voting restrictions that -- are saying those ballots need to be rejected. half the ballots are being put away. in wisconsin, they are moving aggressively to restrict all sorts of voters. wisconsin can remove its drop boxes that people used to drop off the ballots for the election. the next election is less than a month from now. they are rushing to rip out the drop boxes and make it harder for people to vote. people found it very safe to vote that way, but as of the next election it must be stopped. today in washington d.c., conservative senator joe manchin appeared before reporters, wearing sort of a gym suit or tunic, they are charged by his appearance in this next clip, but he was wearing the sporty outfits and he told reporters, scornfully, that he and sinema are working with republicans to block federal voting rights restrictions that will not hinder people from voting in the next election. that won't happen because the government won't allow it. i know you don't know what that could possibly mean. i know you think i'm paraphrasing him to obscure what he meant. but basically, that's what i got, that's what he said. >> what would you say to voters who colin to say that your obstruction of -- >> there is no obstruction -- >> but a lot of people out there are not gonna be able to vote in the next election. >> the rules are there, and basically the government, the government will stand behind them in the right to vote. >> the government will stand in the way. the government will do that. see the exact phrase he used there! the laws there, the uses are there. the government will stand behind us, we have the right to vote. we have that. who is the government in this construction? senator joe manchin, actually has, in his personal hands whether the government will stand behind people to protect the right to vote. and right now, thanks to him, it is the governments in places like florida, wisconsin, this state government controlled by republicans, are in fact making it so people can't vote. or have their votes counted. or have their vote diluted to an extent, that their votes basically don't count. no matter how publicly and completely they and their -- further chosen representative. the existing federal voting rights act was gutted by republican judges. the restrictions on voting rights we are now seeing, like this one in texas, they cannot be blocked anymore by the federal government. this new law in texas, that is having the state required by law to throat half the ballots applications, it is law. it is new law they made in texas and it is in effect. it is not being blocked by anything. the government has radically rescinded voting rights there. and no one is coming to the rescue because of joe manchin. the federal government can only help if congress acts. if congress passes legislation to let the federal government establish federal mineral rights when it comes to the election. joe manchin, and kyrsten sinema who are working with republican senators to stop that from happening. senator manchin says, don't worry, the government will fix it somehow. as if it's not the government who is blocking people from voting. the republican state government who is blocking people from voting in the states. and as if he is not the government. as if he is not the reason the federal government can step in to fix this. the federal government could step in and fix this, it is those senators working with republicans who are stopping that from happening. in the state of georgia today, where republican leadership has also radically restricted the voting rights of residents, they have moved one of their own officials into per the shin so they can use the power that they have given themselves to -- have all republican officials oversee the ballot. they took the next major step to taking over full county georgia, and there are more ballots in that state than any of the other country -- they are kicking out the ballot counters, and taking over for themselves. why do you think they want to do that? but do not worry, felt senator joe manchin said surely the government would help. this is the government. this is the republican-led state government of georgia. moving radically to voting rights. we do not have standards to block this thing because of joe manchin and kyrsten sinema working with republican senators to get into the way, unless it's whatever republican senators wanted to be. scene after scene, scenes from a country that is trying to save itself. we are going to get to all of it tonight. it is farce at a lot of levels. look at all the -- senators sentient -- why they feel comfortable siding with republicans to prevent the government from doing anything on this issue. senator manchin and senator sinema are blocking votes. we're gonna look at the key moderates in a -- and wattles joe manchin and sinema, cannot seem to wrap them their heads around about what is happening with republican, the cold reality is shivering all over the news right now. in michigan today, dana -- answered reporters on -- asking attorney's office to bring a criminal investigation on 16 republicans who signed a forged a documents claiming to be the electors in the last election when they were not. she reiterated the argument that she said to the federal prosecutors, that she believes this would make a case, but speaking to reporters today she also clarified that if the government chooses not to pursue a path sick youshan, her office does absolutely believe that there is plenty of evidence to prosecute these people under michigan state law. >> at this point, do you think that there is enough evidence, if you wanted to, to bring charges against these electors under state law? >> absolutely. >> absolutely, okay. second question, have you interviewed or is any of these individuals cooperating with your investigation of what we have done so far? >> i cannot comment on the investigation on this point. i will say, again, we have quite enough evidence to charge if we decide to pursue that. yeah i want to hold out, but for all reasons of standard, i think it is a better idea for the defense to pursue this. technically, it is an ongoing investigation. even though we have given everything we have to the feds, so they have the information should they wish to pursue it, it is not as though we have the pre-determination that we are not going to charge. i just want to say what it is what they decide to do. these individuals to be prosecuted under state law, i'm saying that if one of the goals is to find out who orchestrated this, again, seemingly there is a conspiracy between multiple states, so if with the ultimate goal is to is not just to prosecute these individuals, but to find out who put them up to this? is this part of a conspiracy at play? in order to undermine the legitimate results of the 2020 national election, it is going to involve interviews in other states. it is going to involve possible prosecution. >> michigan attorney general dana, speaking with michigan today, making the case that part of the republican plot to overthrow the government and keep donald trump in power, is part of a coordinated effort to have republicans in multiple states forged document saying that they are the states electors when they were not, she believes that they can be dry urged under a level crime under michigan law and they should do so. but she thinks he should be pursued under -- again that was dana speaking with reporters today. and tonight, just before going on the air, we got news that another state is investigating this matter is a potential crime. the attorney general in michigan, as she was describing, the attorney general in wisconsin says that he too is referring the matter to the -- and now there is this, if the attorney stayed under the state of nevada. our office has received numerous inquiries regarding some members of the state gop attempting toward fake electoral votes. we cannot confirm or deny the existence of the investigation, but wrestle sure that this matter is on our radar, and we take seriously any efforts to rob nevada's of their votes. there is been a sustained effort to invalidate the 2020 election in to downplay the shocking events that happened after. my office cannot and will not accept any efforts to overturn a free and fair election. voting rights are fundamental to our democratic republic, we will protect them. again, to recap, michigan attorney general has referred them to federal prosecutors, and the same has happened in new mexico who has referred them to federal prosecutors as well. now in nevada, we have the statements -- they said rests a sure this matter is on our radar. i don't know with this means in legal terms, there you have it. in the january six investigation in congress, we are looking at this broadly, it is part of the plot, and five different states filled out these forged documents pertaining to the electors. and those documents were sent to congress. we know that the january six investigation is looking at it, that in fact in some way they were able to find out some reporting trails from the fall out, in order to figure out that these documents existed, they were part of a coordinated effort, and the january 6th investigation is looking at them. so we know january six is involved in some way. now the u.s. justice department has formally been asked to states to contend with it as well. do you remember like how after the election rudy giuliani held a couple of election conferences? there was the four seasons election -- just off phil -- why was it held there? certain to be the subject of political science dissertations to come. giuliani at that event, seem to be investigating election irregularities at that event, but the event was interrupted with all the networks calling the election for joe biden. that was not the only conference that he held that much. he held the smoking contents of that event, that what's that on his face presser? where he appeared to be, melting, before our eyes. i know that is what you remember about that event. none of us can forget it. but, what was that event for? other than to haunt our dreams. that event was to be a full dissertation by rudy giuliani and his legal team, about how the election had been stolen from trump. he told us that the hair dye press conference, that he had won by -- boats and that he could prove it. he would have the evidence soon, and we should get ready. evidence of all the corruption by the big city democrats, and he said he could knew, and he could smell them. it's another member, sydney powell, took and -- she said that the election had been stolen by communists and venezuela, and that -- trust us, it works out. another lawyer, jenna ellis, yelled at the media to cover allegations, while they were covering allegations. also, trump campaign advisor boris, who is on the right side of your screen, i'm pointing out all these folks because this evening, all four of them were subpoenaed by the january six investigation in congress. all four of them need to produce documents to the investigation by the first of next month. as ridiculous as they're quasi-legal efforts seem at the time, even now in retrospect, the january six investigation is subpoenaing them, not because of the joke -- these clownish folks were allegedly involved in the very worst of what is happening to the government. to keep trump in power. as with so many things related to the trump era republican party, it is a clam shell and a dangerous threat. giuliani, and the rest of these guys, technically were trump's legal team. they did bring lawsuits alleging malfeasance, an election kyle. sydney powell saying about the communist crime was sanctioned by one court, because the allegations that she brought to that court were so baseless and full of obvious lies. julianna thinks all he says matters. but the january six investigation is subpoenaing this group because directly in those -- the investigation is interested in giuliani and the legal team, because of the way that they facilitated the broader plot to overturn the election even after the courts. the investigation has revealed evidence that you have claims that the election was stolen. any claims that -- based on your allegations. remember, disrupting or delaying those certification of the results on january 6th, if nothing else so that they could buy time to overturn the election, either through the courts or, more likely, some other way. the letters for the investigation tonight, manchin giuliani's attempts to convince republican legislators that they should falsify the elections in their states. the legislators in swing states they said, should declare it in favor of trump. the investigation also claims to have witnessed hertz testimony of trump -- to direct the seizure of voting teams around the country. but it is unlawful to do so. according to public reporting, on january six in the days before it, this is a letter to mr. giuliani, you are in contact with then president trump and -- for delaying or overturning the results of the 2020 election. we know that mr. giuliani was on the phone with republican senators on january six, even after the mob had stormed the capitol, trying to get them to -- that night, even after the mob attacked the capitol, they still try to find a way to keep trump in power. the investigations letter to jenna ellis, wanted to explain how -- delay or accepts the electing votes from states that had submitted false slates of electors -- they never did succeed in getting republican state legislators in states that joe biden won, to have other slates of elections. but they did sign forged elector -- which would solve -- and they would be prosecuted in multiple states now as a crime. but it all appears to be a part of the same plan. the trump allies subpoenaed today were, according to the investigation, involved in every effort. rudy giuliani tried to get state legislators to falsify the ballots, jenna ellis tried to get them to overturn the results, and they also tried to get them to root voting ballots across the country, boris was at the willard hotel, the command center, talking with then-president trump about stopping the certification of the election that day. one way or the other, they were gonna make it happen. and so it is no surprise that the january six investigation wants to talk to them. once to compel them to talk by subpoena. meanwhile, like i said, today just seems like it's trying to save itself. there is new reporting tonight from cnn, and cnn has not confirmed this story, so i'm just gonna tell you what they report without vouching for it, but they reported that the january 6th investigation has also subpoenaed the phone records of donald trump's son eric trump, and don jr.'s fiancée, his other son wife for their phone records. they have issued a subpoena targeting a member of the trump family. the phone records obtained by the committee are part of a new round -- of these records to provide the committee with what that show incoming and outgoing calls, including the time and length of calls. it also shows tax messages. the newly-obtained records include the cell phone number used by acts eric trump. including fund raising efforts for the stop the steal effort. -- eric trump says in a statement to nbc news tonight, this partisan committee is welcome to review my phone records, i have nothing to hide. the january 6th investigation is the unnatural outgrowth that democrats had to force, to be the outgrowth that -- in an effort to overthrew the u.s. government. they said it was an out a natural outgrowth of that because republicans wanted to -- and the broader plot. we are now seeing the broader plot exposed by the january six investigation, and by public reporting, and the states in their own terms. where this resolves? is anybody's guess. part of it is in the united states senate, where manchin and sinema say they are going to continue to stand with republicans to block voting rights in the name of this lie of voting through odd which was part of overthrowing the election -- . not just for the people who entered the capitol -- but also in terms of whether the platters of the attack will be black brought to justice in the criminal justice system. it may also resolve instate courtrooms, as people who are part of this plot and up facing the music. like the false electors who signed on to these documents, purporting to be someone who was in the electoral college. where this will all resolve will all be in one place, and we may not know for a long time. what is driving this is the comprehensive, brave investigation of the january 6th attack that is being conducted by the members of congress in that path. joining us is jamie raskin, he is author of a great book, unthinkable, and i thank you for taking time on this busy night for being here. thank you. >> thank you rachel. >> so i have tried to sum up a number of different developments, it seems like a whirlwind, can you correct me? can you put in your own words the importance of these new subpoenas, they are complaining that the subpoenas are to lawyers, we have eric trump complaining that there is a partisan investigation, and he has nothing to hide, can you tell us about the importance from your perspective? >> well, lawyers, first of all, are not exempt from having to obey the law. neither our family members of presidents or former presidents, or royal families who have a privilege position, anyone's subject to the law and order to turn over papers in it. we're examining attack on the democracy itself and how to preventing it in the future. what's the subpoenas have in common, is these four individuals are responsible for the big lie. they were spreading it in courtrooms, they were spreading it in official and unofficial ways. our committee is not a criminal investigatory committee, it is an investigative committee for the american people to see what happened for us, and how we get set up in a city which and where we almost lost our democracy? behind the whole attack on the congress and on the peaceful transfer of power, we want to know the message of which this light was told, who is involved in it, and in what ways can we for the fire cells against these lies? -- you cannot lie in court. this is why, rudy giuliani's license has been suspended in new york, and in a panel, he had been telling falsies. he had been lying against the court. you cannot do that. lining up in places like courtrooms, we can for the fire cells against these lies. >> i want to ask you about something about cnn reporting tonight. i'm doing my reporting with you right now, which i apologize. but they reports a night that the committee has subpoenaed and got records for -- who is the -- they spoke at the rally before the attack on the capital. can you confirm it is true? >> no, i do not know. i'm not being coy. i do not know whether they have been served in the subpoena process. i will say, with these committees that you have missed, that anything is relevant on the -- anything relevant to the attack on the democracy is going to be pulled into this investigation. so, speaking for myself, i would have no problem sending such a subpoena if we have reason to believe that trump has rare evidence relevant to the inquiry. >> it does appear that the court order of tomorrow, the national archives is going to release four pages of white house records that trump has blocked to be released. should we know anything about the importance of those records? >> well we will not know for sure against -- until we need to go through them all for sure. what we are seeing is a basic precepts of democracy being vindicated. when someone goes into public office, what we do, is a part of public concern. people in the democracy can arm themselves in the information it gives. we cannot govern ourselves if the people who get into office keep everything a secret and put it away like it is public or private property. we are going to get all the information, and we are gonna be able to look and see what kinds of activities that the branches have been there. what is the involvement that they have in -- i've divided it into a riot, an insurrection, and a coup. we need to find out to wet exit the branch was involved on this attack on america. >> >> well, senate democrats are united in supporting this critically important voting rights and -- legislation. this is the fourth time this year that we have tried to have this debate. in the past three times, republicans have blocked the effort. they found a procedural way to find -- we will continue to make the case for these bills. i, as you know, and particularly concerned about the accelerated at temps at the state level to subvert our elections. to interfere with the fake count, and certification, for the elections. that was part of my evolution because what's's at state is important for our democracy. we will have this debate tomorrow, and if they continue to block us being able to vote by majority on this clarida cull legislation, we will then propose a relatively modest, and limited, change to our rules so that the republicans, all of who are trying to block this legislation or, will need to come to the senate floor and explain the reasoning to the american people. >> when you say a moderate, and limited change to our rules, could you give us a -- what that might be? do you know with the proposed change might? be >> the proposed change is -- there is always room for tweaks, and last minute adjustments, but we return to the talking filibuster. we would use the talking filibuster only for voting rights. this is saying that this is such a foundational issue for our country, free and fair elections, and it is important if a group of senators -- decide and then a final vote on the issue, they need to come to the senate floor, and they need to explain why. historically, the senate rules say that's every senator can speak twice, but when the speaking stops you can call the question and then you have a straightforward majority vote. there are details and permutations between the beginning of a debate and when the speaking stops, but what it that is what their proposal is intended to do. the critical legislation that affects the foundation of our democracy, the access to the ballots, and the impartial legislation of the process, they need to come to the floor of the united states senate and explain himself. that is what we are trying to do here. we're having the debate that we are supposed to encourage. but over the last several decorates it has the opposite effect. >> the democratic -- senator matt e. -- as you describe it, it could go on till tomorrow, mattis and minimal rules change, we can all hear this history happen. thank you for being here tonight, this is a high pressure time in the senate. >> well thank you so much. it is really important that all of us come together to protect our democracy. >> well, no argument here. thank you senator. there is more next, stay with us. senator. there is more next, stay wit us i may be close to retirement, but i'm as busy as ever. careful now. nice! you got it. and thanks to voya, i'm confident about my future. oh dad, the twins are now... ...vegan. i know, i got 'em some of those plant burgers. - nice! - yeah. voya provides guidance for the right investments and helps me be prepared for unexpected events. they make me feel like i've got it all under control.
