the judge ordered him held in jail until his trial, but the defense team said they might seek bail in the future. his attorneys also requested a psychiatric exam. a public defender representing james in the eastern district of new york spoke to reporters outside of the courthouse right after the hearing. >> what happened in the new york city subway system on tuesday was a tragedy. it's a blessing that it was not worse. we are all still learning about what happened on that train, and we caution against a rush to judgment. what we do know is this. yesterday mr. james saw his photograph on the news. he called crime stoppers to help. he told them where he was. initial press and police reports in cases like this one are often inaccurate. mr. james is entitled to a fair trial and we win ensure he receives one. >> again, james did call crime stoppers himself, and he called and said this is frank, i think you are looking for me, my phone is about to die. that's a paraphrase. there are questions, why, and how long did he plan the attack and was he targeting any group in particular, and what might have happened if his gun did not jam? perhaps the hardest question of all to answer, how do officials stop the next person like frank james? and joining me is nbc news justice correspondent, pete williams and toni. i want to begin with you. what did you see today? >> the arraignment got started today and it was his first appearance in court. the judge ordered that he be detained indefinitely, and while the defense team did ask that he receive a psychiatric evaluation during his detention, and he had access to supplements, magnesium tablets for the cramps in his legs. and the disruption this caused unlike anything we have seen in new york city in the last 20 ar did not speak much during this pretty short meeting. what was interesting to many reporters on the ground is shortly after his two public defenders came out here to speak to the media, as you just showed a clip from there, and they made a statement that in some ways raised more questions than provided answers. it was interesting to hear them say eventually he called the police line to help because he had seen his own face on television, and his reporters shouted did they have the wrong guy, and it was hard for reporters to get much from the two public defenders, and more charges are expected and there are so many questions that we are hoping to receive about what comes next, and what his team will argue really happened in tuesday morning's gruesome attack. >> pete, let's get to the details on this. the crime stoppers call is so interesting. this is according to the call, he said something along the lines this is frank, i think you are looking for me and my phone is about to die and minutes later they had him apprehended outside a mcdonald's in the east village in new york. everything you see is not actually correct. what can you tell us about what law enforcement sources have been telling you about this case? >> i just read that as sort of standard defense lawyer talk, and that's the kind of thing defense lawyers often say at this stage of the case, give us the benefit of the doubt, and it's early, and that's pretty much routine. that's one of the crime stoppers they received is from frank james himself, and what prosecutors said in a detention letter earlier today filed with the judge, and they made an interesting point that government has not talked about much, but they make a point about how premedicated it was and what he did immediately after. at the beginning here, katy, they showed video of him trying to get through the turnstile and you see him wearing the helmet and the construction vest, and he looks like he has a two-way radio around his neck, and he has the gloves on and reflective tape. but then when he leaves the subway minutes later after the shooting, he's not wearing any of that. the government makes a point that in essence he came on to the subway wearing a disguise, and then gets off at the next station, all that gets tossed away. the government points that out as it's part of the premedication involved in the crime. right now he faces a single count. it's the federal train wrecking statute is what it is. normally there's a 20-year maximum penalty for somebody that attacks a mass transportation system, and if the mode of transportation attacked was carrying passengers, and the person was using a deadly weapon, then the sentence can be up to life. so he faces a possible life sentence here. >> pete, the fact that he did not kill anybody, and the fact that all the injuries are lower body injuries and everybody survived, is that going to factor into the charging? >> i don't think so. i mean, the fact that nobody was killed, fortunately, is the reason why the charges aren't more serious, but in terms of the statute, it doesn't matter. once he started opening fire then he qualified for this enhancement, so it really -- that part really doesn't matter. it raises the question, i think anybody would ask is why did he set off the smoke? what was the point of that? was it to obscure he was doing the shooting? it's all very strange. >> very strange, indeed. joining me in the studio is doug burns, the former federal prosecutor in the criminal eastern division of new york, which is the district that brought the charges against mr. james. tell us what is going on right now? >> basically the complaint is the preliminary charge, and they are working around the clock to write up the indictment and they will have each count per victim -- >> it's not going to be just one count? >> no, very detailed and lengthy, and facing life in prison on count after count after count. right now today he went in front of the george, and a nerd point, it's an arraignment and he doesn't have to plead guilty or not guilty, and they ask if they understand what they are charged with and they address the question of bail, and there's no argument he should be released on bail, obviously. >> the disguise, what pete was saying, appearing to work like an mta worker, that's often what mta workers, the orange jacket, if i had seen this man i would have assumed he was going to go and work on the tracks, and then leaving without it. >> i like the way pete broke it down, and this shows this was not a random thing that popped into his head. he took the time to wear the outfit and so on and so forth, and then it's a double edged toward, he leaves keys, credit cards, and every clue in the book. >> would they assume he got confused by the smoke and was making his way out like everybody else. >> it's a double sorted analysis when you look at it a little bit. on the one hand they did charge him with the statute that has terrorism in the title, but i am not sure it's a terrorism case. we're not sure yet. terrorism is defined, real quick, as killing civilians for a political aim. okay. you can put that together, because he was disgruntled with mayor adams and the homeless, and so they have ordered a psychiatric exam. >> he will come back for an arraignment -- >> on the indictment. >> -- on the indictment, and he will have listed a number of charges probably for each of the victims, the same charges all around? >> absolutely. >> what about the smoke? what about the fact that he had fireworks and he was wearing that disguise, does that lend toward the longer time because of the premedication? >> without getting in the weeds of the sentencing guidelines, i looked quickly at the guidelines for what they charged him with in the complaint, and it's going to come out extremely high. to your point, with what he did with the smoke and everything else will be strong at trial if he goes to trial. >> any hiccups here because there were some cameras not working within that station, and will they have the arguments that maybe this is the wrong guy here? >> yeah, there is a big hiccup that the cameras were not working, and it's still early but there were many surveillance points with cameras, and this type of horror is seared in people's brains and they will be able to identify him in my opinion. >> what about the youtube videos? >> yeah, they will be devastating, and they will fight tooth and nail to keep them out of court, and i don't know if he's going to trial, of course, but those will be damaging. >> what about the psychiatric exam? >> i was talking to my friends and we have been through these rodeos for years, and sometimes they come back and say, yes, the person is sane, and sometimes it's a little too much rubber stamped. >> what if they do find that he is not mentally well? >> actually, e-mailing. i told him my sons like the 54/20 joke, that he is making about weed that most people realize. i have interviewed him lots and lots of times and i want to take him through the paces of what he's doing here, because he needs a little bit of pushback, i suspect, and he's making claims, some which are interesting and some are dramatic, because elon musk is dramatic. i think a lot of wall street doesn't think he's serious, because the stock has not driven at all, and it looks like he's trying to get out of the stock, and i think he's much more serious than that but i am not sure he can afford it, even though he said it onstage and that puts his other companies at great risk. >> if he was able to afford it and if the shareholders were to take him up on the offer, and whether he's a free speech absolutist, and he says yes, what does that mean? would he let somebody like donald trump back on the platform? >> oh, yeah, he thought that decision was not correct. he tweeted about it several times, i think. at least once that he thought it was the wrong thing. you know, he sort of dabbles in this area and talks about free speech, but he has never run a social media platform, and i think he would find it harder to run it in what should be done and not, and it's easy to make observations from the sidelines and he's good the that, and running it is another story. this company is not a big company and not a good business, and i think he's right that the potential needs to be unlocked and it has more value over the course of its history. >> he's talking about a subscriber base, paying money, and does that mean there would be ads on the platform, and part of the thing people hate about instagram, although it's quite addictive, every other stroll is an ad for something. >> and it's quite lucrative, by the way. there are ads on twitter but you don't see it, and that's how bad they are on it. you and i and a lot of people would pay, depending on how many subscribers you have, and it's a great marketing and news distribution vehicle, and it's giving everything away for free, and they have an ad business and and he's talking about a public square but it's a private square, it's a private company, and he wants to bring it private so it can do some of the things without pressure from wall street and the stock price. >> twitter, it's very tricky, and he's had a large affect on democracies abroad, and we also saw here with the insurrection, and he's talking about getting rid of the bot armies? if you could get rid of them easily, wouldn't twitter have done it? >> if you make it a subscription, it solves problems in that way. every one of these sites, including facebook, which has unlimited resources have issues on this, and it does ruin the experience on twitter. by the way, elon has a bot army, and there's a lot of people that may not be in existence, and that said he has a lot of fans and it could get them going depending on what he's tweeting about, weed or taking over twitter, and he does a lot of different meme stuff. this is a company under leveraged, and a lot of people looked at it and it has a lot of hair on it, including donald trump, speaking of hair. to bring him back, you know, without elon musk, they have to think about it if he runs for president and if he wins can they bring him back on it. >> it's so tricky, kara, because there are real and devastating consequences for using that platform to lie. we have seen it happen. i wonder -- you know, in talking about this, it's funny, elon musk wants to buy it, but there are -- >> i get it -- >> -- but there are life altering consequences for letting people run wild on the thing. >> yeah, absolutely, and facebook is the real action on that. it has an out sized influence, because politicians like it and world leaders and elon musk. so if he's not going to do this -- by the way, twitter and some of its users are saying no, and what is he going to do? [phone rings] sorry. is this where they're gonna put the statue of liberty? liberty... are we married to mutual? cut. only pay for what you need. ♪ liberty. liberty. liberty. liberty. ♪ it is day 50 of russia's war on ukraine and here's what we know right now. big news out of the european union where officials are drafting an embargo on russia oil products, and taking russian oil off the market would hurt them more than russia, especially in germany where it would lead to enormous increases in the cost of energy and has the potential to disrupt politics there, and at the same time the biden administration is preparing to provide ukraine with an additional 800 million in military assistance, and russia's premier navy vessel is sinking in the black sea, and ukraine is taking credit. it's the same ship that demanded the surrender of ukrainian forces early in the invasion, and then was told to, quote, go ef itself. regardless of russia's explanation, there are questions about what the setback means for russia's ability to wage war in the south and east. joining me from ukraine is ali arouzi. >> reporter: they said this was a ammunition fire that caused the damage, and they say what the ukrainians are saying is credible, this was hit by an anti-ship missile, and it's a significant blow to the russians. this was their flagship, and it will not hurt their capabilities here but it will complicate things for russians, and the russians are saying it's an accident and the ukrainians are saying it's -- they hit it. further east in the country where the russians are trying to encircle the donbas area, they are being hampered by heavy rain and it's affecting their ability to mobilize and amass troops and encircle that area, but it has not stopped people from escaping from the donbas region. let's listen to one teenager that escaped the area just recently. >> are you worried the russians will encircle that whole area? >> yeah, i am really worried and i think about it every day actually, and they are scared about that because i know what it was like in 2014 with all the other -- you know, like russian-controlled area of my region, and i am really scared of that because i don't want to lose my hometown and my ability to live there and that stuff. >> reporter: katy, it's a very tragic story. he was 11 years old when the russians attacked that area in 2014. now she's had to run away from her home. she got on the train at the railway station that was bombed two days before it was bombed and it was a bittersweet experience for her, and she managed to get out but two days later a 16-year-old friend of hers was killed in the bombing. tragedy after tragedy for civilians in this country. >> so tough. ali, thank you. joining me is a lady and we are not using your name for your safety. >> thank you for having me. i am 45. i am a lawyer. i used to be with a international law firm, and i spent 35 days in the russian occupation in a tiny village. it's a very rural one and it's located 80 kilometers north of kyiv. i have been there with my family, my kid, he is 14, and my husband and my parents in law. here's the message i have for you. first, russians are not after our land. they are after our people, our dignity, our free spirit and our european venues. they want it destroyed. the only reason why they are shelling, why they are shooting, why they are looting and murdering -- sorry, and why they are depriving civilians of running water, electricity, power, internet, food supply and medicine supply, and freedom of movement, like they did it to my family. my message number two is as follows. we're fighting for our land and we are fighting for what is dear to us and we have our dignity, but we need your support. ukraine needs food, medicine and more weapons, and the crimes that is been committed on our land must be prosecuted, and i think they are hoping to get away with it, the way they got away with it in syria. i think they hope to get it settled by the money, and we need the whole free world to stop them. >> let me ask you about the securing of evidence of the war crimes. what are you doing to document what has happened and find the individuals who are directly responsible, the individual troops, the individual, you know, sections of russian soldiers that have committed these war crimes in bucha or in mariupol and et cetera? >> a year ago. if people want to wear it, i'm all for it, and i am not criticizing whoever wants to wear it, but -- i don't know, if it's a hospital, i get it, but at the airport? >> reporter: her sentiments echos the same we heard from the ceos of american airlines and delta who have asked the cdc to drop the mask mandate saying they believe everybody should have the decisions themselves to mask up or not when they get on a plane, and at this point according to those airlines, they say the science shows they should be able to drop the mandate, and the cdc says they want to be able to study the ba.2. >> one way masking does work. thank you very much. in the early months of pandemic, the trump administration handed out at least $5.1 billion to answer the unprecedented demand on our health system. our next guest says it's clear the government's response program would be a magnet for a free for all as uncontested contractors promised to fulfill everything from hand sanitizer to masks to icu beds, and delivered unusable products or nothing at all. and joining me is david mcswaeupb. the new book, "pandemic, inc" that is out right now. the story you tell is frankly insane. it's absolutely nuts. tease it out a little bit for us, and when the pandemic hit and nobody had masks and hand sanitizers, and nobody knew what was going on, what exactly happened? >> right, it really began in the chaos you described in april of 2020, the early scary weeks, we did not have the things we needed and health care workers were in danger and hospitals overrun, and the trump administration tried to catch up after denning the pandemic, and we see the outflows of money, hundreds of millions and billions of dollars, and being a reporter in d.c., my first thought was people will take advantage of this and it's emergency spending and we looked at the companies getting the deals, they were companies with weird names, and one company got a $34.5 million deal with the va's system, and it seemed to have come out of nowhere. called them up and said how are you delivering the $6 million masks nobody can get a hold of, and he said i am the real deal, i am hopping on a private jet in the morning, and i asked to go and when we took off he revealed he didn't have the masks, and so began a year and a half of that reporting. >> you document all of these stories in your book. i wonder why in the world did that gentleman bring you along on his private plane to get nothing, and why did everybody else tell you about their cons? >> no, i don't. >> do you have a driver's license? do you speak english? >> yes. >> can i see your license? the plate doesn't belong on this car. >> video shows the officer grab lyoya before he pulls away and starts to run. the officer tackles him to the ground where the two continue to struggle and we should warn you what you're going to see in this next clip is disturbing. the police chief confirmed lyoya was laying face down when he was shot in the back of the head. the officer involved in that shooting has not been named. joining me now is megan fitzgerald. i'm not sure we got to the heart of the story there, but this is a traffic stop. it was a license plate issue that he was stopped for. it seemed in that video that the man -- did he understand english?
