tonight, the efforts on the way to fight back. we will start this hour for you with a ukrainian commander confirming right now that about 20 women and children successfully made it out of mariupol's embattled steel plant. united nations have been leading efforts to rescue up to 8000 civilians who have been bunkering underneath that berry structure. russian troops have destroyed mariupol, where an estimated 100,000 ukrainians remain. russia's destruction of the port city is part of the strategy to overtake the donbas region. but, the pentagon says that fierce pushback from the ukrainian troops have set russia several days behind schedule. that is rj thing too heavy weapons that the west has been sending to ukraine in recent days. president biden requested for even more military aid to be sent. earlier this week, he asked congress to authorize 33 billion dollars of artillery, anti tank weapons and funds for economic and humanitarian relief. meanwhile, actress angelina jolie was spotted in ukraine today. she is in lviv visiting children injured by attacks in kramatorsk. nbc correspondent, cal perry, is live for us in kyiv. cal, the most important development tonight at this hour, certainly, what appears to be collaboration that is working on both sides there in mariupol? what do you know? >> absolutely, small steps for certain, but stepped in the right direction. at least 20 civilians making it out of the city. probably, not surprisingly, the russians and ukrainians disagreeing on actually how it came about. the russians say that they facilitate and permitted to 25 civilians. ukrainians making it clear to nbc news that it was in fact the red cross that facilitated the evacuation. it was 20 civilians. either way, you are looking there a video from underneath that still works factory, the situation there remains, in the word of officials, hell. you have a leasing such a civilians bunker down there. some are wounded. you have some ukrainian marines wounded. this is a place that is running out of food, running out of water, that has limited medical supplies. you get a picture of how bleak the situation is there. the country is watching the situation, as they have now for weeks because we have been in that besieged place now for a number of weeks. fighting heavy not just there today, across the country as well. in the east part of the country, at least four people were killed, eight wounded in shelling that took place in 36 different locations. russia is that bring up its attacks in the east. when you talk to government officials here, they will tell you that the heroic defense of the steel factory in mariupol is preventing russian troops from actually redeploying in the eastern part of the country. it is something that the military is planning to hear as a victory, even though these pictures, as you have been looking at over the past few weeks, are certainly devastating. >> cal, thanks as always. nbc's cal perry live for us there in ukraine, appreciate it so much. the war in ukraine struck home close for one marine who was killed fighting alongside the ukraine military. our reporter with our new york station has the details for us. >> an outpouring of grief for 22-year-old willie joseph cancel, the former u.s. marine who fought and died alongside ukrainian forces. >> it paints my heart because i am a former marine. i did 20 years in the marine corps. i know he wanted to serve for freedom, but he paid the ultimate sacrifice, and it is sad to hear. >> will these mother first confirmed the death to cnn, saying that he was killed on monday while working with the private military contractor. the news, a devastating blow for his home's town of orange county, new york, which once served as a law enforcement firefighter. >> a lot of kids his age do not understand what they want to do in life. he seemed to have figured it out at a young age. >> the county executive writing in part that we will never forget will ease privy and sacrifice. his wife, brittani, telling fox news that he went there wanted to help people. he had always felt that was his main mission in life. adding that they have a seven-month-year-old son who will not be without a father. according to family, willie lived and worked in tennessee where he was a correctional officer. he inspired to pursue a career in law enforcement. he joined the marine corps in 2017 as an infantry riflemen. in 2020, a military judge convicted him of violating a lawful general order, he was given a bad conduct arch. the state department said they were closely monitoring the situation surrounding his death. >> we are right now in the process of reaching out to his family to learn more details. i would be remiss if i did not take this opportunity to reiterate what we have said for weeks now, americans should not travel to ukraine. it is inherently dangerous. >> despite the warning, thousands of foreign fighters, including americans, have traveled to support ukraine, putting their lives on the line for a brutal battle nearing a third month. >> thinks they're two w and bc's gabrielle for that support. i want to bring in the former ambassador to ukraine, john herbst, he is the senior director of the atlantic council at the eurasia center. you see these stories like willis, what does that say about your belief here as our commitment as america to what is happening in ukraine. whether it is informal or formal? again, president biden recommitting support military and otherwise. >> look, a very large majority of american people recognize that moscow is pursuing a brutal war designed to not just subjugate ukraine but step out the whole nature of ukrainian people. so, individual american see this as something that they want to stop. of course, the u.s. government recognizes that we have a vital national interests in defeating russian aggression in ukraine before comes to our nato allies, who we have a duty to send a sort of just a fight. >> ambassador, we just heard from cal perry about the developments and variable, potentially from what we are hearing, ukrainian commander, at least 20 people were able to escape to still play mariupol. what does that tell you in terms of where we are at right now? >> this is a very good thing for the 20 people. i am delighted to see it. we still know that there are two, close to 3000 people people, 2000 soldiers, maybe 980 civilians now, in that steel plant. they still are going on a savage russian attack. it would be nice at the red cross are able to expedite the evacuation of other civilians and maybe the military. we will see if that happens. >> if you look at the city by city breakdown of where the conflict is going, we seem to still be in the going forth, going back a little, one step forward, one step back. here is that map of the land bridge that we have been talking about for several weeks. it does not seem to be growing. of course, a map does not say what is happening on the ground. what do you make of where we are at in the conflict? >> what all this suggest is that the second, new russian offensive is not going very well. but, of course, it is still very early. they can make incremental gains, they can make more. >> we have also seen some decisions made by vladimir putin, this has to do with utilities and oil and gas, he has decided to cut it off to a couple of bordering countries, vice versa. there have been some moves for independence for energy from these border countries. is this going to work in either side to make either vladimir putin thing twice, or for that matter, nato. it does not appear. >> this is clearly a losing proposition for putin. first, cutting off oil and gas supplies to poland and bulgaria, europe has already been reducing its dependence on russian oil and gas. this just confirms that russia is not a reliable surprise or. impossible carrying, the bulgarians are rather soft on putin aggression. here they are, punishing the softies of bulgaria, which will undermine, this is a good thing, the advocates of sauce policy towards russia and bulgaria. >> ambassador, thank you so much for a time. and bassett or john herbst, appreciate it. next, new details about the grand jury investigation into the former president in new york city. what it might say about whether or not donald trump could face indictment. later for you, prosecutors in michigan now considering the case against the police officer who shot and killed patrick lyoya. what we have learned about that case? >> i don't recall. >> who are denying you today, you just don't remember? >> i don't remember. >> meanwhile, leaked audio, as house gop leadership, horrified, by gates comments after the capitol attack. minority whip, steve scalise, even asking if gates threats against fellow republicans were illegal. all of this, as the january six committee, shifts its focus to sitting lawmakers, to request testimony from republicans, and both chambers. joining us now, msnbc legal analyst, and civil rights attorney, maya wylie. and, to a, michelle washington correspondent for the atlanta journal-constitution. to, let's start with you on this. what do you make of what we are hearing right now, in ohio? what are the january 6th revelations we are hearing right now? we still have eight more, potential hearings, with -- on the hill soon. what do you make of that? >> well, what i make of it is that the members of the january 6th committee, and i would say, democrats in general, think that there is a lot that the american public still does not know about january 6th. they think that there is still a lot of dots to be connected, regarding january 6th, and the factors, they believe, contributed to the violence that day. so, it is clear, the committee, and democrats, are not going to let it go away, even though it may be something that the republicans you have mentioned want to put it in a different light. the republicans are not going to let them. >> those eight new hearings in front of us, we continue to do, day today, maya, and get more information about what was said what, denials contradict that along the way. in addition to that, let me throw one more log on the fire. politico saying, a former trump attorney, eastman, you might have heard about this, with 10,000 emails we might get, that involve conversations with the former president. there's a lot of stuff still coming out. >> a lot of stuff, still coming out. it is also true, we have been seeing this picture come into sharper, and sharper relief, every single week. what we already know, is what we are talking about, which is what is in the public sphere. not all evidence of the committee has been shown, or talked about. really, it paints a picture of donald trump, actively, looking for a path to overturn, or prevent the electoral college votes from being counted, or certified. picking, and choosing, who he listens to. we already know, many lawyers, including his department of justice lawyers as well as mike pence's counsel, into's advisers in the white house are saying you can't do this. well, john eastman was the architect of the strategy, trying to steal, overturn the election, steal it from joe biden. and those exchanges of communications that will include the president, possibly mark meadows, and other members of congress, are going to be extremely telling about the state of mind of these elected leaders. so, one of the critical things we have to understand, to what degree, are our elected leaders, including the former president himself, willing to, essentially, do what it appears he did, which is to corruptly interfere with a constitutional obligation of congress to steal an election? >> staying on that idea of the state of mind of the republican party, and let's focus a little further down into this team. it is on the way into the conversation. based on the candidates on the right, and who is saying i support, or will not reject, president trump, the former presidents move to say, january 6th, is not what the left is saying. then, there are those who rejected on the right. only one candidate, actually, matt dolan, who seems to trend better, by rejecting that donald trump narrative of what january six this. what is happening in ohio? so, what is happening in ohio, is what is happening in a lot of other states, including georgia, and to get president trump's endorsement the key, if not the only, or the major deciding factor, is if you are willing to continue to support the big lie, that the 2020 election was stolen from him. so, in all of these races, up and down the ballot, in so many states, president trump has endorsed republican candidates, who, even, a year and a half later, falsely, are saying that the election was stolen. so, that is affecting all of these primaries. quite frankly, it is affecting the future of the republican party, in many states. and, depending on if these trump endorsed candidates win, it could affect how elections are run in many states. but, it is also a test of whether president trump's endorsement can swing some of these hotly contested, republican primaries. there are, for example, in georgia, former senator david perdue, who is trailing incumbent governor, brian kemp. they -- david perdue, supporting the big lie, brian kemp, refusing to do so. we see that again in ohio, with that senate race. we know j.d. vance is invoked coursed by president trump, and, again, he, along with representative green, representative gates, representative factions, and they're enjoying election information, but this would not guarantee that it would be enough to get voters to support the candidate from the primary. >> téa, thank you, maya, you are staying with us, we'll talk to you soon. let's move to this now. tonight, a twofold return of a deede tradition. the white house correspondents dinner, is back. while it was sidelined by covid, tonight is the return of a sitting president to the dais. donald trump, breaking with presidents before him, did join the annual dinner, but that changes tonight. president biden will be there, not just a tossed friendly to exert reporters, but to reinforce an american value, the freedom of the press. and we see julia just, our washington d.c. force, with the latest on this busy, d.c. night. and, it is busy already. what are you seeing? >> i am here, at the red carpet, we have quite a fun guest here. >> hey! i can't believe i get to be here, with all of these journalists, with the president, with the people i work with, who have have not seen face to face. let me kiss you. it's been so long. it's just so awesome to be here. >> we have hollywood's biggest stars, nbc's biggest stars. everyone seems to be so excited, to be back in the same place covid protocols are in play with, president biden, being here tonight, he's gonna give a speech, and it's a tough act. what do you think you will say? >> everyone has been covid tested before we came in, you need to take the test within the last 24 hours. while we don't know, specifically, what we hear from the president, i think that there will be a lot of gratitude, and unity, across the board. also, all of us have colleagues in ukraine. many colleagues have been there for the last nine weeks. journalism is so important. we have people, on the other side of the world, denying that there's a war going on. so, the fact that we have journalists chronicling all of this, is so important. to be here, this weekend, yes, it's awesome to be dressed up, to be at a party, but it's great to be here to support one another, and to have an administration that respects what we do. >> there are no stranger to the white house correspondents dinner. how does it feel, this year, after not having it for two years? >> yes. we need an executive order, because congress could not get voting protections. this is a fundamental right in this country. it is our right to participate in our democracy. yet, we could not get bipartisan support. there was over two democratic senators, as you know, who sat out, and did not support voting rights protections. now, it is time for the president to step up. what we are seeing, and in this country, across the state, is an effort, a concerted effort, to make it harder to vote, and especially voters of color. >> dig into the number that i just mentioned, which is the proof of voter fraud, small, as the numbers i just quoted. and, the response here, potentially, coming from florida's governor saying, hey, it's bigger than that. we need an election police unit. >> this is a continuation of the big lie. so, really, he is just peddling lies, and disinformation, because voter fraud is, evident potentially, very scant. they said, they are more likely to be struck by lightning, then they are to find a prosecutable piece of voter fraud. that is the truth. we don't need an additional police force that looks into this. also, there are laws, on the books, already, to prosecute voter fraud. so, we know that this is peddling lies, him playing to his base, who do not believe the outcome of the last election, and, also, that this is an effort to intimidate. we just won a very important voting rights case in florida. then, the governor turns right around, and does what the court said they should not do, which is, to engage in voter suppression that targets black voters. so, this is nothing new, for those who want to suppress the vote. turning to the police says, always been, an effort to intimidate voters. that is what governor desantis is doing, right now. >> part of the conversation, there judith, is rank choice. as a voter you can say, i like number one, number two, and number three. conservatives are saying, who are critical of this, that the approach favors progressives. discuss that? at walmart, we're working on it, every day. tonight, advocates demand answers on the police killing of a man, in grand rapids michigan. on tuesday, dozens of protesters, shutting down the city commission meeting, seeking justice for the death of 26-year-old, patrick. now, this body camera footage from april 4th, showing the deadly encounter, after a traffic stop. moments later, he ran away, leading to a struggle with the officer. officer chris, sure, then shooting him in the back of the head, after yelling for him to let go of his taser. the county prosecutor, now reviewing the investigation by michigan state police, to see if the officer will now face charges. judith, my, outback to discuss the latest in the case. maya, as you've been looking at the details come in, advocates call for transparency, since this happened on april 4th. but then, we get into the details. three weeks for the police to release the officer's name. just one of those. why three weeks? why are we still having the same conversations about transparency, and accountability, with cases like this? nearly two years after the death of george floyd? >> sadly, the problem has been that we do not have sufficient will to, actually, change our accountability structure. meaning, for example, as we know, when they tried to win a federal legislation, that would create more accountability. it was going to be so brutally murdered, and a long, and painful video. i think the thing that should concern us, in particular here, is remember, excessive force, deadly force. it's deadly force, it becomes excessive, when you don't have reason to use it. you are not supposed to use deadly force, unless the person that you have reason to believe the person is dangerous, in the process of doing something, that is going to be a danger to the officer, and others. or, may cause a danger to someone, inflict harm, as they are fleeing. the only thing that is going on here, is a routine traffic stop. there is no indication that we have, in any public record, that mr. patrick was engaged in any serious time. was any threat, had any weapon, so, the only thing that we should see is that there is a police officer, on top of him, when he is faced down, and he is shot in the back of the head. that is the public record. that cries out for a very different kind of accountability. that accountability, also, has to start with why that kind of traffic stop turned into that kind of incident to begin with. >> judith, as maya digs into some more details around this very case, and we'll go back to the very body camera footage that i was mentioning, moments ago, that it took several weeks for us to understand even the name, it's different, based on the cases that we've seen in recent years. it could be weeks, it could be months, before we even get these kinds of details. now, when you look at the patchwork of the way that these pieces of data, and evidence, are released to the public, it is patchwork. how do we get around that, so that there is transparency, in these cases, that seem to have so much difficulty in consistency, and with the republic going to, watch and understand? >> this is, to maya's point, around a lack of accountability. we continue to see places where the police departments, and the police officers, have an incredible amount of protections. some of those protections come in their policing contracts, where it's not just about benefits, or conditions of employment, but also, to get protections, that allow for this kind of evidence to not be produced. but then, also, one of the things that is very troubling about what is happening in grand rapids, is the community calls for a special prosecutor, as well. we know, time, and again, that the local prosecutor, typically, has an interdependent relationship with the police. therefore, it is not, always, unbiased when it comes to prosecuting police officers. then, the last thing i want to mention about this particular case, is talking about routine traffic stops. unfortunately, the so-called, routine traffic stops, are so deadly for black and brown people. so, we need to think of a different way. so many people are stopped, because of their race, and then, because there are stopped, they are victims of misconduct, brutality, and sometimes, deadly use of force. so, was that stop really necessary? moratorium on deportations, announced a one on medical, so you ended agreements with northern triangle countries, you stop building the wall, and in 25 days, title 42 goes away. do you think that is encouraging people to come to the border? >> congressman, the increase at the border is the result of a number of factors, and it is a regional phenomenon. >> a number of factors, a messy about those specific factors, your actor tunes, your policies. >> i do not. >> with me now, jasmine, a national political reporter for the new york times. you know, this language we hear, jasmine, we have seen it every two years, every four years, every eight years, the idea of a comprehensive, immigration reform package, seeming so far away from the state, here, in 2022. what do you see in the language that is being used, by politicians, who are, and now, looking at the midterms, right now? >> what i am hearing is, really, this newer strain. it is these two issues, that are emerging. illegal immigration, and this belief in lies, that the 2020 election is stolen from president trump. you are hearing more echoes with, this grand replacement theory, this conspiracy theory, that black and brown immigrants are coming into the country to replace white people. you are hearing echoes -- not even echoes, you are hearing this rhetoric of invasion. you hear these very old beliefs that, to confer this old language, that conflates illegal immigration in crime, but you also get this new restrain, which is that unauthorized immigrants are crossing the border, to vote, specifically, to vote democrat. so, as you said, it's in this basis that voter fraud is extremely rare. but, also, the data that we do have, what immigrants do vote, when we saw in the last election, is in cities where there were larger immigrant populations, it was actually a turn to the right. is wrong and more ways than one. >> the data is not there, and both conflation's you bring up. we were mentoring it earlier in today's our. so, on top of that, as this energy, and thematic of bringing these two ideas together, there is, often, and opposite reaction, as you have written, that it may mobilize those who say, no, this is wrong, it may get out the vote. how may that happen? >> yes. some republican consultants have warned, this could mobilize the other side. that it will not work in the general election. but, so far, republicans see again in perpetrating, and in amplifying this language. democrats, themselves, are very divided on that issue. you have seen a push back with, concerted pushback from democrats, on this narrative. you are seeing at, when you take a look, it adds in 18 states, which is just analyzing the rhetoric, and it is from unsecure elections, to unsecured borders, and you get the company coming, over, and over, and no pushback on the other side? it then becomes much more difficult to counter that narrative. >> how are those who, are going up against these candidates that are taking on this narrative, fighting back against it? are they addressing the wrong next, or the incorrectness, of what the statements are being made by these candidates? are they fighting back those who are against these particular candidates in the primaries? >> to some extent. i am not hearing as much as some people want, especially as immigrant advocates would like to hear more about, and on the ground is. ohio is a state, and needs workers, and relies on immigrant workers, and many immigrant workers are coming into this state, actual, you have work visas, or are here illegally. even immigrants, who are coming in, which is another -- another false statement, which is, that immigrants have a legal right to claim asylum. there is this false notion, it is just open borders, and people wander in. i can hear it from voters, all the time, saying that there are boatloads of hispanics arriving, or dropping off children on the streets. i was talking to immigrant advocates and they say, this is not the case. >> on that note, how does title 42 work into this conversation, which is already heated, as his?
