democrats a blueprint for beating that right-wing culture war attacks? >> hate will only win if people like me standby and let it happen. all in starts right now. good evening, everyone, from new york, i'm in for chris hayes this evening. and it has been nearly two months since russia launched this unprovoked war on ukraine. and russian troops are bearing down on the eastern part of the country an area known as the donbas. they are healing their new assault with artillery and missile strikes all along the 300 mile eastern front. in the utterly devastated city of mariupol, the ukrainian government estimates the death toll now stands at more than 20,000. let that sink in for a moment. the commander of the last remaining ukrainian troops in that city, hold up in a steel -- with hundreds of troops and civilians is literally begging the world for help. >> [speaking foreign language] today ukraine's deputy prime minister said that a planned humanitarian corridor to evacuate civilians out of mariupol did not work as planned, blaming the russian government for its disorganization and negligence. according to the united nations, more than 5 million refugees have now fled the violence in ukraine and ukrainian president zelenskyy is asking the united states to do more to punish russia. during a recent phone call with president joe biden, zelenskyy at one point reportedly requested that the united states designate russia as a state sponsor of terrorism. that is a classification that is currently reserved for just four countries. north korea, cuba, iran and syria. the washington post is reporting that biden did not commit to any specific actions on that call. but that he did tell zelenskyy who is willing to explore a range of proposals to exert greater pressure on moscow. and today russian president vladimir putin ratcheted up tensions even further, with a nuclear capable missile test. saying that the new weapon, quote, will force all who are trying to threaten our country in the heat of a frenzied aggressive rhetoric, to think twice. and amidst all of the threats and the devastation on the ground that has taken place in ukraine, ukrainians and russians are losing their lives, and there is a real, fundamental question that i think is actually not being discussed enough. about how we should be responding to all of this and whether our involvement, the united states involvement and the west's, it's actually helping the ukrainians or not. military continues to pour into ukraine from all of the world, though it has sparked fierce debate in some countries. take, for example, germany. germany had pledged more than a billion dollars in military aid to ukraine. but its government is divided over whether to send heavy weapons, including artillery and tanks. here in the u.s. the biden administration and -- sent another $800 million, a pledge to do that. that's in addition to the 800 million dollar packet. and that would bring the total u.s. military aid to ukraine since the start of the war well above three billion dollars. in just two months, we have pledged about the same amount of military aid to ukraine as we did to israel. of course, israel is the largest recipient of u.s. military aid and that would be the entire year of 2020. there has been practically no debate over sending it in congress. of course, the ukrainian people are being terrorized. and of course they need help. and i have every right to defend themselves by any means necessary. but as the death continues to pile up in ukraine. and beating the drums at war. and trying to make this awful conflict and. ? the president zelenskyy has indicated multiple times he's willing to come to the negotiating table. . and he said that they have to talk. >> they can send millions bergeron. >> that is why one has to strike a balance. whether you want to or not. we must protect their lives, we cannot give up our territory and there must be some dialogue. >> at the end of last month there was optimism when negotiators met in istanbul. and russia said it would drastically reduce activity in the capital region. and unfortunately, there has not been any real progress since then. but here is the thing. we continue to send more and more weapons. and our own national security apparatus is regularly speaking out in a way that really sounds like it is encouraging war. just listen to what former secretary defense leon pickett told my colleague, andrea mitchell told. -- i >> think the most important mission right now is to do whatever is necessary to provide the weapons to the ukrainians, so that they can stop the russian advance in the donbas. if they can successfully saw that advance, then that will be another defeat for the russians. and a real signal to putin that it is time to leave. i think that that is the primary mission right now. >> the primary mission for the united states should be doing what is best for the ukrainian people, not running some sort of proxy war against vladimir putin. and the best thing for the ukrainian people, who are being slaughtered and terrorized and forced to flee their homelands, is to bring this war to an end. jason blazakis is the former designator -- and now professor at the middleburry institute of international studies at monterey, thank you for making time to us. >> thank you for having me. >> should the united states be doing more to bring the war to an end? what could or should we be doing at this point? because i could be wrong but the way that i see it is this binary choice, whereby if we continue to send more weapons to the ukrainians, to defend themselves, it may not bring about a peaceful end to the war. it may defeat the russians. but it may come at a great cost for ukrainians who are suffering and losing cities analyzed by the thousands. >> well, we can expand what we are doing vis-à-vis sanctions. we have not used every sanction tool at this point. and one of the arguments i made back in march, in the l.a. times, was the possibility of the russian federation being added to the state sponsor of terrorism list, further restricting the flow of assets to the russian federation. from my perspective, the russian federation meet the criteria. it's a country that has engaged in assassinations overseas. obviously, what it is doing in ukraine is terrorizing ukrainians every day. and listing itself is going to have two significant action. it is time for the biden administration to take into account zelenskyy's recent request to add the russian federation to the state sponsor list. that's one thing we can do. that does not up the ante and context of military, of the kinetic support. c >> as i was mentioning there n the setup, the amount of military aid that we have sand has been basically gone through without so much a debate in congress. is it the best use of our energy and resources to be sending this much military aid to ukraine at this moment in this war? >> i think we are at an inflection point in the eastern portion of ukraine. i think the donbas situation is becoming increasingly worse and if the united states does not continue its support i think ukrainian efforts are going to collapse in eastern ukraine. so, the donbas intuition, i think, is requiring a plus up of u.s. military support to the region. that means we have to be selective about what we provide. i think the ukrainians need additional s-300 an s-400 defense systems. there are soviet-era tanks that could be helpful in the context of the eastern ukrainian search by the russians as well, these could be provided to the eu cranium's as an addition to the javelins and other items we provided before. so, there are things we should do, we are at an inflection point and i think it is important that the international community in the united states inflict more pain on the russian federation for its illegal invasion in ukraine. >> we have heard people warn of world war iii, we have people saying that world war iii has officially started or has actually started. some are saying that we are fighting a potentially dangerous proxy war with russia that is currently underway. are we fighting a proxy war with russia? one of the ramifications of us being so deliberate and open about the fact that we are providing these arms? even though, as we saw last week, russia said in a cable to washington warning that some of the weapons we are sending risks elevating or escalating tensions? >> i think, let's be clear -- the russian federation is using proxies right now in ukraine. they're using paramilitary groups like the wagner group, to carry out a operations. they are using the russian imperial movement, a white supremacist group to carry out operations in the donbas region as well. so, the russians are using proxies right now and we cannot ignore that. i think that in the context of the u.s. response we have to take that into account. that is another reason why i think that the state sponsor of terrorism listing is appropriate. it is a non military tool that we can use right now to do economic harm to the russian federation. because it would have real world consequences. one example of a consequences that it can expand the secondary sanctions that the u.s. government can place on countries, meaning providing economic support to the russian federation. countries like china, for instance, may think twice about providing economic support to the russian federation. i would also add a reputation all events for businesses -- private multinational companies -- to continue their business and do their business operations in the russian federation would also, i think, put a lot of state reputations at risk and lead to more shuttering of businesses in the russian federation. i think we have hundreds of businesses that have decided to stop there are still hundreds who can make the decision to leave. i think the state sponsor of terrorism tool would help them make that decision. >> let me get your thoughts, jason, on negotiations here for a moment. as i was saying, i was questioning whether the u.s. is doing enough to encourage negotiations. but the truth of the matter is that vladimir putin does not seem willing or capable of negotiating at this point. and perhaps he is just going through the motions. do you think that it is even possible that vladimir putin would be willing to negotiate at this point? and why with those changes potentially prevent another trump-like scenario that we saw in january six from happening again? >> well, as the committee is doing its work, and they've interviewed more than 850 witnesses, they are increasingly getting information about the extent to which the insurrection it could have played a role in january 6th. we know that during 2020, president trump several times wanted to use the act to put down protests. and he -- used it on the southern border, to deploy active duty military in the united states. but as the events of january six were getting close, extremist groups were encouraging president trump to use the act to maintain power, to send out troops to -- and this was such a cause for alarm that former defense secretary even wrote a letter about the election, general mark milley was concerned about. stewart rhodes, leader of the [inaudible] road a letter calling for the insurrection act to be used. so, now it is under discussion is whether the act should be altered to prevent future presidents from doing what these extremists want done. and that is -- the military to deal with an election. so, a couple of changes are under discussion. one would be having congress authorize the invocation of the insurrection act, at least consult on it. another would-be to define the terms in specific ways that a president cannot just site for any reason. there is also discussion of lengthening the period of when a president could deploy the military. right now it has no stop date in the insurrection act, if it's put into effect. so, there are a number of changes that could come out of this. >> so, even if they agree, luke, on the recommendation, if the committee does, ultimately any meaningful change would have to pass congress. do they think that there is a political path they are? because ultimately it would require getting approval not just through the house but ultimately the senate. and obviously, the window on that is counting down ahead of the midterms, if one is to assume that the democrats might not, at the very least, control the house after the midterm elections. >> yes. i would think that the politics of this would be difficult, as it rolls into next year. this committee recommendations will be issued by republicans and endorsed by democrats. many people do believe that the republicans will take over the house next year. it is possible that things can change. politics can change by the month. and one of the goals of the committee is to bring out as much evidence on this, on this attempted takeover of the 2020 election and the overturning of the 2020 election. and to inform the public about how alarming that was. and potentially, that could have some effects when the report comes out and when the findings are made public. but right now it does look very much like republicans have all the advantages to bring back their party to the house. and they would see that the committee's recommendations are unlikely to be passed then. >> let me ask you not just about the insurrection act to prevent another january six but what do we have to do -- and i know that you have reported on this -- on potential changes to the electoral count act? what recommendations should we expect they are to prevent the situation from november 20th getting -- excuse, me from november 7th, -- getting to what we saw on january 6th, 2020. >> one of the things that trump tried with the electoral count act with the idea that the vice president could throw out the votes of states, if they were impeded slates of electors. so, one thing to make clear is that the vice president does not have that authority. of course, the whole [inaudible] that -- was trying to overturn the election. and if that was not even on the table, if that wasn't the idea in his head, that crowd may not have been there. or at least may not have had that talking point to go and -- mike pence. there are some other changes as well, about objections that make it much more difficult for single members of congress to stand up and object. and to try to throw out people from single states. so, they do have a number of options there. there is also the senate, a group of senators led by susan collins is working on this as well. and they are probably going to have recommendations. >> all right, luke broadwater, thank you, it is always a pleasure to see you. we greatly appreciate your insights. >> thank you. >> coming up next, the legal fight happening in george's disqualification of marjorie taylor greene from seeking reelection in part of the case will require the congresswoman to actually testify under oath about january 6th. we are going to talk to the lawyer who will lead that question right after this. they are going to allow the press in the courtroom, they are going to allow the whole thing to be videoed live, allowed to go anywhere in the world. they want to -- and you know what that is going to look like. ook like we hit the bike trails every weekend shinges doesn't care. i grow all my own vegetables shingles doesn't care. we've still got the best moves you've ever seen good for you, but shingles doesn't care. because 1 in 3 people will get shingles, you need protection. but, no matter how healthy you feel, your immune system declines as you age increasing your risk for getting shingles. so, what can protect you? [splash] [disappointed] broooo... good thing you saved on the trip! priceline. every trip is a big deal. just finished with our meetings here at the white house this afternoon. we had a great planning session for january 6th objection. we are not going to let this election be stolen by joe biden and the democrats. president trump won by a landslide. call your house reps! call your senators from your states. we have got to make sure that they are on board and we already have a lot of people engage. >> all right. so we know that congresswoman marjorie taylor greene of georgia was among the republican lawmakers who are instrumental in trying to prevent congress from certifying joe biden's election as president biden, president of the united states, on january 6th. we all know that. you heard it right there. and last month, a group called free speech for people filed a complaint with georgia secretary of state, arguing that because of the actions of marjorie taylor greene, she is constitutionally qualified disqualified from congressional office and ineligible to run as a candid under section three of the 14th amendment. the group asked secretary of state brad raffensperger to call a hearing to determine whether representative green is eligible for office and if it is determined that she is not eligible, to withhold her name from the ballot or even withhold strike her name for the ballot if the ballots have been printed. in response, marjorie taylor greene filed a lawsuit, trying to block the complaint from being considered. but on monday, a federal judge actually ruled that the group can proceed and that's a state administrative court and -- scheduled to hear on friday. marjorie taylor greene is clearly rattled by the judge's ruling and you can hear this in her appearance on oan. >> my cases in the administrative law court. and they are actually putting me on the witness stand on friday. i am the first republican member of congress that is going to be forced to take a witness stand and be forced to defend myself against a lie and something that i never did. so, this is a precedent that is a very dangerous precedent. i cannot believe that i am being forced to do this. i cannot believe that this judge has not thrown this case out. and said it for what it is, it's nothing but a big, funded scam for the democrats trying to control our elections. >> and as she said right there, on friday, marjorie taylor greene is expected to go under oath to answer questions, live in court. ron fein is the legal director of free speech for people and police council on this complaint, meaning he's actually going to be the one in that courtroom, questioning congresswoman greene at the hearing on friday. and he joins me now. it is great to have you with us, ron, i greatly appreciate your time. what do you plan to ask congresswoman greene? what's the information that you want to get out of her? >> well, thank you for having me, ron. as you know, i cannot give a sneak preview of the questions that we are going to ask a hostile witness. but even before we ask a single question, we know for things already. one is that she called for nancy pelosi and joe biden to be executed for treason. she told her followers that they could not allow a peaceful transfer of power. she worked with the planners of some of the events of january 6th. and then the day before the attack, she signal to her followers, a code word, meant to storm federal buildings and supposedly overthrow tyrants. so, we are going to ask her about all of that and more. >> in her dismissal filing, she argued that the 14th amendments disqualification clause only applied to members of the confederacy. what would you say to that? what would your response be to that claim, that she has made? >> there was a debate about that in the year 1866, when they were trying to decide how to write the 14th amendment and some people said that. they lost that debate and the 14th amendment was written in a way that applies for all time and for all insurrections, in both congress and in the supreme court, repeatedly emphasizing that the disqualification clause is a live and viable part of our constitution. >> you are probably aware, sir, that a judge, in a similar case in north carolina, actually filed against madison cawthorn, was blocked. basically, they blocked the challenge to his eligibility based on the same argument that greene is trying to use. are you at all concerned that this effort could be derailed by a higher court? you see similarities or differences between what happened in the madison cawthorn legal challenge and what you are trying to do with marjorie taylor greene? >> madison cawthorn somehow got a federal judge in north carolina to say that an 1872 congressional amnesty for ex confederates applies to madison cawthorn. and any future insurrectionists. that ruling is so bizarre that not one outside expert has stood up to defend it. and the court of appeals has agreed to fast-track our peel. and furthermore, win them greene try to use that exact same argument in federal court in georgia, the judge said that both she and north carolina's judge were wrong. so, marjorie taylor greene is going to have to answer questions on friday. >> and there have been a pair of law professors, i understand, ron, that published an op-ed in the new york times, arguing that section three is not self executing. that congress must establish or at least authorize the process that affords accused insurrectionists an opportunity to contest the allegations brought against them. what do you make of that theory? that legal theory? >> they quoted an old case. and i wished they had supplied more context. which is, that that case came from a period that was quirky, during reconstruction, when virginia was under federal military occupation and when it had no state government whatsoever. so, much like today, sometimes the district of columbia cannot do something and that requires congress to take action. in those days, in virginia, if anyone was going to pass a law, it had to be congress because there literally was no state government. that is a weird period of time. it is over. and in the years after the civil war, other southern states like north carolina and louisiana, they are courts applied section 32 x confederates and there is no reason that georgia cannot do that today. >> if the hearing does not agree with you, is that it? or do you have any other recourse? >> if the judge fairly and impartially applies the facts in the law, then he will agree with us that marjorie taylor greene is disqualified from public office, because of her eating and facilitating january 6th insurrection. but if he does not, then we are prepared to appeal and we will take it all the way. >> and if she does and up -- if it does end up going your way, do you think that this sets a precedent for other members of congress that you might have your sights on? here to answer that question and more is symone sanders, former chief spokes person for kamala harris, former senior adviser to the biden campaign and host of the simone show. and of the progressive think tank new consensus, -- . simone, i will start with you, it does -- understand a real danger here for the party come november? and is their strategy? should they have a strategy between now in the midterms to turn it around? >> yes, yes and yes, a man. i do think that the administration understands the question. the question is can they implement what they know needs to be done? look, at any given day in the white house, the folks who work in that building are not only doing the things that we are talking about on television. there are issues that do not make it to primetime cable news but there are things that we need the vice presidents presidents attention. the one ukraine is taking up a lot of the white house time, talent and energy, so much so that they do not get the opportunity to talk about some of what is happening and is being done. i think about immigration and i think about the presidents trip to new hampshire yesterday. not a lot about what he talked about was covered. he talked to people, talked about the infrastructure plan and its unveiling, what it has done. that is the kind of plan. but the question is how you breakthrough, not to do they know that it needs to be done. because they know it needs to be done. >> yes, and they have actually accomplished a lot and have done a lot. the question is more about messaging, if it's not able to breakthrough. a lot of the narrative is often defined by republicans. corbyn, i am curious to hear about your thoughts in the progressives in this, what is the mood right now among progressive democrats? do they think they have been taken for a ride when they look at some of the issues, that they want it delivered? the -- >> they have been trying to offer some solutions. the problems we are seeing in america. and those solutions just keep getting pushed off the table before they're really considered. i think when you see a party that does not have a coherent strategy to make a vision for america, that resonates with the american people, i think that you should be looking at all your options and using all the resources you have. you had one of the most popular politicians in america, bernie sanders, and he does have the time, i think, to go out there and push a bit of adrenaline into the democratic party base. and get people fired up for the midterms. so, i understand the president has a lot going on. and the democratic folks running the white house have a lot going on. but there are other people that could be out there battling the republican narratives. you mentioned that -- already has a party. i think that -- [inaudible] >> simone, let me pick up on what corbin was saying there, i think we may have lost him -- carbon, i am sorry, we lost a bit of your connection there. we >> -- >> i wanted to share with you, simone, what elizabeth warren wrote in the new york times. she wrote that democrats win elections when we show that we understand a painful economic realities facing american families and convince voters that we will deliver meaningful change. if we fail to use the months remaining before the elections to deliver on more of our agenda democrats are then headed to big losses in the midterms. watch our is your assessment of what she said and how can democrats deliver more on that agenda? >> so, i don't want to throw cold water on anybody out there in america and i want people to do everything they can regardless of party to get people excited about the midterm election. but i think, frankly, democrats could still do a lot and still lose the house and hold the senate. i think that that is the political reality. the question is that maybe they could hold the house. i don't know. but i do think that it is very likely that the house is lost, but the question is by how much. i 100,000% agree with corbyn. i think that the reality is that what corbyn is describing is a surrogate operation. it is when you coordinate with people to go to different places across the country and you have someone on your team who is dedicated to calling up folks like senator sanders, calling up people like congresswoman ocasio cortez, and calling out maybe former elected folks that are popping up in places like clare mccaskill. and asking them to get on the road to come here and get on the road. from my knowledge that i have, i do not think it is happening. and that is something that speaks to what senator warren wrote about in that op-ed for the new york times. and if that happens, it will get people excited about the midterm election. and hopefully, stave off those losses. i would like to be wrong, ayman, but i do not know. >> so, corbyn corbin, symone name checked your former boss there, aoc, alexandra ocasio-cortez. she was asked about biden's poll numbers. let me show you what she said. >> we need to acknowledge this is not just about an increasingly narrow band of independent voters, middle of the road voters. but it's really about the collapse of support among young people, among the democratic base feeling like they worked overtime to get the president elected and they aren't necessarily being seen. >> is she right? and if so, what can democrats do to win back that portion of their base? >> i think she is absolutely right. i think there is a big portion of the democratic base that feels forgotten. we are not just losing rural, white voters, like we have been for decades. we are losing voters across the board and we are losing voters in tennessee. national starting to slip away. i think the democratic party has got sort of an identity crisis happening. and that the bad part of that is that the right-wing republican party has i definitely articulated vision. if you give them more power, they are going to have smaller government, less immigration, and they want to ban abortion, restrict women's rights and choice. there is a vision, a coherent vision, if you elect us, this will happen. and i think we have done a bad job as a party of creating that vision. and we've done a bad job of picking low hanging fruit that improves the lives of people. even when we did, when we put peoples money pockets -- we touted that as an accomplishment. we showed people whose lives had changed. we reduce childhood poverty in a dramatic fashion. we did not tell that story. and then we cut that off, so i think there is no question that there are a lot of people who feel taken for granted and that they are not getting the satisfaction that they deserve from putting democrats in charge. >> we have about 30 seconds, symone, one of those low-hanging fruits that he's corbin talking about is probably the issue of canceling $10,000 worth of student debt. why hasn't president biden not on that yet? >> well, it is my understanding that yes, that is one of the campaign promises that president biden made. it is my understanding that the white house feels as though that congress can send them a bill. and if the president is sent a bill, -- i also know that they hear the people who have been protesting in the streets, and they are getting the calls from members of congress and advocates and i think that they are going to be poised to do something. what that something is, well, we will have to wait and see?
