president biden makes a push for voting rights. despite ramping up messages to emphasize the need to get rid of the filibuster. president biden went to atlanta on tuesday to talk about voting rights. joe manchin and krysten sinema threw cold water on the plan. let's set side the filibuster for a moment. the american government was created by and for white men. everyone else had to fight for the right to vote. after they won the right, there was push back. recall the jim crow laws and poll taxes and literacy tests and intimidation and violence. it is nice to think that is all in the past. history is a continuum. the design whose aim is not to encourage every qualified voter to vote, but impede those of suspected by where they live and where they are from and how much they make or the color of their skin to vote for one party or another. republicans are trying to prevent democrats from voting, to gain or maintain power. last year, 19 states enacted voter restriction laws over widespread voter fraud that did not exist. the 2020 election has been litigated and reviewed and audits have been done. none turned up widespread voter fraud. none. the issue is becoming central to the entire gop legislative agenda nationwide. in so far there is a gop legislative agenda. the john lewis voting rights act and freedom to vote act address the issues that remain. i'll break them down in details during the show. recent developments under score the importance and need for the specific federal protections. just yesterday, the ohio supreme court tossed out the redistricting map. a judge in wisconsin ruled that absentee drop boxes are not allowed under state law. the 2020 elections proved that making voting easier benefits the country. according to the census bureau, there was a record high turnout in 2020. 67% of all citizens aged 18 and older reported voting. it's good. not enough. everybody should be voting. in addition to that, voters used alternative voting methods and there was a shift to voting early and voting by mail. which worked across the country. these two voting rights bills remain in legislative limbo in the senate. this man, the most powerful and influential man in the republican party continues to spread lies about the 2020 election results. just today, later today, donald trump is holding a rally in arizona where he and a cast of characters that would make a circus blush, including a man who sells foam pillows on tv, will continue to erode american democracy by giving his endorsement to election deniers running for public office and there are many of them. in fact, per nbc news, trump has endorsed 59 candidates who questioned the 2020 election results. that number. that 59 is republicans who voted against the electoral college and 10 who attended the rally in washington, d.c. they are running for governor, state senator, dog catcher, secretary of state. it's a problem. joining me now is the democratic congress member from south carolina. jim clyburn. he is a student of history and comes from the part of the country which the group of many americans allowed to vote was disallowed. good to see you, senator. you have been a leader in it. we're supposed to have a vote. it was supposed to be monday. now it is tuesday. what is the sense of how this is going? >> thank you very much for having me, velshi. it is not going good. many of us democrats are on the right side of history when it comes to the the key issue of voting. most of us are aware of the sordid history when it relates to voting. all you have to do no matter what continent you're on, i remember well apartheid came to an end in south africa. all of the things didn't matter. what they really wanted was to preserve the vote for the white minority. so, we know how important voting is to democracy. that is the foundation of every democracy. when you begin to erode the vote, you are really undercutting the foundation of which democracy sits. what we're faced with this coming week is whether or not we are going to continue this pursuit of perfection is what i like to call it. creating a more perfect union or give up on democracy and give in to autocracy and watch our children live that life. that's the big deal. now we have the bill. it seems to be doomed. there is a third bill. i like people to focus on the electoral college bill. i'm asking everybody to look at that bill and see whether or not you can take it out of the john lewis voting act and look at decriminalizing the state laws and put that into the electoral format and let's pass this bill and see what we can do about having an election this year that we can be proud of. >> you know, you say you hope these particular senators decide they will be on the right side of history. krysten sinema and joe manchin say they support these bills. sinema gave a speech on the senate floor and said breaking the filibuster would worsen the underlying disease of division in the country. you were with me the day that joe manchin wrote that op-ed. he doesn't want to be part of it. today, you have the same response to these folks. are you thinking about this the wrong way. >> absolutely. history ought to be our guide with these issues. the fact of the matter is the 15th amendment for the constitution was passed on a straight line party vote. the 15th amendment is what gives the former slaves and other blacks the right to vote. that was the straight line party vote. for you to argue that it has to be bipartisan or it is not credible, you are flying in the face of history. that is not what the facts are. i look at the same thing about krysten sinema's speech yesterday or the day before on the floor of the house. that was just not true. that's not what the facts are. the filibuster has been reformed time and time again. why don't they allow the filibuster to be in place when we were trying to preserve the credit of the united states of america? we have the filibuster in place when we tried to raise the debt limit. it was risky. get rid of the filibuster so it doesn't ruin the country. we set the record back in 1957. all it did was get a place in history. at that time, it was the vote that tried to break the filibuster. congress decided no. it's too conflicting. things have changed. this is a different country today when we were having these debates. now, they get a chance to filibuster. they changed it. back in 1957, you had to stand on the floor and carry your argument. it made it convenient for people to stop the constitutional right rather than continue as we did have with the filibuster. if you change it, make it convenient, we can change it to make it constitutional. >> congress member, you bring good history to us. thank you for joining us. congress member jim clyburn. here with me now is dr. barber. the chair of the poor people's campaign. the senior lecturer of the breach. you have put yourself and your organization and your body on the line in this particular fight. you have gone to protests at the offices of krysten sinema and of joe manchin. you stood with the people of those states and found yourself arrested in those cases. there is a chance this is coming to a head in the next few days. how are you feeling? >> this part is coming to a head. we don't operate on the political deadlines. our can't allow the politicians to set the deadline and say where we won and where we lost. yesterday, impacted people representing upwards of 50 million people and growing, we are committed to mobilizing the largest massive assembly of poor and low wealth and low wage workers of the nation called the mass poor people's assembly mall march on washington on june 18th, 2022. we know, velshi, let's back up. number one, a democracy is at stake. the democrats should not have waited until now to fight for voting rights. all three of these things should have been fought for at the same time. voting rights and infrastructure and investment in our lives and the infrastructure of roads, bridges and technology. there is something else going on here. this is not a black issue. if we keep framing that, we lose. the u.s. chamber of commerce opposes living wages and voting rights. they back sinema and manchin and the republicans. they do not bifurcate their money. they want to suppress wages. they are not bifurcating their money. we should not bifurcate our movement. it impacts our daily lives and the power to control the purse strings of the u.s. budget. we have to have that debate and it has to be pushed by the people with a multi-racial and multi-faith movement. not just back room deals and political deadlines. >> i want to explore this a little bit more. you wrote in "time magazine." voting rights is not a black issue. the voting suppression laws hurt all of us. if you want a perfect democracy, you have to believe in the universe of the franchise. the ideas these are happening to voters in some parts of the country where they are poor, low wealth, black, however it may be they are left out, affects every single one of us even if i never have a problem registering to vote. i'm a participant in an imperfect democracy until everyone who is qualified to vote can vote. >> what is hurting us, you have to make the connection with voting rights and progressive politics. if you are for living wages, you have to be for voting rights. if you are for family leave, you are for voting rights. if you are for climate change, you have to be for voting rights. the same forces that suppress the vote and they try to make us think about it is special interests and minorities groups and race is in there. i'm not saying it is not. the laws we looked at and they are trying to pass now and have passed, it will affect 55 million people who use processes in 2020 that won't be available in 2022. that is a fundamental attack and assault on the democracy. i'm just going to challenge them folks to say this business of black folks in the corner over here and other folks in the corner here and going in the back rooms. you have to go to the state and organize from the appalachian or delta. we must have a third reconstruction in the country. we must put a face on this to show how voter suppression is dangerous and detrimental to all progressive ideas. what is going on, velshi, is an attempt to shutdown progressive public policy and progressive voice in this country. we have to understand that and say that and make the connection and not organize it as it is a special interest. >> are you the guy who walks the walk, literally. marching and sitting and fighting for this. reverend dr. william barber. the chair of the poor people's campaign. thank you. we'll continue to talk about voting rights and saving american democracy at the top of the hour. i will be joined by two officials on the frontlines. michigan attorney general dana nessel and then pennsylvania attorney general josh shapiro. what congress needs to do at the federal level and what we need to do at the ground level. e need to do at the ground level. ♪ ♪ ♪ ♪ with a bit more thought we can all do our part to keep plastic out of the ocean. we hit the bike trails every weekend shinges doesn't care. i grow all my own vegetables shingles doesn't care. we've still got the best moves you've ever seen good for you, but shingles doesn't care. because 1 in 3 people will get shingles, you need protection. but, no matter how healthy you feel, your immune system declines as you age increasing your risk for getting shingles. so, what can protect you? shingrix protects. you can protect yourself from shingles with a vaccine proven to be over 90% effective. shingrix is a vaccine used to prevent shingles in adults 50 years and older. shingrix does not protect everyone and is not for those with severe allergic reactions to its ingredients or to a previous dose. an increased risk of guillain-barré syndrome was observed after getting shingrix. fainting can also happen. the most common side effects are pain, redness, and swelling at the injection site, muscle pain, tiredness, headache, shivering, fever, and upset stomach. ask your pharmacist or doctor about shingrix. shingles doesn't care. but you should. on january 6th, 2021, within the first hour of the assault on the united states capitol, the merriam-webster dictionary said the word sedition was the top search. and joe biden said the attack borders on sedition. not the first or last time sedition is used to describe the trumpers used to breach the capitol that day. now actual sedition charges have been filed. 11 members of the group the oath keepers have been charged with seditious conspiracy. these are the most serious charges yet relating to the day. they may prove the hardest. seditious conspiracy is if two or more persons in any state or territory or in any place subject to the jurisdiction of the united states conspire to overthrow, put down or destroy by force the government of the united states or to levy war against them or oppose by force the authority thereof or force by execution of any law. you notice the word use the force. the sedition laws in early america targeted anti-government speech, not violence. these charges relate to interfering with the operation of the government directly. interfere directly with the operation of the operation of the government. the success of the prosecution rests on proving the insurrection was to stop the certification of the election victory of joe biden. the oath keepers leader, stewart rhodes, conspired with others to disrupt the election certification. rhodes and others discussed tactical gear and stockpiles weapons. they placed armed rapid response teams on the edge of washington, d.c. one suggested a boat to ferry heavy weaponry across the potomac river. much of the indictment centers around stewart rhodes. rhodes started the oath keepers in 2009. he is a yale law graduate and staffer for former republican congress member ron paul. his estranged wife describes him as a gun happy false prophet. he says rhodes believes he is an historical figure. comparing him to dr. martin luther king jr. his ex adds he has been living in a cabin and using donations from the oath keepers for years. he sent messages to the group chat saying we are not getting through this without a civil war and a bloody battle and desperate fight. we will have a fight. that can't be avoided. despite the military attitude and arsenal of weapons, he apparently is not handy with a gun. his ex-wife telling nbc news, he's not a very good shot. rhodes wears an eye patch after dropping a loaded gun and shooting himself in the eye. unlike so many charged so far, rhodes did not enter the capitol building on january 6th. he stands accused of helping to orchestrate the violence. over the last year, rhodes has denied wrongdoing and entered a not guilty plea during arrangement on friday. for now, these are allegations. an important part of the democracy is we are trying to preserve is the presumption of innocence and fair trial. seditious conspiracy is a rare and difficult charge to prove beyond a reasonable doubt. it has been successful a handful of times in american history. there is one instance, in 1954, armed extremists burst into the capitol and headed for chambers. violence ensued. rioters were puerto rican nationalists and stormed the capitol and injured several lawmakers. one seditious conspiracy was about a long forgotten siege on the u.s. capitol. here we are an again. i'm not lawyer, prosecutors feel confident and the department of justice is serious about getting to the bottom of the insurance deartment incident. it may have cost us our cherished democracy. s our s our cherished democracy. dayquil severe is a max strength daytime, coughing, power through your day, medicine. new from vicks. ♪ well the sun is shining and the grass is green ♪ ♪ i'm way ahead of schedule with my trusty team ♪ ♪ there's heather on the hedges ♪ ♪ and kenny on the koi ♪ ♪ and your truck's been demolished by the peterson boy ♪ ♪ yes -- ♪ wait, what was that? [bacon sizzles] [bacon sizzles] ♪ [electronic music plays] ♪ [bacon sizzles] ♪ [electronic music plays] ♪ woo! subway® has so much new it didn't fit in our last ad. like the new artisan italian and hearty multigrain bread. it's the eat fresh refresh™ at subway®. it's so much new there's no time for serena! wait, what?! sorry, we don't even have time to say they were created by world class bakers! oh, guess we did! seriously?! my bad. before the break, we were discussing one of the most significant sets of charges to date handed down in relation to the capitol riot. the founder of the oath keepers, stewart rhodes, known as person one, now in custody. rhodes and others charged with seditious conspiracy as well as a handful of other crimes. he appeared before the federal judge yesterday in texas and will remain in custody until the next court appearance scheduled for this coming thursday. according to the indictment, two days after election day, rhodes urged followers to refuse to accept the election results and stated we are not getting through this without a civil war. too late for that. prepare your body, mind and spirit. the january 6th investigation is happening on multiple fronts. these charges come on the heels of new reporting of what appears to be a multistate coordinated effort to install fake electors for president trump. this was reported in five states that joe biden won. arizona, georgia, michigan, nevada and wisconsin. republicans appear to have filed fraudulent documents, falsely affirming that donald trump won despite that not being the case. sent the fake documents to the archives before the approval from congress. another failure in the system we didn't know about. these are the fakes. they use the same font and spacing and same wording. i want to talk about that. first, i'm joined by joyce vance. an msnbc contributor and the cohost of the sisters in law podcast. so much to speak to you about, my friend. i want to start with the seditious conspiracy charges. i tried to layout as a non lawyer what these are and why they are so difficult. i had you in the back of my mind the whole time saying prosecutors don't bring cases that they know they can't win. >> i think that's exactly right. that's one of the keys to understanding this indictment because doj requires before prosecutors bring charges that they believe they have sufficient evidence to convict at trial. that means they have evidence that will prove charges beyond a reasonable doubt and they believe that they can win on appeal and there aren't legal impediments to the conviction. this shows a measure of confidence from the doj that they can win these charges. >> these are the most serious charges that have been laid so far. give me some sense of how this fits in the continuum of everybody and everything needs to be held into account for january 6th. >> one of the keys to understanding this indictment is it doesn't look at january 6th as just one day. the conduct is the day after the election and continues to january 6th. we have a firm direction if the doj is looking at january 6th as a standalone day or is the course of conduct surrounding the big lie. the fact they are looking at the longer spectrum of conduct is good news for people involved in the day's events held responsible for all of the efforts to interfere with the election. not just the violence on january 6th. this is prosecutors continuing to move up the ladder of responsibility. they now hit a point with people involved in a definitive way and the violence on that day. the question is whether some of these individuals and other people who have been indicted will decide to cooperate with prosecutors and if they decide to cooperate, what information they may have to share. >> so let's talk about the information they may have to share because the defense they may be going for and maybe the most plausible for those charged with seditious conspiracy is this was not our plan. we were waiting for donald trump to signal us to doing something. that leads to an important question to lead the doj up the chain. >> that is exactly right. the heart of the conspiracy charge is this agreement among a group of people to achieve an illegal end. in this case, to interfere with the certifying of the 2020 vote. were they reading the tea leaves from what trump said and tweeted or was there a former agreement and who was involved? there are ecek echos here that important. when you have stewart rhodes, the head of the oath keepers, he said he went to talk to the head and he says i was a lawyer and wasn't present that day. you cannot charge me. we have roger stone who said the samething. he was around, but did not show up on january 6th. was that coincidence or was there a level of communication? [copy machine printing] ♪ ♪ who would've thought printing... could lead to growing trees. ♪ tensions escalated sharply with russia and ukraine and extension the united states. on friday morning, reuters reported that the ukrainian government was hit with a cyber attack. hackers shutdown government web sites and left an ominous message. all information about you has become public. be afraid and expect the worst. this is for your past, present and future. the kremlin denies iinvolvement. the united states says russia is creating a prtext for indication. more than 100,000 russian troops are gathered near the border of ukraine. nbc news is reporting that the biden administration is considering arming ukrainian insurgents in addition to providing arms to the ukrainian government. this is the situation the u.s. has been trying to avoid for months. this has continued to show the military might along the ukrainian border and it hasn't budged in the discussions with western nations. joining me now is the pentagon correspondent for the new york times. she is an msnbc analyst. helene. thank you for joining us. i want to talk about the false flag operation which the russians may simulate something that looks like an attack on them justifying their entry into ukraine. what is this all about and why is russia seemingly itching for a reason to invade ukraine? >> that's the million dollar question. why they are looking for a reason? we are still 50/50 out whether vladimir putin intends to go over the border or wants to make the fear of it so sharp in the west and particularly among nato allies that any chance of ukraine being brought more into the fold of the west is completely off the table. the fundamental problem as putin sees it as ever since the collapse of the soviet union, all of the nato have the military alliance at the border. he sees ukraine which is they want to join nato and move more to the ukrainian government that's now in power. he sees ukraine as the last stand for him. what he wants to do is make it as clear for the united states and europe as possible, but you can't allow ukraine into nato. that's a red line for him, and so then we get into the why pretend that there's some sort of attack. he's often done that before in crimea which he invaded in 2014. he pretended that the russians, the ethnic russians in crimea were under attack from pro-western forces and he's looking to do that and there's a belief that he's looking to do that now in ukraine because that gives him some sort of fig leaf to say we're going in there to protect pro-russian forces. it's what he would use and what he wants to give himself enough cover that he can mitigate some of the sanctions. he can get china to at the very least abstain and an excuse to sell most importantly to the russian people back at home because that's where he's walking a really fine line. the russians right now back putin, but the second you start seeing russian troops and body bags come back and it starts to get really bloody, he gets in trouble with his domestic audience at home. >> that's exactly what happened to russia in afghanistan. it was good while it was going good and suddenly it wasn't. there are 30 nato nations if russia dared attack the border or one of them. rules of nato is as if they were attacked themselves. it wants to be more western facing, but that is probably the greatest insult or the most political and military pressure that russia feels. it does not enjoy the fact that all of these countries that were not nato country now its actually western border. >> oh, he hates that. that's the biggest issue for him. russia was a completely different country in the 1990s when all of these countries joined nato than it is now with vladimir putin who sees nato as one of the biggest problem in his side and you can see his point up to a point. he does have the biggest military alliance in the world right at his doorstep and they're right there on his border. these countries decided democratically that they wanted to join nato, so it becomes a question of do you support the will of the ukrainian people to pursue democracy as they see fit or are you going to be vladimir putin who will sit there and say no, he believes inside that this is part of russia, that they're russian, and he doesn't want them going anywhere. the reality is nato doesn't really want the fight. they don't want ukraine joining nato because that would put the fight right on their doorstep and they would end up in a situation where they may end up infiltrate. >> good to see you. thank for the great explanation. we will need it and it will become important in the next few days. she's a reporter for "the new york times" and msnbc political analyst. how they're essential protectioning democracy. do you know what's in them? did you just turn us into subway® ads? yep! subways got so much new like the new turkey cali fresh, that they couldn't fit it in their ads. so, they bought space on your jerseys. go long italian b.m.t.® it's been a disappointing week for democrats who appear to have hit a wall. chuck schumer says he will hold votes on two key voting rights bills. the freedom to vote act and the john lewis voting rights advancement act on tuesday. republicans plan to block both bills and when the bills fail democrats plan to figure out a way to ditch the fill buster and force the proposals through with a simple majority. it's a strategy that also appears doomed because two senate democrats joe manchin and krifrtin sinema. i want to tell you exactly what's in them and what makes them different from each other and why you should care. the freedom to vote act is all about making voting an easier process for everyone by maintaining fairness and safety, not just for your actual votes, but also for the people working the elections. here's what passing the freedom to vote act would mean. election day becomes a federal holiday so folks don't have time to get time off to vote. like a student or military i.d. card, bank statement or a gun or hunting license. formerly incarcerated people who have served their time will be able to vote again. interfering with voter registration becomes a federal crime and anyone who harasses, threatens and intimidates election workers will face a stricter penalty. the bill also targets dark money and promotes transparency and campaign fund-raising. then there's the john lewis voting rights advancement act which is a version of the voting act of 1965. this one is all about making sure every american no matter your race, religion, economic class or political parity has equal access to voting. here's what this bill would ensure. it would adversely affect voters without giving them warning six months in advance. any states that have blatantly violated voting rights in the last several years would need approval before changing things like congressional district lines and voting i.d. requirements and voting locations and this is known as preclearance. it gives the attorney general the power to sue a state if they believe they are avoiding federal pre-clearance. they're long and complicated and it makes them easier to glaze over the details and the details affect each and every american. you may not live in a state directly affected by voting restriction. the moment an american loses their right to vote is the moment democracy begins to recede. these bills may be the answer to many problems, but they fall short on preventing sub version. we'll talk about that with two officials, dana nessel and josh shapiro. another hour of "velshi" begins now. ♪♪ ♪♪ good morning. it is 9:00 a.m. in the east. i'm ali velshi. we begin this mlk weekend on the brink of losing one of our key pillars on our democracy that reverend martin luther king jr. fought poor, the right for a free and fair vote. dr. king's daughter, bernice king posted a particularly po

president biden makes a push for voting rights. despite ramping up messages to emphasize the need to get rid of the filibuster. president biden went to atlanta on tuesday to talk about voting rights. joe manchin and krysten sinema threw cold water on the plan. let's set side the filibuster for a moment. the american government was created by and for white men. everyone else had to fight for the right to vote. after they won the right, there was push back. recall the jim crow laws and poll taxes and literacy tests and intimidation and violence. it is nice to think that is all in the past. history is a continuum. the design whose aim is not to encourage every qualified voter to vote, but impede those of suspected by where they live and where they are from and how much they make or the color of their skin to vote for one party or another. republicans are trying to prevent democrats from voting, to gain or maintain power. last year, 19 states enacted voter restriction laws over widespread voter fraud that did not exist. the 2020 election has been litigated and reviewed and audits have been done. none turned up widespread voter fraud. none. the issue is becoming central to the entire gop legislative agenda nationwide. in so far there is a gop legislative agenda. the john lewis voting rights act and freedom to vote act address the issues that remain. i'll break them down in details during the show. recent developments under score the importance and need for the specific federal protections. just yesterday, the ohio supreme court tossed out the redistricting map. a judge in wisconsin ruled that absentee drop boxes are not allowed under state law. the 2020 elections proved that making voting easier benefits the country. according to the census bureau, there was a record high turnout in 2020. 67% of all citizens aged 18 and older reported voting. it's good. not enough. everybody should be voting. in addition to that, voters used alternative voting methods and there was a shift to voting early and voting by mail. which worked across the country. these two voting rights bills remain in legislative limbo in the senate. this man, the most powerful and influential man in the republican party continues to spread lies about the 2020 election results. just today, later today, donald trump is holding a rally in arizona where he and a cast of characters that would make a circus blush, including a man who sells foam pillows on tv, will continue to erode american democracy by giving his endorsement to election deniers running for public office and there are many of them. in fact, per nbc news, trump has endorsed 59 candidates who questioned the 2020 election results. that number. that 59 is republicans who voted against the electoral college and 10 who attended the rally in washington, d.c. they are running for governor, state senator, dog catcher, secretary of state. it's a problem. joining me now is the democratic congress member from south carolina. jim clyburn. he is a student of history and comes from the part of the country which the group of many americans allowed to vote was disallowed. good to see you, senator. you have been a leader in it. we're supposed to have a vote. it was supposed to be monday. now it is tuesday. what is the sense of how this is going? >> thank you very much for having me, velshi. it is not going good. many of us democrats are on the right side of history when it comes to the the key issue of voting. most of us are aware of the sordid history when it relates to voting. all you have to do no matter what continent you're on, i remember well apartheid came to an end in south africa. all of the things didn't matter. what they really wanted was to preserve the vote for the white minority. so, we know how important voting is to democracy. that is the foundation of every democracy. when you begin to erode the vote, you are really undercutting the foundation of which democracy sits. what we're faced with this coming week is whether or not we are going to continue this pursuit of perfection is what i like to call it. creating a more perfect union or give up on democracy and give in to autocracy and watch our children live that life. that's the big deal. now we have the bill. it seems to be doomed. there is a third bill. i like people to focus on the electoral college bill. i'm asking everybody to look at that bill and see whether or not you can take it out of the john lewis voting act and look at decriminalizing the state laws and put that into the electoral format and let's pass this bill and see what we can do about having an election this year that we can be proud of. >> you know, you say you hope these particular senators decide they will be on the right side of history. krysten sinema and joe manchin say they support these bills. sinema gave a speech on the senate floor and said breaking the filibuster would worsen the underlying disease of division in the country. you were with me the day that joe manchin wrote that op-ed. he doesn't want to be part of it. today, you have the same response to these folks. are you thinking about this the wrong way. >> absolutely. history ought to be our guide with these issues. the fact of the matter is the 15th amendment for the constitution was passed on a straight line party vote. the 15th amendment is what gives the former slaves and other blacks the right to vote. that was the straight line party vote. for you to argue that it has to be bipartisan or it is not credible, you are flying in the face of history. that is not what the facts are. i look at the same thing about krysten sinema's speech yesterday or the day before on the floor of the house. that was just not true. that's not what the facts are. the filibuster has been reformed time and time again. why don't they allow the filibuster to be in place when we were trying to preserve the credit of the united states of america? we have the filibuster in place when we tried to raise the debt limit. it was risky. get rid of the filibuster so it doesn't ruin the country. we set the record back in 1957. all it did was get a place in history. at that time, it was the vote that tried to break the filibuster. congress decided no. it's too conflicting. things have changed. this is a different country today when we were having these debates. now, they get a chance to filibuster. they changed it. back in 1957, you had to stand on the floor and carry your argument. it made it convenient for people to stop the constitutional right rather than continue as we did have with the filibuster. if you change it, make it convenient, we can change it to make it constitutional. >> congress member, you bring good history to us. thank you for joining us. congress member jim clyburn. here with me now is dr. barber. the chair of the poor people's campaign. the senior lecturer of the breach. you have put yourself and your organization and your body on the line in this particular fight. you have gone to protests at the offices of krysten sinema and of joe manchin. you stood with the people of those states and found yourself arrested in those cases. there is a chance this is coming to a head in the next few days. how are you feeling? >> this part is coming to a head. we don't operate on the political deadlines. our can't allow the politicians to set the deadline and say where we won and where we lost. yesterday, impacted people representing upwards of 50 million people and growing, we are committed to mobilizing the largest massive assembly of poor and low wealth and low wage workers of the nation called the mass poor people's assembly mall march on washington on june 18th, 2022. we know, velshi, let's back up. number one, a democracy is at stake. the democrats should not have waited until now to fight for voting rights. all three of these things should have been fought for at the same time. voting rights and infrastructure and investment in our lives and the infrastructure of roads, bridges and technology. there is something else going on here. this is not a black issue. if we keep framing that, we lose. the u.s. chamber of commerce opposes living wages and voting rights. they back sinema and manchin and the republicans. they do not bifurcate their money. they want to suppress wages. they are not bifurcating their money. we should not bifurcate our movement. it impacts our daily lives and the power to control the purse strings of the u.s. budget. we have to have that debate and it has to be pushed by the people with a multi-racial and multi-faith movement. not just back room deals and political deadlines. >> i want to explore this a little bit more. you wrote in "time magazine." voting rights is not a black issue. the voting suppression laws hurt all of us. if you want a perfect democracy, you have to believe in the universe of the franchise. the ideas these are happening to voters in some parts of the country where they are poor, low wealth, black, however it may be they are left out, affects every single one of us even if i never have a problem registering to vote. i'm a participant in an imperfect democracy until everyone who is qualified to vote can vote. >> what is hurting us, you have to make the connection with voting rights and progressive politics. if you are for living wages, you have to be for voting rights. if you are for family leave, you are for voting rights. if you are for climate change, you have to be for voting rights. the same forces that suppress the vote and they try to make us think about it is special interests and minorities groups and race is in there. i'm not saying it is not. the laws we looked at and they are trying to pass now and have passed, it will affect 55 million people who use processes in 2020 that won't be available in 2022. that is a fundamental attack and assault on the democracy. i'm just going to challenge them folks to say this business of black folks in the corner over here and other folks in the corner here and going in the back rooms. you have to go to the state and organize from the appalachian or delta. we must have a third reconstruction in the country. we must put a face on this to show how voter suppression is dangerous and detrimental to all progressive ideas. what is going on, velshi, is an attempt to shutdown progressive public policy and progressive voice in this country. we have to understand that and say that and make the connection and not organize it as it is a special interest. >> are you the guy who walks the walk, literally. marching and sitting and fighting for this. reverend dr. william barber. the chair of the poor people's campaign. thank you. we'll continue to talk about voting rights and saving american democracy at the top of the hour. i will be joined by two officials on the frontlines. michigan attorney general dana nessel and then pennsylvania attorney general josh shapiro. what congress needs to do at the federal level and what we need to do at the ground level. e need to do at the ground level. ♪ ♪ ♪ ♪ with a bit more thought we can all do our part to keep plastic out of the ocean. we hit the bike trails every weekend shinges doesn't care. i grow all my own vegetables shingles doesn't care. we've still got the best moves you've ever seen good for you, but shingles doesn't care. because 1 in 3 people will get shingles, you need protection. but, no matter how healthy you feel, your immune system declines as you age increasing your risk for getting shingles. so, what can protect you? [bacon sizzles] [bacon sizzles] ♪ [electronic music plays] ♪ [bacon sizzles] ♪ [electronic music plays] ♪ woo! subway® has so much new it didn't fit in our last ad. like the new artisan italian and hearty multigrain bread. it's the eat fresh refresh™ at subway®. it's so much new there's no time for serena! wait, what?! sorry, we don't even have time to say they were created by world class bakers! oh, guess we did! seriously?! my bad. before the break, we were discussing one of the most significant sets of charges to date handed down in relation to the capitol riot. the founder of the oath keepers, stewart rhodes, known as person one, now in custody. rhodes and others charged with seditious conspiracy as well as a handful of other crimes. he appeared before the federal judge yesterday in texas and will remain in custody until the next court appearance scheduled for this coming thursday. according to the indictment, two days after election day, rhodes urged followers to refuse to accept the election results and stated we are not getting through this without a civil war. too late for that. prepare your body, mind and spirit. the january 6th investigation is happening on multiple fronts. these charges come on the heels of new reporting of what appears to be a multistate coordinated effort to install fake electors for president trump. this was reported in five states that joe biden won. arizona, georgia, michigan, nevada and wisconsin. republicans appear to have filed fraudulent documents, falsely affirming that donald trump won despite that not being the case. sent the fake documents to the archives before the approval from congress. another failure in the system we didn't know about. these are the fakes. they use the same font and spacing and same wording. i want to talk about that. first, i'm joined by joyce vance. an msnbc contributor and the cohost of the sisters in law podcast. so much to speak to you about, my friend. i want to start with the seditious conspiracy charges. i tried to layout as a non lawyer what these are and why they are so difficult. i had you in the back of my mind the whole time saying prosecutors don't bring cases that they know they can't win. >> i think that's exactly right. that's one of the keys to understanding this indictment because doj requires before prosecutors bring charges that they believe they have sufficient evidence to convict at trial. that means they have evidence that will prove charges beyond a reasonable doubt and they believe that they can win on appeal and there aren't legal impediments to the conviction. this shows a measure of confidence from the doj that they can win these charges. >> these are the most serious charges that have been laid so far. give me some sense of how this fits in the continuum of everybody and everything needs to be held into account for january 6th. >> one of the keys to understanding this indictment is it doesn't look at january 6th as just one day. the conduct is the day after the election and continues to january 6th. we have a firm direction if the doj is looking at january 6th as a standalone day or is the course of conduct surrounding the big lie. the fact they are looking at the longer spectrum of conduct is good news for people involved in the day's events held responsible for all of the efforts to interfere with the election. not just the violence on january 6th. this is prosecutors continuing to move up the ladder of responsibility. they now hit a point with people involved in a definitive way and the violence on that day. the question is whether some of these individuals and other people who have been indicted will decide to cooperate with prosecutors and if they decide to cooperate, what information they may have to share. >> so let's talk about the information they may have to share because the defense they may be going for and maybe the most plausible for those charged with seditious conspiracy is this was not our plan. we were waiting for donald trump to signal us to doing something. that leads to an important question to lead the doj up the chain. >> that is exactly right. the heart of the conspiracy charge is this agreement among a group of people to achieve an illegal end. in this case, to interfere with the certifying of the 2020 vote. were they reading the tea leaves from what trump said and tweeted or was there a former agreement and who was involved? there are ecek echos here that important. when you have stewart rhodes, the head of the oath keepers, he said he went to talk to the head and he says i was a lawyer and wasn't present that day. you cannot charge me. we have roger stone who said the samething. he was around, but did not show up on january 6th. was that coincidence or was there a level of communication? [copy machine printing] ♪ ♪ who would've thought printing... could lead to growing trees. ♪ tensions escalated sharply with russia and ukraine and extension the united states. on friday morning, reuters reported that the ukrainian government was hit with a cyber attack. hackers shutdown government web sites and left an ominous message. all information about you has become public. be afraid and expect the worst. this is for your past, present and future. the kremlin denies iinvolvement. the united states says russia is creating a prtext for indication. more than 100,000 russian troops are gathered near the border of ukraine. nbc news is reporting that the biden administration is considering arming ukrainian insurgents in addition to providing arms to the ukrainian government. this is the situation the u.s. has been trying to avoid for months. this has continued to show the military might along the ukrainian border and it hasn't budged in the discussions with western nations. joining me now is the pentagon correspondent for the new york times. she is an msnbc analyst. helene. thank you for joining us. i want to talk about the false flag operation which the russians may simulate something that looks like an attack on them justifying their entry into ukraine. what is this all about and why is russia seemingly itching for a reason to invade ukraine? >> that's the million dollar question. why they are looking for a reason? we are still 50/50 out whether vladimir putin intends to go over the border or wants to make the fear of it so sharp in the west and particularly among nato allies that any chance of ukraine being brought more into the fold of the west is completely off the table. the fundamental problem as putin sees it as ever since the collapse of the soviet union, all of the nato have the military alliance at the border. he sees ukraine which is they want to join nato and move more to the ukrainian government that's now in power. he sees ukraine as the last stand for him. what he wants to do is make it as clear for the united states and europe as possible, but you can't allow ukraine into nato. that's a red line for him, and so then we get into the why pretend that there's some sort of attack. he's often done that before in crimea which he invaded in 2014. he pretended that the russians, the ethnic russians in crimea were under attack from pro-western forces and he's looking to do that and there's a belief that he's looking to do that now in ukraine because that gives him some sort of fig leaf to say we're going in there to protect pro-russian forces. it's what he would use and what he wants to give himself enough cover that he can mitigate some of the sanctions. he can get china to at the very least abstain and an excuse to sell most importantly to the russian people back at home because that's where he's walking a really fine line. the russians right now back putin, but the second you start seeing russian troops and body bags come back and it starts to get really bloody, he gets in trouble with his domestic audience at home. >> that's exactly what happened to russia in afghanistan. it was good while it was going good and suddenly it wasn't. there are 30 nato nations if russia dared attack the border or one of them. rules of nato is as if they were attacked themselves. it wants to be more western facing, but that is probably the greatest insult or the most political and military pressure that russia feels. it does not enjoy the fact that all of these countries that were not nato country now its actually western border. >> oh, he hates that. that's the biggest issue for him. russia was a completely different country in the 1990s when all of these countries joined nato than it is now with vladimir putin who sees nato as one of the biggest problem in his side and you can see his point up to a point. he does have the biggest military alliance in the world right at his doorstep and they're right there on his border. these countries decided democratically that they wanted to join nato, so it becomes a question of do you support the will of the ukrainian people to pursue democracy as they see fit or are you going to be vladimir putin who will sit there and say no, he believes inside that this is part of russia, that they're russian, and he doesn't want them going anywhere. the reality is nato doesn't really want the fight. they don't want ukraine joining nato because that would put the fight right on their doorstep and they would end up in a situation where they may end up infiltrate. >> good to see you. thank for the great explanation. we will need it and it will become important in the next few days. she's a reporter for "the new york times" and msnbc political analyst. how they're essential protectioning democracy. do you know what's in them?
