there is back and forth between them all today, are we likely to see members of donald trump's family, possibly donald trump himself forced to cooperate with the attorney general of new york state? >> i don't think we will see cooperation in the near term, i think what stands out here is that attorney general james is not only pursuing this simple question of fraud charges under new york's develop, but she is also participating with the manhattan da in a criminal investigation and of course the trump lawyers have argued that wearing two hats in a situation like this as somehow complicated her position and of course, anything that is revealed and a subpoena civil case can necessarily then be used and shared for a criminal investigation. that is of course is the worry. again, if they refused to testify in a civil situation, then the refusal of it later goes to trial and there is the jury can be used against them. the trump family is in a hard spot, but those letitia james with these two asked the civil investigation and criminal investigation that are being investigated in parallel. >> philip rucker the anniversary sixth of the attack on the capital, steve bannon is going to be hosting a special edition of his podcast called the war room. you will have two of trump's most zealous reporters their representative matt gates of florida, and marjorie taylor greene who has just been banned from social media. what do you expect to happen on january 6th from trump and his -- ? >> you know, ali, i expect that january 6th will be the most extensive expert by trump and his acolytes to whitewash history. to reimagine for millions of trump supporters what exactly happened on january 6th. to apply the patriots to the people who history will regard as insurrectionists rioting violently at the capitol -- i think we will hear from the former president himself donald trump who is preparing to hold a news conference on january 6th at mar-a-lago, his private club in florida. but there, will be a surround sound campaign including the bannon podcast as you just pointed out, including people who will be appearing all day long i imagine on fox news channel oan other pro trump right-wing media outlets to try and reframe how the american people view what happened on january 6th in a way that is more favorable to trump and his supporters. keep in mind, ali, that public polling opinion surveys continue to show that a majority of republican voters in america consider the election of 2022 have been rigged and stolen, and joe biden president by illegitimate president. i think we will hear those arguments, even though they are not true, even though there is no evidence to support them, i think we will hear arguments from trump and his supporters on the sixth. >> so, courtney, this is interesting because as philippe talked about this reframing, members of the committee and others, are actually talking about getting more seriously. you had the reference to the hundred and 87 minutes that donald trump within the white house, and liz cheney has talked about whether or not he may be responsible through action, or an action. let's listen to what claire mccaskill the former senator had to say earlier today about the committee. >> it is frightening when you really read the constitution and realize that their plan could have worked if the republicans have been in control of the house of representative. -- had the republicans been in charge of the house of representative. >> courtney, the january six committee has that it is going to get more aggressive you are going to be seeing more -- when you think happens now? >> yeah, i think a lot of what has taken place so far has happened behind closed doors and hearings to review their fine case and -- trump that day more details about preparations and financing for that attack and the attack campaign to overturn the 2020 election. i think it is important to know that as, philip, said earlier that this comes as trump supporters -- trump and his supporters continue to try and minimize what happened on january 6th. so as much as this committee investigation is about joe accountability, it is also a messaging battle. especially as we know from -- attacking the credibility of the committee and its findings. so this is a messaging battle to debunk the trump's false claims about the election and the idea that the narrative around january six is on going control of that narrative especially if republicans should take control of the house in november. >> melissa, you had heard on december 13th list cheney used a very specific series of legal terms, you and i talked about this before the new year, talking about trump's or action or inaction, deliberately, not being a lawyer i don't remember the exact term, but deliberately objected an official proceeding of congress. we now hear about this hundred 87 minutes, the idea that ivanka trump went in and asked him to intervene. this whole idea that donald trump knew what was going on and could have had an opportunity to do something about it, what does that amount to? is that culpability and responsibility something significant? >> well it really all depends, ali, on a mission or failure to act is not -- affirmative duty to act under the circumstances of course that is the question. some affirmative offer mission -- now she's talking about it in terms of duty and the perspective of beefing up federalists to include the election of duty as a crime going forward. but again it may be also a retrospective to look at the affirmative obligation an act to do so. >> phil rucker will increasingly be referencing and, if the house representatives -- in november, republicans have shown very little interest with very few exceptions and holding anyone to account what happened on january six, that could entirely go away, we could end up in a situation -- >> there will be criminals that will be held in terms of the investigation in congress it is widely assumed -- by both democrats and republicans on capitol hill that if and when republicans reclaim that majority, in january of 2023, presumptive house speaker kevin mccarthy would almost disband the commission or the finger, make it so that the inquiry slows down -- trump or people around him or for that matter fellow republican members of congress accountable for their actions in the run up to and including the day of january 6th. >> courtney, let's talk a little bit about the other matter of a lot of americans and that is these exploding covid numbers. we are going to talk a bit more about -- doctor nahid mightily about the significance of greater hospitalizations despite the fact that we have so many people getting covid right now. what is the white house thinking about right now about how to deal with covid? >> yeah, well, biden and harris are actually due to meet with the covid response team tomorrow, and he is expected to deliver remarks and an update on the administration's latest strategy which includes resources and personal hospitals, ramping up availability of tests and affordability. we know there was a lot of frustration over the holiday season in trying to find tests as people were trying to gather with their families. redoubling booster and vaccine efforts. this of course comes as cases are surging and one of every hundred americans have been reported as a positive covid case in the last week, which the biggest search we have seen in the pandemic and more than three times as many new cases than any previous wave and during the coronavirus pandemic. we should he expect to hear from the president tomorrow. updating how the administration is rolling out this new strategy and reminding americans to use the tools that we know work, which is boosters, vaccines, masking. >> phil rucker, let's talk about what we heard from chuck schumer today and -- dear colleague letter and. no later than january 6th martin luther king is trying to get a vote that deals with this filibuster that is stopping so much legislation from going on on the basis of it being about voting rights and democracy itself. he is hoping that -- two democratic senators come around, but he doesn't know that they're going to. yes, and the senators of course are joe manchin of west virginia and kristen serum llama of arizona who have expressed a great deal of hesitation about changing those filibuster rules in the past. but there is hope from schumer and other democratic leaders in the senate that they can sort of leverage this january six one year anniversary. the emotion around what happened at the capitol and that the very plain threat of american democracy that continues to this day. that they can leverage all of that to force manchin and sinema to come around on this filibuster and get behind the idea of pushing through this voting rights legislation which of course has been a cornerstone of the biden agenda for a year now. but it has fallen behind other issues like infrastructure and stimulus spending in terms of the biden priority. there is a feeling among democrats and especially among activists and some of the most important battleground states like georgia and texas that something has to be done immediately on voting rights or else to democracy could truly be threatened and i think schumer is trying to push that forward in the weeks ahead. >> any likelihood of any republican support on an effort like this? they spread the virus. and we fully anticipate on top of the surge that has already been ongoing that there is going to be another wave that is recurring as a result of these holidays. >> new cases soaring nation wide as we mentioned, the fda has approved pfizer's booster dose for children ages 12 to 15. the fda also shortened the wait time for everyone 12 years of age and older to get a booster shot from six months to five months after the initial series. new york times analysis shows that hospitalization have risen nationally 41% over the last two weeks. but as experts point out that hospitalization have not risen as fast as cases has. and that may be a more important [inaudible] >> when you have multi multi for more people getting infected, the messages that you're going to need a lot more people getting hospitalization. and that is the reason why we are concerned about stressing and straining the hospital system. as you get further on and the infections become less severe, it is less relevant to focus on the hospitalization as opposed to the total number of cases. back with us is dr. nahid bhadelia, an infectious disease physician and the public director of boston university center for emerging infectious diseases policy and research. nahid bhadelia, we need to now and to try to make sense of this because we are in the confusing stage of covid. lots of people are getting it. there is a sense that it's a severe. but the number is so great that the net result is that more people continue to be hospitalized. how do you square that with the people who are saying, this is not a big deal if i get it now? >> yes, ali i'm going to start by saying that for the individual if you are vaccinated and boosted the chances of you getting the severe disease is very low. that is why vaccination boosted has been sort of the school front of trying to get people on the other side of this pandemic. the way that i am seeing getting partly of this pandemic is to faces. the to face. the current surge that people, experts, and modeling experts are suggesting maybe 6 to 8 weeks here in the u.s.. seeing what we've seen in south africa in the uk about this highly transmissible variant. and that we could talk about what comes after this in the midst of the. but metrics are important. the reason this search is different is that this high number of cases, at least during this search mattered for two reasons. one is one what doctor fauci just said. we have this huge number of cases, and the virus find people who are unvaccinated and finds people who are vulnerable. and then you have increased number of bikes -- they are reaching the steam peak that they had last winter. despite the number that we've seen, there is so much more virus finding people who are unvaccinated and who are vulnerable. the other reason, the surge and the cases matter. for this short period of time, anytime that you have an infectious disease it affects millions of cases in a short period of time. and you have to people to take time off of work. which we are looking at is potentially the impact in our society continuing. we are seeing shortages of workers and health care at school, you might see that in essential services, water, food production, transportation. and we are not even at the peak. we are predicting millions of cases a day. millions, rather i should say has been predicted. and in that scenario, having everybody gets sick, but also other societal elements is why we don't want to shut down. we don't lockdowns. and we don't want to let it rip. what we want is to let all of us, including those who are vaccinated, to continue to have a model of precaution of using mask and taking tests. >> one of those complications i heard people having is that this is just the way we get to the immunity? we have people resisting to get vaccines. who are not getting. them people are getting boosted. and then we're getting a whole lot of people who are actually getting the virus. what do we know about the antibodies that you get, either from the vaccination or from getting omicron, for instance? how long are we protected for? and does actually contribute to us becoming part of me? >> yes. i think that this is a tough lesson. i think that this trial by fire, almost but we are going through, the hope is that, unfortunately, this big wave of cases that we are seeing is going to do one of two things. one is after this initial crisis there is a period after the surge that we are talking about that you might see, as you, said you sort of increasing the baseline level of immunity in the population now. now we don't know how long antibodies would last against covid. we are still learning about how exactly you had the boosters and after you had your initial infection would be a variant. but we do know that every time you have increased the baseline population immunity, at least the immunity against severe disease you can increase that at the population level. so the health care system, hopefully, the next time you have a variant that may not be as overwhelmed because you have created a lot more of the people who've had some sort of exposure to this virus that might keep them from getting critically ill. however, that is the whole. and hope is not a book public health policy as we have learned from this pandemic. so what we need to do is to make sure that everybody is vaccinated. everybody is boosted. and follow to see over the long term how this virus behaves in the potential of this new variant. >> from a personal risk perspective people are thinking that if i get this thing, it boost my antibodies and i'm fine. about 60% of the cases that we have in the united states, we not believe it or macron. which means 40% are still delta. which still can cause more serious illness. >> yes, and you can't know. a lot of the research lab and diagnostic labs can send all the sample. a percentage of the sample that are tested and diagnostic laboratories are set for sequencing. but not every sample sequenced. so if you are somebody just got sick, you don't know if you just got delta or omicron. and that actually has a critical importance. some of the monoclonal antibodies don't work against omicron. the way that they do against delta and vice versa. so if you are unvaccinated, for example, that matters. and not only, that you can't say that i might get omicron and be severe because you can't guarantee that you're going to get omicron and not delta. in hence, i think that the best strategy during the search, we could talk about efficacy, we can talk about biometrics later, but the best part during this acute setting is for all of us to continue to maintain and take advantage of those boosters. >> so one side is that people are going out of the way to say that maybe i could get this thing is going to be good for me, but the other thing is people are going out to get a fourth booster shot. that is not something that is not the right right now. good idea? bad idea? how do you look at that? >> i think that my heart goes out, and the story that you see of people seeking out additional boosters are those who are immunocompromised. this is a set of the population that you don't see an increase in and to bodies. and that is why initial boosters were actually added to people who were immunocompromised. it is an additional one that is off the rest in the future than that might be the part that we need to look at. but we just don't have the data, yet. in terms of whether that should be recommended or not. the best thing is that if you are immunocompromised, the best thing they could do today is make a plan with their doctor about how you will access what is right for you. is there another dose that you should be taking. if not, what other strategies, in terms of accessing for example or antivirals are prepositioning yourself in able to get -- what you can do to increase your chances of getting severely. that is what i would suggest patients to take. >> dr. nahid bhadelia, we're always grateful for you for your advice. dr. bhadelia, is a doctor for emerging infectious diseases and research. thank you for being with. thus the january six committee lays out what the investigation is so important for the future of our country as someone that our government still faces a threat from a movement that is openly contemptuous of democracy. when the 11th hour continues. continues when a truck hit my car, the insurance company wasn't fair. i didn't know what my case was worth. so i called the barnes firm. i was hit by a car and needed help. i called the barnes firm, that was the best call i could've made. i'm rich barnes. it's hard for people to know how much their accident case is worth. let our injury attorneys help you get the best result possible. we came critically close to ♪ the barnes firm injury attorneys ♪ ♪ call one eight hundred, eight million ♪ losing this democracy as we have come to know it. it is our duty as patriots and americans as -- to make sure we get it right. >> as we near the one year anniversary of the january 6th attack on the u.s. capitol, there is a very real sense that the remains a clear and president danger to our democracy. -- marking the new year with his dire warning, writing, quote, january 6th is not in the past, it is every day. the republic faces an existential threat from a movement that is openly contentious of democracy, and has shown that it is willing to use violence to achieve its ends. no self governing society can survive such a threat by denying that it exists. rather, survival depends on looking back and forward at the same time. and quote. back with us, jonah edwards -- now a washington post columnist. matthew dowd -- good evening to both of you. thank you for being here. donna, this is the issue that a lot of americans are confronting. there are a number of people who say look, this happened, it didn't succeed, let's move on. and others are saying, it is current, it is not a thing you can look past. >> well, and i think the numbers prove that, and the washington post university of maryland poll that was released just a couple weeks ago showed that in fact, fully a third of americans believe that violence is a response that is sometimes needed against government. 40% of those republicans and independents, so it is not something that is a theory, in fact, the numbers bear out. something like 62% of americans in another poll demonstrated that they believe that they expect violence against the next presidential election. this is extraordinary in the united states, and i think it is something that we have to view as a clear and present threat, i did not just something that happened to you or go. >> well matthew, what is the committee do about this? folks are pretty dug in, i don't know how many people there are in the middle of this conversation because it is quite binary. i do believe democracy is important and needs to be preserved by any political party in america, or you don't really think there is a -- threat to democracy in the first place. >> well, i see it is not binary but there is three groups of people in the country in my view right now. there is basically a third third a third. the third is find abandon america see they achieve the ends they want they want -- all men and women are created equal, that is a fundamental nature of this. then there is a third who are very concerned, like all of us, that we are losing our democracy as the new york times editorial said every single day. we are losing our own ability of self determination and -- all the ways that manifests itself public health of stations, ability to do anything on climate change we are losing that democracy and it doesn't allow us to do the things that we need to do to protect our society. the third part that i think the committee can affect is the third of the people who today are like where my going to pick up dinner, i have to drive ten miles to go get my son, whatever they are thinking about, they are not thinking about either one of those. that is the group that i think has the factual basis of all of this in what happened and the evidence comes out, and i hope to god there's public hearings can be moved to a bigger concern and under -- one thing we are all add to this is this is not new in our country, but what is new, is that one political party is now completely consumed by this. we had a third of the country that wanted to stay with the monarchy, we had a third of the country that succeeded from the union, wait a third of the country that was against women's right to vote. we had a third of the country that was against civil rights. we've always had an element, but we've never had one of the main political parties be completely taken over by that element. >> donna, how do you have that conversation with people, because, to those of us who study and talk about this every day, it seems like a stark choice, but there are a lot of americans, to matthew's point, that are going about their lives and concerned about the virus, the kids education, inflation, a whole lot of other things, not the slippage of democracy. >> well, i think matthew is right about that one third, i would urge that both the committee and terms of the way it's presenting the evidence about what happened on january 6th and all the rest of us to stay focused on now because the other third's in -- we are not going to move them so it doesn't seem very much of a point to try and speak to them but to speak to the part of the country that believes in the moxie wants to preserve our constitutional governance and i think that is the majority of us and we can't let it slip away the way that it is slipping away all around the world the united states cannot be a part of the all around the world is important that is a note to keep in mind because this is not just happening in the united states. we'll have our guests are staying a bit longer, coming up the next two weeks could be critical in terms of protecting the right to vote in this country. when the 11th hour continues. 11th hour continues i'm jonathan lawson here to tell you about life insurance through the colonial penn program. if you're age 50 to 85, and looking to buy life insurance on a fixed budget, remember the three ps. what are the three ps? why haven't we seen more, is there fear that getting involved in this could backfire? >> well, i think they made a calculation, and i have criticized them for this. i think they made a calculation that they would get things like infrastructure through, and all those things, and that was what was important. but what happened in the midst of all that is that we are slowly losing our democracy. so i think that is part of it. it made a priority that wasn't this because they -- thought if they did those things they -- look at them better. i think the other part is and i sort of see it as a five stages to understanding where the republican party really is, and i think the president and many of the democratic senators were in denial about who the republican party fundamentally became. who they are, and it wasn't really about donald trump. donald trump was the representative of where they were, but getting rid of donald trump would go back to some past normal case, and i think it has taken almost a year to move from denial to bargaining to sadness, to anger and they are finally understanding -- dealing with acceptance. but for too long they have tried to go back to a time that no longer exists, and treat the republican party like the party from ten, 20, 30 years ago. i think it took them a while especially joe biden grew up in a time of a different republican party, to finally come to that conclusion and i think it is late, it is not to play too late, it is late, to me is the most important issue. every other issue we want to deal with is contingent on whether or not voting rights and whether or not our democracy exists in this country. none of those issues can matter or be accomplished if we lose voting rights. >> so, jonah edwards, the -- whole lot of people who never thought about this until this current period. now they have to think about these things. claire mccaskill who is known as a moderate, sort of summed up the majority leader's sentiments and let's listen to how she put it. how can it be fair that republican legislatures all over the country are trying to suppress voters with the simple majority. but yet congress is not allowed to address those suppression efforts with the same simple majority. that is a pretty easy argument to make and frankly for everyone to understand. so hopefully, by putting pressure on joe and kyrsten, they do the right thing and we could get a carve out for the filibuster. >> all right, if only i could explain the supply change as well as she just explained what we are facing here with the filibuster. but how likely is that simple straightforward argument that she is making to succeed?
