chesky live on the scene and chief investigative reporter jonathan dean. what is happening on the ground right now? >> reporter: very tense situation playing out as we speak. we are about a quarter mile from congregation beth israel's synagogue where this hostage situation is taking place. that's according to three senior law enforcement officials who say earlier this afternoon they were made aware that a man had entered the synagogue and took the rabbi and a potentially unknown number of others hostage and is asking for the release of a federal prisoner you mentioned. we have seen a large amount of law enforcement converge on the scene. we know the s.w.a.t. team is present near the synagogue, and we are outside of the perimeter that's about a quarter mile away. we do know that there is some sort of communication ongoing between that man inside the synagogue and officials, however we don't know exactly what's being said at this point in time. an incredibly disturbing audio recording, the services inside the synagogue that were being broadcast over facebook live were interrupted when the man walked inside the building and started making his demands before the live stream was eventually cut off. as it stands right now, we do anticipate some sort of update from colleyville police department within the hour. they are currently the lead agency on the scene. we do know the atf and fbi are also here. a very tense situation ongoing with this hostage situation playing out at this colleyville synagogue. >> in a little bit we'll be talking with a former hostage negotiator about how critical this period of time is. jonathan, our latest reporting on what led to this situation. >> our best information right now from numerous law enforcement sources is that the gunman went in and took hostages. we believe it's a rabbi and at least three others inside the synagogue. we believe this gunman went in there demanding the release of a convicted terrorist suspect that was convicted here in new york back in 2010. she has alleged ties to the mastermind of 9/11. when she was captured overseas, she had fired shots and injured some u.s. service members as she was taken into custody and being interrogated. she was sentenced to 86 years in prison. so it appears this hostage taker, this gunman who entered the synagogue in texas, is demanding her release, and he had said that he wants his sister released, and that led to some confusion as to whether this hostage taker is somehow related to the mit scientist that had lived for numerous years here inside the u.s. investigators are looking into it. we are now told that they do not believe that's the case, but the investigation very much ongoing. so, again, a demand for a terror-related suspect who is in prison in texas. that is the demand that's being made at this hour, for her release. and the standoff continues. we are hearing from some law enforcement sources that there's concern that one shot had been fired, but that it may have been accidental, and that they are continuing to try to communicate with the hostage taker inside that synagogue. one other important note, how did this all come about? apparently when the gunman entered the synagogue and took the rabbi hostage in dallas, he had that rabbi call another rabbi here in new york to say, this is what is happening, we are now being taken hostage, and this gunman is demanding the release of her. the rabbi here in new york called 911 and that got the police in texas and the fbi looking into this matter. and as of now, the nypd here in new york is deploying extra units to synagogues as a precaution, given the new york and texas connections to all of this t. but as of now there's no threat in new york. this incident, for now, appears isolated to that synagogue in texas. >> morgan chesky, jonathan dean, thank you so much. i want to bring in msnbc terrorist analyst malcolm unanimous and co-host of the sisters in law podcast, an msnbc contributor. malcolm, your thoughts as you watch this unfold? >> it's an unfortunate situation and what you have is a planned hostage taking. based on the information we're getting, which is rather sketchy, i actually heard the live stream. i've listened to the discussions that the gunman had with the s.w.a.t. hostage negotiator and he's laid down some pretty solid lines that are going to be tough for a good negotiator to work with, but we hope they can wear him down with no loss of life. he has stated that, you know, he intends to die at the end of this situation. why he is motivated to have sadeki released is unknown at this point and he seems to have some reason that he wants her released. she was a very well known factor in the counterterrorism world. she was a courier, suspected to be a courier for mohammed, the mastermind of 9/11, and, again, as jonathan just said, she was captured in afghanistan and during interrogation tried to kill u.s. service members with their own weapon. she was extradited and sentenced to 86 years in prison. now someone has a personal or political stake in this and they are going to make a point, you know, with the hostages. i hope this doesn't end up in loss of life, but we'll just have to see. the on-scene commander and negotiators are going to make that call. >> joyce, you have been working the phones, talking with those who prosecuted her case. what did you learn from them? >> she was apparently radicalized after 9/11, and as malcolm has said, when she was brought to the u.s. for trial, the acts she committed were sometime around 2008. she stands trial and is convicted in 2010. when she's sentenced, she receives the terrorism enhancement, which is how she ends up with this 86 year sentence. it's a sentence of life in prison. what we know is she's somehow motivated or somehow by her situation, the individual who is currently inside of the temple just north of dallas, is animated by a desire to have her released. of course that's not going to happen. but something we know about the fbi and atf hostage negotiators, they're very skilled in handling these situations. the first thing they'll do is establish a line of communication and then they'll begin to work on what can be done, hopefully convincing the person who is inside of the synagogue with hostages to release hostages over time and continue to talk to them so that there can be a peaceful resolution. >> malcolm, you said something that i want to dig into, which is the motivation for this could be personal or could be political. tell me what you mean by that, tell me how law enforcement is working to riddle out that answer, and tell me why a man demanding the release of an islamic extremist would target a synagogue. >> right now both factors are at play. it is clearly personal. the individual has committed his life to the situation where he's decided to take hostages, which is a completely fraught situation. at any time he could decide to exercise excessive power and control, as we called it in my terrorism hostage survival school that i taught at, where he could start injuring people or executing to demonstrate that he has the ultimate power at the time. when that happens, of course, a completely different dynamic is going to take place with the s.w.a.t. team. hostage negotiators, for the most part, can work only up to a certain limit. as i said, the on-scene commander will then make a decision. i know, having trained as a s.w.a.t. officer and as a scout sniper, that this process could be resolved in less than a second, but no one wants to go there. we really want to find out what is the motivation for this individual, can this individual be spoken to and talked down off the ledge, so to speak. and we really need to make sure that no one else is injured if they do have to go to direct action or sniper action to resolve the issue. what would be his ultimate motivation politically, this was a hot button case. i know from way back in 2010 in pakistan, she was a celeb. she was here in the united states, she studied as a neuro scientists and there were allegations that she was part of the black rendition program, but she did try to kill service members in a u.s. detention facility in a combat zone after being caught as a member of al qaeda. so is someone trying to hold up the honor of her nation state or the honor of her family, or the honor of her as a person who may have a personal or romantic involvement? all of these things are possible from prison, even though she's in a federal connection facility that's only 20 miles away from colleyville. so all of these things are going to come into play with regards to the negotiators, they're going to have the fbi and the fbi's counterterrorism resources and national resources, psychological profilers and people who have access, people who have actually been involved in the prosecution of this person. not just so that we can find out what the motivation for that hostage taker is. was she in communication with this individual? we've seen circumstances where people have actually carried out private vendettas due to romantic intentions. i don't know at all. nobody knows until this situation gets resolved. >> and we have a new press release from the colleyville police department at this time, no injuries have been reported. malcolm and joyce, you are staying with me. next, the new charges against nearly a dozen members of a far-right group and what it means for the january 6th investigation. plus, within minutes of being sworn in today, virginia's new republican governor signed executive orders targeting how race is taught in classrooms. author angie thomas, whose best-seller is being banned by schools across the country. and next hour, governor jones from new york on where dems go from here on voting rights. we continue to follow the hostage situation under way in texas. updates as we get them throughout the hour here on msnbc. n msnbc. ♪sure would help a lot ♪ ♪wouldn't you like to get away? >> this confirms that merrick garland meant what he said at his address on january 5th, when he indicated that he was willing to go after people at every level, whether they were at the events on the 6th or not, and the most important detail in this indictment, frankly, is the fact that it doesn't treat january 6th as a one-day event. this goes back to events that start contemporaneously with the election, it ends with events after the insurrection itself. it shows that doj is, in fact, looking at all of the events that occurred in the effort to block the confirmation of joe biden as the winner of the electoral vote. so i think this suggests that doj really will make good on garland's commitment to engage in a robust investigation of everyone who is involved. obviously the goal, one of the goals with an indictment like this is to flip some of these defendants, to see if there's an opportunity to have them cooperate against other people who were involved. and typically when you do that, you're working up the ladder, trying to reach people who are more culpable. >> the doj plans to organize into teams and were prepared and willing to use force and transport firearms into washington, d.c. i want to talk about the plan here as you understand it and describe for us, if you would, what might have happened had they been able to actually pull this off. >> a lot of operational planning with stewart rhodes and other people took place well before the election. in fact, he made a statement on his internal communications, a lot of which we saw, many counterterrorism analysts saw playing out in time in forums, but they had started training in october in the run-up to the election with many of these members coming together in the criminal conspiracy that was executed on the 5th and the 6th. by election day, he made it very clear that he intended to wage war, and actually used the word insurgency against the united states. on many platforms he did that and organized it. by december 12th, the first major protest in dc, he was coordinating with the proud boys and three percent malitia in order to get hundreds of people there. he put out a call to all of the oath keepers, most of whom are military, ex-military and police, and gave them instructions on where to bring body armor, helmets, riot gear, sticks, pepper spray, weapons, and then he coordinated this reaction force that was supposed to be in northern virginia, that was in the area of manassas at a hotel where they staged all of their weapons and were plan to go get into dc in seven minutes and land heavy firearms there once they had taken the capital. what's the difference between what we saw last year and what's happening in texas right now? the only difference is, the gunman in texas has his hostages. all throughout the day i warned that there could have been very specific capture and kill teams seated amongst those rioters, and it turns out there were, there were individuals coming to take hostages and kill. if it wasn't for officers like eugene goodman and personal security details that secured everyone, this could have ended very badly. >> joyce, one of the things i think about as i watch the info wars clip, it wasn't as though rhodes was doing all of this on the dl. he was announcing his attention on multiple broadcasts. he's a law school grad and understands some of the finer points of the law. could that complicate his defense of his own involvement? >> inevitably it's going to complicate his defense, and he voluntarily submitted to an fbi interview over theummer and he said i'm a yale educated lawyer. of course i never would have done anything illegal. he said he stayed away from the capitol and didn't enter himself on the 6th, as somehow that insulates him from criminal liability. the charges he faces are charges of a conspiracy, and that is a common sense crime. we all understand that it involves an agreement to achieve an illegal end, and here we have him on videotape showing that he's acknowledging that he's involved in the planning of those events. i think 20 years -- or i should say a statutory maximum of 20 years in prison, even though guideline sentences are lower, there's a lot of violence involved and he's a leader and a planner here. he'll be facing significant time. we'll have a lot of incentive to cooperate with prosecutors. >> malcolm, i have one more question for you. who is paying for all of this? when you look at all the gear that they had, when you think about who is actually at the center of power here, who is paying for all of that? >> well, a lot of these people pay for it themselves. you see them dressed up in body armor, what we call the tactical tuxedo, trying to outdo each other in a combat fashion show. this is what we call those posers. these are guys who are live action role play. but you have to understand, there were many groups that sent the oath keepers money. the oath keepers were collecting tens of thousands of dollars. they were getting donations everywhere. there are other groups out there like, you know, code of vets, another group affiliated with general michael flynn, who gave them $100,000 last year, the fake election lawyer sidney powell, she gave them $10,000. there are millionaires out there that give these groups money. they are now a -- the oath keepers i'm speaking of specifically, all of them are now tainted with the brush of criminal conspiracy to overthrow the government of the united states. so all of these guys who are outlying and meeting up at denny's in idaho and even parts of upstate new york, they are now going to have to understand their leadership, you know, took part in this and organized it. >> even being a poser has consequences. joyce and malcolm, thank you both so much. an update on our breaking news in colleyville, texas, the police department confirming that the hostage situation inside a local synagogue remains ongoing, but thankfully no injuries to report inside. nbc news reporting the hostage taker is holding one rabbi against his will. more updates as we get them. we're back after this quick break. we're back after this quick break. those who tried me felt more energy in just two weeks! >> yeah, look, i think the democrats are going to continue down the path of having a vote on this more expansive voting rights legislation. senate majority leader chuck schumer and other leading democrats want to get everyone on the record weighing in on this voting rights and drawing that clear contrast with a record to show where democrats and where republicans stand on this issue, but ultimately, as you just laid out clearly, there is no future path to getting this enacted into law. so it's going to be very clear that they're going to need to redirect or change course in the coming weeks when this ultimately fails to pass the senate, given the filibuster remains intact. >> judith, if we accept tyler's analysis, and feel free to tell me if you disagree, what then does that mean for groups like yours? what is the pivot? >> well, i think he's right that, unfortunately, you know, we're going to -- let's call the vote, see where people stand. because that's where they're going to stand in the history books. then we're going to keep calling for real strong legislation. i'm really hoping that dems don't cave and really start negotiating right away for a watered-down bill, because what we have seen is they continue to negotiate against themselves. the freedom to vote act actually was the compromise. that was what manchin said would be the bill that he could get republicans on, and he failed to get republican support. so, you know, stop negotiating away, you haven't heard from the other side. the bottom line is, alysia, you and i both know that republicans do not want any voting rights legislation. they are the people, they are the ones in state legislators across the country suppressing the vote of black and brown people and they are not going to be open to moving towards anything to change. so we're going to have to keep fighting in the courts, we have a trial in georgia and florida coming up, and we're going to keep fighting. but at the same time democrats need to understand, this is a do or die moment and we have to -- i think it is right to be in arizona calling for sinema to do something and it's not just black voters. brown voters, latinx voters are hit by voter suppression also. and so we've got to come together to push them. we need corporation to say weigh in. this is the moment. midterms are around the corner and we know that it's going to be harder for people to vote. >> a lot of people have tied voting rights to what happened on january 6th, to former president trump's big lie. none quite like former vice president pence, who referred to the filibuster as a power grab, saying, quote, their plan to end the filibuster to allow democrats to pass a bill, nationalizing our elections would offend the founders' intention that states conduct elections just as much as what some of our most ardent supporters would have had they do one year ago. >> the filibuster is a racist role. it was put in place to continue to control this country and the senate. that's number one. and they're tying it to that. but we know this, that we have to get a rule change, because the real power grab are republicans who are standing in the way of our democracy. that's the real power grab. >> let me ask you about that very point, tyler, which is there was a lot of attention paid this week to sinema, for understandable reasons, at the same time there are senate republicans who have not come to the table. is there any appetite on their part to be a part of this process? >> look, i think that is what's most frustrating to some of the democrats, heavily involved in voting rights, is that senator sinema has criticized the democrats for not working with republicans to try to get a deal done. but the republicans have shown no interest, the majority of them, in working on this issue, as it was just laid out. most of the more restrictive or almost all of the more restrictive voting laws we see are republican-led. so the republicans don't acknowledge for the most part that there is a crisis that the democrats outlined with regard to restricting the right to vote. so i think they are just coming at this issue from totally different perspectives, and so democrats are growing frustrated and have been frustrated over the lack of acknowledgment from, in particular senator sinema and senator manchin, with the reality that republicans are not willing to come to the table and negotiate over the more -- over this issue. as it was discussed, this bill that the democrats are considering is one that senator manchin led the process of trying to find common ground and agreement and saying that he had support. so i think that's where the democrats are growing frustrated, that republicans have shown no interest in addressing some of the fundamental parts of the voting rights legislation. there's some discussion of tweaking the electoral college act, which democrats say does not even get at the heart of the issue, and so that, to them, is a nonstarter, given what democrats say is a crisis of democracy. >> judith and tyler, thank you both. next hour we're going to go one-on-one with democratic congressman mondaire jones of new york. that is at the top of the hour right here on "american voices". an update on today's breaking news situation, playing out for hours at a synagogue outside of dallas. the hostage taker demanding the release of the woman currently serving an 86 year prison sentence for trying to murder americans in afghanistan. former hostage negotiator jim cavanaugh with how he sees this order playing out after this break. r playing out after this break. “let's get you on some antibiotics right away.” we could bring it right to your door. with 1 to 2 day delivery from your local cvs. or same day if you need it sooner. but aren't you glad you can also just swing by to pick it up, and get your questions answered? >> you've been a journalist too long. exactly. well, they're interviewing the female terrorist already, they've already interviewed her at the prison, i'm sure the fbi has been there and interviewed her or they're doing it now. she's unlikely to be of any help, but they'll be doing it. and to give you a peek of how this works, at the scene, as an on-scene commander, colleyville commander, lieutenant or commander, and it generally works like this, he works with a team of three other supervisors, a chief negotiator, chief tactical officer and a chief of intelligence. so those three wise men report to the commander. i used to like to sit them at a table right across, the chief negotiator, on-scene commander -- i'm sorry, the tactical supervisor and the chief of intelligence and you're getting information from all three. so the decisions are made not based on, well, we talked to him for a while and nothing happened, so now we have to, you know, do an emergency assault. that's not the way it works. it's the way it works in hollywood, but not really. so the professional team, which is there, reads the escalation and de-escalation of the situation inside and that's what they're doing on the phone with the subject, that's what they're doing from their eyes and ears from the tactical operators who are outside, that's what they're doing with the intelligence chief who is bringing in that information from the prison, from this actor's home, from his relatives, from his co-workers. all that intelligence is coming in so they can read the escalation, de-escalation of the situation and try to walk with him or ride with him in his frame of mind to reduce emotion so he can make more reasoned judgment, but see if they can take steps along the way, alysia, to bring him down off of this emotional place of suicide and this demand for release. so talking and longer talking is good. we've negotiated with people for days sometimes, hours, a lot of times it will go overnight. sometimes they're too short, but sometimes that's because people get antsy. you have to make the appropriate decisions. it can change in a minute, a second, really, if he decides to kill hostages. and he's going to know that the rabbi is a very valuable -- he's going to know the rabbi is a very valuable hostage. that's one point that hasn't been discussed, but he will know that. >> we're going to continue to track the story. thank you. our coverage continues after this quick break. this quick break e back to young. i think most adults will start realizing that they don't recall things as quickly as they used to or they don't remember things as vividly as they once did. i've been taking prevagen for about three years now. people say to me periodically, "man, you've got a memory like an elephant." it's really, really helped me tremendously. prevagen. healthier brain. better life. ww's all new personalpoints program is made just for you. you take an assessment, enter your goals, the foods you love and ww builds a plan just for you. i lost 26 pounds and i feel incredible. no two people are alike so no two plans are alike. with ww, i lost 30lbs. this new program changed my life. live the life you love. lose the weight you want. the all new ww personalpoints program. don't pay until spring! join today at ww.com hurry! offer ends january 17th! ♪ i see trees of green ♪ join today at ww.com ♪ red roses too ♪ ♪ i see them bloom for me and you ♪ (music) ♪ so i think to myself ♪ ♪ oh what a wonderful world ♪ what happens when you block heartburn with one prilosec otc in the morning? also, are you going to say that to the young people who see themselves in star's story, to the young activists who see themselves in her story? are you going to say to them to their face that this makes me uncomfortable? no, you're not. >> one of the public arguments made about "the hate u give" is there's inappropriate language in it. talk about why you felt that language was necessary in telling this story. >> well, i'm not botheredly the language. there are 89 instances of the f-word in the book, and i own that. but people the number wlosz their lives to police brutality, that number concerns me far more. our kids use words and language. but it's also funny to me because the same people who say, oh, i have a problem with the language of the hate you give, they are silent when it comes to these classics that young people have to read in class so often that use the n-word religiously. the n-word is spoken out loud often by teachers who are reading these texts and no one is thinking about the effect it has on the black kids at those moments. so if we're going to talk about language being uncomfortable, are we going to start pulling books like huck finn because the language makes young black people uncomfortable? nobody's having that discussion, so. >> angie, i think of you and the fact that you are this supernova and you absolutely exploded onto the scene with this book, and part of the message is not only kids don't read it, right? look away, don't learn that. it's also don't write anymore of this, right? silence that voice, it is not wanted, it is not rewarded. i have to imagine that for someone like you, this just ups the ante on staying committed to these voices. >> absolutely, 1000%. it fuels the fire in me more every time my book is banned in whatever city it's banned in, usually the sales quadruple there because it tells me that, again, young people, adults also are going to read what they're telling them not to read. but what it tells me is i made you uncomfortable. true change comes from discomfort. honestly, i'm on a list -- "the hate u give" has been on the top ten banned. i'm on there with a bunch of legends. at this point it's an honor to be banned because every single book that is on that list has changed perspectives, it has changed lives. and you can push back against that change all you want, but it's inevitable. >> author angie thompson, i'm a huge fan. i've wanted to have you on the show for some time. i'm so grateful for your time. at the top of the hour, the latest from colleyville, texas, where a man has taken a rabbi and others hostage inside a synagogue demanding the release of a woman charged with trying to murder americans in afghanistan. you're watching "american voices." afghanistan. you're watching "american you're watching "american voices."
