that document? and that's obviously not going to happen. so it's very hard to figure out from ground zero exactly how the document got leaked. sometimes, li leakers come forw. maybe that would happen here. >> in fact, what could happen to leaker or leakers once discovered? >> i don't know. i'd be interested to see what your other guests think. i don't know if it's a crime. i should say it's a theft of a government document although in the past, prosecutors are reluctant to bring those cases when the documents are made public. i don't even know if it's a federal crime here, if it's a clerk, then that clerk will undoubtedly be fired. i think that clerk's -- any future in the law is completely foreclosed to them. i think it would destroy their legal career, because this is just about the worst thing that a court employee, certainly a clerk, if it is a clerk, and we don't know, can do. because the court takes its own security, the safety of the ability to have these discussions in a closed setting so seriously. this is a precious resource for the premium court. and to have it squandered like this, there's just no worse offense, i think. >> so, i'm wondering -- pete, thanks, tali, you once clerked for sandra day o'connor. what could that person or persons face? >> well, as pete said, the supreme court has never conducted an investigation like this, and so i'm not sure that they even know yet what that would look like when chief justice roberts said that yesterday. but, you know, i think ultimately, this is about a violation of norms. and about the supreme court's own premium on secrecy. it is not a crime, and if it were a clerk, an employee, as opposed to the justice themselves, really the only consequences is for them to be hired and i imagine to suffer reputational harm and possibly reputational enhancement from folks who think that the leak was the right thing to do under the circumstances. >> tali, take us through us process when a case is organized to to finally when the high court issues its decision and where that stands along the way. >> yeah, the time line, jose, is really important because i think sometimes people think of the supreme court as almost an active debating club between the justices. that's not quite right. the circulation of opinions are really the way principally they talk with each other. so this case was heard in december. after oral argument, during that week, the court would have gotten together in private, just the nine of them, to have a conference. and to give their preliminary views about the case. and a majority would form. and the senior justice in the majority would decide who likes the majority opinion. it's clear that chief justice roberts was not in that group proper likely he would have written the opinion, and not written such a caustic opinion. and then the majority writer works on his draft. and after he circulates it, in this case, justice alito, then concurrences and dissent will start to circulate. and that's really when the negotiations begin. votes can shift. or just as important, and this is really important, the language of an opinion, some of its details might change. there might be, for example, a justice like chief justice roberts who said, i can go along with some of this. but you've got to put a rape and incest exception into this draft. and those negotiations would ensue. so, one theory is that, and i think a very strong theory, is that the leak happened at that moment, when those discussions, through the writing among the justices begin. >> so, just -- and i'm trying to, you know, view this. the fact that it's five to four, right, the fact they say the majority will be writing this. that's improbable that those numbers change, or not, tali? >> it's quite possible that they would change. and you know, everyone is thinking about 5-4 and how to divide 9 into two groups. but we've had really important supreme court decisions over time when you don't get five people who agree on one thing. casey, the decision that affirmed roe, was a plurality opinion, meaning less than nine. right. three justices including my mentor justice o'connor wrote the controlling opinion. the narrowest view would be the controlling view. so there is a possibility that there's concurrence out there. again, i think the best speculations that would be by chief justice roberts. and maybe he would be able to take one of the people from this majority that was formed at the beginning, and make a controlling opinion up to justices. now, that's if you think the leak is about internal jockeying and that was the motivation of the leaker, i think it's also important to think about the fact that the leak might have been meant to send a signal to the outside world. jose, i was struck by the fact that just yesterday, oklahoma signed a new abortion restriction. a so-called heartbeat law. into law. the governor signed. and we're seeing states talk about special sessions. to make new legislation. so, an effect also is to tell a state who don't have an abortion restriction on the books or don't like the restriction they have, maybe they think it's not restrictive enough, that they can get to work, too, in anticipation of the ultimate decision. >> yasmin, protesters have been outside of the supreme court since shortly after this draft opinion was published. you've been able to talk to people on both sides of this debate. what are they telling you? >> reporter: i want to take you on a little bit of a journey, jose, while i'm talking to you. i think it's important to kind of give you the lay of the land as to what was happening here. i was here late last night and this whole area was completely packed. we had hundreds of folks out here protesting to say the least. i think, jose, it's a lot less sparse to be honest. i've spoken to people out here who are here more to reflect on what is to come when it comes to the future of roe v. wade, a precedent in the supreme court that's been in place for half a century known as the law of the land. and it seems that precedent obviously is changing if in fact this decision comes down to drop. some of the words i'm hearing from folks against abortion rights,they feel elated. it's now coming to fruition. for those for abortion rights, they are angry, they are sad, they are shocked. and they don't know what is to come. they want the government. they want the biden administration to do something about the senators that stood there on the steps of scotus just yesterday to enact legislation to codify roe, they want that to happen. let's take a listen, jose to what some of these women said late last night. >> what this court is trying to do, what they will do, will absolutely have a devastating impact. but it's not going to stop abortions from happening. abortions are going to continue happening. >> this is a human right. it's medical care. my nieces, my little cousins, like they don't understand what's happening right now. it's, you know, it's not going to stop abortion, it's just going to stop safe abortions. >> to stand up for what it's right, codify roe v. wade. we don't need to wait until november. this is not something that we need to wait on. it's very clear what the intentions of the supreme court are today. >> reporter: so here's the thing, jose, you can't help but wonder if today is a reflection of what is to come. last night there were hundreds protesting, today, not many. you can help wonder, can republicans use this as momentum for the midterms? will democrats use this as momentum for the midterms to drive folks. we're watching that closely to see if the reversal of roe v. wade will be a major issue in the upcoming election. >> yasmin, just a few yards where you are is the capitol. ali, you're there. what are congress' next steps when it comes to abortion rights? >> reporter: jose, they're trying to keep the momentum building here. yesterday on the steps of the supreme court, on the steps of the senate, we saw 40 democrats saying they're going to demand action in legislative form. you and i know they tried this in february to pass the house version of the women's health protect act. that failed but senate majority leader chuck schumer yesterday in a fiery speech to reporters saying they're going to try again next week. listen. >> every senator now under the real glare of roe v. wade being repealed by the courts is going to have to show which side they're on. and we will find the best way to go forward after that. >> reporter: so, look, last night, jose, they did find a way to start the process of moving forward. and i apologize for the noise towards our back in the capitol here. but on the senate side of this, schumer is going to move forward at some point next week. the open question, though, is what they're actually going to be voting on. it sounds like it's going to be some amended version of the women's health protection act. in talking to senators here this morning, it may include some kind of a carve-out that doesn't punish people who may have objections performing abortions. all of that a live debate on capitol hill. as democrats try to push forward to pass something. the reality is, though, they're probably not going to be passing anything because the numbers have not changed since february. the filibuster is still in place. there is not the senate will to do that, to change it. so they don't have 60 votes here that they would need to overcome the republican filibuster on this issue. which means when they do take that vote next week, jose, it's going nowhere. >> ali vitali on capitol hill. a very busy capitol hill. and tali faraheadian weinstein sand yasmin vossoughian. thank you. joining us the vice chair of the democratic women's caucus. congresswoman, a pleasure to see you. what is your sense of what happens next? >> well, good morning, jose. you know, i think it's really important for women across the america to really take in this moment. our daughters, my daughter, will have fewer rights in america in 2022, than the rights that we got to enjoy. that my generation got to enjoy. and this is the reality that republicans want for women in america. i don't know how many different ways, or how many different times republicans need to say it before all of america understands. but their future, their vision for america does not include women who enjoy economic and productive freedom. and so, to your question, where do we go next? i think, you know, i appreciate the path that the senate democrats are trying to carve out. as you know, the house democrats passed a women's health care protection act so that we could codify roe v. wade. the senate obviously, a narrowly divided senate, my fear is that it will go nowhere. and why? because republicans want to make sure they continue to control women, women's future and women's body. they're not pro-life, jose. they may be forced birth republicans but they're not pro-life. there's nothing pro-life about them. >> let's talk about that, the women's health care protection act because it was passed in the house. it is obviously, it looks like there's nowhere for it to go in the senate. i mean, the senate simply doesn't have the votes to pass the bill to put protections under roe v. wade. into law. so is there a -- i'm just thinking, is there a way to, you know, try it again? a version of women's health care protection act in the house that is different that maybe could look to have a new road in the senate? >> you know, we -- i am open to considering all sorts of options. the challenge, though, is i don't think that anything will get done in the senate, because it is so narrowly divided. but i think we've also got to keep our eyes on november. you know, the american people need to understand that the reason why we're here is because of republicans. you know, i mentioned just briefly, we should not -- we should stop calling republicans pro-life. when you look at what republicans stand for, they -- not a single republican voted with us on paid family and medical leave. so that mamas can be home with their babies after child birth. not a single republican voted with us on access to universal pre-k so that our kids had a great opportunity at an education. not a single republican has voted with us on access to child care so that women could get back into the workforce. so, you know, it's for us to believe that republicans will vote in the senate to protect women's rights to their productive freedom, i want senate democrats to try. we've got to keep fighting to live another day. but ultimately, jose, we have to win elections. and this november, that ballot is a referendum on whether we believe women have a future to economic freedom and dignity. and reproductive freedom and dignity in unites in 2022. >> congresswoman escobar, thank you for being with us. i appreciate it. >> thank you. up next as the war in ukraine continues the european union is proposing pretty aggressive measures to punish russia. we'll be speaking live to congressman gregory meeks, he just got back with meeting with ukraine's president next. place, as we wake up, the president's remarks on the economy in the next hour, the expected interest rate hike could have on your wallet. you're watching "jose diaz-balart reports." ruby's a1c is down with rybelsus®. my a1c wasn't at goal, now i'm down with rybelsus®. mom's a1c is down with rybelsus®. what did you learn on this trip? >> well, i learned that president zelenskyy is focused and has a plan. and is -- he and ukrainian people are fighting for their sovereignty. and they believe, as i believe, they have the will to live. and they are just asking for, as we move into a different phase of attacks by russia. yeah, still at mariupol but as it goes to -- to the donbas area, the different weapons that need to go that can go the distance further to hit some of the russians, as well as what is significantly important today is that the russians have the ports bombarded. so that you cannot get any of the grains or harvests that you need to get out -- that ukraine needs to get out to the rest of the world, that shows don't suffer from hunger. we need to give them the ammunition that's necessary to we can clear those ships out so we can get the grain. we talk about wheat and sunflower oil, et cetera. a lot of that comes from ukraine. and that's one of the reason the prices are going up. but in places like africa and some parts shipped to south america, starvation could be around the corner. so, they want to open that up. and this was mined by the russians also. they want to come in and clear the mines there. so, it's about, of course, the russians invading the sovereignty of the ukrainians, but also humanitarian basis, preventing a starvation around the world. we've got to make sure that we are getting these weapons to them in a timely fashion, because time is of the essence. and that's absolutely clear from our conversation here. and lastly, i would say, the unity that's necessary. there should not be any imports going into russia at all. and we should not be accepting any exports from russia. and that's why, i think, it was a big deal today when we heard from the eu that by early next year, late this year. there will be no oil exports to any of our eu partners. and that's us staying together in unity. and that's something i know that putin didn't count on. >> yeah, the embargo certainly is having an impact. and every day that passes that's involved is certainly more affected. you were talking about unity here in the united states. president biden once again pressed lawmakers to pass the ukrainian aid package. what do you think needs to be the top priority in this bill? >> well, the top priority, of course, is getting the weapons to ukraine so that they can go about defending their sovereignty. and we can prevent the starvation that i'm talking about. and i'm sure that we should be able to do that very well. i know that the appropriations committee is working on the bill as we speak this week. so that when we get back next week, it will be something that we vote on, and pass. and get to the president's desk, so that we can see that those weapons are getting to the ukrainians as quick as possible. and as visit, also, the 82nd air division who is helping to get -- as the weapons are delivered there, to get the weapons to the battlefield. you know, over into ukraine. so, we want to make sure that's done. we know time's of the essence. and so that's why it's extremely important that we pass the $33 billion to get the weapons necessary to the president of ukraine. >> and congressman, you feel confident that the ukrainians will be able to beat the russians? at walmart, we're working on it, every day. a suspect has been arrested and charged with deadly assault after jumping on stage and attacking comedian dave chappelle in hollywood bowl in los angeles last night. joining us is nbc's gadi schwartz. what happened? >> reporter: it happened live in the netflix show. dave chappelle was on the show just finished joking that comedians have to have more security at awards. all of a sudden, video taken by fans shows a man on the crowd jumping on the stage, charging chappelle. knocking him to the ground and getting up and trying to run away from chappelle's security team who caught him in the back of the stage and appeared to fight with him for several minutes. police say the attacker was arrested. had hi replica gun with a knife blade inside. chris rock who was there ran up to the microphone and yelled, is that will smith? chappelle joking it was a transman, over attacks that have been called transphobic. the attacker was identified as a 25-year-old named isiah lee. he will be charged with assault with a deadly weapon. he was surrounded by jeering chances and taken to the hospital and booked into jail. jose. >> thank you. we're awaiting president biden's remarks on the economy in the next hour as the federal reserve is expected to announce a raise in interest rates this afternoon. joining us nbc news business and tech correspondent jo ling kent. what does this mean for justice. >> hey, jose, the fed is set to release its biggest rate hike since 2000 to get inflation under control. it's going to be more expensive to take out loans, credit card interest rates. and to cool off the demand from buying things from the pandemic. and the high prices that you see, ideally will come back to earth. this is a delicate balancing act as jerome powell tries to avoid stoking pressures here. it appears that powell has adopted a more aggressive strategy as he hiked the rates that quarter point in march. remember that. and he said it's appropriate in his view to be moving more quickly. we also noted that there's something in the idea of front end load, whatever accommodation he thinks is appropriate. the idea here is to act now, raise rates now, and then re-evaluate as the fed goes along. the fed is expected to do more than raise rates. we want to point out, we'll see another tool being deployed here. reducing the balance sheet with loans and mortgage-backed and the fed injecting that money into the economy and we've the price of borrowing money lower. ideally, if that changes then inflation will cool off. jose, a lot of americans are changing their spending hands right now. according to the nbc news online poles, 6 in 10 shoppers say they've decided not to purchase an item or delaying because they can't afford it. >> thank you very much. appreciate it. up next, the results of last night's big primary night in ohio. steve kornacki is back at the big board to break it down for us next. you're watching "jose diaz-balart reports." e diaz-balart reports. me they don't beat me♪ ♪ ♪ ♪he'd better not take the ring from me.♪ does daily stress leave you feeling out of sync? (soft music) ♪ is one mission, life. i get to keep her. we get to have her and enjoy her. and she gets to grow up, which is the best gift anyone could ever give. 42 past the hour. now to an early test ahead of the midterm elections. j.d. vance the trump-back senate candidate won the ohio primary tuesday night. vance will face democratic congressman tim ryan who won the democratic primary last night. joining to us break that down, nbc news political correspondent steve kornacki. steve what can you tell us about the results in ohio? >> it was the first clean test of donald trump's strength with republican voters. this is an open seat for the u.s. senate. almost all of these candidates, the big exception was matt dolan, sought trump's endorsement and catered towards trump's message. being the line, the differencemaker. vance, obviously, as you say, the man who got trump's endorsement. when you look at the map, the maroon counties are the counties that vance won. there's breadth to his victory geographically cheer. but where he really ran up the score, i'm going to draw roughly a region here, this portion of ohio, this is the appalachian region of ohio. there's 31 counties there considered part of appalachia in ohio. it's where donald trump did the best in the general election in ohio. it's before donald trump did the best when he ran in ohio's primary back in 2016 against john kasich who was then the governor of ohio. you take a look at some of the counties in that region, and they were j.d. vance's best counties here. this is portsmouth, ohio, vance up 50% here. you look around the region, vance up 40%. the areas that were sort of the core trump areas in ohio for the very beginning for trump back in 2016 is where j.d. vance ran the best. i think there's evidence there that the trump endorsement you can see a real differencemaker for j.d. vance. the other thing for vance, mat dolan trying to beat vance. dolan was calculating all of that trump vote would be split up among a bunch of different candidates and there would be a path within more moderate republican voters. voters in and around metropolitan areas. for instance, take a look at cuyahoga county, cleveland, dolan family here, owners of the baseball team in cleveland. the calculation here from the dolan campaign there were going to be a lot of votes for dolan to really run up the score. and maybe there was going to be more resistance to the trumpism. but vance didn't fine here, he didn't win cuyahoga county but he didn't get blown out. only an eight-point margin. we see that in the populated centers. columbus, the state capital, the dolan folks were hoping to win by 20 points. vance held him to six. vance did great in the trump areas but also a p.o. in the suburbs that wasn't expected. >> thank you very much. fascinating. coming up, you've probably been hearing that a number of states have trigger laws on abortion. what does that mean? we'll look into that, next. you're watching "jose diaz-balart reports." we hit the bike trails every weekend shinges doesn't care. i grow all my own vegetables shingles doesn't care. we've still got the best moves you've ever seen good for you, but shingles doesn't care. because 1 in 3 people will get shingles, you need protection. but, no matter how healthy you feel, your immune system declines as you age increasing your risk for getting shingles. so, what can protect you? shingrix protects. you can protect yourself from shingles with a vaccine proven to be over 90% effective. shingrix is a vaccine used to prevent shingles in adults 50 years and older. shingrix does not protect everyone and is not for those with severe allergic reactions to its ingredients or to a previous dose. an increased risk of guillain-barré syndrome was observed after getting shingrix. fainting can also happen. the most common side effects are pain, redness, and swelling at the injection site, muscle pain, tiredness, headache, shivering, fever, and upset stomach. ask your pharmacist or doctor about shingrix. shingles doesn't care. but you should. [ding] e*trade now from morgan stanley. 48 past the hour with all signs pointing to the supreme court set to overturn roe v. wade, many are wondering what happens next. nbc anchor morgan radford joins us to break it down. megan, good morning. assuming the court follows through with the opinion, what are we seeing? >> well, the reality, jose, this could be different depending on where people live. it's so important to remember that the decision would not immediately outlaw abortion everywhere, what it does, it leaves it up to the state and could make a big difference in what this means for you. nbc analysis shows 23 states would ban abortion after roe is overturned. there's three things to remember. number one, 13 of those states have trigger laws. those are laws on the books that go in effect and ban abortion statewide, pretty soon after roe is overturned. one example, idaho. that state would make performing an abortion a felony 30 the grant states the authority to ban abortion. once it goes into effect, anybody sentenced for performing an abortion could face two to five years in prison. number two, another five states have abortion bans on the books before roe and never were removed. and then it could be a felony to perform an abortion for no exceptions for rape or insist. it never successfully has been repealed. three, other states have stat shoots were blocked by the courts, and there's a strong chance it would be enforceable, if roe is overturned. and abortion rights have been codified, meaning the protections are written into law. even if you do live in a state that has codified abortion protections, and they are home to more than 180 million people, and that includes the south where more than half of the nation's black population lives and one-third of the latino population. >> appreciate you breaking that down for us. she is the anchor, and if roe v. wade is struck down, the black and brown communities could end up bearing the brunt of that. let me start with you, you are one of the only authorization abortion providers in louisiana and what are people telling you there? >> well, i am here in shreveport, louisiana, at one hope medical group for women, and this is a clinic that has been inundated with women from around the region, and the director is losing sleep and i asked her what would you do if women can't come to the clinic. she said she's too worried about the women on the waiting list here, and i put that same question to shannon brewer who is the director of the last-standing abortion clinic in mississippi, and she's overlooking the clinic at the center of the supreme court case. >> we are making preparations to open facilities in safe states, because we are going to try and continue help women with travel and lodging and stuff if they need services. it will not just go away because the people decided that they know what is best for us all of a sudden. >> so the reality on the ground here is that women would be having to drive 12 to 18 hours to get any sort aabortion in the area, and i should also note that both of the women heading up these clinics told me it will disproportionately affect women who are poor and of color, and they said it would be devastating for the entire region if roe v. wade was to be overturned. >> you recently were reporting on abortion activist face a heavy toll if abortion rights are prohibited? >> yeah, providing reproductive for women, and if roe v. wade is overturned, and in speaking with other experts, they say it's going to get worse because all of the barriers we just talked about, money, class and immigration status, they will just become bigger if you need to travel to one state to get care, you may have to travel to two or three states, and the burden becomes bigger for latino women to get care. >> the average split between those that support abortion rights and anti-abortion in the latino community, it's about 50/50, right? what -- how important is it to put that context? >> it's pretty divided. there's a few factors that determine what latinos are going to view in terms of issues, and some is seeing and hearing the stories of women in countries that already dealt with this, with having bans aabortions, and the other is religion. you have this idea that you have to decide if it's a health issue or a moral issue and that comes into play of the polls. >> thank you so much. very much appreciate your time. that's it for this hour. i will be back with more news minutes from now. coming up next, what one senator will do about abortion rights. that and more, next. to help manage hunger and support muscle health. try boost® today. you ever wonder why people are always on their phones? of the house foreign affairs committee talks about his recent meeting with president zelenskyy. overnight, comedian dave chappelle was attacked on stage while performing at a comedy festival in los angeles. we'll bring you the very latest. and we begin this morning with a continuing firestorm over the unprecedented leak of a draft opinion in which a majority of justices on the u.s. supreme court appear ready to overturn the right to an abortion, granted by the roe v. wade decision, nearly 50 years ago. a handful of protesters are still in front of the u.s. supreme court this morning. as they have been since politico first published the draft opinion roughly 36 hours ago. protests were also held last night until cities across the country from new york to chicago to phoenix. the supreme court has confirmed the document published by politico is authentic. but it stressed, this is not the final decision which will likely be issued in late june or early july. chief justice john roberts said in a statement that he has ordered an investigation into the leak which he called a singular and egregious breach of trust and continue to get fierce reaction across the political spectrum with republicans denouncing the leak and accusing liberals of being behind. it. vice president harris blasted republican leaders when she spoke last night to emily's list a group that works to elect democratic candidates who support abortion rights. >> how dare they tell a woman what she can do or not do with her own body. how dare they. how dare they try to stop her from determining her own future. how dare they. try to deny women their rights and their freedoms. >> and with us to start off the coverage this hour, nbc news justice correspondent pete williams, msnbc anchor yasmin vossoughian, and amy weinstein, a legal analyst and nbc news capitol hill correspondent ali vitali. pete, what will the supreme court's investigation into this leak look like? >> i think the supreme court couldn't even answer that question for us. this is not the kind of thing that the marshal normally is in charge of. she's the chief security officer, but she has a lot of options it seems to me. one is she can try to look at the document itself and see if there are clues in that. a sort of hire outside experts that could forensically analyze, that's a possibility. question people in the court, of course. in the past, chief justices upset at leaks have even suggested that people could be polygraphed. whether it would come to that or not, i don't know. i suspect that she's just beginning to get the answer to that question herself, jose. i just think it's going to be a long and difficult thing for her. leak investigations always are. even inside the government. even investigators who are long used to doing leak investigations say that they're very, very difficult, because, of course, the obvious place to go would be to call politico and say, hey, by the way, where did you get that document? and that's obviously not going to happen. so it's very hard to figure out from ground zero exactly how the document got leaked. sometimes, li leakers come forw. maybe that would happen here. >> in fact, what could happen to leaker or leakers once discovered? >> i don't know. i'd be interested to see what your other guests think. i don't know if it's a crime. i should say it's a theft of a government document although in the past, prosecutors are reluctant to bring those cases when the documents are made public. i don't even know if it's a federal crime here, if it's a clerk, then that clerk will undoubtedly be fired. i think that clerk's -- any future in the law is completely foreclosed to them. i think it would destroy their legal career, because this is just about the worst thing that a court employee, certainly a clerk, if it is a clerk, and we don't know, can do. because the court takes its own security, the safety of the ability to have these discussions in a closed setting so seriously. this is a precious resource for the premium court. and to have it squandered like this, there's just no worse offense, i think. >> so, i'm wondering -- pete, thanks, tali, you once clerked for sandra day o'connor. what could that person or persons face? >> well, as pete said, the supreme court has never conducted an investigation like this, and so i'm not sure that they even know yet what that would look like when chief justice roberts said that yesterday. but, you know, i think ultimately, this is about a violation of norms. and about the supreme court's own premium on secrecy. it is not a crime, and if it were a clerk, an employee, as opposed to the justice themselves, really the only consequences is for them to be hired and i imagine to suffer reputational harm and possibly reputational enhancement from folks who think that the leak was the right thing to do under the circumstances. >> tali, take us through us process when a case is organized to to finally when the high court issues its decision and where that stands along the way. >> yeah, the time line, jose, is really important because i think sometimes people think of the supreme court as almost an active debating club between the justices. that's not quite right. the circulation of opinions are really the way principally they talk with each other. so this case was heard in december. after oral argument, during that week, the court would have gotten together in private, just the nine of them, to have a conference. and to give their preliminary views about the case. and a majority would form. and the senior justice in the majority would decide who likes the majority opinion. it's clear that chief justice roberts was not in that group proper likely he would have written the opinion, and not written such a caustic opinion. and then the majority writer works on his draft. and after he circulates it, in this case, justice alito, then concurrences and dissent will start to circulate. and that's really when the negotiations begin. votes can shift. or just as important, and this is really important, the language of an opinion, some of its details might change. there might be, for example, a justice like chief justice roberts who said, i can go along with some of this. but you've got to put a rape and incest exception into this draft. and those negotiations would ensue. so, one theory is that, and i think a very strong theory, is that the leak happened at that moment, when those discussions, through the writing among the justices begin. >> so, just -- and i'm trying to, you know, view this. the fact that it's five to four, right, the fact they say the majority will be writing this. that's improbable that those numbers change, or not, tali? >> it's quite possible that they would change. and you know, everyone is thinking about 5-4 and how to divide 9 into two groups. but we've had really important supreme court decisions over time when you don't get five people who agree on one thing. casey, the decision that affirmed roe, was a plurality opinion, meaning less than nine. right. three justices including my mentor justice o'connor wrote the controlling opinion. the narrowest view would be the controlling view. so there is a possibility that there's concurrence out there. again, i think the best speculations that would be by chief justice roberts. and maybe he would be able to take one of the people from this majority that was formed at the beginning, and make a controlling opinion up to justices. now, that's if you think the leak is about internal jockeying and that was the motivation of the leaker, i think it's also important to think about the fact that the leak might have been meant to send a signal to the outside world. jose, i was struck by the fact that just yesterday, oklahoma signed a new abortion restriction. a so-called heartbeat law. into law. the governor signed. and we're seeing states talk about special sessions. to make new legislation. so, an effect also is to tell a state who don't have an abortion restriction on the books or don't like the restriction they have, maybe they think it's not restrictive enough, that they can get to work, too, in anticipation of the ultimate decision. >> yasmin, protesters have been outside of the supreme court since shortly after this draft opinion was published. you've been able to talk to people on both sides of this debate. what are they telling you? >> reporter: i want to take you on a little bit of a journey, jose, while i'm talking to you. i think it's important to kind of give you the lay of the land as to what was happening here. i was here late last night and this whole area was completely packed. we had hundreds of folks out here protesting to say the least. i think, jose, it's a lot less sparse to be honest. i've spoken to people out here who are here more to reflect on what is to come when it comes to the future of roe v. wade, a precedent in the supreme court that's been in place for half a century known as the law of the land. and it seems that precedent obviously is changing if in fact this decision comes down to drop. some of the words i'm hearing from folks against abortion rights,they feel elated. it's now coming to fruition. for those for abortion rights, they are angry, they are sad, they are shocked. and they don't know what is to come. they want the government. they want the biden administration to do something about the senators that stood there on the steps of scotus just yesterday to enact legislation to codify roe, they want that to happen. let's take a listen, jose to what some of these women said late last night. >> what this court is trying to do, what they will do, will absolutely have a devastating impact. but it's not going to stop abortions from happening. abortions are going to continue happening. >> this is a human right. it's medical care. my nieces, my little cousins, like they don't understand what's happening right now. it's, you know, it's not going to stop abortion, it's just going to stop safe abortions. >> to stand up for what it's right, codify roe v. wade. we don't need to wait until november. this is not something that we need to wait on. it's very clear what the intentions of the supreme court are today. >> reporter: so here's the thing, jose, you can't help but wonder if today is a reflection of what is to come. last night there were hundreds protesting, today, not many. you can help wonder, can republicans use this as momentum for the midterms? will democrats use this as momentum for the midterms to drive folks. we're watching that closely to see if the reversal of roe v. wade will be a major issue in the upcoming election. >> yasmin, just a few yards where you are is the capitol. ali, you're there. what are congress' next steps when it comes to abortion rights? >> reporter: jose, they're trying to keep the momentum building here. yesterday on the steps of the supreme court, on the steps of the senate, we saw 40 democrats saying they're going to demand action in legislative form. you and i know they tried this in february to pass the house version of the women's health protect act. that failed but senate majority leader chuck schumer yesterday in a fiery speech to reporters saying they're going to try again next week. listen. >> every senator now under the real glare of roe v. wade being repealed by the courts is going to have to show which side they're on. and we will find the best way to go forward after that. >> reporter: so, look, last night, jose, they did find a way to start the process of moving forward. and i apologize for the noise towards our back in the capitol here. but on the senate side of this, schumer is going to move forward at some point next week. the open question, though, is what they're actually going to be voting on. it sounds like it's going to be some amended version of the women's health protection act. in talking to senators here this morning, it may include some kind of a carve-out that doesn't punish people who may have objections performing abortions. all of that a live debate on capitol hill. as democrats try to push forward to pass something. the reality is, though, they're probably not going to be passing anything because the numbers have not changed since february. the filibuster is still in place. there is not the senate will to do that, to change it. so they don't have 60 votes here that they would need to overcome the republican filibuster on this issue. which means when they do take that vote next week, jose, it's going nowhere. >> ali vitali on capitol hill. a very busy capitol hill. and tali faraheadian weinstein sand yasmin vossoughian. thank you. joining us the vice chair of the democratic women's caucus. congresswoman, a pleasure to see you. what is your sense of what happens next? >> well, good morning, jose. you know, i think it's really important for women across the america to really take in this moment. our daughters, my daughter, will have fewer rights in america in 2022, than the rights that we got to enjoy. that my generation got to enjoy. and this is the reality that republicans want for women in america. i don't know how many different ways, or how many different times republicans need to say it before all of america understands. but their future, their vision for america does not include women who enjoy economic and productive freedom. and so, to your question, where do we go next? i think, you know, i appreciate the path that the senate democrats are trying to carve out. as you know, the house democrats passed a women's health care protection act so that we could codify roe v. wade. the senate obviously, a narrowly divided senate, my fear is that it will go nowhere. and why? because republicans want to make sure they continue to control women, women's future and women's body. they're not pro-life, jose. they may be forced birth republicans but they're not pro-life. there's nothing pro-life about them. >> let's talk about that, the women's health care protection act because it was passed in the house. it is obviously, it looks like there's nowhere for it to go in the senate. i mean, the senate simply doesn't have the votes to pass the bill to put protections under roe v. wade. into law. so is there a -- i'm just thinking, is there a way to, you know, try it again? a version of women's health care protection act in the house that is different that maybe could look to have a new road in the senate? >> you know, we -- i am open to considering all sorts of options. the challenge, though, is i don't think that anything will get done in the senate, because it is so narrowly divided. but i think we've also got to keep our eyes on november. you know, the american people need to understand that the reason why we're here is because of republicans. you know, i mentioned just briefly, we should not -- we should stop calling republicans pro-life. when you look at what republicans stand for, they -- not a single republican voted with us on paid family and medical leave. so that mamas can be home with their babies after child birth. not a single republican voted with us on access to universal pre-k so that our kids had a great opportunity at an education. not a single republican has voted with us on access to child care so that women could get back into the workforce. so, you know, it's for us to believe that republicans will vote in the senate to protect women's rights to their productive freedom, i want senate democrats to try. we've got to keep fighting to live another day. but ultimately, jose, we have to win elections. and this november, that ballot is a referendum on whether we believe women have a future to economic freedom and dignity. and reproductive freedom and dignity in unites in 2022. >> congresswoman escobar, thank you for being with us. i appreciate it. >> thank you. up next as the war in ukraine continues the european union is proposing pretty aggressive measures to punish russia. we'll be speaking live to congressman gregory meeks, he just got back with meeting with ukraine's president next. place, as we wake up, the president's remarks on the economy in the next hour, the expected interest rate hike could have on your wallet. you're watching "jose diaz-balart reports." ruby's a1c is down with rybelsus®. my a1c wasn't at goal, now i'm down with rybelsus®. mom's a1c is down with rybelsus®. what did you learn on this trip? >> well, i learned that president zelenskyy is focused and has a plan. and is -- he and ukrainian people are fighting for their sovereignty. and they believe, as i believe, they have the will to live. and they are just asking for, as we move into a different phase of attacks by russia. yeah, still at mariupol but as it goes to -- to the donbas area, the different weapons that need to go that can go the distance further to hit some of the russians, as well as what is significantly important today is that the russians have the ports bombarded. so that you cannot get any of the grains or harvests that you need to get out -- that ukraine needs to get out to the rest of the world, that shows don't suffer from hunger. we need to give them the ammunition that's necessary to we can clear those ships out so we can get the grain. we talk about wheat and sunflower oil, et cetera. a lot of that comes from ukraine. and that's one of the reason the prices are going up. but in places like africa and some parts shipped to south america, starvation could be around the corner. so, they want to open that up. and this was mined by the russians also. they want to come in and clear the mines there. so, it's about, of course, the russians invading the sovereignty of the ukrainians, but also humanitarian basis, preventing a starvation around the world. we've got to make sure that we are getting these weapons to them in a timely fashion, because time is of the essence. and that's absolutely clear from our conversation here. and lastly, i would say, the unity that's necessary. there should not be any imports going into russia at all. and we should not be accepting any exports from russia. and that's why, i think, it was a big deal today when we heard from the eu that by early next year, late this year. there will be no oil exports to any of our eu partners. and that's us staying together in unity. and that's something i know that putin didn't count on. >> yeah, the embargo certainly is having an impact. and every day that passes that's involved is certainly more affected. you were talking about unity here in the united states. president biden once again pressed lawmakers to pass the ukrainian aid package. what do you think needs to be the top priority in this bill? >> well, the top priority, of course, is getting the weapons to ukraine so that they can go about defending their sovereignty. and we can prevent the starvation that i'm talking about. and i'm sure that we should be able to do that very well. i know that the appropriations committee is working on the bill as we speak this week. so that when we get back next week, it will be something that we vote on, and pass. and get to the president's desk, so that we can see that those weapons are getting to the ukrainians as quick as possible. and as visit, also, the 82nd air division who is helping to get -- as the weapons are delivered there, to get the weapons to the battlefield. you know, over into ukraine. so, we want to make sure that's done. we know time's of the essence. and so that's why it's extremely important that we pass the $33 billion to get the weapons necessary to the president of ukraine. >> and congressman, you feel confident that the ukrainians will be able to beat the russians? >> reporter: it happened live in the netflix show. dave chappelle was on the show just finished joking that comedians have to have more security at awards. all of a sudden, video taken by fans shows a man on the crowd jumping on the stage, charging chappelle. knocking him to the ground and getting up and trying to run away from chappelle's security team who caught him in the back of the stage and appeared to fight with him for several minutes. police say the attacker was arrested. had hi replica gun with a knife blade inside. chris rock who was there ran up to the microphone and yelled, is that will smith? chappelle joking it was a transman, over attacks that have been called transphobic. the attacker was identified as a 25-year-old named isiah lee. he will be charged with assault with a deadly weapon. he was surrounded by jeering chances and taken to the hospital and booked into jail. jose. >> thank you. we're awaiting president biden's remarks on the economy in the next hour as the federal reserve is expected to announce a raise in interest rates this afternoon. joining us nbc news business and tech correspondent jo ling kent. what does this mean for justice. >> hey, jose, the fed is set to release its biggest rate hike since 2000 to get inflation under control. it's going to be more expensive to take out loans, credit card interest rates. and to cool off the demand from buying things from the pandemic. and the high prices that you see, ideally will come back to earth. this is a delicate balancing act as jerome powell tries to avoid stoking pressures here. it appears that powell has adopted a more aggressive strategy as he hiked the rates that quarter point in march. remember that. and he said it's appropriate in his view to be moving more quickly. we also noted that there's something in the idea of front end load, whatever accommodation he thinks is appropriate. the idea here is to act now, raise rates now, and then re-evaluate as the fed goes along. the fed is expected to do more than raise rates. we want to point out, we'll see another tool being deployed here. reducing the balance sheet with loans and mortgage-backed and the fed injecting that money into the economy and we've the price of borrowing money lower. ideally, if that changes then inflation will cool off. jose, a lot of americans are changing their spending hands right now. according to the nbc news online poles, 6 in 10 shoppers say they've decided not to purchase an item or delaying because they can't afford it. >> thank you very much. appreciate it. up next, the results of last night's big primary night in ohio. steve kornacki is back at the big board to break it down for us next. you're watching "jose diaz-balart reports." e diaz-balart reports. me they don't beat me♪ ♪ ♪ ♪he'd better not take the ring from me.♪ does daily stress leave you feeling out of sync? [ding] e*trade now from morgan stanley. 48 past the hour with all signs pointing to the supreme court set to overturn roe v. wade, many are wondering what happens next. nbc anchor morgan radford joins us to break it down. megan, good morning. assuming the court follows through with the opinion, what are we seeing? >> well, the reality, jose, this could be different depending on where people live. it's so important to remember that the decision would not immediately outlaw abortion everywhere, what it does, it leaves it up to the state and could make a big difference in what this means for you. nbc analysis shows 23 states would ban abortion after roe is overturned. there's three things to remember. number one, 13 of those states have trigger laws. those are laws on the books that go in effect and ban abortion statewide, pretty soon after roe is overturned. one example, idaho. that state would make performing an abortion a felony 30 the grant states the authority to ban abortion. once it goes into effect, anybody sentenced for performing an abortion could face two to five years in prison. number two, another five states have abortion bans on the books before roe and never were removed. and then it could be a felony to perform an abortion for no exceptions for rape or insist. it never successfully has been repealed. three, other states have stat shoots were blocked by the courts, and there's a strong chance it would be enforceable, if roe is overturned. and abortion rights have been codified, meaning the protections are written into law. even if you do live in a state that has codified abortion protections, and they are home to more than 180 million people, and that includes the south where more than half of the nation's black population lives and one-third of the latino population. >> appreciate you breaking that down for us. she is the anchor, and if roe v. wade is struck down, the black and brown communities could end up bearing the brunt of that. let me start with you, you are one of the only authorization abortion providers in louisiana and what are people telling you there? >> well, i am here in shreveport, louisiana, at one hope medical group for women, and this is a clinic that has been inundated with women from around the region, and the director is losing sleep and i asked her what would you do if women can't come to the clinic. she said she's too worried about the women on the waiting list here, and i put that same question to shannon brewer who is the director of the last-standing abortion clinic in mississippi, and she's overlooking the clinic at the center of the supreme court case. >> we are making preparations to open facilities in safe states, because we are going to try and continue help women with travel and lodging and stuff if they need services. it will not just go away because the people decided that they know what is best for us all of a sudden. >> so the reality on the ground here is that women would be having to drive 12 to 18 hours to get any sort aabortion in the area, and i should also note that both of the women heading up these clinics told me it will disproportionately affect women who are poor and of color, and they said it would be devastating for the entire region if roe v. wade was to be overturned. >> you recently were reporting on abortion activist face a heavy toll if abortion rights are prohibited? >> yeah, providing reproductive for women, and if roe v. wade is overturned, and in speaking with other experts, they say it's going to get worse because all of the barriers we just talked about, money, class and immigration status, they will just become bigger if you need to travel to one state to get care, you may have to travel to two or three states, and the burden becomes bigger for latino women to get care. >> the average split between those that support abortion rights and anti-abortion in the latino community, it's about 50/50, right?
