a crashed plane seconds before it's hit by a train, boom. the question is, did you just see that? it is way too early for this. ♪♪ good morning and welcome to "way too early," the show that has georgia on its mind. congrats also to the bulldogs. i'm jonathan lemire on this tuesday, january 11th. we'll start with the news. in just hours president biden will deliver a major speech on voting rights in atlanta. biden is expected to publicly push for a senate filibuster change to pass voting rights. previously he had endorsed reinstating the talking filibuster. he's expected to go further today, this as senate majority leader chuck schumer will force a vote on two federal voting rights bills this week. schumer says he will start a debate on changing the filibuster if republicans use it to block the bills. >> president biden will travel to georgia and make the moral case to the nation that the time has come to act to defend democracy and protect voting rights even if it means changing senate rules to restore the senate. if republicans refuse to join us in a bipartisan spirit, if they continue to hijack the rules of the senate to turn this chamber into a deep freezer, we're going to consider the appropriate steps necessary to restore the senate so we can pass these proposals and send them to the president's desk. >> the excuses put forward for this behavior are entirely fake. the supposed justifications are simply false. the senate democratic leaders are trying to use a big lie to bully and berate their own members into breaking their word, breaking the rules, and breaking the senate. leading democrats say they want to break the senate because of an anti-senator plot that's sweeping america. of course, this is totally fake. it does not exist. >> joining us now, white house reporter for "the washington post," tyler pager, a friend of the show to be sure. tyler, let's set this up for a second though. the president and the vice president kamala harris are expected to speak today. there are going to be voting rights groups there. stacey abrams seemed to be the widely accepted favorite. she's also not going to be there as part of a sort of seemingly she says scheduling conflict. some voting rights groups say, hey, we want to see more action from president biden rather than words. he's given some fire are speeches, but he's not been able to do much else. what do you expect to see as they way in on this growing democratic party? >> it's great to be with you this morning. i think the activists are likely to be disappointed again from president biden. i think we'll seem of that fiery rhetoric, white house officials previewing that saying it will be a continuation of the speech he gave on january 6th where he's expected to give a full-throated speech. but the key problem here is that there just aren't the votes in the senate at this point to either pass voting rights legislation in a bipartisan matter or enough democrats to endorse carving out or changing the filibuster in any manner to push through voting rights legislation with democrat-only votes. and so i think that's the big conundrum that president biden and vice president harris have. today when they head to georgia, it's figuring out what the path forward looks like. he said he would support changes to allow democrats to pass voting rights legislation with just 50 of them, but they don't have the votes from joe manchin or kyrsten sinema to do that. so i think the big question is how did this speech plot out a path forward to make some sort of change? right now all we've heard is soaring rhetoric and searing criticism of the other side, but i think the activists are looking for a path forward that will result in substantial change in voting. >> let's be clear here. the republicans have not offered any support. murkowski from alaska said she might, but that's it. there are nowhere near enough to get things done. let's focus on what can happen in the senate and what senator schumer hopes to do. there are other democrats who work quietly who have expressed resistance or reluctance of tweaking the filibuster for fear of what republicans could do with it if they could regain control of the senate down the road. how you do see it happening on the other end of pennsylvania avenue this week? >> i think that's an important point you make. they want to get the headlines to their opposition to changing the filibuster, but they're often taking the headlines from other colleagues who are more nervous to express their more conservative opinions about changing the filibuster. and so we've heard senate majority leader chuck schumer is going to push forward with trying to pass legislation to change the filibuster, and that is headed for failure. so i think what the big question is and what i think a lot of people are looking for from president biden today is what is he going to do to try to change this dynamic. how is he going to break the stalemate on capitol hill where any sort of voting rights legislation lives or dies, and they need the entire democratic block to get together, to change the filibuster in any way, shape, or form, or they need to start making compromises with republican senators. as you said, senator murkowski of alaska has expressed some opening to work with democrats, but that's not going to be nearly enough. she's not going to change the filibuster, and they would need ten republicans to go along with them. this comes on top of already failures on the build back better legislative agenda. this is potentially more difficult to push through congress, and it remains to be seen what president biden is going to door how he's going to use the bully pulpit, but also the power of the presidency to make progress on this issue. >> the president is certainly a longtime senator himself. his audience today, his former senate colleagues in any way. "washington post's" tyler pager. we appreciate you being here today. turning now to the coronavirus pandemic, the number of americans hospitalized with covid-19 has now surpassed anything we've previously seen. according to data from the u.s. department of public health and human services, as of sushld, there were more than 142,000 patients hospitalized with the virus nationwide, surpassing the peak reached on january 14th of last year. the surge in cases is causing a serious shortage of hospital staff. some hospitals are so desperate to keep nurses on the job, they're allowing them to work even if they have covid. >> we have hundreds of doctors and nurses now that have covid and are isolating because of that. there are many hospitals in the country that are simply on their knees, they are overwhelmed. >> california says doctors and nurses who test positive but are symptom-free can continue working without isolating. arizona and rhode island went a step further allowing health care employees with mild covid symptoms to take care of patients. other hospitals are keeping beds open because they don't have the staff to handle the patient load. health officials say that move is a last resort to ensure the proper care for current patients. health insurance companies will now be required to cover the cost of at-home covid tests. that will start this weekend. the biden administration announced the change yesterday. under the plan, private insurance companies would pick up the cost of eight over-the-counter covid tests per person each month. starting saturday, a family of four could get up to 32 free home covid tests per month. demand for tests remain high with many stores and pharmacies struggling to keep them in stock. the administration is sending out 500 million tests through the website starting this month. we've seen the cost of those tests skyrocket in recent days. school will be back in session for the third largest city in the nation. the teachers union and the board of education in chicago have agreed to end the teachers work action that saw school canceled for the last four school days. under the agreement, students will return to in-person learning starting tomorrow, this after teachers refused to teach over covid measures including lack of testing among students. >> on capitol hill, "the new york times" is reporting former vice president mike pence said with people familiar with his thinking is growing increasingly disillusioned with the voluntary idea of cooperating with the commission on the january 6th attack. he said they've taken a smart partisan turn by openly considering the potential for criminal referrals to the justice department about mr. trump and others. he is publicly annoyed that the committee is publicly signaling that it has secured a greater degree of cooperation from his top aides than it actually has. it could be a key to deciding whether to make a criminal referral of trump to the justice department. the "times" is reporting that today. committee chair bennie thompson told npr last week they'll formally request an interview with pence by the end of the month. who could have seen pence's reluctance coming. >> house minority leader kevin mccarthy is threatening to strip some of their committee assignments. in an interview with the outlet breitbart, he mentioned at least three democrats who would be removed from their roles. >> the democrats have created a new thing where they're picking and choosing who can be on a committee. never in history have you had the minority tell the majority who can be on the committee. if eric swalwell cannot get a security clearance in the private sector, there's no reason why he should be given one to be on intel or homeland security, so that will not -- he will not be serving there. ilhan omar should not be serving on foreign committees. >> what about any committee for omar? this is something that had partisan support years ago, decades ago. right now it does not. unfortunately it's become a bipartisan thing. you heard mitch mcconnell talking about it. you heard president biden saying if we cannot pass it, he'll consider other actions including rethinking the senate laws. >> so there's been going discontent among democrats who are saying that the president is offering too much rhetoric and not enough action. stacey abrams, she's skipping today. a bunch of civil rights groups have also said they won't attend. and others have said, hey, we want to see something real by martin luther king day, which is less than a week away, or you might not be able to count on our votes in the fall. what's your sense on these pressure tactics. >> i'm nodding my head because i completely understand. again, georgia is ground zero, the battleground. so many of these activists and leaders have overcome so many laws that suppressed their voting rights. i understand their frustration. we've been talking about voting rights for so long. we haven't seen any action. we need to see something in order for us to believe that we're going to do something about this. let's not get it twisted. we've been talking about this all over tv in addition to voting rights, what's happened on january 6th. that's because of the big lie, the voting that people are pushing against. activists are tired of overcoming voting rights tactics without pressure from the government to ensure that voting will be more -- excuse me -- that voting will be easier for people of color, for young people, for marginalized communities where these laws have been directly attacking. so i understand what they're doing. it's a pressure campaign. it's saying, hey, we need some concrete solutions. i'm hopeful that the senate will take up a vote on these bills so that we know where people stand and whether or not we should target the filibuster, which i'm sure we will have to. and these activists are saying if you want us to deliver again, particularly in the midterm, you havepresident's speech. vice president harris is also addressing the audience today in georgia and also on msnbc. >> alyssa johnson, we appreciate you being here today. come back soon. >> we ask all of you this question, why are you awake? >> brad writes from michigan, up way too early playing a little morning puck and also known as breakfast hockey. my boys and i broke out the hockey table yesterday. good way to start the day. emma writes this. she passed out right after 10:00 p.m. matt tweets this. having gallbladder surgery this morning and hoping my surgical team enjoys the gift of junior mints but only after the surgery. >> i don't want it. >> just take one. >> stop it. i will say i have been on a bit of a "seinfield" kick rewatching recently. it still holds up. >> up next, a look at the axios one big thing. a new vaccine from pfizer that targets omicron could be months away. we'll hear from dr. scott gottlieb, martin luther king iii will join us.
