tonight what we know about that draft of a former executive order prepared for then-president trump that described the plan to seize voting machines after the 2020 election. plus, one senate candidate in louisiana is hoping to smoke his competition in the midterms but can he translate a viral video into a successful campaign? today on the 49th of roe vs. wade is the anti-abortion rights movement taking hold of this country? i'll speak live with the president of planned parenthood. i'm ayman mohyeldin. let's get started. it is a tale as old as time, another week goes by in this country and more and more evidence of trump and his associates attempts to overturn the election results become public. the january 6th committee now has in its possession over 700 pages of documents from when trump was still president and trump's last-ditch efforts to keep the national archives from handing over these documents finally failed in the supreme court this week. now, because of appeals court filings from the committee, we have a pretty good idea of the documents they have obtained. proposed talking points relating to allegations of voter fraud, presidential calendar, a draft of a trump january 6th speech at the save america march and a draft executive order on the topic of election integrity are just some of the handful of items the committee has been seeking throughout all of this. and thanks to new reporting from politico this week we now know that executive order would have ordered the department of defense to actually seize voting machines across the country and it would have appointed a special counsel to probe the 2020 election. let me be clear here for a moment. now, the document was never signed by trump and while we don't yet know who wrote the executive order, it does track with a plan that trump advisers that you may recall sidney powell and michael flynn presented to trump just days after the document was actually written. that executive order is likely just one of the many reasons the january 6th committee would like to hear from powell. they've subpoenaed her along with rudy giuliani, boris epshteyn and jenna ellis about pushing unsupported claims in attempts to delay the version of election results. now, those efforts were extensive to say the very least but we learned more this week about one particularly brazen scheme that they pursued. "the washington post" and cnn reporting on efforts led by rudy giuliani to convene an illegitimate slate of state electors from states he lost. the goal was to undermine the electoral college process by replacing the legitimate biden electors with those bogus ones from states that trump lost. if the plan had succeeded, it would have given the vice president mike pence a pretense to throw out biden's win on january the 6th, something the president was calling on his vice president to do. none of this was a secret. none of it was a secret by any means. a lot of it was happening in plain sight but it's the details that we're now getting on the coordination from giuliani and the trump campaign that i have to say are quite remarkable and alarming. those efforts are on full display in new audio unearthed by rachel maddow. i want you to take a listen. this is a voice mail message left by a member of the trump campaign for a michigan state legislator trying to get them to go along with this scheme. >> tomorrow as you might be aware, mayor giuliani will be presenting experts and witnesses from michigan who will be able to show that the vote totals are fatally flawed and do not accurately represent the will of the voters as well as your constituents. you do have the power to reclaim your authority and send a slate of electors that will support president trump and vice president pence. there are state legislators across the country who are standing with the president to stop this voter fraud from happening under their watch. we want to know when there's a resolution in the house to appoint electors for trump if the president can count on you to join in support. >> so we're at this point where these almost weekly news dumps are occurring and it's becoming more and more clearer just how vulnerable american democracy is. in just a minute i'll speak to the michigan secretary of state jocelyn benson about all of this, the top election official in a state where so much of trump and his allies' efforts were focused in overturning 2020 but first joined by philip bump. this fake elector scheme that rudy giuliani was reportedly running for trump is now as we understand it being investigated by both the jr. 6th select committee and local officials at least in three states including michigan where attorney general dana nessel has been involved and she's now referring this to the justice department for even further investigation. beyond subverting our election from what you've seen is there a potential crime here? what could come out of an investigation into this? >> the main focus when i've heard these discussions and poking around in this myself, the main focus is looking at charges that focus on forgery, forging official documents. obviously what was happening here, what was being undertaken on december 14th is the alternate set of electors was trying to sort of interrupt the formal process articulated by law that the people who are duly designated electors from a state get together to cast their votes and they are carried alongside a formal document from the governor of each state and that package together is the thing that then gets transmitted to washington and count the on january 6th so i think the idea here is that there are going to be potential criminal charges focusing on forging an alternate slate that didn't represent the vote of people in those states, michigan, new mexico or wherever it happens to be and instead are moving forward with this, you know, this document that purports to be something that doesn't actually capture what the voters want. is it something prosecutable? i'll defer to the experts on that. that's not my area of expertise. >> fair enough. but what's interesting in this, philip, the plan involved using these electors that the campaign themselves had convened in order to give vice president a pretext -- vice president mike pence at the time a pretext for rejecting biden's victory on january 6th. we know he did not go along with it because of what we saw play out on that day but do we know any details, any thinking at all about where pence stood on this plan, because at the end of the day, this was all part of the plan laid out in that infamous eastman memo that was presented to pence. >> so, i had a conversation with the constitutional law expert in october of 2020, well before any of this was under way and he told me that this was the scenario that he was worried about, he was worried the electoral count act allowed for there to be competing slates of electors even they didn't carry the imprimatur of the governor responsible for that certificate i mentioned, he was worried that there was space for there to be alternate slates of electors submitted to congress and that they could potentially be claimed as -- this isn't john eastman in cahoots with donald trump but studies this stuff and said this is a vulnerability so i think what they were trying to do was simply, you know, they were -- it was like they had just gotten fresh spaghetti out of a spaghetti and dumping it in every bowl they could find and trying to figure out is this something that might actually get them some headway? was this the predicate for what pence was doing? look, i have little confidence that donald trump understood the nuances of the processes at stake. i think he was like pence, you got to do this thing. pence decided not to do it to his credit. i don't even think congress really went along with it. yes, there were objecting votes but the plan didn't come to much fruition but this was a point of pressure with whom i spoke were worried about. >> one reason why i said it exposed how vulnerable our democracy is. it was mike pence who saved the day and know how he's been behaving ever since. who is to say next time around you won't have someone willing to go along with a plan like this. the efforts to reform and address concerns, democrats have had a rough week, voting bills, they failed in the senate. there was a possible bipartisan compromise that would have thrown out or actually did throw out the attempt to reform the electoral count act which would have to some extent through its reforms prevented schemes like this from succeeding in future elections. is this a setback? have we done anything in the past year to make sure something like this cannot be repeated? >> we haven't and it's honestly quite baffling. i don't think, you know, everyone who looks at this, even the people who are in congress and who are sympathetic to donald trump to some extent recognize this is a flaw but also a lot of republicans who stood in opposition to this effort, republicans in both the house and senate who opposed donald trump's, you know, who supported the idea of actually convicting donald trump on impeachment charges after all of this went awry on january 6th. i think it's rather baffling that this arcane archaic piece of legislation written in the mid-1800s should stand even though we just saw where the limitations are. it's like driving your truck that a wall and you see that it almost crumbles. okay, we don't need to fix the wall because when we drove a truck into it didn't break. it's sort of baffling that congress doesn't come together and say, let's fix this really, really poorly worded legislation so that we don't have our elections stolen. >> yeah, completely agree with you on that front. let me switch gears really quickly, philip, and talk about this draft executive order that politico reported on this week. it cites two classified document, national security presidential memorandas 13 and 21 and according to politico the existence of the first one was already public but it's the second one that had never been reported on publicly before. what can you tell us about that? i mean, what does it say that this was included this this executive order, this possible attempt to get the military to seize voting machines and then have a special counsel declare to probe the 2020 elections? >> i think one thing to keep in mind when you mention the documents and process, part of what was happening with that order is they were trying to give a stamp of formality to what they were doing. they were trying to make it seem as though the government writ large had problems with what was happening and part of it by supporting the information into private documents, it can make it seem like something ominous is happening. what donald trump and what his team were trying to do, trying to convince the american people there actually was fire underneath all the smoke he had been whipping up. of course, there wasn't and honestly the thing that struck me about the executive order and that they wrote about on friday it leads with this idea there was something suspect in michigan which was debunked a million times substantially well before this thing was written and that really speaks to the quality of the document. >> and i'm glad you brought up michigan. we want to talk about that. philip bump, thanks. joining us is michigan secretary of state jocelyn benson. madam secretary, thank you so much for joining us. let me pick up on what philip was talking there. your reaction if i can ask about seeing an election mistake in michigan, one that you issued a statement on being used in a draft executive order that would have resulted had it been implemented in the military taking over of our election systems. >> thanks for having me. i think this is a critical conversation as we seek not just accountability for those that did try to block the results and overturn a presidential election but make sure it doesn't happen again. with antrim county and other issues in michigan underscores the fact that there was not and never had been evidence of widespread fraud or any wrongdoing with our elections. our election was safe, secure and an accurate reflection of the will of the people and the very fact that antrim county or other things that have been cited underscores how there is no real evidence of wrongdoing or fraud and all of it is being used or was being used to just suggest or provide an avenue to really not just overturn the results of the election but create confusion, chaos and illegitimacy over the entire process over our democracy and it was a very challenging time to overcome all of those challenges from the federal government in realtime and it also underscores how important it was to have good people in place from both sides of the aisle who refused the pressure whether it was the former vice president or whether it was lawmakers in the state of michigan or members of the state board of canvassers and did the right thing, upheld the results of the election. didn't buy -- didn't drink the kool-aid or buy the lies that they were being sold. instead did their job. >> speaking of drinking the kool-aid, let me play for you some audio obtained by cnn of michonne maddock speaking at a public event last week. listen to this. >> we fought to seat the electors, um, the trump campaign asked us to do that under a lot of scrutiny for that today. >> you see him saying the trump campaign asked them to do that. the michigan attorney general dana nessel said it was an open and shut case of forgery of a public record. do you agree with that assessment? >> yeah, these were -- first of all, the law is very clear on who the electors are and how they're selected by the states and so for a political party and -- to co-collude with a presidential candidate who was the president at the time to try to block that legal transfer of power, that legal verification of the votes, the electoral college and electorates is, you know, a flagrant violation of these legal requirements and determinations of who is an elector and the fact that these individuals both co-chair of the state republican party and candidates for the president and their followers lied to the federal government about who those electors were really is egregious, it's unprecedented. there needs to be consequences and also a signal of just how far folks were willing to go to try to nullify the voices and the votes of millions of american citizens in michigan and across the country. >> yes, so picking up on that when you see how far they were willing to go, you know, trump and his cronies threw out any and every theory they could come up with to not only delay the certification of the election but cause confusion among the american public and folks in michigan and ultimately undermine confidence in our election. when you see that polling today shows many republicans, i believe as many as 70% or 80% of republicans believe that joe biden is not the legitimate president of the united states or did not win legitimately, do you think that ultimately these efforts were at least partly successful and have we shored up our systems for it to not happen again in 2022 and 2024? >> those are exactly the right questions because you're right, the goal was not only to actually interfere with the actual election results but to cause this sense of illegitimacy over the ultimate and real victor, president biden. and so in that way there was success, there was a successful effort to dampen citizens' confidence in our democracy and in our government and that, of course, creates an air of illegitimacy to make it difficult to get anything done which is what we're seeing play out now. the second piece, all i know from this as a chief election officer in the state of michigan we should all look at this, this was an attempt made that was unsuccessful in actually overturning an election in 2020 solely because good people did the right thing and people of integrity followed the law. now a lot of those people have been replaced in michigan and around the country and there's efforts under way to replace even more of us and, you know, that's something that the american people really need to think about as we move into these next several election cycles how do we ensure the bar in place to protect the results if this happens again. >> yeah, i mean i think it's a blueprint. that is what scares me the most. partly why i said our democracy is so vulnerable. i don't think that's sunk in for a lot of people in this country, certainly influential people. michigan secretary of state jocelyn benson, thanks for joining us. greatly appreciate it. >> thanks, thanks for having me. coming up, commemorating the anniversary of the landmark supreme court decision roe versus wade, but could this one be the last one? that man was former president trump who made that point multiple times as he campaigned for the presidency in 2016. he was referring to hillary clinton's aides pleading the fifth when asked about a private email server when she was secretary of state. barbara mcquade, professor at michigan law school and msnbc legal analyst, barbara, great to see you as always. invoking the fifth more than 500 times, you would certainly know better than i do, is that striking? what do you think is behind that? why would the questioner even ask 500 questions as opposed to realizing after the first couple hundred this is not going anywhere, let me stop? >> well, all of us have an absolute right to invoke our fifth amendment rights against self-incrimination because we have this adversarial system where we don't have to be witnesses against ourself. important to invoke on a question-by-question to lock someone into their position so you can't simply say i will a take the fifth therefore i don't have to show up. you have to ask it on a question-by-question basis and the person needs to show they have a well-grounded fear of prosecution. judges and even people questioning others are usually pretty respectful and deferential in not pushing that too hard if someone invokes those rights in an effort to be respectful of their constitutional rights but it is important to lock them in. you can ask questions that do not call for information that could be incriminating. what's your job? what did you do during the following years? did you have responsibility for these documents? you can ask those but important to lock a person into a story as to what you can cover, that way it's difficult for them later to wiggle out of it because they've testified under oath but 500 times is a striking number. it does show some good persistence by those asking the questions but also shows the trumps are very concerned about being prosecuted for similar claims, claims of fraud. >> let me ask you about the information that has been coming out of this because it has been quite extraordinary. i mean, letitia james submitted it before midnight ahead of a court deadline. that explains the timing a bit but isn't it unusual for a prosecutor to release so much information while the investigation is still ongoing? i mean, how do you evaluate that? >> yeah, it really is, ayman, and, tish james has not done herself any favors by making public statements attacking the legitimacy of donald trump as president and talking about how she'll go after him. but in this instance the trumps really invited this kind of response. they filed a separate lawsuit to stop the entire investigation. they filed motions to quash these subpoenas saying this is all just a made up impeach. there's no evidence here and she said, really? let me show you some of my evidence and in a 115-page very detailed document she laid out exactly what her evidence is to date and she shows things like an inflation in the assets of a property from 200 million in 2013 to 400 million in 2014 one year later. she shows how trump's apartment in manhattan was represented as being 30,000 square feet when, in fact, it's only 10,000 square feet. these are objective eye-popping numbers that at least raise suspicion and they were done for the purpose of obtaining loans, insurance coverage and tax deductions and so if those were false or fraudulent that could be the basis for fraud. she is seeking -- exploring it from a sieve perspective. she does have the authority to bring a claim and seek damages which could be in the hundreds of millions of dollars so she's put her cards on the table and said you pushed me, donald trump, here you are. here's the public evidence and now it's in the public domain. >> and comes at the same time, you know, this new york civil investigation comes at the same time as the manhattan district attorney's investigation into criminal conduct. explain the differences between those for us. what are the similarities and differences between the two cases? does one pose greater risk for the trumps? is this a smart strategy, if you will, or should they be more focused and targeted and unified although they're from different jurisdictions? >> yeah, i think that they're working in parallel which is probably the best way to go. certainly all three of the trumps, four of the trumps who have been subpoenaed, eric, donald jr., ivanka and donald trump have invoked potentially will invoke their fifth amendment rights against self-incrimination because of that criminal prosecution that is ongoing in manhattan. but i think it's wise to go explore from both perspectives. there are some -- there are different tools but ultimately the criminal prosecution does bring potential prison terms so the stakes are highest there. >> all right, barbara mcquade, always a pleasure, thank you. >> thank you, ayman. today marks 49 years since the landmark roe versus wade decision but with a majority on the court will roe make it through 2022? ♪ ♪ ♪ sometimes you want to go ♪ ♪where everybody knows your name ♪ ♪ ♪and they're always glad you came ♪ 49 years ago today january 22nd, 1973 "the washington post" dubbed that day as, quote, the day that changed america. abroad you had henry kissinger flying to paris. back home in texas, former president lyndon b. johnson died at the age of 64. his legacy, of course, as everyone remembers was shaped by signing the civil rights act and the voting rights act that effectively expanded our nation's democracy and made it more inclusive of people to vote and in the nation's capital on that very same day, the supreme court issued its landmark ruling on abortion rights in roe versus wade protecting a woman's constitutional right to choose. now here we are on this day almost five decades later voting and abortion rights front and center of our national debate but this time the result in 2022 could be very different than it was in 1973. activists are sounding alarm bells that this year's 49th anniversary of roe versus wade could be its last. let that sink in for a moment. the supreme court is currently considering whether to uphold a mississippi law that would bar almost all abortion after 15 weeks. that decision which is still months away from being released could gut the long held precedent and change abortion access in america as we know it. because right now 26 states are standing by. they are ready, ready to enact laws restricting abortion the moment roe is overturned and there's good reason to think that it might be overturned. those laws would make the procedure illegal or next to impossible to access abortion for over 135 million americans. and under roe the average american had to travel 25 miles to reach the nearest abortion provider but without roe, that distance because of restrictions that states could impose is likely to increase to 125 miles. so how are abortion providers planning to adapt to a possible post-roe america? joining me is alexis mcgill johnson, president and ceo of planned parenthood. thank you so much for joining us. i greatly appreciate your time. this is obviously a major cause of concern not just for a woman but for the entire country and as activists have been warning this could be the last anniversary of roe as we know it. how is your organization preparing for what could become a very difficult time later this year? >> well, thank you, ayman, for having me here. look, we are exploring all options to continue providing abortion care to make sure that our patients get the care that they need when they need it, that means increasing investments in patient navigation, it means exploring all options around telemedicine, abortion and more states which were allowed at the end of this year when expanded access with the lifting of the restrictions around the -- means bolstering support around our affiliates to ensure that, you know, those who are able in states that are pushing the boundaries and expanding access and expanding provisions are allowing us to meet the need. i think with that center here, right, is the fact that we know the people most impacted by the court decision and currently by the bans that are being enacted across the country are the people who will be most marginalized grappling with, you know, low income who are marginalized because of their, you know, race, their gender identity, a number of things. those are the things that my organization and many others are most concerned about right now. >> so can you talk to us a little about that concern, i mean, to just elaborate on it. i know there was a doctor who practiced before roe said he saw firsthand how the effects of illegal abortion were particularly hard upon women of color and low income women noting the death rate due to illegal abortion was nine times higher among black women compared to women. you talked about that a little bit. how worried are you and your organization that history could repeat itself? >> oh, very worried and i think we're already seeing this now with what's happening in texas. we are over 130 days in texas with a six-week ban which is two weeks after someone has just missed their period and we know that the impact is largely going to be borne by people who are least able to absorb that impact. people who have means have always been able to access termination of pregnancy. they've been able to travel. they've been able to get on planes, able to afford the resources for a doctor, private doctor, what have you. those are the resources that are not going to be available to the people now who not only have to identify the resources for the procedure but also who have to think about how to travel as you said hundreds of miles, thousands of miles in some cases given the kind of ripple effect of what we've seen coming out of texas and potentially now in mississippi. people who have to think about caregiving, who is going to watch their kids while they take off from work. will their job be there when they come back? what is going to happen as they travel through the endemic that we are still living in. those are at the top of people's mind and things we are most caring about right now. >> as you very well know, alexis, there are those who are calling on congress to legislate abortion rights as opposed to letting the precedent be overturned by the supreme court. two advocacy groups are pulling support from kyrsten sinema because she's opposed to changing the filibuster and since the filibuster would also stand in the way of any federal action on protecting abortion rights, people are targeting their i guess frustration or disappointment at her and people like joe manchin for refusing to budge on reforming the filibuster. would planned parenthood consider following suit and pulling support for kyrsten sinema, senator kyrsten sinema? >> look, i want to be 100% clear that we cannot have access to abortion rights, we cannot fight and defend abortion rights without access to voting rights and are willing to do whatever we need to do by any means necessary to ensure that people have access to voting. i think we have to connect the dots here, right? the same states where we are seeing these egregious restrictions all across the country, particularly in the south and midwest are also the same states that are enacting the most egregious voting restrictions and so we have to connect the dots here and say that it's not possible for us to continue to fight for ensuring that we have access in our own states, in our own zip codes to get health care that we need and require without actually having the same fight for democracy and i think that's what, you know, we all understood this week more than any other week before and that's what's the most critical thing we need to be thinking about right now. >> it is going to be a case that could potentially change this country for many years to come. we'll be watching it closely. alexis mcgill johnson, thank you so much for your time this evening, greatly appreciate it. still to come, we have wall-to-wall coverage of former president trump's exchange with sean hannity. i hope you saw what i did there. it was pretty smart. plus, coming up in the 9:00 p.m. hour, my saturday night panel grading president biden's first year in office. why tucker carlson is complaining rather about m&ms being less sexy and what not to do when you're a world leader trying to fight a pandemic. more "ayman" after the break. ndc ndc more "ayman" after the break so we only pay for what we need. -hey tex, -wooo. can someone else get a turn? are you at all worried that your opponent could use this ad as a weapon against you? >> the senator has already sent out an e-mail to his daughters with our campaign ad in it, so i'm not worried about what cannabis is going to do. people all over louisiana have been reaching out, and we're having amazing conversations. people are donating, and that's what we want to see. we want to see this conversation become a conversation that people have where it's not as controversial. and i can't speak for others having done it, all i can say i'm young and i believe this is right thing to do. people are going to talk about you. the question is are they going to talk about you because you're trying to move forward or talk about you because they're making fun of you in the u.s. senate. >> speaking of moving the needle forward i do have to ask you how do you avoid becoming like other high profile senate candidates who are able to garner national attention. as you mentioned you are garning national attention. how do you translate that but avoid becoming like a jamie harrison in south carolina. >> well, the numbers in south carolina and the numbers in louisiana are different. we have a democrat as as our governor, and it is possible. it's already been done here in louisiana. we can win. i ran in a congressional race last year. we spent very little money on tv and we came within 1,500 votes of making it into a congressional runoff because we had a powerful grassroots game in this community. what we believe is in a by air strategy, talk to people on-air, radio and all those things but bay ground also, getting out into the community and letting them know we're going to bring louisiana from the 50th rank straightforward. there's nowhere to go but up from here. >> gary chambers, thank you so much for joining us. greatly appreciate your time. senator mitch mcconnell is in hot water after his controversial comments this week. was it a froiden slip? >> well, the concern is misplaced because if you look at the statistics african-american voters are voting in just as high a percentage as americans. this is not a problem. >> i don't know if you heard that, so let me just rephrase that. african american voters are voting in just as high a percentage as americans? mitch, african american voters are american voters. it's one thing to say the quiet part out loud. it's another thing to scream it. now, mcconnell's staff was quick to do cleanup after that comment saying the minority leader meant to say african american voters vote in just as high as a percentage as all americans, but, look, this doesn't really matter if this was a slip or an unfortunate gaffe by mitch mcconnell because those remarks reflect the gop's genuine view of black voters. to many republican politicians people of color are not perceived as real americans with legitimate wants and concerns. .

tonight what we know about that draft of a former executive order prepared for then-president trump that described the plan to seize voting machines after the 2020 election. plus, one senate candidate in louisiana is hoping to smoke his competition in the midterms but can he translate a viral video into a successful campaign? today on the 49th of roe vs. wade is the anti-abortion rights movement taking hold of this country? i'll speak live with the president of planned parenthood. i'm ayman mohyeldin. let's get started. it is a tale as old as time, another week goes by in this country and more and more evidence of trump and his associates attempts to overturn the election results become public. the january 6th committee now has in its possession over 700 pages of documents from when trump was still president and trump's last-ditch efforts to keep the national archives from handing over these documents finally failed in the supreme court this week. now, because of appeals court filings from the committee, we have a pretty good idea of the documents they have obtained. proposed talking points relating to allegations of voter fraud, presidential calendar, a draft of a trump january 6th speech at the save america march and a draft executive order on the topic of election integrity are just some of the handful of items the committee has been seeking throughout all of this. and thanks to new reporting from politico this week we now know that executive order would have ordered the department of defense to actually seize voting machines across the country and it would have appointed a special counsel to probe the 2020 election. let me be clear here for a moment. now, the document was never signed by trump and while we don't yet know who wrote the executive order, it does track with a plan that trump advisers that you may recall sidney powell and michael flynn presented to trump just days after the document was actually written. that executive order is likely just one of the many reasons the january 6th committee would like to hear from powell. they've subpoenaed her along with rudy giuliani, boris epshteyn and jenna ellis about pushing unsupported claims in attempts to delay the version of election results. now, those efforts were extensive to say the very least but we learned more this week about one particularly brazen scheme that they pursued. "the washington post" and cnn reporting on efforts led by rudy giuliani to convene an illegitimate slate of state electors from states he lost. the goal was to undermine the electoral college process by replacing the legitimate biden electors with those bogus ones from states that trump lost. if the plan had succeeded, it would have given the vice president mike pence a pretense to throw out biden's win on january the 6th, something the president was calling on his vice president to do. none of this was a secret. none of it was a secret by any means. a lot of it was happening in plain sight but it's the details that we're now getting on the coordination from giuliani and the trump campaign that i have to say are quite remarkable and alarming. those efforts are on full display in new audio unearthed by rachel maddow. i want you to take a listen. this is a voice mail message left by a member of the trump campaign for a michigan state legislator trying to get them to go along with this scheme. >> tomorrow as you might be aware, mayor giuliani will be presenting experts and witnesses from michigan who will be able to show that the vote totals are fatally flawed and do not accurately represent the will of the voters as well as your constituents. you do have the power to reclaim your authority and send a slate of electors that will support president trump and vice president pence. there are state legislators across the country who are standing with the president to stop this voter fraud from happening under their watch. we want to know when there's a resolution in the house to appoint electors for trump if the president can count on you to join in support. >> so we're at this point where these almost weekly news dumps are occurring and it's becoming more and more clearer just how vulnerable american democracy is. in just a minute i'll speak to the michigan secretary of state jocelyn benson about all of this, the top election official in a state where so much of trump and his allies' efforts were focused in overturning 2020 but first joined by philip bump. this fake elector scheme that rudy giuliani was reportedly running for trump is now as we understand it being investigated by both the jr. 6th select committee and local officials at least in three states including michigan where attorney general dana nessel has been involved and she's now referring this to the justice department for even further investigation. beyond subverting our election from what you've seen is there a potential crime here? what could come out of an investigation into this? >> the main focus when i've heard these discussions and poking around in this myself, the main focus is looking at charges that focus on forgery, forging official documents. obviously what was happening here, what was being undertaken on december 14th is the alternate set of electors was trying to sort of interrupt the formal process articulated by law that the people who are duly designated electors from a state get together to cast their votes and they are carried alongside a formal document from the governor of each state and that package together is the thing that then gets transmitted to washington and count the on january 6th so i think the idea here is that there are going to be potential criminal charges focusing on forging an alternate slate that didn't represent the vote of people in those states, michigan, new mexico or wherever it happens to be and instead are moving forward with this, you know, this document that purports to be something that doesn't actually capture what the voters want. is it something prosecutable? i'll defer to the experts on that. that's not my area of expertise. >> fair enough. but what's interesting in this, philip, the plan involved using these electors that the campaign themselves had convened in order to give vice president a pretext -- vice president mike pence at the time a pretext for rejecting biden's victory on january 6th. we know he did not go along with it because of what we saw play out on that day but do we know any details, any thinking at all about where pence stood on this plan, because at the end of the day, this was all part of the plan laid out in that infamous eastman memo that was presented to pence. >> so, i had a conversation with the constitutional law expert in october of 2020, well before any of this was under way and he told me that this was the scenario that he was worried about, he was worried the electoral count act allowed for there to be competing slates of electors even they didn't carry the imprimatur of the governor responsible for that certificate i mentioned, he was worried that there was space for there to be alternate slates of electors submitted to congress and that they could potentially be claimed as -- this isn't john eastman in cahoots with donald trump but studies this stuff and said this is a vulnerability so i think what they were trying to do was simply, you know, they were -- it was like they had just gotten fresh spaghetti out of a spaghetti and dumping it in every bowl they could find and trying to figure out is this something that might actually get them some headway? was this the predicate for what pence was doing? look, i have little confidence that donald trump understood the nuances of the processes at stake. i think he was like pence, you got to do this thing. pence decided not to do it to his credit. i don't even think congress really went along with it. yes, there were objecting votes but the plan didn't come to much fruition but this was a point of pressure with whom i spoke were worried about. >> one reason why i said it exposed how vulnerable our democracy is. it was mike pence who saved the day and know how he's been behaving ever since. who is to say next time around you won't have someone willing to go along with a plan like this. the efforts to reform and address concerns, democrats have had a rough week, voting bills, they failed in the senate. there was a possible bipartisan compromise that would have thrown out or actually did throw out the attempt to reform the electoral count act which would have to some extent through its reforms prevented schemes like this from succeeding in future elections. is this a setback? have we done anything in the past year to make sure something like this cannot be repeated? >> we haven't and it's honestly quite baffling. i don't think, you know, everyone who looks at this, even the people who are in congress and who are sympathetic to donald trump to some extent recognize this is a flaw but also a lot of republicans who stood in opposition to this effort, republicans in both the house and senate who opposed donald trump's, you know, who supported the idea of actually convicting donald trump on impeachment charges after all of this went awry on january 6th. i think it's rather baffling that this arcane archaic piece of legislation written in the mid-1800s should stand even though we just saw where the limitations are. it's like driving your truck that a wall and you see that it almost crumbles. okay, we don't need to fix the wall because when we drove a truck into it didn't break. it's sort of baffling that congress doesn't come together and say, let's fix this really, really poorly worded legislation so that we don't have our elections stolen. >> yeah, completely agree with you on that front. let me switch gears really quickly, philip, and talk about this draft executive order that politico reported on this week. it cites two classified document, national security presidential memorandas 13 and 21 and according to politico the existence of the first one was already public but it's the second one that had never been reported on publicly before. what can you tell us about that? i mean, what does it say that this was included this this executive order, this possible attempt to get the military to seize voting machines and then have a special counsel declare to probe the 2020 elections? >> i think one thing to keep in mind when you mention the documents and process, part of what was happening with that order is they were trying to give a stamp of formality to what they were doing. they were trying to make it seem as though the government writ large had problems with what was happening and part of it by supporting the information into private documents, it can make it seem like something ominous is happening. what donald trump and what his team were trying to do, trying to convince the american people there actually was fire underneath all the smoke he had been whipping up. of course, there wasn't and honestly the thing that struck me about the executive order and that they wrote about on friday it leads with this idea there was something suspect in michigan which was debunked a million times substantially well before this thing was written and that really speaks to the quality of the document. >> and i'm glad you brought up michigan. we want to talk about that. philip bump, thanks. joining us is michigan secretary of state jocelyn benson. madam secretary, thank you so much for joining us. let me pick up on what philip was talking there. your reaction if i can ask about seeing an election mistake in michigan, one that you issued a statement on being used in a draft executive order that would have resulted had it been implemented in the military taking over of our election systems. >> thanks for having me. i think this is a critical conversation as we seek not just accountability for those that did try to block the results and overturn a presidential election but make sure it doesn't happen again. with antrim county and other issues in michigan underscores the fact that there was not and never had been evidence of widespread fraud or any wrongdoing with our elections. our election was safe, secure and an accurate reflection of the will of the people and the very fact that antrim county or other things that have been cited underscores how there is no real evidence of wrongdoing or fraud and all of it is being used or was being used to just suggest or provide an avenue to really not just overturn the results of the election but create confusion, chaos and illegitimacy over the entire process over our democracy and it was a very challenging time to overcome all of those challenges from the federal government in realtime and it also underscores how important it was to have good people in place from both sides of the aisle who refused the pressure whether it was the former vice president or whether it was lawmakers in the state of michigan or members of the state board of canvassers and did the right thing, upheld the results of the election. didn't buy -- didn't drink the kool-aid or buy the lies that they were being sold. instead did their job. >> speaking of drinking the kool-aid, let me play for you some audio obtained by cnn of michonne maddock speaking at a public event last week. listen to this. >> we fought to seat the electors, um, the trump campaign asked us to do that under a lot of scrutiny for that today. >> you see him saying the trump campaign asked them to do that. the michigan attorney general dana nessel said it was an open and shut case of forgery of a public record. do you agree with that assessment? >> yeah, these were -- first of all, the law is very clear on who the electors are and how they're selected by the states and so for a political party and -- to co-collude with a presidential candidate who was the president at the time to try to block that legal transfer of power, that legal verification of the votes, the electoral college and electorates is, you know, a flagrant violation of these legal requirements and determinations of who is an elector and the fact that these individuals both co-chair of the state republican party and candidates for the president and their followers lied to the federal government about who those electors were really is egregious, it's unprecedented. there needs to be consequences and also a signal of just how far folks were willing to go to try to nullify the voices and the votes of millions of american citizens in michigan and across the country. >> yes, so picking up on that when you see how far they were willing to go, you know, trump and his cronies threw out any and every theory they could come up with to not only delay the certification of the election but cause confusion among the american public and folks in michigan and ultimately undermine confidence in our election. when you see that polling today shows many republicans, i believe as many as 70% or 80% of republicans believe that joe biden is not the legitimate president of the united states or did not win legitimately, do you think that ultimately these efforts were at least partly successful and have we shored up our systems for it to not happen again in 2022 and 2024? >> those are exactly the right questions because you're right, the goal was not only to actually interfere with the actual election results but to cause this sense of illegitimacy over the ultimate and real victor, president biden. and so in that way there was success, there was a successful effort to dampen citizens' confidence in our democracy and in our government and that, of course, creates an air of illegitimacy to make it difficult to get anything done which is what we're seeing play out now. the second piece, all i know from this as a chief election officer in the state of michigan we should all look at this, this was an attempt made that was unsuccessful in actually overturning an election in 2020 solely because good people did the right thing and people of integrity followed the law. now a lot of those people have been replaced in michigan and around the country and there's efforts under way to replace even more of us and, you know, that's something that the american people really need to think about as we move into these next several election cycles how do we ensure the bar in place to protect the results if this happens again. >> yeah, i mean i think it's a blueprint. that is what scares me the most. partly why i said our democracy is so vulnerable. i don't think that's sunk in for a lot of people in this country, certainly influential people. michigan secretary of state jocelyn benson, thanks for joining us. greatly appreciate it. >> thanks, thanks for having me. coming up, commemorating the anniversary of the landmark supreme court decision roe versus wade, but could this one be the last one? that man was former president trump who made that point multiple times as he campaigned for the presidency in 2016. he was referring to hillary clinton's aides pleading the fifth when asked about a private email server when she was secretary of state. barbara mcquade, professor at michigan law school and msnbc legal analyst, barbara, great to see you as always. invoking the fifth more than 500 times, you would certainly know better than i do, is that striking? what do you think is behind that? why would the questioner even ask 500 questions as opposed to realizing after the first couple hundred this is not going anywhere, let me stop? >> well, all of us have an absolute right to invoke our fifth amendment rights against self-incrimination because we have this adversarial system where we don't have to be witnesses against ourself. important to invoke on a question-by-question to lock someone into their position so you can't simply say i will a take the fifth therefore i don't have to show up. you have to ask it on a question-by-question basis and the person needs to show they have a well-grounded fear of prosecution. judges and even people questioning others are usually pretty respectful and deferential in not pushing that too hard if someone invokes those rights in an effort to be respectful of their constitutional rights but it is important to lock them in. you can ask questions that do not call for information that could be incriminating. what's your job? what did you do during the following years? did you have responsibility for these documents? you can ask those but important to lock a person into a story as to what you can cover, that way it's difficult for them later to wiggle out of it because they've testified under oath but 500 times is a striking number. it does show some good persistence by those asking the questions but also shows the trumps are very concerned about being prosecuted for similar claims, claims of fraud. >> let me ask you about the information that has been coming out of this because it has been quite extraordinary. i mean, letitia james submitted it before midnight ahead of a court deadline. that explains the timing a bit but isn't it unusual for a prosecutor to release so much information while the investigation is still ongoing? i mean, how do you evaluate that? >> yeah, it really is, ayman, and, tish james has not done herself any favors by making public statements attacking the legitimacy of donald trump as president and talking about how she'll go after him. but in this instance the trumps really invited this kind of response. they filed a separate lawsuit to stop the entire investigation. they filed motions to quash these subpoenas saying this is all just a made up impeach. there's no evidence here and she said, really? let me show you some of my evidence and in a 115-page very detailed document she laid out exactly what her evidence is to date and she shows things like an inflation in the assets of a property from 200 million in 2013 to 400 million in 2014 one year later. she shows how trump's apartment in manhattan was represented as being 30,000 square feet when, in fact, it's only 10,000 square feet. these are objective eye-popping numbers that at least raise suspicion and they were done for the purpose of obtaining loans, insurance coverage and tax deductions and so if those were false or fraudulent that could be the basis for fraud. she is seeking -- exploring it from a sieve perspective. she does have the authority to bring a claim and seek damages which could be in the hundreds of millions of dollars so she's put her cards on the table and said you pushed me, donald trump, here you are. here's the public evidence and now it's in the public domain. >> and comes at the same time, you know, this new york civil investigation comes at the same time as the manhattan district attorney's investigation into criminal conduct. explain the differences between those for us. what are the similarities and differences between the two cases? does one pose greater risk for the trumps? is this a smart strategy, if you will, or should they be more focused and targeted and unified although they're from different jurisdictions? >> yeah, i think that they're working in parallel which is probably the best way to go. certainly all three of the trumps, four of the trumps who have been subpoenaed, eric, donald jr., ivanka and donald trump have invoked potentially will invoke their fifth amendment rights against self-incrimination because of that criminal prosecution that is ongoing in manhattan. but i think it's wise to go explore from both perspectives. there are some -- there are different tools but ultimately the criminal prosecution does bring potential prison terms so the stakes are highest there. >> all right, barbara mcquade, always a pleasure, thank you. >> thank you, ayman. today marks 49 years since the landmark roe versus wade decision but with a majority on the court will roe make it through 2022? ♪ ♪ ♪ sometimes you want to go ♪ ♪where everybody knows your name ♪ ♪ ♪and they're always glad you came ♪ 49 years ago today january 22nd, 1973 "the washington post" dubbed that day as, quote, the day that changed america. abroad you had henry kissinger flying to paris. back home in texas, former president lyndon b. johnson died at the age of 64. his legacy, of course, as everyone remembers was shaped by signing the civil rights act and the voting rights act that effectively expanded our nation's democracy and made it more inclusive of people to vote and in the nation's capital on that very same day, the supreme court issued its landmark ruling on abortion rights in roe versus wade protecting a woman's constitutional right to choose. now here we are on this day almost five decades later voting and abortion rights front and center of our national debate but this time the result in 2022 could be very different than it was in 1973. activists are sounding alarm bells that this year's 49th anniversary of roe versus wade could be its last. let that sink in for a moment. the supreme court is currently considering whether to uphold a mississippi law that would bar almost all abortion after 15 weeks. that decision which is still months away from being released could gut the long held precedent and change abortion access in america as we know it. because right now 26 states are standing by. they are ready, ready to enact laws restricting abortion the moment roe is overturned and there's good reason to think that it might be overturned. those laws would make the procedure illegal or next to impossible to access abortion for over 135 million americans. and under roe the average american had to travel 25 miles to reach the nearest abortion provider but without roe, that distance because of restrictions that states could impose is likely to increase to 125 miles. so how are abortion providers planning to adapt to a possible post-roe america? joining me is alexis mcgill johnson, president and ceo of planned parenthood. thank you so much for joining us. i greatly appreciate your time. this is obviously a major cause of concern not just for a woman but for the entire country and as activists have been warning this could be the last anniversary of roe as we know it. how is your organization preparing for what could become a very difficult time later this year? >> well, thank you, ayman, for having me here. look, we are exploring all options to continue providing abortion care to make sure that our patients get the care that they need when they need it, that means increasing investments in patient navigation, it means exploring all options around telemedicine, abortion and more states which were allowed at the end of this year when expanded access with the lifting of the restrictions around the -- means bolstering support around our affiliates to ensure that, you know, those who are able in states that are pushing the boundaries and expanding access and expanding provisions are allowing us to meet the need. i think with that center here, right, is the fact that we know the people most impacted by the court decision and currently by the bans that are being enacted across the country are the people who will be most marginalized grappling with, you know, low income who are marginalized because of their, you know, race, their gender identity, a number of things. those are the things that my organization and many others are most concerned about right now. >> so can you talk to us a little about that concern, i mean, to just elaborate on it. i know there was a doctor who practiced before roe said he saw firsthand how the effects of illegal abortion were particularly hard upon women of color and low income women noting the death rate due to illegal abortion was nine times higher among black women compared to women. you talked about that a little bit. how worried are you and your organization that history could repeat itself? >> oh, very worried and i think we're already seeing this now with what's happening in texas. we are over 130 days in texas with a six-week ban which is two weeks after someone has just missed their period and we know that the impact is largely going to be borne by people who are least able to absorb that impact. people who have means have always been able to access termination of pregnancy. they've been able to travel. they've been able to get on planes, able to afford the resources for a doctor, private doctor, what have you. those are the resources that are not going to be available to the people now who not only have to identify the resources for the procedure but also who have to think about how to travel as you said hundreds of miles, thousands of miles in some cases given the kind of ripple effect of what we've seen coming out of texas and potentially now in mississippi. people who have to think about caregiving, who is going to watch their kids while they take off from work. will their job be there when they come back? what is going to happen as they travel through the endemic that we are still living in. those are at the top of people's mind and things we are most caring about right now. >> as you very well know, alexis, there are those who are calling on congress to legislate abortion rights as opposed to letting the precedent be overturned by the supreme court. two advocacy groups are pulling support from kyrsten sinema because she's opposed to changing the filibuster and since the filibuster would also stand in the way of any federal action on protecting abortion rights, people are targeting their i guess frustration or disappointment at her and people like joe manchin for refusing to budge on reforming the filibuster. would planned parenthood consider following suit and pulling support for kyrsten sinema, senator kyrsten sinema? >> look, i want to be 100% clear that we cannot have access to abortion rights, we cannot fight and defend abortion rights without access to voting rights and are willing to do whatever we need to do by any means necessary to ensure that people have access to voting. i think we have to connect the dots here, right? are you at all worried that your opponent could use this ad as a weapon against you? >> the senator has already sent out an e-mail to his daughters with our campaign ad in it, so i'm not worried about what cannabis is going to do. people all over louisiana have been reaching out, and we're having amazing conversations. people are donating, and that's what we want to see. we want to see this conversation become a conversation that people have where it's not as controversial. and i can't speak for others having done it, all i can say i'm young and i believe this is right thing to do. people are going to talk about you. the question is are they going to talk about you because you're trying to move forward or talk about you because they're making fun of you in the u.s. senate. >> speaking of moving the needle forward i do have to ask you how do you avoid becoming like other high profile senate candidates who are able to garner national attention. as you mentioned you are garning national attention. how do you translate that but avoid becoming like a jamie harrison in south carolina. >> well, the numbers in south carolina and the numbers in louisiana are different. we have a democrat as as our governor, and it is possible. it's already been done here in louisiana. we can win. i ran in a congressional race last year. we spent very little money on tv and we came within 1,500 votes of making it into a congressional runoff because we had a powerful grassroots game in this community. what we believe is in a by air strategy, talk to people on-air, radio and all those things but bay ground also, getting out into the community and letting them know we're going to bring louisiana from the 50th rank straightforward. there's nowhere to go but up from here. >> gary chambers, thank you so much for joining us. greatly appreciate your time. senator mitch mcconnell is in hot water after his controversial comments this week. was it a froiden slip? >> well, the concern is misplaced because if you look at the statistics african-american voters are voting in just as high a percentage as americans. this is not a problem. >> i don't know if you heard that, so let me just rephrase that. african american voters are voting in just as high a percentage as americans? mitch, african american voters are american voters. it's one thing to say the quiet part out loud. it's another thing to scream it. now, mcconnell's staff was quick to do cleanup after that comment saying the minority leader meant to say african american voters vote in just as high as a percentage as all americans, but, look, this doesn't really matter if this was a slip or an unfortunate gaffe by mitch mcconnell because those remarks reflect the gop's genuine view of black voters. to many republican politicians people of color are not perceived as real americans with legitimate wants and concerns. .
