district attorney's office in georgia, is important stuff to put it mildly. that means they are in there, making their arguments about why he should not be criminally charged. >> yes, there's nothing that we can read, there's nothing that we can extrapolate directly. we can't say, this definitely means the investigation is at this, pointer that this is going to happen in the investigation, or this is not. but to the extent that the president's lawyers, have a lot to deal with right now given nine pending civil suits against him for january six. plus all the legal stuff that's happening with this business, all this stuff, for them to be taking in-person meetings, with this prosecutor's office, in december which is when we know at least one of these meetings happened. that is news, and it means that this might be a more concrete worry to them than we had previously understood. >> we will have neil conte all join us in a moment, i'm going to hand him, that i'm going to hand him your breaking, news among other, things to tell us what does this mean, when criminal defense attorneys are meeting with district attorneys, who are investigating the criminal defense attorney's client. >> i wait with bated breath. i would love to hear what he has to say. thank you. >> that's where we have to shows rituals. that's why mine follows you. thanks lawrence. thank you rachel >> today was not a good day for the defendant donald trump, possibly criminal defendant, but definitely already a civil defendant. tonight, we have the breaking news that rachel just reported. the attorneys, criminal defense attorneys for donald trump, have now met in person with the fulton county district attorney's office, in georgia, which is conducting a criminal investigation of donald trump's possibly criminal interference in the georgia presidential election last year. they announced the investigation is focused on potential violations in georgia law prohibiting the solicitation of election fraud, the making of false statements to state and local government bodies, conspiracy, racketeering, violation of oath of office. and any involvement in violence or threats related to the elections administration. the associated press is reporting today, that district attorney willis, will be making a decision, in the case. in the first half of this year. in an interview with the associate press, the district attorney said, i certainly think that within the first half of the year, that decision will be made. also today, donald trump had a very bad day, in federal court. in a five hour hearing involving being the lawsuits that could bankrupt donald trump. five hour hearing involve three lawsuits, suing donald trump for his part in the attack on the capitol, on january 6th. one of the lawsuits, is filed by to capitol police officers, another is filed by congressman eric swalwell who will join us in a moment. nbc news reports the judge, who was appointed to the court by president obama, asked donald trump's lawyers, why do i do about the fact, that the president did not denounce the conduct immediately. and in fact, sent a tweet that arguably exacerbated things. what do i do about those facts. that he does not do anything for about two hours, to tell people to stand down. and leave the capitol. he continued. isn't that enough? to it least plausibly infer, that the president agreed with the conduct of the people, who were in the capitol that day? donald trump's lawyers were seeking to have the lawsuits dismissed, and insisted that donald trump said nothing to provoke the attack on the capitol. once the attack was underway, the judge asked donald trump's lawyers, once the attack was underway, wouldn't somebody who's a reasonable person say, that's not what i meant? the judge was wondering why donald trump never said that, to those people attacking the capitol. you're not doing what i wanted you to do. he never said that. donald trump's lawyers argued that anything said, as president, can never be the subject of a lawsuit. and as lawyers do, when they think one argument might fail, donald trump's lawyers awful the second argument which, is donald trump's comments were simply part of doing his job, as president. the judge raised the georgia case where donald trump called the secretary of state, asking him to change the vote count in georgia. he asked donald trump's, lawyers how is he carrying out the function of the presidency, by calling a state official, donald treasures argued that his job is to make sure that the laws are faithfully executed, not the state laws judge made it interrupted. donald trump's lawyers argue that there is no evidence of conspiracy as alleged in the lawsuits. nbc news reports donald trump's lawyer, saying a conspiracy has to be established before the rioters arrived, and there's no evidence that there was any communication before hand. the judge responded, the president invited people to the public to -- encourage them to march to the capitol. and take it by force, and people accepted that, so that's not enough to establish conspiracy? meeting off our discussion tonight, is democratic congressman eric swallow of congress -- served as a house impeachment manager in the second impeachment trial of donald trump. also with us near cut the l, an msnbc legal contributor. congressman swalwell, i normally go to the opposite, first but with your indulgence, i want to begin with neil to ask about his developments in georgia. . this >> lawrence i think i should get some cod credits for this. two >> okay you will. neil, i want to get your reaction to rachel's breaking news in the previous hour, about donald trump's criminal defense attorneys, meeting with the district attorney's office, in georgia. >> lawrence i have two reactions, the first is, it's good to see georgia doing what the united states justice department should have been doing for the last year, which is investigate what looks like a bunch of potential crimes by donald trump. maybe the u.s. justice department is, we still don't have any evidence of it. but that brings me to the second point which is, it's really good news, that georgia is investigating this. and it's very bad if you're donald trump, to have this. this is a very serious thing, to have your lawyers go in and meet with criminal investigators, that's not something that happens cavalierly. it certainly never happens in my lifetime, or laurence i suppose yours as well. and most of our viewers. it's not something line forsman does, without a really good reason. let's -- not you or me, but a former president of the united states. you will cross every t before you open up and bring those lawyers in for that inquiry. here it was really necessary. within 12 hours of the georgia news breaking last year, now over 365 days, ago i read a new york times piece calling for essentially, impeachment investigation, because it does look like criminal laws were broken. it's good to see georgia getting to the bottom of. this >> neil just a follow-up on, that donald trump's criminal defense lawyers and his company's criminal defense lawyers, had these kinds of meetings with the manhattan district attorney, before the manhattan district attorney issued indictments against the trump business and against allan weissenberg. >> correct. this is a natural precursor to a possible indictment. it doesn't mean donald trump will be indicted by any stretch, that is what they are trying to ask questions about. in a circumstance like, this if you're law enforcement, you don't just go in and indict. you asked for the people to come, in and try to explain themselves. it's really hard to explain themselves, when you have the guy on record, on tape recording say, hey find me 11,780 votes. >> congressman swalwell, we heard some of the trump defense is a civil defendant anyway, about that phone call to georgia, where he is asking for votes. the trump defense today in court, seemed to be, well, when he's president he can say anything he, wants and it is absolutely his right to say anything you wants. >> lawrence, donald trump is meeting the long but slow arm of the law. in court today, in a civil case, he met accountability that he's been a long time stranger, of as it's been reported, now the georgia district attorney is ramping up her investigation. and the judge today did allude to the fact that this may not have been just a one-off on january 6th. our position is, he didn't show up at a rally in spontaneous is a go to the capitol, but for weeks, he had been unhappy with the results on november three 2020, and had been plotting, and paying for social media campaign, to insights his voters. and aim at the capitol, and in the meantime, just days before that, he was hell-bent on having the shake down with secretary of state of georgia. this was not just a one-off. this was premeditated by the president. it's what he wanted. and hopefully now, it's way he's going to be held accountable for. >> one thing we've seen consistently, when team trump lawyers, whether it's giuliani team in the fall or now today the trump lawyers in this civil suit, when they end up in courts, in front of judges, all the gamestop. and congressman swalwell, we heard the judge today say the perfectly normal things that everyone else says, in the face of this evidence. like, when it someone who really wanted to stop the attack on the capital, immediately tell those people know that's not what i meant? when i said fight like, hell i didn't actually mean fight like hell like you're doing right now. it seems like the trump position, and the trump lawyers were smacking into that kind of granite wall of yet another judge, who just sees the plain facts in front of us. >> that's right lawrence. the judge, a number of times, put the screws to the trump, team frankly he put the screws to our team, what we are alleging is something that's already been alleged, that a president used their social media platform, to incite a violent mob. this is a case in many ways a first impression, but you saw every time the trump lawyers tried to make this a partisan argument, the judge also shut him, down and said i don't want to go into partisan politics, i don't care with the political parties of your clients. this is about whether he did or did not do what is alleged. your viewers are frustrated. i see them on twitter. they are getting impatient for good reason. donald trump has not yet met accountability, but we are now starting to see, this, i call it an upcoming crescendo of all of these civil and criminal investigations, and i cannot help but think that he is going to meet accountability, and that's a good thing, that means the rule of law and law in order will prevail over chaos. >> neil, what was your reaction when the trump lawyers ran into reality, in that courtroom today? >> in some ways, my jaw dropped. it shouldn't at this, point nothing should shock me from a trump lawyer. but it still does, lawrence. congressman swalwell is doing a great service to the american people by bringing this lawsuit. he's essentially saying is that the ku klux klan act, which is over 100 years old, was violated when trump fermented this violence. in his argument by his lawyers in court, today was not as much oh why donald trump didn't do it, it was much more, he's immune because he was carrying out his official duties. give me a break. finally any field, anywhere, where it's citing that an attack against your colleagues, should count is a normal day on the job. it is true, that for certain things, presidents have immunity, but context always matters, and the idea that you have a broad immunity, respects of context is basically what we rejected when we throughout the kings in the 1700s. the judge today asked the trump, lawyer he said, is there anything a presidential candidate can do as a candidate, that's not entitled to immunity? to -- >> i've been clear, i have nothing to hide. >> yesterday, congressman jim jordan re-wrote the i have nothing to hide line from i have nothing to hide, to i have no relevant information that would assist the select committee. that is what jim jordan said to a letter to the select committee investigating the january 6th attack to the capital. he refused the committee's request to cooperate with the investigation. congressman jim jordan is of course, again, not telling the truth about having relevant information for the committee's investigation. the committee is investigating everything donald trump did and did not do on january six. and everything donald trump did and did not say on january six. here is what happened to jim jordan when he was asked about that by house rules committee chairman, when jim jordan was not under oath. >> so when did you speak to the president on january six? was it before, during, or after the attack on the capitol? >> of yours i've talked to the president. i've been clear on that. i talked to him all the time. this is not about me mister chairman. i know you want to make it about me. of course i talk to the president. i talk to him that day. i've been clear about that. i don't recall the number of times. but it's not about me. i know you want to make it about that. >> joining us now is democratic congresswoman pramila jayapal of you served with jim jordan's on the house judiciary committee where you get an awful lot of exposure to his tactics and his approach. i am sure, like me, you are not surprised that jim jordan is refusing to cooperate with the committee. >> you know, lawrence, i was not surprised. except that i had heard that he was going to cooperate with the january six committee. and that this was somewhat of a backtrack. and you know, i think it was hard for me to believe that he was going to come in and voluntarily give this information. but i was hoping that perhaps i was wrong about him. and that maybe he was going to do that. it is not up to jim jordan to decide whether he has information that is relevant or not. he said that he had spoken to president trump on january six and in the days leading up to it. and that is absolutely within the relevance of what the committee is doing. and so, i think that this is a bad move on his part. not as a surprising one as you look at his whole record of being a supporter of donald trump. regardless of the fact that the president tried to incite a riot and tried to overturn the election. but it is unfortunate. and i think that it is unfortunate that i am hearing that it is possible that the vice president, pence, might also not testify before the committee. because we need everybody to get their information in order to get to the bottom of this. >> now, it is particular one somebody who is a declared front of donald trump and support of donald trump who publicly believes that donald trump has never done anything wrong, like jim jordan, that the person who had conversations with donald trump on january six, would not want to go to the committee and say to the committee under oath, here are all the good things donald trump said on january six. here is all the correct things. here's all the things the president said that are exactly what you would want in the president and for him to say on that day. maybe jim jordan doesn't have anything good to say to about donald trump to the committee if he's under oath. >> i think it's pretty clear he is hiding something. he said he doesn't have anything to hide. but he's hiding something. and you know what, jim jordan is not wrong how it is not about him. it is about our democracy, our constitution, the need to get to the bottom of a president who tried to overthrow an election. so, you know, i think he does have something to hide. it's clear that if he doesn't want to testify before the committee he is hiding something. that is my view. >> the president is going to georgia tomorrow. he is making a very strong pitch for voting rights. this now seems to be the number one agenda in the united states senate. >> well i think it is. and right next to it, i don't think that these are pitted against each other, it's build back better. but i think we've got to get voting rights through. leaders from or's commitment is to try to get it through before mcarthur looting kingdom. because it is directly tied to our civil rights history and to january six. january six was about overturning election. and that includes undermining the right to vote. there is 400 voter suppression bills that have been introduced in the last year. that is not a coincidence that all of those bills have been introduced. so, the president has said to me and has said to the senate and to the country that this is extremely important. and as somebody who served in the senate as a long time, as you, did he is also saying, look, i believe it's so important that we need to have a carve out to the filibuster. and we need to remember that voting rights was not often a bipartisan proposition. and right now in the country it is the case that we need to just have a simple majority to be able to restore voting rights to everybody. so, he is going to go out there, he's going to make that case out there. we are all pushing as hard as we can. all the way through martha luther king day and through the vote of the senate floor. and then of course we will turn our attention back to build back better and get that done shortly after that. >> congresswoman pramila jayapal. thank you attack, that then sends mitt romney into defense of senator rounds. and we are watching what seems to be a phenomenon that refuses to ends, this republican attack on republicans about who won the presidential election. >> the interesting thing, is my former colleagues, more than just mitt romney and mike rounds, if all the republics did what mike rounds did yesterday, if all of them spoke up, there would be a sea change in this country. because donald trump would then be faced with the reality, that the leaders of his party are no longer going to go along with this lie. what they are afraid of primaries, and i will just tell you lawrence, over the weekend, talk about suppressing, there was a poll taken in a congressional district in missouri, a republican primary voters. 64% of them were, and southwest missouri, said that donald trump had won the election. well and that is happening all over the country and red places. you have this complete disconnect with what donald trump has created, and was some republicans in the senate clearly know is going to get him in trouble in general elections. once you get past the primaries, that's what mitch mcconnell is laying awake worrying about >> what the endorsements, political endorsements, there is a value to that one. it varies depending on who the endorsement comes from. but donald trump, the values his own currency constantly. by constantly retracting endorsements he has issued himself. as we enter another election year, with donald trump offering endorsements to republicans, running in these primaries in general elections, the electorate gets to wonder, when is he going to call this guy a jerk? he's endorsing today? >> well, look at ted cruz, look at the names he called ted cruz. during the presidential election. when he accused his father of being an assassin, he said horrible things about his wife, when he said really derogatory horrible things about ted cruz, and ted cruz just crawls around on his belly trying to please donald trump. there really is on full display, those that have integrity and character in those that don't. in the republican party. it will be interesting to see how this turns out, i do think the democrats have to be very careful here, they have got to continue to remind voters, the problems donald trump caused. i really hope, they also realize that for us to win these midterms, they have to remind people, that we had more jobs created in the last year than ever in history in this country. was that the gdp is the highest it's been since 1984. they really have to begin selling the good news, that this administration has set of focusing on the fight within the party, as build back better is going to look like. >> we run johnson, republican senator of wisconsin is announced he's going to run for another term. that looks like a possible opportunity for democrats, joe biden won wisconsin, wisconsin's other senator is a democrat, they can go democratic in wisconsin. >> wisconsin, you have the same situation in pennsylvania, where, joe biden won pennsylvania as much as donald trump does not want to admit it. and you know ron johnson, i have to be careful here, because i really do try not to get down in the mud. but i have to tell, you this guy is such a political hack. he likes to pretend he's a manufacturer, a businessman. he promised the voters of wisconsin he would only do two terms, but he loves being a politician so much, she loves scratching donald trump's back so much. he's now going to say the voters of wisconsin, never mind when i told you, ahmed cynical politician, i'm going to do it i feel like for the power, now what i told you. when i initially ran two terms ago. >> he has to begin his campaign with okay, i'm breaking my word, that's the first thing i'm doing is breaking my word. and then go on from there. in a state that is highly competitive for democrats. >> highly competitive. but let's make sure we understand one thing, motivation is what controls, you know this lawrence as well as i, do motivation controls midterms. how motivated are we going to be. if our side of the equation votes like our democracy depends on, which i believe it does, we should be able to win wisconsin. on the other hand, if those most motivated are those pushing the big, lie in shining donald trump's shoes, that mitch mcconnell will run the senate. >> so how do you translate that motivation, into individual states and districts where you really need it more than other places? >> i think, one of the things that has to happen, is there needs to be thoughtful advocacy, where the races that really matter sometimes we get caught up for example, wanting to be mitch mcconnell. and money pours into a state, where it is not as likely that the democrats are going to win. i think we have to be very strategic about where we put volunteer resources, and money resources, and make sure we're putting those in races, in georgia where we have to hold on to two, seats it will be tough. in wisconsin, in pennsylvania, make sure that we are protected in nevada. make sure that colorado is okay. and then if there's a little >> well, things were humming along quite well i had been ten minutes into my speech. and then all of a sudden a monkey came on to the screen. i didn't think too much about it but as it went on, the young person started to say things about what the monkey look like. who unaddressed, and i'm sorry to be so forward, but it talked about how big the testicles were. and then began to laugh and scream. and so it took me off guard. and so i said to al womble that we need to get him off. and so with that, the young man actually said, no, don't block me i'll get off. and so he had gotten off. i continued with my speech. but as you know, it went on further pass that. >> and al womble, when did you realize was happening? and what could you do about it. >> this is just as representative phyllis thede said. i tried my hardest to remove that person from the zoom meeting. then we had more individuals come on. as i said before, it almost felt like playing whack-a-mole. the moment i smacked one down, another one came up. i tried to move as quickly as they kept coming up. >> and mr. al womble, how long did this go on? >> it went on for quite a few minutes. we were eventuality able to clear the screen of the unwanted participants. but i really have to give it to representative phyllis thede. she continued with strength and grace. she said i'm going to continue my presentation and make sure i give -- to the state about. so i appreciate everything she did that night. >> and representative phyllis thede, did you change what you are saying in any way to target any of your comments to the people who are trying to destroy this meeting? >> absolutely not. my focus was on the people that were on that zoom call. we stayed strong. we did a not waver on anything that i needed to talk about. and that is the way that you keep moving forward. whatever they did, that is what they did. but what i had to do was make sure that the people that were on that zoom call, they heard my message. we were talking about communication and how to talk with legislators, how to write rent just later's. whatever we need to do. but i never wavered from that because that is why we were on the call in the first place. so we were able to finish. and i thank god that al womble was able to help us get through that. and that was very important. so i'm very happy the way that it ended. >> and representative phyllis thede, did you have a chance to speak after the fact with other people who were involved? and what it felt like for them when this happened? >> absolutely. i got tons of calls and emails. people were upset. they were frustrated. they were angry they said i am so sorry that this happened to you. i even had a minister say, this is awful, this is not with this country is about. so we really just rallied together with other folks. and it felt really good. we know that there are people out there that will not tolerate things like this. and you know what, this is going to continue to happen until all of us take our voices out there and say, enough. enough is enough. we know that we aren't going to tolerate this anymore. we are done with this kind of rhetoric. and what we are going to do is to call you out on it. and once we do that, we are still going to move forward with our target. things that we need to do, and i feel good about that. nothing is going to stop me. i'll keep going. and as people want me to come and talk to, them i will do that as well. but nothing will stop us from telling the truth. >> representative phyllis thede and al womble, i am very sorry but this happened to you. and this is the region that you're joining us tonight. please come back, we want to hear more from you. thank you very much. >> thank you. >> thank you. >> and up next, a special last word tonight about sydney parties, and other greats that we lost this weekend. greats that weall right, let's go get something to it. we are done. >> okay. do we need kosher food? we all know which have been some by musical giants like frank sinatra, barbara streisand and many others. marilyn also found the time to write the theme song for a girls school in los angeles which laughter we will remember whenever we remember the way we were. it is not easy to think about the laughter when death comes rushing at us as it did this weekend. beginning with the crushing loss of people. i had no control over content. no creative leverage except to refuse to do a film, which i often did. i had to satisfy the action fans, the romantic fans, the intellectual fence. it was a terrific burden. i had the honor of meeting sidney poitier a few times i've group dinners. and i knew maryland bergman, but you didn't have to know these people to love them. and that love began with
