plus, president biden calls out vladimir putin's genocide in ukraine. he had already pegged the russian leader as a war criminal. as the kremlin inflicts yet more carnage on civilians. a live report is straight ahead. good morning. and welcome to "way too early" on this wednesday, april 13th. i'm jonathan lemire. we begin in new york city where a manhunt continues for the person who opened fire in a crowded subway car during rush hour yesterday morning. we want to warn you, some of the images you're about to see are disturbing. just before 8:30 a.m., strap hangers were sent into a state of panic when the attack began on a manhattan-bound n train on the sunset park neighborhood of brooklyn. police say at least ten people were shot and 13 hurt when a suspect set off a pair of smoke canisters and a round. many of those injured collapsed on to the subway platform while others were helped to safety. though that subway station is equipped with security cameras which may help identify the shooter. new york city mayor eric adams said a malfunction prevented them from recording anything at the time of the attack. so far, police are calling a man connected to the shooting a person of interest. he's 62-year-old frank james. nypd identified him last night, nearly 12 hours after the shooting. police say he rented a u-haul van in philadelphia which was found about five blocks from the kings highway station, that's elsewhere in brooklyn that was discovered yesterday afternoon. that's about five miles from the 36th street station when shooting occurred. the key to the van along with a credit card with james' name on it were found at the scene. officers discovered a handgun used, three magazine clips, a hatchet and a bag filled with fireworks, gasoline and two unused smoke canisters. police say james has addresses in wisconsin and philadelphia but it's not clear what if at all any connection to new york city. according to the "the new york times," james has posted dozens of videos on social media with bigoted views and has recently criticized the policy of new york city eric adams. according to "the new york times," the ten gunshot victims makes up the worst history. all are expected to survive, the two youngest victims between 12 and 16 years old new york governor kathy hochul visited them at a local hospital. another 13 taken to the hospital for smoke inhalation for injuries happened in the chaos after the shooting. most of those have been released. joining us live is he subway is nbc correspondent vaughn hillyard. there was a sense there of panic, traffic was snarled. people seemed reluctant to get on the subway with the shooter still at large. what's the reaction there as the commute begins? >> reporter: the subway station is back open in new york city form here, jonathan. to give the two story lines that are key here as the sun rises is number one, that there were no fatalities yesterday. you had an individual over the course of a subway ride between two stops, begin opening fire. at least 33 shells were dispensed, authorities said, that they were found at the site there. a 9 millimeter glock here. but there were also other magazines. there were three extended capacity magazines that were found on that train which suggest that the extent of the damage could have been much more severe. a hatchet was also found onsite. as well as gasoline. and, too, not only smoke dispensing canisters that were used, but two others that were not used. we have seen these videos that individuals took at the subway platform here yesterday morning. but you've also got to take into account there is a man who is at large here. that authorities are still calling a person of interest, not a suspect. but this is an individual who they say rode over the course of eight subway stops. ultimately to this 36th street subway location here. that is where eight stops from here, they found that u-haul with keys that were recovered here within a bag with that glock and with that hatchet here on that train where this attack took place. that individual here, on this wednesday is still at large. and authorities are asking for help for any information as to where this individual may be. jonathan. >> sunset park, the neighborhood in brooklyn, heavily latino, asian population there as well. about 20 minutes or so in manhattan. working class. middle class neighborhood. vaughan, we don't know the motive of this shooting. the nypd yesterday was quick to suggest they didn't think it was terrorism. but it comes at a time, of course, where there's a real scrutiny on violence, particularly guns in new york city. and big cities across the nation, as crime rises. new york city mayor eric adams who had to do this from isolation yesterday, because he tested positive for covid, he's made this a major priority as has president biden. you were reporting this week on the efforts to crack down on ghost guns. what do we know about the weapon that was used yesterday? >> reporter: apparently, they're working with the atf to track the serial number that was attached to this glock. they suggested that process is under way which would mean this would not be a ghost gun. it would not be a weapon that is untraceable here. and that is where, perhaps, the atf, is able to work with local law enforcement, to accident fi where the individual who was the shooter in this attack. not only picked up their gun. but also how they were able to purchase these three extended capacity magazines, which to note here in the state of new york, are legal here. but you also mentioned here, jonathan, not only the neighborhood here, but also the new york city at large. and violence and crime. we're looking at already 300. nearly, 300 shooting-related incidents in new york city, here in 2022 alone. i think it's important to note that new york city is largely backed -- we're looking at subway ridership at about 70% from where it was prepandemic here. when you're looking at concerns around violence, you know, this individual who we do not believe lived, or we should say the person of interest in this case is not to have have have a new york address here. but at the same time, the videos that this individual posted to youtube, we don't want to go into too much detail, but he targeted and talking about subway-related violence. and it's clearly a subject of interest to this particular individual. >> msnbc's vaughn hillyard, thank you for being with us. obviously, we will stay on top of this story all day long in the wake of yesterday's mass shooting. still ahead, president biden takes the rhetoric to the war in ukraine to the next level. plus the attorney for a man on trial for the capitol riot claims that former president trump authorized the attack. also ahead, we'll remember a comedian with an iconic voice. and coming up on "morning joe," new york city mayor eric adams joins us live, following the subway attack in brooklyn. ow! ♪♪ welcome to "way too early." it's coming up on 5:30 a.m. on the east coast, 2:30 out west. i'm jonathan lemire, we're coming back from break a lit early. there's a lot to cover from the war in ukraine, starting here. for the first time, president biden has publicly called russia's actions there a genocide. >> your family budget, your ability to fill up your tank, none of it should hinge on whether a dictator declares war and commits genocide, a half a world away. >> comment ratchets up the rhetoric on the invasion. unlike when biden first called putin a war criminal, the president this time, isn't walking back these comments. >> yes, i called it genocide, it's becoming clearer and clearer that putin is trying to wipe out the idea of being able to be ukrainian. and the evidence is mounting. judging from last week, more evidence coming out of literally, the horrible things that the russians have done in ukraine. and we're going to only learn more and more about the devastation. . and we'll let the lawyers decide internationally whether it qualifies. but it sure seems that way to me. >> up until that moment, the white house avoided using that phrase "genocide" which the president said there say legal definition to it. which lawyers will have to decide whether or not what has happened in ukraine approaches that. but ukrainian president zelenskyy was happy to hear that. calling biden in a tweet, true words of a true leader. and the biden administration is planning on sending more aid, $750 million and may be announced earlier this week. the package is to include m-17 helicopters and helping to fight the russians in the eastern donbas region. where the moscow launch an invasion. and there's a silence there could be a slog of a battle, with heavy artillery. ukrainians are having for more and more weapons as this continue. after local rounds of peace talks, russian president vladimir putin said those negotiations have, quote, hit a dead end. with one of the allies lukashenko, putin vowed to press on until the kremlin's goals are fulfilled. the russian leader claiming that moscow has to choice but to press after. it should be noted even while the peace talks were taking place, many experts expressed skepticism that russia was serious about reaching any sort of an agreement. russian forces stepped up attacks in eastern ukraine. hitting civilian areas and blocking off aid. several strikes yesterday hit a culinary school in nearby residential schools in kharkiv, the country's second largest city and injuring three people. local officials say 100 residents were in the buildings at the time of the attack. russians had been relentlessly battling eastern cities for a week now. and ukrainian forces allege that russian troops have also allegedly blocked the city. and it's been a point for moscow to amass troops in what is expected to be the largest and neighboring donbas region. heavy fighting also continued in mariupol as ukraine officials say hundreds of thousands remain trapped in the besieged city. an adviser to president zelenskyy said ukrainian troops are facing challenges in the port city as they remain blocked and are facing supply issues. joining us now, nbc foreign correspondent raf sanchez is in ukraine. raf, one of the major story lines that officials have been following in the last 48 hours or so, is the report of chemical weapons used in mariupol. the ukrainian officials suggest they were. white house officials say they're proceeding cautiously. they're not able to confirm that those weapons have been used. and if they are, a proportional response would be required. what's the latest from what you're hearing there? >> reporter: yeah, jonathan, more than 24 hours on after these initial reports that a russian drone dropped chemical weapons in mariupol, there has been no official confirmation from either the ukrainian or the american government. secretary of state blinken was asked about this yesterday. he said that the u.s. does not possess any information now that would verify that the russians have indeed used chemical weapons in mariupol. the fighting, though, chemical weapons remains incredibly intense in mariupol as russian forces close in on that besieged city. i spoke to an officer from the ascore area, leading that defense in mariupol. i asked him, tens of thousands have been killed in that city according to president zelenskyy, and whether his forces had what they needed to continue the fight. take a listen. >> a lot of civilians died. a lot of civilians died people have not received the supplies, food and the water. >> reporter: let me ask you what do you need to defend mariupol? >> we have limited ammunition. so to cope with this problem, we need more ammunition. we need supplies. we need more medical care for wounded. >> reporter: he told me what they need most are anti-tank missiles, but especially weapons that would allow them to counter russia's enormous advances in the air. they have very little answer right now to russian bomber aircraft going over the city. president zelenskyy's adviser this morning, saying there is some good news from mariupol. a marine unit apparently abe to break through russian lines and link up with the fighters from the ascore regiment. but it's still going to be a very, very difficult fight ahead for the ukrainian side now, jonathan. >> we're certainly going to have a continued spotlight on whether the chemical weapons are used. as i report today, it would certainly take this war to a new phase if indeed confirmed they were used by russians. that has not happened yet. raf, as we can discussing, there's an expectation that russia is about to launch a major assault in the donbas. and they've already stepped up attacks in eastern ukraine, particularly in kharkiv. tell us the latest you're hearing in terms of the violence there. >> reporter: yeah, jonathan, kharkiv is ground zero as far as attacks. we've been talking about it all week, all expectations are that the fighting is going to shift dramatically towards the east, towards the donbas region. and president putin confirmed that yesterday. he was visiting the far east of russia. he said as you mentioned, peace talks are at a dead end as far as he's concerned. what he calls the special technical military operation will continue in ukraine. and that russia's objectives will met. now, the fighting in the east very different from what we've seen around kyiv. the ukrainian homefield advantage, likely to dissipate, as the fighting shifts from the donbas. jonathan, remember, russian forces have been fighting in the donbas since 2014. they know the terrain. they know the ground. it's a very different situation from them wandering their way through the streets of the suburbs around the capital city. we're likely to see large pitch battles in the east. russia's supply lines much shorter than they've been previously. so unclear that the ukrainians will be able to mound the kind of mobile hit and run tactics that have worked so well for them up to this point. president zelenskyy said this is a battle that his side can win. but as he and all of his officials continue to insist, every single chance they get, they need more weapons, and they need them soon. the pentagon today meeting with america's top eight weapons manufacturers to discuss what kind of arms the u.s. needs to be producing if this conflict is going to drag on for years. but that isn't a great help to the ukrainians in the short term. therefore, trains on old soviet arms. the latest american technology, even if it can get to them, not necessarily of enormous help. jonathan. >> terrific reporting as always from msnbc correspondent raf sanchez. stay safe. still ahead, we're live with cnbc for a look at how wall street is reacting to the highest inflation data in 41 years. they've identified a person of interest. what are the next steps we could see? >> first, the main thing to do now is to get the individual into custody. and this is an all hands on deck sort of event so they're going to be utilizing u.s. marshals all from the nypd, which is some of the best hunters in the world tracking down this individual. they're going to go everywhere he's ever been in his life. out in milwaukee, residents there, speaking to people there. anywhere in pennsylvania where he's shown he's been. anyone who has ever had contact with this individual will be reached out to try and find out where he may have gone. there's really no place to hide. i would be rest assured that they will have this individual in custody, rather quickly. and then it's just a matter of putting the pieces together, to show that he was the individual that did this attack. and that's just getting the forensics that was recovered from the scene. from the numerous items that he left on the train. it would be watching his dna up. his fingerprints up with the objects left on that train. witnesses being interviewed to see if they can identify him as being the individual who was doing the shooting on the train. all all these investigative steps have been taken right now, but the main thing, focus now, is getting him into custody, interviewing him and starting that whole process. >> so there is a bit of a distinction made yesterday, as governor hochul and mayor adams said they felt the perpetrator was trying to terrorize, but no one deemed this terrorism. tell us what the difference is, and why do you think they made that distinction? >> well, terrorism is usually done for some sort of political motivation, inspired by isis, inspired by some sort of political event. we don't know what his motivation was at this point. there's beliefs that he may have just been acting solely out of rage. uncertain. so until you can toe that motivation, it is not classified as a terrorism event, which then would be led by the fbi. it is now just an active shooter who terrorized the people, but its lead would be the nypd at this point. >> all right. certainly, we will keep everyone updated throughout the day on developments in this case. a person of interest, to recap, identified. no arrests made yet. former nypd chief of the department, terry monahan, we appreciate you walking us through the steps in the investigation. appreciate you being here. up next, the pushback against president biden's latest efforts to fight high prices at the pump. coming up on "morning joe," the person who fired in a train car. two former commissioners will join the conversation. plus, we'll hear from the ceo of the metropolitan transportation authority. and mayor eric adams is also a guest. (vo) with 5g ultra wideband in many more cities, you get up to 10 times the speed at no extra cost. verizon is going ultra, so your business can get more. president biden, his latest attempt at fighting high gas prices around the country is drawing a rare rebuke from both environmental activists and oil companies. that's a tough combination. from an ethanol manufacturing plant in iowa yesterday, the president announced that the environmental protection agency will issue emergency waiver to permit year-round sales of e-15 gas. the fuel, including 15% ethanol, is usually prohibited over the summer months because it causes increased air pollution when temperatures are high. >> e-15 is about 10 cents a gallon cheaper than e-10. some gas stations offer an even bigger discount than that. but many of the gas stations that sell it here in iowa, illinois, wisconsin, pennsylvania, are required to stop selling it in the summer. with this waiver on june 1, you're not going to show up at your local gas station and see a bag over the pump that has the cheapest gas. you're going to be able to keep filling up with e-15. it is going to solve a whole problem. >> environmental groups say the move will lead to health and climate risks, while oil companies worry it'll cut into their bottom line. joining us now, white house correspondent for bloomberg news and pessimistic philadelphia sports fan, justin cink. thanks for being with us this morning. so this week, we see the white house trying to turn back to domestic issues. we had ghost guns on monday. yesterday, on fuel prices. later and tomorrow, he goes to north carolina to talk about supply chains. obviously, inflation and rising prices all over this white house's radar. what other steps are they trying to take to bring down prices at the pump and grocery stores anywhere else? >> well, in terms of gas prices, which, obviously, has been kind of the leading driver of inflation concerns and the thing weighing most on american's pocketbooks. the white house is tapping into the strategic oil reserve, putting 1 million barrels on the market each day throughout the summer. the hope is is that will start to put a dent in gas prices. the president estimated it could be 10 or 20 cents a gallon. in addition to the e-15 change. that's a real hope from the white house, that they can start to tackle what has been a big problem, especially since the russian invasion of ukraine has sort of skyrocketed energy costs around the world. on top of that, i think they are really focused on supply chain issues. you are seeing new issues bubble up each day. shutdown in shanghai has created a real bottleneck in the ports there. there's some issues coming across the u.s.-mexico border right now, especially with the expected surge of migrants that's going to come. all these issues are things that folks in the white house are looking at in hopes of addressing some of these price increases that have really rocked american's pocketbooks. as a result, really hurt democrats politically. >> yeah, increased prices that loom over the upcoming midterms, and we see president biden still saddled with pretty low poll numbers right now, despite receiving largely high marks for his handling of the crisis in ukraine. that's where i wanted to go next, justin. earlier, it was a few weeks ago when he deemed president putin a war criminal. white house walked that back. he then, while in europe, said putin should be removed from power. the white house kind of walked that back. yesterday, when he said what he is seeing in ukraine is a genocide, the white house didn't walk that back. talk to us about what this means. >> reporter: yeah, i think the white house is learning a lesson, that if the president makes these rhetorical declarations that don't carry specific penalties but reluctant to use before because of the moral calling they result in, it is better to kind of lean into it. americans aren't afraid of describing the actions of vladimir putin as extreme and severe, and so, you know, even though it might not necessarily reach legal definitions within the state department, there's a political advantage, i think, the white house has seen, sort of leaning into the president's rhetoric here. as a result, you know, when the president came and clarified his remarks under the wing in iowa last night, he wasn't kind of walking them back, pulling them back, as he did in earlier cases that you mentioned. >> justin, one last quick one for you. any update on terms of the military funding and equipment that the u.s. hopes to send to ukraine in the coming days? >> reporter: yeah, so we're expecting another package of around $750 million to be announced in the next couple days by the white house. the specifics of it are still being worked out. the white house wants to keep pushing that military aid to ukraine. >> all right. certainly, we've heard from the ukrainians saying they need heavy artillery as they prepare for what could be a real set-piece battle in the donbas. bloomberg's justin sink, thank you, my friend. appreciate you getting up early for us today. thanks to all of you for watching us on "way too early" on this wednesday morning. "morning joe" starts right now. good morning and welcome to "morning joe." it is wednesday, april 13th. we want to update you right away on the major story that broke while we were on the air yesterday morning. the very latest in the worst shooting in the history of the new york city subway. this morning, a man hunt is still under way for the person who opened fire in that crowded subway car during rush hour yesterday. police are currently calling it a man they are connecting to the shooting a person of interest. 62-year-old frank james. nypd identified him last night, nearly 12 hours after the shooting. police say he rented a u-haul van in philadelphia, which was found yesterday afternoon about 5 miles from the 36th street station where the shooting occurred. a key to the van, along with a credit card
